This info was of some surprise to folks on Bluesky, so I'm going to repeat it here in light of the sheer number of "the Internet Archive was an uncomplicated good apart from this one weird move" posts I've seen...

Are we all aware that IA has been gradually pushing the dogma that generative AI is a net public good, and has been feeding books, music, and video into AI?

This article is about how IA is actively using AI in their archives. It's an interview with Brewster Kahle, founder and Board Chair of IA. Choice quote:

This is the blog post about the comments they submitted to the US copyright office arguing against any new copyright regulations for AI. Some more choice quotes:

You can guess how I feel about framing the writers and artists whose work BUILT generative AI as "workers" who just need to be "retrained."

Last year they hosted a zoom panel called "Generative AI Meets Open Culture: Opportunities, Challenges & Ethical Considerations." Multiple visuals were AI-generated art, the panelists were asked to avoid discussing copyright. It's an hourlong panel and I couldn't find a transcript, so I skipped around to see if anyone addressed the elephant in the room. I found at ~32 minutes, a vague gesture at acknowledging it wasn't great if you tried to replicate an artist's style, but fine if you just wanted generic art.

(If anyone finds a more concrete statement in there, and/or a transcript, I'd love to know! The tenor I got was overall "look at how cool these tools are and let's talk about how they're a public good.")

At the end of January 2024, they hosted "Public Domain Day," including a panel on incorporating Generative AI in art. They invited two artists who utilize Generative AI, and a publisher whose books go immediately into the public domain. More quotes from their own writeup:

This was an event in celebration of public domain, but as far as I can tell, they've more or less avoided even acknowledging that creators are actively being harmed by Gen AI. Again, if anyone can find a clearer statement, please share it.

Another wrinkle in this is that Kahle, on behalf of the Internet Archive, sued the US Government in 2004, challenging the law that automatically granted and renewed copyright to a creator. Previously, copyright was opt-in only, had to be regularly renewed by the holder, and cost money to do so. The case went all the way to the Supreme Court in 2007, but was dismissed. (Scroll down to Docket 07-189, Kahle v Mukasey, for court filings.)

To be clear, this is the law that means you automatically own your own work. It's not a shock that Kahle's suit failed. But if Kahle had won, artists who didn't pay to secure and maintain copyright over their work would be SOL right now in the lawsuits against generative AI image and text scrapers.

So yeah. My tiny violin for IA continues to shrink.

You and Sy were in your own little bubble most of the time you were at the prom. Of course you had fun with your crew, but you two were all over each other, and after a couple of hours, decided to cut out and head to the chalet. On your way out, you were stopped by Jeremy Atkins, who hadn’t spoken much to Sy since he’d broken up with Becca six months earlier.

“They are about to announce Prom Court, Sy. Word on the street is that you’re a cinch for King.”

Sy looked at you, and then back at Jeremy, sighed, and whispered in your ear.

“You mind if we stay just a little while longer, Buttercup?”

You pouted just a little, then grinned up at Sy, going on tiptoe to whisper in his ear. 

“Only if you keep the crown on all night. I mean allllll night.”

You giggled as Sy chuckled and grinned down at you.

“Even if I’m king, your wish is my command. Here. I see the goosebumps raising on your arms.” 

You grinned as Sy draped his tuxedo jacket around your arms. Now you were ensconced in his warmth and his smell. 

Stephanie Prince, the Student Body President, walked up to the mic on stage and said lots of words before announcing the court. You were too wrapped up in Sy to pay attention. When he was announced King, Sy picked you up when he stood, causing you to squeal before he put you down. Your classmates either laughed or rolled their eyes.

Sy reached the stage and winked at you, who was standing right in front taking pictures of your man.

When Becca was announced queen, you curiously watched her gain the stage. Becca’s high waisted ball gown was a little out of fashion, which was weird for her, but you figured she just wanted to attract attention. After they were crowned, Sy moved to get back to you as Becca stepped up to the mic.

“Thank you for this honor. I just want to make one announcement.”

Becca moved her hands around her waist, unfastening her skirt. Everyone gasped as they thought she was stripping, but she only revealed a sleek dress underneath.

And a very pregnant belly.

“I will be having a baby in August. And the father is your Prom King, Jake Syverson.”

“WHAT THE FUCK!?!?” 

Carla yelled it as the rest of the room was silent.

Your eyes searched for Sy, who was frozen halfway down the stage steps. His eyes were wide as he gaped at Becca.

She looked back at him triumphantly.

“Remember the night of your 18th birthday, Sy?”

Your mind raced. Sy’s birthday was in October, and right before you two got together. That would mean that Becca was almost 7 months pregnant. You felt the blood rushing in your ears as you started walking backwards toward the door.

His mouth dropped open as he stared at her, then, when he heard you sob, he searched for you in the crowd. 

You were out of the door, Carla and Tiffani and their dates hot on your heels, in under two seconds, flat.

You woke up with a start and stared over at Sy, who was sleeping peacefully beside you in his bed. This time it was you who watched him sleep as you processed the fact that Sy was here with you now, and what happened 20 years ago was over and done with. Your mind was trying to trick you with fear and anxiety. 

