I owe my Trump-supporting friends an apology. I’ve been critical of the Trump presidency and am still exhausted from the experience.

But to be fair, President Trump wasn’t that bad, other than:

• lost those children in the bureaucracy

• tear-gassed peaceful protesters on Lafayette Square so he could hold a photo op holding a Bible in front of a church

• got impeached again

• had the worst jobs record of any president in modern history

• pressured Ukraine to dig dirt on Joe Biden

• fired the FBI director for investigating his ties to Russia

• bragged about firing the FBI director on TV

• took Vladimir Putin’s word over the US intelligence community

• diverted military funding to build his wall

• caused the longest government shutdown in US history

• called Black Lives Matter a “symbol of hate”

• lied nearly 40,000 times

• banned transgender people from serving in the military

• ejected reporters from the White House briefing room who asked tough questions

• vetoed the defense funding bill because it renamed military bases named for Confederate soldiers

• refused to release his tax returns

• increased the national debt by nearly $8 trillion

Things the Biden-Harris Administration Did This Week #29

President Biden announced his plan to reform the Supreme Court and make sure no President is above the law. The conservative majority on the court ruled that Trump has "absolute immunity" from any prosecution for "official acts" while he was President. In response President Biden is calling for a constitutional amendment to make it clear that Presidents aren't above the law and don't have immunity from prosecution for crimes committed while in office. In response to a wide ranging corruption scandal involving Justice Clarence Thomas, President Biden called on Congress to pass a legally binding code of ethics for the Supreme Court. The code would force Justices to disclose gifts, refrain from public political actions, and force them to recuse themselves from cases in which they or their spouses have conflicts of interest. President Biden also endorsed the idea of term limits for the Justices.

The Biden Administration sent out an email to everyone who has a federal student loan informing them of upcoming debt relief. The debt relief plan will bring the total number of a borrowers who've gotten relief from the Biden-Harris Administration to 30 million. The plan is due to be finalized this fall, and the Department of Education wanted to alert people early to allow them to be ready to quickly take advantage of it when it was in place and get relief as soon as possible.

President Biden announced that the federal government would step in and protect the pension of 600,000 Teamsters. Under the American Rescue Plan, passed by President Biden and the Democrats with no Republican votes, the government was empowered to bail out Union retirement funds which in recent years have faced devastating cut of up to 75% in some cases, leaving retired union workers in desperate situations. The Teamster union is just the latest in a number of such pension protections the President has done in office.

President Biden and Vice-President Harris oversaw the dramatic release of American hostages from Russia. Wall Street Journal reporter Evan Gershkovich, former Marine Paul Whelan held since 2018, Russian-American reporter for Radio Free Europe/Radio Liberty Alsu Kurmasheva convicted of criticizing the Russian Military, were all released from captivity and returned to the US at around midnight August 2nd. They were greeted on the tarmac by the President and Vice-President and their waiting families. The deal also secured the release of German medical worker Rico Krieger sentenced to death in Belarus, Russian-British opposition figure Vladimir Kara-Murza, and 11 Russians convicted of opposing the war against Ukraine or being involved in Alexei Navalny's anti-corruption organization. Early drafts of the hostage deal were meant to include Navalny before his death in Russian custody early this year.

A new Biden Administration rule banning discrimination against LGBT students takes effect, but faces major Republican resistance. The new rule declares that Title IX protects Queer students from discrimination in public schools and any college that takes federal funds. The new rule also expands protections for victims of sexual misconduct and pregnant or parenting students. However Republican resistance means the rule can't take effect nation wide. Lawsuits from Republican controlled states, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia and Wyoming, means the new protections won't come into effect those states till the case is ruled on likely in a Supreme Court ruling. The Biden administration crafted these Title IX rules to reflect the Supreme Court's 2020 Bostock case.

The Biden administration awarded $2 billion to black and minority farmers who were the victims of historic discrimination. Historically black farmers have been denied important loans from the USDA, or given smaller amounts than white farmers. This massive investment will grant 23,000 minority farmers between $10,000 and $500,000 each and a further 20,000 people who wanted to start farms by were improperly denied the loans they needed between $3,500-$6,000 to get started. Most payments went to farmers in Mississippi and Alabama.

