The Murder of Joyce Nelson
If you have seen the Netflix documentary, it is difficult to think about Joyce Nelson without recalling her family’s devastation when they discuss her personality, the way she dressed and her fears. The family display a justified hatred and disgust towards her killer. They believe wholeheartedly that Richard was convicted with conclusive evidence.
When examining the details of Nelson case, it is plain to see that no real evidence tied Richard to the crime. One might feel a sinking feeling: if Richard Ramirez was not the killer, these poor people never had justice and the killer might still be free and probably went on to kill others. For anyone in this situation, that would be difficult to process. How does one deal with that? Can it really be true that the wrong man was caught and sentenced to death? That you were misled by both the police and the courts? It feels cruel to the family to write this, but there was no concrete evidence that Richard was the Night Stalker.
What Happened?
On 7th July, 1985, Joyce Nelson’s neighbour, Robert Blanco, noticed Joyce’s back gate was open at 6am. Blanco entered her yard and heard her TV on and called out. There was no response. He checked on her again at 9am, with the same result. At this point, Blanco noticed the window screen from the front window lying in her flowerbed. The window itself was open. Her front door was also open. The back door screen had also been cut. Blanco alerted another neighbour who called the police.
Joyce had been beaten over the head, (which was not the immediate cause of death) and then manually strangled. She had fought her attacker and sustained a broken nail and severe bruising and cuts to the face.
Physical Evidence at the Scene
Partial shoe prints in the planter under the window and on the porch.
A shoe print on Joyce Nelson’s face and robe.
Palm prints on the bedroom door and windowsill.
Glove marks on a file box in the other bedroom.
Hairs were found.
Enter: Avias
By this time, a big deal is being made by the police about the ubiquitous Avia prints. After they were found at the previous attack two days earlier, (Whitney Bennett), Sergeant Frank Salerno had finally come on board Carrillo’s serial killer train, so of course they had to appear here too in such a conspicuous place – the victim’s face. Salerno even brought a pair along with him to compare the prints. If the circumstances were not so horrific, it would be comical.
As always, the unqualified Gerald Burke plodded along to confirm the prints were indeed the Murder Avias – although we know Burke is not a reliable witness – he later perjured himself regarding the Cannon Incident five days earlier (the prints at Cannon had been inconclusive and shoe forensics expert Lisa DiMeo discovered the jury had seen faked shoe evidence). So, forgive us for implying the shoe is fabricated and preposterous at this point.
For Richard’s appeals, four partial shoe prints were examined by Lisa DiMeo. From Document 7-19.
None of this was presented at the actual trial, because the defence did not bother.
Oops – Richard dropped someone else’s hairs again
The prosecution repeatedly used those shoes to link seemingly unconnected crimes. A competent defence should have demonstrated that not only were these crimes unconnected but at Bell & Lang, Cannon, Bennett and later, the Kneiding and Abowath attacks, ‘Richard’ shed some hairs that were not his. All the hairs at Joyce Nelson’s murder scene were medium brown.
Glove Prints and Palm Prints.
First of all, glove prints cannot be used as evidence. They do not leave identifiable prints. So that must be thrown out. But the palm prints could not have been Richard’s otherwise the prosecution would have mentioned it and it would have seemed damning from a juror’s perspective, despite how unreliable fingerprint science was in the 80s.
So, it was not Richard’s hair and it was not his palm print… can the verdict really rest on partial shoeprint evidence? Wait, there’s a witness!
It was Launie Dempster, the all-seeing (literally – she had x-ray vision) newspaper deliverer again.
Dempster’s route and witness statements are presented in more detail in the Doi Incident post, but here is a recap of the locations where she claimed to have seen ‘Richard’:
14th May – man in a car opposite the Doi residence where William was killed.
(Approximately) 28th May, the same man, in the car again, on San Patricio Drive. Richard was given an alibi by his father and a family friend in El Paso for this date. (Their claim that he was there beyond the 29th was disproved by dental records)
(Approximately) 5th July, a man is seen standing by a car, close to Joyce Nelson’s home.
If Dempster saw ‘Richard’ in East Arlight Street on 5th July, not only is this date irrelevant to Joyce Nelson’s murder, which occurred on 7th July, but by placing him in Monterey Park at 3am, she unwittingly gave Richard an alibi for the Bennett attack, in Sierra Madre, 11 miles away. If Richard really was the man in Monterey Park, then he cannot have been one of Whitney Bennett’s attackers.
Dempster’s description is odd. She claims ‘Richard’ was wearing a short-sleeved shirt but also a jacket. Unless she witnessed him in the act of putting the jacket on, she would not be able to see the length of his sleeves. And there is nothing significant about her seeing a man by his car. People get in and out of their cars at all times of the day or night.
Not only that, each time Launie Dempster had seen him, it was around 3am – 4am, in the dark and he was wearing dark clothes and sitting in a dark car. How can one accurately identify someone in these conditions?
Even less likely when one considers that she had not bothered to inform the police she had seen a man near Nelson’s home until she had seen Richard Ramirez on the news. This strange delay in informing the police was also the case with Sophie Dickman, Somkid Khovananth, Virginia Petersen and the strange woman who thought an innocent man with a cat was Richard.
The bumbling, blundering defence counsel failed to adequately cross-examine Launie Dempster and her motivations for reporting her sighting so late, and never questioned her on what characteristics the suspect had that led her to believe he was Richard Ramirez.
Now that Launie Dempster has been ruled out as a reliable witness, we are still in the position of having Avia shoe prints as the primary evidence, and there is no proof Richard Ramirez ever owned a pair. Things should have looked bad for the prosecution but unfortunately, when the defendant had a bunch of clowns and the abhorrent Ray Clark as his defence counsel, he ended up with this conviction.
Felipe Solano Yet Again
Items stolen from Joyce Nelson’s home ended up in the possession of the notorious LA ‘fence’, Felipe Solano, but he and all the other burglar associates were never brought to trial, some were given immunity and the chain of ownership of the stolen items was never established. Moreover, none of the stolen property was recovered directly from Richard and his fingerprints were not found on any of them. Felipe Solano’s name keeps coming up. He will be examined in an upcoming post.
Connections to Other Attacks
The prosecution attempted to connect Nelson with Cannon and Bennett because all three women were hit over the head and manually strangled. While the crimes look similar, this theory could easily have been pulled apart, had the defence presented the necessary evidence. Someone else’s blood was found at both Cannon and Bennett, and someone else’s hair was found at all three locations, but were the hairs at each crime compared with each other? The Cannon and Bennett attacks were geographically close, but Nelson was much further away. All that appears to connect them is the shoes, but we now know the prints at Cannon were bogus. That is to say, faked evidence from the Cannon crime created a ‘spillover effect’, which caused Richard to be convicted of Nelson.
They also attempted to connect Joyce Nelson’s murder to the Dickman Incident because they occurred on the same night. Sophie Dickman lived just a mile away and was the victim of a rape and burglary. Detective Carrillo claims that Richard had not achieved his sexual gratification from Joyce’s murder so went to deal with his ‘unfinished business’ at Sophie Dickman’s. This is pure conjecture and also ridiculous – Sophie Dickman was threatened with a gun. If Joyce Nelson’s killer had a gun, why did he not use it? To say Richard was a circumstantial killer and did not have a modus operandi is lazy and too convenient. If Joyce was murdered first, then why did Sophie Dickman not report that her killer was covered in blood and bruises, from where Joyce had fought back? Because these two crimes were committed almost simultaneously a mile apart by two different men because crime in Los Angeles County was and still is out of control.
So, what is the evidence Richard Ramirez committed this brutal murder? Shoeprints. That is it. Shoes that were never proven to be his.
Do not be angry at bloggers; save your fury for Gil Carrillo and Frank Salerno for pinning all these crimes on a mentally disturbed and brain-injured young man. Be angry at Richard’s appalling lawyers for not defending him and covering up his mental illness for financial reasons.
Joyce Nelson and her family have not had the justice they deserve.

