After two years of unoriginal insults, unsolicited opinions, unwarranted geography quizzes, and a lifetime of lukewarm beverages, the only way this nineteen-year-old American citizen girlie will be happy about selective service is if we’re fighting some shit-talking Europeans!

And I’m not talking about the Russians, I couldn’t care less about them, they’ve got bigger fish to fry, but Germany?! France?! ENGLAND?! And, hell, throw in Australia in there, too.

I live in a neighborhood with a large middle eastern/west Asian population, some of which are full citizens and many of which are not— they’re here on student and work visas, while the rest of their family stays in their home country. And of course, with election season, there has been a lot of talk about what the future is going to look like.

So, if anyone is still on the fence about not voting, please keep this anecdote in mind.

My neighbor invited her mother over from Iran last month, because if Trump wins, she does not know the next time they’ll see each other. Another neighbor has been trying to get her husband’s papers in order so he can get his medical license in America, but doesn’t know if she’ll be able to complete that before the new term. This says nothing about if their own visas will be at risk of being revoked a year or two down the line if Trump wins, and in that case, what happens to the families on my block with parents on visas and children that are citizens? Either way, neither of these women can vote for themselves, because they are not citizens.

This isn’t to say that this is the worst thing that will happen under Trump. You’ve probably seen plenty of arguments about forced birth and death rates of mothers of color, about Trump and Netanyahu’s alliance, all of those statistics. This is just to say, the consequences of Trump winning this election are not happening to an abstract population. They would happen to my neighbors, your neighbors, your communities.

I’m not going to do the song and dance about “the lesser of two evils ”, because if you’re voting age, you’re an adult and you don’t need someone holding your hand— if Trump wins, communities like mine, and thousands of others, will suffer over something that was entirely preventable. So if all of the statistics and logical arguments have not swayed you, have this: vote for these two women who deserve to see their families. Please.

Kiran Devabhaktuni was 26 years old, a medical student at Gotham U, still a little drunk, and very, very, extremely dead. He was sitting on the grass-- perfectly trim, perfectly green-- staring at his car smashed into shrubbery and a low wall, the passenger side tyre flat and bumper smashed in. They were as ruined as his future. 

He could see it now, drenched with petrol and on fire. He’d be suspended, his student visa would be revoked, he’d go back to England and have to live with…

Kiran swallowed, hard, to keep the bile down. He’d already thrown up once, in the car, on the passenger seat, before he’d scrambled out the driver’s window and landed on the gravel beside the road. The bonnet had been smoking, black plumes hissing out, and he’d stumbled back while two little boys emerged atop the shubbery screeching in delight like some strange, incoherent avenging angels. 

It had taken his still-not-sober brain a bit too long to process that they weren’t bizarre, floating bush creatures, but were standing on the stone wall the bush had swallowed some years ago, watching the car with boyish, pyromanic glee. 

A harsh bark of an order behind them made Kiran flinch, and both of them jump backward. Kiran tried standing and only succeeded in falling a few feet further away, into the grass, where he still sat. The gate several meters down the road swung open, and a man strode out with a child on his hip, and two more boys jumping along at his heels like eager puppies. 

“Are you alright?” he called, sounding more concerned than angry. Kiran blinked and stared at the car, and then at the man. He looked familiar.

“You’re bleeding,” one boy announced, leaning close to his face. Kiran startled and winced, cradling his arm automatically when pain shot up into his shoulder. 

“I’m...drunk,” he said, honestly, because his life was already over and he’d learned early on it was best to get the worst part over soonest. His da’s lecturing was still ringing in his head from the phone call earlier; the alcohol hadn’t drowned it out, after all. He’d ruined his life and his brain hadn’t even gotten properly numb yet. 

“Dick, come here,” the man said, gesturing for the taller of the two boys to back away from the car. The smoke died with a final fizzle and the boy looked plainly disappointed. He didn’t go back to the man, but instead yelled, “I’ll get Alfred!” and climbed over the wall rather than go back to the gate.

The boy closer to Kiran prodded experimentally at Kiran’s forehead and Kiran shifted away.

“The car might blow up,” he said. “Tell me where it hurts. I’m five.”

“Are not!” a yell came from over the wall. “You’re four and you know it!”

“Almost!” the boy leaned his head back to howl into the air. He looked back at the man. “I don’t think he talks, Daddy.” 

“Jason, give him some space. He’s probably in shock. Did you hit your head?” 

“I was going to be a sodding neurosurgeon,” Kiran said faintly, as things began to truly sink in. “I...smashed up your gate.” He put his forehead on his arm, propped on his knee, to let a wave of dizziness-- concussion and failure alike-- wash over him. 

“We’ll call an ambulance. How much were you drinking? Can I look at your eyes?” 

“Vodka. Not a full bottle,” Kiran said, automatically. A screaming lecture on telling the truth was mixing with a rotation lecture on accurate charting in the ER in his head, making him feel like his brain was full of tangled and knotted strings. “Please don’t call an ambulance. I’ll walk.”

“You’ll walk,” the man echoed. “Hm. Let me see your eyes.”

Kiran tried to open them, and winced and squinted. The sun was brighter than he remembered it being a moment ago, but they adjusted slowly. 

“You broke my wall,” the man said, when Kiran was looking at him, and the man was studying Kiran’s eyes. He’d always thought it was funny, how you could study someone’s eyes and still not be looking at them, the way they might be looking at you. It made him feel now a bit like an insect, squirming under a magnifying glass and tweezers. The man’s voice had gotten a little harder, and then it went to positive ice. “You could have hit one of my children.” 

“I know,” Kiran tried to choke out. His throat was closing up. “I’m sorry. I’m really...I’m...I’m really bloody sorry.” 

He had to wrench his chin down, because his eyes were filling with tears that weren’t from the too-familiar pain in his head, and he thought he’d crossed enough lines today without adding crying in front of a stranger to the list. 

“Do you drink and drive often?” the man asked, and Kiran could feel him moving back, see his feet moving around the car as he studied it.

“No,” Kiran managed. “Just the once, so far. Started off with a sodding bang, innit?” 

There was a dry, humorless chuckle in response; a quiet aside to one of the boys. 

Kiran wanted to cry. He wanted to lie down in the grass and weep until his throat stopped hurting, until the sky was dark. The worst part was that out of all the things he struggled to understand how his father expected him to control, this one was solidly and clearly his fault. If only he hadn’t answered the phone today, if only he hadn’t decided to go for a drive, if only he hadn’t pried the top off a bottle of vodka and told himself ‘just one sip, then I’ll go home and finish it.’ 

His chest was a blackhole, sucking in his future and the what-ifs and the narrow misses until it was a weight so heavy he nearly couldn’t breathe. His breath hitched and he felt the oddest sensation on his cheek.

Then again. It was a little pat, over and over. A tiny, chubby hand. 

He drew in a slow breath and looked up. Serious baby eyes looked at him, wide with concern, as the toddling baby patted his cheek in an attempt at consoling. 

“Tim,” the man said, “don’t bother him. He’s not feeling very well.” 

The man sounded kind, and Kiran suddenly understood why. It was because the baby was there. He was just saving his real anger for when the kids were inside, and the police showed up, and Kiran didn’t think his roommate would appreciate a bail call so that was out. 

“Nuh,” the baby Tim said, shaking his head. He kept patting, little soft pats like Kiran was a frightened animal that needed soothing. Kiran was frozen. 

“Thanks, mate,” Kiran managed to say. 

The baby Tim sat in the grass and moved his hand to Kiran’s knee, watching his face carefully as he patted. “Better?” he asked, after another minute.

“Yeah,” Kiran said quietly. It was not entirely a lie.

The baby didn’t move from his spot, watching, and if Kiran had been any less miserable he might have found it creepy. Instead, it was just bizarrely reassuring. 

“If you think you can get up, we might as well go inside and sort this out,” the man said. “I’m Bruce Wayne.”

Kiran had smashed up a car on Bruce Wayne’s lawn.

He was going to sodding pass out. 

Somehow, he managed to stand, while the inside of his skull screamed from terror and pain. 

“Kiran Devabhaktuni,” he heard himself say. “I really am sorry. I don’t have to come in.”

He made the mistake of moving his arm, and he was drenched in white hot pain that muted even the ache in his head. His head that was still positively swimming from vodka, and when had he eaten last? How long ago had he answered the phone? 

The man’s arm was around him and he was crying, sod it all, he was crying and he had the distant, detached thought that maybe it was possible to have two worst days in the same lifetime. Later, would he look back at the day where he flushed his entire future down the drain and remember with a flush of shame that he’d also cried on Bruce Wayne? Or would that just fade into the general miasma of misery, then? 

“I think my arm is broken,” he mumbled, while swaying. 

“I think so, too. You went as gray as a ghost,” Bruce Wayne said. “Jay-lad, go tell Alfred to get a splint. I think he’s coming out with Dick now.”

Half an hour later, Kiran was sitting at a kitchen table with his arm splinted and iced. He had water, and a cup of black coffee he was forcing himself to drink despite hating the taste. Bruce and a man dressed as household staff had a quiet conversation that sounded very little like the sort of discussion oen had with staff. The baby, Tim, was kneeling on a chair near Kiran’s and every so often would pat his uninjured arm. He kept staring at Kiran’s face with a searching, anxious little look, until Kiran finally said, “Look, mate, I’ll be alright,” just to see if it would make the baby feel any better. Tim seemed satisfied by this, and the pinched worry faded but the occasional pats didn’t stop.

Kiran waited, his own tension still high and nauseating. 

Did it take the police so long to make it out here from Gotham? 

“Well,” Bruce Wayne said, coming back to the table a moment later. One of the boys-- Dick?-- was climbing on him like he was a jungle gym, and he stoically ignored it, and let it happen. Kiran found it downright bewildering. “Alfred is going to take you to the hospital to have that arm set, and your head looked at. We’ll have someone tow the car. We think, considering the circumstances, that it would be too much of a mess to report this or file charges. If Alfred stays with you until they admit you or discharge you, will you think about going to AA? He can get you a number.” 

Kiran blinked at him. And blinked again. He didn’t…”I don’t understand,” he said bluntly.

“It’s a second chance, Mr. Devabhaktuni.” 

“I don’t…”

Get second chances, he wanted to say.

He swallowed.

“I’ll take the number,” he said quietly, instead. He wanted to duck his head but he made himself look Bruce Wayne in the face when he said, “Thank you,” in the loudest whisper he could manage. “It’s just...it’s Kiran. Just Kiran.” 

“What happened today?” Bruce Wayne asked, pulling out a chair. 

“I got a phone call,” Kiran said, feeling he owed him that much at least. “I don’t get along with my da.” 

