Attorney from the US here, working in the entertainment law field here, and who deals in copyright matters on the daily, which is, in fact, my favorite area of US law (even thought its hot garbage mess on the best of days).
In the US at least, the requirements for something to qualify for copyright protection are genuinely very minimal. In other countries, it may be more or less. If you're French, the law is generally massively in your favor as an artist even. No one does artist protection like the French, truly.
But in the US the only requirements are 1) originality of expression 2) fixed in a tangible medium 3) in one of 8 categories of works (literary, dramatic, pictorial/graphic/sculptural, choreography/pantomime, music, sound recording, motion pictures/audiovisual, archtecture). If your work, or parts of your work, meet all three you "own" a copyright to the work or those parts of your work.
So actually there is a high degree of protection affordable to fanfiction and fanarts, outside if the limited elements from canon that someone else holds the copyright to.
For clarity though, an idea is not copyrightable. It's the original expression of that ide which is. For example, an idea is "coffee shop meet cute". The expresion that is original is what an author does with that idea, the plot and the story beats, the dialogue and the descriptions. You know you've seen or read various expressions of this idea across fanworks and fandoms to know it can be developed in a myriad different ways that are each unique. That uniqueness is the part of a story that would always qualify for protection under copyright law, regardless of the names and physical descriptions of the characters in the story.
DC might own batman and superman, but if you write a coffee shop meet-cute au fanfic about those characters, your original story and plot elememts, and especially, the particular syntax and dictionary of your story is highly protectable. That is your originality of expression in a literay work. It's what sets your fic apart from every other cofee shop meet cute written in every fandom under the sun, probably, including any other that may exist for Bruce and Clark.
See 50 Shades of Gray, notorious for having started its first life as Twilight fanfic. Not my fandom, but im sure its not the only kink fic that existed in that fandom. And clearly, the story had sufficiently original elements to it to be able to stand on its own and be a commercial sucess as a copyrightable work with some judicious filing away of specific canon elements.
Now, if you make something truly derivative of canon (think an different looking superman or batman suit), that would be a grayer area, beacuse one of Supes defining traits is that he has the suit with the S shield on it. When you get too close to something made by someone else, its harder to separate your originality from someone elses. You can't really "file the serial numbers" off a Superman suit too easily after all, without modifying the artwork significantly to where its no longer a "superman" suit. That isn't to say there aren't or couldn't be protectable elements in the artwork, it's just that they'd be so entrenched with the canon elements that a court would almost certainly consider the work as a whole derivative. Saying something is derivative does not void it of all originally of expression, it's just that it steps on the toes of someone else's rights to their elements. This is the reason fanart generally cannot be used commercially. The idea behind that is that your taking a bite out of someone else's money pie and that isn't fair in the eyes of the law. It's not to say that there was no originalty of expression in your work.
But that cuts both ways, which is why authors don't want you sending them detailed ideas for a story, and why studios return unsolicited screenplay unread. If DC came up with their own original Bat & Supes meetcute story, the last thing they want to contend with is a fanfic author trying to sue them for stealing their story elememts. If they don't look at anything fanmade, they can assert that as part of their defense. For the love of your fandom, don't send your fanfics to the authors! It's the fastest way to make sure that idea never sees an official light of day.
All that said, RPF is actually a very intersting area, because there is no copyrightable canon elemts you're using. Traits of a human person are not copyrightable. Mother nature cannot hold copyrights in the eyes of US law. RPF, especially sport rpf, is not tyically pulling from a "canon", unless it's pulling from music videos or other creative work, but from real life traits and events of people. The reason these cannot be commercially marketed is because they'd infringe on things like someone's right of publicity and potentially could be considered libel, if the person was fussed enough about the content, but only if you were trying to posit the fic as true and factual events (its why true story film say "based on" or "inspired by" actual events rather saying these are true and actusll events). RPF though, as far as copyright goes, almost definitely entirely protectable.
Tl:dr you do own lots of elements of your fanworks, just not the specific bits that are pulled wholesale from canon. RPF surprisingly even more protectable.
