WIBTA for publishing a novel that might be in poor taste?

i have been working on my debut novel for the better part of three years. im in the long haul to finish it within the next couple of months and i hope to be ready to publish it later this year.
the caveat is that despite being a fictional high fantasy novel, its main character is from a culture that was eradicted (almost) by the ruling class.
the main characters history is based off of my own experiences as well as stories of what my family and ancestors went through.
im worried it will be received poorly and make me look like an asshole clout chaser trying to capitalize on real-life suffering. im especially concerned since genocide has been a main topic in the publics collective consciousness for the past several months (as it should be)
would i be the asshole for going through with the publication anyway?

Journey to the West Reading Group-Beginning Volume 3
Hello pilgrims! After our (perhaps too-long) rest after officially finishing the second volume of Xiyouji, this reading group will resume with Volume 3 in about a week's time. That's right, on September 15 we will be picking the journey back up with "Chapter 51: Mind Monkey in vain uses a thousand tricks; Futile water and fire makes it hard to smelt demons!" U.S. Copyright Office Presses 'Pause' on DMCA Exemption for Video Games

When we think of a library, we picture never-ending shelves of books; the world's knowledge available to us at the touch of a finger. But nowadays, it's not just physical records that libraries collect. Many now lend video games to their members, providing their local communities with entertainment while helping preserve the software for future generations.
The recent decision by the U.S. Copyright Office (USCO) to reject an exemption to the DMCA for video games in libraries' collections has put that practice into question. The decision prevents video games from being accessed remotely by researchers. While some in the games industry view this ruling as a win for rights holders, others see it as a major setback for arts research, especially compared to researchers in other fields with "routine and regular access" to digital archives.
What Is The DMCA?
Passed in 1998, the Digital Millennium Copyright Act (DMCA) brought the U.S. in line with treaties of the World Intellectual Property Organization (WIPO), updating copyright law for the digital age. Section 1201 of the DMCA criminalizes the "circumvention of copyright protection systems" that prevent unauthorized access to copyrighted works, such as reading encrypted optical discs or removing copy restrictions from electronic documents.
Exemptions are made for some uses, including for nonprofit libraries, archives and educational institutions (section 1201(d)), as long as a "good faith" determination is made. Libraries are permitted to create digital copies of obsolete works for purpose of preservation, but those works must not be commercially available for a "reasonable price" and can only be accessed onsite.
The Petition
The Video Game History Foundation (VGHF) has been working with the Software Preservation Network (SPN) since 2021 on a petition to the U.S. Copyright Office, proposing that the DMCA digital copying exemption be expanded to allow access to games outside of the physical premises of an institution. A study published by the VGHF in July 2023 estimated that 87% of video games released in the US before 2010 are "critically endangered" and inaccessible, being out of print in either physical or digital form. Options to play classic games are limited as many require vintage hardware or are no longer available on a digital storefront, potentially pushing consumers and researchers towards piracy as the most convenient means of access.
The petition's main argument is framed from the perspective of fair use: works kept by archives and collections are exempt from copyright infringement laws if they are used for purposes such as research or teaching. To enable this, the SPN proposed a system of user vetting and copyright notices, allowing institutions to restrict access only to users who submit a research request detailing the scope of their project and providing notices to remind them that their access is subject to copyright law.
The requirement of having to request specific access ensures that games are being used for research purposes, with the SPN citing "academic literacy" as a way of filtering out users planning to access them for entertainment. The USCO already allows institutions to lend other forms of media remotely, and the SPN argued that the DMCA's stringent rules around distribution of software programs places impediments on video game scholarship that are not present in other disciplines.
Arguments Against
The Entertainment Software Association (ESA), a trade association representing the U.S. video game industry, opposed the SPN petition, stating that the exemption would leave rights owners insufficiently protected and that the market for classic video games would be damaged. The SPN's proposed method of fair use vetting was dismissed by the ESA as "illusory", arguing that this was not enough justification for the breadth of use they would enable. It would be too difficult for libraries to supervise multiple users remotely accessing games, thus enabling usage for entertainment purposes.
Furthermore, the ESA contended that the market for classic video games is "vibrant and growing", citing the number of titles currently available on digital storefronts such as the Xbox Game Pass, not to mention frequent re-releases of individual titles on modern systems. That a game is "out of print" does not mean it is lost forever, only that the copyright owner decided not to put it on the market. Allowing widespread remote access to classic games would present a serious risk to the market and prevent copyright owners from enforcing their copyrights.
The USCO Ruling
The USCO observed that, for a fair use exemption, access to the games would have to be guarded against recreational use by containing "appropriately tailored restrictions". The view taken by the ESA on the SPN's proposed restrictions was echoed by the USCO, which ruled that they were not specific enough to prevent market harm and that the SPN had not met the burden of showing that allowing simultaneous remote access by multiple users was likely to be fair.
Regarding the claims of market damage put forth by the ESA, the USCO acknowledged the evidence presented of a "substantial market" for classic video games, and the SPN's concession that the industry has made a greater effort in recent years to reissue older games. Considering these arguments, the Register ultimately rejected the petition, but recommended clarifying the wording used in the DMCA to reflect that a computer program may be accessed by as many individuals as the institution owns copies.
What Does This Mean?
As a newer form of digital media, U.S. law has yet to settle on a definitive classification of what copyrights arise from a video game. A common view is for games to be treated as computer software and for the source code to be considered a literary work. However, unlike "traditional" literary works such as books or newspapers, the interactive nature of a video game makes regulating access to it more complicated.
Games are often limited to their corresponding hardware, potentially leading to research costs going up as researchers may be forced to travel long distances or somehow purchase a retro console for themselves; not to mention potential consideration of extra-legal methods. Researchers are pushed into focusing on works that are easy to access rather than those they have a true interest in studying. Teaching is also affected: academics cannot assign their students games with historical or technological significance if they may not be able to access them (for example, the original Metroid Prime (2002), noted for its female protagonist and being the first game in the series to use 3D graphics, is only available on the GameCube). This curtails the growth of video game studies, introducing obstacles to a field with deepening cultural impact and technological advancement.
In their submission to the USCO, the SPN compared the rise of video games to the film industry, highlighting the creation of the National Film Preservation Board in 1988 as a way of recognizing that films are a part of cultural heritage, worthy of academic preservation and study. Whether games will ever reach that status remains uncertain: they make up a large part of our cultural and entertainment landscape today and it's clear that they are here to stay, but only time will tell whether the USCO's attitudes change.

