Can Any Indian Citizen Buy A Property In North East India?
The Modi administration declared significant modifications to legislation in the Union Territory of Jammu and Kashmir on October 26th, using powers provided to the Centre underneath the Jammu and Kashmir Reorganisation Act 2019.
The headline modifications basically allow outsiders to acquire land in J&K by eliminating legislation and statutory rules of the former state that prohibited the ownership of property in J&K to 'permanent inhabitants'.
The lifting of limitations on outsiders purchasing land in J&K has long been hailed by proponents of the Modi government's decision to terminate the former state's special status. Governor Manoj Sinha has lauded the move's industrial ramifications, while BJP politicians like Sambit Patra have enthusiastically declared on social networks that anyone may now buy property in J&K.
Non-tribal people and foreigners are not permitted to purchase land in Sixth Schedule territories, while the Northeast has various state-specific regulations.
As Article 244 of the Indian Constitution, the Sixth Schedule contains provisions for the governance of tribal territories in Assam, Meghalaya, Tripura, and Mizoram.
Mizoram and Nagaland (except Dimapur) are, on the other hand, protected by Articles 371G and 371A of the Indian Constitution, and indigenous people have land ownership rights, and several states in the area have Inner Line Permit (ILP) provisions.
The Sixth Schedule of the Indian Constitution empowers Autonomous District Councils (ADCs) to pass rules prohibiting foreigners from purchasing tribal territory.
Articles 371A for Nagaland and 371G for Mizoram have provided specific authority to refuse any new Acts of Parliament until adopted by a resolution voted by the state's legislative assembly and to defend their rights to their land, customs, and religion.
Inner Line Permit (ILP) is relevant in Mizoram, Nagaland, and Arunachal Pradesh underneath the Bengal Eastern Frontier Regulation of 1873, which requires citizens from other parts of India to obtain permits to enter these states in order to control influx, and outsiders are not permitted to acquire property in the Sixth Schedule and other tribal areas, such as the hills of Manipur.
Prestone Tynsong, Deputy Chief Minister of Meghalaya, stated that there are Sixth Schedule and non-Sixth Schedule territories in Meghalaya.
"There are certain provisions for non-tribal people to acquire land in non-Sixth Schedule regions, including sections of the state capital Shillong as well as some grasslands of the Garo Hills area," Tynsong added.
Assam has several Sixth Schedule regions, and many parts fall underneath the tribal belt, where non-tribal people cannot acquire land. Under the Sixth Schedule of the Indian Constitution, there are three Autonomous Councils: the Bodoland Territorial Council, the Dima Hasao Autonomous District Council, and the Karbi Anglong Autonomous District Council.
Aside from these, Assam has 17 tribal straps and 30 blocks in the districts of Morigaon, Tinsukia, Darrang, Sonitpur, Nagaon, Lakhimpur, Kamrup, Goalpara, Dhemaji, and Bongaigaon, and four districts under the Bodoland Territorial Council (BTC) where non-tribals are prohibited from purchasing land.

Sarwan Singh Pandher, coordinator of Kisan Mazdoor Sangharsh Morcha, said that the BJP has staged a dharna for 3 hours on October 3 against the non-punishment of former Union Home Minister and his son Ashish Monu Mishra, the main accused. A nationwide train stop movement has been announced for the rest of the 12 demands, including the Lakhimpur Khiri incident.
Pandher said that trains will be stopped at about 30 places in 18 districts of Punjab. These include Batala, Tarn Taran town and Patti in district Gurdaspur, Tanda and Hoshiarpur Khas in Hoshiarpur, Fort Raipur and Sahnewal in Ludhiana, Phillaur and Lohia in Jalandhar, Talwandi Bhai, Mallanwal, Makhu, Guruharshay, Moga stations in Ferozepur district.
Apart from Patiala station in Moga district, Malot in Muktsar, Hamira and Sultanpur in Kapurthala, Ahmedgarh Mandi in Sunam, Faridkot city in Faridkot, Rampura Phul in Bathinda district and Parmanand in Pathankot district, there are three places in Haryana, two places in Rajasthan and Tamil Nadu. And there will be protests in Madhya Pradesh too. While trains will be stopped at three places in UP.