Chapter 51
I took my Team back to Pern. We go to Pern once a week and spend a week there so I can take care of my hold and get away from fighting monsters. I also take Welf with us, because he has been using the Lab to forge weapons, shields and armor. I take anyone else from the Familia that wants to go as well.
Soon after arriving back on Pern, I headed to the lab to see if Mercedes was there. 'Like she's going to be anywhere else.' I think to myself with a chuckle.
"Hi, Mercedes. I have a project for you." I told her.
"What do you need?" Mercedes asked me.
I handed Mercedes several magic stones. "I want you to make micro cameras and TVs like they use on Remnant. I want to be able to wear the camera in the Dungeon and it broadcast the images to the TV on the surface. I'm going to use the PDs to link the signals together." I told Mercedes.
"First it was Dust from Remnant and now you want me to work with magic stones from Orario. What next?" Mercedes asked me.
I chuckled. "I know you like a challenge. You can use another power source if you want to, as long as it works on the 'lower world'." I suggested.
"How long before you want it and how many?"
"If you can have the first ones ready by the time, I go back to Orario that would be great. And I would like two cameras and two TVs sets to start with. If they work well and are received well, I'll need a lot more so I can sell them at our store in Orario." I informed Mercedes.
"I should be able to get you two cameras and two TV sets by the end of the week." Mercedes informed me and turned to start working on her new project.
I walked up behind Mercedes and put my arms around her and gave her a hug and leaned around and kissed her on the cheek. "Thank you, Mercedes. I appreciate it." I told her.
Mercedes put her hands down on my arms and hands for a few moments then she starts reaching for pieces of equipment. "Leave me alone so I can get to work." She chided me.
I chuckled again. "I'll leave you to it then. Love you." I said as I took my arms from around her and turned to leave the lab.
I heard a soft. "I love you, too."
I stopped and turned around looking back into the Lab. "Hello Welf. I see you got right to work." I said as Welf was working on a sword.
"Hi, Eilwyn. No time to waist. I only have a week to get enough weapons and armor to sell in the store." Welf said with his usual cheeky grin and a laugh.
I chuckled. "I'll let you get to it then. Just don't forget to take some breaks and get something to eat. The Cafe and The Bakery are open twenty-four hours. So, there is no excuse to not get something to eat. And that goes for you too, Mercedes." I said then left the Lab so they both could work on their projects.
Once Mercedes gets into the 'zone' she can get cranky when someone interrupts her. So, I'll leave her to work on the TV project for a few days before I check up on how she is coming along with it.
As for Welf, he has agreed to my suggestion of putting Dust into some of his weapons. He charges more valis for them because they do extra damage because of the Dust. Yet they don't crumble after being used a few times like 'Magic' weapons do. The Dust weapons are a good middle alternative for adventurers, extra damage without the high price tag of magic weapons.