“Hm,” Bruce Wayne said. “Maybe don’t answer the phone, next time.” 

The boy who had been climbing settled on Bruce Wayne’s lap, kissed his cheek, and jumped off. “I’m sorry your car didn’t explode,” he said earnestly. “But it’s probably good that it didn’t.” 

“Mine,” Tim said, patting Kiran’s arm again. 

“No,” Bruce Wayne said, reaching across the table and moving Tim’s hand. The baby gave him a look of profound irritation and gently, intentionally, moved his hand back. “You don’t claim people,” Bruce Wayne said, despite this small rebellion.

“After nap?” 

“No, not even after a nap. We’re not bargaining, Tim.” 

“Oh. Please?”

Kiran was quiet through this, watching with a desperately silent and aching hunger he didn’t quite understand, until suddenly he did. This wasn’t how families sounded, not to him. A wave of irrational hatred sparked hot, followed almost immediately by an sour self-loathing. The little hand patted his shoulder again.

“No,” Bruce Wayne said. “Not even for please.” 

“Mine friend,” Tim said, emphasizing. 

“That’s alright,” Bruce conceded. “If Kiran doesn’t mind.”

“Not at all, mate,” Kiran said, feeling choked and a little lightheaded at the whiplash of the day. “That’s bloody fine with me.”

not only has the US decided to stop issuing work visas to those who do not already have them, but also, ICE is essentially proposing to force the deportation of any international student whose university classes are only online. that is, unless they transfer to another university whose classes are in person—so their choice, instead of being able to continue getting an education during a fucking pandemic, is to either risk COVID and death even more by being in close quarters with other students for 16 weeks, or to go back to their home country against their will (also potentially risking COVID and death because what the fuck are they going to do, teleport??)

and of course within all of this I have my own fucking problems, like my fiance being one of those people who will not be able to get a work visa for this country and him being unwilling to stay in SA (and also not keen on having me move there because that presumably means he’s more likely to stay, which he does NOT want to do), and like how I have no idea what happened to the NP who saw me at the doctor’s office last fall but her name isn’t on the list anymore and she hasn’t responded to the pharmacy’s fax about please write me another prescription so I have to try to get one CORRECTLY written by the psychiatrist I’m seeing who is only writing prescriptions for patients until July 15th and then he retires, so assuming I get a hold of anyone tomorrow, I anticipate it will be at least until Wednesday when I’ll be able to get my prescription for sleeping pills filled, and I am so fucking tired and worn out and emotionally drained and there is nothing I would like more than to be able to sleep like a fucking baby tonight but that doesn’t happen!! without these pills!! for reasons that are unknown despite a sleep study (except that I don’t have sleep apnea)

and of course as usual I still do not have a job and I’m very paranoid about this job I’m in the interview process for, because lord knows I am only accustomed to getting rejected from jobs that I think I am otherwise totally qualified for even when I get interviewed for them and I’m also paranoid that if I don’t sleep then every day will be like this where I have zero mental energy and I just EXHAUST myself by the time I get myself mentally prepared to look at data, and I know from past experience that this WILL be the case (with migraines!) until I get the quetiapine filled and I ONLY DON’T HAVE IT FILLED BECAUSE FOR SOME STUPID-ASS FUCKING REASON THE PSYCHIATRIST WROTE ME A SCRIP FOR PROPRANOLOL INSTEAD WHEN I EVEN FUCKING ASKED HIM TO WRITE ME ONE FOR QUETIAPINE and I just. am. so fucking tired. and I recognize that things are going to change. and it’s not as bad as it feels like it is. probably. but it’s very hard to see that right now.

Masterpost on the Hong Kong Extradition Amendment Law Bill

I’ve struggled for a while whether to make a separate and anonymous tumblr blog/email account just to post this, since there have already been arrests made on university students as well as police officers showing up at the house of an admin from a Telegram group that organizes the protest and searching the place. But I know it in my heart that I do no wrong in speaking up. If I do end up facing legal consequences for doing this, then it only further proves my point on how dangerous it has become to live in this once beloved city.

Hong Kong citizens are protesting against the government’s proposed Extradition Law Amendment Bill (“Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation (Amendment) Bill 2019” in full) that would allow people accused of offense to be handed over to Mainland China, Taiwan, and Macau upon request with only prima facie level evidence provided to the court. The bill has raised serious concerns and opposition for its possible violations against freedom of speech, judicial independence, and Hong Kong’s autonomy under One Country Two Systems, etc. With incidents such as the disappearance of the five staff members working in Causeway Bay bookstore, many fear that the passing of this bill will allow China to request extradition from ANYONE, INCLUDING THOSE WHO ARE NOT RESIDENTS who dare to speak in any form against the CCP and step foot in Hong Kong even only for transition.

Because of this proposed amendment, Hong Kong people have taken to the streets and other acts of protest to voice our disagreement. But our democracy and rights are being stripped away by a government that will not budge even with over 1 million people (one seventh of our population) marching to be heard or seeing students being tear gassed and shot by rubber bullets. The government is refusing to listen to its people, instead it is using unnecessary force on us through its police force and calling us rioters when all we did was gather together and protect ourselves.

As of right now (16th June, 03:00 GMT+8), there has already been one casualty in our fight to be heard. The government has only promised to pause the passing of the bill, meaning that at ANY TIME the Legislative Council can restart the reading process on the bill. Though we still feel suppressed and carry a heavy heart, we will not lose hope. If its citizens are not enough, we are wishing for louder international attention to give the government more pressure to COMPLETELY WITHDRAW the bill to safeguard Hong Kong’s democracy.

please take a moment to learn about what’s happening in Hong Kong since June til now.

We have been protesting every Sunday, and many saturdays and weekdays, on the streets since 9th June.

First and foremost, we are protesting against extradition bill. which will take away the wall that protect Hong Kong people (or any visitors in HK) against Chinese communism.

Hong Kong is a Special Administrative Region that runs a different legislative, judiciary and executive system from China, bc we were colonized by British before 1997. After handover, “one country two systems” is run in HK, as agreed by UK. we have basic law, that protects our freedom of speech, freedom of assembly and demonstration, freedom of press. We shd be going towards the direction of DEMOCRACY and true universal suffrage.

This bill will take away every advantageous difference of Hong Kong from China. our freedom and human rights. China can arrest us with any claim of a person in hk breaking china’s law (which we do not follow).

9th June: we march with 1million people. CE did not withdraw the bill nor address people’s demand.

11-12th June: we surround Legislative Council to stop them from passing the bill that day. Police abuse their force to attack/ evavuate peaceful protestors, and define that day as riot.

Police beat people who did not attack or use violence. Police used lots of tear gas (weapon to evacuate a mass) while not giving them space or route to get away. Police beat reporters, a serious suppress to freedom of press.

16th June: 2million people march on the street. asking for 5 things:

1. Complete withdrawal of the extradition bill

2. Resignation of Beijing-backed Chief Executive Carrie Lam

3. Release of arrested protesters

4. Investigation into alleged police brutality against protesters

5. Retraction of characterisation of protests as riots

1st July: (handover anniversary day) on top of 550thousand people doing peaceful protest, radical side of protestors break into legislative council as a form of step-up protest, after government refused to listen to 2million people’s protest to withdraw extradition bill. They expressed messages such as:

“There’s no rioters, only a tyrannical regime”

“It’s You (the government) who taught us that peaceful protest is useless”

and repeat the similar 5 demands and also for universal suffrage.

Since then, every Sunday, hundreds of thousands of hong kong people march on the streets. there are also people of particular identity protest, such as mothers of hong kong, and elderlies, to protest against violence against young ppl and students at the front line. there had been judiciary group/ lawyer group. there had been social workers group.

Police:

Police used evil and illegal tactics,

(such as surrounding protestors, not giving them route to leave, and then attack them with unreasonable force for “illegal assembly” after or before a legal march just ended.

such as, not showing their warrant card or police number to identify themselves as police, so any actions against their guidelines, any excessive violence, any law breaking acts can be done by the police without consequences.

such as beating even the reporters

such as aiming bean bag bullets at protestors’ head and eyes instead of limps)

and excessive violence, and unreasonable arrest,

1. to protect the govt who dun listen to the people and betray us to please Chinese Communism and try to wait for us to get tired and let the protest die down without addressing anything

2. to spread white fear so as to suppress hongkongers’ freedom of speech and assembly

3. to suppress freedom of press

We urge the government to set up independent investigation into police’s use of violence(not only the current complaint system that is only going to let police investigate the police themselves. we do not trust the police nor the government anymore)

Government/ Chief Executive’s response:

The Chief Executive (CE) ’s response so far has always been playing words, such as using “indefinitely suspending the bill”, and “the bill is dead”. while never using the formal and legal term and action to WITHDRAW the bill.

She apologized for causing social rift, but did not address protestors demands at all. only pushed police and social workers to the frontline.

the government do not address any police’s abuse of power. excessive force. illegal actions. but only post statements to seriously condemn protestors’ actions. Protestors would not be forced to step up their actions if CE has addressed our demands.

Four people had committed suicide for this cause already.

And many people felt helpless and depressed over these continuous and seemingly helpless fight while the government ignore any demand and push us towards Chinese communism. Our CE don’t give a fuck about four actual hongkongers’ lives. but got so butthurt when legislative council’s glass doors got broken, or when policeman got hurt (finger got biten off due to trying to poke a protestor’s eyeball out).

This is my recap just off my mind as of now. not particularly good at these kind of political awareness post as some other hongkongers. but just to name a few dreadful, futureless, unjust things against human rights that is happening in hong kong right now.

not sure when the govt will care or listen... seems like over these month the govt got more numb about the large numbers when march occur every sunday, but this scale of protest that lasted so long had never happen in hong kong before. 2million out of 7million hong kong ppl march onto the street had also never happened before. we hongkongers’ persistence are not dead yet. and we do not forget the injustice, our rights, our demands. we do not abandon the people who stand at the front line, risk their lives and future, or people who already sacrificed their lives over this. Hongkongers stand tgt.

US Representatives Jim McGovern and Senator Marco Rubio introduced the “Hong Kong Human Rights and Democracy Act of 2019” bill to the House of Representatives and the Senate. (17July)

EU (18July) called for export control on crowd-controlling technologies that hong kong police “used to violate basic rights” and urged HK government for an independent investigation into the use of force by hong kong police.

im tired. after a march. been tired for the past month. tired of our govt and system. dark things are happening right now as im typing.. i cannot tell u everything that is happening every day. Dark everywhere basically...

