The Supreme Court ruled against Texas and other Republican-led states seeking to strike down the Affordable Care Act in its latest test before the nation’s highest court.

The top court voted 7-2 to reverse an appeals court ruling that had struck down the law’s individual mandate provision.

Two of former President Donald Trump’s court picks, Justices Brett Kavanaugh and Amy Coney Barrett, joined the majority in rejecting the Republican effort.

President Joe Biden praised the ruling as a major victory and vowed to expand Obamacare.

The Supreme Court ruled 7-2 on Thursday against Texas and other Republican-led states seeking to strike down Obamacare in the law’s latest test before the nation’s highest court.

The court reversed an appeals court ruling that had struck down the law’s individual mandate provision. Chief Justice John Roberts and fellow conservative Justices Clarence Thomas, Brett Kavanaugh and Amy Coney Barrett joined Justice Stephen Breyer’s opinion, as did Sonia Sotomayor and Elena Kagan.

Breyer said Texas and the other states that challenged the law failed to show they were harmed by it.

“Neither the individual nor the state plaintiffs have shown that the injury they will suffer or have suffered is ‘fairly traceable’ to the ‘allegedly unlawful conduct’ of which they complain,” Breyer wrote.

Biden also vowed to expand Obamacare, a central promise of his presidential campaign.

The Supreme Court agreed in March 2020 to hear the case.

Commenting on the apparent change of position among Republicans who voted against repeal on July 26, Senator Ben Sasse claimed, With just one exception, every member of the Republican majority already either voted for repeal or explicitly campaigned on repeal.

Is Sasse correct? Did every current Republican senator, except one, previously vote for or campaign on repeal of the Affordable Care Act?

Yes. With the exception of Sen. Susan Collins , all 49 current Republican senators who were in office in 2015 voted that year to repeal elements of the ACA . Seven Republican senators who were in office in 2015, including Collins, voted against a similar bill on July 26, 2017.

Senators John Neely Kennedy and Todd Young , both elected in 2016, campaigned to repeal the ACA. Sen. Luther Strange , appointed in 2017 and currently running in a special election, has also campaigned on repeal. All three senators voted to repeal the ACA on July 26.

Some GOP senators worried the measure would go back to the House, where leaders would put it on the floor, pass it and send it to Trump who has said he would sign whatever lands on his desk when it comes to Republican-passed health care legislation.

Before the vote, at 10:43 p.m. ET, Trump was rooting them on in a tweet: “Go Republican Senators. Go!”

Afterward, it was a different story, with the president tweeting at 2:25 a.m. ET that those who voted no had “let the American people down.”

It’s somewhat ironic that McCain was the one to derail what seemed like a sure Trump victory . After all, Trump’s comments about the former prisoner of war were among the earliest to land the then-candidate in controversy.

“He’s not a war hero,” Trump said in 2015 of McCain. “He was a war hero, because he was captured. I like people who weren’t captured. He’s been losing so long he doesn’t know how to win anymore.”

That was likely never lost on McCain.

Three Republicans; New Yorks;Tom Reed and John Katko and Pennsylvanias Brian Fitzpatrick had voted in January to authorize the House general counsel to intervene in the lawsuit to defend the health care law. All three also voted for the resolution Wednesday.

One Democrat 15-term Minnesota Rep. Collin C. Peterson bucked his party and voted against the resolution. Hes one of the last Democrats remaining in the House who opposed the 2010 health care law and is likely the last Democrat who can hold his heavily agricultural 7th District seat.

Democrats were otherwise united in supporting the resolution, and the Democratic Congressional Campaign Committee launched positive Facebook ads touting their vulnerable members votes to protect families with pre-existing conditions.

It isn’t clear what comes next, but the collapse of some insurance markets around the country serve as an incentive for Republicans and Democrats to hold hearings and fix the problems with health care.

Most Republicans never embraced the different iterations of legislation they crafted, nor the process by which it was constructed. Even on the last-ditch effort at a bare-bones bill, Republicans couldnt reach agreement. Over the past two days, many rejected a plan that would have partially repealed and replaced Obamacare and a measure that would have just repealed it. The repeal vote was the same bill that passed the Senate and the House in 2015 when former President Barack Obama vetoed it.

