Sometimes I regret not being a computer programmer anymore because I have ideas that I think could be successful apps/platforms and I even have a good idea of how to roll them out to minimize upfront time doing it all on my own and making no money for the work. But I hated programming. And hosting has changed so much I wouldn't know where to even start if things took off and I needed to 3rd party solution that.

Spain lied about not selling weapons to Israel.
Even after October 7th, Spain has sold more than 1 million € of weapons to Israel. Norway and Finland make it possible.
In January, Spain made headlines word-wide when the government's Minister of Exteriors, José Manuel Albares (PSOE), claimed in Congress and later again in a radio interview that Spain had stopped selling weapons to Israel ever since October 7th. Israel's intensification of violence in Gaza following October 7th meant that, on top of decades of apartheid and ethnic cleansing, between October 7th and January 23rd Israel had already killed 28,000 people and forced 2 million out of their home. In this context, many people were demanding their governments stop arming and funding the genocide of the Palestinian people, and here on Tumblr and other social media sites like Twitter I think we all saw the many posts praising the Spanish government for this.
Well, it turns out it was a lie.
According to Albares, "Since October 7th there are no more weapons exportations [from Spain] to Israel". But in November alone, Spain exported weapons to Israel for 987,000€, as was published on the Spanish Government's official website dedicated to exterior commerce (Comex). A researcher from Centre Delàs (an independent centre for peace studies) found it and published it, and it has also been verified by newspapers such as elDiario.es.
This 987,000€ worth of weapons in November was not the only ammunition that Spain has sent to Israel in 2023. In 2023, Spain exported a total of 1.48 million € in war material to Israel.
All of the weapons sent in November come from the factory of Nammo Palencia (Castilla y León), a corporation that is 50% property of the Government of Norway and 50% owned by a public Finnish business. However, even if the owners are foreigners, the ammunition was sent from Spain and thus it had to be authorized by the an organism of the Spanish Government named Junta Interministerial de Defensa y Doble Uso, whose deliberations on whether a weapons exportation is accepted or denied are kept secret. The only cases where they have denied exporting weapons to Israel have been when they thought that Israel would re-sell these weapons to the Philippines.
Spain has had a close relation with Israel for years. As published by the Spanish Government, Spain has sold 20 million € of weapons to Israel between 2012 and 2022. Spain also buys weapons and military software from Israel (for example, the Spanish Intelligence Service has been using the Israeli software Pegasus to illegally spy on Catalan activists, journalists, politicians and civil society members and their relatives to attack the Catalan independence movement), and Spain has continued buying from Israel and allocating defense contracts to Israel even after the October 7th attacks. It is very difficult to track the concessions of public contracts such as buying weapons, but some contracts have been known. For example, on November 24th 2023, Spain bought 287.5 million € of missiles from Israel. This is not unusual: between 2011 and 2021, it is publicly known that Spain bought war material from Israel for at least 268 million €, but experts say that the real number could be two or three times as much.
Spain has also continued allocating concessions to Israel. For example, on December 15th 2023 Spain allocated a contract worth over 576 million € to Israel for a rocket launcher programme. On November 22nd, Spain allocated another another Israeli company to provide missiles for 237 million € at the same time as the Spanish army bought Israeli inhibitors for 1.4 million €. The very next day, November 23rd, Spain signed another military allocation to Israel for 82,600€. The following week, Spain signed yet another allocation with a different Israeli military corporation for 3.7 million €.
Spain also allows Israeli weapon manufacturing companies to produce weapons through their branches located in Spain. This way, Israeli weapons make their way to markets with which Israel doesn't have diplomatic ties but Spain does, like Saudi Arabia. And since Spain is a member of NATO, Israeli weapons produced in Spain are approved according to NATO standards and access it easily. In the same way, these Israeli weapons manufacturers also access European Union defense funds through their branches in Spain. (source).
As I said, I saw a lot of positive posts around when Albares said Spain was going to embargo, but I haven't seen any post about how they didn't do it. I also (personally) haven't seen anything on international media, and barely anything on Spanish media, which is already busy with the PSOE covid material corruption scandal. So I share this in the hope of helping put pressure on Spain to cut all ties with Israel immediately.

