What A Bus Accident Lawyer Wishes Victims Knew About Bus Accidents
Were you or someone you love recently in an accident involving a bus and wondering if you might have a case? Belal Hamideh, a bus accident lawyer in Southern California, has helped many who were injured in vehicular accidents. While bus accidents share many similarities with other kinds of vehicular accident cases, there are important differences as well. If there’s any possibility that you were hurt in an accident with a bus, reach out for a free case evaluation.
Any Kind of Bus Accident Could Be a Case Some are under the assumption that, to have a bus accident case, they need to have been involved with a several-car pileup while on a Greyhound bus. That’s not the case. Really, to have a case, you just need to have been injured in an accident involving a bus that was caused by the negligence and/or recklessness of another party. So, you could have a case if you were hurt on a Long Beach Transit bus, a school bus, a tour bus, even a private bus, a hotel shuttle, a rental car shuttle, or anything else.
Damages for Your Accident Your accident doesn’t need to have been a serious crash for you to have been injured by it. For example, many bus accidents come not necessarily from a bus careening wildly into a building, but rather, from a “fender bender,” or a bus driver having to slam on the brakes, which could give you (as well as other passengers) whiplash. That can lead to serious injuries even if none are visible at the moment. If you have been hurt in any way in a bus accident, it’s worth it to reach out for medical attention just to make sure.
You Don’t Have Forever to File Unfortunately, in so many ways, a bus accident can be a life-changing event. As such, it’s natural to want to take your time to rest, to recuperate, and so forth. That is the right thing to do when it comes to your health, but not the best course of action when it comes to reaching out to an attorney. You have two years from the time of the accident to file a lawsuit. That period of time shortens dramatically depending on which parties may be at fault (such as if they’re a public entity, and so forth).
A Bus Accident Lawyer Who Can Help Today In the wake of a bus accident, it’s completely understandable to not know what to do. All you did was get on a bus, or go onto the road, and so forth. You did not ask to be in an accident. If you were, Belal Hamideh and the staff here can help. No clients of ours pay us unless we win. We do win 99% of the time. That said, our payment comes out of their eventual settlement. To schedule a free case evaluation, message us through our site or call.

Australia: Driver charged in bus accident that killed 10 wedding guests denied bail
Brett Andrew Button, 58, was driving 35 passengers on a 20-minute journey from a wedding reception in New South Wales when the bus rolled at a roundabout late Sunday.
Tumblr media
CESSNOCK: A bus driver was driving too fast when the vehicle rolled on its side and hit a guard rail in heavy fog in an Australian wine region, killing 10 wedding guests and injuring 25 others, police alleged Tuesday.
Brett Andrew Button, 58, was driving 35 passengers on a 20-minute journey from a wedding reception at the Wandin Estate Winery to the town of Singleton, both in the Hunter Valley wine region of New South Wales state, when the 2009 Volvo bus rolled at a roundabout late Sunday.
Button had been in police custody but was released on bail when he appeared in the Cessnock Local Court on Tuesday charged with 10 counts of dangerous driving in relation to each death and one count of negligent driving.
Earlier, acting Police Assistant Commissioner David Waddell alleged that Button “entered that roundabout driving in a manner that was inconsistent with the conditions.”
“Obviously, the speed was too quick for him to negotiate that roundabout, causing the vehicle to fall onto its left side and cause those injuries,” Waddell told reporters.
It was Australia’s most deadly road accident since 1994, when a bus skidded on its side across a highway and down a steep embankment in Brisbane, killing 12 people and injuring 38.
Police said Button underwent mandatory testing for drugs and alcohol Sunday night but no impairment was detected.
Prosecutor Courtney Broom argued against Button being released on bail.
“There are 10 witnesses who gave evidence in relation to the prolonged behavior of Mr. Button and dangerous driving,” Broom told the court.
“There is evidence in the fact sheet that says they (passengers) fastened their seatbelts,” Broom added.
Defense lawyer Chris O’Brien pointed out Button’s clean criminal record and only seven traffic offenses on his 30-year driving record.
Magistrate Robyn Richardson said his family ties and bail conditions could reduce his risk of fleeing the country or interfering with witnesses. She also noted a trial was unlikely to be heard before late 2024.
His bail conditions include that he does not drive and that he observes an overnight curfew at his Hunter Valley home of Maitland.
Button sat with his head bowed throughout the short bail hearing and wept when Richardson noted that he was clearly suffering and said she had concerns about his wellbeing.
“It is clear to this court he suffers along with the rest of the community,” Richardson said.
Broom said Button could face further charges in relation to the seriously injured survivors.
Of the 25 passengers taken to hospitals, 14 had not been discharged by Tuesday, with two remaining in an intensive care unit in critical but stable condition, Waddell said.
The dead and injured were aged from their 20s to their 60s, Waddell said.
He declined to comment on media reports that Button told passengers through the bus’s microphone shortly before the crash, “If you think that was fast … watch this.”
Waddell also declined to comment on reports that passengers were standing moments before the crash.
Linq Buslines, which provides school bus and event charters, owns the bus involved in the crash. Its website says all its buses are equipped with seatbelts.
New South Wales law requires bus passengers to use seatbelts if they are available.
The tragedy has rekindled public debate but Australia’s seatbelt laws and whether there should be national rules.
New South Wales Premier Chris Minns said, while not commenting on Button’s case, bus drivers in that state were legally responsible for ensuring passengers wore seatbelts.
