MEXICO CITY (AP) — A Mexican woman who killed a man defending herself when he attacked and raped her in 2021 was sentenced to more than six years in prison, a decision her legal defense called “discriminatory” and vowed to appeal Tuesday.
The ruling against Roxana Ruiz spurred anger from experts and feminist groups who said it speaks to the depth of gender-based violence and Mexico’s poor record of bringing perpetrators of sexual violence to justice.
“It would be a bad precedent if this sentence were to hold. It’s sending the message to women that, you know what, the law says you can defend yourself, but only to a point,” said Ángel Carrera, her defense lawyer. “He raped you, but you don’t have the right to do anything.”
The Associated Press does not normally identify sexual assault victims, but Ruiz has given her permission to be identified and participates in public demonstrations led by activists who support her.
While the Mexico State court found Monday that Ruiz had been raped, it said the 23-year-old was guilty of homicide with “excessive use of legitimate defense,” adding that hitting the man in the head would have been enough to defend herself. Ruiz was also ordered to pay more than $16,000 in reparations to the family of the man who raped her.
In May 2021, Ruiz was working selling french fries in Nezahualcoyotl, one of the 11 municipalities in the Mexico State with an ongoing gender alert for femicides and another one for forced disappearances of women.
While having a beer with a friend, Ruiz, a Indigenous Mixteca woman and a single mother from the state of Oaxaca, met a man she had seen around the neighborhood. After hanging out, he offered to walk her home and later asked to stay the night because it was late and he was far from home.
Ruiz agreed to let him sleep on a mattress on the floor. But while she slept he climbed onto her bed, hit her, tore off her clothes and raped her, according to Carrera, Ruiz’s legal defense. Ruiz fought back and hitting him in the nose, and he threatened to kill her. In the struggle to free herself she killed him in self defense, Carrera said.
In a panic, Ruiz put the man’s body in a bag and dragged it out to the street where passing police arrested her.
Despite telling police she had been raped, Carrera said a forensic exam was never taken, a crucial step in prosecuting sexual violence cases. Instead, an officer responded that she probably wanted to have sex with the man at first and then changed her mind, he said.
“I regret what I did, but if I hadn’t done it I would be dead today,” Ruiz told the AP in an interview last year, adding, “It’s evident that the state wants to shut us up, wants us to be submissive, wants us closed up inside, wants us dead.”
Women’s rights groups have repeatedly accused Mexican authorities of revictimizing survivors and failing to judge cases with a gender perspective.
Ruiz spent nine months in jail on charges of homicide with excess of legitimate self-defense, and was finally released to await trial.
The court responded to public outcry of the sentencing Wednesday, saying the judge did examine the case with a gender perspective. It also noted that a blow to the head during the struggle left the man unconscious at one point, saying the court found that was “enough to contain the physical aggression.”
The woman’s lawyer said the court’s defense “is totally false.” Carrera said that while there was some evidence the attacker received a blow to the head, it was never proven the man lost consciousness. He said the defense hopes to challenge the court’s statement in its appeal.
Despite the sentencing, Ruiz still remains free pending further judicial steps.
Nearly half of Mexican women have experienced sexual violence in their lifetime, government data shows.
In 2022, the Mexican government registered a total of 3,754 women – an average of 10 a day – who were intentionally killed, a significant jump from the year before. Only a third were investigated as femicides.
That number is likely just a fraction of the real number due to rising disappearances and lack of reporting of violence in the country.
Angelica Ospina, gender fellow for International Crisis Group in Mexico, said she worries that the sentencing may empower victimizers while discouraging women from reporting gender-based violence or defend themselves.
The case points to just how “normalized” gender-based violence is in Mexico and other parts of Latin America, Ospina said.
“When a woman defends herself, the system is particularly efficient in processing and sentencing her without taking into consideration the conditions in which she killed the man,” Ospina said.
Meanwhile, outside the courtroom, women carried signs and chanted “justice!” A tearful Ruiz stood before the crowd, thanking feminist groups and the women who had supported her through the years-long judicial process.
Speaking to the crowd, she thought of her 4-year-old son.
“My son, I hope to see him again. I hope to stay with him, to be the one who watches him grow up,” Ruiz said.