[7.21 protest]. if u care to know the updates and details. there are people against anti-extradition protestors. They are violent. Beat people who wears black, or people who wrote democracy lennon wall, or people who in any way shows that they are part of the anti extradition movement. Some people of criminal background are gathering to wait for black-tshirt protestors at certain district tonight. they beat people up. Police aint showing up when people call 999 for help. We all know that police won’t arrest (or won’t proceed with charging) those people who are against protestors. Police probably know about it or even collude with the criminals to beat citizens up. What a dark age Hk has come to. we basically don’t hv police to enforce the law as they should anymore. police is just another criminal organization now. Even before tonight, police won’t arrest or charge those violent people at Pro-police assembly who beat a 16yo girl who wears black. In countless incidents this month, they just don’t even do anything for any harm goes in protestors way....

Pro Revenge: Prof. Vs Student edition.

This is a long one folks; I’ll post a TL; DR at the end, but I hope you enjoy!

It would have been petty, but the results blew up so much more massive than I intended.

The Background:

This took place in a university in the UK about 9 or 10 years ago. I was there on my first year of undergraduate degree, and the subject of my revenge, lets call him DIP (Dubious Incompetent Professor) was the sole lecturer for a module that I was taking. DIP was an American professor, over in the UK for a couple of years to teach at this university. He wasn't doing the best job. He was often late, refused to answer questions, often used new acronyms or terminology and refused to explain them and never made his slides or notes available to his students. He would make rude and unprofessional comments about the students when we were not able to answer his questions instantly, even on topics we hadn't yet covered. On one occasion DIP turned up covered in cuts and bruises and proceeded to give us a third year lecture about a complete unrelated topic became angry when this was pointed out, swore at the student and stormed out of the lecture. Several lectures he attended smelling strongly of Cannabis. Needless to say, I was not able to keep my mouth shut about this and had challenged him about it several times - usually after lectures when most of the other students had left. I never got anywhere.

The Tipping Point

Completely out of the blue, I get a letter delivered to my dorms summoning me to a departmental disciplinary hearing later that day. I have absolutely no idea what it’s for, but I start Shitting Bricks. Time to read up on the University discipline regulations. I turn up at the appointed time and there’s another student from DIPs class there with me - lets call him Jim. Jim’s a bit of a wet lettuce and we don’t particularly get on (at least in part because he’s sleeping with my Ex) we both look at each other kind of confused. Neither of us knows what's going on. They pull Jim into the office first, and I sit down on the chairs in the corridor feeling more nervous as the minutes go on.

After about 10 minutes Jim comes running out of the office sobbing. The door closes behind him and then nothing for another 10. What have I got myself into here? Then it’s my turn. I go in and there’s 4 people sat in the office. In a rather intimidating stroke, the blinds are drawn, and there’s a single lamp on making the room kind of dark. There’s a desk in the middle of the room, with two people I don’t know sat at it and two more sat in the far corners mostly in shadow. One of them is clearly DIP – he’s kind of distinctive. 6’2” plays a lot of American football and is pretty beefy. I sit down and ask “what’s going on?” and they slide a peice of paper over to me. It’s a printout of a Facebook post – by Jim - made about a week ago. The post reads something along the lines of “I’m so sick of DIPs lectures, they’re pointless we never learn anything. I might just punch him in the face” I raise my eyebrow at the suits watching me. They slide another printout over with a comment I made on it, circled in red. My comment on that status was roughly “Great Idea Jim, posting threats to assault a lecturer on Facebook. Why not go the whole way and say you want to kill him? Lay out a plan to dispose of the body and everything. You idiot.”

I look up at the suits across the desk “Please explain these comments” they ask. DIP leans forward in his chair, glaring at me. “They’re exactly what I wrote!” I say. “I’m pointing out to Jim in a sarcastic tone that making threats to assault people isn’t a great idea, especially in writing,” “BULLSHIT!” DIPshouts interrupting the suits conducting this interrogation as they begin to reply. He grabs the chair of one of them and pulls it back saying, “move” and takes their place at the interview table. The other person in the corner looks alarmed, and I notice that she’s been making notes the whole time but has now stopped. “You are planning to kill me.” Dip growls “You and your little asshole friend. I do not take threats like this lightly.” DIPs face is red with rage and he looks like he’s on the brink of loosing his self control completely. I can’t help it. I laugh. The sheer ridiculousness of the situation is hilarious. DIP slams his palm down on the desk, and roars at me to stop laughing. “Listen you little punk. How would you like it if I threatened to kill you? I’ve started keeping a baseball bat in my office just in case one of you comes round with ideas. I feel genuinely under threat by you due to your comments. (I’m 5’9” and back then about 150 pounds. He could bench press me with one arm) Maybe I take it with me for a walk one day after lectures. You live in (Student Halls block X) don’t you? Maybe we could find some ways to adjust your attitude.”

Well. That starts to get me angry. And when I get angry, I tend to get a bit verbally malicious. I don’t respond initially. Then I look past him to the lady in the corner and say “Hi! Are you taking minutes for this “disciplinary” interview?”she nods “Great! I just noticed you’d stopped when DIP took a place at the table. Could you please record his actions and DIPs threats to assault and kill me verbatim? As well as the fact that he has just disclosed he keeps a baseball bat in his office to assault students with?” DIP glares at me again, and begins to speak. I ignore him and pull a copy of the university disciplinary procedure out of my bag, on loan from the student library. Turning to the other suit, still at the table. “Why is he here? According to these, any complaints should be resolved by staff members who are independent of either party. Please could you ask him to leave?” “That’s IT!” DIP shouts, “You’re failing my course, if this was America, I’d have you arrested” “That’s nice,” I reply, “but you can’t do that. All I’ve done is challenge another student in a jokey manner over comments they posted on a social media page. I havn't done anything wrong”I look back to the other suit “could you explain to me where these printouts have come from, and why I was not given sufficient notice of this meeting to arrange for a student union representative to attend with me?”

The printouts clearly have the name of DIPs girlfriend, another lecturer in the department visible. She’s obviously been searching the Facebook pages of students in DIPs class, which is against university policy, and shown DIP what she found. The woman in the corner has stopped writing again. I ask her to record those questions as well. She does so reluctantly. The suit that was removed from the table puts a hand on DIPs shoulder “you should go” he says and DIP stands up and storms out slamming the door. The suits whisper to each other for a minute, look at me and say “You can go. We will not be pursuing this any further on this occasion but you will be getting a warning.” “That’s ridiculous!" I say, but they won’t budge. *“Please send me a copy of the minutes!” I ask cheerily as I’m going out the door. I wan't going to let this go.

The REVENGE

Thoroughly pissed off after this, I decide to get my own back, and head up to the dean’s office to submit the exact same complaint against DIP, that he’d tried against me. I fill in all the paperwork, give a statement and I’m I ask what sort of resolution I’d like. I go for what will hurt DIP’s pride the most. A public apology to me in front of the class. I get told that I will be advised of the result in due course.

A week or two goes by and I don’t hear anything then one day, there’s a different lecturer teaching DIPs class. We all look around as she walks in. “I’m sorry to tell you,” she says “that DIP is no longer employed by this university. I will be filling in for him until the end of the semester” excited murmurs fill the lecture hall. This is the best thing that had happened on this course all year. A day or two later I get a letter from the university. It says that they have terminated DIPs employment due to the complaint from me and testimony from other students. They have also referred the matter to the police who may be in touch with me in due course. The letter also went on to say that due to the potential risk he posed to the students, the university had also withdrawn their sponsorship of his VISA and that he no longer had leave to remain in the UK and would be returning to America within the week, so I should not feel under threat. I was to report any further contact with him and would have the warning removed from my record. A friend in the department also told me that he and his girlfriend had a shouting match down the corridor when she found out what he had done and that he’d been sacked and she left him. I do feel a little bad for him. But not a lot.

TL;DR

Awful American lecturer in the UK misunderstands "British" humour, makes threats to kill me over it I complain he loses his job, his girlfriend and gets his VISA revoked so he has to leave the country.

Cullrian Seasonal drabble

The tag needs some love so here’s a self-prompted seasonal drabble, inspired by this list.

10: I forgot to buy a Christmas tree and I tried to cut one in your garden, you caught me, please, don’t call the police, I can explain. (Cullrian, modern Thedas AU, rating T)

Just to note, many liberties were taken with this prompt, the largest being the assumption that Satinalia traditions share similarities with Christmas. Any and all mistakes are my own since this drabble has not been beta-read. Happy Holidays!

Dorian didn't know what he had been thinking when he agreed to be responsible for procuring a Satinalia tree for their weekend outing in Dragon's Peak. It had seemed like a good idea at the time: Ellana was scrambling to make last minute arrangements to secure the family cottage from her (evidently, rather large) extended family just before Satinalia and Dorian had been more than happy to relieve her of some of the planning. Sera and Bull had been left in charge of alcohol (a decision that had Dorian raise his eyebrows because if the two had it their way, everyone would be left drinking cheap whiskey and that Maker-awful spirits qunari favored) while Varric and Garrett in charge of the baking. In hindsight, it was all a disaster in the making, made worse by the final push for holiday shopping that saw Dorian working overtime these last few weeks, all while struggling to find time to prepare for his dissertation. Before he knew it, it was already Friday evening and he had to make the drive up to cottage country, hours later from when he had told his friends he would arrive.

Bloody ridiculous, thinking I had the luxury of going out to buy a blasted tree, he thought, moodily, grunting as he impaled the ax into the tree's base.

That he even had found the tool in his trunk was a miracle that he supposed he'd have Bull to thank for later, who frequently borrowed Dorian's car. It was only slightly worrying that the qunari had done anything recently involving an ax.

Snow flicked off the evergreen branches in an annoying, powdery spray that threatened to muss Dorian's carefully oiled coif and put him in an even fouler mood. Cutting down a tree – incredibly illegal, he had no doubt – had been his last option. Never mind that he was an international student on a Ferelden study visa and could see more than his study rights revoked if he was caught. He was far enough up the road from the nearest farm that he doubted anyone would discover him and the need to not disappoint his best friends outweighed being a model resident in that moment.

He cursed beneath his breath as snow splattered onto his face, pausing to swipe a gloved hand over his eyes. Great. Now his face was wet, he was freezing his arse off because Ferelden winters bloody-well sucked, and he was barely even halfway into chopping down this tree.

“You'll never get it down. Not with that sloppy form. And if you keep swinging like that, you'll throw out your back.”

Dorian nearly choked on his next curse, ax fumbling in his unsteady grip. He hadn't expected anyone to find him this far into the woods and certainly not to sass him upon seeing him committing a crime against the environment. His immediate reaction was a vicious retort to match his bitter mood but panic prevented him from running his mouth before he found himself in even hotter water.

Turning to face the man who had interrupted him, the Tevinter tried not to let his surprise show at seeing a handsome blond standing not yards from where he was chopping, an unleashed mabari at the man's side. The beast had its head tilted, sniffing the air as if to discern whether it liked this trespasser, while Dorian's brain was trying to come up with anything to say other than the word FUCK, which was running on a loop in his head.