“It’s always the driver of the vehicle whose responsibility it is to ensure that there’s enforcement with the law and to reinforce the point,” Minns told Australian Broadcasting Corp.
Victoria state Premier Daniel Andrews said: “This is an incident that I’m sure every state and territory will learn from.” Several of the passengers were from Victoria.
Andrews said he was open to a national approach on bus seatbelts, but noted complexities around school, charter and public transport types and difficulty in striking a deal.
“Sometimes getting a national agreement can add a long period of time to the process of developing rules,” Andrews said.
Tasmania Premier Jeremy Rockliff said his government would also consider any recommendations that come from the crash investigation.

How to Sue Local Governments Under the Texas Tort Claims Act
Every year, hundreds of people in Houston and elsewhere in Texas suffer injuries caused by garbage trucks, public buses, police cars, ambulances, and municipal construction vehicles. Before 1969, victims were unable to claim compensation from local governments. Today they can file a claim under the Texas Tort Claims Act in many circumstances.
The Texas Tort Claims Act (TTCA) is a series of statutes that determine when the state, a city, county, or other government entity can be held liable for personal injury, deaths, or property damage. The TTCA limits liability in certain circumstances. However, it gives victims more protection than before its enactment when sovereign immunity provided complete protection against lawsuits being filed against governments.
Sovereign immunity is an ancient and unfair doctrine derived from the British common law and the idea that the monarch was above the law so could not be sued. Sovereign immunity was imported into U.S. law and protects many states. Sovereign immunity protects state divisions including hospitals, universities, and state boards. Subdivisions of the state including cities such as Houston, counties, and school boards are protected from lawsuits and liability by government immunity. The Texas Tort Claims Act allows lawsuits against state bodies, cities, counties, and other entities. However, making a claim is complicated and time is of the essence given the tight deadlines. You should talk to an experienced Houston injury lawyer to avoid making mistakes that could jeopardize your claim.
When is a Government Liable Under the Texas Tort Claims Act?
The Texas Torts Claims Act partially waives the state’s immunity to liability for wrongs committed by its “governmental units” and their employees. Governmental units include police and fire departments, hospitals, parking facilities, schools, jails, construction departments, airports, health and sanitation services, parks and zoos, community and senior services centers, and public transportation.
The TTCA recognizes two types of injuries, specifically:
Injuries, deaths, and property damage from car accidents or “motor-driven equipment” accidents, and;
Personal injury or death “so caused by a condition or use of tangible personal or real property,” which can include slip and fall injuries in public buildings. Property damage claims cannot be filed in premises liability cases against governments.
A government entity can only be held liable for injuries, deaths, or property damage caused by the wrongful act, omission, or negligence of workers acting within their “scope of employment.” The employee must have been liable as if they were a private person. This means there is no strict liability placed on government workers. If you end up injured on a Houston METRO bus, the city cannot be held liable if another driver caused the bus to crash.
Texas law defines “scope of employment” as “the performance for a governmental unit of the duties of an employee’s office or employment and includes being in or about the performance of a task lawfully assigned to an employee by competent authority.”
In other words, an employee must be working for a state or local government entity at the time of the accident for the Texas Tort Claims Act to apply. While a city may be held liable for injuries caused by a police car speeding to a crime scene, it will not be liable if a police officer assaults a concert-goer while he is performing weekend contract work for a private entity.
Local governments are typically only liable for accidents when performing core government functions that include police and fire protection, transportation, education, sanitation services, street and bridge construction, and other key areas.
Governments typically are not held liable for damage caused by potholes, damage and injuries from weather-related situations, non-mandatory functions in parks, and emergency situations. However, local governments may be held liable for drownings at poorly-supervised municipal swimming pools, attacks by police dogs during working hours, and the failure to clear snow or ice on major highways.
When Should a Notice be Filed Under the Texas Torts Claims Act?
If you believe you have a valid claim under the Texas Torts Claims Act, you have just six months to file it. The notice must describe the damage or injury claimed, the time and place of the incident, and the incident itself. Some cities require notification even sooner. The City of Houston requires written notice within 90 days of the incident.
This requirement means Texas Torts Claims Act cases carry a greater urgency than other personal injury lawsuits which must be filed within two years.
How Much Can You Recover Under the Texas Torts Claims Act?
The liability of the State of Texas under the Texas Torts Claims Act is limited by statute to $250,000 for each person and $500,000 for each incident involving a death or a bodily injury. Each incident causing property damage is limited to $100,000. The liability of a unit of local government, such as a sanitation department, a school board, or an emergency services organization, is limited to $100,000 per person, $300,000 per incident, and $100,000 for property damage.
The liability for a municipality such as a city is limited to $250,000 per person and $500,000 for an incident that causes injury or death. Property damage is limited to $100,000.
