Edinburgh man, 72, and deceased wife recognised as parents of surrogate child
An Edinburgh sheriff has granted a parental order which recognised a 72-year-old man and his deceased wife as the legal parents of a child born in the USA as the result of a surrogacy agreement.
An Edinburgh sheriff has recognised a 72-year-old man and his deceased wife as the legal parents of a child born from surrogacy.
The three-year-old was born on August 21, 2020, in Oklahoma. This came after a surrogacy agreement that the couple, who were in their late 60s at the time, made before the pandemic.
Following travel restrictions, the man and his wife were unable to travel to America. The child was cared for by a professional nanny.
They were brought back to Scotland in August 2021, and visited a nursing home where one of his parents was three times a week. The court understood that he recognised her as his mother.
The judgement noted that while the parents are "outwith the normal accepted range of parenthood", the father was described as "active and energetic". It was said that he had been enrolled in nursery, while boarding school options were being considered.
Factors such as the connection between the boy and his father, the effect on his identity, and the "legal rights he would have on her significant moveable estate" were also noted.
In her decision, Sheriff Wendy Sheehan said: âI do not consider that the petitionersâ failure to apply to the court for a parental order within six months should operate as a bar to their application. There are cogent reasons which account for the various delays in this application.
"A broad and flexible approach to interpretation of these proceedings should be adopted when this is necessary to secure the effective protection of the rights. That interpretation results being read down so as to read âAt the time of the application and the making of the order (a) the childâs home must be with the applicants (or in the case of an application where an applicant has died and the application is brought on his or her behalf by the surviving applicant, the childâs home must be with the surviving applicant."
She also highlighted issues that may arise in future, such as appointing a guardian in the event of the father's death. She said that the child's welfare would be "gravely compromised" if the court made no order.
She concluded: âThe lack of a parental order would result in a failure to recognise his genetic relationship with the first petitioner and would deny him the social and emotional benefits of recognition of his relationship with his parents with a legality that matched his day-to-day reality. A is well cared for and thriving in the care of the first petitioner. Overall, am satisfied that the orders sought will safeguard and promote his welfare and that it is better for him that I make a parental order than that none is made.â

Nurses launched a 10-day strike Friday at Garfield Medical Center in Monterey Park, accusing hospital management of failing to address short staffing that they said could jeopardize patients, broken and substandard equipment,and inadequate safeguards to protect nurses from violent attacks. Members of SEIU 121RN, which represents hundreds of registered nurses at the Monterey Park hospital, are expected to strike through Aug. 27. The Friday kickoff of the week-and-a-half-long strike was joined by U.S. Rep. Judy Chu (D-Monterey Park) and California Assemblymembers Miguel Santiago (D-Los Angeles) and Laura Friedman (D-Glendale), who cheered alongside workers clad in purple shirts. âYou deserve to have working medical equipment like defibrillators and cardiac monitors. ... You deserve to have safe working conditions where you donât have to deal with patients who bring in knives and guns and other kinds of weapons. Thatâs not right,â Chu told the crowd to applause.

