NEW YORK (AP) — Montana Gov. Greg Gianforte on Wednesday signed into law a first-of-its kind bill that makes it illegal for TikTok to operate in the state, setting up a potential legal fight with the company amid a litany of questions over whether the state can even enforce the law.
The new rules in Montana will have more far-reaching effects than TikTok bans already in place on government-issued devices in nearly half the states and the U.S. federal government. There are 200,000 TikTok users in Montana as well as 6,000 businesses that use the video-sharing platform, according to company spokesperson Jamal Brown.
Here’s what you need to know:
WHY IS MONTANA BANNING TIKTOK?
Proponents of the law in Montana claim the Chinese government could harvest U.S. user data from TikTok and use the platform to push pro-Beijing misinformation or messages to the public.
That mirrors arguments made by a bipartisan group of lawmakers in the U.S. Senate, as well as the heads of the FBI and the CIA, all of whom have said TikTok could pose a national security threat because its Beijing-based parent company ByteDance operates under Chinese law.
Critics have pointed to China’s 2017 national intelligence law that compels companies to cooperate with the country’s governments for state intelligence work. Another Chinese law, implemented in 2014, has similar mandates.
TikTok says it has never been asked to hand over its data, and it wouldn’t do so if asked.
HOW DOES MONTANA PLAN TO BAN TIKTOK?
The law will prohibit downloads of TikTok in the state and fine any “entity” — an app store or TikTok — $10,000 per day for each time someone accesses TikTok, “is offered the ability” to access it, or downloads it.
That means Apple and Google, which operate app stores on Apple and Android devices, would be liable for any violations. Penalties would not apply to users.
The statewide ban won't take effect until January 2024. It would be void if the social media platform is sold to a company that is not based in "any country designated as a foreign adversary” by the federal government.
The governor indicated he wants to expand the bill to other social media apps in order to address some of the bill’s “technical and legal concerns.” But the legislature adjourned before sending him the bill, which meant he couldn’t offer his amendments.
Montana Attorney General Austin Knudsen has pointed to technology used to restrict online sports gambling apps as a way to curtail TikTok from operating in the state. Those violations can be reported by anyone. And once the state verifies a breach has taken place, it sends a cease-and-desist letter to the company involved, said Kyler Nerison, a spokesperson for Knudsen's office. He said different companies use different methods for compliance and it's up to them “to not allow their apps to work in Montana and other states where they are not legal.”
SO, COULD THE TIKTOK BAN WORK?
Cybersecurity experts say that, other than avoiding the fine, there's nothing incentivizing the companies involved to comply and it will be extremely difficult — if not impossible — to adequately enforce the law.
For one, the U.S. doesn't have anything equivalent to the type of control countries like China have on what their citizens access on the web. Compounding that, internet service providers are out of the picture.
Before the Montana law passed, lawmakers rewrote portions of the bill to let them off the hook after a lobbyist for AT&T said during a February hearing the legislation was “not workable” to put into effect.
COULD TECH COMPANIES BLOCK IT?
Apple and Google have not spoken out against the law. But a representative for TechNet, the trade group that counts the two tech giants as its members, has said app stores don’t have the ability to “geofence” apps in different states and it would be impossible to prevent TikTok from being downloaded in Montana. The group has also said the responsibility should be on an app to determine where it can operate, not an app store.
Telecoms analyst Roger Entner, of Recon Analytics, says he believes the app stores could have the capability to enforce the law, but it would be cumbersome to implement and full of loopholes. Apple and Google’s address-linked billing could be bypassed with prepaid cards and IP geolocation easily masked by using a VPN service, which can alter IP addresses and allows users to evade content restrictions, said mobile security expert Will Strafach, the founder of Guardian, which makes a privacy protection app for Apple devices.
Oded Vanunu, head of products vulnerability research at the cybersecurity firm Check Point, agreed it would be difficult for app stores to isolate a single state from downloading an app. He suggested it would be more feasible for TikTok to comply since it controls the software and can “adjust the settings based on the geographical location or IP addresses" of users.
COULD TIKTOK BLOCK ITSELF?
When users allow TikTok to collect their location information, it can track a person to at least 3 square kilometers (1.16 square miles) from their actual location. If that feature is disabled, TikTok can still collect approximate location information - such as the region, city or zip code in which a user may be located - based on device or network information, like an IP address.
But similar to the app stores, cybersecurity experts note that any enforcement measures the company implements could be easily bypassed with a VPN and efforts to use IP geolocating might lead to other issues.
David Choffnes, the executive director of the Cybersecurity and Privacy Institute at Northeastern University, said cell providers may use the same types of IP addresses for multiple states, which could mean someone who is not in Montana could incorrectly be blocked from using TikTok.
WHAT'S GOING TO HAPPEN NEXT?
Likely a legal battle.
Knudsen, Montana's attorney general, has already said he expects the law will end up in court.
TikTok spokesperson Brooke Oberwetter said in a prepared statement Wednesday that the law infringes on Montanan's free speech rights and is unlawful.
“We want to reassure Montanans that they can continue using TikTok to express themselves, earn a living, and find community as we continue working to defend the rights of our users inside and outside of Montana,” Oberwetter said.
Oberwetter declined to say if the company will file a lawsuit but described some of the legal issues at play. She argued Montana is attempting to override U.S. foreign policy by claiming the bill addresses a national security risk. She said foreign policy and national security laws are not made at the state level.
NetChoice, a trade group that represents TikTok and other tech companies, says the bill would violate the First Amendment and “bill of attainder” laws that prohibit the government from imposing a punishment on a specific entity without a formal trial.