The complexity and time-sensitive nature of claims under the Texas Tort Claims Act highlight the importance of hiring an attorney who has handled many of these cases. so i've been thinking about this and i think the BIG difference is that unlike the other "school is hell" novels, nifkin doesn't have any support system in the school OR compelling reason to get away from it. for months! in alan mendelsohn, leonard meets and befriends alan fairly quickly, and when alan gets suspended/leonard gets temp excused they already have plans to trawl bookstores where they meet samuel klugarsh, the mad guru, etc. in young adult novel all the action takes place in the school but the members of the Ducks sort of insulate each other from the school environment which has a notably less negligent/cruel administration than the others. in the snarkout boys, again the two protags meet at school and quickly build a robust network of acquaintances outside of it. the only connections nifkin makes at school are linda/nastasia, who he sees there all of once; lance, who is terrible; delfett or however that's spelled who he beats up; and the unnamed slacker who tells him how to skip study hall.
it is only after he becomes so depressed that he literally can't even get off the bus that he skips school, and then he doesn't even get the energy up to get OFF the bus until he completely randomly runs into kenny papescu. nifkin is at rock bottom for a good portion of the book in a way that pinkwater protagonists rarely are.
it's also interesting that i think this is the first school novel that has a private school as an escape from the torture of public school and it's not portrayed especially well here. the wheaton school is a much healthier environment for nifkin than public school, but it is essentially an institution that exists to provide no-effort diplomas to kids who may or may not ever show up. there's a bit where the protagonist wonders how it's even accredited, and it's mentioned that the students who are there because their parents enrolled them under the impression it is a legitimate school really struggle there. nifkin graduates with a fake drivers license and a job delivering counterfeit art pieces for his friend's dad. what the hell!
daniel pinkwater is, if not my favorite author, at the very least top three and the education of robert nifkin is a good book but it also reads like he put alan mendelsohn, young adult novel, the snarkout boys, and lizard music in a blender and hit liquefy. there's really not anything new in there unless you count how goddamn bleak it is.

The Devil Judge, Ep.1 Meta
(On the re-imagined justice process, imageries, parallels in South Korea and our world today)
As with all dystopian fiction, it is not exactly a far-fetched imagining of our world. Instead, it is a critique of our society which seeks to amplify the inequalities and suffering of society through some exaggeration.
The Devil Judge is that: it "re-imagines" South Korea today with a sprinkle of cyberpunk aesthetics (a little too much bluish green tint) and dystopian imagery (of homeless people, a very dirty subway and dingy backalleys on a rainy night).
I kept thinking it was a dystopian "future" but was wondering why they were using only Samsung Note 20 instead of some Samsung futuristic prototype phone. So, those phones do keep audiences grounded in the reality it is portraying -- this is the alternative South Korea of today.
We are barely halfway into the first episode and we've got this extremely charismatic, anti-hero male lead strutting red carpets and making verbose declarations like "I am the power. By the judicial authority delegated to me by the people of Korea, I will run this court. And it is the people who hold this power." (Not verbatim but that's the gist).
Then, meet associate judge Kim Ga-On who seems to be against how the system is running. He seems to be the outlier who rose to his ranks from the bottom class of society (which his colleague Oh Jin-joo says, he looks like he's from the shanty town of Seoul). We start off, barely into the drama at this point, with a dramatic scene of a kindergarten bus ramming down barricades and charging towards the Court building. A group of kindergarten children crossing the road there (I've just no clue what businses kids would have near the court building tbh). A little girl tripping as they were rushed across the road, Ga-On jumping to the rescue, and unable to pick her up in time, shields her with his own body. Kang Yo Han is just there, taking a heavy gun from the guard and unhesitantly opened fire at the bus driver who was flooring the pedal. He misses the driver's head and hits the headrest before firing again. The bus swerves and flips. The driver loses consciousness and Ga On (again!) jumps to the rescue. So, here the tone is set. We've got this "devil judge" who seems to be the ultimate modern day anti-hero who's given immense amount of power.
Much more interesting is that in this dystopian South Korea, we've got what seems like a publicly elected judiciary (or Kang Yo Han is perhaps the first?) and that has always been something that has been discussed in legal academic. Not the idea of electing the judiciary but that the argument of the judiciary not being publicly elected can be seen as slightly out of tune with democracy. (In legal academic, however, this is theoretically seen as being balanced by the separation of powers; ie. the executive branch (=government) and elected members of Parliament/Congress are supposed to be fully separated from the judiciary and should therefore never interfere with the judiciary. But, of course, these are all theoretical stuff. They look good on paper and when discussed in legal essays but in reality, it can often be different (if not, the exact opposite). This series takes things to yet another level by imagining the inception of a publicly televised and publicly voted trial.
This goes against the nature of trials in general because in our world today, the judiciary (wherever it may be) typically have mechanisms (ie. laws and codes) to prevent manipulation by media. The principle of fair trial requires that no external influence affects the process of adjudication (ie. the judgement by judges). There also tends to be avoidance of trial by public opinion because the way the law is interpreted and applied can be rather technical and different from what people may say or think about a certain trials, the decision delivered and also sentencing. Trial by jury is the nearest it gets but that too can be a fairly technical process which do also include considerations like avoiding a two-day trial to prevent influence by the media or other agents on a jury member's decision. (A recent drama mentioning this is Law School). The thing about this idea of trial by the public is that standards of morality can be very subjective and varies from person to person. Judgement by judges are not entirely free from the influence of morality, but the process is a litle more stable through the processes of interpretative practices, case precedents and legal theories. Previously in another Kdrama, Miss Hammurabi (2018), Judge Lim Ba-reun became slightly frustrated by his friend's comment that having a jury trial is like "true democracy" because the "people gets to decide" and he even thinks the judiciary should be elected too. Lim Ba-reun sarcastically said he must have loved every elected politican since they were elected by the public. He tells him grimly that no jury has ever found a policeman who had beaten up a Black man to be guilty. He also pointed out that Nazi, the Holocaust and Hitler were all supported by the public.