Every day . . . people share their food and bring enough for other people to eat. Some days people cook for everyone, and other days people just bring bits and pieces that multiply into enough to feed the entire crew. It’s a bit like the story of the loaves of bread and the fish when Jesus preaches to 5,000. I rarely see people walk in with food, but somehow when mealtime comes around, people pull out dishes from home of rice or frijoles charros . . . or roasted chicken. The first day I worked, Eva shared her chicken with me. Carmen brings me pomegranates from the tree in her yard. . . . Every day I come in unprepared to get through the day without starving. . . . But these women take care of each other, and they take care of me, too. When you walk into the dining room, people get up and get you a chair, ask if you want tortillas or salsa or half of the food on their plates. I feel respected and important to them, but why? When I started working at Casa Amiga, I didn’t expect people to offer me free food or even notice if I ate or not. . . . In previous jobs in the U.S., I’ve been mostly expected to fend for myself. . . . Even last summer when I worked at a community center where the people were all very respectful and sweet, if I didn’t bring lunch, I had to go out and buy something. No one thought to bring food for other people or eat potluck-style. So at Casa Amiga the routine surprised me, and I felt guilty until recently about eating their food; [butnow] I have stopped feeling guilty and started participating in the lunchtime ritual of everyone bringing something small to share. . . . So now I feel like part of a community of women who respect each other, and it makes me feel so content and secure. Isn’t that funny? A little thing like sharing lunch can bring women together, empower them individually and as a group, and build real commitment between them. . . . This atmosphere is very different from the one I’m used to in the U.S.

It kills me a bit more inside every time I realize how much the incels TRAs took over the left worlwide and pushed their agenda so the left would abandon women, to the point only right wing politicians dare to speak.
Being forced to make an apology like a kid and this moid gets a boner from humiliating a woman this way. Someone who is genuinely afraid and oppressed is not gloating about having a victory over political oponents like that.
And punishing someone with a lesson against 1984 Wrongthink and forcing them to repeat the same apology daily on socials like a religious getting absolution is literally a fucking dystopia. When I think I can't peak harder, TRAs find ways to radicalize me more.

Hi! Saw your post on redberryterf and racism.
I'm not PoC(nebulous USA spicy white but I come from immigrants) but I've been eyeing that user specifically for a fucking minute tbh. Her posts always seemed too edgy and evocative of the alt-right to me, in a way I couldn't quite describe much less prove something wrong with. Lo and behold LOL.
The truth is racism is everywhere there's white people and especially there's racism where there's Not Supposed To Be, like radical leftist organizing.
Queer AND radical feminist spaces host plenty of racism cloaked in whatever politically correct language, because both Queer and Radical Feminist discourse spaces on the English-speaking internet are predominantly white, western, upper middle class and college-educated.
I've seen some women on here try to claim Radical Feminism is *thee* feminism of the rest of the world, but I find that disingenuous. Most American and British radical feminists are nothing like Korean or Chinese radical feminists, and who knows what would happen if we were all in the same conference as those in Mexico, Romania, Greece. A responsible feminist would not try to separate herself from racism in her own movement by claiming The PoC Agree and would instead acknowledge and address it.

