The Patent Eligibility Restoration Act, S. 2140, (PERA), sponsored by Senators Thom Tillis (R-NC) and Chris Coons (D-DE) would be a huge gift to patent trolls, a few tech firms that aggressively license patents, and patent lawyers. For everyone else, it will be a huge loss. That’s why we’re opposing it, and asking our supporters to speak out as well. 
Patent trolling is still a huge, multi-billion dollar problem that’s especially painful for small businesses and everyday internet users. But, in the last decade, we’ve made modest progress placing limits on patent trolling. The Supreme Court’s 2014 decision in Alice v. CLS Bank barred patents that were nothing more than abstract ideas with computer jargon added in. Using the Alice test, federal courts have kicked out a rogue’s gallery of hundreds of the worst patents. 
Under Alice’s clear rules, courts threw out ridiculous patents on “matchmaking”, online picture menus, scavenger hunts, and online photo contests. As a consequence, companies were able to monopolize diagnostic tests that relied on naturally occurring genes in order to help predict diseases such as breast cancer, making such testing far more expensive. The ACLU teamed up with doctors to confront this horrific practice, and sued. That lawsuit led to a historic victory in 2013 when the Supreme Court disallowed patents on human genes found in nature. 
If PERA passes, it will explicitly overturn that ruling, allowing human genes to be patented once again. ...
“To See Your Own Blood, Your Own Genes”
From the 1980s until the 2013 Myriad decision, the U.S. Patent and Trademark Office granted patents on human genomic sequences. If researchers “isolated” the gene—a necessary part of analysis—they would then get a patent that described isolating, or purified, as a human process, and insist they weren’t getting a patent on the natural world itself.
But this concept of patenting an “isolated” gene was simply a word game, and a distinction without a difference. With the genetic patent in hand, the patent-holder could demand royalty payments from any kind of test or treatment involving that gene. And that’s exactly what Myriad Genetic did when they patented the BRCA1 and BRCA2 gene sequences, which are important indicators for the prevalence of breast or ovarian cancer. 
Myriad’s patents significantly increased the cost of those tests to U.S. patients. The company even sent some doctors cease and desist letters, saying the doctors could not perform simple tests on their own patients—even looking at the gene sequences without Myriad’s permission would constitute patent infringement. 
This behavior caused pathologists, scientists, and patients to band together with ACLU lawyers and challenge Myriad’s patents. They litigated all the way to the Supreme Court, and won. “A naturally occurring DNA segment is a product of nature and not patent eligible merely because it has been isolated,” the Supreme Court stated in Association for Molecular Pathology v. Myriad Genetics. 
A practice like granting and enforcing patents on human genes should truly be left in the dustbin of history. It’s shocking that pro-patent lobbyists have convinced these Senators to introduce legislation seeking to reinstate such patents. Last month, the President of the College of American Pathologists published an op-ed reminding lawmakers and the public about the danger of patenting the human genome, calling gene patents “dangerous to the public welfare.”

Never buy a 6 decades old stuffed animal filled with dirt… best mistake of my life

I’ve wanted a rubber faced doll ever since I discovered them back when I was in middle school. Their cute, slightly creepy appearance and interesting faces have always inspired and intrigued me. However, I had never had the chance to own one until now. Heck, before getting Rosy, I had never even seen one irl! I had only seen images of them online so I didn’t have any idea what to expect. How did their fabric and rubber faces feel? She wasn’t one of the famous Rushton star creation toys but that was fine with me since she was one of the cutest ones I had ever seen.
When she arrived, I opened the box and upon seeing her I flinched. Idk !! It’s kinda jarring seeing one of these creatures irl for the first time, I picked her up and upon further inspection she was EXTREMELY dusty/dirty. The listing did NOT show this or say anything warning about it in the description. Here is what she looked like upon arrival. The clean spot on her face in the second photo is where I passed my finger.