In this series, the premise allows all of these imaginings to be realised and played out. It is peak criticism, I think, when they portray the scenes of the TV producer being excited about the real-time ratings and viewer ratings. And also the scene of the broadcasting channel's chairman dancing in joy when he received realtime report of the ratings (vowing to treat his equally wealthy friends to a meal). Even when his other friend seemed appalled by the decision delivered by Judge Kang, the Chairman could not hide his joy in the skyrocketing viewership ratings. This really reminded me of the entire Produce 101 franchise which also heralded the shows for putting the decision in "The Nation's Producers" (ie. voters) and emphasised how it is the Nation Producers who put together ("produce") the National Kpop group that is bound for success and set to receive national love. All of this illusion collapsed (and the Korean franchise died along with it) when the court finds its producers guilty of voting manipulation. The Devil Judge seemed to have a similarly dramatic flair in its emphasis of TV production gimmicks, camera angles, cuts of a person's reaction, etc. The President of South Korea (who has a very light voice, a penchant for orotund speeches and a lack of concern for national policies) and all these top 1% of people tuned in were on the edge of their seats watching Judge Kang orchestrate this theatre of public trial. Kim Ga-On watched him closely and was sure that Judge Kang had something up his sleeves and was definitely up to no good, yet he couldn't tell. When he finally delivers a verdict (that yes, this was a case of professional negligence and not negligent homicide), Ga-On was crestfallen and frustrated because it carries a mere 5 year imprisonment maximum. But Kang turns the table and brings up the newly passed legislation which allows accumulative sentence which then resulted in 235 years of imprisonment.
This sounded very much like how some Korean netizens had previously wondered (online) why Korea couldn't have a sentencing system like the US where the years of imprisonment can go up to 100 years or 500 years. Again, this was like realising an alternative South Korea that many have perhaps tried imagining. Episode 1 ends with Judge Kang stepping down from his high seat when a victim's family member bowed deeply with her hands clasped, as though in prayer, and even kneeled to him. This corresponded well and tied perfectly into the religious/godlike imagery represented in the justice's robes which is reminiscent of the pope's robes and resembles a priest's robe, and the app they named DIKE or Diety of Justice (正義의 神). When Judge Kang hugs the old woman with a compassionate smile, teary eyed and full of empathy, he ends up yawning barely a minute into consoling the weeping woman. Ga-On witnesses this and realises, all of this must have been a gimmick after all. He had his hopes up when Judge Kang serves the sentence of 235 years. The episode ends.
I think this series is set to be a great one. (Just as Law School was amazing too!) It has tons of stuff to unpack, lots that goes into the cinematography and camerawork. While characters do seem a little more like caricatures rather than realistic people that are properly fleshed out in the narrative, there is still promise to push beyond these caricatures. I think there is also a lot in the imagery of dystopia and the constant bombardment of messages from the government (which is often the mainstay of dystopian fiction) which emphasises a certain narrative which they want the people to believe. For example, Kim Ga-On is travelling up the escalator when there were ads of the DIKE app, ads on electronic billboards on the justice system, paper posters plastered in the dark backalley where a high school girl is being dragged away by two men saying "The government will now create a safe South Korea". That last one is perhaps the most glaring one to me because when I was in Korea, it was repeated to me by different Korean individuals: "Your things are safe. No Korean will steal it. (Not sure about foreigners though!) You are safe. Crimes don't happen. I checked and there are no sexual offenders living in this neighbourhood." But... spycams can be anywhere. Men secretly follow women to their homes and try to break into them. Sexual harassment can happen anywhere. Robbery and theft can happen.
Personally, my paranoia and anxiety won't ever let me believe such words. No narrative, self-made or otherwise, can convince me enough to think that I am in a safe place. I would always have a nagging thought at the back of my mind telling me danger can be lurking just about anywhere. I think Koreans today do have high levels of confidence in their country. Most people do think it is safe to be walking around in the dead of night without any worry. (Again, I do not quite share the sentiment.) But this is a kind of self-made narrative because I also know my countrymen who travel to other countries like the UK and say "I feel absolutely safe walking the streets in the dead of night while I won't feel the same in my own country" when those are simply ideas they've planted into themselves through the mindset that [This country is better than my country and therefore safer.] There is absolutely no correlation between a "better" country and crime rates (or potential of becoming a victim of crime). Not to mention, being an Asian in a Western country sets you up as a likelier victim of hate crime...
So, I was saying.... This narrative of "safe Korea" is already existing in South Korea today. The need for mass surveillance or a spycam detecting task force in public toilets don't add up with a "safe country" image but the sentiment planted into the people seems to be strong despite all of this. However, Koreans do call South Korea "Hell Joseon". Youth unemployment can be a concern is a country like South Korea and a graying population, increasinly empty gray towns like the one mentioned in the series are all concerns which are ever-present in the public conscious. The mention of plauge and unemployment too must be a major concern now. In a rather similar vein, this narrative of DIKE or trial by the public through app voting creates a sentiment that people can take into their own hands and deliver justice. But what about the people at the margins of society who are homeless and do not own smartphones? What is this concept of democracy that places power in the hands of people? Is it a mere illusion or is power really in the hands of people?
..................................................................................................
(A side note on how the indicted chairman of the company responsible for mass poisoning of an entire town had brushed off concerns about a failing filtration system and the move of industrial plants to Southeast Asia. As a Southeast Asian, it is also something on my mind how South Korea has moved out of China and moved most of its plants to Southeast Asia for cheap labour. But what about the pollution here, the appallingly low wages they pay Southeast Asians (both white and blue collars!) in comparison to the few Korean expat managerial staff or engineers they station out here? I remember how I was at the hospital at 2 am and a small group of blue collar workers in their work uniform came in with their injured colleague; this can only mean they were at work past midnight due to some accident and we are still in the midst of the pandemic. What kinds of welfare and benefits are these blue collars provided with?)

