#Legal Implications

Why isn't licensing for brands, music, etc. permanently acquired for use in video games that include them? Who benefits from no one being able to sell the game legally in 10-20 years time (as opposed to the games we can still buy after decades)?
Tumblr media
Licensors want to maintain control of their intellectual property. Most of the time, they grant a reasonable temporary use of the license because they want to re-evaluate how things are going from time to time and decide whether to renew the license or not. For old games from 10-20 years ago, the brand owner may not want their brand associated with that game anymore. Most owners are very protective of their intellectual property because it holds value and it's what pays their bills. Beyond that, the vast majority of game sales happen within the duration of the first license, so it really isn't worth it to either the publisher or the licensor to think about the handful of player collectors who are looking to buy a decade-old licensed game. If there are enough people who want to buy those old games, the publisher will usually reach out to the licensor to see if a remake/remaster is reasonable. If an agreement can be reached, the remaster goes forward.

Understanding the Legal Implications of Various Car Accident Types
Car accidents come in different types, natures, and severities. Each car accident incident, therefore, carries with it legal implications that might vary. Whether it is in a rear-end manner or in a multi-vehicle pileup manner, their legal consequences should first be understood if you are one of those parties involved in it. Depending on the type, everything from liability, insurance claims,…

The Philosophy of Moral Luck
The philosophy of moral luck explores the paradoxical notion that factors beyond a person's control can influence the moral evaluation of their actions. This concept challenges the intuitive belief that moral responsibility should only be ascribed to actions and decisions within one's control. By examining how luck interacts with morality, philosophers seek to understand the complexities of moral judgment and responsibility.
Key Concepts in the Philosophy of Moral Luck
Definition of Moral Luck:
Concept: Moral luck refers to situations where the morality of an individual's actions is influenced by factors beyond their control.
Argument: The idea of moral luck suggests that outcomes, circumstances, and inherent traits can impact the ethical assessment of actions, even if the agent had no control over these elements.
Types of Moral Luck:
Resultant Luck: Pertains to the consequences of actions. For example, a drunk driver who accidentally kills someone versus one who doesn't hit anyone.
Circumstantial Luck: Relates to the specific situations or contexts in which a person finds themselves. For example, a person who is never put in a morally testing situation versus one who is.
Constitutive Luck: Concerns the inherent traits and dispositions one has due to factors like genetics and upbringing.
Causal Luck: Involves the random events leading up to an action, which can affect the decision-making process and outcomes.
The Paradox of Moral Luck:
Concept: The paradox lies in the conflict between two intuitively appealing ideas: that moral judgment should be based only on what is within an individual's control, and that luck influences moral outcomes.
Argument: This paradox challenges the traditional notions of moral responsibility, suggesting a need to re-evaluate how we ascribe moral blame or praise.
Philosophical Perspectives on Moral Luck:
Thomas Nagel: Nagel's seminal work outlines the different types of moral luck and argues that it is pervasive in moral judgments, thus questioning the fairness of these judgments.
Bernard Williams: Williams explores the role of luck in ethical life, suggesting that acknowledging moral luck does not undermine morality but rather adds complexity to our understanding of it.
Theoretical Debates and Implications
Moral Responsibility and Control:
Concept: The principle that moral responsibility should correlate with control over actions.
Argument: Critics of moral luck argue that it undermines the fairness of moral responsibility by attributing blame or praise for outcomes influenced by uncontrollable factors.
Reevaluating Moral Judgment:
Concept: Adjusting moral judgments to account for the influence of luck.
Argument: Some philosophers advocate for a nuanced approach to moral evaluation that recognizes the role of luck without dismissing the concept of moral responsibility entirely.
Implications for Legal and Ethical Systems:
Concept: How moral luck influences legal and ethical accountability.
Argument: The recognition of moral luck can impact legal judgments, potentially leading to more equitable systems that consider the uncontrollable aspects of human behavior.
Practical Ethics and Everyday Morality:
Concept: The impact of moral luck on daily moral decisions and judgments.
Argument: Acknowledging moral luck in everyday life can foster greater empathy and understanding in moral evaluations, recognizing the complex interplay of choice and circumstance.
The philosophy of moral luck delves into the intricate relationship between control, responsibility, and moral judgment. By exploring the different types of moral luck and their implications, this philosophical inquiry challenges traditional views on morality and encourages a more nuanced understanding of human actions and their ethical evaluation.