The Biden Administration took an important step to stop the criminalization of poverty by changing child safety guidelines so that poverty alone isn't grounds for taking a child into foster care. Studies show that children able to stay with parents or other family have much better outcomes then those separated. Many states have already removed poverty from their guidelines when it comes to removing children from the home, and the HHS guidelines push the remaining states to do the same.

Vice-President Harris announced the Biden Administration's agreement to a plan by North Carolina to forgive the state's medical debt. The plan by Democratic Governor Roy Cooper would forgive the medical debt of 2 million people in the state. North Carolina has the 3rd highest rate of medical debt in the nation. Vice-President Harris applauded the plan, pointing out that the Biden Administration has forgiven $650 million dollars worth of medical debt so far with plans to forgive up to $7 billion by 2026. The Vice-President unveiled plans to exclude medical debt from credit scores and issued a call for states and local governments to forgive debt, like North Carolina is, last month.

The Department of Transportation put forward a new rule to bank junk fees for family air travel. The new rule forces airlines to seat parents next to their children, with no extra cost. Currently parents are forced to pay extra to assure they are seated next to their children, no matter what age, if they don't they run the risk of being separated on a long flight. Airlines would be required to seat children age 13 and under with their parent or accompanying adult at no extra charge.

The Department of Housing and Urban Development announced it is giving $3.5 billion to combat homelessness. This represents the single largest one year investment in fighting homelessness in HUD's history. The money will be distributed by grants to local organizations and programs. HUD has a special focus on survivors of domestic violence, youth homeless, and people experiencing the unique challenges of homelessness in rural areas.

The Treasury Department announced that Pennsylvania and New Mexico would be joining the IRS' direct file program for 2025. The program was tested as a pilot in a number of states in 2024, saving 140,000 tax payers $5.6 million in filing charges and getting tax returns of $90 million. The program, paid for by President Biden's Inflation Reduction Act, will be available to all 50 states, but Republicans strong object. Pennsylvania and New Mexico join Oregon and New Jersey in being new states to join.

Over the past month, we’ve watched an astonishing, high-stakes global drama play out in The Hague. A group of countries from the poorer, less powerful bloc some call the global south, led by South Africa, dragged the government of Israel and, by extension, its rich, powerful allies into the top court of the Western rules-based order and accused Israel of prosecuting a brutal war in Gaza that is “genocidal in character.”

The responses to this presentation from the leading nations of that order were quick and blunt.

“Completely unjustified and wrong,” said a statement from Rishi Sunak, Britain’s prime minister.

“Meritless, counterproductive and completely without any basis in fact whatsoever,” said John Kirby, a spokesman for the United States National Security Council.

“The accusation has no basis in fact,” a German government spokesman said, adding that Germany opposed the “political instrumentalization” of the genocide statute.

But on Friday, that court had its say, issuing a sober and careful provisional ruling that doubled as a rebuke to those dismissals. In granting provisional measures, the court affirmed that some of South Africa’s allegations were plausible and called on Israel to take immediate steps to protect civilians, increase the amount of humanitarian aid and punish officials who engaged in violent and incendiary speech. The court stopped short of calling for a cease-fire, but it granted South Africa’s request for provisional measures to prevent further civilian death. For the most part, the court ruled in favor of the global south.[...]

The court was not asked to rule on whether Israel had in fact committed genocide, a matter that is likely to take years to adjudicate. Whatever the eventual outcome of the case, it sets up an epic battle over the meaning and values of the so-called rules-based order. If these rules don’t apply when powerful countries don’t want them to, are they rules at all?

“As long as those who make rules enforce them against others while believing that they and their allies are above those rules, the international governance system is in trouble,” Thuli Madonsela, one of South Africa’s leading legal minds and an architect of its post-apartheid Constitution, told me. “We say these rules are the rules when Russia invades Ukraine or when the Rohingya are being massacred by Myanmar, but if it’s now Israel butchering Palestinians, depriving them of food, displacing them en masse, then the rules don’t apply and whoever tries to apply the rules is antisemitic? It is really putting those rules in jeopardy.”[...]