Conspiratorialism as a material phenomenon
I'll be in TUCSON, AZ from November 8-10: I'm the GUEST OF HONOR at the TUSCON SCIENCE FICTION CONVENTION.
I think it behooves us to be a little skeptical of stories about AI driving people to believe wrong things and commit ugly actions. Not that I like the AI slop that is filling up our social media, but when we look at the ways that AI is harming us, slop is pretty low on the list.
The real AI harms come from the actual things that AI companies sell AI to do. There's the AI gun-detector gadgets that the credulous Mayor Eric Adams put in NYC subways, which led to 2,749 invasive searches and turned up zero guns:

Any time AI is used to predict crime – predictive policing, bail determinations, Child Protective Services red flags – they magnify the biases already present in these systems, and, even worse, they give this bias the veneer of scientific neutrality. This process is called "empiricism-washing," and you know you're experiencing it when you hear some variation on "it's just math, math can't be racist":

When AI is used to replace customer service representatives, it systematically defrauds customers, while providing an "accountability sink" that allows the company to disclaim responsibility for the thefts:

When AI is used to perform high-velocity "decision support" that is supposed to inform a "human in the loop," it quickly overwhelms its human overseer, who takes on the role of "moral crumple zone," pressing the "OK" button as fast as they can. This is bad enough when the sacrificial victim is a human overseeing, say, proctoring software that accuses remote students of cheating on their tests:

But it's potentially lethal when the AI is a transcription engine that doctors have to use to feed notes to a data-hungry electronic health record system that is optimized to commit health insurance fraud by seeking out pretenses to "upcode" a patient's treatment. Those AIs are prone to inventing things the doctor never said, inserting them into the record that the doctor is supposed to review, but remember, the only reason the AI is there at all is that the doctor is being asked to do so much paperwork that they don't have time to treat their patients:

My point is that "worrying about AI" is a zero-sum game. When we train our fire on the stuff that isn't important to the AI stock swindlers' business-plans (like creating AI slop), we should remember that the AI companies could halt all of that activity and not lose a dime in revenue. By contrast, when we focus on AI applications that do the most direct harm – policing, health, security, customer service – we also focus on the AI applications that make the most money and drive the most investment.
AI hasn't attracted hundreds of billions in investment capital because investors love AI slop. All the money pouring into the system – from investors, from customers, from easily gulled big-city mayors – is chasing things that AI is objectively very bad at and those things also cause much more harm than AI slop. If you want to be a good AI critic, you should devote the majority of your focus to these applications. Sure, they're not as visually arresting, but discrediting them is financially arresting, and that's what really matters.
All that said: AI slop is real, there is a lot of it, and just because it doesn't warrant priority over the stuff AI companies actually sell, it still has cultural significance and is worth considering.
AI slop has turned Facebook into an anaerobic lagoon of botshit, just the laziest, grossest engagement bait, much of it the product of rise-and-grind spammers who avidly consume get rich quick "courses" and then churn out a torrent of "shrimp Jesus" and fake chainsaw sculptures:

For poor engagement farmers in the global south chasing the fractional pennies that Facebook shells out for successful clickbait, the actual content of the slop is beside the point. These spammers aren't necessarily tuned into the psyche of the wealthy-world Facebook users who represent Meta's top monetization subjects. They're just trying everything and doubling down on anything that moves the needle, A/B splitting their way into weird, hyper-optimized, grotesque crap:

In other words, Facebook's AI spammers are laying out a banquet of arbitrary possibilities, like the letters on a Ouija board, and the Facebook users' clicks and engagement are a collective ideomotor response, moving the algorithm's planchette to the options that tug hardest at our collective delights (or, more often, disgusts).
So, rather than thinking of AI spammers as creating the ideological and aesthetic trends that drive millions of confused Facebook users into condemning, praising, and arguing about surreal botshit, it's more true to say that spammers are discovering these trends within their subjects' collective yearnings and terrors, and then refining them by exploring endlessly ramified variations in search of unsuspected niches.
(If you know anything about AI, this may remind you of something: a Generative Adversarial Network, in which one bot creates variations on a theme, and another bot ranks how closely the variations approach some ideal. In this case, the spammers are the generators and the Facebook users they evince reactions from are the discriminators)

