A curious ask for a criminology student. Which is worse: a guilty man going free or an innocent man being sent to prison? Why?

oh anon i will never shut up now i love this question. prepare for the biggest word vomit you have ever seen lol

okay so first, this question is very vague, because what is the guilty man guilty of? stealing something once isn't as bad as murdering hundreds of people for example (to give an extreme example lol). same goes with the innocent man, going to prison for a couple of years is far less severe than being sentenced to life for something they didn't do (not gonna include the death penalty because firstly my country doesn't have it and secondly im fundamentaly against it)

however, if we take a general view grounded in ethics and principles of justice, many legal scholars and philosophers (such as William Blackstone who famously said "it is better that ten guilty persons escape than one innocent suffer") argue that sending an innocent person to prison is worse. i tend to agree with this because i think the legal system should prioritize protecting the rights of individuals, especially when it comes to something as severe as taking away someone's freedom. the foundation of justice should be built on the principle that it’s more important to avoid harming innocent people than to ensure that every guilty person is punished.

a wrongful conviction doesn't just harm the individual, it also weakens the moral authority of the justice system itself. when the system makes such errors, it undermines public confidence in its fairness and reliability, which can have a ripple effect, causing people to doubt its ability to deliver justice in future cases.

on the other hand, allowing a guilty person to go free could endanger public safety. it can also lead to a sense of injustice for the victims and society as a whole, who expect the legal system to hold wrongdoers accountable. additionally, when a guilty person is not punished, it could send a message that criminal behavior doesn't always have consequences, potentially encouraging more lawbreaking. in this sense, the legal system fails to fulfill its duty to maintain order and deter future crimes.

ultimately, i think it depends on the values we prioritize: protecting society at large or protecting the rights of individuals. both outcomes are harmful in different ways, but for me, the wrongful imprisonment of an innocent person strikes at the heart of what justice is supposed to stand for. a justice system that fails in this regard loses its legitimacy, and without that foundation of fairness, the system itself starts to break down.

if you take both extremes, so a mass murderer going free against an innocent person being put in prison for life, then i think it's definitely the innocent person going to jail that's worse. after all, in many legal systems, the principle of "innocent until proven guilty" emphasizes that it is better to err on the side of letting a guilty person go free than to risk imprisoning the innocent. but if you start thinking about a mass murderer going free vs someone being put in prison for idk 6 months, then the situation becomes more complex. while the mass murderer being free clearly represents a greater immediate threat to society, the question still hinges on how we value individual rights versus collective safety. i think most legal professionals would argue that collective safety in this case is more important. like Jeremy Bentham said "the greatest happiness of the greatest number is the foundation of morals and legislation." from this view, allowing a mass murderer to go free would be a serious failure of the legal system, as it would likely lead to more harm to society and further endanger innocent lives.

which is true of course, but a justice system that consistently prioritizes security over fairness risks becoming oppressive. if the system starts to wrongfully imprison individuals, even for short periods, in the name of protecting the public (the "better safe than sorry" argument), it could create a dangerous precedent. this could lead to abuses of power, where innocent people are routinely sacrificed for the perceived greater good, eroding public trust in the system over time.

so yea i believe that prioritizing the protection of the innocent is critical. if a legal system loses sight of that, it risks sacrificing its moral authority in the name of safety, leading to deeper systemic problems in the long run

okay!!! oakland show post!

i had so so much funnnn it was the best night ever!!! i went alone and was pretty nervous because even though ive been to shows and concerts alone before, i'd never been to something that had so much "waiting time" like between the m&g and preshow & show, but truly everyone was so so friendly, and it was so easy to meet people and make friends in line, so if anyone is still wondering if they should get a ticket and are worried about going alone, DO IT. it's so worth it, and phannies are lovely <3

so the m&g! this is my first time meeting both of them so i was so nervous and so excited. the line moved faster than i was prepared for it to (sarah was at the front of the line making sure everyone had their cameras ready and knew what they wanted to get signed. i'm so face blind i kept thinking about how familiar she looked but didn't realize that was sarah until it was almost my turn lmaooo), but the actual interaction didn't feel rushed. i gave them the letters i had written for them. i had tried to get metallic green envelopes but couldn't find any, and i told them that, and dan immediately knew what i was talking about and pointed knowingly at phil lmao <3