FOP: Fairy Fallout Pt.4
Previous (X)
Act IV
After Chloe’s new plan was set, the previous scene transitioned with a fade to a timecard that simply read “Friday, after school…” before the fourth scene began with another shot outside of the elementary school, and the bell rang to signal the end of the day before kids came flooding out of the double doors.  While the children were running and cheering, eager to enjoy their weekend, Chloe was shown among the crowd walking with a rather concerned expression on her face; Cosmo and Wanda’s faces were visible on their pink and green object disguises, but they appeared more puzzled than anything.  Once all the kids in the background were gone, the shot followed Chloe as she walked across the courtyard to get to her bus, and the echoing voice of her conscience could be heard as she questioned why Timmy hadn’t shown up to class that day.  She knew that Timmy was acting strangely during the week, but all he seemed to do was ignore her, and distance himself from everyone.  Once Chloe was on the bus and took a seat, her eyes quickly shifted over to glance at Chester, A.J., and Elmer as they talked amongst each other.
Their voices were muted as Chloe’s thoughts recalled how they asked her what the deal was with Timmy, and how she wasn’t able to tell them, so she was forced to feign ignorance on the matter.  And when she asked the same to them, all of Timmy’s friends just explained to her that they left him after he broke down in front of them one day after school; they went to keep him company, but he grew unreasonably kurt, and gave them the cold shoulder since then.  Chloe frowned sadly, knowing that Timmy likely didn’t mean to push everyone away.  It just wasn’t like him to go out of his way to make everyone stay away from him, and keep himself isolated for so long.  Eventually, Chloe’s thoughts were cut off by the bus driver, who barked at Chloe that the bus arrived at her stop.
Instinctively, she gave a quick apology to the bus driver before exiting the bus in a hurry, thanking the driver who simply rolled his eyes and grumbled as he pulled the lever to close the doors behind her.  Once the bus drove off, Chloe turned to face the Turner house, and puffed up her chest as she took a deep breath.  It was time.  If Timmy was absent from school, then she doubted he’d be anywhere else except his own room; the last place he could ever feel a sense of safety from the outside world.  Bracing herself for the worst, Chloe paced up the walkway that led up to the front door, and hesitantly gave it a few knocks before waiting patiently for someone to answer.
It wasn’t long until the front door opened to reveal Timmy’s dad, who cheerfully greeted Chloe with his usual toothy smile.  At first, Chloe seemed taken off guard from seeing Timmy’s dad instead of Timmy himself, but maintained her composure.  With her usual respectful tone, Chloe explained to Timmy’s dad that she needed to speak privately with Timmy, and asked if he was available.  This suddenly wiped the chipper smile off of the man’s face, and Timmy’s dad scratched his head before telling Chloe that he hasn’t seen Timmy all day; he swore that he thought Timmy was at school that day, and was absolutely shocked when Chloe revealed that he didn’t even show up to class.  Timmy’s dad became visibly distraught by the news of his own son suddenly disappearing, rushing back into the house without shutting the front door to question his wife on the possible whereabouts of their child.
Instead of waiting in the doorway, Chloe took the opportunity to rush into the house after Timmy’s dad, and entered the kitchen where the married couple were frantically trying to figure out what happened.
“You’re his parents, didn’t he say anything to you guys?” Chloe asked, practically begging for answers as she began to slightly panic.  “He’s been acting so upset lately, haven’t either of you noticed?!” She exclaimed in disbelief, no longer fully in control of her emotions at this point.
The final straw was when both of Timmy’s parents exchanged puzzled glances, and their expressions turned blank as they tried to remember anything strange, but they could only recall the night when they came home to Timmy bawling uncontrollably.  Aside from that brief mention, neither of them seemed to have any idea that their son was in an inescapable rut, and could only answer Chloe’s question by claiming that they were out of the house during the times Timmy came home from school during that week.  They also admitted that neither would really try to talk to him once they came home because their son would always be curled up in his bed by the time they got around to checking up on him.  This display of obliviousness was enough to aggravate Chloe, and nearly scold Timmy’s parents for being so negligent, but she held her tongue long enough to storm out of the house without another word.  The moment she closed the front door behind her, Chloe took another deep breath and held it before opening up the flap of Wanda’s messenger bag disguise, and let out a muffled scream of anger into the bag as Wanda visibly winced at the noise.
It was a brief moment, but Chloe was quick to apologize to Wanda after she calmed down again before breaking into a sprint down the walkway, and down the street.  For a split second, Cosmo and Wanda generated arms out of their object disguises just to wave their wands and transform into a couple of dogs so they could run alongside their godchild, and were quick to ask what Chloe had in mind next.
“We need to find Timmy, and fast.” She simply answered without slowing her pace as she took out her phone to begin dialing a few numbers.
But before she made the call, Chloe instructed her fairy godparents to split up, and search anywhere they knew Timmy frequently hid to escape his problems aside from his own room.  Without protest, both fairies dutifully went on their way, and teleported out of the scene to let Chloe get to work on her own.  The sequence transitioned into a montage of Chloe contacting as many of Timmy’s friends and allies as she could, pleading for them to join her in her search to find her neighbor before switching into different shots of said search party members scouring all over Dimmsdale.  Some groups even went so far as to look for Timmy in rather absurd places, such as the town sewers, only to get scared away by a giant alligator popping out of the water to roar ferociously at them.  Chester and his group went searching through dumpsters, but some of the group members were attacked and chased off by angry raccoons that were inside the piles of garbage.  Finally, the last group was shown trudging through the thick woods before screaming as they fell off the edge of a shallow cliff.