I got to thinking about this today while reading User Mag, Taylor Lorenz's superb newsletter, and her reporting on a new AI slop trend, "My neighbor’s ridiculous reason for egging my car":

The "egging my car" slop consists of endless variations on a story in which the poster (generally a figure of sympathy, canonically a single mother of newborn twins) complains that her awful neighbor threw dozens of eggs at her car to punish her for parking in a way that blocked his elaborate Hallowe'en display. The text is accompanied by an AI-generated image showing a modest family car that has been absolutely plastered with broken eggs, dozens upon dozens of them.
According to Lorenz, variations on this slop are topping very large Facebook discussion forums totalling millions of users, like "Movie Character…,USA Story, Volleyball Women, Top Trends, Love Style, and God Bless." These posts link to SEO sites laden with programmatic advertising.
The funnel goes:
i. Create outrage and hence broad reach;
ii, A small percentage of those who see the post will click through to the SEO site;
iii. A small fraction of those users will click a low-quality ad;
iv. The ad will pay homeopathic sub-pennies to the spammer.
The revenue per user on this kind of scam is next to nothing, so it only works if it can get very broad reach, which is why the spam is so designed for engagement maximization. The more discussion a post generates, the more users Facebook recommends it to.
These are very effective engagement bait. Almost all AI slop gets some free engagement in the form of arguments between users who don't know they're commenting an AI scam and people hectoring them for falling for the scam. This is like the free square in the middle of a bingo card.
Beyond that, there's multivalent outrage: some users are furious about food wastage; others about the poor, victimized "mother" (some users are furious about both). Not only do users get to voice their fury at both of these imaginary sins, they can also argue with one another about whether, say, food wastage even matters when compared to the petty-minded aggression of the "perpetrator." These discussions also offer lots of opportunity for violent fantasies about the bad guy getting a comeuppance, offers to travel to the imaginary AI-generated suburb to dole out a beating, etc. All in all, the spammers behind this tedious fiction have really figured out how to rope in all kinds of users' attention.
Of course, the spammers don't get much from this. There isn't such a thing as an "attention economy." You can't use attention as a unit of account, a medium of exchange or a store of value. Attention – like everything else that you can't build an economy upon, such as cryptocurrency – must be converted to money before it has economic significance. Hence that tooth-achingly trite high-tech neologism, "monetization."
The monetization of attention is very poor, but AI is heavily subsidized or even free (for now), so the largest venture capital and private equity funds in the world are spending billions in public pension money and rich peoples' savings into CO2 plumes, GPUs, and botshit so that a bunch of hustle-culture weirdos in the Pacific Rim can make a few dollars by tricking people into clicking through engagement bait slop – twice.
The slop isn't the point of this, but the slop does have the useful function of making the collective ideomotor response visible and thus providing a peek into our hopes and fears. What does the "egging my car" slop say about the things that we're thinking about?
Lorenz cites Jamie Cohen, a media scholar at CUNY Queens, who points out that subtext of this slop is "fear and distrust in people about their neighbors." Cohen predicts that "the next trend, is going to be stranger and more violent.”
This feels right to me. The corollary of mistrusting your neighbors, of course, is trusting only yourself and your family. Or, as Margaret Thatcher liked to say, "There is no such thing as society. There are individual men and women and there are families."
We are living in the tail end of a 40 year experiment in structuring our world as though "there is no such thing as society." We've gutted our welfare net, shut down or privatized public services, all but abolished solidaristic institutions like unions.
This isn't mere aesthetics: an atomized society is far more hospitable to extreme wealth inequality than one in which we are all in it together. When your power comes from being a "wise consumer" who "votes with your wallet," then all you can do about the climate emergency is buy a different kind of car – you can't build the public transit system that will make cars obsolete.
When you "vote with your wallet" all you can do about animal cruelty and habitat loss is eat less meat. When you "vote with your wallet" all you can do about high drug prices is "shop around for a bargain." When you vote with your wallet, all you can do when your bank forecloses on your home is "choose your next lender more carefully."
Most importantly, when you vote with your wallet, you cast a ballot in an election that the people with the thickest wallets always win. No wonder those people have spent so long teaching us that we can't trust our neighbors, that there is no such thing as society, that we can't have nice things. That there is no alternative.
The commercial surveillance industry really wants you to believe that they're good at convincing people of things, because that's a good way to sell advertising. But claims of mind-control are pretty goddamned improbable – everyone who ever claimed to have managed the trick was lying, from Rasputin to MK-ULTRA:

