"The Supreme Court on Thursday [June 13, 2024] unanimously preserved access to a medication that was used in nearly two-thirds of all abortions in the U.S. last year, in the court’s first abortion decision since conservative justices overturned Roe v. Wade two years ago.

The nine justices ruled that abortion opponents lacked the legal right to sue over the federal Food and Drug Administration’s approval of the medication, mifepristone, and the FDA’s subsequent actions to ease access to it. The case had threatened to restrict access to mifepristone across the country, including in states where abortion remains legal.

Abortion is banned at all stages of pregnancy in 14 states, and after about six weeks of pregnancy in three others, often before women realize they’re pregnant.

Justice Brett Kavanaugh, who was part of the majority to overturn Roe, wrote for the court on Thursday that “federal courts are the wrong forum for addressing the plaintiffs’ concerns about FDA’s actions.”

The opinion underscored the stakes of the 2024 election and the possibility that an FDA commissioner appointed by Republican Donald Trump, if he wins the White House, could consider tightening access to mifepristone, including prohibiting sending it through the mail...

Kavanaugh’s opinion managed to unite a court deeply divided over abortion and many other divisive social issues by employing a minimalist approach that focused solely on the technical legal issue of standing and reached no judgment about the FDA’s actions...

While praising the decision, President Joe Biden signaled Democrats will continue to campaign heavily on abortion ahead of the November elections. “It does not change the fact that the right for a woman to get the treatment she needs is imperiled if not impossible in many states,” Biden said in a statement...

About two-thirds of U.S. adults oppose banning the use of mifepristone, or medication abortion, nationwide, according to a KFF poll conducted in February. About one-third would support a nationwide ban...

Mifepristone blocks the hormone progesterone and primes the uterus to respond to the contraction-causing effect of a second drug, misoprostol. The two-drug regimen has been used to end a pregnancy through 10 weeks gestation...

Biden’s administration and drug manufacturers had warned that siding with abortion opponents in this case could [have] undermined the FDA’s drug approval process beyond the abortion context by inviting judges to second-guess the agency’s scientific judgments. Note: A massive relief and a genuine victory - this will preserve access to the medication used in 2/3rds of abortions last year, for at least another 2 years. (Probably minimum time it will take Republicans to get their next attempt before the Supreme Court.)

Still, with this, a sword that has been hanging over our heads for the last two years is gone. There will be a new one soon, but we just bought ourselves probably at least 2 years. The fight isn't over, but this is absolutely worth celebrating.

This is a very very unfinished thought but I've been thinking a lot as I reread the books about how the women of House of the Dragon don't really get catharsis and how that'll likely be worse in S2. Say what you want about asoiaf but a number of named women there experience catharsis.

They kill their abusers (Lysa, Cersei, Dany). They regain some agency after a violation (Lysa, Cersei, Lady Stoneheart, Dany), and they refuse to forgive the people complicit in their subjugation (Lysa, Cersei, Dany, Lady Stoneheart, Jeyne Westerling).

Obviously, three or four isn't enough in such an expansive cast of characters but the point remains that they claw back their autonomy however they have to. They're allowed to be angry, bitter, unforgiving and cruel to their abusers in a way women in House of the Dragon just aren't allowed. They're allowed grief, grief that is violent and destructive.

The women of House of the Dragon don't get angry. They stand around and stare plaintively at the camera, they cry prettily, and they plead for peace and non-violence. They suffer and suffer and suffer and there's no relief.

For pregnant women in abusive marriages, leaving their is spouse already a difficult decision. Their escape is made even harder in the four states that prevent them from getting a divorce.

Arkansas, Missouri, and Texas all have laws that mandate women seeking a divorce to disclose if they are pregnant, and prohibit judges from finalizing the divorce if they are. No such law exists in Arizona, but judges in practice still will not finalize the divorce of a pregnant woman, according to the American Pregnancy Association.

In Missouri, a law from 1973 requires couples to disclose “whether the wife is pregnant" while filing, and the two must finalize "any arrangements for the custody and support of the children." Justices count the gestating fetus as a child, and have therefore interpreted the law to mean until the pregnancy is finished.

Democratic state Rep. Ashley Aune introduced House Bill 2402 earlier this year, which would remove restrictions around divorcing while pregnant. Aune recently told NPR that "I don't honestly feel very hopeful" about its chance of passing in the Republican-dominated state legislature, but she said she felt compelled to try after hearing harrowing stories from survivors of domestic violence.

"How can you look that person in the eye and say, 'No, I think you should stay with that person,'" Aune said. "That's wild to me."

Activists say that the U.S. Supreme Court's overturning of Roe v. Wade in 2022 left pregnant women in abusive relationships with even less control over their lives, and less access to vital resources. Marium Durrani, vice president of policy for the National Domestic Violence Hotline told the outlet that the group received a 100% call increase in the year following the ruling.

"We're seeing lots more people citing reproductive coercion, sexual coercion, reproductive abuse, or pregnancy coercion as part of their experience," she said. "I mean, we are getting calls that are very explicitly like 'I am pregnant.' 'I am trying to escape.' 'I cannot get resources where I am or in my state or my locality.'"

Marilyn Lands, who campaigned on abortion rights in deeply conservative Alabama, won a special election to the Alabama Legislature, in a victory that Democrats say illustrates voter backlash to extreme reproductive restrictions imposed by Republicans.

Lands, a Democrat, on Tuesday decisively defeated Republican Teddy Powell to win the open House of Representatives seat in a suburban district that — while increasingly politically moderate — had long been held by the GOP. Her victory was celebrated by Democrats who said it underscores the importance of reproductive rights as an issue across the country ahead of the 2024 elections.

“Voters want something different, and I think they are tired of women’s freedoms and reproductive health care not being addressed,” Lands told The Associated Press in a telephone interview.

Alabama bans abortion at all stages of pregnancy with no exception for pregnancies arising from rape. Lands’ victory comes several weeks after in vitro fertilization services were temporarily paused in the state after the Alabama Supreme Court issued a ruling equating frozen embryos to children.