It was terrible, I knew she needed a nice wash. I thought maybe she was just a bit dusty… oh boy was I wrong. I decided to unstitch the seam on her back and remove the stuffing, this was the single most important step of the process because nothing could’ve prepared me for what happened next. THIS was what was inside when I opened her up:

Up until now, I still have no idea what this stuff was or is but she was totally full of it. Perhaps whatever was inside her had totally decomposed, but I don’t know what or how this could’ve happened. It was like DIRT or sand, or something. It was dark and very thin in texture. One of my friends said it looked like human ashes, which I hope was not the case. I doubt it though, since it was even lodged into her ears (her ears are hollow inside), while it’s possible that she could’ve been tampered with because the stitches on the back of her head were extremely sloppy and visible, some other images of these bunnies sometimes had similar stitching. It could’ve been anything really. Obviously I used a mask and gloves while removing this. I even made sure to turn her body totally inside out to make sure ALL of it was gone.

After that, I proceeded to give her a nice hand wash and brushed out her fur. You may notice a patch of it is missing near her arm but that was always there, it just wasn’t visible in the first image but the listing photos did show this. Then I set her to air dry on a hanger. I would recommend against this though since I believe her mid section was slightly stained by it when her pink back fur was pressed against the white on the front. The next day after I got home from school she was dry. I went out and got some new stuffing for her and stitched her back up. Here she is nice and new with a few other plush friends ! I decided to give her a little bow too.

Overall I’m super happy with how this restoration turned out, Rosy is absolutely perfect now! She is everything I could’ve wanted in a rubber faced doll. I’m still getting used to her presence but she makes me very happy and I feel like I did her a great service by restoring her and giving her a new loving home ^_^

