Things the Biden-Harris Administration Did This Week #29

July 26-August 2 2024

President Biden announced his plan to reform the Supreme Court and make sure no President is above the law. The conservative majority on the court ruled that Trump has "absolute immunity" from any prosecution for "official acts" while he was President. In response President Biden is calling for a constitutional amendment to make it clear that Presidents aren't above the law and don't have immunity from prosecution for crimes committed while in office. In response to a wide ranging corruption scandal involving Justice Clarence Thomas, President Biden called on Congress to pass a legally binding code of ethics for the Supreme Court. The code would force Justices to disclose gifts, refrain from public political actions, and force them to recuse themselves from cases in which they or their spouses have conflicts of interest. President Biden also endorsed the idea of term limits for the Justices.

The Biden Administration sent out an email to everyone who has a federal student loan informing them of upcoming debt relief. The debt relief plan will bring the total number of a borrowers who've gotten relief from the Biden-Harris Administration to 30 million. The plan is due to be finalized this fall, and the Department of Education wanted to alert people early to allow them to be ready to quickly take advantage of it when it was in place and get relief as soon as possible.

President Biden announced that the federal government would step in and protect the pension of 600,000 Teamsters. Under the American Rescue Plan, passed by President Biden and the Democrats with no Republican votes, the government was empowered to bail out Union retirement funds which in recent years have faced devastating cut of up to 75% in some cases, leaving retired union workers in desperate situations. The Teamster union is just the latest in a number of such pension protections the President has done in office.

President Biden and Vice-President Harris oversaw the dramatic release of American hostages from Russia. Wall Street Journal reporter Evan Gershkovich, former Marine Paul Whelan held since 2018, Russian-American reporter for Radio Free Europe/Radio Liberty Alsu Kurmasheva convicted of criticizing the Russian Military, were all released from captivity and returned to the US at around midnight August 2nd. They were greeted on the tarmac by the President and Vice-President and their waiting families. The deal also secured the release of German medical worker Rico Krieger sentenced to death in Belarus, Russian-British opposition figure Vladimir Kara-Murza, and 11 Russians convicted of opposing the war against Ukraine or being involved in Alexei Navalny's anti-corruption organization. Early drafts of the hostage deal were meant to include Navalny before his death in Russian custody early this year.

A new Biden Administration rule banning discrimination against LGBT students takes effect, but faces major Republican resistance. The new rule declares that Title IX protects Queer students from discrimination in public schools and any college that takes federal funds. The new rule also expands protections for victims of sexual misconduct and pregnant or parenting students. However Republican resistance means the rule can't take effect nation wide. Lawsuits from Republican controlled states, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia and Wyoming, means the new protections won't come into effect those states till the case is ruled on likely in a Supreme Court ruling. The Biden administration crafted these Title IX rules to reflect the Supreme Court's 2020 Bostock case.

The Biden administration awarded $2 billion to black and minority farmers who were the victims of historic discrimination. Historically black farmers have been denied important loans from the USDA, or given smaller amounts than white farmers. This massive investment will grant 23,000 minority farmers between $10,000 and $500,000 each and a further 20,000 people who wanted to start farms by were improperly denied the loans they needed between $3,500-$6,000 to get started. Most payments went to farmers in Mississippi and Alabama.

The Biden Administration took an important step to stop the criminalization of poverty by changing child safety guidelines so that poverty alone isn't grounds for taking a child into foster care. Studies show that children able to stay with parents or other family have much better outcomes then those separated. Many states have already removed poverty from their guidelines when it comes to removing children from the home, and the HHS guidelines push the remaining states to do the same.

Vice-President Harris announced the Biden Administration's agreement to a plan by North Carolina to forgive the state's medical debt. The plan by Democratic Governor Roy Cooper would forgive the medical debt of 2 million people in the state. North Carolina has the 3rd highest rate of medical debt in the nation. Vice-President Harris applauded the plan, pointing out that the Biden Administration has forgiven $650 million dollars worth of medical debt so far with plans to forgive up to $7 billion by 2026. The Vice-President unveiled plans to exclude medical debt from credit scores and issued a call for states and local governments to forgive debt, like North Carolina is, last month.

The Department of Transportation put forward a new rule to bank junk fees for family air travel. The new rule forces airlines to seat parents next to their children, with no extra cost. Currently parents are forced to pay extra to assure they are seated next to their children, no matter what age, if they don't they run the risk of being separated on a long flight. Airlines would be required to seat children age 13 and under with their parent or accompanying adult at no extra charge.

