The abdication of what Ambedkar would have called, ‘constitutional morality’ was most evident in the response of the State of Karnataka. It consciously and deliberately went out of its way to deny Muslim women the right to choose their attire. It privileged uniform over education. At all points in time it consciously shirked its constitutional responsibility under Article 46 to make ‘make effective provision for securing the right to education’ and its constitutional responsibility to ensure the right to education without discrimination. The Karnataka Government, indeed has an inalienable constitutional responsibility to respond to the continuing violations of fundamental rights of young Muslim women. More than a year after the hijab was first suddenly prohibited in a PU college in Udupi, Muslim women students across Karnataka continue to struggle to pursue their education and face grave consequences such as psychological distress and isolation. It is this abdication, of a government which has sworn to uphold the Constitution, which is a matter of grave concern.

The Supreme Court Strikes Down the Unconstitutional Resolution of the Mysore Bar Association

The matter was heard by the Division Bench of Hon’ble Mr. Justice Vikram Nath J & Hon’ble Mr. Justice Satish Chandra Sharma J
Order
The Apex Court quashed the resolution of Mysore Bar Association prohibiting members of the Bar from filing Vakalatnama on behalf of the present petitioner.
Fact
In the present Writ Petition Resolution of the Mysore Bar Association dt.16.03.2019 was challenged.
It was resolved by the Association that no member of the Association shall file Vaqalatnama on behalf of the present petitioner.
The matter is pending since 2019 and despite repeated notice, the Mysore Bar Association did not enter appearance.
The Apex Court stayed the Resolution of the Association vide its order dt. 06.10.2021.
On 14.11.2022 notices to Respondent no. 3(Association) were served through the Commissioner of Police, Mysore but despite the same, Association has not put in appearance.
Hence, the Apex Court proceeded Ex Parte.
Observation of the Apex Court
Such a Resolution could not have been passed.
Right to defend oneself is a Fundamental Right under Part III of the Constitution of India.
Right to appear for a client is also a Fundamental Right being a part of carrying on one’s profession as a lawyer.
As such, the said Resolution is hereby quashed.

A legal retainer is a working contract, by which the legal counsel is hired for a certain period and paid a certain amount of money for the time he or she will be serving the client. This fee makes sure that the lawyer will be available to give legal advice, review some documents or any legal services that may be required.
The specific terms that define the work to be done, the role of the lawyer and the period of the retainer are normally provided in such an agreement. This arrangement benefits both parties: the lawyer has employment and the client is always accorded the full range of services of the lawyer.