Sy had reached his goal of convincing you to give this a try this weekend, and you decided to risk it all by checking out of your AirBnB early and taking your rental back to the airport that morning because you wanted to spend every possible minute with him. 

“Now who’s bein’ a creep, Buttercup?”

Sy’s gravelly voice was heaven as he gathered you up in his arms, and the smile on his face was everything.

Sy lifted you off of his lap and went down on one knee on the rug in front of you. It felt as if there was no air in the room and you could hear the blood rushing in your ears.

“Will you take this ring as a promise of marriage?”

“Now. What exactly are you asking me?”

Psych (TV) and Same-Sex Marriage in California

While rewatching Psych, I have been thinking about what audiences today versus audiences at the time would have thought about the references to the issue of same-sex marriage, and what it says about voting this November.

(This post contains some spoilers for Psych Seasons 3 and 6.)

A lot happened in California related to same-sex marriage while Psych was airing. In 2004 (two years before the show began), same-sex marriage was briefly legal for one month, though the licenses issued were later voided. It became legal again in June 2008 for a little over four months until Proposition 8 was passed that November, which modified the California Constitution to make the definition of marriage be between a man and a woman. This time, marriage licenses issued in 2008 remained valid.

Psych Season 3 started airing in July 2008. So all of this would have been on people's minds during 3x11 "Lassie Did a Bad, Bad Thing" when Drimmer sets Shawn and Lassiter up to be "former lovers" in their murder-suicide note.

Prop 8 was ruled unconstitutional in August 2010, though this ruling was not final until 2013, when same-sex marriages were again permitted.

6x3 "This Episode Sucks" is when we learn that Lassiter's mom Mona has been with her girlfriend Althea since Lassiter left for the academy, and he keeps a framed photo of them in his apartment:

This episode aired in October 2011. Mona and Althea's right to marry would have very much been in limbo while the appeals worked their way through the courts.

The final episode of Season 6, 6x16 "Santabarbaratown," contains this scene, where our waitress identifies herself as an ally:

That episode aired in April 2012. Prop 8 was still very much on people's minds.

The final season of Psych (Season 8) finished airing in January of 2014, shortly after same-sex couples were again allowed to marry in California.

In 2015, same-sex marriage was finally legalized US-wide, overriding state constitutions on the subject. (If Obergefell v. Hodges were overturned, state constitutions would again take precedence.)

However, the California Constitution still technically defines marriage as being between one man and one woman, thanks to Prop 8. This year (2024), there is a vote on the ballot to finally remove that language from the California Constitution.

So, the issues LGBTQ+ Californians (and the Psych characters) faced while Psych was airing are still very much relevant when you cast your vote this November.

Like that's GAY, it's so common amongst the queer community to be in romantic relationships and having to hide that from their family and friends out of fear of rejection and the possibility of abuse from those loved ones for being some flavor of gay. Homophobia is still very prevalent in society across this earth especially in the USA (looking at the conservative majority Supreme Court who have hinted that they want to overturn Obergefell v. Hodges) and don't get me started on the transphobia and how that has homophobia rooted in it. Literally 64 countries out of 195 countries have criminalized homosexuality as of 2024 and have it in law as of 2024. 12 of those 64 impose the death penalty as punishment for being homosexual. I mean this song was written before 2015 when the Supreme Court in the USA finally did something right and legalized gay marriage federally. Before this only 37 of the 50 states (plus Washington D.C.) had legalized gay marriage starting in 2004 (Massachusetts was the first state to legalize this) like dude that was only 21 years ago when we finally started getting equal rights, in the grand scheme of things that isn't that long ago. I was literally 6 years old when the first state legalized gay marriage and when it became legalized federally in the US I was 13 days away from turning 17. And now almost 10 years since the legalization we still have homophobic Republicans trying to take away the equal right that the LGBT community fought so hard for.

