Bannon is a leading fascist strategist for Trump. It's too bad that their trials are in different jurisdictions. It would be fun to imagine them sharing a jail cell – material for a genuine reality show. 😝
A three-judge panel of the U.S. Circuit Court of Appeals for the District of Columbia Circuit upheld former White House adviser Steve Bannon's conviction for criminal contempt of Congress. Bannon was sentenced in October 2022 to four months in prison on charges related to his refusal to testify before and provide documents to the Jan. 6 committee investigating the attack on the Capitol. At the time, the judge also fined Bannon $6,500 but allowed the former Trump adviser to remain free while he appealed his convictions. According to Friday's order, the three-judge panel rejected Bannon's argument that he was not guilty because his "lawyer advised him not to respond to the subpoena" from Congress. Bannon could still appeal to the U.S. Supreme Court, but the justices there previously did not help Peter Navarro, another Trump aide, to stay out of prison on similar charges.

Steve Bannon, the controversial hard-right strategist who has been influential in the thinking of Donald Trump, has lost his appeal against his conviction for contempt of Congress relating to the investigation into the January 6 insurrection. A unanimous ruling from a three-judge panel of the District of Columbia circuit court of appeals upheld Bannon’s conviction on Friday. The decision brings him closer to a four-month sentence behind bars meted out to Bannon for having resisted the terms of Congress’s subpoena against him. He has one last hope left to avoid a prison term – he could appeal to the full bench of the circuit court. He has seven days to make the move. Bannon, a former editor of the far-right news outlet Breitbart, was convicted of contempt charges at trial in July 2022, having been charged with two federal counts. He was accused of refusing to appear for a deposition and of refusing to provide documents to the committee in response to a subpoena.
He was sentenced later that year to four months in prison. The punishment was put on hold after Bannon appealed. Bannon’s lawyers claimed in the appeal that he had not ignored the committee’s subpoena, but was following the advice of his lawyer and acting out of concern that he might violate executive privilege objections raised by Trump. The January 6 committee countered that virtually none of the documents it was seeking related to executive privilege as they were overwhelmingly related to Bannon’s actions as a private citizen. The appeals court decision, written by Judge Brad Garcia, found that “Bannon failed to comply with the subpoena, and his failure to comply was willful”. The “advice of counsel” defense “is no defense at all” when faced with a subpoena. Another former senior aide to Trump, Peter Navarro, is currently serving an identical four-month prison term having refused to testify and hand over records to the January 6 committee about matters relating to Bannon. Congress had wanted to question Navarro about a plot to subvert the 2020 election with which he had been involved and which he wrote about in a book, stating that the plan originated with Bannon.
Stephen Bannon may be headed to closer to jail time, as a 3-judge panel on the DC Circuit Court upholds the Contempt of Congress conviction. Bannon can still appeal to the full court, but he is running out of options to avoid jail time.

Washington — The House voted Wednesday to hold Attorney General Merrick Garland in contempt of Congress, escalating a fight over audio recordings related to the President Biden's handling of classified documents.  Garland has defied subpoenas from the Republican-led House Judiciary and Oversight committees demanding that the Justice Department hand over the audiotapes of the president's interview with special counsel Robert Hur as part of their impeachment inquiry. Mr. Biden asserted executive privilege over the recordings of Hur's interviews with the president and the ghostwriter of his book as the committees moved forward with contempt resolutions against Garland in May.  The resolution passed by a vote of 216 to 207, with all but one Republican voting to back it. Rep. David Joyce of Ohio was the sole Republican to vote with Democrats.  "It is deeply disappointing that this House of Representatives has turned a serious congressional authority into a partisan weapon," Garland said in a statement. 
The House voted 216-207 nearly along party lines to hold AG Merrick Garland in contempt of Congress for frivolous and partisan reasons.
Rep. David Joyce (R-OH) is the lone Republican to vote no.