You don’t own fanfics. They’re inherently public domain because they aren’t your IP. Agree or disagree with AI, there are no grounds for “protection” from AI because it isn’t your IP to begin with. That’s what you chose when you chose this medium

Okay, you get an answer, because at least you took the effort to write your ask out properly, even if you are hiding behind the grey, sunglassed circle.
Do I, or any fanfic author for that matter, have any legal claims to our work? No, not really, no. (Although if someone took a fic, filed off the serial number--deleted the fandom specific elements--, and then had it published for financial gain, yeah, that would be a case.)
BUT
Fandoms are built on a social contract that says we respect each others work, the effort people put into their art. We don't steal or disrespect the work of our peers. By feeding people's fanworks to AI you both steal and disprect it, and we need to make people realize that before it's too late--before fandom falls apart, because there will be no more real, actual fanworks.

Thanksgiving / Giving Thanks
I often find myself feeling grateful and joyful over many of the wonderful online interactions and friendships I have, and I occasionally voice those feelings to people (usually one-on-one). However, online communication is fairly limited: 98% of the time it’s limited to text (that other 2% is voice chat in Discord and voice recordings). In real life, I get to see several of my friends and family in person on a somewhat-regular-to-daily basis. There’s more opportunity to communicate the positive feelings I have about those relationships and interactions, verbally and through body language and just my presence.
I’ll text many of my friends (including those I don’t talk to very often) and family “Happy Thanksgiving!” on Thanksgiving, along with an emoji or two, and I’ve done that in Discord servers I’m in as well. I remember thinking about sending a Thanksgiving message to at least one person last year; I don’t recall if I actually did that or not, but I did think about it. Because I wanted to share in celebration with online friends, and for the first time, that included people on Tumblr.
I thought about that for this year, but sending a simple message didn’t feel like it expressed my gratitude enough. And it made me think about how I sometimes yet-not-frequently express that gratitude. So, I decided that today, Thanksgiving, was the perfect time to make a post about who and what I’m thankful for here on Tumblr and online fandom spaces.

@thegreenleavesofspring and your friendship and encouragement and your desire and hope for goodness to succeed in this world through the light of the Lord and sharing pieces of your life with your friends (including me). For writing Sons of the Star and Annaáuchiwee—seriously some of my favorite stories—and sharing them with the world. For the Talk Shop Tuesday asks. For writing Valentines Flowers and Cookies FOR ME (okay not just for me, obviously, but like, they were story thoughts/ideas I had and you grabbed them and ran with them without me even asking and then dedicating them to me on AO3. I am ridiculously touched.) and then telling TAC about my idea for Riser and Billie slow dancing to "Come Home to You" and writing that with her too. For your awesome writing in general. For being you.
The Anonymous Coauthor/TAC and for writing Annaáuchiwee with Bri and (through Bri) getting me into Ian Munsick’s music (I would not be surprised if one of his songs was my top song on Spotify this year; I’ll find out when Spotify Wrapped comes out soon) and also getting me interested in watching more media about/featuring the Western US that I come across or someone shares with me (like the TV show Longmire and the movie Quigley Down Under, the latter being courtesy of Bri). And for writing that scene where Riser and Billie slow dance to “Come Home to You” in chapter 8 of Montana Stars because I had mentioned to Bri that I pictured that happening. You absolutely did not have to do that and I was, and still am, over the moon about it. (Bri, would you mind sharing this with TAC? I would love for her to see it.)
@scleroticstatue and your friendship and encouragement and creativity and listening to me ramble on about one of my irl activities (it was so much fun being able to infodump to you, and I was honestly so touched by the way you genuinely wanted to know more and asked questions!) and sharing info about health stuff when I ask and being someone who reminds me (with so much hope!) that the Lord is faithful. It’s so much fun being your friend.
@afaroffsong and for your friendship and encouragement and your lovely art and writing. I also…okay, this might sound weird, but I feel grateful that I get to share that encouragement back. When people talk about things in their lives that they have going on, especially if it’s stuff they’re going through or things they hope for, I often feel honored to hear that and to be able to do my best to encourage or support them. And I know my words alone can’t solve people’s problems, but I hope they help in some capacity, and I am grateful that I can share reminders that you are loved.