i brought tabinof and a mini lesbian flag which was between the pages in case they'd have time to sign both and they did! while they were signing i asked my questions. i asked phil for book recs and he said project hail mary, which i think he's mentioned in a preshow before. he said it's space/sci fi and he really liked it. i asked dan his thoughts on this f1 season, and he said "i think it's been quite a good season! it started off and it was like 'max is gonna win everything' and then it was like 'no he's not 🤪'"

and then dan took our selfies, and i'm rly happy with how they turned out 🥺 so here's them being cute sans me lol

they are indeed really good at making you feel comfortable and just generally being very nice and chill. they sounded more british than i was expecting? which is crazy given i allegedly know exactly what they sound like having watched their videos for 12 years, but still, hearing it up close was still kinda crazy. they are indeed very spindly, im glad i wore platforms so i was at least a little bit taller than i usually am

i Did forget to ask phil my follow up question which was if he would ever do a book recs video/livestream, and i also forgot to tell them that the sappy shit and also some recs for boston food is in the letters, but w/e they'll read those sooner or later, and at least i rmred the most important things. oh also phil's blue eyed stare really is So intense, i can definitely see how his aura can be intimidating (but he rly was so sweet <3). dan is so teddy bear vibes though, not intimidating at all <3

i was towards the end of the m&g line, so after my m&g ended, preshow started ~45 minutes later. the energy at this preshow felt rly married and silly, it was so fun. they definitely have someone prune the phlit questions (but im not sure if whoever does it just grabs them randomly or if they actually read and pick which ones dnp read), since not all of my questions were answered. but i cant complain bc they answered two of mine, which i'll post the videos for tn. but i asked if they're digital hoarders, and they said no (liars), and then dan talked about how phil's desktop is disorganized. and i also asked about their fave recent horror movie, and they both said the substance, which i've been wanting to watch!

and oh my god the show itself was CRAZY. like even though i've been looking at spoilers this entire time, i still wasn't fully prepared (maybe i'll put my more spoilery thoughts in a reblog later). they were so energetic, and their stage presence is magnetic. i think it was a good night for them, as far as i remember, no lines were obviously Forgotten, and any tripping over lines was minor. the show had silly parts, it had serious parts, it was just so Them. you really can feel how comfortable and happy they feel in this new era and, like they talked about in the phukbang, that they feel that their audience is truly Theirs now. the show was so good i Did log onto ticketmaster and google flights to san diego after work today but due to flight prices and work, i fear it's not happening, but god i do want to see it again immediately 😔

finally, thank you to all the wonderful phannies i met!!! i had such a lovely time chatting w/carolina, esmeralda, orion, and winter, who aren't on tumblr 😔 and of course with molly @finalfeudfiend!!! we were seat neighbors, partners in phannie crimes for the night, and also they took my m&g video (mwah mwah tysmmmm molly <333). it was really so great to meet everyone, and all my worries about going alone were totally unfounded <3

Currently reading: I just fixed up my nook and downloaded all of Brandon Sandersons stormlight archive books, I've just finished part 1 of his first book The Way of Kings. I'm reading since my friend really wanted me n other friends ti read it so she could start a book club so I'm reading it partly for her and partly because I haven't bitten into a fat fantasy book in a while and I know I'd like it. I was starting his other book mistborn but was told off and instructed to read the way of kings first so im doing that. I'm also reading the manga Gachuakuta as it comes out chapter by chapter with one of my close friends it's been really fun being able to follow a manga as it releases and the art style goes hard.

Last movie: took me a second but I think it was Doctor Sleep at a friend's movie night. I have not watched the shining. Which I feel adds to the experience in a sideways unique way. Rebecca Ferguson's hat in that movie is so funny. I liked it but it felt kinda insane. Like it could've been weirder but it had some shining Hollywood ropes to jump thru. Very fun otherwise very silly.

Sweet/spicy/savory: Sweet I'm sorry to my spicy and savory lovers I'm right there with you but I've recently embraced and accepted I have a sweet tooth and it's been wonderful. I can still throw it down spicy style with only a little crying and savory is soooo close too but sweet. The grip honey in my tea has on me.