After the compilation of the search parties failing to find any sign of Timmy, the scene switched over to a shot of Chloe as she stared out of her bedroom window up at the night sky above.  The tone of the scene changed from suspenseful yet slightly comedic, leading to a more hopeless and glum setting.  From inside her room, Chloe could see the flashing red and blue glow of the cop cars parked outside of Timmy’s house.  The cops had been there hours after she returned home at dusk, and from what she could tell, they would be there late into the night.  Through Chloe’s point of view, the shot switched from the police cars to the kitchen window where a glimpse of Timmy’s parents was shown; the couple were in absolute hysterics that Timmy hadn’t returned home yet, holding each other as they wept.
It lingered there for a moment to show the cops doing their best to console the parents, but to no avail.  The focus switched back to third-person as Chloe leaned against her window sill, resting her elbows on it while letting out a heavy sigh.  Wanda’s hand rested on Chloe’s shoulder, prompting her to turn away from the window and look up at the pink haired fairy with a disheartened expression.
“Do you think we’ll ever find him?” Chloe softly asked, her generally cheerful pitch reduced to an exhausted, hopeless drawl.
Wanda’s expression remained somber as she patted Chloe’s shoulder, genuinely unsure of what would become of Timmy Turner now that things were looking much bleaker than before.  After a moment of hesitant silence, however, Wanda managed to find her voice as the scene came to a close with a shot of the silhouettes of Cosmo, Wanda, and Chloe in her bedroom window together.
“We can only hope for the best.” Wanda could be heard saying as the shot slowly panned up towards the moon, and the stars in the dark blue skies before doing a final fade to black.
END.

Ignore this if you want, imma just vent real quick because I am FRUSTRATED. From least to most frustrating:
Because it is winter and I live in Canada it is dry asf which is making my eczema get really bad, mostly on my hands and insides of knees and elbows. It Hurts and keeps bleeding and I cannot stand putting the cream on because it’s sticky and it is hell. I do it right before I fall asleep but even having it on for those few minutes is absolute hell because then I stick to the sheets and get fuzz on me and it’s gross and I hate it with a passion.
I still have to get my MRI results from a month ago but I don’t know how to call the hospital to make the appointment with the doctor because I have to file an extension and I don’t know how and I don’t know who to call and it makes me want to scream. Also I have to get my doctor to refer me to someone so I can get diagnoses for a few more things that I know are happening. I’m kind of frustrated that my younger sister got diagnosed with all her mental illnesses before me. I know it’s shitty of me. I’m glad she has her diagnosis and everything, I’m just frustrated that I don’t yet.
I’m doing a good job at work though apparently. My manager told me she knows how hard I work and she’s very thankful for it and she’s offering to give me more hours. Which is kind of frustrating because like yay more hours, yay maybe I won’t be so broke, but also I work evenings so getting more hours means that I’ll probably start working until 1-3 am, but I have to wake up early to take care of my nephew, and nowhere is open that late except for fast food places, so I’m going to end up eating even more shittily than I am because I don’t want to get home at 3 am and make food. My grandparents bedroom is right next to the kitchen, I don’t want to wake them up.
Still related to work, it was very busy at work last night because it was a Friday and it was cold (I deliver pizzas). The owners of our store were in last night to help because we’re understaffed (in the middle of hiring more people). I’m going to call one of them S. He’s lowkey a dick. Me and the 9 other drivers last night were in the back hall folding pizza boxes (what we’re supposed to be doing when we aren’t on a run or otherwise busy doing something). It was starting to slow down, so one of my coworkers bought some food and was eating it in the back hall, and the rest of everyone was kind of distracted and talking (except for me, I was folding boxes because nobody was including me in conversation). It shouldn’t have been a big deal, we’re allowed to eat and talk during work as long as what needs to be done is getting done, which it was, I was doing it. And even if I wasn’t doing it, it should have been fine, my coworker who was eating dinner had opened and been there for 6 hours already. S decided that he would come yell at everyone for not doing enough. He started yelling at my coworker eating dinner and basically saying “if I have to be working, so do you” (S had like just started). After yelling at everyone else for not doing anything, he decided to try to get me on his side because I was working, by saying “[he] shouldn’t have to be doing all the work, that isn’t fair, is it?” I just kind of shrugged, I didn’t know what tf to say to that. I was honestly perfectly content folding pizza boxes on my own. There’s not that much space (let alone space for 10 people to be doing it).
And last but not least, the most stressful thing rn is that CAS (children’s aid) kind of placed my one and a half year old nephew with my family because his mom is negligent. My family being: my 70 year old grandparents who are both disabled/chronically ill, my dad who works full time, my mentally ill 16 year old sister, and me, a disabled, mentally and chronically ill 18 year old who works almost full time. During the day my sister is at school and my dad is at work, so it’s just my grandparents and I watching my nephew (mostly my grandma and I if she’s feeling well that day, if not, then just me). I love my nephew to death, he’s the cutest kid ever, but he has SO MUCH energy. I wake up at 7 to drive my dad to work, and I sometimes drive my sister to school if she misses her bus. I come home, fall asleep for another hour until my nephew wakes up. I spend the better part of the day taking care of him and keeping the house tidy. I usually start work at 5, and frequently don’t get home until midnight. I usually fall asleep before 2, and it starts again. My nephew’s supposed to be back with his grandma and mom on the weekends (they live together). Today, his grandma decided she wants to go out with her friends, so we’re babysitting the kid again. She sees him two days a week. But no, she can’t bring him with her to her friend’s house for like two hours, she has to bring him here so I can spend one of my two free days watching him and running errands. I’m frustrated and tired and I need a fucking hug lol.