The Russian Armed Forces carried out a massive attack on civilian infrastructure throughout Ukraine on Monday, using various types of missiles and combat drones. The attack began shortly after midnight and lasted throughout the night and morning. According to maps of missile and drone movements published by Ukrainian media, the strikes targeted regions in western, eastern, and central Ukraine. The air raid alert in Kyiv continued for about eight hours and later resumed briefly to warn residents of possible renewed drone attacks.
The attack targeted Ukraine’s energy infrastructure, according to Energy Minister Herman Halushchenko. Writing on Facebook, he said that Russia “has not abandoned its plans to deprive Ukraine of electricity” and that emergency power outages had been implemented across Ukraine. “The situation is difficult and the effects of the attack are still being assessed. Energy workers are working to restore the damage,” Halushchenko reported. Altogether, Russian attacks affected 15 of Ukraine’s regions and damaged energy infrastructure in several of them, according to Prime Minister Denys Shmyhal.
According to reports from regional authorities, energy facilities and other infrastructure were damaged in the Volyn, Dnipropetrovsk, Zaporizhzhia, Zhytomyr, Kyiv, Lviv, Rivne, Vinnytsia, Odesa, and Ivano-Frankivsk regions.
Two energy facilities were damaged in the Kyiv region, according to the Ukrainian authorities. One of them was the Kyiv Hydroelectric Power Plant in Vyshhorod, just kilometers from the capital. According to the Ukrainian news agency UNIAN, the dam’s roadway and the power station’s engine room were affected. Local official Serhiy Knyzhnykov reported that traffic across the dam in both directions was blocked.
Andriy Kovalenko, the head of Ukraine's Center for Countering Disinformation, reported that the dam itself was not under threat. “It’s impossible for it to be destroyed with missiles,” he wrote on Telegram.
A video circulating online that was reportedly filmed near the Kyiv Hydroelectric Power Plant appears to show a missile landing in the water of the Kyiv Reservoir.
Multiple residential buildings came under fire. Authorities in Kyiv reported that Russia’s attack damaged high-rise apartment buildings and private homes, as well as railway facilities, vehicles, warehouses, and other civilian structures. In the Poltava region, an industrial facility was reportedly hit.
In the city of Lutsk in the Volyn region, an apartment building was struck by a Russian drone.
Ukraine’s State Emergency Service published photos of the aftermath of the drone strike.
Multiple civilians were killed and dozens were injured in Russia’s attacks. According to reports from regional authorities, one civilian was killed in the Volyn region; one was killed in the Dnipropetrovsk region; one was killed in the Zaporizhzhia region; one was killed in the Zhytomyr region; and one was killed in the Kharkiv region. Five people were injured in both the Volyn and Poltava regions, four were injured in the Odesa region, and three were injured in both the Mykolaiv and Ivano-Frankivsk regions. The State Emergency Service has not yet published overall figures on the number of casualties from the attack, but Ukrainian President Volodymyr Zelensky reported that “dozens” of people were injured.
Monday’s attack was one of the largest combined assaults against Ukraine since the start of the full-scale war, Zelensky said. According to the president, Russian troops used more than 100 missiles of various types and approximately 100 Shahed combat drones. On Monday evening, Ukrainian Air Force Commander Mykola Oleshchuk reported that Russian troops fired 127 missiles, including three Kinzhal missiles, 77 Kh-101 missiles, 28 Kalibr cruise missiles, three Kh-22 missiles, and three Kh-59/Kh-69 guided aircraft missiles, as well as 109 Shahed combat drones. He said Ukrainian air defense forces shot down 102 missiles an 99 drones, and that two drones crossed into Belarus.
Commenting on Monday’s attacks, Volodymyr Zelensky called Russian President Vladimir Putin a “sick creature.” Zelensky’s addressed the Ukrainian people in a video statement:
Putin remains true to himself. He’s a sick creature — that’s long been clear to everyone. But what’s no less clear is that he can only do what the world allows him to do. Weakness and insufficient responses only feed terrorism. And every leader, every one of our partners, knows what strong actions are needed to end this war and end it justly. Ukraine can’t have weapon range restrictions when the terrorists face no such restrictions. The defenders of life cannot have limitations on their weaponry while Russia uses all kinds of weapons, including [Iranian-made] Shahed drones and ballistic missiles from North Korea. The U.S., Great Britain, France, and other partners have the power to help us stop terrorism. We need decisions.
In the course of Russia’s attack, an unidentified object entered Poland’s airspace and appears to have crashed on Polish territory, Poland’s Armed Forces General Command reported, according to Radio Liberty. The object, which is suspected to be a missile or drone, crossed Poland’s air border near the Ukrainian city of Chervonohrad in the Lviv region and disappeared from radar screens after traveling 25 kilometers (15 miles) over Polish territory. Search operations are underway.
The Russian Defense Ministry reported that Russian troops targeted energy facilities that support Ukraine’s defense industry. During a press briefing, a ministry spokesperson told reporters that Russian forces “carried out a massive attack using precision weapons” on critical energy infrastructure.
According to the Russian authorities, the attack’s targets included electrical substations in the Kyiv, Vinnytsia, Zhytomyr, Khmelnytskyi, Dnipropetrovsk, Poltava, Mykolaiv, Kirovohrad, and Odesa regions. The Defense Ministry also said it hit gas compressor plants in the Lviv, Ivano-Frankivsk, and Kharkiv regions that support Ukraine’s gas transportation system. It also said it targeted airfields in the Kyiv and Dnipropetrovsk regions, where “aircraft weapons” supplied to Ukraine by Western countries were stored.
“All designated targets have been hit, resulting in power outages and disruptions to the transport of weapons and ammunition to the front line,” Russia’s Defense Ministry said.
Russian State Duma Defense Committee chairman Andrey Kartapolov said that Monday’s attack was a response to the Ukrainian military’s offensive in Russia’s Kursk region. “There will be more to come,” he said.
Kyiv will prepare a response to Russia’s attack, Ukrainian Defense Minister Rustem Umerov said. “Last night, Russia attacked our cities once again. Civilians were injured, homes were destroyed, and critical infrastructure was damaged. This proves yet again that to achieve victory, we need long-range capabilities and the removal of restrictions on strikes against enemy military targets. Ukraine is preparing its response. Using our own weapons,” he wrote on Facebook.

