Supreme Court Overturns DOJ's Use of Key J6 Felony Court

JUN 28, 2024 In a devastating but well-deserved blow to the Department of Justice’s criminal prosecution of January 6 protesters, the U.S. Supreme Court today overturned the DOJ’s use of 18 USC 1512(c)(2), the most prevalent felony in J6 cases.

The statute, commonly referred to as “obstruction of an official proceeding,” has been applied in roughly 350 J6 cases; it also represents two of four counts in Special Counsel Jack Smith’s J6-related criminal indictment of Donald Trump in Washington. 

In a 6-3 decision, Chief Justice John Roberts wrote that the “c2” subsection is tethered to the “c1” subsection that addresses tampering with a record, document, or “object.”

From the opinion:

Roberts was joined by Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Ketanji Brown Jackson. Justice Amy Coney Barrett authored the dissent (!) joined by Elena Kagan and Sonia Sotomayor.

Today’s decision means hundreds of Americans have been wrongfully prosecuted by Attorney General Merrick Garland as he insists his department is dedicated to upholding the “rule of law” and pursuing justice “without fear or favor.”

An Irreversible Black Eye for DOJ and Federal Courts in Washington

The matter originated in the case of Joseph Fischer, a Pennsylvania man who attended Trump’s speech and later went to the Capitol. According to court documents, Fischer briefly entered the building around 3:25 p.m., nearly an hour after the joint session of Congress to certify the electoral college votes had recessed. He exited about four minutes later.

In March 2021, a D.C. grand jury indicted Fischer on numerous counts including 1512(c)(2). The statute reads:

Whoever corruptly— 

(1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or 

(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so.

It is punishable by up to 20 years in prison.

Fischer, in addition to many J6ers facing the count, asked his judge to dismiss the charge. Judge Carl Nichols, appointed by Trump, dismissed the count against Fischer and two other defendants by finding the language in the post-Enron/Arthur Anderson statute covered tampering with records or documents not interrupting a meeting of Congress. The DOJ appealed Nichols’ decision.

In December, SCOTUS granted Fischer’s petition to grant cert seeking to reverse the appellate court’s mandate. Oral arguments were held on April 16.

Nichols is the only judge to have dismissed the count; 18 district and circuit court judges in Washington refused to dismiss the count. The judges essentially enabled the Biden DOJ’s unlawful pursuit of Americans who protested Biden’s election that day.

There Goes Your Summer, Your Honor

The federal courthouse in Washington has been bracing for a flood of motions post-Fischer; a few judges have released individuals from prison in anticipation of a reversal. Roughly 110 J6ers have been sentenced to prison on 1512(c)(2) convictions; several J6ers were held under pretrial detention for being charged with the nonviolent obstruction count alone.

But despite the law’s legal limbo over the past year, U.S. Attorney for the District of Columbia Matthew Graves, a Biden appointee, continued to indict J6ers on 1512(c)(2) while some judges continued to sentence those convicted to lengthy prison terms. Last month, Beryl Howell, the former chief judge who upheld the 1512(c)(2) charges for defendants in her courtroom, sentenced a Missouri man to 60 months in prison for the 1512 conviction and assault on police.

In January 2022, Howell gave the green light for her colleagues to support the DOJ’s use of the obstruction count. Here is what she said in denying a motion to dismiss filed by two J6ers:

“For over 200 years, the peaceful transition of power from one presidential administration to another has been marked with Congress's certification of the Electoral College vote; and this event has been respectfully observed by American citizens, but not on January 6, 2021. And I start with this historical fact because what happened on January 6th was a chilling new type of criminal conduct to which our criminal laws have never before had to be applied. Application of criminal laws to conduct never before seen, like what occurred on January 6, 2021, appropriately generates the kind of legal questions the defendants raise here about whether the criminal law fits the charged criminal conduct.”

The first judge to uphold the obstruction charge in J6 cases was Trump-appointee Dabny Friedrich. In 2021, she agreed that interrupting a meeting of Congress met the definition of “official proceeding” and that the statute’s broad language did not require the government to prove the conduct involved tampering with records or documents.