Fandom Gripe #23: I know that fandom is in some deep denial about its treatment of female characters that are canonically involved with fan favorite m/m ships, but do y’all realize that when you disappear female characters from the narrative wholesale to push the idea that your canonically straight fav was “secretly gay all along!” you’re making several bad implications? That 1) bi men don’t exist, 2) bi men do exist, but those who have genuinely loved a woman before cannot genuinely love a man after that (therefore bi men don’t exist in practice), 3) women cannot inspire genuine love and devotion in men, therefore any relationship with a woman is “lesser” than the one they later have a man (see previous parenthesis), or 4) to acknowledge the existence of a lovable woman who isn’t a terrible person, where if a relationship previously existed, it did not end because of “incompatibility,” is enough to destabilize the present relationship between two queer men?
Because why is the tgcf fandom allergic to acknowledging that He Xuan had a whole ass fiancée that he loved? Why does no one ever seem to remember that the kidnappings and murders of He Xuan’s sister and fiancée were the final straws that sent him on his rampage, and he still keeps a shrine to them in the present-day of the story? Why is her entire existence and significance to He Xuan as a man, character, and to his character arc disappeared in favor of pushing Shi Qingxuan—the brother of the man responsible for his fiancée’s death—into that same role, as if to say that her impact on He Xuan is significant... just not when it's from her? Why does He Xuan’s life in fandom essentially begin not just after her death but because of it?

You should find yourself a muscular feeder, who gets up early, does his morning routine of exercising, cold showers and excellent breakfast cooking while you are still sleeping. He is so productive and energetic, meanwhile you are embarrassingly lazy.
As you get up late in the morning and go to the kitchen to eat, you see masterfully cooked waffles with ice cream. You ask your feeder:
"Will you stay with me for but a moment?"
And he answers:
"No. I go hunt bear. Be back in hour."
this is so fucking funny hold on 😭😭

recently a Ubisoft exec apparently said that customers would have to get used to not owning their games for streaming and game services like game pass to really take off. What’s your take on that? Are we really headed to a place where none of us own our games anymore and we just rent them? If we buy games digitally do we actually own them? Can the rights to those games be taken away even after we paid for them?
As with most things, it's good to take the time to understand the nuance of what was said. The Ubisoft person doing the speaking was Philippe Tremblay and he is Director of Subscriptions at Ubisoft. In [the article], he was specifically talking about the mental shift that needs to happen in order for a subscription business model in games to really take hold, because game subscription services are really still in their early stages. Realistically speaking, subscriptions have one of two possible futures - an eventual plateau where subscriptions reach sustainability and equilibrium or an eventual crash because they couldn't.
Tumblr media
Look at digital music streaming services like Spotify. They have largely reached their plateau as a massive chunk of the music market. There are still people who buy physical albums, but they are in the minority. The majority of music consumers tend to listen to their music via streaming services and have gotten used to not owning their music. This is one possible future for video games.
Tumblr media
Let's contrast this with the current state of movie and tv streaming services. There's a huge number of streaming customers, but there are still strong physical media sales because the streaming services can't necessarily keep the shows and films the people want due to licensing issues. When this kind of volatility in the availability of the product is commonplace, it upsets the user base and puts them off of staying as subscribers. This is another possible future for video games.
Tumblr media
As for buying games digitally and "owning" them... well, not really? Like... we've known for ages that end of service for live games is the end of the road, barring player-run grey shards and the like. There are many MMOG, MOBA, looter shooter, mobile, etc. games that have been shut down permanently. Some kinds of games are inherently ownable and some are not.
Tumblr media
As player, it is largely up to us to decide what kind of games we want to support. Playing with a regular group of friends in a live service game is a huge amount of fun but absolutely not conducive to owning the game. Playing a single-player game by myself at my leisure is much more conducive to ownership, but I lose out on content updates and the camaraderie of playing with friends. It is my belief that we should all support the things we value. There are no solutions, only tradeoffs.