Sen. Lisa Murkowski, R-Alaska, stood against every version of the legislation even in the face of immense pressure. The Trump administration threatened to withhold federal resources from Alaska because of her opposition, according to the Alaska Daily News. Murkowski herself said the next day in response to the report that she would not characterize it as a “threat.”

“I sat there with Senator McCain. I think both of us recognize that its very hard to disappoint your colleagues,” Murkowski told NBC News after the vote. “And I know that there is disappointment because it was the three votes that Senator McCain, Senator Collins, and I cast that did not allow this bill to move forward. And that is difficult.”

“John McCain is a hero and has courage and does the right thing,” Schumer said.

When Did Obamacare Start

The timeline of key events leading up to the passage of the Obamacare law began in 2009. Here is a list of those events, along with key provisions that went into place after the law was enacted.

Why Supporters Pushed For The Bill

The PPACA addresses the needs of the 46 million uninsured Americans;

strengthens the Medicare system by closing the donut hole in prescription coverage, and cutting waste and fraud while guaranteeing preventive care without co-pays;

provides health insurance to low-income children;

funds cutting-edge research into cures for diseases;

gives patients the clout to challenge the decisions of health insurers and;

increases access to care by making it impossible for insurers to shun the sick.

In the past, insurers either refused to cover patients suffering from pre-existing conditions, or charged them unaffordable premiums. As House Speaker Nancy Pelosi noted shortly before the legislation passed: “If you’re a woman that’s a pre-existing condition; if you’re a woman of child-bearing age and you’ve had children that’s a pre-existing condition. If you can’t have children, it’s a pre-existing condition. If you have a C-section, it’s a pre-existing condition. A victim of domestic abuse, it’s a preexisting condition.”

Under the PPACA, Americans would no longer have to worry about being denied insurance. Pelosi urged her audience to “Think of an economy where people could be an artist or a photographer, a writer without worrying about keeping their day job in order to have health insurance. Or that people could start a business and be entrepreneurial and take risks, but not be job-locked because a child has a child has asthma or diabetes or someone in the family is bipolar “

The House Votes To Repeal Obamacare

Republicans overcame an embarrassing early failure to pass their replacement for the Affordable Care Act with few votes to spare. Now, they await the political fallout.

For House Republicans, the burden of an unfulfilled campaign promise had simply become too much to bear alone.

And so on Thursday, after an embarrassing early failure and weeks of fits and starts, a narrow GOP majority passed legislation to partially repeal and replace the Affordable Care Act that even many of its supporters conceded was deeply flawed. The party-line vote was 217-213, with 20 Republicans voting against. The bill now goes to the Senate, where its fate is uncertain at best.

The House Has Voted 54 Times In Four Years On Obamacare Heres The Full List

Sunday marks the fourth anniversary of the signing of the Affordable Care Act, or Obamacare, however you prefer to describe it.

While Democrats are struggling with whether to embrace the law or push for changes, Republicans are reminding voters that since they took control of the House in 2011, theyve voted 54 times to undo, revamp or tweak the law. Heres a full list of those votes, as provided by GOP aides. Dates with an asterisk denote a bill that also passed the Senate and was signed by President Obama:

Votes during the 112th Congress, from 2011-2012:

1.Jan. 19, 2011: The Health Care and Education Reconciliation Act would have repealed all of the Affordable Care Act. It passed 245 to 189 with three Democrats voting for it, but was never considered by the Senate.

2.Feb. 19, 2011: The Houses version of the fiscal 2011 continuing appropriations bill included several amendments that would have severely limited implementation of the law. It passed 221 to 202 with no Democratic votes and was never considered in the Senate.

The next few votes were on amendments added to the appropriations bill:

3.The Rehberg Amendment #575: Prohibited funding for any employee, officer, contractor or grantee of any agencies funded under appropriations for the departments of Health and Human Services and Labor to implement provisions of the law.

4.The King Amendment #267: Ensured that no money included in the appropriations bill would be used to implement the law.