Ironically—or not—Friedrich is married to Matthew Friedrich, a former DOJ official who worked on the Enron Task Force alongside Andrew Weissman and current deputy attorney general Lisa Monaco. The 1512(c)(2) statute was a product of the Enron/Arthur Anderson investigation; Weissmann, as the lead prosecutor for Special Counsel Robert Mueller in the bogus Russiagate probe, pushed the DOJ to charge Trump with 1512(c)(2) while in office.

Retired judge Thomas Hogan recently warned how a SCOTUS’s reversal of 1512(c)(2) would affect the DC courthouse. Here is Hogan, who upheld the statute in J6 prosecutions, with former DOJ official and FISAgate mastermind Mary McCord:

Reacting to the SCOTUS decision, Geri Perna, aunt of Matthew Perna, told me this by email:

“When Matthew was unexpectedly charged with the felony of Obstruction of an Official Proceeding—after initially facing only misdemeanors—his world collapsed. The weight of a potential lengthy prison sentence bore down on him, filling his days with insurmountable worry and anxiety. At that time, there was no glimmer of hope that this severe charge would be dropped.

Matthew has now been dead for 28 months. In the wake of his passing, the Supreme Court of the United States is finally set to rule on whether the Department of Justice wrongfully applied 1512(c)(2) in January 6 cases. As much as I am hopeful for a just ruling in favor of the January 6 defendants, I am consumed by a profound sense of loss and anger. My nephew's death was both avoidable and senseless.

I feel cheated, and if that sounds selfish, then so be it. The pain of losing Matthew under such circumstances is a burden I carry every day. I fervently hope that those responsible for wielding this charge erroneously will be held accountable in a court of law. However, I am not holding my breath.”

I was looking at that new photo of John again this morning, and thinking about that quote 'cementing the Sugdens' back in the village... We've figured out he's Vic's brother and is more than likely meant for Aaron. It feels like they probably want him to stay longterm.

All this got me thinking of all the people they've brought in, say in the last 5 years or so. Often they get on of these photos, shot somewhere in the Dales to announce their arrival. They often already have, or end up with familial bonds to other characters. Others are more brought in as romantic links of course.

Anyway, I've put together all the ones I could think of that are now gone or on their way out soon. (Also, as a side note, quite a few of these characters have been gay. Or, in Luke's case maybe bi, I'm still unsure because I refused to watch the Posners.)

Let me know if I've left someone out, I'll add them in.

Some of these still confuse me to this day. The made a pretty big announcement about the recasting of Georgia Sharma, for her to only be in a handful of episodes. There are other headscratchers as well, like Chloe's dad, who died shortly after this promo photo was released. Not to mention that Chloe left during Laura Norton's maternity leave...

What was the point of young Oscar? Naomi's short stint? Victor's even shorter? Making Marcus Pierce's son?

Amit was another one that lasted waaay shorter than I thought, and now Nicky and Suni are leaving because the actors weren't happy with their material it would seem.

Meena, Paul and Tom were obviously brought in with the sole purpose of being villains with a timeline.

I think Jamie was a character they really wanted to keep longer, but he wanted out, just like Joe before him. They probably wanted Ellis to stay as well, but we all know what happened there...

(And I put Sandra in there, just because it was so horrible of them to bring her back in a story that would completely destroy Liv's relationship with her mum before her death, instead of healing it. Who thought of that gem?)

As for those who have stuck around, we have Mandy & Vinny, Charles, Wendy (why?), Mackenzie, Bear, Mary, Suzy, Gail, Claudette, Caleb, Ruby, Ella and Rose (for now). I'm not sure if Ella and Rose are meant to become permanent residents of the village or what they might have planned there...

Meg őszintén, imádom az érzelmi részét és a metaforákat meg ilyeneket. Az egész világot is amit megteremtett. A hatását is. Tudom hogy egy csomóan emiatt a sorozat miatt kezdtek el olvasni és szerették meg a könyveket, vagy egyenesen lett belőlük könyvmoly:D Az meg jó hogy többen vagyunk! 💕

Jaspernél aztán tényleg voltak extremitások, egyik végletből a másikba, nagy változások, amiket nagyon tudtam becsülni benne mert pontosan tudom hogy milyen nehéz. Meg a sorozat során is folyamatosan változott szerintem, annak ellenére hogy tudjuk hogy kőből van mint a többiek... Imádtam ahogy védi Alice-t🥺💗

On Sai Vágymágusok sorozata — az volt nekem életemben a 2. fantasy sori ami nagyon a lelkemre fonódott, pedig szeretek olvasni, és a posztolási előtt rengeteget is olvastam:D- Az első A Szirt Krónikái sorozat volt Paul & Chris Riddelltől. Azt hiszem cirka 11 éves koromban olvashattam először, és azóta is az egyik legjobbnak tartom azok közül, ami valaha is a kezeim közé került.