Okay, do they any proof of this? Like, Google sucks, but also..

The most recent article I could find about Google purchasing a streaming company is in 2011. Google TV was in 2010. There are no signs of these companies becoming much of anything at the present time.
There’s no screenshots of the actual terms and conditions, the Tiktok OP spends most of the video telling you how to get off Google or telling this elaborate story about Google buying a streaming company that they haven’t bought and show no interest in buying. There’s no evidence for why people should panic, at least more than the general panic we probably need around AI in general.
There’s no evidence that this “poison pill” exists and I’ve looked over the terms and conditions (yes, terms and conditions are legendary and nightmarish, but you can take it bit by bit and break it down)
I’ve had a long, miserable day because of this TikTok and its impact on my social circle, but I haven’t seen anything to prove that Google has been doing this to my Drive. The tiktok users spends most of the video assuming that Google is already doing this to Drive, ignoring the conflict with companies who hold private data there and the fact they’d probably get their asses sued off.
If this person has credentials of some kind, or produces a video with screenshots that corroborate their claims. 
I understand the concern, I really do, but I need more proof. A tiktok user’s willingness to bet good money is not enough.

OP has proved elsewhere that Google Labs will might scrape your data if given the opportunity, but they have also proved it is currently opt-in and there is no proof that this is about to change secretly change, possibly due to the legal risk under discussion and the Zoom controversy (which people had forewarning about).
I feel like a corporate bootlicker even saying this, but there is. no. proof. The Tiktok does not provide proof of these issues.
Could Google be lying? They could be. But usually if they were going to slip it into the terms and conditions, they would have. Google is being shitstains about AI, but it's limited to public data, it has to be, unless they want to mess with big copyright companies (at least, that's my understanding). Be very careful about who you allow access to shit ("anyone can have this link" is most likely no longer your friend) but there's no evidence here of anything worse.
I’ve spent a long, frazzling day collecting these resources (which I encourage people to explore more) about the issue. Google is definitely using AI to fuck us on the search engines, but they don’t need to fuck us in drive, specifically, when the whole system is a mess. I don't want to be fucked over and have my writing stolen, and to do that I need to know what's going on.
I might be wrong, but I’ve been looking for sources, and I encourage everyone to do the same.
The question is, of course, what counts as "public" and here I get OP's concern. There are issues, I won't lie, there is currently a lawsuit, but this is based off of more wide-spread issues of content theft. Google Drive specifically is not mentioned, this is an issue that has already been discussed with AO3 and other content sources that are more public.

TL;DW though is that hidden in the Terms and Conditions for Google's AI Labs is a nice little poison pill that says they get access to your entire Google Drive if you opt in.
So if you're an author of some type and you keep your unpublished works in your G-Drive that means an AI will get to scrape all of it and by opting in you will have given them permission to it. The content creator goes on to predict that Google is going to let out their own streaming service where the scripts, and potentially the art if it's animated, will be almost or entirely AI generated using that scraped data as a baseline and the authors/artist's who's work was essentially stolen in its most raw form to crib from will have zero way of fighting Google on that in our current legal system.
This is of course right in the middle of the writers and actors strike where we're seeing just what lengths studios will go to in order to screw everyone but themselves.
They go on to recommend that if you keep any creative or personal works on Google Drive that you pull it off as soon as possible and delete your entire Drive. They acknowledge that of course this doesn't mean Google really deleted the data but if you do it before they start compulsory opting everyone in there's a chance your work might get overlooked. They also recommend several free editing programs that aren't run by corporations like Google with LibreOffice (the default office program of most Linux distros) being named.
Finally they go over methods of shaming Google which I feel like you just have to watch for comedies sake so I won't describe them in full.
Now this is from me: I know the majority of people don't have the ability to build and manage a big archive just for themselves, but if you're a creative NOW IS THE TIME to educate yourself on what you can do to protect your works. Cloud storage was always iffy at best, but with AI scraping entering the mix it's now downright malignant. Get a bunch of thumb drives, buy some external hard drives, if you have the money buy a pre-built NAS, and if you really want to get into learn how to build your own NAS. These are the old ways before cloud and they're coming back again, more important than ever.