Bri, Sclerotic, and Song. As a group. I love seeing the back and forth reblogs on my dash with Bri and Sclerotic, and I love how I see you all reblog things from one another (and then I get to reblog them from you). It’s also so fun seeing y’all reblog things from me. I love seeing the content you put on my dash, the funny posts and deep posts and personal posts and everything in between. All of the people who have read my fics and enjoyed them but didn’t leave a comment. As someone who didn’t engage at all in online fandom for a long time but loved reading fics, I know how a fic can stick with you for years and can be one of your favorites—even though you’ve never shared it with the author. Although I don’t know how non-commenting readers perceive my work (obviously, lol), I’m guessing there’s at least one or two people out there who have read a fic of mine and enjoyed it. I’m thankful for that and for them.
All of the comments I’ve received on my fics. I am grateful beyond words for every comment left on my fics (okay, not the bot or spam comments, but that’s not the point here, lol). Many of the comments people have written have made me feel like I’m on top of the world. They’ve made me feel SO LOVED. Seeing a comment in my inbox always sparks joy in me, and I always smile reading them. It’s so much fun getting comments from regular readers/commenters (it makes me quite happy to see familiar names), and it’s equally fun getting comments from people whose names I’ve never seen before. Whether it’s a short “great story!” type comment or a comment listing the different parts of the fic/the chapter they liked or an in-depth analysis on part of (or the entire) fic, I deeply appreciate people choosing to share their thoughts on my writing. Comments really do bring me a lot of joy and they mean a lot to me. (So far, I haven’t gotten a negative one, which is both something I’m relieved about and grateful for.) If you’ve left me a comment (or multiple comments!) on any of my fics before, thank you so, so, so much. ❤️

The end of Astorvember 2024!

We have officially made it to the last two days of Astorvember, or as they were called last year AU Days:

As always feel free to engage with the themes literally or figuratively; make a piece of art that depicts the prompt or make a post promoting your own AUs, however you want to engage with the prompts.
Sincere and heartfelt thank you to everyone who participated, whether you made posts, interacted, or lurked. I'm consistently amazed with the longevity, depth, and creativity of this fandom for a little cardboard ratman who was onscreen for five seconds and then died. I have so many plans for the next year, as well as ideas for next year's Astorvember.
Moving on to more zine things, I'm officially extending the submission deadline through February 1st. I want to give everyone plenty of time to complete their new submissions and collect older works to be submitted (I may or may not also be scheming, more info to come). Unfortunately for Astor, November is extremely busy for most folks. I want the zine to have a truly astronomical amount of submissions, so keep them coming!
FAQ under the cut, and thanks again to everyone for making the official second Astorvember so much fun.
Q: What is the maximum number of images per submission? A: No limits for now. The full, digital zine will have much looser limitations (I'm fully prepared to be proven wrong on this, but for now no limits) but for the curated, printed version I ask that you submit a shortened version in the same vein as NSFW works having a censored companion piece for the SFW editions (optional, you can also opt to have your piece removed from certain versions, but no piece will be removed from the full version). As always, no changes will be made without author/artist permission, but keep an eye out for follow up emails. Repetitive or superfluous images may be removed in the event that y'all actually find a number of images I'm unable to handle.
Q: Can I submit digital submissions such as videos and gifs? A: Yes, tentatively. The full, free version of the zine will be published as a PDF, and I may be able to embed gifs, videos, or hyperlinks. Digital extras outside of the main zine were always welcome as a category of submission, so go ahead and submit them. If you want these submissions to be included in the physical zine, please include a thumbnail and summary.
Q: Can I submit a craft to the zine? A: Yes, and there are two ways to do so. You can submit pictures of the craft, and feel free to include a short essay on why you made it, how, when, anything else you'd like to include (under 2500 words). Or you can submit a tutorial for how to make your craft.
Q: Is 2500 words a hard limit? A: No, if your work is a little over go ahead and submit it as is and I'll let you know if it needs to be shortened. The word limit was primarily intended to discourage submissions of full novel-length fics. If you want to submit a fic that's longer than 2500 words, choose your favorite chapter and include where readers can find the rest of it such as links to Tumblr, AO3, or other sites.