With Landing open to everyone, it is picking up. More people are moving to Landing to help excavate the many building that still need to be uncovered. Many people are coming to learn from AVIAS about many different subjects. From mining, glass making, agriculture to animal husbandry, as well as many new subjects.
Our shops at The Market are doing well, and the craft halls that have set up shops there are starting to get customers.
I've spent several hours talking to AVIAS about those taking some of the classes. I want to find out who might be good to bring to my Hold. I don't want someone that is just good in book learning, I want someone that is good at the practical experience as well. Along with being friendly and not snobbish, like some in the healer's hall can be, just because they are healers, they think they are better than everyone else.
I spent a couple days at our shops at The Market. I wanted to see how things were going and how the people of Pern were reacting to the new shopping center.

I waited five days before I checked up on Mercedes and how the cameras and TVs were coming along.
"I have two cameras and one TV so far. I should have the second TV finished by the end of the day. Fortunately, the magic stones work almost like the Dust crystals work, so I didn't have to do much to adapt them for use." Mercedes told me.
"That's good. I want to test them out shortly after we get back to Orario. I'll let you know how they work out." I informed Mercedes.
Mercedes nodded her head in understanding. "I designed the cameras so you can either put them into a head band or strapped on the chest." She added.
"Both locations have good points and bad points. On a head band, the viewers will have a better view, but if the person wearing the camera starts moving their head around fairly quickly, the viewers will get dizzy. But if the camera is on the chest, the arms of the person wearing the camera will get in the way. So, we'll have to see which works better." I offered my ideas.
"I just make them. It's up to you to make them work properly." Mercedes told me and giggled.
"Ha-ha-ha." I fake laughed. "That is why I'm going to test them out. One person can wear the camera on a head band and another person can wear it on their chest. Whichever one has a better picture and view will be the way we go." I told Mercedes.
Mercedes instructed me on how the cameras and TVs work. "I didn't have time to put in a zoom lens, so I put in a 40 mm lens for now. It is wide enough so the viewers will see a lot of the Dungeon but anything in the distance will be difficult to see." Mercedes informed me.
I nodded my head in understanding. "That's not a problem. My main reason for having them is so Hestia and Eina can see what is happening in the Dungeon. Hestia can send Osma into the dungeon with Bell's party or mine, but I think it would be easier this way. Osma won't have to relay messages back and forth. I know she gets tired of doing that. Along with hearing Hestia screaming when a big monster shows up." I told Mercedes and chuckled.
"I'll let you get back to work on the last TV." I said, I gave Mercedes a kiss on the cheek and left her to finish up.
The next day I picked up the cameras and TV boxes. The TVs are like a lot of the TVs they us on Remnant. They are a rectangle box that projects the image into the air directly above the box. You can see through the image. The way the image looks is kind of like looking at a magic mirror the 'gods' can make to see what the 'children' are doing.
"Could you make ten more of the cameras and monitors?" I asked Mercedes. "If they go over well, I want to have enough to start selling right away. I'm sure I don't have to tell you, but just in case. Make sure each camera-TV pair are on a different wavelength than any of the others. Don't want one Familia getting the signal from a different Familia in the Dungeon." I reminded Mercedes.
"Ten more sets, and yes I know, each pair is to be set to a different frequency." She replied.
"Thank you, Mercedes."
While I was picking up the cameras and TVs, I stopped to talk to Welf. "I would suggest you take a break tomorrow and get some rest." I suggested to Welf.
"I still have lots to do." Welf told me.
"Welf, you need to take a day off. Besides with the store just being opened, I'm sure we're not going to be flooded with customers the first week." I told him.
"Your right. I just don't like doing things halfway." Welf replied.
"If we need more weapons or armor, I'll bring you back in the middle of the week. How does that sound?" I offered.
Welf nodded his head in agreement. "Yah, that'll work."
I grinned. "So, tomorrow you take a break, and, in the evening, I'll take us back to Hearthstone Manor."
"That sounds good. Now get out of here so I can finish up what I'm working on." Welf chided me with his usual cheeky grin.
I chuckled and left Welf to finish up what he was working on.