“...this isn't what it looks like,” he said, realizing how stupid it sounded once it was said.

“Really?” the Fereldan questioned, a hint of disapproval beginning to creep into his feigned tone of bemusement. “Because if I didn't know better, I'd think you were trespassing on private land and attempting to chop down one of my sister's trees.”

Okay. So maybe it was what it looked like.

Fasta vass. He had been caught with literally ax in hand, hacking away at a tree.

“Perhaps we can come to some agreement that doesn't involve inconveniencing either of us further,” Dorian tried, using that same, smooth tone he had to employ often to defuse the ire of disgruntled customers. “I apologize, take my leave, and we forget this rather embarrassing situation. Poor judgment on my part.”

“Or, I have you fined for illegally attempting to fell a tree,” the man answered, arms folded over his chest, grim lips beginning to curl in a scowl.

“There's no need to get the authorities involved,” Dorian replied, quickly. He didn't even want to think of what could happen to his student visa if he was entangled in a violation of the law. “I'm sure we can find other means to settle this. I'm more than willing to compensate you, Mr...?”

“Detective Cullen Rutherford.”

…FUCK.

It would be just his luck that he ends this shitty week being caught by a police officer in his first flirtation with crime.

How was he going to get out of this without making things worse?

"Detective Rutherford? How wonderfully Fereldan-sounding. Do appease my curiosity and tell me you have an equally endearing middle name, like Nathaniel or Bryce. Detective Cullen Nathaniel Rutherford. It rolls off the tongue quite nicely."

If the detective was annoyed before, he was absolutely baffled by now, staring incredulously at the would-be tree feller. The gray mabari barked at the sound of its master's name while the officer began to flush.

"What are you--t-that's not my--"

"No need to correct my assumption. You can tell me over a cup of coffee. How does next Thursday sound?"

The poor blond looked even more bewildered at the turn of conversation. It took him a few seconds to process the silky, flirtatious tone Dorian was using. And when he figured it out, his face went a deeper shade of red.

"A-are you attempting to bribe an officer of the law with coffee to avoid being charged for a misdemeanor?"

"Bribe?" the Tevinter laughed, his voice taking on a coy lilt. "Is it so hard to believe that I find you far too handsome to pass up this opportunity, even if we must deal with such frivolities as charging me for attempting to cut down a tree?"

"M-Maker's breath!" Cullen mumbled, dropping his red face into his gloved hands. “Th-there's no need to—you really shouldn't—”

And much to the detective's dismay, his loyal companion bounded through the snow towards Dorian, wagging its stubby tail, to which the Tevinter rewarded the dog with a generous pat on the head and some very appreciated ear scratching.

“Man's best friend indeed,” the detective muttered, feeling more than a little betrayed by his pet.

“I must commend you on your excellent choice in four-legged companions, Detective Handsome.”

“Rutherford!” Cullen quickly corrected, looking for all the world like he was about to die of embarrassment.

“A big, fierce beast like this? And you know what they say about a man with a big dog. He's also got a big—!”

“By Andraste, if I drop the charges, will you stop?!”

Dorian smirked triumphantly. “I was going to say, 'big heart'.”

"Look...it's Satinalia. The weather's not the best and it's hard to see anything clearly this time of night. Let's say a would-be violator of Ferelden's rather important,” Cullen emphasized, with a slight glare, “environmental protection laws managed to get away before any real damage could be done and we forget this whole incident.”

“...that sounds reasonable.”

“And for the love of the Maker, please stop attempting to flirt your way out of trouble. It's not a habit you should be employing every time you anger an officer.”

“But it worked, didn't it?”

The Tevinter's answer was a groan but he swore the Fereldan was hiding a smile behind his gloved hand.

“Alright. No more flirting with officers so gorgeous, they're making me rethink my lifelong hatred of plaid,” Dorian said, winking salaciously at the detective. “From now on, I'll curry favor with officers of the law by bewitching their beloved pets.”

“Something tells me Brixon and I will need to have a long chat about accepting scratches from 'perps',” Cullen said, giving a mock glare to his dog.

"Brixon? What a lovely name for a big, scary mabari," Dorian said, smiling down and scratching the mabari's ear once more.

The dog whined, giving what seemed to be a disapproving look at his master, which only made the detective chuckle.

"Don't be like that. I know you're as good as any one of the men and women who serve on the Denerim police force."

Dorian's head perked up at that. "You're from Denerim as well?"

"Transferred from Honnleath only a few months ago," the Fereldan answered. "You've come quite a ways out of the city to find a tree."

The Tevinter had the humility to look somewhat embarrassed at the observation. "I'm spending the weekend at my friend's cottage and, of course, the one thing I was tasked with, I failed to do until the last minute."

The blond fell quiet for a moment, deep in thought. "If it's a tree you need, I may be able to help you out.”

"I can't thank you enough for this," Dorian said, as Cullen helped him secure the tree on the roof of his car.

Checking the ropes one final time, Cullen gave the Tevinter a small smirk. "I'd much rather give you one of my sister's left over trees than have you commit another crime."

"Attempted-crime," Dorian corrected, to which the Fereldan simply chuckled.

As luck would have it, Cullen's sister Mia was the owner of the tree farm he had been attempting to steal a tree from. She had been more than happy to treat Dorian to cocoa as Cullen fabricated a story about finding Dorian at the side of the road and helping him to jump start his car. And when Dorian had added that he had been on his way to find a tree farm that would hopefully still be selling trees at this time of night, Mia had generously offered one on the house.

"It's the least I can do after the night you've been having.”

And if that didn't inspire guilt that had Dorian pulling out his wallet, he wasn't sure what else would. But after much insisting, most of it by Cullen, the Tevinter accepted the gift.

"You really didn't have to do this for me," he added once more, standing a bit sheepishly by the door to his car.

The detective smiled rather shyly and as his cheeks grew pinker, Dorian couldn't help but think, for not the first time that evening, how adorable the (“still quite tragically single,” Mia had declared overly loud over warm beverages, earning her a mortified look from her younger sibling) man was. “When you attempted to flirt your way out of a fine, I knew you had to be in some financial trouble. Times are tough. Plus, it's Satinalia. I hope you and your friends put that tree to good use.”

The Tevinter grinned widely. “You have my word, detective. Thanks again for the tree. Please tell your sister I wish both of you a happy Satinalia.”

As he unlocked his car, he paused, glancing sideways, with a smug smirk on his face. “And just so you know, I would have flirted with you even if you hadn't caught me in the middle of destroying the local environment.”

This time, Cullen's blush reached the tips of his ears, which peeked out above the thick, plaid scarf he wore around his neck.

“About next Thursday...”

Dorian, with one leg already in the vehicle, stopped. “Hmm?”

“I-I'm free. If you still want to know my middle name,” the detective said, ducking his face bashfully.

Dorian's stomach did a flip.

“I-it doesn't have to be a date,” Cullen added quickly, still not quite able to meet the Tevinter's eyes. “I-I don't have many friends in Denerim and—well, it would be nice to—and coffee. Coffee would be great.”

“So, in exchange for coffee, you'd tell me your middle name?” Dorian teased. “Then I, in good conscious, must inform you that Mia divulged that information in private while you were feeding Brixon, Detective Cullen Stanton Rutherford.”

But the Fereldan took the teasing another way, an apologetic look on his face. “Ah, I-I suppose that means you're busy and—”

“And free after 4. If that works for you.”

Dorian had thrown out a random day when he had initially made his suggestion. Luckily, he had nothing planned after his shift.

When the detective looked back up, his honey-colored eyes widened in shock. “Y-yes t-that's great. I—would you like to exchange numbers?”

In his nervousness, Cullen fumbled with his phone and nearly dropped it onto the road. Dorian did his best to hold back a chuckle but seeing the embarrassed smile on the detective's face made the Tevinter's own lips curl in a grin, a flutter in his chest. Once numbers were exchanged and they had added each other to Let’s Chat, a popular Thedosian app, they said their goodbyes and Dorian started his car.

Before pulling off onto the road, he rolled down his window and called out, “Oh, and just so you know, Cullen, Thursday is very much a date!”

The poor man nearly slipped into the snowbank but that didn't stop him grinning from ear to ear as he waved Dorian off.

Perhaps this week wasn't so terrible after all.

In college, Lexa had a short-lived infatuation with a Brazilian foreign exchange student named Costia.

It wasn’t Lexa’s first lesbian awakening but it was the only time she acted upon it.

(She went to an all girls prep school, played lacrosse and had a string of intense female friendships, so it was pretty much a given she was going to have a gay epiphany when she was old enough to realise what those squirmy feelings meant. But since she was raised in a super strict, conservative household, she ruthlessly repressed that part of herself for fear of her family’s rejection. Basically, she was so far into the closet she was in Narnia.)

It was her step-mother, Nia, who discovered Lostia’s clandestine relationship by walking in on them in a comprising position at the house one afternoon. Lexa thought they’d have the place to themselves for spring break. Wasn’t expecting her parents to cut short their trip to DC and return home two days early.

So there was Lexa: wide-eyed and horror-struck, cheeks flaming red hot with shame and embarrassment at being caught, clutching her shirt to her chest as she rolled off a very naked Costia.

Nia’s lip curled in disgust but there was a gleam of hard, cold satisfaction in her eyes when she told Lexa to “get that hussy out of my house. Now.”

“Please don’t tell Dad,” Lexa begged, after Costia had been hastily ushered out the side entrance and into a waiting Uber.

He might be an old homophobe, entrenched in his bigoted views, but he was still her father. Stern and emotionally distant as he was, he loved her in his own undemonstrative way, and she couldn’t bear to see the bitter disappointment on his face, the revulsion in his eyes.

“I won’t,” Nia conceded at last. “But not for your benefit, Alexandria. His feeble heart couldn’t take it and I have my sights set on a two term tenure in the White House as First Lady.” Her stare turned malicious, voice dripping with poison as she twirled her pearls. “No, this is what’s going to happen: you will end this dalliance immediately. You will not see or speak to her again in any capacity. If you so much as look sideways at another woman with anything other than platonic admiration, I’ll have you disowned and disinherited faster than you can say ‘trust fund allowance severance’. Is that understood?”

Lexa clenched her jaw but gave a tight nod, sullen gaze cutting away. “Yes.”

“Yes, what, dear?”

Lexa’s eyes returned to Nia’s face, studying her condescending expression for a beat.

Filled with complete loathing for this woman, Lexa fought hard to keep the emotion from her own voice. “Yes, mother.”

