It’s been twenty years since my Microsoft DRM talk

It's been 20 years (and one day) since I gave that talk. It wasn't my first talk like that, but at the time, it was the most successful talk I'd ever given. I was still learning how to deliver a talk at the time, tinkering with different prose and delivery styles (to my eye, there's a lot of Bruce Sterling in that one, something that's still true today).

I learned to give talks by attending sf conventions and watching keynotes and panel presentations and taking mental notes. I was especially impressed with the oratory style of Harlan Ellison, whom I heard speak on numerous occasions, and by Judith Merril, who was a wonderful mentor to me and many other writers:

I was also influenced by the speakers I'd heard at the many political rallies I'd attended and helped organize; from the speakers at the annual Labour Day parade to the anti-nuclear proliferation and pro-abortion rights marches I was very involved with. I also have vivid memories of the speeches that Helen Caldicott gave in Toronto when I was growing up, where I volunteered as an usher:

When I helped found a dotcom startup in the late 1990s, my partners and I decided that I'd do the onstage talking; we paid for a couple hours of speaker training from an expensive consultant in San Francisco. The only thing I remember from that session was the advice to look into the audience as much as possible, rather than reading from notes with my head down. Good advice, but kinda obvious.

The impetus for that training was my onstage presentation at the first O'Reilly P2P conference in 2001. I don't quite remember what I said there, but I remember that it made an impression on Tim O'Reilly, which meant a lot to me then (and now):

I don't remember who invited me to give the talk at Microsoft Research that day, but I think it was probably Marc Smith, who was researching social media at the time by data-mining Usenet archives to understand social graphs. I think I timed the gig so that I could kill three birds with one stone: in addition to that talk, I attended (and maybe spoke at?) that year's Computers, Freedom and Privacy conference, and attended an early preview of the soon-to-launch Sci Fi Museum (now the Museum of Pop Culture). I got to meet Nichelle Nichols (and promptly embarrassed myself by getting tongue-tied and telling her how much I loved the vocals she did on her recording of the Star Wars theme, something I'm still hot around the ears over, though she was a pro and gently corrected me, "I think you mean Star *Trek"):

But the start of that trip was the talk at Microsoft Research; I'd been on the Microsoft campus before. That startup I did? Microsoft tried to buy us, which prompted our asshole VCs to cram the founders and steal our equity, which created so much acrimony that the Microsoft deal fell through. I was pretty bitter at the time, but in retrospect, I really dodged a bullet – for one thing, the deal involved my going to work for Microsoft as a DRM evangelist. I mean, talk about the road not taken!

This was my first time back at Microsoft as an EFF employee. There was some pre-show meet-and-greet-type stuff, and then I was shown into a packed conference room where I gave my talk and had a lively (and generally friendly) Q&A. MSR was – and is – the woolier side of Microsoft, where all kinds of interesting people did all kinds of great research.

Indeed, almost every Microsoft employee I've ever met was a good and talented person doing the best work they could. The fact that Microsoft produces such a consistent stream of garbage products and crooked business practices is an important testament to the way that a rotten organization can be so much less than the sum of its parts.

Coase says the reason institutions exist is to enable people to work together with lowered "coordination costs." In other words, if you and I are going to knit a sweater together, we're going to need to figure out how to make sure that we're not both making the left sleeve. Creating an institution – the Mafia, the Catholic Church, Microsoft, a company, a co-op, a committee that puts on a regional science fiction con – is all about minimizing those costs.

As Yochai Benkler pointed out in 2002, the coolest and most transformative thing about the internet is that it let us do more complex collective work with smaller and less structured institutions:

That was the initial prompt for my novel Walkaway, which asked, "What if we could build luxury hotels and even space programs with the kind of (relatively) lightweight institutional overheads associated with Wikipedia and the Linux kernel?"

So the structure of institutions is really important. At the same time, I'm skeptical of the idea that there are "good companies" and "bad companies." Small businesses, family businesses, and other firms that aren't exposed to the finance sector can reflect their leaders' personalities, but it's a huge mistake to ascribe personalities to the companies themselves.