Rather than seeing these platforms as convincing people of things, we should understand them as discovering and reinforcing the ideology that people have been driven to by material conditions. Platforms like Facebook show us to one another, let us form groups that can imperfectly fill in for the solidarity we're desperate for after 40 years of "no such thing as society."
The most interesting thing about "egging my car" slop is that it reveals that so many of us are convinced of two contradictory things: first, that everyone else is a monster who will turn on you for the pettiest of reasons; and second, that we're all the kind of people who would stick up for the victims of those monsters.

Average neoliberalism enthusiasts: solarpunk is only aesthetics with no praxis. there is no alternative to capitalism and the only way we can make change and save the environment is by voting.
Actual ecopunks handing out the resources on agroforestry, micropermaculture, zinemaking, embroidery, DIY sewing and fashion, open source software, prefigurative organizational strategies, repairable tech upcycling and deep ecology for years before it was trendy or cool:
we don't see you doing anything. Either stop the oil empires and animal exploitation industries yourself or get out of our way.
Solarpunk comes from within. The social revolution will not be televised but live. The ballet box will not save us or give us a fair society and we can't vote or buy or sell our way out of this mess. Change must come from direct action.

I just read your TF2 bot post and I’m fascinated. It has left me with a few questions though. Why/how were bots a problem for so long? What was the main incentive for botting (is it botting or boting??) Was it just to be an asshole? What’s your favorite baked good? The bots were a problem for so long because Valve just didn't care, sorry to say. They just let it happen. I'm not sure when they started coming in in force, maybe after the Jungle Inferno update like six years ago? But they just kept pouring in and Valve just ignored it. It's really shameful how bad they let it get, honestly. They just kept putting out community updates like nothing was wrong.
Eventually after a lot of community pressure a year ago (#savetf2) they tweeted saying they were aware of the problem and then nothing happened. Then there was ANOTHER community movement this June (#fixtf2), and THEN at the end of June they ACTUALLY did something, which is why everyone was so shocked and skeptical at the time. Like the bots got so bad, it's hard to get across just how bad it got if you weren't playing at the time. It was bad. To suddenly go from that to totally bot-free was unbelievable. Frankly I'm still shocked they're gone! No one knows why Valve's acting now or how they're doing it (personally, I think they must have been working on these anti-bot measures for a while... maybe even since their initial tweet, but no one knows), but I hope they keep it up. I can finally teach people how to play in peace!
As for why they'd do this, yeah, it's just to be jerks. They just want to make people miserable. They have websites on Neocities you can find under the tf2 tag (I was looking through it for sites to link to my tf2 site) and they state themselves that they just like making people mad. I don't think they actually hate TF2 so much as they love the power rush from destroying something so famous that so many people love. Kind of a power-trip/control thing, with a dose of being desperate for attention. A lot of the more notorious bot hosters had twitters or youtube accounts where they invited people to rage at them uselessly, they loved it. They've also formed communities around botting and trolling people, so they have kind of a social investment in it (although they were quick to turn on each other when they suspected someone was a mole). Some of them sell their bot software or "bot immunity" for money but I think that was just pocket change, I don't think that was a real motivator.
After having free reign for so long, they reacted violently to the community movement in June. They were positive that nothing would happen to them, so they kept doing more and more outrageous things to prove it. They DDoS'd and DMCA'd the site for the petition multiple times, they doxxed and swatted one of the main bot fighters, they impersonated figureheads and posted illegal links to things, like they were really stepping over the line and gloating about it. They were extremely confident and to be fair, who could blame them? Valve's negligence let them get away with it for years. To suddenly have that power taken away from them without warning made them absolutely furious. They're still seething about it right now and plotting ways to get back in, but they haven't found one yet. It's a matter of pride for them at this point I think, that and a childish tantrum about not being able to ruin other people's fun anymore. Them targeting a baby game version of TF2 (TC2) also points to it being a power trip. If they can't ruin TF2 anymore then by god they've got to ruin SOMEthing!
Even now I'm not sure Valve can hold the line and I keep checking TF2 Casual every now and then to look for bots, haha. It's just hard to believe! I greatly enjoy hearing about bot hosters raging about it and suffering though, they deserve nothing less. Die mad about it!!!