Ultimately, Nia used her influence to have Costia’s student visa revoked and had her deported back home to São Paulo. And Lexa never forgave Nia for it, but what could she do? She couldn’t go to her father, had no recourse, no way to fight back.

Titus’s public image was carefully constructed to portray him as a paragon of traditional family values and the scandal of his daughter being a raging lesbian would destroy his reputation and leave him a laughing stock, given the views he’d long espoused on homosexuality and his strident opposition to laws that would protect LGBT citizens. And Lexa would be shamed, shunned, made a pariah, cut off from her only source of income. Forever pitied and sneered at by the liberal elite as the unfortunate offspring of a man who decried the existence and fundamental human rights of his own progeny.

Well, Lexa was too proud to see herself disgraced in such a way.

From that day onwards, whenever Lexa didn’t toe the line, Nia would dangle the threat of outing Lexa to Titus over her head and Lexa endured it with stoic acceptance.

So she attended the Republican ladies luncheons, the campaign fundraisers and the GOP conventions, joined a gun club, donned the twin sets, and played the part of the meek, obedient, morally upstanding, straight as a ruler daughter as required. She kept telling herself that once her father was re-elected, she could finally be her true self: cast off the Ralph Lauren for comfortable flannel; sit like a proper lesbian instead of keeping her knees daintily together; cut her nails short; get a sleeve tattoo; go on dates and kiss girls and be happy.

But his political star kept rising as he climbed the greasy pole to power and Lexa continued to hide behind a facade of straight conformance, making a rod for her own back.

Until she crossed paths with Clarke Griffin at the rally and it was like a shock to the system, startling Lexa out of a waking nightmare she’d been mired in for years.

She couldn’t fully explain what drove her to visit the precinct, to use her own money to bail Clarke out. The hooligan assaulted her, for God’s sake!

Perhaps it was because she envied Clarke’s freedom to live life on her own terms; admired the woman for having the courage of her convictions to stand up to injustice and oppression, no matter the personal risk (and the potential stain of a criminal record). Or maybe it was because Lexa hadn’t been able to shake the memory of fierce blue eyes, blonde hair streaked with pink dye, the tight fit of the NoH8 shirt that Lexa couldn’t stop staring at in the grubby reception area even now…

All she knew for certain was that there was something liberating in finally being honest about her true feelings on her father’s repellent rhetoric. Also, something oddly pleasing about the way Clarke gaped at her, like Lexa was a two-headed creature from another planet. The other woman’s expression made all the more absurd by the bright pink ‘pussy’ hat pulled down over her ears.

Whatever the case, Lexa drew herself up and flicked a hank of coiffed hair over her shoulder. “I’m assuming they haven’t fed you here. You must be hungry. Would you care to join me for dinner?”

So, like, Clarke’s protesting outisde the rally Titus is holding for his knuckle-dragging supporters. She and her friends have placards and everything. Are doing a funny but scathing chant to interrupt his speech and Titus gets ever more angered/flustered by it.

Afterwards, as he and Lexa flee to their vehicle, escorted by their security detail, they get pelted with eggs. Yolk all down Lexa’s neatly pressed skirt suit. Within seconds Clarke and gang are leapt on by the cops. And in the melee that follows, riled green eyes meet smug blue. Clarke is dragged off to a paddy wagon and Lexa is bundled into the car, shaking bits of broken shell out of her hair in the back seat. Her heart racing. Tuning out her father’s furious ranting about “snowflake liberals.”

Later, at the police precinct, Clarke stews in her cell. Her mom’s in surgery but she managed to put in a call to Kane, who’s co-ordinating a local grassroots movement for the Democrats. So the last person she expects to see when an officer informs her she’s made bail is that stuck up Republican bitch, Lexa fucking Woods.

“You,” Clarke seethes.

She almost demands to be locked up again because she doesn’t want to owe a thing to this privileged white asshole.

But she’s also curious. “Why?”

Lexa raises her chin and regards Clarke for a long moment.

“I despise my father’s policies as much as you do.”

And Clarke is SHOOK.

What does the “Muslim Ban” mean for you?

1 Today (2/2/17) I went to an information session led by some officials of at UMN and immigration lawyers. These are my notes. Please don’t take them as more than what they are -- information collected in a very informal way. I am not a lawyer. Still, they may be useful information. I learned a lot and everything was explained without excessive legalese. 

Three executive orders were issued on 1/27/2017. There is overlap between them.

Executive Order # 1 - “The Ban, basically”

1. 120 day moratorium on refugees from all countries was established 2. Indefinite ban on refugees from Syria 3. 120 day ban on nationals from the selected 7 countries (this includes those who hold valid visas)      i. There is an exception for members of “religious minorities.” Those “religious minorities” are not defined in the text of the executive order but are understood to mean only Christians. 4. All valid (non-immigrant) visas from the 7 country list have been revoked.      i. This is unprecedented. Visa revocation is almost always done on a case-by-case basis.      ii. The State Department cable says this applies to visa holders already in the country at the time of the Executive order. Customs and Borders Protection claims that it does not apply to visa holders already in the country at the time of the Executive order.      iii. A person in not in unlawful status until they have received written notification that they are in unlawful status. 4.Dual citizens are being processed according to the passport they present at the border. (E.g. Iran-Canadian dual citizens are advised to present a Canadian passport if they are traveling. Dual citizens should still contact an attorney prior to travel.) 5. Re-entry to the US on a multiple entry non-immigrant visa for persons from the 7 countries is barred for a minimum of 90 days.      i. The fact that this is a fluid situation was emphasized. This 90 day period may increase. 6. Executive order is expected to limit faculty and student exchange and impact field work for academics and collaborators from those 7 countries.

Executive Order #2 - “Enhancing Public Safety in the Interior”

1. Previous deportations were sorted through a priority list. This executive order prioritizes deportation -- all residents without lawful status are a priority. Terms are very unclear. 2. Includes provisions for deportation action for those who have been charged, are being charged, or have “done actions that constituent grounds for a charge” and includes overstay violations. 3. States the intention to hire 10,000 new ICE officers. (There are currently 7,000 ICE officers, total.) 4. 287G program is expanded. 5. Legal action could affect “those who facilitate [the presence of aliens in the country]”     i. Unclear what this means. 6. Will publish crimes committed by immigrants that are in “sanctuary jurisdictions”      i. There is no legal definition of sanctuary. Therefore, it is expected that the Attorney General will designate these sanctuary jurisdictions. 7. The Secure Communities Program will return.      i. This was ended in 2014 due to constitutional issues.

Executive Order #3 - “This is the wall, guys.”

1. Funding for the wall is unclear. 2. Unclear whether new federal hires to build the wall will be exempt from the federal hiring freeze. 3. Those on removal proceedings (including those on humanitarian parole) will be detained. 4. Expedited removal now applies to those who have entered the country unlawfully from the southern border throughout the entire country unless they have been in the interior for two continuous years.      i. Expedited removal means you do not see a judge.      ii. It limits the right to claim asylum.      iii.  Previous limits for expedited removal applied to those caught having entered unlawfully within 100 miles of the Southern Border and within 14 days. This is a large expansion of those guidelines. General Comments: 1.  These orders seem to have been written up to create an atmosphere of fear. It is does not seem that there is strong legal ability or community will to force compliance or to comply, respectively. 2.  There is speculation on Executive Orders applying to DACA but no concrete action yet. 3. Naturalized U.S. Citizens who are originally from the 7 countries should not be affected.  4. Executive Order does not apply to green card holders any longer.(But they are advised to contact an attorney prior to travel.) 5.  If you applying for citizenship, how this affects you depends on the step of the process you are currently at. (See an attorney.) 6. Status of multiple entry student visas are unclear. (See an attorney.) 7.  Drafts for executive orders applying to HB-1 programs are being circulated but no concrete action yet. 8.  Temporary protected status ramifications are unclear. 9. 60 days for immigrations and intelligence community to develop a psychometric screening test to identify those who mean to “harm our country”. (This is an extremely short time period to develop such a tool in.) 10. If you are a student at UMN, Student Legal Services and International Student Services are available. Immigration lawyers at the university have attorney-client privilege. If you go to another school, I do not know what is available to you but I encourage you to check with a department that serves international students.

Do NOT Teach English in China and Why EVERYONE Should Read This

If you are thinking about taking a job teaching English in China, my strong advice to you is DON’T DO IT. Just don’t. Look for such a job in Vietnam or Thailand or Japan or Spain or the Chezk Republic or really just about anywhere else in the world. I say this becasue teaching English in China has become that corrupt, that horrible, that exploitive, and that risky.

Let me explain….

Our international lawyers have always gotten a steady stream of emails from English teachers in foreign countries who are in trouble or not getting paid. Though these matters are invariably too small for us (or just not the sort of work we handle), we do want to help to the extent we can. That “help” usually consists of an email providing “fly-by” legal or career help or even emotional support. We view helping these teachers as a bit of a public service.

In International Education: The Emails We Get, we explained how our international lawyers have inadvertently found themselves on the front lines with this, even though we have never made a single cent from representing an English teacher anywhere in the world.

A couple years ago we wrote a four part series on establishing an international school in China. In part 1, Establishing International Schools in China: The Basics, we discussed the complications foreign parties typically see when trying to start a school in China. In part 2, Establishing International Schools in China: A Deeper Dive, we focused on what it takes to start a School for the Children of Foreign Workers. In part 3, Establishing International Schools in China: A Deeper Dive (Continued), we discussed Sino-Foreign Cooperative Schools and Chinese Private Schools. In this, my last post in this series, I look at future trends for international schools in China. In Part 4, Establishing International Schools in China – Future Trends, we wrote about some of the distinctive issues foreign schools face in China. Many of our lawyers and staff attended international schools or are sons or daughters of teachers or professors. I spent my junior year of high school at Robert College in Istanbul, a year studying Spanish at LAE Madrid, and 8 months studying French at the Institut de Touraine. All three are amazing schools and these were some of the best years of my life. My father taught English Literature at a liberal arts college for 36 years. Our law firm has a long history of representing universities and international schools on their international legal work, ranging from helping them set up in foreign countries to licensing technology they’ve developed to foreign companies.

Our writings and our legal work and our various international school connections mean we get 10-20 emails every month from people teaching around the world, roughly be divided into the following four categories:

Visa issues.

Employment contract issues.

Medical and landlord issues.

Starting a school issues.

We went on to talk about how our international lawyers try to do their best to give responses that contain actionable advice, based on the limited time and information we have and the below reflects how we typically handle the four most common categories of foreign teacher emails.