Lina Khan Gets It Wrong (Again)

60 Minutes recently aired an interview with Federal Trade Commission (FTC) Chair Lina Khan conducted by veteran reporter Lesley Stahl. This may have been the first time in their 58-year history that 60 Minutes has profiled an FTC chair, but Lina Khan is not the “typical” FTC chair.
President Joe Biden picked Lina Khan to head the FTC because she is a (maybe the) leading advocate for “neo-Brandeisians.” Named for former Supreme Court Justice (and progressive icon) Louis Brandeis, this movement seeks to restore the “big is de facto bad” approach that dominated antitrust from the passage of the first antitrust laws in the 1890s until the Ronald Reagan administration. The “big is de facto bad” approach was displaced by the consumer welfare standard, which focuses on how businesses’ actions affect consumers.
Stahl questioned Khan about concerns that when government prevents companies from merging, they deprive them of the ability to use economies of scale to lower prices. Khan said, “Even if those efficiencies arise, if the companies are not checked by competition, it won’t have an incentive to pass those benefits on to the consumer because those consumers may not have anywhere else to go.” Khan and her progressive allies fail to consider the history of businesses that believed their position as leader of the market was so untouchable that they could abuse their customers with high prices, poor customer service, and a refusal to adapt to compete with new and innovative competitors.
An example of a seemingly untouchable market leader that failed to “keep up with the times” is Borders Books. Borders’ failure to see the potential in online retail caused the company to lose many customers (and eventually go bankrupt) to an online book retailer that started as one man selling books in a rented warehouse. That company was Amazon.
Khan acknowledged concerns that her aggressive approach to antitrust could make companies reluctant to engage in beneficial mergers or acquisitions because they fear that the time and money they will have to spend justifying the merger to the government will make the transaction unprofitable. However, Khan says those concerns must be balanced by the risk that businesses could grow so big and act so recklessly they could crash the entire economy. This concern ignores the fact that the only case of big business recklessness causing an economy wide meltdown was the subprime crisis of 2007-2008, which was the result of government intervention in the housing market, not “unbridled capitalism.”

If you have voted in New York before, you do not need to bring an official photo ID. However, if this is your first time voting in New York, and you registered to vote online or by mail and did *not* provide an official form of ID during registration (such as a NY driver's license NY non-driver ID number, Social Security number, or a copy of your ID), you will need to bring an official form of ID to the polls. Examples of official ID include:
A current and valid photo ID such as a driver's license or passport, OR
A copy of a current utility bill, bank statement, government check, paycheck, or other government document that shows your name and address.
If you are a first time voter and are unable to provide a form of ID, you will be able to vote using an affidavit ballot.
You can wear apparel that includes general political viewpoints, unless the issue is on the ballot.
You can’t wear anything that encourages people to vote a certain way.
You can’t electioneer within 100 feet of a polling site. Electioneering is defined as “efforts to encourage voters to vote a certain way and includes distributing, wearing or carrying political literature, posters, banners or buttons or soliciting votes.”
In New York state, but NOT New York City, you can take a photo at a polling site or with a blank ballot.
You can’t take a photo of or with your completed ballot.
You can make calls or texts as long as you’re not being disruptive or invading the privacy of other voters or poll workers.
You can have someone who provides assistance enter the voting booth with you.
If you are disabled, you have the right to assistance in voting from a person of your choice, who can be a friend, family member, or poll worker (but not your boss, union agent, or a candidate unless this person is your family member). You are also allowed to bring your service animal to the polls.
You can’t remove a ballot from a polling site before the polls close.
You can’t open the door or enter a voting booth occupied by another voter.
The only legal reasons for being turned away at the polls are:
If you are not a US citizen
If you are a felon whose voting rights have not been restored
If you do not live in that voting precinct, or
If you are not registered to vote (please note that New York does not have same-day voter registration).
If you are turned away at the polls for any other reason, ask verbatim for "a provisional ballot with receipt, as required by law".