What Piyush Goyal Said After Late-Night Meeting With Protesting Farmers
A panel of Union ministers held a fourth round of talks with farmer leaders here on Sunday over their demands, including a legal guarantee of MSP, as thousands of protesting farmers camped at the Punjab-Haryana border.
Agriculture and Farmer Welfare Minister Arjun Munda, Minister of Commerce and Industry Piyush Goyal and Minister of State for Home Affairs Nityanand Rai reached the Mahatma Gandhi State Institute of Public Administration in Sector 26 for the talks.
Punjab Chief Minister Bhagwant Mann also joined the meeting, which began at 8.15 pm on Sunday and ended at around 1 am on Monday.
Talking to reporters after the meeting, Mr Goyal said the panel has proposed the buying of pulses, maize, and cotton crops by government agencies at minimum support prices for five years after entering into an agreement with farmers.
The farmer leaders said they will discuss the government's proposal in their forums over the next two days and thereafter, decide the future course of action.
"Cooperative societies like the NCCF (National Cooperative Consumers Federation) and NAFED (National Agricultural Cooperative Marketing Federation of India) will enter into a contract with those farmers who grow 'tur dal', 'urad dal', 'masoor dal' or maize for buying their crop at MSP for next five years," said Mr Goyal.
"There will be no limit on the quantity (purchased) and a portal will be developed for this," he added.
It will save Punjab's farming, improve the groundwater table, and save the land from getting barren which is already under stress, Mr Goyal said.
On the Centre's proposal, farmer leader Sarwan Singh Pandher said, "We will discuss in our forums on February 19-20 and take the opinion of experts regarding it and accordingly take a decision."
A discussion on loan waivers and other demands is pending and we hope that these will be resolved in the next two days, Mr Pandher said, adding that the 'Delhi Chalo' march is currently on hold, but will resume at 11 am on February 21 if all the issues are not resolved.
The Union ministers and farmer leaders had met earlier on February 8, 12 and 15 but the talks remained inconclusive.
Protesting farmers from Punjab have been camping at Shambhu and Khanauri points on the state's border with Haryana since February 13 when their 'Delhi Chalo' march was halted by police.
The call for the march was given by the Samyukta Kisan Morcha (Non-Political) and the Kisan Mazdoor Morcha to press their demands.
Besides a legal guarantee of MSP, the farmers are demanding the implementation of the Swaminathan Commission's recommendations, pension for farmers and farm labourers, farm debt waiver, no hike in electricity tariff, withdrawal of police cases and "justice" for the victims of the 2021 Lakhimpur Kheri violence, reinstatement of the Land Acquisition Act, 2013, and compensation to the families of the farmers who died during a previous agitation in 2020-21.
Ahead of the fourth round of talks, the SKM announced that it will gherao the residences of BJP leaders in Punjab for three days from Tuesday to press the Centre into accepting their demands.
Balbir Singh Rajewal, a leader of the SKM, an umbrella body of various farmer unions, said they will stage protests in front of the residences of Punjab BJP leaders, including MPs, MLAs and district presidents, from Tuesday to Thursday.
Interacting with reporters after a meeting of SKM leaders in Ludhiana, Mr Rajewal said it has also been decided that they would protest at all toll barriers in the state and make them free for all commuters from February 20 to 22.
The SKM will not accept anything less than the C-2 plus 50 per cent formula for MSP as recommended in the Swaminathan Commission report, he said after the meeting which was also attended by farmer leaders Balkaran Singh Brar and Boota Singh, among others.
Earlier, farmer leader Jagjit Singh Dallewal said the central government should not dilly-dally and accept farmers' demands before the Model Code of Conduct for the Lok Sabha elections comes into force.
If the government thinks it will continue to hold meetings till the Model Code of Conduct is imposed and then say it cannot do anything as the code is in force… the farmers are not going to return, he said.
"The government should find a solution to our demands before the Model Code of Conduct comes into force," he added.
In Haryana's Kurukshetra, Bharatiya Kisan Union (Charuni) chief Gurnam Singh Charuni and some 'khaps' took part in a panchayat to chalk out a course of action to support the protesting farmers from Punjab.
Mr Charuni told reporters after the meeting that it was decided to unite all farmer organisations to hold a protest in support of the agitation.
Mr Charuni said a good chunk of the rural belt is part of the National Capital Region (NCR) and a four-member committee has been formed to connect with farmers from Delhi.
He said it is surprising that the government is not allowing the farmers to travel to Delhi on their tractors.
Khap leader O P Dhankar said Haryana 'khaps' are behind the agitation and the central government should not delay giving a legal guarantee of MSP.
Another 'khap' leader who attended the panchayat said farmers will reach Delhi and protest if the talks fail.
Meanwhile, the suspension of internet services has been extended in certain areas in some Punjab districts, including Patiala, Sangrur and Fatehgarh Sahib, till February 24 on the orders of the Union Ministry of Home Affairs.
Earlier, internet services were suspended from February 12 to 16 in view of the farmers' march.
The Bharti Kisan Union (Ekta Ugrahan) continued to hold protests at toll plazas in Punjab for the second consecutive day, forcing authorities not to charge toll tax.
At the Ladhowal plaza in Ludhiana, farmers shouted slogans against the Centre and the Haryana government.
The Haryana government on Saturday extended the ban on mobile internet and bulk SMS services in seven districts till February 19.

