We need to talk about this.

Tony Stark fans are very keen on repeating the claim Tony made in Captain America: Civil War that the Avengers could simply sign the Accords and then get them changed to make them more acceptable at a later point.

Play ball now, negotiate later.

Sounds reasonable right?

Except from a legal perspective this is patent nonsense.

Anybody who has ever had to sign a contract or legal document, or indeed any lawyer could tell you that you it is next to impossible to make changes after the fact. i.e after signing.

You read the contract and you make changes before signing: otherwise that's it. Once you sign you are obligated to abide by the terms of the contract in every point.

Now, there are certain very limited circumstances where you can change a contract after signing, but these are few and far between. It also takes time, money and a lot of legal wrangling. It is a nightmare.

This is why, at the risk of repeating myself, you read the law or contract, and you ask a lawyer to make changes before you sign. Even if this process takes weeks or months because you do not want to be bound to the terms of a contract which may negatively impact you.

What Tony was saying was bullshit, and he knew it. He had dealt with contracts before, and knew how they worked. He knew they couldn't "sign now and change later" so he lied.

Just like he lied about getting Bucky into a psych ward. According to a deleted scene, Bucky had already been sentenced to extadition, and Tony could not simply reverse that judgement. Besides, T'Challa was not going to stand for some white dude telling him what he could do.

Man I was JUST thinking about this. I also hate when people make it out to seem like team Cap was wholly in the wrong when I also would be adverse to something that would limit me and my team from doing our jobs as efficiently as we have been doing. Also Cap distrusting the outward facing idea of a legal document is kinda on par with ya know, him and the whole WWII thing he has going on.

While it’s valid to think that super powered and enhanced individuals should have some oversight and consent of other countries when they are doing their…. Superheroing. I also think that there would be too short of a time for any meaningful oversight to take place AND you can’t really trust the govt. to have everyone’s best interest in mind. So honestly, kinda have to go with Steve here. While I get where Tony was coming from. I think both have flaws and stubborn ideas of their own wanted outcomes of the accords. But I do lean towards team Cap.

In rewatching Captain America: Civil War, it is important to remember that Steve is assembling a team to take on several supersoldier assassins and the mastermind who wants to take over the world while Tony is assembling a team to arrest Steve's team.

The distinction is important.

"So... enjoying the calm before the next 'genius-level' project takes over your brain again?" She raises an eyebrow, a teasing glint in her eyes. "Or are you actually taking a break for once?"

Tony doesn’t look up right away, his hands moving deftly as he adjusts a small circuit board with one of his many custom tools. A faint smirk tugs at his lips, though, betraying the fact that he’s heard her loud and clear.

"Break? What’s that?" he quips, finally glancing up at her with a flash of mischief in his eyes. He leans back in his chair, spinning the tool in his hand like a magician showing off his favorite trick. "You know me, Serena. If I’m not building something to save the world—or occasionally, to annoy it—then what’s the point?"

He tilts his head toward the window, where the lake glistens under the soft sunlight filtering through the trees. "Though, I’ll admit, this whole ‘peaceful retreat’ thing has its perks. It’s almost enough to make me forget the endless list of world-ending problems out there. Almost."

Tony gives her a once-over, his smirk growing. "But look at you. All calm and collected. What’s your secret? Zen yoga? Or have you been stashing the good scotch somewhere I don’t know about?"

He gestures toward the chair across from him with an exaggerated flourish. "Sit down, Potts 2.0. If I’m taking a break—and I’m not saying I am—you might as well keep me company while I pretend."