The military campaign has “wreaked more destruction than the razing of Syria’s Aleppo between 2012 and 2016, Ukraine’s Mariupol or, proportionally, the Allied bombing of Germany in World War II,” the report quoted researchers as saying. The researchers, hardly some raving left-wing activists, are experts cited in one of the most respected news organizations in the world, The Associated Press.[...]

The International Court of Justice issued a nonbinding opinion in 2004 that the security barriers Israel was erecting in the West Bank violated international law, but that ruling has had no effect. The walls still stand.[...]

Indeed, what is a rules-based system if the rules apply only selectively and if seeking to apply them to certain countries is viewed as self-evidently prejudiced? To put it more simply, is there no venue in the international system to which the stateless people of Palestine and their allies and friends can go to seek redress amid the slaughter in Gaza? And if not, what are they to do?

For the cause of Palestinian statehood, every alternative to violence has been virtually snuffed out, in part because Israel’s allies have helped to discredit them. The most recent example is the boycott, divestment and sanctions movement that has, in many places, been successfully tarred as antisemitic or even banned altogether. Efforts to use the United Nations Security Council have drawn U.S. vetoes for decades. Is seeking redress at the appropriate venue for alleged violations of international law also antisemitic, as Israel’s defense minister said on Friday? Does no law apply to Israel? Are there no limits to what it may do to defend itself?[...]

The Biden administration has made the shoring up of the international rules-based order a centerpiece of its foreign policy but, unsurprisingly, has struggled to live up to that aspiration.[...]

Occasionally straying from your principles because circumstances require it is very different from being seen to have no principles at all, and that is precisely how much of the global south has come to regard the United States.

It seems especially shortsighted in these times that the Biden administration elected to wave away the carefully documented case prepared by South Africa. One of the biggest threats to the rules-based international order is the growing consensus in the poor world that the rich world will apply those rules selectively, at its discretion, when it suits the powerful nations that make up the global north, such as when Russia invaded Ukraine.[...]

As far as the rules-based order is concerned, when it comes to crimes like genocide and ethnic cleansing, it simply does not matter who started it. [...] The best way to shore up the rules-based order is to be seen, in word and deed, as committing to the institutions and moral commitments of that order.

So some might be wondering why do I constantly say if Trump gets back in office, he won’t leave?

Now this is not fear mongering on my part as I have several reasons why. Let’s not forget during his first presidency he not only praised China’s dictator for having an infinite term but wanted to be “president for life”:

And couple that with the January 6th incident and him not peacefully relinquishing power to Biden, it is a VERY SAFE BET to assume should he get his 34 count Convicted Felon ass BACK into the White House, he certainly won’t be leaving unless it’s in a body bag and IF we have elections in 2028, they’ll be the “elections” they have in Russia that his good friend Putin has.

