Bauwerkvertrag: Zur Abrechnung von Teilleistungen eines Einheitspreisvertrages, auf die der Auftraggeber verzichtet

Bei einem Einheitspreisvertrag orientiert sich die Kalkulation an den dem Vertrag zugrunde gelegten Mengen. Im Falle einer Äquivalenzstörung durch Mengenänderungen ist die Geschäftsgrundlage gestört und daher eine Anpassung nach § 2 VOB/B vorzunehmen.

Werden Leistungen vom Auftraggeber teilweise gänzlich nicht abgerufen, handelt es sich nicht um einen Fall des § 2 VOB/B. Da die Kalkulationsgrundlage des Unternehmers der Gesamtauftrag ist, er hier einige Positionen attraktiv im Preis gestaltet und bei anderen (z.B. da er günstige Materialbeschaffungskosten hat) mit einem höheren Gewinnzuschlag belegt, hat der Unternehmer hier einen Anspruch für die nicht abgerufenen Leistungen. Er muss eine Gesamtabrechnung unter Offenlegung seiner ursprünglichen Kalkulationsgrundlage vornehmen und ersparte Lohn- und Materialkosten herausrechnen (entsprechend § 8 VOB/B bzw. § 648 BGB).