Employer Mandate And Part

The employer mandate applies to employers of more than fifty where health insurance is provided only to the full-time workers. Critics claimed it created a perverse incentive to hire part-timers instead. However, between March 2010 and 2014, the number of part-time jobs declined by 230,000 while the number of full-time jobs increased by two million. In the public sector full-time jobs turned into part-time jobs much more than in the private sector. A 2016 study found only limited evidence that ACA had increased part-time employment.

Several businesses and the state of Virginia added a 29-hour-a-week cap for their part-time employees, to reflect the 30-hour-or-more definition for full-time worker. As of 2013, few companies had shifted their workforce towards more part-time hours . Trends in working hours and the recovery from the Great Recession correlate with the shift from part-time to full-time work. Other confounding impacts include that health insurance helps attract and retain employees, increases productivity and reduces absenteeism; and lowers corresponding training and administration costs from a smaller, more stable workforce. Relatively few firms employ over 50 employees and more than 90% of them already offered insurance.

Republicans Can Give Up On Health Care And Move To Other Issues

That seemed to be the message from Senate Majority Leader Mitch McConnell, R-Ky., after Fridays roll call was over.

Our only regret tonight is that we didn’t achieve what we had hoped to accomplish,” McConnell said. “Its time to move on.”

Without question, Republicans have a boatload of other pressing issues to tackle including a must-pass defense measure, annual funding bills to keep the government open, and tax reform. Republicans need a legislative victory, and so far theyve spent an exasperating seven months on health care with nothing to show for it.

So its no wonder if some lawmakers are eager to turn the page.

Right now, we have very little to go home and talk about, said Rep. Mark Walker, R-N.C. We have not delivered.

Four Senators And A Bill One Year In The Making

While Republicans had worked on various proposals to overhaul the tax code for decades, Republican senators began strategizing their latest attempt to reform the tax code not long after Trump stunned the country and won the White House. Republicans had a President ready and willing to sign a bill if they could manage to send him one.

According to a source familiar with the tax negotiations, as far back as December 2016, a small group of Republican senators all on the Senate Finance Committee and guided by Chairman Orrin Hatch and his staff began hashing out the Senates course.

The group included Sens. Rob Portman, formally the director of the Office of Management and Budget, Sen. John Thune, a member of the GOP leadership, Pat Toomey, a fiscal conservative and a member of the Senates Budget Committee and Sen. Tim Scott, a rising conservative star in the party. Over the next several months, the senators held what the source said must have been hundreds of meetings as they sought to find a way forward not only among fellow senators but in cooperation with the House of Representatives and Trump who lawmakers widely acknowledge was more engaged and interested in tax reform than he had been on health care.

Theres been an enormous amount of work done. The reason you see everybody looking so tired is because we are, said Sen. John Kennedy, a Louisiana Republican. They did a great job of keeping us apprised so we wouldnt be surprised.

Senate Republicans’ Obamacare Bill Could Hinge On Three Women

Senate Republicans aren’t disclosing much about their plans to overhaul the Affordable Care Act . But with just nine legislative days left before their self-imposed deadline for a vote on the legislation, one thing is clear: Three female senators could make or break their effort to deliver on a political promise seven years in the making.

Republicans Lisa Murkowski, Susan Collins and Shelley Moore Capito all hail from largely rural states , and all have been openly critical of how the House-passed bill to repeal Obamacare would affect their constituents. “The plan the House laid down does not help Alaska. It does not help decrease their costs, and it does not help increase their access,” Murkowski told Vox last week.

The trio of senators also tends to be more moderate than most of their GOP colleagues, at least in terms of how they view the federal government’s role. So Medicaid funding is a huge sticking point for them, and they did not like the cuts in the House bill. The question is whether the final draft of the Senate’s health care proposal will move far enough to the middle to assuage their concerns. With 52 Republicans in the Senate, the party can’t afford to lose all three women and still pass its bill with a bare majority.

Actual Events That Occurred As A Result Of The Affordable Care Act 2011 To 2014

January, 2011: In 2011, insurance companies had to ensure the value for premium payments. If insurance companies did not spend at least 80% to 85% of premiums on care the difference is sent to customers in a refund.