↬ The Westminster Aquamarines

The Sunderlandian royal family has several magnificent parures of aquamarine jewellery. One of these collections, the Westminster Aquamarines, features some of the royal family’s oldest and most iconic jewels; uncovering their history takes us back nearly two hundred years. In 1830s, Sunderland was a lone constitutional monarchy in North America, bordered by the United States in the northeast and Mexico to the southwest. The early 19th century had seen the country’s steady expansion westward thanks to territorial acquisitions from the Spanish and British. This period of territorial and economic growth, however, was cut short by the early death of Sunderland’s Hereditary Prince in 1835. Hereditary Prince Frederick James was just shy of thirty, the only son of King Louis III and his beloved first wife, Princess Amelia of the United Kingdom. Freddie was also the only legitimate male-line grandson of King Louis II, as a result, his death complicated Sunderland’s succession. The question of who would succeed Louis III ignited a fierce rivalry among the King’s younger brothers, as they scrambled to marry and produce an heir to the throne. The Duke of Lennox and St. George, the King’s first brother and heir presumptive, married an obscure German princess. The Duke of Glencairn, the King’s second brother, married the daughter of a wealthy British statesman. But it was the King’s fifth brother, Prince Augustus, the Duke of Westminster, who looked for a bride closer to home. Lady Martha Whitley was twenty years younger than her husband-to-be, a descendant of the Prussian nobility that migrated to Sunderland following the election of Prince Heinrich of Prussia as King Louis I of Sunderland, Martha hailed from one of Sunderland’s oldest aristocratic families. Unlike some of her foreign, and significantly younger, sisters-in-law Martha was shrewd and held a deep familiarity of Sunderland's court life, this was reflected in her impressive jewelry collection. On her wedding day, Martha was gifted a small box of aquamarine pendants of various shapes and sizes. As Martha’s prominence at court grew, the aquamarines became known as the Duchess of Westminster’s Aquamarines. Over the years, the Duchess incorporated the aquamarines into a few pieces of jewelry including a necklace and a pair of earrings. The tensions surrounding Sunderland’s succession died down when the British-born Prince George of Glencairn became king in 1860. By then Westminsters had three children, Prince Louis, who became Duke of Westminster following his father’s death in 1877; Prince Thomas, and Princess Elizabeth Anne. The family was popular with nobility and the public alike, but they weren’t without their scandals. After Prince Louis enraged King George by marrying without permission, his subsequent children were declared illegitimate and barred from inheritance. Finding a suitable wife for Prince Thomas, now heir to the Westminster Dukedom, became a top priority. In 1876, Prince Thomas met and fell in love with Princess Marie of Hanover, a male-line great-granddaughter of King George III and therefore a British princess. The couple married in 1880, but struggled to have children. In 1887, their only surviving child was born in the presence of Queen Alexandra. The little princess, given the lengthy name Alexandra Anne Martha Georgina Dagmar Gloriana Marie, would be known to history as Princess Anne of Westminster. Growing up, Anne was placed in the direct care of her Dear Granny Martha.

The Duchess of Westminster had high hopes for her only male-line granddaughter. Indeed, Anne’s maternal cousins were well-connected to the British and Danish royals, as well as the Imperial families of Russia and Germany. By the time Anne was twenty, she’d been taken on several trips to Europe, excursions she came to loathe. Anne’s anxiety worsened when she was rejected by several families. After her mother died in Austria, Anne returned from Europe “alone and feeling rather sorry for myself”. Back in Sunderland, Anne made friends with her second cousin once-removed, Prince George, the Duke of Woodbine and eldest son of the Prince and Princess of Danforth. Over the years, the pair’s friendship developed into a romance and in 1911, King George allowed the couple to marry. That same year, the Duchess of Westminster died, and Anne inherited the largest jewel collection in the royal vault, aquamarines included. Anne and George married in 1913. Anne, now Duchess of Woodbine, was one the most dynastically important ladies at court and she set to work reworking her grandmother’s jewels into spectacular works of art. For King George and Queen Alexandra’s 1920 Diamond Jubilee, Anne commissioned Garrard to work the aquamarines into a parure that included a necklace, a choker, two brooches, and a pair of earrings. The parure paired nicely with the aquamarine Georgiyevna Tiara, which entered the family in the early 1920s. To this day, the Georgiyevna aquamarines are often mistaken for those of the Westminster set, showing how ubiquitous they’ve become with the main-line royal family’s collection. When Anne became Queen in 1930, she wore the aquamarines. Despite her overflowing jewellery box, the aquamarines were evidently her favourite and became synonymous with her name and legacy. The Westminster aquamarines have remained iconic long after Queen Anne’s time. Queen Irene became another famous wearer of the suite, wearing the choker as both a necklace and a headband in the 1980s. Queen Anne was an important figure to Irene during the early years of her marriage, and she wears nearly all of the jewels her grandmother-in-law left to her. In the 2010s, Tatiana, then the Princess of Danforth was seen in bits and pieces of the suite, notably the choker, signalling that the jewels will be carried on into the next generation.

In case you haven't heard, the Finnish Parliament just approved "controversial border law changes".

This refers to a bill that enables the border authorities to reject asylum applications at the border and even deport asylum seekers who already crossed the border, without issuing an official decision that could be appealed, in the event that Russia funnels migrants to the border to pressure Finland.

According to experts, the new law is in blatant breach of the human rights provisions of the Finnish constitution, superseding EU law, and international treaties. If the law is ever enforced, individual border guards may be sued for breaking EU laws, and Finland as a country may have to answer to the Court of Justice of the EU (which just fined Hungary last month for similar practices) and the European Court of Human Rights. The relevant parliamentary committees decided it could be passed anyway as an "emergency" exception that will be in force for one year.

