this is my element (+ album)
asking me to pick my fave album is like asking an orphan matron to pick her favorite baby boy
thats some weird and cruel circumstances to put upon me i feel like it changes every damn week like a rota
i mean what if my beats misbehave and i gotta put 'em in time out i cant play permanent on that theyre too cute
but yknow what i can show you one thing thats been on my mind lately
===
so when i was a kid we had this skateboard vid by "element skateboards" on DVD
they were this skateboard kit slash apparel company that was all about progressivism and shit and they did these much lauded comp tapes of dudes riding around on their boards and doing the dopest of macho tricks on the shit
flipping it turnways
putting the rock in the house like a big man
we had some of their merch actually
===
so anyways the one we had back then was This Is My Element
released 2007
mostly clips from cali i think and i mean the camerawork is fucking insane on some of those shots
this is gonna sound lame as fuck but i prob spent so many cumulative hours just peelin through the footage and ogling the shit outta it
that framing was tight
===
so you may be asking yourself or me
dave you genuine dicksucker i asked about your fav album not your favorite sordid ass display of smooth dudes hardcore riding and grinding them boards in public dude you have a problem
ok well that wasnt a question first of all so jot that down
but anyways to THAT i say
listen to the music
the whole thing has an original soundtrack of ambient beats
got some abstract hip hop jams, got some more indie stuff, lots of acoustic sampling
HELLA underground
and basically every track minus one is done by sampler beast david p. madson AKA "odd nosdam"
dude is my hero seriously
he is the master of the beat machine i shit you not hes always been kinda my idol on this stuff
aside from bro obviously
===
obviously.
===
anyways he had an E-mu SP-1200 which is a really oldschool sampler invented by dave rossum in the late 80s
revolutionary to the hip hop scene
nosdam had this mega distinct sound to his music that i always wanted to replicate on my own beats
still do
i dont know for sure if he used it on T.I.M.E. but he uses some of the same samples from "vol. 9" which was exclusively SP-1200 so im gonna get a lil j’accuzi on that
it couldve been a boss dr sampler SP-202 though idk
he had one of those
===
so aside from beating the shit out of the pause/resume button to flip my whole cranium at the cinematography or whatever i would also kinda play it on loop to listen to the soundtrack and space out at 2am
the lonely broner seemed to free his mind at night
ok shit broner is good but i didnt mean it like that
that was goofy lets just keep movin
it was the only way i had to listen to it back then but i mean the video is 50 mins long so its basically just an odd nosdam album with accompanying ambient skater sounds and random expletives and whatever
random car sequence
yknow what i dont think people respect enough?
the dude who catches all the "mad stunts yo" on camera
i swear to god at least half the time hes ALSO on a board and that shit is bananas to me
bros gotta be on some whole other level of zen to skate good AND catch all them glamor shots of his fellow skater
thats like an express ticket to the ER imo
the ambulance is already on the scene watching you like an eager crow watches a half dead dog
===
ok gonna go ahead and lay it out flat
not great on a board myself
kinda dogshit at it actually
so maybe im not exactly an arbitrator of skateboard heinousness
but i always kinda liked watching THEM do it i mean who doesnt?
whats an even crazier layer to stack on the "dave" cake is
and dirk told me this because unfortunately it kinda happened post-2009
he would do all these collabs with one of my childhood favorite underground rappers david cohn aka serengeti
surrounded by daves left and right dude even before all the time travel horseshit
thats like
serendipitous as fuck i think!