I was on the phone with my moms the other day talking to them about this. We were talking about how quickly the memory can move once dramatic strides have been made, and how it can be easy to pass on the broadstrokes of systemic oppression rather than the fine print when helping the new generation learn what they're looking for.
One of the things my mom pointed out is that part of how same sex marriage was made nationally accessible in the USA depended on was the Full Faith and Credit Clause of the constitution. This clause essentially states that any state within the federation is entitled to have their legal system's output (e.g. a marriage license) recognized and validated by any other state in the federation.
Mom reminded me that when we lived in [redacted 1] the state neither offered its own same sex marriage NOR recognized the validity of my mom and her wife's [redacted 2] state marriage license. So when [redacted 1] offered a domestic partnership pathway to legal family unit recognition, Mom and her (again, legally married by a justice of the peace in a [redacted 2] state courthouse) wife were there with the rest of the crowd first thing the next morning to sign their papers.
For a while, this tomfoolery gave my mom, a student in the art of civil disobedience and the use of malicious compliance with the law to draw attention to unjust legislative procedure, the idea to get RE-married to her wife in every state that made same sex marriage legal. She managed it twice! But on her third try, she was stymied by the state simultaneously legalizing its own same sex marriage procedures, and requiring legal recognition of out of state ones, and even tho it technically wasn't bigamy since she was trying to marry the same wife again, [redacted 3] still wouldn't let her. And shortly thereafter, the national rulings on same-sex marriage enforced legal recognition of her marriage license across states.
My mom pointed out, that technically, overturning same-sex marriage is as simple (and as catestrophic) as doing away with the Full Faith and Credit Clause's persistence in the modern day, a court precedent which would undermine vast swaths of civil rights legislative work acheived over the past few decades and reinforce the old "states rights" argument enough to put many more in real jeopardy.
My mom reminded me about the conversations we used to have, how the work is never really done, but we often lose people after every major legislative victory who have decided it is. About how the battlelines are constantly being redrawn and the talking points evolved, and fighting back means never fully buying into the premises set out by them, because doing so can make us vulnerable when the premise inevitably changes.
Most importantly, she reminded me that anyone selling you on "the one thing you HAVE to do to fix this!!!" is a snake oil salesman or a fool, and if you don't want to join them, you need to keep your tactics diverse. Mom's specialty, for many reasons, was showing up places as a loud and educated white woman to Cause Problems in plausibly deniable ways. She is (at times distressingly) talented and skilled at this. But she also worked with friends whose specialty was, and I quote, "taking abusive partners for a ride they wouldn't come back from", friends whose specialty was "we can get food and medication you need for little to no actual cost to you, just tell us what it's for and DON'T ASK QUESTIONS", and friends whose specialty was "I am a literal nun, and my roommate from the convent over there has a video camera rolling, lets see what choices you feel jazzed about making right now."
Basically, the people who don't want you to have rights feel justified wielding any number of different tools to get to that outcome. And it's important for those of us who consider ourselves resistant understand what kind of resistamce we are both effective at and comfortable with performing, while encouraging others to do the same, ESPECIALLY if they are likely to have different efficacies or comfort zones than we do.
Anyway, yesterday was [one of] the anniversary of the day my family became a family when I was growing up. It's was 2006 and my mom had just had a year long chronic pancreatitis issue that had her in and out of hospital and nearly dead a handful of times. Each time, my mom's [not then legal] wife would call the ambulance and stay with me, and would then have to leave me along for what felt like hours to argue with the paramedics about whether or not she was allowed to be involved in the care of her dying wife and my mother, especially when there was literally no other available family or emergency contact. Eventually she would come back defeated and we would drive to the hospital ourselves and wait for visiting hours, where they would promptly bar her and walk me back alone to my mother.
They could do that. Had done it for as long as my mom could remember. She described times she'd been A Loud Educated White Woman at hospital staff trying to get partners in to see loved ones dying of AIDS and the helplessness she used to feel when it didn't work. What it meant to be seen as such a lesser human that you were not entitled to access in your grief and pain to a dying beloved.
It's been a long time since I've had to live like that, and I hope I never have to again. As someone who was there and involved the first time we did this, I cannot put my eggs all in one tactical basket, and neither should anyone else.