Dear President Biden and Vice President Harris, We are 99 American physicians, surgeons, nurse practitioners, nurses, and midwives who have volunteered in the Gaza Strip since October 7, 2023. Combined, we spent 254 weeks volunteering in Gazaâs hospitals and clinics. We worked with various nongovernmental organizations and the World Health Organization in hospitals and clinics throughout the Strip. In addition to our medical and surgical expertise, many of us have a public health background, as well as experience working in humanitarian and conflict zones, including Ukraine during the brutal Russian invasion. Some of us are veterans and reservists. We are a multifaith and multiethnic group. None of us support the horrors committed on October 7 by Palestinian armed groups and individuals in Israel.
We are among the only neutral observers who have been permitted to enter the Gaza Strip since October 7. Given our broad expertise and direct experience of working throughout Gaza we are uniquely positioned to comment on several matters of importance to our government as it decides whether to continue supporting Israelâs attack on, and siege of, the Gaza Strip. Specifically, we believe we are well positioned to comment on the massive human toll from Israelâs attack on Gaza, especially the toll it has taken on women and children.
This letter and the appendix show probative evidence that the human toll in Gaza since October is far higher than is understood in the United States. It is likely that the death toll from this conflict is already greater than 118,908, an astonishing 5.4% of Gazaâs population. Our government must act immediately to prevent an even worse catastrophe than what has already befallen the people of Gaza and Israel. A ceasefire must be imposed on the warring parties by withholding military support for Israel and supporting an international arms embargo on Israel and all Palestinian armed groups. We believe our government is obligated to do this, both under American law and International Humanitarian Law. We also believe it is the right thing to do.
With only marginal exceptions, everyone in Gaza is sick, injured, or both. This includes every national aid worker, every international volunteer, and probably every Israeli hostage: every man, woman, and child. While working in Gaza we saw widespread malnutrition in our patients and our Palestinian healthcare colleagues. Every one of us lost weight rapidly in Gaza despite having privileged access to food and having taken our own supplementary nutrient-dense food with us. We have photographic evidence of life-threatening malnutrition in our patients, especially children, that we are eager to share with you. Virtually every child under the age of five whom we encountered, both inside and outside of the hospital, had both a cough and watery diarrhea. We found cases of jaundice (indicating hepatitis A infection under such conditions) in nearly every room of the hospitals in which we served, and in many of our healthcare colleagues in Gaza. An astonishingly high percentage of our surgical incisions became infected from the combination of malnutrition, impossible operating conditions, lack of basic sanitation supplies such as soap, and lack of surgical supplies and medications, including antibiotics. Malnutrition led to widespread spontaneous abortions, underweight newborns, and an inability of new mothers to breastfeed. This left their newborns at high risk of death given the lack of access to potable water anywhere in Gaza. Many of those infants died. In Gaza we watched malnourished mothers feed their underweight newborns infant formula made with poisonous water. We can never forget that the world abandoned these innocent women and babies. We urge you to realize that epidemics are raging in Gaza. Israelâs continued, repeated displacement of the malnourished and sick population of Gaza, half of whom are children, to areas without running water or even toilets available is absolutely shocking. It was and remains guaranteed to result in widespread death from viral and bacterial diarrheal diseases and pneumonias, particularly in children under the age of five. Indeed, even the dreaded polio virus has reemerged in Gaza due to a combination of systematic destruction of the sanitation infrastructure, widespread malnutrition weakening immune systems, and young children having missed routine vaccinations for nearly an entire year. We worry that unknown thousands have already died from the lethal combination of malnutrition and disease, and that tens of thousands more will die in the coming months, especially with the onset of the winter rains in Gaza. Most of them will be young children. Children are universally considered innocents in armed conflict. However, every single signatory to this letter saw children in Gaza who suffered violence that must have been deliberately directed at them. Specifically, every one of us who worked in an emergency, intensive care, or surgical setting treated pre-teen children who were shot in the head or chest on a regular or even a daily basis. It is impossible that such widespread shooting of young children throughout Gaza, sustained over the course of an entire year is accidental or unknown to the highest Israeli civilian and military authorities.

Beyond politics, the lives of key workers are essential
According to Robert Booth of The Guardian, Firefighters are more than three times as likely to die from certain cancers than the general population, probably due to exposure to toxic chemicals while battling blazes, a study has found.
Rates of prostate cancer, leukemia and oesophagal cancer appear to be 3.8, 3.2 and 2.4 times higher than the norm and overall firefighters have faced cancer death rates 1.6 times higher than the general population, according to the study published this week in the peer-reviewed Journal of Occupational Medicine.
The Fire Brigades Union, which represents 33,500 firefighters and control room staff across the UK, said the findings âshould horrify fire services and the governmentâ and called for better monitoring and compensation.
LISTENING TO THE FIRESERVICE
New research has found that toxic contaminants in fires are directly linked to increased rates of cancer and mental health issues among firefighters.
The findings support last yearâs ruling from the International Agency for Research on Cancer, which says that exposure through working as a firefighter is carcinogenic â and goes a step further, by also highlighting the mental toll that firefighting can take.
The research, commissioned by the Fire Brigades Union (FBU) and independently carried out by the University of Central Lancashire (UCLan), is based on a survey of over 10,000 firefighters across the UK, representing almost a quarter of the UKâs total firefighter workforce.
LEARNING FROM RECENT HISTORY?
According to the Never Forget Project, more than 7,000 first responders have been treated for physical and mental illness caused by the 2001 Twin Towers attacks in America.
Academics and air pollution experts have described the dust from the collapsed towers as âwildly toxicâ, made up of more than 2,500 contaminants including glass, lead and mercury.
Studies have shown that those exposed to World Trade Center dust were more likely to develop lung problems, respiratory symptoms, sinus problems or asthma. The World Trade Center Health Program also recognizes certain mental health conditions, digestive disorders, musculoskeletal disorders and cancers as being related to 9/11.

Who Is PCRF?
Palestine Children's Relief Fund (PCRF), founded in 1991 by concerned humanitarians in the USA, provides free medical care to thousands of injured and ill children yearly who lack local access to care within the local health care system. Over the years, we've sent over 2,000 affected children abroad for free medical care, sent thousands of international doctors and nurses to provide tens of thousands of children free medical care in local hospitals, and provided tens of thousands of children humanitarian aid and support they otherwise would not get.
PCRF's impact also includes establishing two pediatric cancer departments in Palestine, a new PICU and pediatric cardiology department in Ramallah, and many more critical projects to sustainably bolster the region's healthcare system. Our foundation relies on grassroots efforts, supported by a worldwide network of thousands of volunteers, to fulfill our humanitarian mission.
