Areas of Practice: Product Liability
In Texas and elsewhere, the earliest Hottest lesbo porn – teen, lesbian, lesbicases imposing no-fault liability on manufacturers and sellers involved contaminated food. Difficulties in proving a food preparer negligent prompted the courts to authorize recovery under theories other than negligence. Most of these early food cases based liability on a form of breach of implied warranty. However, the basis was neither the seller’s representations to the buyer, nor a contractual warranty, but rather a warranty imposed as a matter of public policy.
Texas adopted strict liability in tort for product defects in 1967 in the landmark cases of Shamrock Fuel & Oil Sales Co. v. Tunks and Mckisson v. Sales Affiliates, Inc. Although this step was less drastic than it might appear because of existing law on impure food, it formulated for Texas a completely new remedy for product relatedHorny legal age teenager pair is fucking like crazy, instead of studying – teen, hardcore, blowjob injuries.
The most important limitation on the seller’s exposure is that the product must in fact be defective so as to render it unreasonably dangerous. A manufacturer or distributor of products is not required to be an insurer against all product-related accidents. A manufacturer is not required to design the safest possible product. It is not required that the design adopted be perfect, or render the product accident-proof or incapable of causing injury, nor is it teen xxxnecessary to incorporate the ultimate safety features in the product. There are many ways to injure a person or property while using some manufactured product, but only those attributable to a product defect may form the basis for a strict tort liability cause of action.
There are three types of actionable product defects: manufacturing defects (flaws), design defects, and “marketing defects” (warnings and directions). The first two are actually defects in the product. A manufacturing defect is an unreasonable dangerous deviation, usually a flaw in materials or workmanship, from the standards established by the manufacturer for similar products. A defect arising from the design process makes every unit in the product line unreasonably dangerous. A marketing defect reflects not a problem with the product per se, but the absence of adequate warnings of the risks of harm and instructions for safe use. Without these, thejapan xxx product as marketed is unreasonably dangerous, either for the one who is unable to make an informed choice as to whether to use a useful product that has risks associated with it, or for the user who does not know how to avoid dangers incident to improper use of the product. A manufacturer’s duty to warn of risks inherent in its product is based on the policy that the user is entitled to information necessary to make an intelligent choice as to whether the product’s utility or benefits justify exposing himself or herself to a risk of harm.
The product defect as a basis for recovery shifts the focus from that in a negligence action. The care taken by the supplier of a product in its preparation, manufacture, or sale, is not a consideration in strict liability, whereas it is the ultimate question in a negligence action. Strict tort liability focuses on the product itself and determines whether it is defective. Negligence evaluates the acts of the manufacturer and determines if it exercised ordinary Hot massage movie scenes – hardcore, oiled, teencare in design and production.

so last night i finished "league of dragons", for what's likely only the second time - i can't even remember, it's been a few years since a whole series reread. for the record i only read book 1 before 9 and next up is 2. and i'm seriously impressed by the scale of the story and the worldbulding. the way the dragons have been integrated into many different cultures and the way they're all still dragons and fundamentally different from humans. the series spans like a decade and you can see the difference in laurence (where was that post that compared the frequency of his smiles & laughs...?). he does so much in this book that he'd never approved of in the first one. he's got an impressive array of languages by the end which, goals.
the only disappointing point was a missing final conversation with the defeated lien but i guess temeraire had that offscreen. i never like it when such confrontations are left to the imagination, even though i know it's a conscious choice because whatever would have been written, some people would have been disappointed by it.
anyway this series made me do a presentation on napoleon in my second year of high school or thereabouts, is one of the reasons i took french in fifth year and is likely a subtle driving force behind my desire to learn all the languages lol and i'm really glad it exists
#temeraire#next book up is book 2 the china book#which will be interesting as i now have a decent-ish foundation of mandarin#i don't remember if it tells us the character for temeraire's xiang#i just looked it up and thefirst 3 books of the series were all released in '06#and by the time i got them tl was up to book 4 so that was '08#at the earliest#so doing a presentation when i was 12 checks out#for ages i thought the series ends with book 4 lol ;_;#also yes the translations are the reason i know precisely zero of the actual titles. i had to check the cover of the book i just finished#to know the title#i just know them as 1-the beginning 2-the china book 3-the turkish book 4-the africa book 5-the one where temeraire becomes a general#6-the straya book 7-the south america book 8-thejapan book of which i remember nothing and neither does laurence 9-??? the end???