Sorry for the rant

Stuff & Things
It’s been about 6 months since I’ve had a computer, about a year since I’ve had a good computer, and typing on my phone in any significant amount is obnoxious so... a lot has happened that’s not made it’s way here. (Read more below the cut.)
First, we’ve finally moved with the help of a dear friend! Into a townhouse closer to The City. Two stories rather than one has been an adjustment, but The Kid loves it. We’ve an impossible amount of Things and Stuff we’ll have to slowly widdle down to a more reasonable amount because this place is smaller than the last (2 bd, 1.5 bath vs 3 bd, 2 bath w/ garage), and that’s what occupies most of my time atm. Unpacking + sorting + balancing health. We’ve already donated so, so much to charity. There’s still a lot to go. The neighborhood is nice, there’s a park a block away near a creek and lots of green space and wildlife (there is a toad? who lives beneath our kitchen window?!). There’s also a library right beside the park! Best is that The Kid gets to stay in his old school (finding a place in his district was paramount), where he’s thriving academically, and even gets to keep the same morning bus driver which made the transition a little easier. Though half-days for teacher conferences and then a week off for Thanksgiving immediately after we moved did not. There are some drawbacks, a few things we didn’t realize before signing the lease that are kinda meh (like the living room layout has no place for a tv???), and it’s really really very cold (large single pane windows throughout), but altogether I’m glad to have relocated in general. We’ll improvise, and throw some curtains at it. And now for something completely different a health update! So after suffering for years with neck/shoulder/migraine pain and being blown off by my old doctor after 6 sessions of physical therapy didn’t work as if there was literally no choices beyond PT, and given a diagnosis of peripheral neuropathy with 0 treatment options by my old-old doctor, my current doctor ordered new x-rays (because so terrible was my old doctor, they wouldn’t even forward over my medical records when asked by my new physician’s office) which revealed A Problem. My old doctor had also ordered x-rays but reacted as if they were fine? Essentially prescribed physical therapy and spoke no more of it. But it’s not even a small problem. It’s a pretty big one? One that should have been caught sooner and actually treated? Like. A not insignificant part of my present day constant pain might have been avoided? At least lessened? Backstory time. My old-old doctor was also bad (not an uncommon experience for women, sadly) and when I first presented with neurological symptoms of “my hands and feet are always cold, even when they are not cold to the touch, they feel like they are always in ice water” in like 1999 I was basically told I was probably just cold. It physically hurt all of the time but once a doctor said it was nothing, everyone just insisted it must actually be nothing. Like, I wasn’t an adult yet, and my distress about the problem was definitely downplayed because of my age. Young people are too young to have medical problems! Duh. Fast forward a decade and by then my hands and feet mostly felt numb, but sometimes painfully cold because it felt like frostbite if I felt anything at all. About once a year I’d get this intense pain in my neck/shoulders but by the time I could actually get in to my doctor’s office it was “better.” My doctor referred me for the nerve conduction test (EMG) after my insistence (this is a painful test in which needles and inserted into your skin and electricity is passed through them and measured, essentially). When I showed up for the EMG at the hospital, I was asked why someone my age needed an EMG. I said that my hands and feet felt cold and/or numb regardless of temperature. They had me stand in a bucket of hot hot hot water for 10 minutes to “warm up” my feet. After 10 minutes, they were still cold to the touch. “Well, it’s winter, so...” I argued it was like that regardless of season but it wasn’t taken seriously. Everyone thought the EMG results would come back normal. But they didn’t. I was diagnosed with peripheral neuropathy in my hands AND my feet after the EMG showed moderate to significant delays between the signals sent from my hands/feet to my brain and back. They wanted a follow-up but so casual about the problem were they, that it wasn’t going to be scheduled for a year out. I had shit to do, man. A life to live. Then I moved 3000 miles away and got an even worse doctor through my shifty insurance, which I didn’t realize at first because they at least prescribed me something for the previous diagnosis. Even after the diagnosis my old-old doctor offered no solutions. The nerve damage was done, oh well I guess. But the offered treatment was only helping one facet of a multifaceted problem and I found myself being blown-off again. “It sometimes feels like my bones are grinding.” No one listens. So what is happening? Well. Sometimes my bones are grinding! Specifically my spine. I could tell bone pain from muscle pain. Wild fucking concept, I know. But wait, there’s more! Basically the entirety of my cervical vertebrae are fucked, fun! And the fuckening has been progressive and ongoing, all this time. c6-c7 is particularly Fucked with a capital F. We’re talking bone spurs and herniated discs and pinched nerves, we’re talking degenerative, untreated spinal arthritis. We’re talking neurosurgeons and spinal surgery. Which yeah, is gd whacky in a person my age even now, but probably began nearly 2 decades ago, when I first said, “I don’t feel so well. It’s almost as if my bones are grinding against each other and causing nerve damage or something but idk I just live in here.” If they do nothing, it’ll just continue getting worse and I’ll probably experience paralysis. So, beginning of January I go in for a Cervical Medial Branch Block. Then we go from there. My medical team doesn’t want to be spooky but treating this conservatively isn’t really an option anymore, since every doctor up until now has been wildly negligent in my care. It should have been treated conservatively in 1999. We’re way beyond that now. Also, as you’ve undoubtedly seen, heart monitoring! I had an electro that revealed right-axis deviation (not uncommon in people with sleep apnea, but not healthy) but otherwise normal readings, followed by an echo which revealed 3 of 4 valves are leaky but not dangerously so and there’s no malformations as far as they could see (apparently I have obfuscation tits) so they wanted a 48 hours nonstop electro performed with a mobile monitoring system. Results of that will be in in 7-14 days. I suspect it’ll be mostly an uneventful read but they’ll find “something” when I sleep (common in sleep apnea) and something that comes at random during waking hours (sometimes my heart just gets excited like a dog who heard the word “walk” even though no leash is present). In any case, I am confident it’s not life threatening, especially if treated you know, in a timely, reasonable manner.