Relationship status: I'm dating someone rn 🫣 it's been about 2 months since our first date and it's been really nice🥰. It's been really helpful since in August I needed to get rid of a friend crush which is now back to being a good friendship and today I'm gonna introduce my date to a lot of friends so I'm half nervous half very excited for people to meet. Every day I thank God for Bi women. Bi4Bi baby

Current obsession: Competitive Pokémon TCG. It's truly taking over my life in a good way I love it so much. I want to get to worlds next year. I have like 4 decks rn and I'm making more. My strongest deck and most consistent(despite it being by nature an inconsistent deck) has been playing Lugia Archeops I love those two pokemon and I love how the deck plays. It's a joy to look at new cards and try and game theory new innovations or strategies against other met decks and I have been really good about not buying packs and gambling away money. unfortunately almost all my favorite sapphic shows have been canceled especially the ones on netflix but i do still think theyre worth your time. but it might also kill you bc the story isnt finished. all these shows are also just amazing plots too. like i would love them just as much even if there wasnt wlw relationships.

the wilds. this is an AMAZING SHOW. its on amazon its about a staged plane crash where 8 girls are stuck on an island but they dont know that its all a fucked up social experiment. a lesbian relationship became established before it got canceled after s2.

cable girls. this is on netflix and it actually DIDNT GET CANCELED HALLELUJAH. its an amazing show but it actually doesnt really count as sapphic bc one of the characters in the wlw relationship ends up being trans. but its still a great queer love. this shows spanish and set in late 1920s madrid at a telephone company. its one of my favorite shows ever literally every season is better than the last plz watch it.

everything sucks. this is on netflix and it did get canceled but the lesbian relationship was mostly established before the end of the first season. its set in the 90s and its just a really cute show im mad it got canceled.

paper girls. this is on amazon and ngl this is one of the most painful sapphic show cancelations ive ever suffered through so if you dont wanna watch it just bc of that i dont blame you. its about these four young girls who accidentally time travel from the 80s to current day and meet their future selves. the gay girlies are heavily implied and foreshadowed but they dont get together before the end of the show :(

the last of us!!! not canceled its still going!! this show has an episode that shows a past sapphic relationship with the lesbian main character but the first season doesnt introduce a new relationship yet. the second season will tho. im sure youve heard about this or already watched it but its about a zombie-like pandemic from a deadly fungus and its total post apocalyptic. also AMAZING found family father/daughter trope. dare i say i actually think i like them more than el and hopper.

my favorite lesbian movie of all time is portrait of a lady on fire. its a french period piece and its just beautiful and THERE ARE LIKE ZERO MEN IN THE WHOLE MOVIE. i think the only line a man has is “bonjour” and thats it. MY KINDA MOVIE!!!!! INSTANT 5 STARS!!!!! i love this movie. the initial premise is that a woman needs to be painted but she cant know that shes being painted so the other woman has to just study her while hanging out and then paint her from memory. it ends up being much more than that but gaaahhh if you only watch one of these make it this movie.

another iconic sapphic movie is but im a cheerleader. way different tone much less dramatic and more comedy but still never gets old.

an amazing duo book series is criers war. i LOVE scifi and fantasy and this is my favorite sapphic scifi story ive ever read/watched. i want this to be a movie or show so bad. its about a world where some people are people and some are what they refer to as “automa” which are essentially cyborgs but they look just like humans. crier is an automa and the daughter of a king and ayla is a poor human and she has a vendetta against crier bc her father was responsible for her familys murder but crier doesnt know this! so then ayla gets the job as her maid for the goal of killing her basically but of course it gets super gay instead. its such an interesting take on the enemies to lovers trope bc its one sided, cryer has no idea ayla considers her her enemy. also neither of them are white i think crier is brown and ayla is black.

im like the worst person to take media recommendations from because you have to tie me down to watch something new and then i get obsessed with it forever, in terms of things ive seen recently that hit the same tumblr is NOT lying dungeon meshi is really good and if you start watching now you're gonna be watching at the part where it starts getting crazy

other stuff ive been into (gets progressively less mob psycho and generally more depressing like the further down we go bc i tend to get into really, really sad shit):

-i <3 deltarune but everyone has already played that. deltarune good. if you havent played deltarune play deltarune. genuinely like it more than undertale. also if the last chapter of deltarune is just the confession arc i called it and deserve a million dollars

-same w spiderverse. listen usually i dont care about superhero stuff but god these movies are good and i really hope they stick the landing.

-everything everywhere all at once continues to be one of my favorite movies ever

-rainworld (video game, very difficult but skurry's playthroughs do a good job summarizing the plot and general vibe of each route if you wanna watch those. i watched my friend play survivor ages ago and ive been playing through survivor with a friend on multiplayer and decided to watch some playthroughs to get a feel for the map and GOD DAMN the story of this game. rivulet route almost made me cry.) fair warning this is animal death the video game.