In the subsequent press conference, the Prime Minister tried to reassure those who have sounded alarm bells by saying that Finland remains a country that respects the rule of law.

TALLINN, Estonia (AP) — The Russian Justice Ministry on Friday said it has filed a lawsuit with the nation’s Supreme Court to outlaw the LGBTQ+ “international public movement” as extremist, the latest crippling blow against the already beleaguered LGBTQ+ community in the increasingly conservative country.

The crackdown, which began a decade ago, slowly but surely chipped away at LGBTQ+ rights. In 2013, the Kremlin adopted the first legislation restricting LGBTQ+ rights, known as the “gay propaganda” law, banning any non-critical public depiction of “nontraditional sexual relations” among minors. In 2020, Putin pushed through a constitutional reform to extend his rule by two more terms that also outlawed same-sex marriage.

In 2022, after sending troops into Ukraine, the Kremlin ramped up its rhetoric about protecting “traditional values” from what it called the West’s “degrading” influence, in what rights advocates saw as an attempt to legitimize the war in Ukraine. That same year, the authorities adopted a law banning propaganda of “nontraditional sexual relations” among adults, too, effectively outlawing any public endorsement of LGBTQ+ people.

Another law passed this year prohibited gender transitioning procedures and gender-affirming care for trans people. The legislation prohibited any “medical interventions aimed at changing the sex of a person,” as well as changing one’s gender in official documents and public records. It also amended Russia’s Family Code by listing gender change as a reason to annul a marriage and adding those “who had changed gender” to a list of people who can’t become foster or adoptive parents.

“Do we really want to have here, in our country, in Russia, ‘Parent No. 1, No. 2, No. 3’ instead of ‘mom’ and ‘dad?’” Putin said in September 2022 at a ceremony to formalize Moscow’s annexation of four Ukrainian regions. “Do we really want perversions that lead to degradation and extinction to be imposed in our schools from the primary grades?”

I have always held the belief that individuals in positions of authority, such as yourself, harbour the best interests of humanity at heart. However, recent developments in the Middle East and the global response to them have stirred doubt in my convictions, compelling me to express my concerns directly to you.

As I explored the International Court of Justice's website, I took solace in the fact that it consists of "independent judges, elected regardless of their nationality from among persons of high moral character." With this understanding, I address you regarding the impending South Africa v. Israel matter, the provisional measures hearing of which is scheduled for Thursday, 11th and Friday, 12th January 2024.

I am sure that you are acutely aware of the gravity of the case before you, and I believe that your ability to discern the truth, resist external pressures, and deliver a just judgment is foremost on your mind. The Genocide Convention, a cornerstone of international law, was established in 1948 as a commitment to 'never again' allow atrocities akin to those committed by the Nazi’s in WW2. 152 states out of 194 nations of the world honourably signed up to the convention. It is a testament to our parents and grandparents that their generations committed to a set of standards that constitute the basic principles of right and wrong, which underpin the fabric of the world we live in and form the basis of the lives most of us are lucky enough to lead.

The very fact that the responsibility of adjudicating on this case has fallen upon your shoulders underscores a disheartening truth – the failure of existing systems of checks and balances within the international community. It is disconcerting that national interests have tainted the operations of our global systems, allowing the mass killing of civilians to persist without intervention. I find this reality appalling, as do countless citizens around the world who have expressed their horror through protests on the streets of cities across the globe.

The upcoming case is a litmus test for humanity's commitment to the solemn pledge of 'Never Again.' Generations have been educated about the horrors of the Holocaust, and this case challenges us to live up to the principles we profess. It is a stark reminder that the values we hold dear are being tested in real-time, with devastating consequences.

In March 2022, the International Court of Justice ordered Russia to immediately suspend military operations in Ukraine and ensure that affiliated units take no further steps in furtherance of the military operations. Despite this intervention, an estimated 10,000 civilians have tragically lost their lives in Ukraine since Russia's military operation in 2022. Moreover, and by comparison, the death toll in Gaza has already surpassed 22,000 since October 2023, with a staggering 70% of the victims being women and children.