1. Visa Issues. We almost always have to punt on visa issues because our immigration law expertise is mostly limited to business immigration to the United States, with a smattering of additional knowledge gleaned from the transactional work we do in Asia and in Europe. Since none of us have deep immigration law knowledge relevant for foreign teachers our response is usually to urge them to seek out a local immigration lawyer for assistance. I know from my own experience in other countries that there is a veritable ton of bad and outdated immigration law information on the internet and an hour or two with a lawyer who actually knows this area of law can be invaluable. This is pretty much true of all aspects of international law. See China Law Online: It’s All Wrong.

2. Employment contract issues . The typical email we get will say something like “I am a teacher in China and I have been fired for taking a day off because my sister came to visit. Can my school do this?” Our response to this sort of email will usually be something like the following — changed quite a bit for brevity and for emphasis:

I have no idea whether your school can or cannot and for us to know we would first need to make sure we do not represent the school at which you worked (because if we did, we could not represent you) and then we would need to read your contract and then compare that as against the local laws and the province’s laws and China’s laws and then maybe speak with the local employment authorities as well. If it does turn out that the school illegally terminated you we would then need to figure out exactly what we can do about that. Likely that would be registering a complaint with the appropriate Chinese governmental body and using that to try to pressure your employer to take you back, which is very unlikely to happen. When you are not taken back we would then need to look into suing the school. If we did sue the school and you won, we might get an order saying the school needs to take you back and we might get some really small amount in damages. Then again we might also lose. Your school may or may not abide by the order.

The problem with the above is that at some point your China visa may be revoked and you will need to leave China. And win or lose, you challenging this school may lead to you never getting a job in China again and going through the above will be time consuming and expensive.

3. Medical and landlord issues. These emails often come down to money. “The hospital wants $400” or my “landlord wants to raise rent by $100 a month.” As a father, my responses to these are usually nine parts paternalistic, one part legal.

4. Starting a school issues. The typical email will come from someone who has been teaching English in China or in Vietnam or in Poland or wherever and they now want to know what it will take “to open a school for foreign students in X city in Y country.” We then explain the basics of what setting up a school will require and the estimated costs.

Since relations between China and the West (especially the English speaking West) started going into straight line decline about a year ago, the number of these emails have increased exponetially and the problems have shifted. The problems we are seeing these days generaly fit into the following three categories:

1. English teacher in jail for a fight or for drug possession. Our advice is to have someone close to them reach out to their country’s embassy and work with the embassy in securing a good local criminal lawyer. We urge them to act quickly and, if at all possible, secure financial support from their parents. We urge them not to publicize their case unless and until their retained lawyer suggests that be done, which is rare.

3. Visa issues.  We usually suggest the teacher work with their school to try to solve these problems (if they trust/like their school) and/or get a good local immigration lawyer/visa specialist to assist. Occasionally we suggest the teacher leave the country.

4. Non-payment or underpayment. These usually involve the school perpetually underpaying, the school being late with payment, the school not paying promised bonuses, not paying for extra hours, not paying the final month’s paycheck under the contract or not reimbursing or paying for the flight home (as per the contract). Our advice is usually to let it go because finding and hiring and paying for a lawyer will likely be difficult and the teacher (just as with the work related problems mentioned above) may well be better off long-term by not making waves.

Pretty routine stuff right? Yes and no and it is the “no” part that is causing me to write this post. The no part is that in the last three months these issues have gone into warp speed. Speaking just for myself, the number of these emails has gone from one or two a month to four to five a day. I have seen at least a ten-fold increase in prison, visa and payment problems for teachers from China (and nowhere else in the world). It has gotten relentless to the point of being depressing. If the emails we are relentlessly receiving are any indication (and they have to be), the following is happening in China in what feels like every minute:

Teachers are being drug tested using their hair samples. Many are testing for cannabis and being jailed for 30 days or more and then being deported. This is happening to newly arrived teachers who insist they did not consume any cannabis since arriving in China. Listen up everybody, cannabis can show up in hair testings up to (and even sometimes beyond) 90 days after you have consumed it. So if you are going to be teaching in China and you do not want to spend time in jail and get deported, please, please, please go at least four months without consuming ANY cannabis before you go there and please, please, please do not consume any cannabis while there. None. Zero. Zilch. 没有. Aucun. Keiner.  PLEASE. Invaribly, the schools use this as a reason not to pay the teacher whatever is owed.

Teachers are being checked (or reported on) for having an improper visa for China. The teachers are then being tossed in jail and then deported or just deported straight away. Invariably, the schools use this as a reason not to pay the teacher whatever is owed. It appears to have become very common (as a cost cutting measure) for schools to have teachers come to China and start their teaching on tourist visas, all the while claiming this is perfectly legal — it isn’t. The teachers believe this until the day they are arrested. Near as I can tell, the schools rarely if ever get in any real trouble for this but the teachers sure do.

Teachers are not getting paid. Just this morning I got an email from one teacher who say that she and another 75+ teachers in her city (from various different schools) have not gotten paid for months. And another email mentioning nine teachers in another city who also have not been paid.  Add to this the pretty much daily emails I get from teachers who do not get their last paycheck or the airfare reimbursements or the bonuses they were promised and it has become clear that it is open season right now against foreign teachers in China. The schools clearly believe they can blow off paying their teachers with impuntiy because they are right. When teachers ask me what they should do about getting paid my response is usually to say that they can retain and pay a local Chinese attorney to try to get paid, but the odds of a foreign teacher prevailing on such a claim are not good and pushing at all hard to get paid can have all sorts of negative ramifications. Schools will pull teacher’s work visas or refuse to assist in moving it to a new employer. They may also seek to have you deported so they can be sure to avoid having to pay wages owed and it is not uncommon for schools to make up claims about their teachers and to threaten to “make sure they will never work in China again.” You therefore need to think long and hard about getting bogged down in these sorts of disputes and even how they might harm your long term career prospects.

From beginning to end, the game is rigged against English teachers in China. The China employment relationship is complicated and if done wrong, employees can and do end up in jail. The only relevant portion of a China employment contract is the Chinese portion and so teachers who do not speak Chinese have no clue what their employment contracts say and no clue even whether the English language portion of that contract accurately translates the Chinese portion — I can tell you right now that the odds are about 100 to 1 that it does not. And even if you are able to read the Chinese portion, unless you have a comprehensive knowledge of China’s employment laws in the specific locale in which you are working. Our China employment lawyers consistently represent high-level China employees in their employment contract negotiations but English teachers simply cannot afford such assistance. This makes them incredibly vulnerable from day one and their employers know this and they don’t hesitate to take advantage of it.

I have reached the conclusion that the best thing an English teacher can to do protect themselves from the sorts of things mentioned above is not to take a teaching job in China in the first place. Go elsewhere. And if you are teaching in China now, leave now or just resign yourself to your fate. I wish I could give better advice than this but I cannot. Sorry.

So how is the above relevant for non-teachers. I’ll tell you. The truth is that many Chinese companies prefer to hire foreigners illegally to legally because doing so can save them a ton of money and is usually pretty low risk — at least for them. So what I describe above regarding teachers is not as uncommon as you would think in other industries. The Global Times article, The detention of two Irish women who were working side jobs at an unlicensed school in Beijing shines a spotlight on the illegal English education market in China is about  two teachers from Ireland who were detained in prison for more than a week for working illegally in China. Both these teachers had visas that allowed them to work full-time in China, but only with their one employer who secured these visas for them. These two teachers had taken lucrative part-time teaching jobs on the side and it was those jobs that got them arrested.

The Global Times article says the big takeaway from what happened to these two teachers is that “employers have no qualms about hiring foreigners illegally” and “when the illegality is discovered, it is the foreign worker who gets the blame.” It then discusses the following “experiment”:

The article talks about someone who “ran an experiment” by applying for every English language teaching job listed in Beijinger Magazine and clearly stating he could not qualify for a work visa. Only one out of the twenty potential employers declined his application! In other words, 19 out of 20 were happy to have this foreigner work for them illegally. The article notes that under  China’s immigration law, foreigners who work illegally in China can be fined 5,000 to 20,000 yuan and detained for between 5-15 days and then deported. “A lot of the burden and blame falls” on the employee who works illegally in China and therefore, as the US Embassy website makes clear, “it is up to each individual to evaluate potential employers before signing a contract.”

And the getting fooled by the English portion of the employment contract happens in all industries too. We discussed this in Dual Language China Contracts: Don’t Get Fooled!

Can’t believe this is still happening, but it does, and in numbers that would likely surprise many people. The “this” to which I am referring is foreign companies signing dual language contracts without knowing exactly what the Chinese language portion of their contract says. This is really risky dangerous and below I explain why.

Many dual language Chinese-English contracts are silent on which language controls. For some unknown reason, foreign companies far too often just assume that the English language portion controls or they just assume that it does not matter because the meaning of both the English and the Chinese portions is exactly the same. Wrong, wrong, wrong.

What language controls when you have a dual-language contract?  If both languages say the same one language controls, that one language will control. If both the English language and the Chinese language portions say the Chinese language portion controls, the Chinese language portion will control. Similarly, if both the Chinese language and the English language portions say the English language portion controls, the English language portion will control. These are the easy and safe examples.

It is everything else that so often cause problems for American and European and Australian companies in  trouble.

If both your English language and your Chinese language portions are silent as to which portion controls, the Chinese language portion will control in Chinese courts and in China arbitrations. In real life this means that if the English language portion of your joint venture contract says that you get 10 percent of the joint venture’s revenue  but the Chinese portion says you get 10 percent of the profits (which will of course be way less than revenues) you will have no legal basis for claiming anything more than 10 percent of the profits. Not surprisingly it is joint venture contracts and licensing agreements where our China lawyers most often see this sort of meaningful dichotomy between the English and the Chinese portions of the contract.

Of the hundreds of dual language contracts proposed by Chinese companies and reviewed by one of my firm’s China attorneys, we’ve never seen a single one where the Chinese portion was less favorable to the Chinese company than the English portion. But we’ve seen plenty where the Chinese portion is better or much better for the Chinese company than the English portion. Chinese companies love using a contract with an English portion that is more favorable to the foreign company than the Chinese portion and then relying on the English speaking company to assume that the English language portion will control.

But what if the English language portion explicitly states that it will control? This works right? Not necessarily. If the Chinese language portion also explicitly states that it will control, the Chinese language portion will control under Chinese law. If the Chinese language portion is silent or says that the English language portion controls, the English language portion will control.

As we noted in China Contracts: Make Them Enforceable Or Don’t Bother, it usually makes sense to draft contracts with Chinese companies in Chinese with an English language translation. But this also requires that if that contract is going to be enforced in China (as should usually be the case), you absolutely positively need to be certain that you know exactly what the Chinese language portion of that contract actually says. No matter what the English language portion of your contract says, it behooves you to know exactly what the Chinese language portion says as well.