Why enshittification happens and how to stop it.
The enshittification of the internet and increasingly the software we use to access it is driven by profit. It happens because corporations are machines for making profits from end users, the users and customers are only seen as sources of profits. Their interests are only considered if it can help the bottom line. It's capitalism.
For social media it's users are mainly seen by the companies that run the sites as a way for getting advertisers to pay money that can profit the shareholders. And social media is in a bit of death spiral right now, since they have seldom or never been profitable and investor money is drying up as they realize this.
So the social media companies. are getting more and more desperate for money. That's why they are getting more aggressive with getting you to watch ads or pay for the privilege of not watching ads. It won't work and tumblr and all the other sites will die eventually.
But it's not just social media companies, it's everything tech-related. It gets worse the more monopolistic a tech giant is. Google is abusing its chrome-based near monopoly over the web, nerfing adblockers, trying to drm the web, you name it. And Microsoft is famously a terrible company, spying on Windows users and selling their data. Again, there is so much money being poured into advertising, at least 493 billion globally, the tech giants want a slice of that massive pie. It's all about making profits for shareholders, people be damned.
And the only insurance against this death spiral is not being run by a corporation. If the software is being developed by a non-profit entity, and it's open source, there is no incentive for the developers to fuck over the users for the sake of profits for shareholders, because there aren't any profits, and no shareholders.
Free and Open source software is an important part of why such software development can stay non-corporate. It allows for volunteers to contribute to the code and makes it harder for users to be secretly be fucked over by hidden code.
Mozilla Firefox and Thunderbird are good examples of this. There is a Mozilla corporation, but it exists only for legal reasons and is a wholly-owned subsidiary of the non-profit Mozilla foundation. There are no shareholders. That means the Mozilla corporation is not really a corporation in the sense that Google is, and as an organization has entirely different incentives. If someone tells you that Mozilla is just another corporation, (which people have said in the notes of posts about firefox on this very site) they are spreading misinformation.
That's why Firefox has resisted the enshittification of the internet so well, it's not profit driven. And people who develop useful plugins that deshitify the web like Ublock origin and Xkit are as a rule not profit-driven corporations.
And you can go on with other examples of non-profit software like Libreoffice and VLC media player, both of which you should use.
And you can go further, use Linux as your computer's operating system.. It's the only way to resist the enshitification that the corporate duopoly of Microsoft and Apple has brought to their operating system. The plethora of community-run non-profit Linux distributions like Debian, Mint and Arch are the way to counteract that, and they will stay resistant to the same forces (creating profit for shareholders) that drove Microsoft to create Windows 11.
Of course not all Linux distributions are non-profits. There are corporate created distros like Red Hat's various distros, Canonical's Ubuntu and Suse's Opensuse, and they prove the point I'm making. There has some degree of enshittification going on with those, red hat going closed source and Canonical with the snap store for example. Mint is by now a succesful community-driven response to deshitify Ubuntu by removing snaps for example, and even they have a back-up plan to use Debian as a base in case Canonical makes Ubuntu unuseable.
As for social media, which I started with, I'm going to stay on tumblr for now, but it will definitely die. The closest thing to a community run non-profit replacement I can see is Mastodon, which I'm on as @[email protected].
You don't have to keep using corporate software, and have it inevitably decline because the corporations that develop it cares more about its profits than you as an end user.
The process of enshittification proves that corporations being profit-driven don't mean they will create a better product, and in fact may cause them to do the opposite. And the existence of great free and open source software, created entirely without the motivation of corporate profits, proves that people don't need to profit in order to help their fellow human beings. It kinda makes you question capitalism.