-severance (live action tv show, general plot is some sort of dystopian future where they invent a surgery where you can seperate your work self from your normal self so you clock into work and then black out until your shift is over. except your work self is just stuck at work forever. only 9 episodes but very, VERY good)

-i actually really enjoyed the scott pilgrim comics and the anime i wish anyone ever could be normal about them. id definitely suggest comics (if you can handle the 2000s humor) then anime. also basically everyone knows this but fair warning that starting out the main character is in his early 20s dating a 17 year old, it is explicitly treated as a shitty thing by the narrative and theres nothing explicit and its made very clear that he has 0 feelings for her whatsoever and is just using her as an ego boost but if youre sensitive to that stuff i might skip this one

-lots of webcomics about animals. i read so many webcomics about animals its like. my main media intake. this is part of the reason that i dont understand complaints about the art style my favorite webcomic looks like this

its called doe of deadwood and ill think about it until the day i die. others im currently reading (since this one wrapped a while ago) are "what lurks beneath" (cat cult on an island) "waves always crash" (cat cult on the beach) "i didnt know" (cat cult in a barn), toufati sawa (hyena trying to avenge her clan) and africa (leopard trying to survive the harshening world with her cubs) warning for animal death with all of these and general abuse warning for all those cat cult ones bc. cults.

-i like warrior cats. do not read warrior cats. its not very good and youll get stuck here forever.

-pathologic but the actual game and not just people describing the game please watch someone play the actual game summaries skip so much of the meat of the story and the characters. or play the game if you can bear learning to strategically quicksave. fair warning there is a lot of racism depicted against indigenous people in these games and while the framing of it generally aires on the side of "racism bad" there are a lot of kinda shitty tropes that come with it.

-listen bojack horseman is one of my shows it is the polar opposite of mob psycho in like every way and i would never in a million years recommend it if you want something that hits like mob psycho but if we're asking for just things i enjoy this is one of them. heavy cw for drug usage and abuse with this one. might want to give "does the dog die" a look for this one bc people are not joking about how heavy this show is

-same with hospice. hospice is a concept album about a hospice worker and a patient and has had more of an influence on me than any other piece of media ever bc i found it at the exact perfect time in my life for it to be relevant to my circumstances and now its like part of my identity. heavy cw for abuse also

speaking of complex siblings dynamics, have you see succession? its a show on hbo. its about an ultra rich and powerful family that is ultimately, dysfunctional. theres four siblings and their relationship mean sooo much to me. i wont drop any spoilers just in case you dont know anything, but when i say dysfunctional i meant it!! one of the things i like about this show is that it doesnt have any flashbacks or show the backstories for most of the characters, rather they kinda drop pieces of information randomly and you just go ??? that happened ??? youd think it wouldnt be a good storytelling strategy bc how are you going to emotionally connect the story to your audience? but somehow, the show does it really well. for example, one of the brothers, roman, was heavily abused. and sometimes one of his siblings would go, "yeah i remember when dad used to heavily beat the fuck out of you" offhandedly, like its a cute little fun fact. and youre sitting there like....when did THAT happen??? ofc they wouldnt show it, but if you watch how roman and his father interact on show (roman is so submissive and scared next to his father) it starts to make sense. its like the "show dont tell" but they switch around to "tell and show." subtle interactions like that fully exposes a characters psychology. subtle body language goes a long way. theres also the eldest brother connor, whos seen as the father figure bc their real dad is so neglectful. but tbh connot gets shit on a lot and uuyfuefehfe theres more. i would talk about this all day. sibling angst got me on a chokehold.

Oh man, so I did a search for sibling webweaving and I was like woah what is all this lol. I had no idea there was a term for stuff like this, but I'm fascinated! I must not be getting the TikTok videos... admittedly my use of that platform is limited lol.

The thing about the otome game not delving into things means that we all get to speculate and come up with whatever we want. It's a blessing and a curse lol. On the one hand, I like being able to come up with my own interpretations. But on the other hand, it'd be nice to have just a little more depth that what we have.

I have thoughts about Belphie and specifically what happened in the OG with him. That was definitely a situation of, there is so much more going on here than they're bothering to get into. I also get that they can't really do a ton of that, partly due to the medium and partly due to the amount of characters they have to deal with. Like I think they can only choose to flesh out certain characters and the rest kind of end up on the back burner. Which is annoying because there's so much potential for so many amazing stories!