That's how you get foolish ideas like "Apple is a good company because they embrace paid service and Google is a bad company because they make money from surveillance." Apple will spy on you, too, if they can:

Disney and Fox weren't Romeo and Juliet, star-crossed lovers making goo-goo eyes at each other across the table at MPA meetings. They were two giant public companies, and any differences between them were irrelevancies and marketing myths:

I think senior management's personalities do matter (see, for example, the destruction of Boeing after it was colonized by sociopaths from McDonnell Douglas), but the influence of those personalities is much less important than the constraints that competition and regulation impose on companies. In other words, an asshole can run a company that delivers good products at fair prices under ethical conditions – provided that failing to do so will cost more in lost business and fines than they stand to make by cheating:

Microsoft is a company founded and run by colossal assholes. Bill Gates is a monster and he surrounded himself with monsters, and they hired monsters to fill out the courts of their corporate palaces:

To the extent that good things come out of Microsoft – some of its games products, the odd piece of hardware, important papers from MSR – it's in spite of the leadership; it's the result of constraints imposed by competition and regulation – and that's why Microsoft pursued such an aggressive program of extinguishing its competitors and capturing its regulators.

In retrospect, I think one of my goals in that talk was to convince those people doing good work for a rotten institution to go elsewhere and do other things. Certainly, that's one of the goals I pursue in the talks I give today. At the time, some of Microsoft's highest-profile technologists were publicly resigning over the company's war on free/open source software, so it wasn't an unrealistic goal:

What I did not expect what that publishing the talk on my site and blogging it on Boing Boing would spark a wave of public interest that would get its message in front of several orders of magnitude more people than I spoke to at Microsoft that day. Re-reading the speech for my podcast on Sunday, I expected to be struck by the anachronisms in it, and there were a few of those to be sure. In other words, I've been saying the same thing – in different ways – for more than 20 years. That could be depressing, but I actually found it uplifting. Two decades ago, I was radicalized by a fear that the internet would be seized by corporations and governments and transformed into a system of surveillance and control. I found my way into a job at EFF, where I worked with colleagues across multiple disciplines – coders, lawyers and activists – to fight this force.

At the time, this was a fringe cause. Most of the traditional activists I'd come up with in the feminist, antiwar, antiracist, environmental and labour movement viewed digital rights as a distraction and dismissed its partisans as sad, self-obsessed nerds who mistook fights over the management of Star Trek message boards for civil rights struggles:

I thought I was right then, and I think history has borne me out. The point of waging these fights – both in the wide public sphere and within political movements – is to get people activated before it's too late. Every day that goes by is a day when the internet becomes more inhospitable to political organizing for a better world – more surveillant, more controlling. I believed then – and believe today – that the internet isn't more important that the other fights I waged as a young activist, but I think that the internet is fundamental to those fights.

Saving the planet, smashing patriarchy, overthrowing tyranny and freeing labor are all fights that will be coordinated – Coase style – on the internet. Without a free, fair and open internet, those fights are infinitely harder to win.

The project of getting people to understand, care about, and fight for digital rights is a marathon, not a sprint. When I joined EFF, it was already 12 years old. There were six people in the org then (I was the seventh). Today, there's more than a hundred of us, and we're stretched so thin! The 30+ year old idea that internet policy will intersect with every part of every fight has been utterly vindicated.

Back in 2004, I asked Microsoft why they were willing to fight the US government to the death over antitrust enforcement, but were such wimps when confronted with the entertainment industry's demands for DRM. 20 years later, I think I know the answer: Microsoft understood that DRM would let them usurp the relationship between creative workers, entertainment industry companies, and audiences. Their perfect instincts for seeking out and capitalizing on opportunities to seize monopoly power drove them to make deliberately defective products, in the belief that their market power would let them cram those products down our throats:

Hello! I was putting this off bc it was causing me much distress just thinking about which moments I would choose, but here we are! You didn't specify how many so I narrowed it down to my all-time top 10, with a few honorable mentions.

You did specify 'as teammates', so I'm gonna leave out the infamous singapore 2018 pool, tho it is an all-time charlos moment to be sure... The order is honestly kind of random because I found it really hard to rank them (don't ask a mother to choose her favorite child!)