Back in Orario
Tiama and I walked into the Guild Hall on Northwest Main Street. Seeing Eina I walked over to the counter where she was standing. Tiama was in her human form.
"Morning Eina." I said in greeting.
Eina smiled. "God morning Eilwyn." She replied and looked around as if she was trying to see around me.
I looked around me. No one was close to me. I turned back to Eina. "My Team is in the Dungeon." I told Eina.
Eina looked surprised. "Oh, they went into the Dungeon without you?" She asked.
I nodded my head in agreement. "Yes, they did. I sent them down to the 18th floor." I told her.
"Why didn't you go with them?" Eina asked as Misha walked up beside Eina. "Morning Misha.
"Hello." Misha replied.
I placed the TV box on the counter.
"I sent them into the Dungeon so we could show you something." I informed Eina and Misha.
Both Eina and Misha looked at the box with confused excretions on their faces. "Why would you send your Team into the Dungeon to show me something?" Eina quarried.
[Ready?] I sent to Rosni.
[When every you are.] Rosni replied.
A red light blinked on, on the box.
"When you see that red light come on," I pointed to the light. "Just push this button." I pointed to a button and then pushed it.
When I pushed the button lights came on projecting a screen or picture over the box. The picture showed Iris, Cindy and Kimmy standing side by side with a forest behind them. All three were waving and smiling.
"What's this!?" Misha exclaimed waving at the projection.
I chuckled. "They can't see you." I told Misha.
"Oh!" Misha said and dropped her hand blushing.
"That's okay. I've waved at the TV screen, knowing the people on the other end couldn't see me. It is called a Television or a TV for short. Rosni has a camera, which takes the moving picture you see and sends that picture to the TV set here." I told her.
"My Team is on the 18th floor so you can see what it looks like." I said.
"Your Team in on the 18th floor and we can see them?" Eina asked shocked and surprised.
As Eina, Misha and I were talking. Rosni and my Team were moving around. You could see monsters flying in the distance.
"Are those monsters!?" Eina yelled.
I chuckled. "Yes, those are monsters. The 18th floor is a safe zone because no monsters spawn there, as you know. But monsters come up from the 19th and 20th floors." I reminded them.
"Where are they going?" Eina asked.
Before I could answer a male Chienthrope walked up.
"What are you two doing?" He asked Eina and Misha. It was Eina and Misha's superior, Rehmer.
"They are watching my Team down in the Dungeon." I told Rehmer.
"That's Rivira." Iris said on the TV with the entrance to Rivira in the distance. Then the picture panned to the Great Tree with the passage to the 19th floor at its base. "And that is the tunnel to the 19th floor." She said. Iris was holding her hand out to the side with her palms up with a big smile on her face, like she was showing a prize on a game show.
"What's that?" Rehmer asked me.
I chuckled. "I was just telling Eina and Misha that. This," I pointed to the TV box. "Is a Television, or TV for short. It receives a signal from the camera, which Rosni is holding. What you are seeing now is the 18th floor. Shortly they are going to head on down to the 19th floor.
On the projection screen you could see Cindy walking along and Iris skipping along beside her.
"Where is Kimmy?" Eina asked.
"Cindy and Iris are the vanguard, Rosni is in the middle and Kimmy is taking up rear guard." I replied. "Because Kimmy isn't in front of the camera you can't see her. You can only see what the camera is pointed at." I told them.
"Where did this come from? I have never heard of anything like this before." Rehmer asked me.
"It's something I came up with." I lied. I wasn't going to try to explain about Mercedes making it in the Lab back on Pern. It wasn't quite a lie; I did come up with the idea to make the camera and TV using magic stones to power them. But the TV design is from Remnant while the camera is a body camera design from Earth, and Mercedes made them on Pern.
Shortly the girls walked down the stairs to the 19th floor. Three Lizardmen and two Battle Boars appeared in front of the group.
Eina and Misha jumped and screamed at seeing the monsters.
I chuckled. "We see monsters like that all the time, down there." I said to the room in general.
"Aren't you worried that they might get hurt?" Misha asked.
"Any time we go into the Dungeon there is a chance one or all of us will get hurt." I said, although I left out that fact that there is nothing in the Dungeon that can hurt me. Or that there is not much that could hurt Cindy or Kimmy. I also left out that they all have regeneration so if they did happen to get hurt, they would heal up extremely quickly.
We could see Cindy bringing her two Gossip Yuanyang Tomahawks, Chhaya and Uisce, up to attack one of the Lizardmen. She ran towards the Lizardman head on. It looked almost like a mouse running towards a human because of Cindy's small size. The Lizardman swung a landform club at Cindy. Cindy dodged the club, using her momentum, Cindy jumped into the air spinning in mid-air with her arms extended. Chhaya and Uisce clutched in either hand. Cindy struck the Lizardman with Chhaya across the abdomen and as she spun and went higher into the air, Uisce struck the lizardman across its neck. Cindy flew up and over the Lizardman as it went up in a cloud of ash and smoke.
The room was silent. Eina and Misha just stared at the image of Cindy on the projection-screen.
"I like this. It gives me a chance to see how they fight. I'm usually fighting and don't have time to see how they fight in the Dungeon. I'll have to work with Cindy some. She kept dropping and twisting her left hand as she fought." I said nodding my head.
"That's all you can say!?" Eina almost yelled. "She's so small. That monster came close to killing her." She finished, staring daggers at me.
I chuckled. "Cindy is small but she's far from weak. Besides she didn't even come close to being killed. It's just that with her reach, she has to be close to the monsters to use her weapons." I explained.
Kimmy had already started fighting one of the Battle Boars. The Battle Boar was running towards Kimmy. Kimmy lifted Trydan her Pole Axe and started running straight towards the Battle boar. It almost looked like two freight trains on the same track heading towards each other head on.
"YYYAAAAA!" Misha screamed. "The monster's going to run her over!"
I chuckled again. "Not likely. I've seen her do this before." I explained.
Right before Kimmy and the Battle Boar collided head on. Kimmy dodged to the side, bringing Trydan up and slashing the Battle Boar along its side.
The Battle boar dropped onto its side, sliding and rolling from its momentum. Kimmy took the opening and cut the Battle Boar's head off. A moment later the Battle Boar went up is a cloud of smoke and ash.
Misha had her hand over her heart while she staired at the TV screen. "She did it. She moved so fast and just moved out of the way and killed the monster." Misha proclaimed.
By this time several of the Guild workers were watching the battle along with many Adventurers that had come into the Guild for one reason or another. All had their eyes glued to the TV screen watching the battle.
"She moved so fast." "She can really fight." "What level are they?" "What floor are they on?" Were some of the things said and asked from the Adventurers that had stopped to see what was going on.
The other monsters were dispatched just a quickly.
I reached over and pushed the off button. "What do you think?" I asked.
Misha was still looking at where the screen had been, her face was pale.
Eina wasn't much better. Her face being almost as pale as Misha's after seeing my Team fight monsters in the Dungeon. "That was real? They really fought those monsters and killed them?" Eina asked.
I nodded my head in agreement. "Yes, they just killed all those monsters on the nineteenth floor." I replied.
I looked over at Taima. Taima looked back at me and nodded her head. A moment later Taima walked out of the Guild Hall. I had sent Taima to the Dungeon to port my Team back to the first floor of the Dungeon.
I looked around the Guild Hall. "These are going to be for sale at the Hestia Familia store off of Southwest Main Street. They are 50,000 valis for one TV monitor like you saw here and one camera, which is what is needed to send the picture from the Dungeon to the TV monitor." I announced to everyone in the Guild Hall.
I picked up the TV box. "See y'all later." I told Eina and Misha; I gave them a small bow and left the Guild Hall.
I put the TV into my closet PD and walked towards Babel Tower to meet up with my Team.
"What did they think?" Iris asked after we met up.
I chuckled. "Well, Eina and Misha went pale at seeing y'all fighting monsters in the Dungeon. But the adventurers in the Guild Hall seemed to like it. I announced the TV's and cameras would be for sale at the Hestia Familia Store. So, we'll see what happens." I replied.
"Poor Eina and Misha. Seeing what it's really like in the Dungeon like that." Kimmy said.
"They have seen a monster or two on the surface, but yes, it was a shock to them." I replied.
We stopped by the Hestia Familia Store and gave Miach, Nahza, Daphnie and Cassandra a demonstration of how the TV and camera work.
Take' was at the Blue Pharmacy talking to Miach. So, he was able to see how the camera and TV works as well.
"Take', since you don't have much to do most days with your Familia in the Dungeon. What would you think of working part time here at the store. You could earn a little money while killing time." I offered. "It would give you that much more money to send back to the temple back home." I added a little incentive to the offer.
"I do not know anything about selling." Take' admitted.
I shrugged my shoulders. "Doesn't really matter. Hestia and I can help you out. You already know about weapons. There's not much more you need to know about selling weapons. And the furniture, fireplace supplies and other home furnishings pretty much sell themselves. So, you should be able to make sales. Think about it and let us know." I replied.
"I will think about it. Thank you." Take' told me.