I think that one thing we as a society don't acknowledge enough is Timmy's crippling abandonment issues.
He grew up being love bombed with his parents monitoring him literally 24/7. This is suffocating, yes, but also safe. Their constant presence was comforting and reassured Timmy that he was loved.
Then for a year after, he barely had his parents around and was instead left in Vicky's hands. He still has issues with being alone — Cosmo and Wanda are pretty much always at Timmy's side.
It's no wonder that he'd do something like wish for time to stop passing so that he can keep his fairies forever. The two biggest sources of love in Timmy's life — his parents and his fairies — have been shown time and time again to be conditional.
He's only ten and he's already internalized that love doesn't last forever.

thoughts on Ginny and Harry as a couple?
There are a lot of people who find their romance in HBP forced. I don't think it's forced so much as underwritten, and the books don't get the chemistry quite right (though the movies certainly don't, either). There's potential, but they just don't get enough actual scenes of substance (besides Harry thinking she's pretty or feeling jealous of Dean) for a lot of readers to buy that they're not only in love, but deeply enough in love to break up, get back together, and wind up married.
That's not to say I don't see the appeal. There's a very cool scene in Book 5 where Harry's doing a woe-is-me-Chosen-One act, and Ginny effortlessly puts him in his place about it by reminding him that she was possessed by Voldemort at eleven, which is a rare glimpse into her character and also a great synecdoche for their relationship — Ginny is a grounding presence who, like Ron and Hermione, isn't going to be awed by his past adventures because she knew him before they happened. In that respect, Ginny's probably one of the few women Harry could feasibly wind up with, because he only ever seems comfortable around people (let alone girls) who can see past the Chosen-One schtick and treat him like a normo (see: Ron, Hermione, the Weasleys, Luna, Hagrid). True to type, he doesn't get interested in Ginny at all until she's ditched her celebrity crush and ceased to view him as an idol, because in his heart of hearts, Harry wants to be a normal boy, and it's stressed over and over that part of what he likes about his relationship with Ginny is how normal it feels. He kind of has a horribly supercharged version the celebrity dating problem: after the Battle of Hogwarts, anyone he meets is going to know him first as Harry Potter, Chosen One, Boy Who Lived, and Actually Fucking Resurrected Messiah of the Wizarding World, which is... I mean, it's possible that there are witches out there who could get over that, but Harry's not an extroverted guy, and I'm not sure how he'd go about finding them. Ginny's the one who's been there since the beginning, doesn't need anything about him or his past explained to her, and actually likes him for who he is.
When you look at it that way, it's not surprising he married his high school girlfriend. She's one of the few people still alive who doesn't see him as a demigod.
#in general I was never one to ship harry with anybody#what I wanted for him was a long quiet life and plenty of therapy#maybe some dogs. i think harry needs dogs and deserves them#The other obvious solution ftr — though not one I think Harry would take — is for him to marry a muggle#though again. you'd run into the problem of how you explain All That#which harry doesn't like to talk about and probably would want to talk about even less as an adult#plus also: harry loves magic. like he loves it loves it#the muggle world for harry is permanently connected with the dursleys and it would take years to break that association#which I just don't think he's going to invest#Harry post-BOH is moving to Hogsmeade or wizarding London or some other magical neighborhood and staying there forever#by the way this post is not anti Harry and Ginny! no hate on the ship I've seen versions of it that are very cute#but I just think their love story needed Sauce#there are also some really interesting posts I've found in Deep Fandom crackship blogs about h/g as Harry's sublimated desire for Ron#now I don't necessarily buy that reading. I don't think Harry is in love with Ron in the original text#I do think he LOVES ron and projects that love onto the Weasleys very quickly ginny included#and I think Ron is his soulmate platonic or otherwise in every universe#so marrying Ginny has like. Implications. vis-a-vis Harry's status as a Weasley and adoptive brother[in law] of Ron#like it's a full-circle moment where he becomes officially legally a member of Ron's family#which I do believe JKR had in mind. even though that basically means ginny's wedding becomes kinda... actually... about her brother...#it's weird basically. my final verdict is I wish H/G had been written by an author who was more interested in Ginny for Ginny's sake.#greenteacup asks

Read too much Pride & Prejudice and Downton Abbey fanfiction and now get freaked out by how kinky the concept of marriage is. You vow to worship your spouse with your body. You're signing a contract about property rights and also sex. It's the most hard-core mutual objectification agreement two people can enter into under the law? It would be so fucked up if marriage were real

The main cast getting gitty and excited over the prospects of ST5 having a satisfying ending, and Winona mentioning the ending of Schitt’s Creek specifically as what they’d hope to shoot for similarly, Sadie and Gaten agreeing like YES LIKE SCHITT’S CREEK, Finn cutting in like yeah we’re the Schitt’s Creek of Netflix with Noah looking excited but visibly nervous, all while Brett cackles and David is just going 🤠☝️in the background, is all the byler endgame evidence I’ll ever need.