In an age where mainstream media faces scepticism due to perceived biases, the global community has been witness to Israel's actions in real-time through various social media platforms such as Twitter, TikTok, and Telegram.

We find ourselves in a world where trust in global institutions is eroding rapidly. The International Court of Justice, in particular, cannot afford to make an erroneous judgment in the South Africa v. Israel genocide case. A misjudgement in this matter would not only underscore the ICJ's ineffectiveness but also prompt scrutiny regarding its autonomy from nation-state political influences, potentially compromising the esteemed moral character of the individuals involved.

In 1945 we celebrated Winston Churchill as the leader that brought the world together in war to put-down the threat of Nazi Germany and the horror it inflicted. That war claimed over 50 million lives. We do not wish to celebrate a wartime hero again; we wish to celebrate new heroes who averted a war by presiding over justice without fear or favour.

I humbly beseech you to approach this case with the utmost diligence, impartiality, and commitment to justice. The eyes of the world are upon you, and the outcome of this particular case will reverberate through history, shaping perceptions of the ICJ's impartiality and moral standing.

In 2020 the Russian constitution was changed to define marriage as being between a man and a woman. There is a national movement against queer people; you cannot possibly compare that to, say, Florida or Texas passing anti-trans bans. Yes, those things suck and we need to fight them, but they aren’t happening at a national level. (Yes, I realize Republicans are trying. They haven’t yet succeeded. In Russia they have.)

Things are bad for our Russian community right now. Don’t you dare fucking minimize that by comparing them to the privileged lives of US queers, when I can get HRT in the mail, file a joint tax return with my wife, and sue somebody for not respecting my pronouns.

Ireland will intervene in an International Court of Justice case filed by South Africa against Israel alleging genocide in Gaza, Minister for Foreign Affairs and Defence Micheál Martin said Wednesday.

“Analysis and consultation has now concluded. Ireland will be intervening,” Martin said. “I want to reiterate clearly what we witnessed on October 7 in Israel, and what we are currently seeing in Gaza, constitutes a blatant violation of international humanitarian law on a massive scale.”[...]

The intervention will take some months to materialize. Ireland’s statement indicates it will file a declaration to the ICJ once South Africa submits its “memorial” — the written statement of its arguments.[...]

Donald Trump said over the weekend that he wants the Senate to allow him to make recess appointments, a constitutional provision that allows a president to circumvent the Senate's advice and consent function to install his choices without a Senate vote.  “Any Republican Senator seeking the coveted LEADERSHIP position in the United States Senate must agree to Recess Appointments (in the Senate!), without which we will not be able to get people confirmed in a timely manner,” Trump wrote in a post on X. “Sometimes the votes can take two years, or more. This is what they did four years ago, and we cannot let it happen again. We need positions filled IMMEDIATELY!”  Trump shouldn't need to do recess appointments.  First, recess appointments are supposed to be for temporary appointments, not full-blown Cabinet members, as Trump is demanding.

Second, Republicans will be in the majority when Trump is sworn in, with at least 52 votes. Senate nominees need a simple majority for confirmation, after the Senate nixed the filibuster for presidential nominees. Because of that, Republicans should be able to get Trump's picks through—even with a few defections from their own party.

So the fact that Trump is demanding the Senate allow recess appointments is a likely sign that he knows that his picks are so extreme that even a GOP Senate wouldn't confirm them.  For example, Trump has said he wants Robert F. Kennedy Jr. to take a leading role in the country’s health—a terrifying prospect as Kennedy is an anti-vaxxer who also wants to get rid of fluoride in the country’s water systems, something that could lead to a rise in dental decay and infections in children. Trump is also reportedly eyeing Kash Patel to head the CIA, NBC News reported. Patel is a conspiracy theorist and MAGA loyalist who wants to shut down the FBI and target anyone who was involved in the probe into Trump’s collusion with Russia during the 2016 campaign. The three Senate Republicans running to replace Mitch McConnell as leader all quickly came out to say they support Trump’s demand to make recess appointments—a bad sign for anyone hoping that the Senate would serve as a backstop to Trump’s dictatorial impulses.