Let he who has never stolen a public transit bus cast the first stone, said the Bible. It didn’t? Well, then you must not have skipped half the lectures at seminary school in order to do donuts in the parking lot like I did.
Now, don’t get me wrong - I’m a huge fan of organized labour, and under no way should some profit-driven motherfucker take this bus away from its hardworking legitimate driver. “Profit-driven” is almost the last possible phrase people would use to describe me, though, and so when I’m running a little bit late and my driver just nipped out for a coffee break, why not take over and deliver everyone to their destinations ahead of time? They’ll love it. I debate this for about five seconds, during which I have already hooked up the bus’s rear tires in a glorious two-alarm burnout. You gotta get them warm, you know, for increased traction. Traction is safety, just ask anyone.
The big problem was, what do I do with the bus once I’ve arrived at the courthouse? All the people who are on the bus now still have to keep going. They depend on me, like flightless baby ducklings on their mother. To just hop out and abandon them would be negligent at best, but I’d be like two hours late for my appointment if I decided to complete my route. I decided to deputize the most clueful of my fellow passengers, a young woman who is shrieking at me for having “stolen” this bus. She’s got confidence, I tell myself as I leap from the bus at trotting speed, tuck into a roll, and leave her behind. Everything will be fine in her hands.
I know what you’re about to ask - did stealing that city bus count as “community service?” I’m here to tell you that it absolutely did not. Yes, of course I tried to pitch it as sort of a consulting gig - my effort showed how much more efficient the private sector could be, if only the private sector also ignored stop lights, pedestrian crossings and the entire back half of the bus. They didn’t go for it; clients, am I right?

Know how I mentioned that Amber Alert regarding a girl who had been taken from her home after both of her parents were murdered? She still hasn't been found and there continues to be too much death in Wisconsin.
A week or two ago a negligent driver passed a stopped school bus killing 3 elementary aged children.
This past weekend a man that was allegedly drunk driving swerved off the road into a ditch in which a Troop of Girl Scouts was picking up litter. 3 children are dead and one adult, with several severely hurt.
Stop it Wisconsin. We're really over the tragedies. Our hearts can't take much more than this.

Do you need assistance after a bus crash? Call Sico Hoelscher Harris LLP today at (877) 631-9965 to receive a free initial consultation. Our record of successful cases also helps to tell the story of our acumen: we have achieved some of the largest settlements and awards in Texas history. Our team of personal injury attorneys have extensive experience standing up for the rights of injured individuals and their families. If you or a loved one is injured in a major auto accident, including a school bus crash, trust your case to the skilled attorneys at Sico Hoelscher Harris LLP. Wrongful death claims can be extraordinarily expensive, as well as the claims for the other injured children for their injuries, bereavement, recovery, and more. This could be a devastating lawsuit against Durham.
#Chattanooga bus driver arrested driver#
While it’s true that the driver was the one who injured all of the children, Durham was the one who employed him, vouched for his ability to drive, and therefore assumes responsibility for his actions. Their safety record has a history of being negligent, sometimes grossly, and their driver-selection process, despite claims of being stringent, has shown numerous flaws. CNN)A school bus packed with children slammed into a tree, flipped over and split apart.Shell-shocked students cried as rescuers worked for hours to pull the. However, it appears likely that the families of these impacted students will be able to hold the operator liable. It is a little difficult to tell if Durham School Services will be held liable for this accident because it is still so early in the investigation and details are currently still being released.
#Chattanooga bus driver arrested drivers#
There have been eight recorded driver violation incidents since December of 2014 seven of them involved drivers who did not have a school bus operating license. This is not the first instance of Durham using gross negligence in their driver selection process. Durham chose to put him back on the road.
#Chattanooga bus driver arrested license#
In fact, the FMCSA even says that as much as 93% of motor carriers in the same safety group have a better on-road performance.Īlso not helping the company: it was discovered the driver of the bus, who authorities say was traveling well over the posted speed limit, had his license suspended as recently as 2014 after another crash. In just the last 24 months, records show that Durham busses have been involved in 346 accidents, 142 of which were injury crashes, including three with fatalities. While the Federal Motor Carrier Safety Administration admits they have a “satisfactory” safety rating, their records are far from glamorous. The driver of the bus has been arrested and charged with vehicular manslaughter, which is bringing up a lot of questions as to the safety record of Durham. The crash, which occurred Monday afternoon and killed at least six children aged between Kindergarten and 5 th grade, is one of now four fatal crashes that Durham School Service buses have sustained in the last two years. A deadly bush crash in Chattanooga, Tennessee has a major nationwide school bus operator in hot water again.