The Department of Housing and Urban Development announced it is giving $3.5 billion to combat homelessness. This represents the single largest one year investment in fighting homelessness in HUD's history. The money will be distributed by grants to local organizations and programs. HUD has a special focus on survivors of domestic violence, youth homeless, and people experiencing the unique challenges of homelessness in rural areas.

The Treasury Department announced that Pennsylvania and New Mexico would be joining the IRS' direct file program for 2025. The program was tested as a pilot in a number of states in 2024, saving 140,000 tax payers $5.6 million in filing charges and getting tax returns of $90 million. The program, paid for by President Biden's Inflation Reduction Act, will be available to all 50 states, but Republicans strong object. Pennsylvania and New Mexico join Oregon and New Jersey in being new states to join.

It's truly wild how Daniel can make himself look a decade or so younger by just wearing a basic white shirt and no-nonsense Chucks. He only looks a few years older than Dakota in their photo together. And this is with a full beard—imagine if he shaved it off. Whereas in The Alienist, where he's in layers of period garb, it's more believable that he's 16 years her senior.

p.s. this post got me thinking that while one started way younger, they're technically both child stars. The same year the world was introduced to Dakota in I Am Sam, Daniel was making waves in German cinema with The White Sound and Nichts Bereuen. It would be two years later that he'd break out into the international scene with Good Bye, Lenin!.

Eocene gators and Miocene gharials

It's been a busy two-ish weeks for me once again with two "new" crocodilians dropping not even a week apart. These two newcommers couldn't be any more different, as you'll see soon enough.

The first of the two is not exactly a stranger, in more than one way. Sutekhsuchus dowsoni in truth has been known since 1920, when it was described as Tomistoma dowsoni based on fossils from Wadi Moghra in Egypt. Tomistoma being one of those genera that was a popular wastebasket for crocs. Broad snout and overbite? Alligator. Narrow snout? Tomistoma. Everything else? Crocodylus.

Tomistoma is still heavily affected by that, with the paper still referencing about half a dozen species of Tomistoma that are almost definitely not Tomistoma. In that regard, tho its not super new its fantastic to see that one of these Miocene circum-mediterranean forms finally gets its due (especially after having been unceremoniously been lumped into T. lusitanica for a while). Additional fun fact, the original "missinterpretation" as a species of Tomistoma is used as the basis for the new name, basically meaning "Set's crocodile" in reference to Sutekh/Set being god of deception.

Another way in which Sutekhsuchus is not "new new" is that, intentional or not, the name was actually dropped a month ago without many people noticing. As has been pointed out to me by @paleomiguel, a recent paper on Eogavialis featured a phylogeny that contained Sutekhsuchus, a name I was not familiar with. However, the species name did ring a bell and after a brief search on google scholar I did find a reference to the then unpublished redescription.

Anyways, background aside Sutekhsuchus has some cool stuff going for it. Its anatomy is in some regards intermediate between the modern false gharial (which the paper regards as one of the basalmost gavialoids) and the Indian gharial (a highly derived weirdo). Ultimately, its just one of several species that lived around the broader Tethys Sea during the Miocene as part of a flourishing croc ecosystem. Given the warmer temperatures, it was in pretty good company. We know it from Gebel Zelten and Wadi Moghra, both of which preserve the bones of the robust Rimasuchus and the bizarre Euthecodon, both members of the Osteolaemines ("dwarf crocodiles", a name that makes more sense when you ignore these fossil forms). Both localities are interpreted as being somewhat coastal, consisting of lagoons, estuaries, slow moving rivers and surrounding forests.

The other new crocodilian was much more of a surprise to me personally. Ahdeskatanka russlanddeutsche is a species of basal alligatorine from the Eocene of North Dakota. The genus name derives from the Dakota word for alligator, the species name references ethnic Germans that settled the region after emmigrating from the Russian Empire.

It lived during the early Eocene in the Golden Valley Formation of North Dakota and in many regards resembles many early alligators of the time, having been small with a short and blunt snout and globular teeth well suited for crushing hard shelled prey.

During this time period North Dakota experienced the Early Eocene Climatic Optimum, an exceptional warm period that saw lush subtropical to tropical forests grow along the banks of meandering rivers and extensive swamps. Not great for mammalian carnivores but fantastic for crocodilians, of which there were plenty. The Golden Valley was home to at least 4. In addition to Ahdeskatanka there was a similar, possibly closely related unnamed form, a large crocodyloid similar to the ubiquitous Borealosuchus and the large caiman Chrysochampsa, a relic of a Cretaceous offshoot of the family.