Hi, FR tag! In light of the recent tumblr drama, I wanted to call attention to a report by a former tumblr employee about tumblr potentially beginning to sell user data to Midjourney (the AI image software company). FR tumblr is full of artists who've been sharing dozens of pieces of art daily for over a decade, and so this post is to help get the word out about this decision in advance.
As of writing this post (February 21, 2024), this has not yet been implemented. No data is being sold to Midjourney at this time. This post is to raise awareness to allow artists in the community time to determine what their next steps are. There is the possibility that tumblr never follows through with this, but there's also the possibility that they will. We also currently do not have information about what this decision will entail if it does go through, if it's opt-in only, etc.
The FR community here on tumblr is incredibly precious to me. I'm saddened and frustrated by tumblr's decisions. Please reblog this post and feel free to use it as a springboard for discussions, posting other socials, or anything else the community might need.

I know you love scivener, but do you know anything about ellipsus? It's meant to be an aternative to google docs for collaborative writing.
I heard about them when they dropped nanowrimo as a sponsor over their inclusion of AI bullshit, which seemed promising. And digging around on their homepage I saw mentions of beta reading and ao3, and apparently they're trying to promote themselves on Tumblr now.
So it really sounds like we're the target audience, which could be great, but I don't know enough to be able to tell if there's an obvious catch somewhere?

This is the first I've heard of them. A quick scroll through their website seems promising.
As usual, the basic questions are:
How much does this product cost to develop?
Do they have a business plan that makes sense with that cost?
This kind of software can, theoretically, be made by a few friends dicking around, not a huge programmer team all of whom have it as their primary job, so it isn't the pile of massive red flags that all attempts at social media are.
From the site:
"Today we are a small, close-knit team of seven, located across the post-capitalist landscapes of Berlin, Bologna, Buenos Aires, and Szczecin. (So much for our alliteration-based hiring strategy.) True to our mission, we're a progressive, remote-friendly company that prioritizes creativity, community, and creative exchange."
Jobs are listed as: Co-founder and CEO, Co-founder and community, Product and marketing, Design, and Engineering x3.
That seems like a reasonable breakdown and a size of team that could possibly be paid for with some non-insane business model.
The types of red flags we're looking for are
"We want to be the next instagram!"
Many idea people with nebulous skills, few programmers
Thinking you can run tumblr with three programmers
Thinking you can pay for 100 programmers with a cheapass subscription model
Programmers are random, cheap contract workers the founders don't know
Venture capital from sources that will want a big payout rather than support from people who share the goals/values of the team
Extremely overcrowded field with tons of products that do exactly this already
Unclear nature of product or a product that doesn't seem to actually have a market
etc.
What they say about money is in the FAQ:
Will Ellipsus have a paid plan? In order to grow the team and fund ongoing feature development, we will need to charge for a version of Ellipsus at some point. A paid version would be targeting users with specific needs related to advanced security, data syncing, and collaboration. But there will always be a free version of Ellipsus, and we want to be as generous as possible in what's included on that free plan (e.g., unlimited docs and drafts, for starters). It takes time to build a great freemium experience (not to mention a premium product people will happily pay for), which is why we won't roll that out in 2024. While the features that will be included in our paid plan aren't final-final, we can share that everything in the product today will be included in our free plan.
This sounds reasonable. It just remains to be seen whether they keep at it or go belly up (taking your data with them). I guess you'd have to know more about the specific people building this to decide whether they'll be reliable.
The biggest potential issues I see are it being difficult to get people to ditch google docs despite its issues, this taking off big time and the owners deciding to sell it for $$$$$$ to someone who will then ruin it, or the team just not being competent.
But since I don't know any of them, I have no idea how good they are at business.