The content of post-apocalyptic games are usually heavy, with themes of great loss of life and of nature in tow. Please don't feel the need, however, to be constrained to dark themes: human hope and change is a powerful theme in post-apocalyptic literature and art!
Welcome to the 6th monthly game jam that will be hosted on my itch.io page!
In this game jam, your objective is to create a game where apocalypses of any kind are the main focus. What does that mean?
Well, you could create a game where it's a fallout-style post apocalypse with mutated creatures, or you could create a Waterworld or Wind Waker styled game where climate changed has permanently altered the world, or you could create a game where the apocalypse actually gives humanity hope for a brighter future to learn from the sins of the past. It's up to you!
Your games can be tabletop games OR digital games. Anything that gets your mind in the realm of game design is all that matters to me!
IMPORTANT: All games made at any point in time are allowed, but it is HIGHLY encouraged to make games only while this game jam is active. This is a chance to exercise your creative skills AND join a game jam, not just one or the other!
ALSO IMPORTANT: Under no circumstances are people who submit games with bigoted tones, ideologies, or dogwhistles allowed in this game jam. If your work is bigoted in any way, it can and will be rejected for submission. You have no place in my community, and please do not play my games at your tables. This blog is run by someone who is ironically NOT named Mike! No, my name is actually Indigo, my main is @indigos-shits-and-giggles, and my pronouns are he/they/zae. But enough about me, let's talk about rules for submissions!
RULES FOR SUBMISSIONS (Last updated 18/08/2023)
This one's a given, but the characters you're submitting must be named some variation of Mike or Michael
If a character's full name is Michael, they are eligible for submission. So, Mickey Mouse, whose full name is Michael Theodore Mouse, can be submitted!
No real life Mikes or Michaels are allowed to be submitted. Look, I just don't want Michael Jackson fighting against Michael Distortion, for example.
Also, please don't submit any OCs. I just don't want your Mikes to get demolished by Michaels from massive fandoms, you know?
Please only submit one character at a time. The form should be open for multiple responses, so you're free to submit as many characters separately as you like!
That being said, please don't submit the same character over and over.
Submitting multiple characters from the same piece of media is not only allowed but ENCOURAGED. I'll probably only limit it to 3 Mikes or Michaels per piece of media, but you're still very much encouraged to submit all the Michaels you can think of.

— sunghoon caved upon seeing the betrayal in her eyes. he even let sooha go to get closer to her
— della almost succeeded, if sooha hadn't appeared behind her and bit her neck. it wasn't out of pure evil, she was just afraid of what might happen if she didn't
— there was a bonus after-credits scene where della woke up in the middle of the same road. she looked around in confusion and felt weak. really weak
— that was until a man showed up on a motorcycle
— he stopped and removed his helmet, getting off to help her

Notice before hand: This relates to US Labor Rights and GENERAL employment contracts. Please review your contract if you signed one as it may supersede this.
Reminder to workers:
Notice is a COURTESY. You don't OWE your employer notice.
The employer can fire you on the spot (dep. on state) and you can quite on the spot. You can and should request a copy of your employment contract if any employer who tells you that you HAVE to give notice. Give them a reasonable time frame (2 days in most cases) to provide it to you.
If they can't or refuse, then submit your resignation in writing noting that you made attempts to review your contract and your employer will not give you a copy. Ideally do this via email so you can reference your original sent message.
It is illegal for your employer to hold your final pay because they have a stick up your ass. If you feel your rights have been violated, do NOT go to the company HR department. They are HR for the company, not you. Request the final check in writing, and put a response requirement time (1-2 business days). If they don't respond or still refuse, go directly to the US Labor Department (https://www.dol.gov/agencies/whd/contact/complaints) and file a complaint. Do not threaten them, go around them. Threatening helps only you, filing helps all employees.
Obv. as stated, your employment contract could require a notice period. Review to confirm your employer has to give one as well for firing you/laying you off. If it's not there, push them to send you a revised one to sign. If you haven't signed one yet, demand it be a part of it.
I defer to employment attorneys for more specifics, but remember two things: 1) You have rights as an employee 2) Despite what they may say, they need you way more than you need them

