USJAG & CBS NEWS: National Guardsmen fight to get injury claims approved and disability benefits
CBS National News Story w/Catherine Herridge A joint investigation by USJAG and Catherine Herridge, Senior Investigative Correspondent for CBS News, aired on Friday, November 10th, and revealed the following: - National Guard Bureau is overturning at least 30% of “In the Line of Duty” Determinations without authority and evidence. This is used to deny Military Disability Retirement Benefits, thereby violating the Right to Due Process under the 5th Amendment to the Constitution of the United States of America. - Injured Air National Guard and Air Force Reserve Service Members are denied active duty military status, pay, healthcare, and benefits in direct violation of Title 10 United States Code. - The National Guard Bureau and U.S. Air Force weaponize the Line of Duty Determination process and Disability Retirement System to deny injured Service Members DOD retirement and VA Disability benefits. - The Senior Leadership of the National Guard and the U.S. Air Force are aware of these injustices and refuse to correct them. The DOD & Air Force Inspectors General also refuse to conduct objective investigations, so no one is held accountable. CBS MORNINGS BY CATHERINE HERRIDGE, KERRY BREEN November 10th, 2023 Nearly half a million Americans serve in the National Guard, with more than 40,000 engaged in missions around the world. But CBS News has uncovered cases where service members say they were injured in the line of duty face an uphill battle to get health benefits and pay. According to the most recent data obtained by CBS News, about 30% of injury claims that are recommended by local commanders are determined not to qualify by the Air National Guard, raising questions among service members about whether correct policies and procedures are followed. One of those veterans is Master Sergeant Jim Buckley, whose family has spent three generations serving in the military. "It's infuriating," Buckley said. "You're shouting into the wind, and nobody's listening." After tours in Iraq and Africa, Buckley says that he injured his shoulder during a physical fitness test in 2019. While he said he initially dismissed it as a "minor inconvenience," the shoulder wound up needing surgery a year later. Another physical turned up a sleep disorder, migraines and hypertension — all conditions that Buckley said he didn't have before his military service. Unlike the active component of the military, the National Guard requires paperwork to determine that the injury happened or was aggravated while serving. While his shoulder injury was eventually approved, Buckley said he struggled to get his other medical issues recognized for benefits, or what's called a line-of-duty determination. "If you don't have the line of duty, it's like the injury didn't happen," Buckley said. "You're on your own. You're taking care of the injury. You're footing the bill." After Buckley was taken off military orders, he says his family lost his military health insurance and his monthly income of $4,000. It's been "a great hardship," he said. Jeremy Sorenson also served in the Air National Guard as an F-16 and A-10 pilot. He now advocates for injured service members through the nonprofit USJAG.org. Sorenson told CBS News their team is already working with 15 similar Guard cases. "Jim Buckley is representative of what we believe to be thousands of service members that are being mistreated," Sorenson said. Buckley's paperwork indicates his Air Guard command in Mississippi backed up his injury claims, but the final call was made by the Air National Guard. He told CBS News that he has not seen any evidence to support the determination made by the Air National Guard. In October, Buckley was in a dark place. Just minutes before midnight, he wrote the Air Force Secretary and National Guard senior leadership. He said in the email that he was "drowning" and "reaching out for your help," begging that the officials "not turn a deaf ear and a blind eye." "It's coming from a place of pain in my heart," Buckley said. "The last thing I ever wanted to do was get injured. I would have served until I was 60." A National Guard spokesperson told CBS News that Buckley was provided with evidence to back up the injury denials, adding that "a review of the medical records and application of accepted medical principles led the Air Reserve Board to conclude these conditions existed prior to service." Buckley said the struggle to get his injuries covered has made him rethink his family's service. Now, he no longer wants his 16-year-old son, Matthew, to join the National Guard. "Years ago, I would've had a much different answer. The furthest thing I can think of is him joining the military," Buckley said. "I'm so conflicted in saying that, because my grandfather, my father, myself (all served), and I'm very proud of the service, and love the military. But to think that he could be put through the wringer — all it takes is one injury." CBS News has learned both the Defense Department and Air Force internal watchdogs have open cases into Buckley's allegations, which include abuse of authority and failing to provide evidence to back up the final determinations. * * * * * * * * * * * * The TreatNOW Coalition's pro bono Mission is to end service member suicides. Deadline/Completion Date: I’m not a complete fkn idiot. I’m not going to put a time limitation on something as important as this. Doing exactly shit like that - trying to fit my disabilities/chronic illnesses (Read: limited existence) & ADHD-hardwired way of thinking/navigating this world into a life that never quite fit right, that I could never really make work, and of course it was at a pace that I could never keep up with, leaving me behind and feeling defeated and very alone each and every time I tried my little heart out to make it work. My isolation at Balwyn Cottage and very limited social interactions outside of home or at all had this awful way of making me feel like I somehow had started existing outside of time that ticked by out there, watching people pass by my windows, faces almost distorted as if I were viewing them on a sped-up VHS tape.
The people. Busy & full with their intricate and interwoven lives. The million and one faces of humanity floating by the cottage window, every one blissfully unaware of the sickly hermit girl, hidden within the cottage, unseen for closed doors & shut garden gates - and how she ached with missing the daily ordinary of their lives. How they made moving through the world look as if they were dancing across days – their lives an artform – one that her neurodiversity could just never make sense of. She never ceases to gape in awe at the ease, the grace of movement - The people outside seem to be so inherently gifted with; the way they move effortlessly through the hours – stepping & spinning in and out of social circles, passions, learning; with the must-dos, need-to-dos, want-to-dos - beautifully burdened & blessed by the obligations & expectations bestowed.