So, trying to stay on a budget and the Yard Sale gods were with me.
I missed the sweet infotainment center. Big enough to hold a 60-70 inch and gray, my color scheme. The round table pictured odd. It's wood with a grey varnish. (Weathered Grey Oak on a google Consult) Also, 2 huge lighting fixtures with reversible fans. They are Hunter, which is a good name. One needs a plate(?) but less than a fan! The kicks are brand new Avias, in my exact size(a half size even!). The rack has hanging hooks on the bottom. It cost me just under a 100 for everything.
Not bad considering the amount and quality of what I got. I also threw out a good deal of garbage pieces that were destroyed or not working in the house. That includes our current tv stand which was filled with substances better not discussed and was two seconds from falling done.

Dirk Thiele: Dear viewers of Avia tv, we say hello from the Sauerland in the spa hotel where team Germany is hosted since years and when Andreas Wellinger stayed in Willingen, he didn’t sleep somewhere else as well, right?
Andreas Wellinger: Yes, I always stay here. For the 5th time, just one time I had to intermit.
DT: So last night you got renamed?
AW: Yeah, more or less. They made little pun, made Willingen to Wellinger.
DT: They made Wellinger to Willinger.
AW: Yeah, whatever. Anyway I’m kind of native now.
Gerd Siegmund: Are you already a member of the ski club?
AW: They offered me yesterday and I told them we still have to talk about the details. But I think I rather stay in Upper Bavaria.
GS: Peter will do that, Peter Knoll, your manager.
DT: But therefor I’m a member here. Everything’s fine.
AW: Yes, that’s enough.
DT: Yesterday you won the qualification with a perfect jump. One year ago you also won the team competition. So you can’t say you don’t like the hill.
AW: You could say that. It’s a really cool hill, the biggest large hill of the world. It’s fun to jump in front of that backdrop. But yesterday’s jump was not completely perfect yet.
DT: Is there even something like a “perfect jump”? Have you already had one?
AW: Probably not. There’s always something you could do better and so also yesterday was still room for improvement. But all in all I trained well and did a good jump and it’s really nice if I can win the qualification with such a jump, but now I have to look forward to today’s and tomorrow’s competitions.
DT: And you’ll just take the 2000€ along. You actually do not need it, because you’re already a wealthy man.
AW: How do you want to know that?
DT: According to all accounts. They say sponsoring works well… that they chase after you. For example Milka, you’re the successor of Martin Schmitt.
AW: But that’s just that I don’t get too thin, that I get something to eat.
DT: Ah, some bars of chocolate as reserve.
AT: If I remember correctly you also got something from them, right?
DT: From Milka? I got two bars from you. Active corruption!
GS: Two bars? Probably two kilos?
DT: No, two normal sized bars, not even the big ones.
GS: Sometimes you should be pleased with the little things, Mr Thiele.
DT: Welli, so please do not distract. We were at the topic Martin Schmitt and there were rumors about his own bed linen. That’s not possible, is it?
GS: He had his own collection at that time.
DT: And you were sleeping (...in it??? He is like the worst interviewer ever)
AW: Yeah, I was sleeping in my bed, that’s correct. Could be possible that I wore nappies back then… nah, it’s not that long ago… but I have heard something about that, but I don’t know if it’s true.
DT: But there is connection between both of you in sponsoring. Martin Schmitt got sponsored by Milka and then they thought “Andreas Wellinger, a nice guy, very popular with the girls, who also eat some chocolate from time to time…” Did they tell you why they’ve chosen you?
AW: If you say so, it must be that way… Well no, my career started very well and fast. I consider it an honour to represent that color and label. They support winter sports since a very long time and I’m happy every day I can wear the helmet or hat and ski jumping becomes more fun then.
DT: But eating all the chocolate is not that easy considering your weight?
AW: No, I don’t have any problems at all. I got good genes from my dad. If I’m hungry for a schnitzel, I eat one and if I’m not, I don’t.
DT: So you’re a bad food processor?
AW: No, a good one.
DT: A bad one!
AW: A good one. What I take in, gets processed well.
DT: But if you can eat all that stuff, not all of the calories get used.
AW: We could ask the expert.
GS: The Nutritionist? Well, of course he is a good food processor.
AW: 2:1
DT: People, send the employment agency…
GS: Change of subject maybe?
And the discussion goes on...
AW: Just admit that he is correct.
GS: I did so on TV for 13 years and had my peace. (They we’re both German Eurosport commentators for years.)
AW: 13 years?
DT: So you wanna continue without me? If you go on that way, we’re gonna talk about Nordic combined and skiing.
AW: With pleasure. I still don’t want to ski.
DT: I thought so.
GS: Ski fast.
AW: I like doing it as a hobby in my free time, but not in a professional way. It was never my thing.
DT: So let’s be serious. Why did you start as a Nordic combined athlete?
AW: That’s just the typical way. Everyone starts there, learns the basics, so you’re not focused on a special thing from the beginning and I think that’s good, because you can try different things then. Then it develops individually, one is better at jumping, one better at skiing and everyone goes his or her way.
DT: Are you still interested in what the combined athletes are doing?
AW: Of course!
DT: They are too successful, I think.
AW: Yeah, the results are the same eventually which is not the best for the sport in the end.
DT: That’s why you don’t win everything, right?
AW: Pretty much… Last week I watched the race and that was a good promotion for the sport. When there are 20 athletes within 10 seconds during the last round. Things were really happening there. That’s really fun to watch.
DT: So your heart is still beating for Nordic combined?
GS: That’s the general interest in sports. Many athletes watch other sports. The football player who is interested in winter sports or just the other way around: like you as a passionate FCB fan. Every professional athlete has interests in other disciplines. Unfortunately you meet rarely to talk.
AW: Yeah, you know how much hard work it is to achieve such results.
DT: So we were talking about the “perfect jump” which actually does not really exist. Are there still ups and downs or did you put them ad acta after Bischofshofen?