Q: I don't have anything serious to submit, can I submit memes/jokes? A: Absolutely! Memes and jokes are more than welcome. As a matter of fact, I would like to write an essay on the top Astor fandom shitpost extravaganzas of the past four years. If you have a favorite Astor meme such as the egg thing (2020) or the egg thing (2024) or Astor Thursday or the White Boy Bracket or any other absurdity, submit it. Include a summary of the event from your POV, where you were when it happened, screenshots, or just what event you would like me to write about.
Q: What can I submit? A: TL;DR writing under 2500 words (ficlets, fic excepts, essays, poems, etc), visual art roughly the size of a half a sheet of printer paper or smaller (drawings, photographs, etc), miscellaneous works such as sheet music, craft tutorials, physical merch, and others subject to approval. Full info above (or here). Submissions are now being accepted until 11:59 pm CDT on February 1st.
Q: How do I submit? A: Email [email protected] and include: -The work's title -The name you would like to be credited as (screen name, url, or nickname preferred over legal name) -Is the work potentially NSFW and if so what content warnings apply Again, more info above (or here).
Q: How many submissions are you looking for? A: As many as y'all got! No limit, go wild.
Q: Can I submit more than one piece? A: Submit as many pieces as you want. Seriously, no limit.
Q: Who can submit works? A: Anyone! Submissions are very specifically and intentionally open to anyone and everyone instead of taking applications and selecting artists to create a piece specifically for the zine.
Q: Can I submit works I've already posted? A: Yes, this zine is intended to be a collection and celebration of the last four years of the fandom. All works are welcome, no matter how old they are or how many people have seen them. This also very much includes pieces from this or last year's Astorvember.
Q: Can I post the piece I submitted? A: Yes, if you want. You can post it, say it was submitted to the zine, post it and don't say it was submitted, or keep the whole thing secret. You can change your mind and post it after submissions close, before the zine is released, whatever you want.
Q: Are original characters/self ships welcome? A: Yes, so many fan works about Astor are full of original characters and the zine would not be complete without them. All original characters are welcome, very specifically including self insert and self ship characters. They are so welcome that we're making a yearbook page dedicated to original characters.
Q: How do I submit an original character to the zine yearbook page? A: Submit a simple school picture style portrait (feel free to make it silly) of your oc with: -Their name -Their relation to Astor (mentor, family, friend, significant other, weird dogs, etc) -The name you would like to be credited as and/or what fic or au they're from if applicable -A senior quote/superlative (if you want) And again, just to be clear, self insert and self ship characters are very much included in this!
Q: Mr. President there's been a second yearbook page. A: So many people have joked about Astor being a mass original character due to his lack of background and character development that if enough people submit the above for their fanon version of Astor we'll do an Oops! All Astors version of the yearbook page.
Q: Will there be physical merch? A: Possibly, still working out logistics. Proposals for physical merch are one of the categories of submissions, email [email protected] with ideas for things like pins, stickers, keychains, etc. Handmade items are welcome and encouraged if you have the time!
Q: Is NSFW content allowed? A: Yes, both art and writing. All submissions that include violence, gore, nudity, sex, etc will be marked as such. In the event that a physical zine is made there will be curated versions including a safe for work version. When you submit your works please include any potential content warnings. We'll be in contact if any works might need additional warnings. That said, no works will be censored. As mentioned above they will be clearly marked in the full version and omitted from the safe for work version. If you would like to submit a censored version of your work for the safe for work version, you may.
Q: I still have a question. A: Send me an ask, a message, email the submissions email, send a flock of birds to follow me around, reach me in my dreams, whatever. I have seen Galadriel treated as just one of Sauron's many victims and saw a post today. I won't pinpoint the post but it's something I've seen a while actually.
Galadriel isn't a damsel in distress but s2 doesn't help when she's held hostage for several episodes. But that's another post.
