So, it seems that while the FIA have not changed the regulations, they have come to some sort of understanding with Mclaren that the wing they used in Baku is not going to be used for the rest of the season. This is likely because if pressed the wing would have to be fully declared illegal and then further penalties would be risked (if teams like Ferrari and Red Bull pushed hard against the results of certain rounds) So just agreeing not to use it to prevent the issue being pursued further is the way around it.

My understanding given how talks seem to have gone this weekend over the status of the wing.

I think this does mean the team did know that wing was pushing it, and likely overstepping certain regulations. So they can't fully defend it if it comes down to it.