In other words, if you are not truly able to read and understand Chinese, you probably do not know what your contact says. And if it is an employment contract that you do not fully understand, you could be putting yourself at serious risk.

Living and working and doing business in China is way more legally complicated than ten years ago and tolerance of foreigners in China (particularly for Americans) is way down. This means that the likelihood of you going astray of Chinese law is considerably higher as well. Hi there. I have a question. I want to SUE my Car insurance company because they refuse to pay for my stolen car which is been more then 6 months and still hasn't been recovered. I was paying full coverage for about 4 months till the moment my Range Rover 1998 was stolen. After filing proper claims i get a letter from my insurance that they denied the claim. The reason why was because i misrepresented myself. and what they meant by that was that when i signed the contract i selected NO in a question ( Has your license ever been suspended or revoked) Now let me explain how this happened. I got the insurance thru my broker. Everything was done by phone. My broker happened to be family of dear friend of mine. At the time i asked for insurance my driver license was suspended already suspended and the reason why was because of child support for which i was going thru courts with my ex. First i decided to insure my car liability and my car was paid in full. On the liability contract it wasn't any question regarding my driver license either was suspended or not. After a week or so i thought to myself that if i get in a accident god forbid and it was my fault i have to may myself for damages and you know for such a car would be very expensive so i asked my broker if i can changed it to full coverage and so they did. on the day i did the change the girl that worked for my broker and assisting me asked me Klodian you are aware your license is suspended. I said yes and i explained the reason y. So she found this insurance company for a low price and she emailed me the contract to sign and fax it to her. now under the questions which i saw of course latter after i was denied claim i saw they were marked all NO and that was done on computer not hand writing. which of course in this case was done by the girl that helped me. Now my broker told me that insurance company should had run your driving record before they issue insurance to you and if they done that they were gone see your driver lisence was suspended. But when my broker asked them why they didnt run it Their answer was that they trusted me based on the contract i signed which to my opinion is BS. Now i want to sue them and all the lawyers they refuse to get my case and my believe is because my car is worth about $4800.00 and they don't see how they can make money out of me and i don't have to pay them up front. Do NOT Teach English in China and Why EVERYONE Should Read This

If you are thinking about taking a job teaching English in China, my strong advice to you is DON’T DO IT. Just don’t. Look for such a job in Vietnam or Thailand or Japan or Spain or the Chezk Republic or really just about anywhere else in the world. I say this becasue teaching English in China has become that corrupt, that horrible, that exploitive, and that risky.

Let me explain….

Our international lawyers have always gotten a steady stream of emails from English teachers in foreign countries who are in trouble or not getting paid. Though these matters are invariably too small for us (or just not the sort of work we handle), we do want to help to the extent we can. That “help” usually consists of an email providing “fly-by” legal or career help or even emotional support. We view helping these teachers as a bit of a public service.

In International Education: The Emails We Get, we explained how our international lawyers have inadvertently found themselves on the front lines with this, even though we have never made a single cent from representing an English teacher anywhere in the world.

A couple years ago we wrote a four part series on establishing an international school in China. In part 1, Establishing International Schools in China: The Basics, we discussed the complications foreign parties typically see when trying to start a school in China. In part 2, Establishing International Schools in China: A Deeper Dive, we focused on what it takes to start a School for the Children of Foreign Workers. In part 3, Establishing International Schools in China: A Deeper Dive (Continued), we discussed Sino-Foreign Cooperative Schools and Chinese Private Schools. In this, my last post in this series, I look at future trends for international schools in China. In Part 4, Establishing International Schools in China – Future Trends, we wrote about some of the distinctive issues foreign schools face in China. Many of our lawyers and staff attended international schools or are sons or daughters of teachers or professors. I spent my junior year of high school at Robert College in Istanbul, a year studying Spanish at LAE Madrid, and 8 months studying French at the Institut de Touraine. All three are amazing schools and these were some of the best years of my life. My father taught English Literature at a liberal arts college for 36 years. Our law firm has a long history of representing universities and international schools on their international legal work, ranging from helping them set up in foreign countries to licensing technology they’ve developed to foreign companies.

Our writings and our legal work and our various international school connections mean we get 10-20 emails every month from people teaching around the world, roughly be divided into the following four categories:

Visa issues.

Employment contract issues.

Medical and landlord issues.

Starting a school issues.

We went on to talk about how our international lawyers try to do their best to give responses that contain actionable advice, based on the limited time and information we have and the below reflects how we typically handle the four most common categories of foreign teacher emails.

1. Visa Issues. We almost always have to punt on visa issues because our immigration law expertise is mostly limited to business immigration to the United States, with a smattering of additional knowledge gleaned from the transactional work we do in Asia and in Europe. Since none of us have deep immigration law knowledge relevant for foreign teachers our response is usually to urge them to seek out a local immigration lawyer for assistance. I know from my own experience in other countries that there is a veritable ton of bad and outdated immigration law information on the internet and an hour or two with a lawyer who actually knows this area of law can be invaluable. This is pretty much true of all aspects of international law. See China Law Online: It’s All Wrong.

2. Employment contract issues . The typical email we get will say something like “I am a teacher in China and I have been fired for taking a day off because my sister came to visit. Can my school do this?” Our response to this sort of email will usually be something like the following — changed quite a bit for brevity and for emphasis:

I have no idea whether your school can or cannot and for us to know we would first need to make sure we do not represent the school at which you worked (because if we did, we could not represent you) and then we would need to read your contract and then compare that as against the local laws and the province’s laws and China’s laws and then maybe speak with the local employment authorities as well. If it does turn out that the school illegally terminated you we would then need to figure out exactly what we can do about that. Likely that would be registering a complaint with the appropriate Chinese governmental body and using that to try to pressure your employer to take you back, which is very unlikely to happen. When you are not taken back we would then need to look into suing the school. If we did sue the school and you won, we might get an order saying the school needs to take you back and we might get some really small amount in damages. Then again we might also lose. Your school may or may not abide by the order.

The problem with the above is that at some point your China visa may be revoked and you will need to leave China. And win or lose, you challenging this school may lead to you never getting a job in China again and going through the above will be time consuming and expensive.

3. Medical and landlord issues. These emails often come down to money. “The hospital wants $400” or my “landlord wants to raise rent by $100 a month.” As a father, my responses to these are usually nine parts paternalistic, one part legal.

4. Starting a school issues. The typical email will come from someone who has been teaching English in China or in Vietnam or in Poland or wherever and they now want to know what it will take “to open a school for foreign students in X city in Y country.” We then explain the basics of what setting up a school will require and the estimated costs.

Since relations between China and the West (especially the English speaking West) started going into straight line decline about a year ago, the number of these emails have increased exponetially and the problems have shifted. The problems we are seeing these days generaly fit into the following three categories:

1. English teacher in jail for a fight or for drug possession. Our advice is to have someone close to them reach out to their country’s embassy and work with the embassy in securing a good local criminal lawyer. We urge them to act quickly and, if at all possible, secure financial support from their parents. We urge them not to publicize their case unless and until their retained lawyer suggests that be done, which is rare.

3. Visa issues.  We usually suggest the teacher work with their school to try to solve these problems (if they trust/like their school) and/or get a good local immigration lawyer/visa specialist to assist. Occasionally we suggest the teacher leave the country.

4. Non-payment or underpayment. These usually involve the school perpetually underpaying, the school being late with payment, the school not paying promised bonuses, not paying for extra hours, not paying the final month’s paycheck under the contract or not reimbursing or paying for the flight home (as per the contract). Our advice is usually to let it go because finding and hiring and paying for a lawyer will likely be difficult and the teacher (just as with the work related problems mentioned above) may well be better off long-term by not making waves.

Pretty routine stuff right? Yes and no and it is the “no” part that is causing me to write this post. The no part is that in the last three months these issues have gone into warp speed. Speaking just for myself, the number of these emails has gone from one or two a month to four to five a day. I have seen at least a ten-fold increase in prison, visa and payment problems for teachers from China (and nowhere else in the world). It has gotten relentless to the point of being depressing. If the emails we are relentlessly receiving are any indication (and they have to be), the following is happening in China in what feels like every minute:

Teachers are being drug tested using their hair samples. Many are testing for cannabis and being jailed for 30 days or more and then being deported. This is happening to newly arrived teachers who insist they did not consume any cannabis since arriving in China. Listen up everybody, cannabis can show up in hair testings up to (and even sometimes beyond) 90 days after you have consumed it. So if you are going to be teaching in China and you do not want to spend time in jail and get deported, please, please, please go at least four months without consuming ANY cannabis before you go there and please, please, please do not consume any cannabis while there. None. Zero. Zilch. 没有. Aucun. Keiner.  PLEASE. Invaribly, the schools use this as a reason not to pay the teacher whatever is owed.

Teachers are being checked (or reported on) for having an improper visa for China. The teachers are then being tossed in jail and then deported or just deported straight away. Invariably, the schools use this as a reason not to pay the teacher whatever is owed. It appears to have become very common (as a cost cutting measure) for schools to have teachers come to China and start their teaching on tourist visas, all the while claiming this is perfectly legal — it isn’t. The teachers believe this until the day they are arrested. Near as I can tell, the schools rarely if ever get in any real trouble for this but the teachers sure do.

Teachers are not getting paid. Just this morning I got an email from one teacher who say that she and another 75+ teachers in her city (from various different schools) have not gotten paid for months. And another email mentioning nine teachers in another city who also have not been paid.  Add to this the pretty much daily emails I get from teachers who do not get their last paycheck or the airfare reimbursements or the bonuses they were promised and it has become clear that it is open season right now against foreign teachers in China. The schools clearly believe they can blow off paying their teachers with impuntiy because they are right. When teachers ask me what they should do about getting paid my response is usually to say that they can retain and pay a local Chinese attorney to try to get paid, but the odds of a foreign teacher prevailing on such a claim are not good and pushing at all hard to get paid can have all sorts of negative ramifications. Schools will pull teacher’s work visas or refuse to assist in moving it to a new employer. They may also seek to have you deported so they can be sure to avoid having to pay wages owed and it is not uncommon for schools to make up claims about their teachers and to threaten to “make sure they will never work in China again.” You therefore need to think long and hard about getting bogged down in these sorts of disputes and even how they might harm your long term career prospects.

From beginning to end, the game is rigged against English teachers in China. The China employment relationship is complicated and if done wrong, employees can and do end up in jail. The only relevant portion of a China employment contract is the Chinese portion and so teachers who do not speak Chinese have no clue what their employment contracts say and no clue even whether the English language portion of that contract accurately translates the Chinese portion — I can tell you right now that the odds are about 100 to 1 that it does not. And even if you are able to read the Chinese portion, unless you have a comprehensive knowledge of China’s employment laws in the specific locale in which you are working. Our China employment lawyers consistently represent high-level China employees in their employment contract negotiations but English teachers simply cannot afford such assistance. This makes them incredibly vulnerable from day one and their employers know this and they don’t hesitate to take advantage of it.