Hm. But I didn't say she was using Halbrand the same way he was using her. I brought up that she isn't fitting into the box of gendered victim. It's gendered, that fandom attempts to place her in that box even when she doesn't fit it. I brought up her actions to support that point, not to say that she used Halbrand via the same methods and the same scale and scope that Sauron used her.
Halbrand was always Sauron but my post was about what Galadriel knew and she believed Halbrand was a human man. She didn't know he was Sauron. Within her limited knowledge, I am speaking of what she did.
Galadriel is very clear about her intentions for a human man and she says that he can redeem his bloodline, that he's special, and that fate brought them together.
She, with all her rank and position that she lists in front of the Numenoroean court, flattered and singled out a human man about how grand a purpose he would have in following her to the Southlands.
I don't think it's overly villainizing Galadriel at all.
She is upfront about her intentions, yes. But the only reason the Halbrand character doesn't cow before her focus on him unlike Celebrimbor does before an emissary of the Valar telling him how special he is and how he can surpass his family's legacy is because the Halbrand character wasn't a human at all. [Also. I know the deception Annatar does with Celebrimbor about his true goals while Galadriel never hides her goals from Halbrand. This comparison is purely about the similarity of flattery and invocation of family. Sauron always deceives about his goals and Galadriel never does. That's the kind of nuance I'd like to see more in Galadriel meta].
I also don't believe I said that Galadriel deserved to be catfished. My point remains the point I was making from the beginning, which is about Galadriel being forced into the box of the gendered female victim beyond what's onscreen.
I agree that there is a desire to see characters as purely victims and victimizers which is what I was attempting to work around with my post. My pet peeve is the ironing out of Galadriel's flaws, when I love those flaws.
I agree with you about Sauron's and Galadriel's goals in s1.
My confusion in the de-exceptionalizing of Galadriel was in direct relation to making her a pure victim of Sauron, eliding past her actions, and transmitting the exact ways in which Sauron victimized others to her, despite there being an entire season to evaluate their dynamic on its own. A queer reading of Sauron can exist without doing that. I know it can because I've read those posts and metas analyzing Sauron to Adar, Celebrimbor, and Galadriel, and agreed.
Does it matter if the goal wasn't to diminish Galadriel or make her a victim if that's the end result? If Galadriel isn't a pure victim or damsel and there's more nuance than that, she shouldn't be made into that, for whatever purpose. There are ways to do a queer Sauron reading without overly victimizing Galadriel.

Hm, I touched on it a little because you brought it up but I didn't want to address romantic relationships in this post because this post was evaluating Galadriel and Sauron's dynamics as they are in canon without any romantic subtext. So, this post wasn't about a straight relationship: I even mention I used the ship tag for visibility but it's a general character post.
Sauron's relationships, including with Galadriel, are not canonized so I wanted to keep it very dry about the actions characters take.
And I'm a new viewer of TROP but a longtime reader of Tolkien so I'm quite familiar with that side of the world :)
Gennifer Hutchison who's a writer for TROP said that Sauron and Galadriel's relationship is different. She called it a relationship of equals. She went on to say that it's unlike the love bombing and manipulations of Celebrimbor in the second season. Galadriel is also using Halbrand in the first season which supports her point.
So why is there the insistence to de-exceptionalize Galadriel and insist that every way Sauron used and victimized Celebrimbor or even Adar can be transmitted to her?
The showrunners said that you've gotten to know Sauron by watching Halbrand.
Why the insistence then that the show started in s2 and Annatar is the way to understand Sauron's relationships? There's two seasons to watch with no need to make things up.
Galadriel isn't just prey that the dastardly villain preyed on that many of you want to make her be. A large part of s2 included her own culpability being listed for you and a large part of s1 included her agenda to take a human she met and use him as a tool against Sauron. She was telling this man she met he was very special, destined for greater things, and that their meeting was fate. Does the fact that he turned out to be Sauron erase the power differential she believed existed between an elf of her stature and a human?
From my point of view, many are forcing Galadriel into the box of female victim beyond what's on screen.