===
if sburb was just a revolving door of artists called dave that i could bump fists with
instead of other mes in various states of aliveness tending toward extremely dead
i wouldve probably given it something higher than 2 stars on my TGN review
===
so yeah you ask me my favorite album its T.I.M.E. by odd nosdam i guess
bump that shit on a walk your mind will go places unknown to man
#dave strider#homestuck#comix#this is my element#the way i drew dave posing here is rly heavily inspired by askinsufferableprick btw#welcome to strider infodump hours

Can I request a drabble where Rolan overheard that gn Tav genuinely thought Rolan still hates them but just learnt to tolerate them? When in reality, he's been in denial about his crush on them for the longest time but accepted it recently 🤣
First of all— I am sorry that this took so long for me to get to. I rarely find time for asks and it took me awhile to get to this one— some of these I just needed more practice for tbh. I am striving to be better, however I am incredibly busy at work so I cannot promise you I always will be. Instead I promise you that I will always try to make your ask worth the wait.
Words Yet Unsaid
Rolan x Reader, SFW, only lightly edited
Word Count: 1214
Tags: Misunderstandings, fluff, and love confessions
Rolan sits down in front of you with a huff. There is a flush about his face that is so… him. The color on his cheeks paints a starker backdrop for the freckles that dot his face. Despite your so-called nerves of steel you cannot help but quickly glance away from the sight as your heart began to race in your chest.
The silence stretches and you look back across to find him nervously studying the wood grain of the table between you.
Sensing your gaze, he straightens up and clears his throat. He smoothes the simple but well-made dark blue tunic he’d worn with the tight leather breeches you could not help but notice as he’d joined you.
The color he’d chosen suited him well. Distracting you almost as much as the way his bottom and thighs had looked, no longer hidden behind the wizard robes. This was the first time you had ever seen him in at the tavern in casual clothes — sharp as these were.
The Elfsong Tavern was usually a good place to identify oneself as a great and powerful archwizard. But instead, he’d chosen to dress up and blend in with you. But why?
You tried not to let the racing of your heart, and the flush of your cheeks hide you from the cold truth that Rolan had never liked you. You were certain that this meeting he had arranged through Lia, was some sort of attempt at arbitration of your longstanding feud for the sake of his siblings.
Truth be told you had never wanted to fight with Rolan. It just happened every time you two had interacted since the very first time you’d crossed paths in the Druid’s Grove. That ire had only grown through the experiences that followed in the Shadow Cursed Lands and even when you’d slain his corrupt master and ended his apprenticeship abruptly.
So much pressure had instantly been thrust upon him, becoming master of the tower and archwizard of Baldur’s Gate so suddenly. Of course he’d be frustrated further by you.
Despite your best attempts to avoid him, your friendship with his siblings had caused you to repeatedly cross paths. It had been months now since the restoration of the city was considered complete, after you had ended the crisis. You’d attempted to returned to a normal life.
It was simple and gratifying, but something was missing.
“Thank you for joining me here this evening, you look lovely”
His tone cut through your thoughts; it sounded warm but a quick glance to his face revealed that warmth didn’t reach past his words. He looked… uncomfortable. Like your presence somehow pained him.
Tears sting in your eyes as you clear your throat and quickly stand.
“This was a bad idea.”
He opens his mouth, and his hand moves across the table like he’s reaching for you. Before he can form a word you continue.
“I’m sorry for wasting your time, I can tell this isn’t something you want to be doing”
You turn quickly to leave before he can say anything and before the tears you feel welling up are too much to hide. Your stride is quick and sure across the familiar boards of the tavern and out on to the streets that raised you.
The cool night air of the city was an immediate balm for the panic that had caused you to flee the tavern. All you needed to do was avoid Rolan for the rest of your life now, great.
You groan as you continued down the dark and empty streets. All of this weighs heavy on you but it becomes unbearable when the low roofs of the houses and shops fall away. As the street spills out into the open area which reveals Sorceress Sundries and the large structure which you knew was the point of travel for Ramazith Tower — the massive and beautiful wizard tower Rolan now called home.
It is as if the weight of the massive structure itself is on you now and you are stopped in your tracks. It’s then you hear your name called and the sound of someone running after you in the dark.
“Tav, wait! Please!”
You turn quickly to see Rolan sprint after you, still somehow looking perfect in his nice clothes despite the struggle of catching up to you. You glower momentarily at the thought that he will apparently always be gorgeous. Typical.
