I’m writing in support of the “No Kings Act,” introduced by Leader Schumer in August. This bill would reassert Congress’s constitutional authority and curb the judiciary’s unchecked power.

The "No Kings Act" addresses several key issues:

Congressional Authority Under Article III: The No Kings Act uses Congress’s constitutional authority under Article III to set "Exceptions" and "Regulations" to the Supreme Court's appellate jurisdiction. This power has been historically recognized as an important tool to limit the Court's reach, particularly when it comes to cases that could undermine democratic governance.

Neutralizing the Trump v. United States Decision: Leader Schumer’s legislation aims to counteract the Supreme Court’s decision granting former President Trump—and all presidents—immunity from prosecution for official acts. By removing lower courts' jurisdiction over presidential immunity and removing the Supreme Court’s appellate authority in this context, the No Kings Act asserts Congress’s constitutional role in preserving the rule of law and ensuring accountability at the highest levels.

Legal Safeguards: The bill also limits the Supreme Court's ability to review the bill's constitutionality, thereby reinforcing Congress’s role in determining the boundaries of judicial authority. This is not only a constitutionally justified action but also a necessary measure to protect democratic norms from judicial overreach.

If we don’t set limits on the power of a sitting president, or on our out-of-control Supreme Court, our democracy will suffer—greatly. Please support the No Kings Act. Thanks.

White House Press Secretary Violates Hatch Act: Watchdog Investigation Reveals

The U.S. Office of Special Counsel (OSC), an independent federal agency responsible for enforcing the Hatch Act, issued a warning to Jean-Pierre for her repeated use of the term "MAGA Republicans" just days before the 2022 election. The violation occurred during a briefing held at the White House. The OSC received a complaint from a group called Protect the Public's Trust, led by Michael Chamberlain, who was an appointee to the Education Department during the Trump administration. The complaint accused Jean-Pierre of using her position to advocate for the defeat of her partisan political opponents and making derogatory remarks about Republicans. The group requested an investigation by the OSC to prevent similar actions in the future and to impose appropriate penalties. During the November 2, 2022 briefing, Jean-Pierre referred to "mega MAGA Republican officials" in her prepared remarks and during the Q&A session with journalists. She described them as politicians who do not believe in the rule of law. The term "MAGA" was used by President Biden himself five times during an October 24 speech at the Democratic National Committee Headquarters, where he urged supporters to vote for Democrats and increase the party's seats in Congress. The OSC concluded that Jean-Pierre indeed violated the Hatch Act, which prohibits covered employees from using their official authority or influence to interfere with or affect the outcome of an election. However, the agency decided against pursuing disciplinary action and instead issued Jean-Pierre a warning letter. The OSC's Hatch Act unit leader, Ana Galindo-Marrone, explained that the White House Counsel's Office did not believe Jean-Pierre's remarks were prohibited by the Hatch Act at the time. It remains unclear whether the OSC's position on the use of "MAGA Republicans" was ever conveyed to Jean-Pierre. Jean-Pierre commented on the findings, describing the OSC's action as "retroactive" and emphasizing that they were unaware of the OSC's opinion when they received clearance to make the comments. She noted that the White House Counsel's Office is reviewing their opinion and plans to engage in a dialogue with the OSC. It's worth noting that the term "MAGA" has been used in the White House on other occasions. For instance, the Biden administration referred to the "extreme MAGA Republican" contingent in the House in an official release earlier this year, opposing their proposed budget. However, not all conservatives view the term "MAGA" negatively. In some cases, it has been embraced, such as when congressional candidate Cody Hart listed "MAGA Republican Party" as their preferred identifier on the official election website in Washington state ahead of the previous year's midterms. Of all the responses to the economic upheavals of the pandemic, price gouging has got to be one of the most egregious. This is when prices go up, or continue to stay high, not due to market pressures or other economic factors, but only because the seller, renter, or provider wants to increase their already excessive profits.

Some CEOs have even bragged to their shareholders about how much their profit-making pricing strategies exceed their inflationary increases in production costs.

To fight back against what they call “greedflation,” Senator Elizabeth Warren and Rep. Jan Schakowsky have reintroduced their Price Gouging Prevention Act (S. 3803 / H.R. 7390) and are now seeking co-sponsors for the bills.

As your constituent, I would like to urge you to co-sponsor and pass this bill. It has several important features: It will prohibit price gouging on a nationwide basis; it will take aim at companies that have taken advantage of the pandemic to jack up prices unnecessarily and keep them up; it will focus on companies whose executives brag to shareholders about increasing prices faster than inflationary costs; it will require public disclosure of companies’ costs and pricing strategies, and it will increase the FTC’s funding to enforce these conditions.

#julywrapup — minus Ariel Gore’s We Were Witches, which I had to return to the library, and which I have scoured every bookstore that I’ve been in since. I’m pretty happy with this stack! Which was made larger over the course of my birthday weekend, and also the #24in48 readathon. Still not any poetry, though! I psyched myself out by deciding to create my own poetry annual — a notebook into which I would hand write my favorite poems of the year (an idea I discovered on twitter). I made a stack of all the poetry I’d already read this year, intending to go through them to find my favorites, when it finally occurred to me — I don’t have to order the books chronologically! Anyway, there will be lots more poetry in my August TBR. . . I’ve written about most of these books already so I won’t go into much detail here. So let’s say that my favorite book this month we We Were Witches, my favorite character was Rabeya from The Taqwacores, my favorite ending from Desdemona and the Deep.