The Supreme Court ruled in 2014 that the Senate has to be in a true recess for 10 full days in order for a president to make a recess appointment.  “Of course, now that Congress is effectively a year-round operation, the Recess Appointments Clause has become all-but anachronistic,” legal expert Steve Vladeck wrote in a piece examining whether Trump truly could make recess appointments. “The last time either chamber adjourned before mid-December was 2002. The Senate instead began using ‘pro forma’ sessions in the mid-2000s—at least partly to prevent President George W. Bush from making recess appointments.” However, given the fact that the current Supreme Court has ruled that Trump is above the law, never put it past them to change the rules to allow Trump to get his way.

Donald Trump and the GOP-controlled is seeking to shred the rules to circumvent the body’s longstanding advice and consent function by agreeing to make recess appointments on a permanent basis by adjourning Congress for at least 10+ days per the 2014 NLRB v. Canning SCOTUS ruling.

Weird rant-y post, because I was just thinking about it.

But you know International Crimes? They’ve been a sadly very recent topic, showing up on the news a lot. They appear in fiction all the time. People talk about them.

They are Genocide, Crimes Against Humanity, War Crimes, and Crimes of Aggression. They’re also the crimes tried by the International Criminal Court, and defined in the Rome Statute. We’ve all heard about them.

The thing that annoys and concerns me is that a whole lot of people tend to mix them up, and I think it’s important to know the differences.

First, Crimes of Aggression are basically starting a war. One country attacking another country. That’s different from War Crimes, but I’ll talk about those later.

Big confusion people make is between Genocide and Crimes Against Humanity:

Genocide is acts taken purposefully to destroy in whole or in part a group. The international definition lists National, Ethnic, Racial, and Religious groups, but based on a consideration made during one of the trials in the ICTR all the way back in 1998, about the spirit of that law, it’s reasonable to consider it as encompassing any group that is similarly “Stable and Permanent”. This means it does necessarily include, say, regional groups, disabled people, and any part or all of the LGBTQ+ community. But it is purposefully about destroying a group, and it is always directed and specific.

Crimes Against Humanity, on the other hand, is about widespread and/or systematic attacks directed at a civilian population. This doesn’t always require specific intent, and it can be a lot more generalized. It also includes political persecution, and group persecution that isn’t necessarily about destruction. Apartheid is a Crime Against Humanity.

An important detail is that in no way is a Crime Against Humanity less severe, less heinous, less serious, than a Genocide. They’re both heinous. They’re often at equal levels of horror. Heck, a Crime Against Humanity can often have its own special types of cruelty. This is where you most commonly (though not exclusively) get state-sanctioned torture, or oppression lasting for decades or even hundreds of years. So let’s also not treat this as a lesser crime. It’s super duper not.

The next big difference is that Genocide and CAH are not War Crimes. I’ve seen a lot of people calling them that, or saying that people convicted for Genocide and CAH were convicted for war crimes. This one is troubling because it also creates the mistaken impression that those things happen in war, or that they’re always tied to war. That’s a HUGE mistake. As much as they’re often covered up with war, or people use war as an opportunity or justification to commit those crimes, they can just as much happen when there’s no war. And even when there is a war, those crimes don’t favor or are necessary for a war effort (of course, the perpetrators do like framing it as such, but we really shouldn’t put a lot of trust into what perpetrators say to justify their atrocities).

War Crimes are acts committed in violation of the rules about means and methods, and about protected persons, places, and objects, in a context of armed conflict. That’s a specific set of rules. This is also different from starting the war. A country can technically start an aggressive war (Crime of Aggression) and not commit war crimes, just as a country can take part in a war legally (for example, in self defense), but take actions that constitute War Crimes.

Another quick detail is that an act can be more than one thing. And similar acts taken in different contexts can be different crimes.

I doubt anyone will read this post, or read it this far. But if someone does, keep all of this in mind when looking at real world news. Israel, for example, hasn’t committed a Crime of Aggression against Palestine, but is committing Crimes Against Humanity, War Crimes, and Genocide. Some of those for way longer than the current conflict. Russia, on the other hand, committed a Crime of Aggression, and I’d argue all the others as well (long story about Genocide. We don’t usually hear about that, or about the hate rhetoric coming from Russia about Ukraine. Won’t go into it now. But there’s some troubling evidence that there very much is also a Genocide there).