He catches up to you, huffing and puffing as his tail lashes out to steady him while he catches his breath.
“Why would you run after me?” You say with a whisper and you take a step closer to him, unsure if you’re needed to render aid for the struggling man.
“I… I’m sorry… I don’t hate… you… Tav….” He puffs out the words as he catches his breath.
Your blood runs cold at the words. It’s like you can feel the night breeze itself move through you.
“Rolan…”
You don’t know how to continue, and it gives him the opportunity to catch his breath and explain himself further.
“I’m sorry I shouldn’t have tried something so public to talk, Lia warned me, she didn’t say you’d run but…”
He sensed he was rambling and shook his head as if to clear it and start over. Your breath caught when his jaw tensed, the perfect bone structure always so eye catching, so hard to resist.
“I needed to tell you Tav, I don’t hate you. I… I overhead you talking to Cal and Lia about why you keep your distance when they invite you for dinner. I.. I should have apologized better — after all we had gone through—“
“We should have found time to talk…” You add
He takes a step closer to you, as if drawn to you and this time you don’t run.
“Why… Why would you run after me Rolan?” You ask
“Tav…”
“Why do you even care now?”
You can’t help it. The tears that had threatened you earlier, now spill down your cheeks as you pepper Rolan with questions.
He closes the distance to you quickly, his hands on your cheeks. You barely register the softness of the pads of his thumbs as they brush the tears away from your cheeks before you are swept away by the feeling of his lips, crashing into yours.
Your breath catches in your throat. You can’t help but moan into the kiss as his body presses firmly to yours.
He breaks the kiss and presses his forehead to yours and you feel his tail coil around your thigh. Keeping you flush with him as he speaks.
“Because, Tav… I love you. I think I have always…” He gasped as if the realization fully dawned on him as he spoke, “I think I have always loved you.”
You kiss him now, no words on your tongue could be sweeter than to feel his lips against yours once more.
There would be time for words but for right now you wanted to keep kissing the wizard and so you do.
Under the open skies and the stars that shine each night over the city of Baldur’s Gate, wrapped in the strong arms of the man you loved, you kissed him with all the passion of the words in your heart yet unsaid.

Watching House as a kid and rewatching it as an employed adult is crazy like. In 2008 I was like. Of course they go to Cuddy for joint custody arbitration, it involves House and Wilson, so who else could impose a decision? and in 2024 I am like. No sane person would go to their boss to mediate their entirely personal problems, even if and especially if you all work at the same place, and any administrator with their wits about them will be like. Nope. Getting involved in employees’ personal relationships is asking for litigation. Take it elsewhere. House and Wilson would never sue Cuddy and even if they did, they are professional equals and one is on the board and House has tenure and whatnot so the grounds would be flimsy, but Amber could actually have cause of action and we know she’s cutthroat. But Cuddy knew that indulging them was the only way because House and Wilson were just Like That. The show of all time.

What are your thoughts on Police Unions and calls to have them thrown out of the AFL CIO?
The last time that police unions actually acted like unions was the Boston police strike of 1919 (that unfortunately catapulted Cal Coolidge into national political prominence). After that, the basic labor relations between the state and police unions began to change in ways that are not recognizable as standard trade unionism.
The shift really began in the 1930s, when the rise of industrial unionism and attendant strike activity scared the shit out of the employers and their allies in government, because the usual Pinkertons and American Legion thugs were not enough to keep a lid on the situation. Hence the need to keep the police unions on the side of the employers rather than allow any possibility of siding with the strikers - thus you start to see police unions getting easily recognized, wage increases getting thrown around like candy, anything to keep the strikebreakers sweet.