I have reached the conclusion that the best thing an English teacher can to do protect themselves from the sorts of things mentioned above is not to take a teaching job in China in the first place. Go elsewhere. And if you are teaching in China now, leave now or just resign yourself to your fate. I wish I could give better advice than this but I cannot. Sorry.

So how is the above relevant for non-teachers. I’ll tell you. The truth is that many Chinese companies prefer to hire foreigners illegally to legally because doing so can save them a ton of money and is usually pretty low risk — at least for them. So what I describe above regarding teachers is not as uncommon as you would think in other industries. The Global Times article, The detention of two Irish women who were working side jobs at an unlicensed school in Beijing shines a spotlight on the illegal English education market in China is about  two teachers from Ireland who were detained in prison for more than a week for working illegally in China. Both these teachers had visas that allowed them to work full-time in China, but only with their one employer who secured these visas for them. These two teachers had taken lucrative part-time teaching jobs on the side and it was those jobs that got them arrested.

The Global Times article says the big takeaway from what happened to these two teachers is that “employers have no qualms about hiring foreigners illegally” and “when the illegality is discovered, it is the foreign worker who gets the blame.” It then discusses the following “experiment”:

The article talks about someone who “ran an experiment” by applying for every English language teaching job listed in Beijinger Magazine and clearly stating he could not qualify for a work visa. Only one out of the twenty potential employers declined his application! In other words, 19 out of 20 were happy to have this foreigner work for them illegally. The article notes that under  China’s immigration law, foreigners who work illegally in China can be fined 5,000 to 20,000 yuan and detained for between 5-15 days and then deported. “A lot of the burden and blame falls” on the employee who works illegally in China and therefore, as the US Embassy website makes clear, “it is up to each individual to evaluate potential employers before signing a contract.”

And the getting fooled by the English portion of the employment contract happens in all industries too. We discussed this in Dual Language China Contracts: Don’t Get Fooled!

Can’t believe this is still happening, but it does, and in numbers that would likely surprise many people. The “this” to which I am referring is foreign companies signing dual language contracts without knowing exactly what the Chinese language portion of their contract says. This is really risky dangerous and below I explain why.

Many dual language Chinese-English contracts are silent on which language controls. For some unknown reason, foreign companies far too often just assume that the English language portion controls or they just assume that it does not matter because the meaning of both the English and the Chinese portions is exactly the same. Wrong, wrong, wrong.

What language controls when you have a dual-language contract?  If both languages say the same one language controls, that one language will control. If both the English language and the Chinese language portions say the Chinese language portion controls, the Chinese language portion will control. Similarly, if both the Chinese language and the English language portions say the English language portion controls, the English language portion will control. These are the easy and safe examples.

It is everything else that so often cause problems for American and European and Australian companies in  trouble.

If both your English language and your Chinese language portions are silent as to which portion controls, the Chinese language portion will control in Chinese courts and in China arbitrations. In real life this means that if the English language portion of your joint venture contract says that you get 10 percent of the joint venture’s revenue  but the Chinese portion says you get 10 percent of the profits (which will of course be way less than revenues) you will have no legal basis for claiming anything more than 10 percent of the profits. Not surprisingly it is joint venture contracts and licensing agreements where our China lawyers most often see this sort of meaningful dichotomy between the English and the Chinese portions of the contract.

Of the hundreds of dual language contracts proposed by Chinese companies and reviewed by one of my firm’s China attorneys, we’ve never seen a single one where the Chinese portion was less favorable to the Chinese company than the English portion. But we’ve seen plenty where the Chinese portion is better or much better for the Chinese company than the English portion. Chinese companies love using a contract with an English portion that is more favorable to the foreign company than the Chinese portion and then relying on the English speaking company to assume that the English language portion will control.

But what if the English language portion explicitly states that it will control? This works right? Not necessarily. If the Chinese language portion also explicitly states that it will control, the Chinese language portion will control under Chinese law. If the Chinese language portion is silent or says that the English language portion controls, the English language portion will control.

As we noted in China Contracts: Make Them Enforceable Or Don’t Bother, it usually makes sense to draft contracts with Chinese companies in Chinese with an English language translation. But this also requires that if that contract is going to be enforced in China (as should usually be the case), you absolutely positively need to be certain that you know exactly what the Chinese language portion of that contract actually says. No matter what the English language portion of your contract says, it behooves you to know exactly what the Chinese language portion says as well.

In other words, if you are not truly able to read and understand Chinese, you probably do not know what your contact says. And if it is an employment contract that you do not fully understand, you could be putting yourself at serious risk.

Living and working and doing business in China is way more legally complicated than ten years ago and tolerance of foreigners in China (particularly for Americans) is way down. This means that the likelihood of you going astray of Chinese law is considerably higher as well. When you then add in that China’s ability and desire to catch foreign companies and foreigners operating illegally in China is higher now than it has ever been, you can see why it is so critical you make sure that both your company and you are operating in China within the law. If you are not already operating legally, you need to start doing so now and if you cannot, you probably should leave China or not go there at all.  This is the new normal for China. If you are not able to know whether you are in compliance in China and thus protected, you (and your company) would be better off not being there at all, English teacher or otherwise.

International Education: The Emails We Get

A couple years ago we wrote a four part series on establishing an international school in China. In part 1, Establishing International Schools in China: The Basics, we discussed the complications foreign parties typically see when trying to start a school in China. In part 2, Establishing International Schools in China: A Deeper Dive, we focused on what it takes to start a School for the Children of Foreign Workers. In part 3, Establishing International Schools in China: A Deeper Dive (Continued), we discussed Sino-Foreign Cooperative Schools and Chinese Private Schools. In this, my last post in this series, I look at future trends for international schools in China. In Part 4, Establishing International Schools in China – Future Trends, we wrote about some of the distinctive issues foreign schools face in China. Many of our lawyers and staff attended international schools or are sons or daughters of teachers or professors. I spent my junior year of high school at Robert College in Istanbul, a year studying Spanish at LAE Madrid, and 8 months studying French at the Institut de Touraine. All three are amazing schools and these were some of the best years of my life. My father taught English Literature at a liberal arts college for 36 years. Our law firm has a long history of representing universities and international schools on their international legal work, ranging from helping them set up in foreign countries to licensing technology they’ve developed to foreign companies.

Our writings and our legal work and our various international school connections mean we get 10-20 emails every month from people teaching around the world. These emails can roughly be divided into the following four categories:

Visa issues.

Employment contract issues.

Medical and landlord issues.

Starting a school issues.

Recognizing that most of these teachers are not wealthy, our lawyers strive to do their best to give responses that contain actionable advice with the limited time and information we have. The below reflects how we typically handle the four most common categories of foreign teacher emails.

1. Visa Issues. We almost always have to punt on visa issues because our immigration law expertise is mostly limited to business immigration to the United States, with a smattering of additional knowledge gleaned from the transactional work we do in Asia and in Europe. Since none of us have deep immigration law knowledge relevant for foreign teachers our response is usually to urge them to seek out a local immigration lawyer for assistance. I know from my own experience in other countries that there is a veritable ton of bad and outdated immigration law information on the internet and an hour or two with a lawyer who actually knows this area of law can be invaluable. This pretty much true of all aspects of international law. See China Law Online: It’s All Wrong.

2. Employment contract issues . The typical email we get will say something like “I am a teacher in China and I have been fired for taking a day off because my sister came to visit. Can my school do this?” Our response to this sort of email will usually be something like the following — changed quite a bit for brevity and for emphasis:

I have no idea whether your school can or cannot and for us to know we would first need to make sure we do not represent the school at which you worked (because if we did, we could not represent you) and then we would need to read your contract and then compare that as against the local laws and the province’s laws and China’s laws and then maybe speak with the local employment authorities as well. If it does turn out that the school illegally terminated you we would then need to figure out exactly what we can do about that. Likely that would be registering a complaint with the appropriate Chinese governmental body and using that to try to pressure your employer to take you back, which is very unlikely to happen. When you are not taken back we would then need to look into suing the school. If we did sue the school and you won, we might get an order saying the school needs to take you back and we might get some really small amount in damages. Then again we might also lose. Your school may or may not abide by the order.

The problem with the above is that at some point your China visa may be revoked and you will need to leave China. And win or lose, you challenging this school may lead to you never getting a job in China again and going through the above will be time consuming and expensive.

3. Medical and landlord issues. These emails often come down to money. “The hospital wants $400” or my “landlord wants to raise rent by $100 a month.” As a father, my responses to these are usually nine parts paternalistic, one part legal.

4. Starting a school issues. The typical email will come from someone who has been teaching English in China or in Vietnam or in Poland or wherever and they now want to know what it will take for them to start a school in one of these countries. The below interaction is an amalgamation and it is typical:

English Teacher: We would like to open a school for foreign students _________. There is a small but growing group of foreign parents in the city looking for foreign education options for their children.

We are unlikely to get the enrollment needed to have our own campus. Can we legally share school grounds with a local primary school (public/private) if our students do not follow the Chinese curriculum? If we can’t, then I guess we are out of luck.

My second question concerns whether your law firm could handle the process, assuming it is feasible and how much it would cost.

Our response: We have helped set up many foreign school companies in China but we’ve never dealt with your question on sharing space in [China fourth tier city]. My guess is that you can share facilities with the local school, but only if your school has its own separate address. I say this because most cities require you have your own address for any WFOE (the company we would need to set up to own and operate youor school), but things like this tend to be very local.

As for how much this will cost, I would estimate it will cost at least $30,000. This estimate would be for our China lawyers and China business specialists (all of whom have substantial experience in setting up foreign schools throughout China) to research and figure out what you can and cannot do, form the company, secure various governmental approvals, register your trade names and logos, help on the lease and other agreements with the entity that owns the existing facility, draft your employee contracts and your employer rules and regulations, and the various other legal matters that invariably arise when starting a school company in China, including all sorts of discussions with local government officials.

If – as it sounds – the ability to use the facility will make or break this deal, I would propose we start by figuring out whether that is or is not possible. We would do that by researching the applicable laws and then by confirming with the local authorities that our reading of the laws corresponds with theirs. If you can tell us more about the potential space we can get back to you with an estimate for our handling this discrete issue.

If you have any additional questions, please don’t hesitate.

Pretty much every time we then get something back from the teacher saying that the costs and/or the complications are more than they expected and they will need to re-think.

As much as I dislike being the one to hit them with reality, I take comfort from believing it is better they get the truth than to have them waste time and money on a project they are will not finish.