January 2011: A Florida judge rules that elements of the Affordable Care Act are unconstitutional.

November 14, 2011: The US Supreme Court agrees to hear arguments in the Obamacare case brought by 26 states and the National Federation of Independent Business. It argues that elements of the Affordable Care Act are unconstitutional.

January, 2014: Health Affairs published its most recent analysis of Medical Loss Ratio performance by major insurers.

March, 2014: The New York Times reports that the U.S. Census Bureau, the authoritative source of health insurance data changed its annual survey so thoroughly that it became difficult to measure the effects of President Obamas health care law.

To highlight the secrecy of the GOP health-care deliberations, many Senate Democrats have pointed out that the debate over the Affordable Care Act was the second-longest consecutive session in Senate history. Schumer even sought a parliamentary inquiry on the claim, and it was confirmed by the presiding officer, Sen. Joni Ernst

The Secretary of the Senates office notes that H.R. 3590 was considered on each of 25 consecutive days of session, and the Senate Library estimates approximately 169 hours in total consideration, she said.

The longest session, Feb. 12-March 9, 1917, concerned whether to arm merchant ships during World War I, shortly before the United States entered the conflict. That lasted 26 days.

But this statistic obscures a reality: The key work on creating the Senate version of the ACA was done in secret. Lets take a trip down memory lane.

A brief filed in June asked the court to strike down the Affordable Care Act, arguing it became invalid after axed parts of it.

Speaker Nancy Pelosi said: President Trump and the Republicans campaign to rip away the protections and benefits of the Affordable Care Act in the middle of the crisis is an act of unfathomable cruelty.

If President Trump gets his way, 130 million Americans with pre-existing conditions will lose the ACAs lifesaving protections and 23 million Americans will lose their health coverage entirely.

There is no legal justification and no moral excuse for the Trump Administrations disastrous efforts to take away Americans health care.

Republicans also argue that some people are better off without Obamacare due to the fact that it does not cover those who need it most.

According to the provisions, people who earn just slightly too much to qualify for federal premium subsidies, particularly early retirees and people in their 50s and early 60s who are self-employed are not covered.

Trump endorsed a replacement to Obamacare in 2017 but fell short of passing the Republican-controlled Congress.

The 2020 election will be pretty simple: if you want more sick people without healthcare coughing on you, vote Trump.

— Senate Republicans cleared an important hurdle early Thursday in the legislative process to repeal the Affordable Care Act, capping a marathon seven-hour voting session by passing a budget resolution.

It was a key step for Republicans as they move to undo major parts of President Obama’s signature health care law. The 51-48 vote came down along party lines and paves the way for a vote on a repeal bill that could come as early as next month. The measure allows the GOP to pass final legislation in the Senate with a 51-vote simple majority instead of the 60 votes required for most legislation. Republicans currently control the chamber with a 52-seat majority.

Vice Presidentelect Mike Pence tweeted out congratulations to his fellow party members on Capitol Hill, calling it a “first step to repeal/replace ObamaCare.”

The resolution is a blueprint that will now be sent to committees, instructing them to write a budget with certain parameters.

Sen. Bernie Sanders, I-Vt., the ranking member on the committee, responded, “The passage of this budget resolution will allow Republicans to come back to the floor of the Senate with a budget reconciliation package which will repeal the ACA with a simple majority, and if they do that, 30 million Americans will lose their health care, with many thousands dying as a result.”

As if the would-be mother werent already suffering enough, now this extra burden, served up with a sinister insinuation about her miscarriage.

Changes Required By The Affordable Care Act In 2014

October 1, 2013: Health insurance exchanges scheduled to open for 2014 enrollment begin writing policies that go into effect January 1, 2014.

January 2014: People buying insurance on their own get subsidies to help them pay their monthly insurance premiums. Premiums are allocated on a sliding scale, as determined by income. Any individual earning over 400% of the poverty level does not qualify for subsidies.

January 2014: When health insurance exchanges are operational, small business tax credits are up to 50% of premiums.

January 2014: Insurance companies are required to provide health insurance to any adult aged 19 to 64 who applies for coverage.