However, it particularly morphed during the Second Great Migration (1940s through 1970), when the sudden emergence or at least rapid expansion of black populations in Northeastern, Midwestern, and Western cities scared the shit out of the municipal establishment in similar, yet distinct ways than the earlier union uprising had. In this period, an informal understanding was reached that the elected officials would block, slow-walk, or otherwise frustrate attempts by activists to impose accountability on police through civilian complaint review boards and other mechanisms, in exchange for police making upholding the racial hierarchy one of their enforcement priorities.
The expansion of grievance and arbitration procedures to include shootings and other acts of police brutality, written reprimands and other punishments from management, civilian complaints of abuse of power, officers' misconduct records and the extent to which they could be made public or even shared with future employers - the whole intricate mechanism by which police union contracts were turned into a bulwark against accountability - was part of this quid-pro-quo alliance between the state and police in the face of the emergent civil rights movement.
That's part of what slightly gives me pause about the left critique of police union contracts, because I think this alliance would have been constructed, maintained, and expanded over the decades whether or not police were unionized. The means would have been different, probably exercised through city charters, local ordinances, judicial precedents (even more so), but the ends would be the same. And if activists actually managed to eliminate a police union contract today, I'm absolutely confident that municipal government would rebuild it the next day, because they're absolutely scared of police slowdowns.
As to chucking them out of the AFL-CIO, it's not a bad thing per se, but I do want people to understand that it would be purely symbolic. The AFL-CIO is a union federation, it doesn't really have much in the way of direct authority over member unions, or exclusive access to resources that outpace what the member unions have. To give a historical example, the AFL-CIO expelled the Teamsters back in the 50s for being mobbed-up and it didn't change the Teamsters one bit - they kept on being mobbed-up until the Teamsters for a Democratic Union challenged the Hoffaites in the 70s and the Justice Department went after them with RICO charges in the 80s.

Amazon argues that national labor board is unconstitutional, joining SpaceX and Trader Joe’s
Amazon is arguing in a legal filing that the 88-year-old National Labor Relations Board is unconstitutional, echoing similar arguments made this year by Elon Musk’s SpaceX and the grocery store chain Trader Joe’s in disputes about workers’ rights and organizing.
The Amazon filing, made Thursday, came in response to a case before an administrative law judge overseeing a complaint from agency prosecutors who allege the company unlawfully retaliated against workers at a New York City warehouse who voted to unionize nearly two years ago.
In its filing, Amazon denies many of the charges and asks for the complaint to be dismissed. The company’s attorneys then go further, arguing that the structure of the agency — particularly limits on the removal of administrative law judges and five board members appointed by the president — violates the separation of powers and infringes on executive powers stipulated in the Constitution.
The attorneys also argue that NLRB proceedings deny the company a trial by a jury and violate its due-process rights under the Fifth Amendment. (source)
ICYMI, this is a case of corporations going, “7th Amendment Protections for me, but not for thee.”
It is strongly worth noting that in 2018 the John Roberts Court ruled 5-4 that companies can use forced arbitration clauses to stop people from joining together to fight workplace abuses - in effect denying individuals their 7th Amendment protections.
Subsequently, binding arbitration clauses used by corporations has proliferated; sneaking into all manner of common legal documents: personal banking applications, ordinary car loan applications, furniture purchases, and more. This is, unsurprisingly, a direct violation of the 7th Amendment that guarantees HUMAN BEINGS AND PEOPLE the right to a jury trial in certain civil cases and inhibits courts from overturning a jury's findings of fact. Republicans and SCOTUS are perfectly okay with corporations having more rights than workers and using forced arbitration to block people from having access to jury trials—but God forbid if corporations don’t have their right to a jury trial.
This legislative push to bestow corporations with more rights than people, while simultaneously taking away rights from human beings, has been nothing if not thoroughly and methodically done. At this rate, no corporation will ever need to fear a class action lawsuit again.
Amazon, SpaceX and Trader Joe’s are union busting.
But this latest case against the NLRB isn’t just an attack on labor and worker’s rights, it’s a fascistic attack on the very heart of fairness and democracy itself.