($40 per poem), Nonfiction: 1000-2000 words ($75 per essay or article, Cover Art: $100 for reprints, $200 for original unpublished, Interior Art: $50 for reprints, $100 for original unpublished Theme: Solarpunk is a prefigurative, utopian artistic movement that envisions what the future might look like if humanity solved major modern challenges like climate change, and created more sustainable and balanced societies. As a genre and cultural aesthetic, it encompasses literature, visual art, fashion, video games, architecture, and more. Solarpunk carries many aspects of punk ideologies such as rebelliousness, humanitarianism, egalitarianism, animal rights, decolonization, anti-racism, anti-sexism, anti-authoritarianism, anti-corporatism, and anti-consumerism. Similar to the cyberpunk genre, the big difference between the two is that in solarpunk technology and nature are in harmony with one another rather than in conflict. Submissions are closed for the rest of 2023. Our 2024 submission window schedule will be published by the end of September. (At the moment, our nonfiction department is current and always open for submissions. If the fiction portal is closed and you submit fiction through the open nonfiction portal, your submission will be rejected.) All submissions to Solarpunk Magazine are done via Moksha. Any submissions received via email will be deleted without a response. Please don’t email us to describe your story and ask if it’s something we’d be interested in before submitting. We appreciate the consideration, but its easier if you just submit the story through Moksha. We also recognize that there is a lot of justifiable concern over generative AI, data scraping, plagiarizing human created art and literary works, and the potential for AI to displace paying jobs for human artists and authors as a means of further enriching those at the top. Solarpunk Magazine is and remains a venue for human authors and artists to showcase their work. As a result, until further notice, we’ve implemented a strict policy that we do not accept any work created or altered by generative artificial intelligence programs such as, but not limited to Midjourney, Dall-E, and ChatGPT.

Any genre of science fiction, interstitial fiction, magic realism, or fantasy has potential as a solarpunk forum—we welcome robots and elves with equal excitement. If possible, please remove all identifying information (your name, email address, etc.) from your submission file. Your submission won’t be rejected if your manuscript is not anonymous but we prefer to form our initial impressions on the work alone. What our poetry editor, J.D. Likes: Above all else, I value style and form, no matter which kind you choose. There needs to be a certain level of polish to the poetry you submit to us. Your ideas may be interesting, revelatory even, but if the quality isn’t there, then I’m afraid it’s not for me. Also, don’t worry about submitting poetry that rhymes, though I do adore that kind of poetry, and it’s always a delight to read a masterful modern one. Tell us about some cool science or technology that’s going to help us rewild the world, remove carbon dioxide from the atmosphere, or clean up our agricultural act. Weave us the stories of real people who are up to amazing things or of real projects that are underway to help create the world we want to live in. Give us a critical review (of a work, a set of works, or a topic) that rises high enough for a view of the forest as well as the trees. Stake an interesting claim and then convince us that you’re onto something. The possibilities are broad. Interesting is important. Thought-provoking is encouraged. So is keeping it kind. And, again, relevance to solarpunk is key. Some basics: 1- Please don’t send us your solarpunk manifesto or ‘What is Solarpunk’ article. We aren’t interested in publishing those at this time. 2- Non-fiction submissions should be 1000-2000 words long, clearly written, and accessible to general readers. Jargon, when it is necessary at all, should be clearly defined in the text or in footnotes. 3- We prefer to read things in standard manuscript format (double spacing, 1″ margins, page number at the top of each page). Footnotes should be used sparingly, endnotes not at all. Hyperlinks are great and a handful of references for further reading are fine, but not necessary. These are not meant to be academic publications! 4- Any accompanying photos, figures, or other graphics should be the digital equivalent of camera-ready and when the manuscript author does not own the rights to the image, it is the author’s responsibility to secure permission for the publication of the image(s), with any costs to be borne by the author. 5- Submissions should be in English, but either British, Canadian, or American spellings are okay, so long as the manuscript sticks to one style or the other. Please note that our unlike our other departments, nonfiction is always open for submissions. Thanks and good luck! Art We accept art submissions for both cover art and interior magazine art. We are only interested in art that qualifies as solarpunk. If you think your work qualifies, but are unsure, submit and we’ll review your work. We are not accepting submissions of AI generated art. To be considered for cover art, work must be portrait orientation, 8.5×11 inches or a larger equivalent, and at least 300 DPI. For interior art, we also want at least 300 DPI, but orientation and size are open. We prefer work with color, but we do also accept B&W submissions. We’re particularly interested in solarpunk art that features living beings, both human and nonhuman, rather than just architecture and technology scenes.