10. Cookie decorating!! (2022) - I love this video so much (which is why I made a whole charlos flirting video essay about it). It's just chock-full of classic ways the two of them interact and joke around (Charles trying to blindfold Carlos for him, constantly trying to steal things out of his hands, both whistling/humming the same song at different points, touching constantly...). And why were they sitting like this?? (we know why) Anyway, I don't think we talk about it enough.

9. Monza Ferrari battle (2023) - I simultaneously love and hate this moment asfghdka which is maybe why it's down so low on the list. It's the most adrenaline and anxiety I've ever had watching F1 (I was literally running circles around my living room, yelling at the TV). But I think it also just exemplifies how competitive the two of them are, how hard they race each other without crashing. Like, their rivalry is core characterization for them, therefore it had to be on the list!!

8. Bahrain 1-2 (2022) - A classic!! Their first double podium and 1-2 as teammates! Their hug in parc ferme!! Carlos trying to pour wine into Charles' mouth on the podium!!! They were so giddy and happy, and it felt like the start of an incredible year...(we all know how it really turned out 🥴) This could maybe be higher on the list, but it feels so long ago now that I think I'd need to rewatch the race to draw back up those emotions again.

7. 'Lord Perceval' is coined (2021) - This whole moment is so cute, and it became pretty iconic since the team would go on to use the nickname a lot, and it spread throughout the fandom. It's sort of funny bc they were clearly joking around, but it caught on. They became the Smooth Operator and Lord Perceval, and I think that's beautiful.

6. Monaco hug (2024) - It was actually harder than I thought to choose between this one and the Monza '24 one. They both feature Carlos being super happy for a Charles win, his patented charles hair grab, as well as charlos cradling each other heart-to-heart, cheek-to-cheek. ❤️ I went with Monaco bc it came first in the year so had a greater impact on me, and bc Charles finally broke the Monaco curse.

5. Carlos' birthday surprise (2022) - Set the standard for Charlos birthday shenanigans. Charles complaining about his legs cramping in the cupboard LOL. I just love how happy Carlos looked in all those clips... 3. THE tiktok (2022) - This might be too high on the list tbh, but for the sheer shock value of waking up to it that day and the mania it caused in the charlos community, it's a hard one to beat. 😂

2. C² song challenge in Fiorano (2021) - this one gets the place of honor as #2 bc it's charlos' favorite moment together (along with Bahrain '22). They've both mentioned a few times that they fondly remember that day, and how much they laughed. It's also at the very beginning of their partnership, and it shows how immediately they acted like giddy besties.

1. Chili plushie (2024) - Okay. I guess?? This is my all-time favorite charlos moment??? 🥺 It was my favorite of 2024, so it could be recency bias. But something about it being the start of their bittersweet end...Carlos gifting him the chili...'so you remember me for the rest of your life'...Charles in his denial era...oof. I just really love these two, and this moment made me emotional about their years of friendship, rivalry, and shenanigans soon coming to an end.

This was so hard!!! But alas, I forced myself to narrow it down, and also to try and represent all of the years of their partnership, in different scenarios (racing/non-racing). It only took a few minutes for a new DM notification to pop up. Pedri: Stalking my Instagram, I see?

I genuinely don’t understand how some Gwynriels interpret any criticism of them as people being “threatened” by their ship. Maybe they should consider that it’s less about the ship itself and more about their behaviour. It’s that no one has ever been able to join this fandom without being immediately cornered about whether or not they’ve read "the" bonus chapter, or being subjected to some patronizing lecture about how you’re supposed to read it correctly.

It's about the exhaustion of being bombarded with the same handful of cherry-picked lines, completely removed from context. It's about the glaring double standard in how characters are treated. Azriel gets turned into something unrecognizable to serve a narrative. Both Elain and Lucien, who have been integral since the first book and are central to ongoing plotlines, are dismissed as underdeveloped, while outrage erupts if anyone dares suggest Gwyn, a new side character, might not be the next protagonist. Gwyn’s healing journey, which was so clearly focused on regaining the lively and competitive personality that was repressed by her trauma, is misrepresented as romance. It’s just… bizarre.