The union representing thousands of railroaders has appealed the moves that ended the rail shutdown last week — a work stoppage that halted freight and commuter traffic across the country. In filings to the Federal Court of Appeal, the Teamsters union challenged directives for binding arbitration issued to a labour board by federal Labour Minister Steven MacKinnon last week, less than a day after the lockout of 9,300 workers by Canadian National Railway Co. and Canadian Pacific Kansas City Ltd. In response to MacKinnon’s instructions, the Canada Industrial Relations Board ordered the country’s two major railways to resume operations and employees to return to their posts until binding arbitration could produce new contracts.

Did New Jeans misread contract terms in their quest to cancel without court action?
A commenter in a Soompi article “Breaking: NewJeans Announces Departure From ADOR” released today, left some information about standard clauses in an artist’s contract. It appears the girls may be misreading some of the clauses which leads to their belief they can terminate the contract without court action. The girls need an entertainment lawyer.
Parsing some terms from the Standard Exclusive Contract for Popular Culture and Arts Persons (Singer Focus) - the likely agreement under which New Jeans entered into with Ador - however, we may gain some insights into how the legal procedures may play out.
Article 16, paragraph 1: "If either the ' Planner' or the ' Singer' violates the provisions of this Agreement, the other party may demand that the at-fault party correct the violation within a period of 14 days, and if the violation is not corrected or cannot be corrected within that period, the other party may cancel or terminate the contract and claim damages." This seems to be the '14-day' term that New Jeans is basing their termination right on.
Also… "However, if there is a justifiable reason for the delay in correcting the violation, the correction period may be extended by up to 14 days from the date of correction." Perhaps Ador/Hybe tried to extend the period with their last minute letter? Perhaps they submitted a 'justifiable reason for the delay'? What's the definition of 'justifiable' and who decides?
Article 16, paragraph 2: If the ‘singer’ violates the terms of the contract with the purpose of unilaterally canceling the contract during the contract period despite the ‘planner’ faithfully performing his/her obligations according to the terms of the contract, the ‘singer’ shall, in addition to the damages under paragraph 1, pay to the ‘planner’ a penalty equal to the average monthly sales for the two years immediately preceding the time of termination of the contract multiplied by the number of months in the remaining contract period ( if the ‘ singer ’s ’ popular culture and arts service period is less than two years, the amount calculated by multiplying the average monthly sales during the period in which actual sales were generated by the number of months in the remaining contract period). There's roughly 60 additional months left in the contract. Rough estimates have put the potential penalty at around 300 Billion KRW (~US$215 Million, as of Nov 29 2024).
Just because the New Jeans members declare that they are terminating their contract doesn't mean it takes effect. I'm surprised that they aren't aware of this. Or more specifically that their legal counsel did not spell this out for them.
Mediation by the Content Dispute Mediation Committee
Coordination by the Korea Copyright Commission
Arbitration by the Korean Commercial Arbitration Board
Article 18, paragraph 3: "If the procedure pursuant to Paragraph 2 is not carried out, the resolution of disputes regarding this Agreement shall be through litigation procedures pursuant to the Civil Procedure Act."
If the clause below include advertising as part of 'popular culture and arts services with a third party', how do the members expect to fulfill their existing obligations if they are no longer affiliated with Ador, which is the likely contracting party with advertisers? If by chance the advertisers decide to distance themselves from this affair and request indemnity, will Ador be able to in turn sue New Jeans members for non-performance to recoup lost revenue?
Article 5, paragraph 2: “The ' Planner' has the authority to negotiate and adjust the terms and conditions of the contract and the method of performance, etc. regarding the ' Singer 's' popular culture and arts services with a third party on behalf of the ' Singer' and enter into a contract. However, the contents and schedule of the contract, etc. must be explained to the ' Singer ' in advance, and a contract cannot be entered into that goes against the ' Singer 's ' explicit expression of intent.”
The members may want to brace for impact. They should expect to run into a bunch of brick walls along their upcoming life journey. Good luck!