hello!! i really appreciate this, so thank you. i agree with what you said wholeheartedly (ill have to look up the poc agree, though, not very familiar with that). i think people assume that just because a space is far left it is automatically exempt from racism, which is just. factually incorrect.
i mean, to begin with, there is no community in the whole world that is fully exempt from any sort of bigotry. that just doesn't happen. there is no community like that. not the trans community, not the queer community, not the radfem community, that's just not real. the thing is that bigots are everywhere. sometimes they do it out of malice, "infiltrating" those spaces aware that what they're parroting is harmful but uncaring, but more likely it's just ignorance, completely unaware that what they're saying is Actually Bad because they've been trained to not question their own thoughts ever.
so whether it's malice or ignorance, it is a lie to say that (x) community is completely free of all bigotry, which is a feeling that i have seen, whether implicitly or explicitly, in a lot of rad-whatever spaces. i mean, have you fucking browsed the "radqueer" tag over here on tumblr? that shit has more intolerance than fucking fox news and it's all completely masked under "radical acceptance", "positivity" and "equality". that is not what you'll find in their communities, though. and though not as extreme or as obvious, the radfem community is like that in many ways.
the fact that your community has a common goal of equality does not mean that your methods are sensible or justified, and it definitely doesn't mean the members of your community are somehow magically exempt from being the sort of people that actively goes against equality.
my problem with the radfem community specifically goes a bit further than just the general lack of awareness and accountability about and to the occasional bigot hiding in plain sight. i believe the entire community is built on a narrative that ends up being a type of "slippery slope" that very often leads to bigotry. so more than the occasional bigot, i think a lot of what is in the radfem community actively leads people to be less tolerant and accepting of others, in many ways.
one of them is the fact that a lot of classic and even some modern radfem writers and activists were and are incredibly racist (and sometimes homophobic as well), which is a fact that is rarely acknowledged in radfem spaces, if at all. and it shouldn't be just acknowledged, there should be some sort of active work to push the ideas influenced by that hate out of the community.
i also believe that when put in practice, a lot of radfem beliefs make people assume that women are the most oppressed group there is, automatically putting them as winners in the oppression olympics and completely disregarding how being negatively affected by one axis of oppression doesn't erase the fact that you can still be privileged in other ways. if women are the True Oppressed Class, then they can't oppress anyone else in any other way. maybe they can acknowledge that certain women can oppress other women, but anyone outside of their class? unfathomable. and this perpetuates many harmful rethorics.
another big problem i have is, naturally, the transphobia, leading radfems to more often than not become terfs. the unwillingness to accept that someone that wasn't Born A Woman(tm) can find genuine joy and comfort in womanhood - it must be a lie to hurt women, or a mental illness acquired through degeneracy, or a mockery, because women are the True Oppressed Class, after all, that's the opposite of joy and comfort. or the unwillingness to accept that someone that was Born A Woman(tm) might not find womanhood suit for them for many reasons, not all of them born from misogyny. but i know that we're talking specifically about the racism in that community and that is fine. im just making a link to how hate is often "intertwined", and one will feed the other.
regarding racism specifically, i do think the radfem community needs to do better in acknowledging and fighting it, more than most communities considering the aforementioned points. unfortunately, the only radfems ive seen on tumblr actively work for that were menalez and another one who's url i cant remember right now.
regarding bigotry in general, i think most radfems need to rethink a lot of stuff and see where their priorities lay. i think all communities would benefit from that, truly, specially left leaning and far left ones that believe themselves to be Truly Good And Pure (free from hate) - including the trans community, for the record.
and i think people of color aren't listened enough in society, which results in us being shut down when speaking about how that reflects in our respective communities, which results in people like redberryterf feeling comfortable enough to share her horribly racist opinions freely and without a care. i personally had already gotten into a debate with her before in which i told her she had to rethink some stuff but naturally i was ignored. which is why i referred to her as a well known person in the community: i don't interact that often but i had already stumbled across her posts multiple times and a lot of them have a LOT of likes. she isn't as big as menalez or that pineapple blog, but she was definitely influential in some way. and yet no one called her out on her bigotry until it was as obvious as it can be. i mean, it doesn't get any clearer than "i don't care that im being racist". she was spoonfed so much hatred that her perception of reality was altered to the point where being racist was probably a bad thing, but it was fine as long as it was towards men. then it's warranted. she's a woman, after all, the supreme oppressed class, she could never oppress anyone else.
anyways, this was a long fucking way of saying To Fight Bigotry You Have To Study Your Roots, Acknowledge Nuance And Different Points Of View, Listen To And Spread Awareness About Marginalized People and Never Ever Assume That You Are Exempt From Bigotry. That's A Sign That You Are Parroting Bigotry.