Some Gwynriels insist Elriel was never romantic (despite the actual text), while others say it ended definitively in a bonus chapter (despite the ridiculousness of that idea). They moralize lust and rewrite moments depending on who’s involved, and they completely ignore clearly romantic scenes if they involve characters they don't like. It creates this alternate reality version of the story that’s bizarre to witness from the outside. And people tend to want to talk about things that are bizarre.

People don’t keep bringing up Gwynriel because they’re threatened. They do it because Gwynriel has turned into a spectacle. And it is not about shipping preferences. The spectacle of Gwynriel is the insistence that actual canon narratives do not exist, and that sweeping canon-defying extrapolations are confirmations of a complete change in direction of the whole story. And that people should just accept this as true when it is just categorically bizarre.

It's not about being threatened. It's about the exhaustion of having someone down your throat for four years while they demand you respect them. It's about being suffocated to the point that you kind of just have to talk about it. In a "what the hell is going on"? kind of way. I remember mutuals who left already in 2021-22, who had been in the fandom for years, because they felt so suffocated and exhausted by this behaviour. And four years later, I'm still here and that is still going on. The fandom was not sunshine and rainbows before Gwynriels, but it was nothing at all like this.

im sorry - they think we’re “threatened” by their fanon ship? LMFAO. Threatened by what. Despite spending time in the ring with his “mate” who would Az think off every night? Elain Archeron. His mate was in danger, went through something so traumatic- what did Azriel do? Leave her with Mor to carry on with his job. Two years. He didnt visit for two entire years, he didnt check up on her. Ask about her. I could go on but you get the gist - no one is threatened by gwy/riel. There is nothing tying these two together. Az could leave training and thats it. He wouldn’t see Gwyn most of the time. Elucien at least have a bond, gwnriel dont even have that. But ofc they’d twist us critiquing them and their behaviour- not only to us but to their own eluciens as us being “threatened”.

The bonus chapter is the only thing that they think gives them some standing, it doesn’t. The same bonus that isn’t reprinted in the special editions, the bonus that over half of the fandom do not know about - but you know whats rlly embarrassing for them? Not a single part of the “gwynriel” bonus was mentioned in acosf. Not the late night training. Not the singing shadows. Not Az and Gwyn becoming closer. Not the necklace. That is how irrelevant it all was, so damn unimportant that in the 300pgs you had left after solstice - Mass didn’t bother to mention any of it once. But ofc they don’t care cause they cant think outside of “spark!” “Glow!”. They can’t enetertain any other possibility or narrative that doesn’t fit what they set for themselves. God forbid, you challenge their takes. At first they’ll try to debate but once they realise they’ve gone through their 5 repeated points, want to know what happens next?

“elriels are like sooooo mean!” “Elriels are just so so toxic.” “Elriels are bullies!” “Elriels always use canon!” Elriels are this, elriels are that.

oh and no one can say anything about precious Gwyn. Nope, she is perfect. She is exactly what they want her to be. Lucien and Elain are irrelevant, Az is toxic, incel and disgusting but ONLY towards Elain - these issues don’t exist with Gwyn, Elain is too undeveloped for a book but perfect, flawless Gwyn has the right amount of development so she will obviously be next. Lucien? He’s irrelevant too, Gwyn is linked to autumn and thats more important then Luciens messed up family. Gwyn will deal with the troves, the prison and koshei - Lucien and Elain need to sail off on a lake somewhere. Etc etc. Gwyn is currently THE most important person everyone else is just there to remain sitting little ducks until Gwyns fabulous story is over.

Gwynriels guide on how to read the bonus correctly: whilst reading the elriel part, keep on chanting “Azriel is toxic” “Azriel is disgrunting” “elain is boring” “elain is manipulative” etc then whilst you finally get to Gwyns’ part - highlight everything. Az chuckled with Gwyn, aww he has NEVER done that before - highlight it. Now.

THIS. Its the fact gwynriels cherry pick what suits them and what doesn’t. They need to”evidence” from all 3 series just to make sense…and yet their arguments are still so terribly illogical. That was one of my biggest turn offs from Gwynriel actually, them acting as tho throughout acosf, Gwyn was crushing on Az which was not the case at all and is such a disservice to her character.