As President Joe Biden (D) wraps up his term today, his four years in office had successes and blunders. I was proud to have voted for this man in the 2020 general and the 2024 primaries. Regardless of where he ends up on the Presidential rankings, he was still a better President than his predecessor or successor. His successes were the fact he led the US out of the COVID pandemic, defended Ukraine from Russian aggression, secured infrastructure investments, got COVID-19 vaccines out to the American people, signed the Inflation Reduction Act, signed the CHIPS Act, signed the Infrastructure Investment and Jobs Act, signed the American Rescue Plan, delivered a 3rd round of stimulus checks, put Ketanji Brown Jackson on SCOTUS, appointed a record number of judges, signing the PACT Act, expanded food assistance benefits, expanded the child tax credit that lasted for 6 months (and should have lasted longer if it weren’t for the Sinema-Manchin duo), joined striking UAW workers on the picket line by becoming the first sitting President to do so, signed the Respect For Marriage Act into law to protect against a potential Obergefell overturn, made Juneteenth a federal holiday, signed the Emmitt Till Anti-Lynching Act that makes lynching a federal hate crime, got the US out of Afghanistan (though the handling of it can be debated), got Sweden and Finland to join NATO, blocked Nippon Steel from buying US Steel, managed to get a ceasefire deal done (though it came too late), brought home Brittney Griner, Paul Whelan, and Evan Gershkovich from Russian prison in prisoner swaps, tried to solve the student loan debt crisis (although the right-wing activist judges keep denying him that), and signing a bill that makes the bald eagle America’s official bird. His failures were his constant enabling of Israel’s genocide of Gaza, signing a bill banning TikTok in which SCOTUS upheld in TikTok v. Garland, signing the 2025 NDAA that banned trans children of military soldiers on Tricare from getting gender-affirming care, failure to get voting rights and Roe codified into law (though Sinema and Manchin are to blame here), and perceptions of chaos at the US/Mexico Border which he tried to solve with a bipartisan border security bill that Trump complained and forced the GOP to scuttle it. During his tenure in office, like Barack Obama-- who he served under during his time as VP-- Biden was subjected to partisan faux investigations by House Republicans. On June 27th, 2024, the debate between him and former insurrection-inciting felon “President” Donald Trump (R) revealed what a lot of Americans knew about Biden: his decline in cognitive ability and why running for a 2nd term was a colossal mistake. That awful debate performance led to him ending his re-election bid on July 21st after weeks of hemming and hawing. As a result of Biden calling it quits in the race, Vice President Kamala Harris (D) moved up to the lead spot on the ticket. Harris later picked Minnesota Gov. Tim Walz (D) to her running mate. On November 5th/6th, 2024, the Harris/Walz ticket lost to the Trump/Vance ticket in the election, and the Democratic ticket not only lost the Electoral College vote but also the popular vote for the first time since 2004. The result left the question of whether aspects of Biden’s legacy will hold up better or worse in the long run.  There were lots of reasons why the Harris/Walz ticket list, and the key reasons for that are as follows (and some of these were out of the control of the candidate):

Right-wing disinformation and misinformation being amplified on social media, such as the infamous Springfield pet-eating hoax and paranoia-induced QAnon/Pizzagate-tinged conspiracy theories about Hurricanes Helene and Milton, Lahaina wildfires, East Palestine train derailment, LGBTQ+/transgender issues (such as pushing the false “social contagion” myth, baselessly comparing gender-affirming care to “mutilation”, and comparing LGBTQ+ community members to “pedophiles” and “groomers”), COVID-19 (especially the promotion of discredited treatments such as ivermectin), and vaccines.

Normalization of anti-vaccine and anti-expertise sentiments.

Biden’s continued enabling of Israel’s genocide of Gaza.

Biden signing a bill banning TikTok, which ended up being costly to Democratic chances among young Americans.

Worldwide anti-incumbent backlash.

President Biden’s low job approval ratings, especially in the 2nd half of his term.

Inflation rate during most of Biden’s Presidency.

House mortgages and grocery prices rising in recent years.

The fact that a sizable amount of Americans were afraid of a woman leading the country, and a Black/South Asian biracial one at that.

Right-leaning and right-adjacent podcasts such as Joe Rogan, Theo Von, Nelk Boys, Shawn Ryan, and Charlie Kirk-- especially those geared to young males-- helped normalized Trump and his misogynistic ways to that crowd.

Right-leaning posts/videos getting more traction than left-leaning or neutral posts/videos on social media outlets, especially on Facebook, Instagram, X (formerly Twitter), and YouTube. This is despite the overheated claims of “censorship” of conservative content on social media.

In shortened form: conspiracy theories, Gaza genocide, disinformation and misinformation, TikTok ban bill, anti-incumbent sentiment, right-wing content dominating social media, President Biden’s low job approval ratings, and inflation were the key drivers for the 2024 losses for the Democrats. As for Harris, I really don’t blame her for the loss very much considering the circumstances that she was thrown in, as I believe that President Biden, cost of living increases, and worldwide anti-incumbent sentiments were the main reasons for her loss. Harris replacing Biden as the Dem nominee helped save the Democratic Party in the medium-to-long term, as she fought Trump to an almost draw in the Electoral College and Popular Vote, got the House to a manageable distance for the Democrats to retake in the 2026 midterms, and got the Senate to a doable chance to flip within the next two election cycles. Imagine if Biden was our nominee in 2024 instead? The Democrats would have fared far worse at the polls, causing them to lose even more states such as New Jersey, Maine’s two statewide ECVs, Nebraska-02, Virginia, New Hampshire, Minnesota, and New Mexico, and potentially put safe states like Illinois, Oregon, Colorado, Rhode Island, and New York in peril. They would have lost 15-30 more House seats and 5-7 more Senate seats, which would have quashed any chance of getting a majority for at least the rest of the decade.

Here is my take on Joe Biden's four years of being the President of the USA: President Biden had his successes and failures.

Key successes: - funding Ukraine. - got the US out of the COVID pandemic. - got COVID vaccines and boosters out to millions of Americans. - set a record on judicial confirmations. - made Juneteenth a federal holiday. - the first sitting president to join a strike.

Key failures: - enabling Israel's genocide of Gaza - signing the bill that got TikTok banned. - perception of chaos. - declining cognitive abilities.