See, I could say a lot of things on what I dislike about how Israel is handling all of this. But unlike a lot of people, I tend not to pretend I know more about or how to do things better than people who actually live in the subject of conversation, and I don’t pretend I’m important enough that my contribution would add anything. The fact that radfems rarely talk down to places like China, India, and Mexico like this re: misogyny is very true and something y’all are obligated to think about. There are comments about how xyz type of men are misogynistic, but virtually never comments on how xyz country is an empire of evil because if it. You know?
Countering antisemitism and the basic misinfo that foments it is the easy thing to do, which might be lazy if not for the fact that the bar is now at the center of the Earth and that it’s become (or rather, been revealed as) a huge and growing problem in the country I live in and among the people my posts will actually reach.

"Terfs and radfems' ideology is based on hate and white supremacy"
First of all, terf is a term used to label a woman as an acceptable target for violence. Believing you have the right to define when a woman should receive violence is an ideology based on hate and is misogyny.
Second of all, many radfems, myself included, are women of color. Do some research on what lengths of violence women experience in countries such as Mexico, India, Iran, Korea, and others.
Third of all, a white woman being a feminist does not inherently make her a white supremacist.
Fourth of all, women are often labelled terfs because they talk about their sex-based oppression and the need for female-exclusive spaces, such as bathrooms, abuse recovery centers, saunas, where we are already vulnerable and prefer to be in company of other women to mitigate risk.
If your progressive and woke ideology consists of erasing women and hating us even more for expressing concerns over the very real sex-based oppresion we face every day, you are the one whose ideology is a) easily manipulated by people with louder voices even when they're incorrect and b) basing your ideology on hate and misogyny.
Something for all you to think about. Women are not inherently your enemy, you're labelling us as your enemy because you want to invade our rights and our spaces and we are, very rightfully so, not letting you.

Oh man, one time I joined a radfem gaming discord only for them to kick me out because I was the notorious nazi Cosmiccatknight. I think about that sometimes cause like, I was literally in that server for a month and messaged daily with the regulars but like lol someone said I was a nazi so I can't be in with the other girls.
And like.... this is literally highschool mentality.

El berrinche y la falta de respeto de Clemente fue lo que me hizo abrir los ojos a mí también, junto con el asunto de los baños vandalizados de la UNAM, y fue muy interesante que no fue una malvada radfem la que me encontró y me metió a su malvado culto, sino que solo bastó que yo, una mujer que era 100 % libfem hace unos años, viera las acciones de los mismos trans para que yo misma me sintiera incómoda, molesta, violentada e insegura por mí y mis hermanas. Y que sus mismas acciones me llevaran a leer teoría radical.
👏👏👏 dilo hermana! lo del baño en esa universidad de mexico me lleno de mucha rabia, mucho más al saber (si no me equivoco) que ahi habia un botón de auxilio porque hay tantos tantos caso de abuso. y aún asi esos varones decidieron violentar ese espacio seguro. no para asustar a radfems, sino a TODAS las mujeres que usan el baño.
y con lo del congreso, eso fue el colmo. yo pensaba muy inocentemente que la ideología trans podía ir de la mano con el feminismo pero esto me dejo en claro que no. que son incompatibles. el congreso era contra el tráfico sexual, no tenia nada que ver con el supuesto trabajo sexual voluntario que él hace. era para ayudar a las victimas del tráfico (que también afecta a los varones trans identificados) y aún así armó tremendo escándalo.
es la cosa más vil, más inhumana. odio con fuerzas el trafico sexual, esa falta de respeto me pegó duro. directamente en mi moral y mis valores. ahí dije: ya basta. no son mujeres y mucho menos son aliadas.

The group in charge of the women's day march in my city in Mexico hates us radfems in favor of including men and TIMs into the event, so this year we organized ourselves to wear red hoods in protest to symbolize the period blood and also red riding hood who was assaulted alongside her grandmother by a cross-dressing wolf