i spent most of yesterday designing my oc's living quarters in chb (due to reasons she doesnt belong to a cabin bc she doesnt get claimed and instead resides with chiron and is his intern (and niece))
i have never read any of the books nor watched a nanosecond of its adapted media; im purely going off of 3am wikipedia treks and my most recent greek mythology hyperfixation to seamlessly integrate my middle eastern muslim hijabi daughter of hades into the story.
and iM THRIVING
I can't fathom the fact that some people watch a movie, show or read a book they like and they just go: "I liked it :)" and that's it....girl how?? Whenever I like a movie, tv show, book or musical I need to inhale that piece of media like it's air, I need to self insert myself in it and create an elaborate plot line for my character in it, then I listen to music that reminds me of the piece of media and think of it 24/7, while obsessively rewatching scenes and analyzing every bit of it till I notice details nobody has seen, finally, I try to convince people to watch it with me so that I can experience it for the first time through them. Then my obsession dies and I feel empty until the next one comes along..... and you're telling me people can enjoy something and just...go to sleep and not think of it again????

i'll start this saying that i am a huge fan of canon divergent fics. what if this character didn't die, what if they were in a different house, what if this other couple had gotten together instead, those are all compelling ideas that could make really good fanfiction. i'm not a canon purist, i'm not opposed to rare pairs or crack ships, i find it very endearing when people get so deep in worldbuilding for a fanfic they build up levels of lore for background characters
but i also have a tendency to only really like those things when they fit into the logic of the pre existing world. if i happen to read a drarry fic, i don't want them to get together because harry suddenly realises the weasleys are secretly evil and draco is a poor manipulated boy and also incredibly sophisticated. i love marauders era fics but i get annoyed when snape is a one dimensional antagonist (you don't have to like him, you don't have to be on his side, but if you want to write him, you should at the very least take a moment to self reflect and understand him as a character because it will make the story BETTER)
i believe that we make better fanfiction and engage more critically with the problematics of the source material when we know it and understand it. i don't like how fatphobic harry potter is, or the underlying christian morality of it, or true love as the ultimate sacrifice, or the lack of depth of the (inexistent) gender utopia we are supposed to see in the wizarding world, but once i know those things are there and how they manifest themselves, i can work my way on my own writing to improve it
wanting to have the moral high ground of not engaging with the problematic parts of canon doesn't give you a medal or a pass to heaven, it just makes shallow puritanical writing that is only interesting if you're a teenager
the marauders fandom has always been insulated (and i want to make it clear that i DO include jily fans on this, it's your baby too and i don't care if it's ugly), and it's great to have a common lore to build up (marlene mckinnon and dorcas meadowes have been serving on marauders fanfiction for at least the one decade that i've been on the fandom and probably a lot more). the only issues here are assuming your interpretation of characters is the morally correct one and therefore changing who they are with no explanation, and assuming that interpretation has to be shared by anyone else in the fandom. to use op's metaphor, you can build your room at the house, you don't get to make everyone else live there with you
I think what bothers me about folks saying “canon doesn’t matter” is that the spirit of fandom is this concept of a house with no roof. There’s intent of the author, but then there’s interpretation and using evidence from the text to build new meaning. Within the structure of canon, how tall can you build? What can you take from the original context and expand or critique? (Basically, take canon, ask questions like, ‘haha what if these two characters who are best friends in the book fucked either other???’)
But the thing is, instead of building within the original foundations, folks are building entirely new foundations. There isn’t any inherently wrong about fanon, but you don’t get to build a new house with new rules in the lot next door, tell everyone that we all live in the new house now, and burn down the old one while people are still in it. Some of us want to live in the old house and make improvements. That’s not a bad thing.
(Also, you took parts of the old house, particularly the flashy bits that don’t really add quality to the overall structure, to build the new one and then claim “it’s better.”)
Don’t say shit like, “Canon was created by a horrible person so we’re going to ignore it!” God, you don’t get to pick and choose because the characters were literally created by the horrible person! You gotta accept that you are not morally superior to people who use canon to create transformative fic/art.
My point is, if you’re going to change stuff in a fandom that is probably older than you, don’t claim the moral high ground because you’re playing in the exact same garbage patch as the rest of us, and even if you try to cover up your corner with pretty aesthetics, you know we all live in a garbage dump together.