I also have a lot of thoughts about Satan and his relationship to Lucifer and everybody. It's like they give us just enough to make the story dramatic, but in the end everybody loves each other and so on and so forth. I'm not saying both Satan and Belphie shouldn't be able to reconcile what happened to them and move on, but it just happens so fast. It seems too easy. So I kind of headcanon it as, they hide everything. Not just those two, but all the brothers have a certain level of trauma that they just bury deep or at the very least don't display in front of MC. I know they make MC out to be the demon therapist, but nobody resolves their issues in one session and that's all they're normally limited to. But of course they don't have time to get into things that deeply in a mobile otome game lol.

I have not seen Succession! It sounds pretty intense. I think it's always interesting when media use different techniques to tell their story. Of course I have very little knowledge of how TV scripts are written, but for story writing, the way a character reacts can imply all kinds of past history, even if you don't know exactly what happened. Flashbacks are helpful, but I think it's interesting to have a bit of a mix. A character is always going to tell the story of their past a little differently than how it actually happened. And I find that it can reveal a lot about character just to see what they change or leave out when telling it. Of course, who they're speaking to can affect that as well. But it's definitely an interesting concept!

trigun has a 98 anime, a manga and a 23 anime. all of them follow the same story but its told in a distinct way on each which i think its pretty cool

its about this guy named vash the stampede, and outlaw gunslinger with a really pathetic energy about him, as he goes through increasingly more tragic shenanigans to get to his genocidal twin brother, millions knives. along his journey we get to meet meryl milly and wolfwood (my wife) and a lot of other characters

there are Themes and Imagery and im obssessed with everything about it.

although!!! each version kinda tells the story differently so if you want to Really get into it id recommend consuming all of the media but thats not mandatory

for me i started watching the 1998 anime first (just bc o fthe silly gifs and bc wolfwood looked pretty) then read the manga then watched the new anime. tbh, i feel like before watching the new anime you should read the manga or watch the old anime first, just to experience the story on its original beat (not realy a fan of trigun stampedes pacing) but i wouldnt say the new one is bad, if you want to start through it i think you should go for it

theres also a movie from 2009 i think that has Nothing to do with the plot of anything trigun but its fun i have a love hate relationship with it

anywho!!!! whichever way you choose to watch/read trigun i think youre gonna like it, its really really cool. also, for the manga, i highly recommend reading it through @/trigun-manga-overhaul, im doing my reread through them and its GREAT really good translation.

My absolute favorite is The Promised Neverland

This had me obsessed for months!

Its a thriller horror mind game crazy good show that is the best going in completely blind, seriously, watch episode one without know anything at all because its the best like that. Its 12 episodes and i had binged them all in one day, its crazy

I watched in dub because all their smart talking was hard for me to keep up with in sub

I would read the manga since it is so much better but if you are gonna do both, watch the anime first so you can save the better experience for later cuz the anime wont feel the same.

Another rec: Kaguya Sama: Love Is War

I discovered this from clips randomly oon my youtube front page outta nowhere but this show is HILARIOUS i find the dub so much funnier and the anime is better than the manga so watch that instead of reading it cuz the delivery and timing is done so much better in anime form.

Its a romcom and usually i hate roms but the comedy is so funny and clever and constant, the characters, main, secondary and all the other kids in the school, every single one of them is so fleshed out and you end up loving them all, with all of them even the random background character getting focuses a lot, where its not really a show about the main two, but the people surrounding them

And the comedy is good but the story is also AMAZING even when it gets serious the story captivates you and because you love the characters so much from the exelent writing, you are so invested and the story feels so much better. The story is the comedy of it so the jokes dont feel awkward but natural and it makes it so much better

Ive litterally rewatched it countless times, and randomly revisit a random episode every time i need it because the jokes, no matter how much i know them and are prepared for them, land every time and are always still super funny. I love it so much

Those two are in my top three favorites

My fourth favorite is Demon Slayer, you've probably heard of it, the story isnt too good and personally the first few episode do drag a bit on a rewatch (i thouroughly invested on my first watch cuz its good at introducing you to the world) but the anime and the fight scenes and the story later is SO GOOD AND INVESTING

Seriously, watch the anime, its so much better than the manga. The fourth season ended a while ago and some point soon they are going to make a trilogy of movies to end out and complete the manga. For this one i am anime only so i dont want any spoilers at all and im EXCITED

(Just be aware that the fandom is so spoiler happy so just dont search up anything about it on youtube or in the fandom space, seriously, i got MASSIVE things very cassually spoilered to me and been bombarded by them every time i just want to take a peak at what the fandom space looks like)