Mr. Sunshine - 8/10
The best thing about this show is the historical events it covers, but unfortunately, it's also one of the show's weaknesses. I'll explain more about that later.
Alright. SO. This show centers around a man named Eugene (Yoo-jin) Choi. He was born into slavery in the Joseon period, but after witnessing his parents deaths at the hands of the man who owned them, he was able to escape to America as a child with the help of a nearby potter and an American missionary. In America he, of course, faced racism and hardship, but through joining the US Marines he found his place as an American. Thirty years after he left Joseon, he returns. This time he is returning as a Marine and serving as acting consul for the US legation (which is like an embassy). Upon his return he grapples with his identity as a Korean vs his identity as an American and how to navigate the tricky political position he is in as America remains technically neutral in the rising tensions between Korea and Japan. This is all complicated by the fact that Eugene crosses path with Go Aesin, a noblewoman who is a sniper for the Righteous Army (a secretive militia group that works to maintain Korean independence in the face of Imperial Japan), who, of course, he almost immediately falls for because this is a Kdrama.
The other 3 main characters are really interesting. First up is Kim Hui-seong, a Korean nobleman who is in an arranged engagement with Aesin and has been off studying in Japan for the last 10 years. He has been putting off returning to Korean in part because he feels a lot of shame for his family's past misdeeds. Then you have Kudo Hina, the daughter of a prominent Japan sympathizing Korean official, who was married off to an abusive Japanese man who died under ~mysterious circumstances~. And now, having inherited his wealth, she runs the hotel where Eugene and Hui-seong are living. Finally we have Gu Dong-mae, a Korean man who fled Joseon when he was young. He was born the son of a butcher, one of the lowest social classes in Joseon. He witnessed his parents be treated like absolute garbage before his mother fought back, leading to his parents deaths. Dong-mae escaped to Japan where became a skilled samurai and is now back in Korea, leading a branch of a yakuza group that has control over part of Hanyang (what is now Seoul).
So there we have it. Five main characters all with quite different and complicated relationships to Joseon/Korea that defines how they view themselves and this is what makes this story about the fall of Korean to Japan that much more interesting. Unfortunately, I think this is all a bit undercut by the romance. Here's the thing: both Eugene and Dong-mae have absolutely valid reasons to just be like "lol fuck Korea. idgaf what happens to this nation that ruined my life". AND YET since both of them are completely enamored by Aesin, they do things to help her and the Righteous Army. And like why??? I don't get Aesin's appeal???? I think she's definitely the weak link of the main characters. She's a sheltered noblewoman who feels constrained by her position (totally fair!), but you get the impression that she initially joins up with the Righteous Army more because she just wants something to do. She wants excitement and purpose, and it really seems that it is not until much later that she actually believes in the cause. So she's a total ??? to me. I don't get her. I don't get why Eugene and Dong-mae and Hui-seong are SO into her and why Eugene and Dong-mae helps Korea so much because of her. It's weird!!! There is not nearly enough self-reflection from them about WHY they're willing to help out the Righteous Army in spite of how they suffered because of Joseon and its hierarchal social class system.
The other issue with the show is the fact that history ties them to a specific timeline. So if you want to show theJapan–Korea Treaty of 1905 which is kind of the beginning of the end for Korean AND the Japan–Korea Treaty of 1907 which is really where Korea truly becomes a protectorate of Japan, you've got to do a time skip and that time skip was just not well done imo because it felt like we never fully got to catch up with all the characters or understand what had been happening for them during those years.
But in spite of my griping. I DO think that this is a really fascinating period in Korean history to cover and there are some really great characters. It's also BEAUTIFULLY shot with tons of gorgeous Korean scenery. So yeah, I would recommend giving this a watch if you're in the mood for something pretty heavy and serious because like, damn, shit's rough out there for Korea at this time period.

We finally understand the mechanism of photosensitive ion pumps!
We finally understand the mechanism of photosensitive ion pumps!
Biochemists from theJapan Physical and Chemical Research Institute (RIKEN)discovered the mechanism of ion pumps that carry negative ions inside living cells. These ion pumps are actually proteins photosensitive. Once exposed to light, these change shape and allow anions to pass. These works pave the way for brain research and could perhaps find many medical applications. Scientists can then…

The black ones are the shorter ones from the Ver.1-5 they fit not 😥 but perhaps theJapan You Want shop or ebay has some of the new modells like DM20 too.
Still bummed out that I stripped the screws on my translucent green DM20, I really love the shell color… but man I don’t like the orange buttons and frame. I want to replace it with something else. And I think the orange would look great on my yellow one…
I sunk a lot of time into the green one but I’m willing to let go of the sunken cost fallacy to customize my translucent purple to have light grey or white buttons like an old gameboy color, or maybe give it the green frame of my glow in the dark one…. no good though. I could only remove one screw and i’m terrified of stripping more screws.
Bandai really does not want us customizing our Digimon it seems.
At this rate I’d almost like to see if I can pay somebody to do it for me at the cost of shipping and replacement screws, but idk if I can find someone I trust to send back my v-pets.