And yet, the sick hermit girl is still to see any one of the many-faced outsiders stumble on the beautiful paths each of them cut through the day. Not one has ever missed a step.
Not yesterday. Or the day before yesterday. Nor last week. Not six months ago.
The sickly hermit girl has counted years made from the numbered days spent at the cottage window in silent wonderment at the beauty of the lives dancing across her view; at the artwork in their fluent motion, weaving through the world, navigating their paths through this life with such natural ease.
She cannot remember if everyone outside always were so teeming with rhythm & joie de vie - or perhaps everyone is a lowkey professional ballroom dancer in their spare time.
The sickly hermit girl didnt know. Even when she lived in that world, she never quite could figure out how.
Oh yes. She is envious.

Should I Appeal a Denial of Long-Term Disability Benefits on My Own?
If your employer-sponsored long-term disability benefits have been denied, your first instinct may be to appeal right away, potentially without a lawyer, in the hopes that your benefits will be reinstated as quickly as possible. Your disability plan administrator may even try to deceive you into thinking it’s easy, by encouraging you to submit the one-page “Appeal Request Form” included with the denial letter, or by telling you over the phone that “all you need to do is fax a letter stating, ‘I appeal.’”
While it is technically true that you don’t need a lawyer to challenge a denial of long-term disability benefits, and some claimants do appeal on their own with success, you are better off finding a lawyer with expertise in this area to represent you in your appeal. The insurance company is sophisticated and has likely spent weeks, if not months, building its case against you. An experienced ERISA and long-term disability lawyer will recognize the traps that have been laid and know how to overcome them.
Common Mistakes of Going It Alone
As part of our practice, we often review claim files for litigation where the claimant has exhausted appeals on his or her own, without a lawyer. Here are some of the mistakes we commonly see when claimants are unrepresented:
Not taking your time: In general, you have six months (180 days) to appeal a denial of long-term disability benefits. It can take that long to build an effective appeal. By appealing right away, without gathering supporting evidence, you are giving away one of your chief advantages, which is time, and allowing the insurance company to dictate what evidence is contained in the claim file.
Not requesting the claim file: One of the most important protections under ERISA is the right to obtain, free of charge, a copy of your claim file, including all the evidence relevant to your claim for benefits. The claim file will help you to determine what additional evidence and argument is necessary to win your appeal.
Not submitting new medical and opinion evidence: Oftentimes, the medical records obtained by the insurance company are incomplete. Perhaps they don’t include all your doctors, or they don’t go back far enough in time to adequately capture the nature of your disability. Once you have obtained the claim file (see above), review it to determine what medical records are missing. Also, ask your doctors to prepare letters or complete questionnaires documenting your restrictions and limitations.
Nitpicking over the evidence: Self-represented claimants sometimes devote their entire appeal letters to pointing out errors in the denial letter, while losing sight of the bigger picture. A more effective strategy is to tell your side of the story, explaining why you can no longer work, with reference to concrete restrictions and limitations. Still, even the most eloquent appeal letters can overlook critical vocational evidence and arguments that can make or break the case – hence, why hiring a lawyer is a good idea.
Why Should I Hire a Disability Insurance Lawyer?
You may be deterred by the cost of hiring a lawyer. However, most, if not all, lawyers who practice in this area handle such appeals on a contingency basis. Thus, there is little risk to you if your appeal is unsuccessful. If your appeal is successful, the fees paid to your lawyer will have been a worthwhile investment.
You may also be deterred by the time involved in hiring a lawyer. A lawyer will likely require one to three months, and possibly as many as six months, to gather the documents and evidence necessary to perfect your appeal. Then, the insurance company typically takes one to three months to decide the appeal. All told, the process can take up to nine months or more.
While nine months is a long time to go without benefits, there is no point to rushing through the process only for your benefits to be denied. And, depending on the ERISA standard of review, you may not have an opportunity to supplement the record later in litigation. Thus, the prudent approach is to hire a lawyer and allow the lawyer to take the time necessary to build a robust appeal.
How Do I Find a Long-Term Disability Lawyer?
The practice of law has become very specialized, and long-term disability appeals are no exception. While hiring a general practitioner is preferable to going it alone, ideally your lawyer will be one who concentrates his or her practice in long term disability appeals and litigation and have years of experience doing so. If you are unsure where to start, ask the lawyers in your personal network who they would hire for such a matter. Your local bar association may also have a lawyer referral service for this purpose.
You may find there are no lawyers in your city or town who handle such matters, in which case you should consider hiring a long-term disability lawyer with a national practice. A lawyer need not be located in the same city or state as you to provide effective representation. What If I Can’t Find a Lawyer?
There are many reasons a lawyer may be unable to accept your case for representation that have nothing to do with the merits of your disability claim. For instance, if you are receiving Social Security disability benefits or another source of income that is subject to deduction under your LTD policy, your case may not be economically viable on a contingency basis.
If a lawyer won’t accept your case, don’t despair. Even if you are unable to obtain counsel, you should appeal the denial of benefits on your own, as failure to submit a timely appeal could bar you from later bringing a lawsuit. Before you appeal, be sure to first request a copy of your claim file and long-term disability plan document from the insurance company and/or your employer to see what additional evidence, if any, is needed to perfect your appeal. Submit the appeal letter, along with supporting medical and opinion evidence, within the timeframe specified in the denial letter.