AW: There are always variations because it’s just a very sensible sport and the power density is high. But I think they reduce and I’m on a steadier level now.
DT: How did it affect you to win the qualification and not reach the second round then?
AW: It shows how close it is between victory and loss in this sport. One day it was an amazing experience, also with the hill record which lasted about 11 years I think - and on the next day it’s just the opposite. There were a few factors coming together: shorter inrun, tail wind and then you get that result and are in a bad mood. But the next day it goes on, I try to look forward and work on.
DT: On the surface you seem to have a cheerful disposition and I have the impression you just consider it as over and are done with it.
AW: On the inside as well.
GS: It doesn’t always have to be so complicated. But what do you think about asking the FIS to start the world cup like about two weeks earlier? Then the shape of the German team, especially of you and Richard Freitag, would have been to the point for 4HT.
AW: If you look at this season, it would have probably worked out. Basically you could do this. I mean it’s cool to see the dedication of the people in Klingenthal, how they drudge to get the hill ready. But in my opinion you could also go somewhere, where snow and good conditions already are at that time. So we’re back at the topic North America. We will be allowed to go there with Ironwood next year…
GS: But Ironwood is a ski flying hill.
AW: Exactly.
GS: I mean it could be interesting to start the season with ski flying...
DT: I think it got rebuilt.
GS: Yes, it was already a big one.
AW: It’s a surprise how it’s gonna be. Basically there are the opportunities in North America to start the season earlier. Why they don’t use it…
GS: I think this a financial problem. Apart from that it’s famous, like the Olympic games of 2002 in Salt Lake City. Because of the time shift it would be a reasonable thing. You jump in the morning and we watch it in the evening. People were already discussing about that. But what I was talking about was your shape and to start two weeks earlier because of that. You could also train two weeks earlier, but who knows that?
AW: If you could wish it that way, it would be easy. But it’s not always easy to time to the point. The positive side is there is an upward trend.
DT: Let me chase this up. We asked Richard Freitag the same question. Are you able to calculate how to build up your shape in ski jumping?
AW: No, this is not possible. Of course you aim it and try to prepare for such events and it probably works in many cases. But you cannot certainly say “I’m gonna jump best in three weeks if I stay at home for two weekends to train.” That won’t work.
DT: There are automated motion sequences in ski jumping. But it doesn’t work automatically, there is tail wind, up wind, there are too many concomitants that disturb automatisms. You have to accommodate to this. Does that work in every competition, that you factor all that in?
AW: No, because we don’t know it anyway. When you have a competition like Wisla where conditions change so fast and you stand on top of the hill, you don’t if there is tail wind or up wind as an athlete. You have to do your jump and if you do a good one it will work with both conditions.
DT: So it’s the same technique, you don’t change anything like an angle or something?
AW: I do not know if nations like Slovenia with a more extreme jumping style knowingly change something. But I don’t.
GS: So you changed your material in summer like some other athletes, too, which is pretty common to test things. But I remember that statement after your crash in Kuusamo about intensifying the edge of the ski. Did you take this back in the current season?
AW: Of course you try to keep the skis flat to get more inflow and feedback of the ski, but the change from flat ski to more edge was unknowing. It’s a process that develops if you change the jump, your body’s forces and the athletic. These are all unconscious concomitant effects with the goal to jump better.
GS: So you keep the skis flatter now?
AW: It’s not that easy, but I try to. It just takes about several 100 jumps.
DT: Andreas Wellinger and publicity, the girls. Here in Willingen it’s much more pronounced. You’re coming from training and walk by the crowd and don’t want to disappoint anyone. It’s a balancing act. You also need the time to focus on the next jump.
AW: Yes, like yesterday. After the first training you don’t just want to walk by. These fans are waiting there for hours. This is also the great feeling, when you’re sitting above and see all those people. But down there is always not enough time to stop, give autographs and take pictures. So yesterday’s team presentation was really cool. We went down there again afterwards and had more time.
DT: So I heard your postman already has a crooked back if he comes to you because there is so much fan mail. Can you still manage this?
AW: I can manage it, I also get help.
DT: You have employees.
AW: No employees, my family helps me. That’s also a work you really like to do. There are lots of nice letters, like drawings from little kids where you just smile when opening the letter.
DT: Do you want to talk about your private life?
AW: Nope.
DT: You’re taken?
AW: (shrugs). I’m happy with my situation.
DT: What a rascal…
GS: “Wanna talk about your private life?” “No” “But how is your girlfriend?” (laughs)
DT: So now you can imagine how his private life looks like. So he’s happy… And we want that you stay happy, because there is probably a correlation. If everything’s fine in private, there are no worries, then this affects the jumping, too, or is this unimportant?
AW: I think if you have or had stress at home, you unknowingly take it to the competition and are distracted. But family and support from home are very important, so you have a balance between tension and relaxation.
DT: Is there a hierarchy in the team? Unfortunately Severin Freund is hurt and this will take its time. You just say no until I finished the question. So Richard Freitag and you don’t set yourself apart from the rest?
AW: No. Maybe from the outside you might think there is a gradation or hierarchy according our performance, but that doesn’t exist. We have a great team, a good atmosphere, everybody tries to give his best. We spend so much time together during the year, that we need to have fun together and enjoy the time. So I can just say it’s cool to be around with that team.
DT: You share your room with someone who is quite shy...
AW: Depends. Our native… (=Stephan). Basically he is calm and modest. That makes it comfortable, because you can relax and it’s fun.

