Are You Eligible for the Humanitarian & Compassionate Application?

If you're a foreign national currently living in Canada and can't apply for permanent residence through the regular immigration programs, the Humanitarian and Compassionate (H&C) stream could be an option.

But eligibility has some strict requirements.

The H&C application is intended for those who need an exemption from certain requirements under Canadian immigration law (IRPA/Regs) in order to apply for PR from within Canada.

You have to show that there are reasons justifying those exemptions.

To be eligible, you must:

✨ Be a foreign national residing in Canada right now

✨ Require exemption(s) from IRPA/Reg requirements to apply for PR from within Canada

✨ Have humanitarian/compassionate grounds warranting the exemption(s) you need

HOWEVER, you cannot be eligible for PR under any of these classes:

🚫 Spouse/Common-Law Partner

🚫 Live-In Caregiver

🚫 Caregiver for Children/People with High Medical Needs

🚫 Protected Person/Convention Refugee

🚫 Temporary Resident Permit Holder

If you fall under any of those categories, you need to apply through the proper program stream.

The H&C is really meant for exceptional, compelling cases that don't fit other PR pathways.