January 2014: To prevent people from waiting until they get sick to buy health insurance, the ACA requires all Americans to buy health insurance or pay a fine. The fine starts at $95 for an individual in 2014 and goes up each year until 2016, when the fine is $695 or 2.5% of a persons annual income, whichever is greater.

January 2014: Pre-Existing Condition Insurance Plans , established in 2010 are scheduled to expire on January 1, 2014 once all major ACA reforms go into effect.

Eliminating Health Care Penalties

The Affordable care Act, required most Americans to be enrolled in Health Insurance since it was made affordable, otherwise a penalty would be induced. Effective 2017, congress attempted to eliminate financial penalties that were related to complying with the mandated law that every individual needs to be enrolled in Health insurance, this law however did not become effective until 2019. This policy is still valid, the penalty for having no health insurance was reduced to 0$. Individual mandates effects the decisions made by individuals regarding healthcare in that some people will not enroll since health insurance plans are no longer mandatory.

On March of 2020, the nation has undergone a global pandemic, however, several Republican-led states and the Justice Department are making the case for invalidating the ACA. This will cause at least 60 million people to not be able to afford being hospitalized, or treated which increased the number of COVID-19 cases nationwide.

In a moment of unexpected high drama, Republicans were stymied once again in their effort to repeal the Affordable Care Act and they have John McCain to thank for it.

In the early morning hours Friday, the senator showed why he earned the nickname “Maverick” over his long tenure.

McCain, who was diagnosed with brain cancer and returned to Washington to advance the health care bill, turned around and bucked his party’s leadership and President Trump by joining two moderate Republicans, two independents and every Democrat in voting against the so-called “skinny repeal” of the Affordable Care Act, also known as Obamacare.

McCain’s office released a statement from the senator on his reasoning:

McCain continued, calling on lawmakers to “return to the correct way of legislating and send the bill back to committee, hold hearings, receive input from both sides of aisle, heed the recommendations of nation’s governors, and produce a bill that finally delivers affordable health care for the American people.”

The Senate voted 51-49 against the legislation aimed at dismantling the Affordable Care Act.

Democrats Launch Gun Control Debate

In recent months, many Senate Democrats have grown increasingly agitated at their inability to respond to the growing number of mass shootings across the country and pass tougher gun control legislation and measures to help mentally unstable people before they carry out a tragedy. Their last major effort came after 20 children and 6 adults were killed by a gunman in Newtown, Connecticut, three years ago.

Even then, a bipartisan measure from Sen. Joe Manchin, D-West Virginia and Sen. Pat Toomey, R-Pennsylvania to expand background checks failed.

The entire country will know where every member of the Senate stands on tightening background checks, on keeping guns out of the hands of terrorists, and on strengthening and improving mental health in this country, said Sen. Chuck Schumer of New York. The scourge of gun violence that has swept through this country in recent years has snuffed out thousands upon thousands of lives. Its an epidemic that must be dealt with head on and that means keeping guns out of the hands of people who should not have guns.

Democrats brought up the Manchin-Toomey measure, a proposal from Sen. Dianne Feinstein of California that would prevent people on the terror watch list from buying guns, and a third amendment to strengthen mental health and substance abuse treatment all failed. Each was blocked from getting 60 votes to advance. Republicans offered alternatives to each and they were blocked as well.

The other amendments fell on party lines.

Threw a bunch of stuff together for lunch and somehow it managed to look aesthetically pleasing so I took a picture 💁🏽‍♀️ I threw a bunch of veggies and tofu in a pan and made the sweet potatoes in an air fryer and oh my gosh it all turned out really good like I had really low expectations for this meal y’all 😅 I’ve been trying to get more creative in the kitchen. I tend to get used to certain foods and will literally wind up eating the same thing over and over again. Or I tend to avoid the oven and the spice rack all together and wind up with some really crazy food combos...like really guys I had ramen, cheese and an apple for lunch one day all to avoid cooking 🙈 Yeah some of it is probs my eating disorder but I also think I’m just lazy in the kitchen 😂 Regardless though I’m trying to switch it up which is never a bad thing!