Gwynriels 🤝 contradicting statements which is why it’s hard to take them seriously. Lmfao, like Elain making Az laugh so joyously means nothing to them and isn’t romantic but Gwyn making Az chuckle and snort - is the beginning of a gwynriel romance. Its hypocritical.

Say it louder anon, literally no one is threatened by a ship where the two characters dont even have any romantic interest towards each other - but gwynriel and gwynriels have become something to witness with how desperate they’ve become to convince everyone including themselves their ship is just as much as a possibility like elriel or even elucien. Its like when a kid in your class gets an answer so wrong you just have to put your pen down and wonder how tf they reached that conclusion.

gwynriels have definitely affected the fandom, im sure some are nice but majority are disrespectful, condescending, stubborn etc. They come into elriel spaces and talk about their ship and how they’re right, they’re constantly mocking elriels - Im sure the fandom wasn’t lovely before but gwynriels have turned it more hostile. I dont blame anyone that left this fandom because of them - it’s exhausting trying to see reason with people who believe a bonus holds more weight then the previous 4 books. That a new character we’ve just met is suddenly the most interesting and important then any of the OG cast - Someone said it before, but gwynriels argue with their own version of canon mixed with opinions and biased interpretations- you just can’t logically argue with that.

And if a gwynriel genuinely listened and understood how little a bonus affects the books - they’d see reason.

Matthew Tkachuk on friend, former teammate Johnny Gaudreau: ‘I’m going to keep his memory alive’

FORT LAUDERDALE, Fla. — Matthew Tkachuk, reigning Stanley Cup champion and prince of South Florida, was bouncing off the walls at the Baptist Health IcePlex on Tuesday. He delivered light cross-checks to his Florida Panthers teammates and led the pack in conditioning drills, and his mouthguard received its customary chomping.

It appeared to be business as usual for the young star who is always occupied with something, whether it be selling the sport in Florida or partying with the Stanley Cup all summer.

Right now, that might be for the best.

Tkachuk’s dream summer turned into a nightmare when he learned of Johnny Gaudreau’s death on Aug. 29.

Gaudreau and his brother, Matthew, were killed in a traffic crash in Oldmans Township, N.J., outside Philadelphia. Police said the brothers were riding bicycles when they were hit by a driver trying to pass an SUV on a two-lane road.

Tkachuk and Johnny Gaudreau played together for six seasons with the Calgary Flames, a couple of American kids taking western Canada by storm, often on the same line. The two left the Flames in the summer of 2022, Gaudreau signing as a free agent with the Columbus Blue Jackets, while Tkachuk was sent to the Panthers in a blockbuster deal.

Tkachuk, whose life has been a whirlwind for months, hasn’t had enough time to process Gaudreau’s death in the month since it happened.

“You put so much work into a season, that’s where all of your energy goes,” Tkachuk said. “Then you make the playoffs. You make the Final. And then, when it was over, we got to celebrate this summer. It was the greatest summer of my life, and some of the most incredible memories were made. But then, right at the end of this amazing summer, the unthinkable happened.”

Gaudreau took Tkachuk under his wing in Calgary, and a forever friendship was formed. Understandably, Gaudreau is on Tkachuk’s mind every day, but that was already the case long before Gaudreau was gone.

“Ever since I left Calgary and came to Florida, all I ever do is tell stories about Johnny,” Tkachuk said. “At one point, I was probably telling the guys down here a Johnny story once a week. I was always talking about him, about something funny he had done, something he had done in practice, whatever. He was the kind of guy that you could never get out of your mind, and I hated being away from him.”

Gaudreau and Tkachuk talked all the time after leaving Calgary, and while they badly missed playing together, they looked forward to having another opportunity to wear the same jersey and maybe even play on the same line.

The NHL 4 Nations Face-Off — a tournament among the United States, Canada, Finland and Sweden — will be in less than five months in Boston and Montreal. Then, in 2026, NHL players will return to the Olympics for the first time since 2014. Between the NHL balking at its season being delayed and COVID creating havoc with the 2021-22 schedule, NHL players have not participated in the Olympics for a decade.