Identification? Hallucination? Falsification.

For the purpose of this article I will be referring to the expert witness statement of Dr Kathy Pezdek, document 16-7 from the Federal Petition of the Writ of Habeas Corpus, filed by the Federal Defenders Office 17th December 2008.
For ease of clarity when discussing the tainted line up procedure, I will briefly mention the events that led up to it. Those events will be comprehensively covered in a later article.
Police sketch released August 30th 1985. A point was made that the assailant had “straight, white teeth”, which considering that Richard had excessive dental problems, doesn’t sound quite right. No, I’m not seeing a likeness here..
On the 30th August 1985, the final police sketch of the man suspected of being the notorious “Night Stalker” was released to the media. That in itself is odd, because by then they were already in possession of his mug shot, which was released to the world and was soon seen staring out of every newspaper stand and TV. Law Enforcement had a man in their sights and now it was only a matter of time.
Not even if I squint.
After the well documented and public beating Richard received in East Hubbard Street after the release of the mugshot, LAPD wasted no time getting him into a live line up.
It should be pointed out that the people who attacked Richard in the street that day didn’t realise they were beating up the most wanted man in the USA, but a car thief after a failed carjacking. The officer in attendance, Deputy Sheriff Andres Ramírez (no relation), was told by Manuel De La Torre that Richard had attempted to steal his car and assault his wife. It wasn’t until the Deputy Sheriff asked for his name that realisation began to sink in. Richard was placed under arrest for attempted grand theft auto and assault. He was unarmed, compliant and non-aggressive. The most evil man ever born, was apparently, not carrying a weapon, although it has been said he threw his gun away. No gun was seen or recovered. A bit like those famous Avia trainers, that no one ever saw him wear, or throw away. If Richard had a gun that morning, does anyone seriously think he wouldn’t have hesitated to use it as he was running for his life? After all, this is the man they call the Night Stalker, right?

Richard had taken a severe beating, bleeding heavily from being hit on the head twice by a metal pole, an ambulance was called. This “street justice” meted out from a posse of enraged citizens may just have saved his life “as an LA Times reporter said that an order had been explicitly given out to police ‘we don’t want a trial for this guy’” (Taken from Programmed To Kill; The Politics Of Serial Murder by Dave McGowan) In other words he was never meant to be taken alive.
Alas for Law Enforcement he was handed over very much alive, his head wounds treated and completely covered in gauze bandages. With helicopters circling above, an angry crowd and a plethora of cameras, this drama was now playing out directly in the public gaze. Everyone had now seen his face staring out from every news stand and directly from their TV sets into their homes; he was instantly recognisable.
Into The Fire..
The line up took place on 5th September 1985, a couple of days after two award ceremonies had taken place honouring those citizens instrumental in taking the infamous Night Stalker off the streets. All before he’d even been identified, arraigned or even charged. He was already tried and found guilty in their eyes.
Varying police composites. Described at differing times as light, “Oriental”, 5ft 7 to 5ft 9 (Richard was 6ft 1) and my personal favourite, seen with a cat on his shoulder carrying, a tub of ice cream, about three blocks away from a crime scene.
Richard really didn’t want to take part in the live line up as he knew his face had been spread all over the media. He also had an obvious head wound with two shaved patches on his head where treatment had been administered. All knew the circumstances of his arrest and these wounds would not go unnoticed, especially as he was the only one out of the six individuals on the viewing platform that day with an injured head. Also Richard appeared that day for the first and only time with a side parting in his hair. A deliberate move, perhaps, to more closely match the last eye witness description given of him on August 30th? At no point before or since did he style his hair that way. Richard was given place number 2, with a board bearing the number round his neck.