Tickle vs Giggle has placed the delusions of trans activists over biological reality and women’s hard-won rights.
The courts Down Under have gone topsy-turvy. At 9am Sydney time, a judge handed down a ruling that eradicated the category of sex in law, finding in favour of a man who was denied access to a women-only app. Justice Robert Bromwich stated that according to Australian law, sex is ‘changeable and not necessarily binary’. The case, known as Tickle vs Giggle, has set a dangerous legal precedent that the world may now follow.
The legal row started when Tickle – an angry man in a frock who changed his name to Roxanne – saw some posts on social media that annoyed him. He is a trans activist who has gone to some lengths to ‘pass’ as female. He had so-called gender-affirmation surgery in 2019 and changed his birth certificate to obfuscate the fact that he was, to use his words, ‘assigned male at birth’. His sex obviously remains male, as perfectly illustrated in photos by his five o’clock shadow, even if on paper he is legally a ‘woman’.
The tweets that upset Tickle were posted by Sall Grover, founder of the women-only social-media app, Giggle. Giggle, a small tech start-up, used facial-recognition software to screen out men. Tickle put this to the test, and initially was accepted on to the app. But after seven months his picture was clocked, either by Grover or the screening function, and his access was restricted.
Tickle then responded in the way that unpleasant, petulant men do when they’re spurned. He huffed, puffed and sent numerous emails and made phone calls to Grover. When that failed to get him reinstated, he took her to court.
Tickle argued he had a right to use Giggle because he is a woman on paper. The judge agreed, noting ‘the imposed condition of needing to appear to be a cisgendered female in photos submitted to the Giggle app had the effect of disadvantaging transgender women who did not meet that condition’. (‘Cisgendered female’ is trans-speak for ‘real woman’, while ‘transgender women’ refers to men.)
For their part, Grover’s legal team agreed that Tickle had been discriminated against – but on the grounds of his male sex, not his claims to have a female gender identity.
The judge went on to explain that although the science of sex difference was not in dispute, ‘the issues in this case involve wider issues than biology’. He considered and then dismissed expert opinion from evolutionary biologist Colin Wright, author and philosopher Kathleen Stock, and campaigner Helen Joyce. Remarkably, he declared Joyce, author of a best-selling book on transgenderism, as having ‘no recognised expertise in any of the areas in which she expresses an opinion’.
Reading the ruling, it is clear that Justice Bromwich understands that blokes can’t become Sheilas; he just didn’t think that biology was relevant to the case. Instead, he stuck to a narrow, administrative understanding of sex and gender, stating that ‘Tickle is a legal female, as reflected in her updated birth certificate issued under Queensland law’ (sic).
Strip away the robes and legalese, law is supposed to uphold what we collectively agree as a society to be right. But trans activists have broken that covenant. They are twisting justice itself to meet the desire of an entitled few to be affirmed as something they are not. Perhaps Justice Bromwich ought to consider the words of the great Australian feminist, Germaine Greer: ‘Just because you lop off your dick and then wear a dress doesn’t make you a fucking woman. I’ve asked my doctor to give me long ears and liver spots and I’m going to wear a brown coat but that doesn’t turn me into a fucking Cocker Spaniel.’
What ought to send a shiver down the spine of all right-thinking people is that this ruling could have huge ramifications for those in other countries across the globe. The Convention to Eliminate All forms of Discrimination Against Women (CEDAW) is an international treaty adopted in 1979 by the UN. It is an agreement that recognises the specific needs of women. Giggle’s defence argued that Australia’s ratification of CEDAW obliges the state to protect women’s rights, including single-sex spaces. That Justice Bromwich rejected this will have ramifications for the 186 countries that have ratified CEDAW, as judges across the world look to landmark rulings like this to inform domestic decisions.
The real cost of Justice Bromwich deciding that ‘female’ is a legal identity rather than a biological reality is likely to be felt by those in CEDAW signatory countries where violence against women is highest. Judges in countries including Pakistan, El Salvador (the femicide capital of the world) and South Africa (which has the highest reported rate of rape in the world) are now likely to take their lead on the interpretation of CEDAW from Australia. Even if misogynist imans in Pakistan, woman-killers in El Salvador and rapists in South Africa all know which sex they are targeting, there is now a real risk their nations’ judges will follow in the heavy tread of Australia in abolishing the category of woman.
The human rights of the most marginalised women in the world have been put at further risk – all because an angry man in Australia wasn’t allowed to play with the girls on a social-media app. Despite the comical name, there is really nothing funny about Tickle vs Giggle.