“You have to understand that Johnny and I talked about being in the Olympics together a lot,” Tkachuk said. “In 2022, when they canceled us from being in the Olympics, we were so upset. We were both playing really well together in Calgary and we thought we were going to be so good in the Olympics. We talked about it all the time. That was a tough one. He had played for Team USA in so many big events, and I know it meant a lot to him. Obviously, we would have been together this time. It’s tough to think about right now. But I know he would have been excited for those tournaments and he will be on my mind during those times even more than he usually is.”

Tkachuk doesn’t require nor ask for any sympathy. He simply misses his friend.

“Trust me, I feel like I’m the luckiest guy in the NHL,” he said. “I get to play a sport that I love, and it’s my job. And I get to play it (in Florida), which, in my opinion, is the best place in the league. The lifestyle. The fans we’ve developed down here. The way our fan base is growing and growing every day. You wouldn’t want to be anywhere other than this place. It really is the best, and I’m so lucky to have this life. I came here to win a Cup. I looked at this group of guys and I knew it could be done. I knew something special could happen. I guess I was right.”

Tkachuk’s emotions will surely peak in a few weeks, when the Panthers play on Oct. 15 in Columbus for the Blue Jackets’ home opener. In lieu of typical opening night ceremonies, the Blue Jackets will honor the memory of Johnny and Matthew Gaudreau.

“I really haven’t thought about that night too much just yet,” Tkachuk said. “But I have a feeling that it’s going to be pretty tough to play that night. It’s not just me that’s feeling it, obviously. The whole league is feeling it right now. Anyone who knew him is feeling it even more.”

Tkachuk is busy preparing his Panthers for a chance to claim back-to-back championships. Dynasties aren’t much of a thing in the modern-day NHL, but the Panthers have won the Cup once, have been to the Final two years consecutively, and their core remains in its 20s.

“We can do something special,” Tkachuk said.

Even still, a small part of his mind remains focused on the international tournaments, where he’ll never get the chance to play with Gaudreau again. But he does have a chance to honor Gaudreau during those tournaments.

“It’s been a really, really, really tough few weeks,” he said. “I still can’t even believe it. It’s just so sad. All of it.”

While sitting and looking down at the Panthers practice facility, Tkachuk’s face alternates emotions, his mind churning.

“You know, the thing that’s getting me through this is those stories I was telling you about,” he said. “Those stories about him I tell all the guys constantly. I’m going to keep those stories with me forever and I’m going to keep his memory alive in everybody by continuing to tell those stories.”

He hopes to generate another story involving Gaudreau when the Olympics arrive.

“He would have been there and wearing that Team USA jersey meant a lot to him,” Tkachuk said. “It means a lot to me, too. When I’m there, he will be on my mind the whole time. Even more than usual. And I’ll be telling stories.”

Cetanganda: Foreword and ch. 1

Cetaganda here we go!

Something marvelous happened: there was only one Cetaganda volume left in my e-library! There's two copies available at any given time for most Vorkosigan books, so that means there's other person reading the book too. I requested that they continued the Vorkosigan saga selfishly last year after reading Shards and Barrayar (I only had TWA left) so it makes me happy that other people are benefiting too. (I was so surprised when the library answered my request the following week with "Sorry, we could only get up to no 10 :/". That's 7 books more than you had before!!)

This edition has a foreword written in 1996 explaining the context of the Vorkosigan saga at the time. The guy is extremely excited for Memory to come out, and wonders if either Cetaganda or Memory would get the 1997 Hugo. A Wikipedia search reveals neither did and that the foreword guy died in 2021. Oh, well. I hope Memory also has a prologue from him so I can know if he liked it. He did seem to like Cetanganda a lot!

Ivan is 22 and Miles is 21 and will be 22 in some months which doesn't math with previous books, I recall in TWA Miles tells Elena that he is registered as born when transferred to the uterine replicator, and that would make him a bit older than Ivan as per Barrayar. This implies that his birthday was at some point changed to his second birth. Is this correct??? Sounds weird, but I can totally picture him changing his birthday for some weird paperwork issues when entering the military academy or something. Or maybe it's a security issue and he had to change his birthday to not have the same as Admiral Naismith.

Anyway this sets this book two/one-half-ish years after TVG. Cool!

If this tedious duty ran to schedule, he should actually be back home in time for a celebration, for a change. A pleasant thought