According to documents obtained by Grist and Type Investigations through a Freedom of Information Act request, the FBI’s Minneapolis office opened a counterterrorism assessment in February 2012, focusing on actions in South Dakota, that continued for at least a year and may have led to the opening of additional investigations. These documents reveal that the FBI was monitoring activists involved in the Keystone XL campaign about a year earlier than previously known.  Their contents suggest that, long before the Keystone and Dakota Access pipelines became national flashpoints, the federal government was already developing a sweeping law enforcement strategy to counter any acts of civil disobedience aimed at preventing fossil fuel extraction. And young, Native activists were among its first targets. “The threat emerging … is evolving into one based on opposition to energy exploration related to any extractions from the earth, rather than merely targeting one project and/or one company,” the FBI noted in its description of the Wanblee blockade. The 15-page file, which is heavily redacted, also describes Native American groups as a potentially dangerous threat and likens them to “environmental extremists” whose actions, according to the FBI, could lead to violence. The FBI acknowledged that Native American groups were engaging in constitutionally protected activity, including attending public hearings, but emphasized that this sort of civic participation might spawn criminal activity.  To back up its claims, the FBI cited a 2011 State Department hearing on the pipeline in Pierre, South Dakota, attended by a small group of Native activists. The FBI said the individuals were dressed in camouflage and had covered their faces with red bandanas, “train robber style.” According to the report, they were also carrying walking sticks and shaking sage, claiming to be “Wounded Knee Security of/for Mother Earth.” “The Bureau is uncertain how the NA group(s) will act initially or subsequently if the project is approved,” the agency wrote.  The FBI also singled out the “Native Youth Movement,” which it described as a mix between a “radical militia and a survivalist group.” In doing so, it appeared to conflate a specific activist group originally founded in Canada in the 1990s with the broader array of young Native activists who opposed the pipeline decades later. Young activists would play an important role in the Keystone XL campaign and later on during protests against the Dakota Access pipeline at Standing Rock, but the movement had little in common with militias or survivalists, terms typically used to describe far-right groups or those seeking to disengage from society.  The FBI declined to respond to questions for this story. In an emailed statement, a spokesperson for the Minneapolis field office said the agency does not typically comment on FOIA releases and “lets the information contained in the files speak for itself.”

Environmental activists and attorneys who reviewed the new documents told Grist and Type Investigations that law enforcement’s approach to the Keystone XL campaign looked like a template for the increasingly militarized response to subsequent environmental and social justice campaigns — from efforts to block the Dakota Access pipeline at Standing Rock to the ongoing protests against the police training center dubbed “Cop City” in Atlanta, Georgia, which would require razing at least 85 acres of urban forest.  The FBI’s working thesis, outlined in the new documents, that “most environmental extremist groups” have historically moved from peaceful protest to violence has served as the basis for subsequent investigations. “It’s astonishing to me how such a broad concept basically paints every activist and protester as a future terrorist,” said Mike German, a former FBI special agent who is now a fellow at the nonprofit Brennan Center for Justice.

Anti-German sentiment was rampant in the United States following World War One. Numerous German language newspapers were shuttered and the names of so-called “disloyal” German-Americans were published in newspapers. It wasn’t uncommon for German immigrants to be attacked.

On the 18th of August, 1918, men in Luverne, Minnesota, forced their way into the home of John Meints, a local German-American farmer. They dragged him from his hone and drove him to the South Dakota border where he was beaten, whipped and threatened. Afterwards, the men tarred and feathered him and told him to cross the border into South Dakota, threatening to kill him if he returned to Minnesota.

Meints sued all 32 men involved in the attack, however the judge ruled in their favour and they were set free without charge.

KP.3.1.1 is still the dominant COVID-19 variant in the United States as it accounts for nearly 60% of positive cases, but the XEC variant is not far behind, recent Centers for Disease Control and Prevention (CDC) data shows.

"CDC is monitoring the XEC variant," Rosa Norman, a CDC spokesperson told USA TODAY. "XEC is the proposed name of a recombinant, or hybrid, of the closely related Omicron lineages KS.1.1 and KP.3.3."

The variant, which first appeared in Berlin in late June, has increasingly seen hundreds of cases in Germany, France, Denmark and Netherlands, according to a report by Australia-based data integration specialist Mike Honey.

The CDC's Nowcast data tracker, which displays COVID-19 estimates and projections for two-week periods, reflected that the KP.3.1.1 variant accounted for 57.2% of positive infections, followed by XEC at 10.7% in the two-week stretch starting on Sept. 29 and ending on Oct. 12.

KP.3.1.1 first became the leading variant between July 21 and Aug. 3.

The latest data shows a rise in each variant's percentage of total cases from Sept. 15-28, as KP.3.1.1 rose by 4.6%, and XEC rose by 5.4%. Previously, the KP.3.1.1 variant made up 52.6% of cases and XEC accounted for 5.3% from Sept. 15-28.