‘Major’ Oil Spill Off California Coast Threatens Wetlands and Wildlife (NYT) A pipeline failure off the coast of Orange County, Calif., on Saturday caused at least 126,000 gallons of oil to spill into the Pacific Ocean, creating a 13-square-mile slick that continued to grow on Sunday, officials said. Dead fish and birds washed ashore in some places as cleanup crews raced to try to contain the spill, which created a slick that extended from Huntington Beach to Newport Beach. It was not immediately clear what caused the leak, which officials said occurred three miles off the coast of Newport Beach and involved a pipeline failure. Mayor Kim Carr of Huntington Beach said at a news conference on Sunday afternoon that the spill was “one of the most devastating situations our community has dealt with in decades.”

India’s Christians living in fear as claims of ‘forced conversions’ swirl (Guardian) It was a stifling July afternoon when the crowd moved into the small district of Lakholi, in the Indian state of Chhattisgarh, and gathered outside the house of Tamesh War Sahu. Sahu, a 55-year-old volunteer with the Home Guard who had begun following Christianity more than five years previously, had never before had issues with his neighbours. But now, more than 100 people had descended from surrounding villages and were shouting Hindu nationalist slogans outside his front door. Sahu’s son Moses, who had come out to investigate the noise, was beaten by the mob, who then charged inside. As the men entered the house, they shouted death threats at Sahu’s wife and began tearing posters bearing Bible quotes down from the walls. Bibles were seized from the shelves and brought outside where they were set alight, doused in water and the ashes thrown in the gutter. “We will teach you a lesson,” some people were heard to shout. “This is what you get for forcing people into Christianity.” Sahu’s family was not the only one attacked that day. In some villages, Christian churches have been vandalised, in others pastors have been beaten or abused. Congregations have been broken up by mobs and believers hospitalised with injuries. The police, too, stand accused—of making threats to Christians, hauling them into police stations and carrying out raids on Sunday prayer services. The attacks have coincided with renewed attention on a longstanding claim from rightwing Hindu groups: that a string of forced conversions are taking place in Chhattisgarh. Such claims have been made by senior figures in the ruling Hindu nationalist Bharatiya Janata party (BJP), which governs India.

Since early in the pandemic, New Zealand had pursued an unusual zero-tolerance approach to the virus through strict lockdowns and aggressive contact tracing. Under Ardern’s plan that starts Tuesday, Aucklanders will be able to meet outdoors with loved ones from one other household, early childhood centers will reopen and people will be able to go to the beach. The dates for a phased reopening of retail stores and later bars and restaurants have yet to be decided.
3,000 Yazidis Are Still Missing. Their Families Know Where Some of Them Are. (NYT) The voice messages sent by Abbas Hussein’s teenage son are heartbreaking in their matter-of-factness. The boy, a member of Iraq’s Yazidi minority who was kidnapped by Islamic State fighters seven years ago, asks about his mother and wonders why his father has not been in touch. In the messages sent last summer to his father, an unemployed laborer, the son says his captor will not let him send any more because his parents have not delivered payments as demanded. “Father, if you don’t have money, that’s OK. Just let me know,” says the teenager, who still has the voice of a child. “I will work and save money and give it to him to let me talk to you.” Mr. Hussein has known for more than a year that his son and five other relatives are being held in Turkish-controlled northern Syria by a former ISIS fighter who joined the Syrian National Army—a Turkish-backed coalition of armed opposition groups that includes mercenaries and Syrian rebels. He’s one of roughly 3,000 Yazidis still missing after being captured by ISIS during its takeover of parts of Iraq and Syria. While most of the missing are presumed dead, hundreds more are thought to be alive and held captive in Syria or Turkey. In some cases, their families know where they are and have even been in contact with them or their captors. But financial support from governments and private donors, as well as interest from them in finding the missing Yazidis, has dried up.
Taliban-style security welcomed by some, feared by others (AP) It wasn’t 7 a.m. yet and already the line outside the police station’s gates was long, with men bringing their complaints and demands for justice to Afghanistan’s new Taliban rulers. Something new they immediately found: The Taliban fighters who are now the policemen don’t demand bribes like police officers did under the U.S-backed government of the past 20 years. “Before, everyone was stealing our money,” said Hajj Ahmad Khan, who was among those in line at the Kabul District 8 police station on a recent day. “Everywhere in our villages and in government offices, everyone had their hands out,” he said. Many Afghans fear the harsh ways of the Taliban, their hard-line ideology or their severe restrictions of women’s freedoms. But the movement does bring a reputation for not being corrupt, a stark contrast to the government it ousted, which was notoriously rife with bribery, embezzlement and graft. Even residents who shudder at the potential return of punishments—such as chopping off the hands of thieves—say some security has returned to Kabul since the Taliban swept in on Aug. 15. Under the previous government, gangs of thieves had driven most people off the streets by dark. Several roads between cities are again open and have even been given the green light for travel by some international aid organizations.

Named Tropical Cyclone Shaheen, the tempest slammed ashore late Sunday, about 50 miles to the west of Muscat, Oman’s capital city. The storm has since departed, but not before leaving 11 dead in Oman, mostly because of flash flooding and landslides. The storm was also blamed for two fatalities in Iran, where the bodies of two fishermen were found.