Also think about it when we see it in fiction! Thanos in the MCU didn’t commit a genocide. His attack was generalized, unspecific, and undirected. He killed indiscriminately. It’s a Crime Against Humanity (or, I guess, in that case, not humanity? Maybe a Crime Against Sentiency. Not a Genocide, though).

In Star Wars, the Empire commits multiple genocides (in that case, a planetary group can be considered), as well as Crimes Against Sentiency in its oppression of populations. The Jedi Purge was a genocide as well. Meanwhile, we see Republic forces committing War Crimes (such as when they use the tactic of false surrender to lull CIS forces into a massacre, or the use of an enslaved army, or the recruitment of children), and even Genocide against the Geonosians. We do also have CIS forces committing international (or…interplanetary?) crimes, mind you. Especially Crimes Against Sentiency, attacking and oppressing civilian populations, or War Crimes as they use torture.

In Star Trek DS9, when the Cardassians enact a systematic and widespread oppression of the Bajorans, that’s a Crime Against Sentiency. But when they decide they should exterminate them, that’s Genocide. The Dominion trying to exterminate Cardassians is also Genocide. And when the Romulans hid weapons in their hospital base, that’s a War Crime.

Infamous arms dealer Viktor Bout is reportedly back to his old ways less than two years after his release from U.S. custody in a prisoner swap for WNBA star Brittney Griner.

The Wall Street Journal reported that, when emissaries from Yemen’s militant Houthi movement visited Moscow in August to negotiate a $10 million arms purchase, they encountered the man known as Vladimir Putin’s “Merchant of Death.”

The polyglot former Soviet intelligence officer turned to arms dealing after the Cold War, buying up enough surplus Soviet-era military equipment to seed his gun-running into a global enterprise that brought in hundreds of millions in revenue by selling to militant groups in Africa, Asia, and the Americas.

His alleged former clients include terrorist group al Qaeda and the guerrilla Revolutionary Armed Forces of Colombia (FARC), as well as Western governments. He won the moniker “Sanctions Buster” for his ability to get around restrictive trade measures and his story even inspired a middling 2005 Nicolas Cage movie, for which a sequel is in the works (mercifully, Cage did not try to put on a Russian accent).

One of the world’s most wanted men, Bout was arrested in 2008 in Thailand in a sting by the Royal Thai Police and the U.S. Drug Enforcement Administration. In 2012, he was convicted in a Manhattan federal court of trafficking arms to terrorists and sentenced to 25 years in prison.

Citing a European security official and others familiar with the August meeting in Moscow, the Journal reported that the Houthis’ arms purchase is a relatively small one, consisting of automatic weapons including AK-74s that could begin delivery as early as this month under the guise of food shipments.

However, the Houthi members who visited Moscow also inquired about other weapons Russia would be willing to sell, including anti-tank missiles and anti-aircraft weapons, the Journal’s sources said, noting that there’s no evidence Bout would be involved in those deals.

Nevertheless, even the smallest shipment will raise ire in Washington, as the Iran-backed Houthis were put back on a U.S. list of “global terrorist” groups in January.

That followed dozens of attacks by the group on merchant and commercial ships in the Red Sea, which the Houthis say is in protest of the Israel-Hamas war, in which the U.S. government has sent billions in arms to the Israeli Defense Forces.

The Houthis also recently claimed responsibility for attempted drone attacks on Israeli cities that were thwarted by Israel’s air defenses.

Russia, the Journal noted, has limited its involvement in the Middle East conflict, and arming one of the belligerent parties would constitute a notable escalation.

Bout, who said he kept a picture of Putin in his prison cell and is a fervent supporter of Russia’s invasion of Ukraine, was elected to a seat in a local legislature last year.

After his release from U.S. custody, he expressed sympathy for Griner, who was sentenced to nine years in a labor camp by Russian authorities for cannabis oil cartridges found in her luggage, in what was seen as a deliberately harsh punishment.

“Of course, I feel, you know, bad or sorry for any person who’s going to be used as a pawn, despite whether they committed something or not,” Bout told ESPN, following his 2022 release in the prisoner swap for Griner.