MAKATI, NATIONAL CAPITAL REGION -- A serious mobile service disruption took place last Wednesday night (September 18th, 2024), impacting all Smart Communications subscribers in the Luzon area. The outage started before 8pm (Manila local time) and caused a complete loss of mobile data, signal, SMS texts and one-time pins (OTPs) for e-wallets like GCash, Maya and Coins.PH. There were also indications of similar problems in Cebu and potential disruptions here in Dumaguete City and Negros Oriental.
Almost 3,500 users have reported experiencing service problems accessing 'Smart Communications' with 81% indicating experiencing complete service failure on the outage reporting website 'DownDetector'. The National Telecommunications Commission (NTC), a government regulatory board issued a memorandum for this said telco giant explaining such disruptions and restoring the service for both prepaid and postpaid users.
Netizens are extremely annoyed because of the blackout that caused all of Luzon. On the other hand, some local residents in the Visayas and Mindanao are not as likely to worry about a nationwide telco blackout. The day after on Thursday (September 19th), Smart Communications also announced that the issues had already been fixed, and things were back to normal as before.
The company publicly apologized for the inconvenience caused by the lack of service resources and customer support during the blackout. OneNETnews has yet to reached out for a comment.

I’ve never kept a diary, but I guess if I had, the entry for today would run something like this… September 5, 2024. It is summer again. Did summer actually ever leave? 21C and not a cloud in sight (teeny fib, the late afternoon turned hazy, but still warm). Shorts and T-shirt. Short socks in sneakers :D No response from real estate agent on web query. Wrote direct email re next possible viewing. Yay, a fast response! Viewing planned for today. In two hours time… find bus route and get there on time. Arrived on time, no agent in sight. Wait. Wait. Ah, eff it, I take a stroll around the property to get my bearings and make use of MY TIME! Apple trees, red and blackcurrant bushes. Nice. Pick up Newtonian apple (allowed!). Take a bite. Soft… pick a few red and blacks (don’t tell!). WHERE IS THE EFFIN AGENT??????? call agent. Auto response: can’t talk right now. What? Text agent: where are you, I’m here!!!! Out of town? Misunderstanding? Oh. Well yeah you didn’t spell that word right did you, but I also did not read that word properly. Next week you say. Okay. Fuck. (sneaks off the property hoping no one saw me). Now what? Stroll down the high street. Check out the local shops and dining places. Quaint, my final verdict of this village. Check bus time table, last bus an hour away. Hungry. Take aim at the local pizza place. 45 minutes later I roll out of the pizza place, one calzone and a beer lining my stomach. Buy orange fizz for desert (why? There wasn’t any coke!). The text to mum contains too many expletives to mention, but how the fuck can EON (electricity company) be allowed to run planned maintenance without telling their customers. Getting annoyed. Write complaint email to EON using even more colourful language. Press send. Feel no remorse. Fuck. (#3) I was supposed to enlist in the next uni course today. Today. The last day. But the power is off… I can access the computer with all the docs. Fuck (#3 still echoing in my head). Get phone out. 30% battery left. Might just work… Log on to Uni. Select course. Enlist. Proceed. Sorry? What? The online system can’t determine how much I’m supposed to pay cuz I’ve moved… BUT I DONT NEED TO PAY TODAY!!!!!! Contact Uni using web form. Write long explanations but try to ignore the frustration from the power fucking company idiot still bouncing in my head. Press send. Get automated reply immediately. Okay, that seemed to have gone to the wrong department. Try again. Contact student support. Sigh. Repeat the same info, adding a few extras and further queries. Press send. Fuck it. Walk to fridge. Open door. Get beer. Drink beer. Sigh. Gawd, I just feel the urge to whinge, into the void where no one can hear me. Huh, I know — Tumblr.