There were so many witnesses called to participate that day that there had to be two separate line ups. Public Defender Alan Adashek (briefly assigned to Richard) stated in court that he and 5 other public defenders had gone to the line up to make sure everything was done correctly and fairly. This seems to not have been the case as witnesses we’re allowed to gather together before hand, discuss and swap notes. Public Defender Judy Crawford also attended the line ups that day to observe, she later testified in court that she had noticed Deputy John Jones hold up two fingers to the assembled audience during the first line up. Apparently, she didn’t think much of this until she saw that Richard was in position number two. Her suspicions were then confirmed at the second line up when another deputy, Tom Hyeboek did the same. Two fingers were again held up to the audience as he said “Does anyone have any questions?”
So here we have a room full of tense and upset people, perfectly understandable considering the awful circumstances, most of whom, if not all, had seen his face plastered over every media outlet for days. Were they being subtly coached and encouraged to pick the man they’d already decided was guilty? It certainly looked that way to the lawyers observing. A kangaroo court in the making, even before the fact.
The public defenders in attendance during those biased line ups filed an objection sheet, pointing out the media saturation, visible head wounds and the deputies and their fingers. However, during the trial itself, Prosecutor Phil Halpin lied and said he’d never been given it. That, as it turns out, wasn’t the truth and the objection sheet was duly produced and handed to Public Defender Ray Wallen to read out to the jury. Halpin was proven to have been wrong and to have lied.
I am using this eyewitness identification taken from the Writ of Habeas Corpus to demonstrate how perceptions change, along with descriptions after prolonged exposure by the media.

It is beyond imagining that anyone looking at the composites of Richard could readily identify him from those alone. None look anything like him and it’s absurd to suggest that they do. For eyewitness identification other methods must be employed, whether that’s a live line up or in court but what happens when the procedure is tainted from the start? The eyewitnesses were hopelessly compromised by their exposure to media coverage, daily, hourly, attested to in the court documents, of which I given an example above, although there are more.

How they managed to morph the composites by rubbing bits out here and there… they still don’t and never will match.
As for composites, below is a double one, with the one of “Richard Ramirez” on the left and one of the GSK aka The Golden State Killer on the right. A closer match to each other than the left hand one ever was to Ramirez!

In the aftermath of this wholly inappropriate line up Public Defender Alan Adashek gave the following statement to the LA Times. “The publicity is so intense, so intense and constant, over so many days, it’s really a problem. A major problem. The effect of all this massive publicity can be very negative in terms of a fair trial”.
And so it came to pass. The first stage in the railroading of Richard Ramírez.

Justice League Beyond
As a sorta kinda follow up to my Young Justice Beyond Lineup, and inspired by @the-antiapocalyptic-man‘s Beyond era, I’m thinking of an equivalent lineup to Batman Beyond’s JLU.
Superman’s been [Redacted] by the Beyond era, so the man sort of taking his place actually one of the Marvel family. I’m leaning towards Billy, but I’m open to suggestions.
Barda’s there, and she’s sort of thrown herself into the league due to her allies and friends dwindling, most of the New Gods having died (Scott included) and a bit of empty nest syndrome with Avia & Jacob gallivanting around the universe.
Warhawk’s there and basically unchanged, and with Mareena & Kai Ro more affiliated with the YJ, I’m coming up with substitutes. For the Aquafam rep, I’m actually thinking of La’gaan’s kiddo from the Young Justice TV show, maybe as Warhawk’s teammate? And instead of a Lantern, I’m adding a more-or-less OC called Generator.
Generator’s story is actually tied into Jason Rusch/Phoebus. Another Scion of the Firestorm Beyond Project, Generator was created by adding a Firestorm Matrix to to act as a power source/matter replicator to a next gen Magnus pattern Response-O-Meter, coordinating a breakthrough in a biotech nanobot infused ferrofluid, with the resulting intelligence basing themselves off of the cartoon known as Generator Rex.
Alinta is there as Bolt, as is Micron, who's basically gonna be an OC, but Ryan Choi’s graduate student. Maybe a Duncan kid in there, and topping it off with Drake Winston, AKA Bluebird, with Maps Mizoguchi serving as a mission coordinator.
I’m still working on a magic character, but that’s it for now.

Zaki: This morning I came down to the cafeteria to get a coffee, one that wasn't good, actually it was horrible, and my days sucks when they start with bad coffee, but then I look up at the TV and there it was, a gorgeous, breathtaking woman giving the news.
Zaki: Then it hit me, I can text that beautiful woman and wish her to have a lovely day, and just like that my day suddenly didn't felt as bad anymore, in fact, it made me feel like a very lucky man.
Zaki: So good morning Miss Fletcher, I hope you have a great day today and thank your for fixing my coffee fiasco, with that smile.