"FELL, KICK AGED MAN AS STRIKE WARMS UP," Toronto Star. February 20, 1934. Page 2. ---- Assault Charge Is Laid, Making Third Arrest in Kitchener Disturbances ---- Special to The Star Kitchener, Feb. 20. - The number of arrests in Kitchener's furniture strike disorders totalled three to-day when police took into custody Alex Nezninoi on a charge of assault. The charge followed a brief flurry at the plant of the Brandt Furniture Co. to-day when an aged man was knocked down and kicked, allegedly by picketers and strike sympathizers.
In the meantime Wilfred Oliver and George Stuebing, arrested last night, were admitted to bail and were awaiting a court hearing on charges of obstructing an officer. Police charge that when a constable sought to rescue a strike-breaker from a roughing at the hands of picketers he was obstructed by the two men.
City council has moved for arbitration in an effort to iron out difficulties and to prevent spread of trouble. A committee consisting of Aldermen Hearn, Mullins and Meinzinger was named to study the situation and to try to bring representatives of the manufacturers and workers together for a conference to-morrow.
The plant of the De Luxe Co. is still tied up, with no settlement in prospect. The Reliable Manufacturing Co. management refuses to dis- cuss a settlement with the union as at present constituted.
At the Brandt plant to-day some W men who reported for work yesterday remained away while some new workers reported.

Women's sports is for women. Subpar or older male athletes can try something else or just retire with dignity
By Amy HammJuly 30, 2024
The Canadian Powerlifting Union (CPU) has issued a six-month suspension to Anne Andres, a trans identified male competing in women’s powerlifting, for uttering threats and engaging in a campaign of harassment towards several women and sports officials.
Andre’s six-month suspension was recommended by ITP Sports, an arbitrator brought in by the CPU after Andres targeted several women, as well at the Alberta Powerlifting Union (APU), and the CPU, with abuse, death threats, and harassment. In their disciplinary ruling, made based on the decisions of a panel, the CPU deemed Andres’ words “harmful, disparaging, insulting, or otherwise negative.”
In his response to the original complaint which led to his suspension, Andres simply said “Fuck the APU.” They noted that Andres demonstrated “a lack of remorse” despite having removed several of his harassing posts from his social media accounts.
Andres’ conduct included threatening to commit suicide if the APU refused to comply with his demands, lying about having been banned from the female sports category, and bullying and harassing the APU’s executive board.

It looked like a man punching a woman. Algeria’s Imane Khelif, at 5’10”, is only two inches taller than Italy’s Angela Carini; but watching the two in the ring of the women’s 66kg boxing at the Olympics, the difference between them was painfully obvious. Khelif’s hard, rangy body had more reach, and more power. After taking two ferocious blows, Carini abandoned the bout, receiving the final result in devastated tears.
It looked like a man punching a woman because, according to the International Boxing Association, Khelif is not a woman. In 2023, Khelif was disqualified from the World Boxing Championships along with Taiwan’s Lin Yu-ting — “a result of their failure to meet the eligibility criteria for participating in the women’s competition”. This decision was based, not on testosterone levels, but on “a separate and recognised test, whereby the specifics remain confidential”.
A Russian-language statement (the IBA is Russian-led) put it more bluntly: “Based on the results of DNA tests, we identified a number of athletes who tried to deceive their colleagues and pretended to be women. Based on the results of the tests, it was proven that they have XY chromosomes.” Lin did not appeal, while Khelif initiated an appeal and then withdrew it, meaning that in both cases, the judgement became legally binding.

Why More ARB Hearings in Some Counties
The Appraisal Review Board (ARB) marks the second phase in a three-step process. The initial two phases, informal hearings, and ARB hearings, collectively termed “administrative hearings,” precede it. Following these, property owners can opt for 1) binding arbitration, 2) court appeal, 3) State Office of Administrative Hearings (SOAH) or take no action. After the ARB, approximately 98% of owners opt for no action.