For most of his life, my dad researched numerous local trolley systems in smaller Midwestern towns and cities. He was a rail fan and obsessed with it, and I had no idea how many there were.
Online the rail fan community called him the Professor, and he regularly drew cartographically-accurate maps for folks publishing articles about these trolley systems.
He railed regularly about how the automobile industry and gas industries had teamed up to gut or destroy these lines so people would be forced to buy cars. It was a targeted campaign. There are entirely communities of people who focus on this subject.
Unfortunately, many of them are aging. My dad, before his death, was bequeathed several collections by fellow rail fans, and knew others had been trashed because the family didn’t know what they had. Dad was an archivist and a hoarder. His specific areas of expertise was electric railways, trolleys, and interurban lines.
Fortunately, we knew of his work and he had arranged in his will for his collection to be donated to a rail museum, where it’s being sorted and digitized by volunteers who are thrilled by his copious notes accompanying each artifact, often where, when, time of day the photo was taken, what rail line it was, and even what specific trolley was being photographed, sometimes including manufacturing information.
Dad would go on vacation JUST to take pictures of trains. He also dumpster dived at railroads to save memorabilia.
If he hadn’t passed 6 years ago, I would’ve sent him this post to have fun with and I’m sure he’d have written a very educational essay for all of you, but I only have a surface level understanding of his knowledge.
Some older trolley cars from various small lines survived in various conditions in small to large railroad museums across the country. Many are being restored and brought back into service where trolley lines have been brought back.
It’s kind of nice to be able to write this just before Fathers Day in his honor.

DUMAGUETE, NEGROS ORIENTAL -- Around last Thursday night (April 27th, 2023 -- Dumaguete local time), a widespread power outage occurred in Central and Western Visayas, affecting thousands of homes and businesses. Outages lasting several hours were caused by power distribution problems, specifically between the red and yellow warning alerts.
One of the affected distribution utilities was the Negros Oriental Electric Cooperatives 1 & 2 (NORECO I & II), which was first posted on social media that it experienced multiple trippings and power interruptions due to the high demand for electricity during the excess searing summer heat. Other distribution utilities, such as Panay Electric Company (PECO) and Guimaras Electric Cooperative (GUIMELCO) have also reported various power outages in their service areas. Some areas experienced complete blackouts, while others had a partial power loss.
Social media users expressed their annoyance and concern about the prolonged blackout, which made the situation worse. Many other people in the Visayas region forcing to dissatisfaction with lack of communication from its authorities, and the slow critical response in all of electrical power companies.
Local media reports and newspaper outlets that the power outages was caused by the national grid's inability to handle a higher demand for electricity in every cooperative franchises. The Department of Energy (DOE) claims that the constrained power supply was also caused by power plants in the area producing shortages than projected. Despite the government's efforts to conserve and save electricity, certain parts of it remain grappling with power outages. Photos and videos that have gone viral online show businesses and residential homes with no power, and residents resorting to use candles and flashlights.
Many netizens have criticized the National Grid Corporation of the Philippines (NGCP) and other government agencies, saying they were not prepared for the blackout despite the DOE's warning.
Both regions have urged the Philippine government to act fast to address the problem and preventing it from happening all over again. In response, the NGCP released a statement highlighting that they have been working to address the aforesaid power outage and ensuring that the electrical companies can fully restore power to the affected areas. In addition, companies also assured the public that they are doing everything they can to prevent future blackouts, regardless of comparable weather conditions in the past seasons.
Alvin Elchico, who is a veteran journalist and weekend news anchor of TV Patrol; and Rose Marie Chris Dalaguit, who's also a former radio reporter of DYAB-TV's Teleradyo: Cebu that has criticized the government and power distributors for not doing more to prevent the said power outage. The extremist situation was a "brazen landslide flop" and urged Philippine President named Ferdinand "Bongbong" Romualdez Marcos Jr. to revoke all electrical franchises if the blackouts persists in the Visayas region continues.
As of this exclusive writing, there have been no official announcements from the government regarding both journalists' call to action. The DOE has yet to release an official report detailing the cause of the power outage and its impact on their affected areas.