Paul Stamets világhírre tett szert a Netflixen ma is elérhető dokumentumfilm, A gombák lenyűgöző világa egyik főszereplőjeként. Nem csak a világ egyik legelismertebb mikológusa (gombaszakértője), de egyben a pszichedelikus gyógyászat egyik úttörője is. Nagy öröm volt megismerni személyesen is a haarlemi tudományos konferencián, ahol végre meg is interjúvolhattam és feltehettem neki pár kérdést (a videóinterjú linkje a kommentben, sajna egyelőre csak angolul, de alább összefoglalom magyarul is).

A sci-fi rajongók számára bizonyára ismerős a Star Trek Discovery című sorozat, ami egy 23. századi űrhajó legénységének kalandjait meséli el. A hajó képes arra, hogy átszelje a teret és az időt - és ebben egy olyan különleges hajtómű segít neki, ami képes kapcsolódni egy titokzatos, a téridőt átszövő pszichedelikus micélium-hálózathoz - mikoverzumhoz (mükész görögül: gomba).

A Star Trek eme gomba-hálózatának ötletét nem csak Stamets inspirálta, de a sorozat alkotói egyenesen róla nevezték el az űrhajó gépészét is. Ez persze science fiction. De mivel Paul Stametshez hasonlóan magam is Star Trek-rajongó vagyok, így már régóta szerettem volna megkérdezni a gombakutatót, hogy mit gondol, hogy ilyen módon gondolták tovább a varázsgombával kapcsolatos elképzeléseit. Stamets szerint nem véletlen, hogy a világegyetem - akár a makrokozmoszt, akár az idegrendszer, vagy a gombahálózatok mikrokozmoszát nézzük - hálózatos szerkezetben épül fel. Ahol a hálózat pontjai folyamatosan kapcsolódnak, elszakadnak, újrarendeződnek. Bizonyos értelemben a varázsgomba által nyújtott pszichedelikus élmény ma is megnyitja egy multiverzum kapuit: a fogyasztói arról az élményről számolnak be, hogy megtapasztalják, hogy az univerzum alapvetően egy közös tudatra épül.

Megkérdeztem Stametset arról is, hogy mit is ért az alatt, hogy a varázsgomba megmentheti az emberiséget. Megmondom őszintén, én azon szkeptikusok közé tartozom, akik a hasonlóan bombasztikus kijelentéseket, legyen szó akár kannabiszról vagy varázsgombáról, egy nagy adag fenntartással fogadom. With a grain of salt, egy csipetnyi sóval, ahogy az angol nyelv találóan fogalmaz.

Stamets válaszában kifejtette, hogy nem önmagában a gomba az, ami megmenti az emberiséget - hanem az üzenet, a tanulság, amit az ember a pszichedelikus utazásból leszűrhet és felhasználhat. Albert Hofmannhoz, az LSD felfedezőjéhez hasonlóan úgy látja, hogy a pszichedelikus élmények elmélyítik az ember felelősségének tudatát azzal kapcsolatban, hogy harmóniában éljen a természettel. Az egész bolygó ökológiai egyensúlyát fenntartsa és megőrizze.

"Az evolúcióból szerintem nem azt a tanulságot vonhatjuk le, hogy a legrátermettebb él túl, hanem az, hogy meg kell osztanunk a feleslegünket a felebarátunkkal, aki kevésbé kiváltságos helyzetben van, mint mi," mondta. A pszilocibin által előidézett élmények azt az evolúciós tanulságot segítenek felismerni és hasznosítani, hogy felelősek vagyunk egymásért és a bolygóért. Ez nagyon fontos egy olyan kritikus időszakban, amikor az ember tevékenysége miatt a fajok tömeges kihalásával kell szembenéznünk.

Stamets szerint a tudományos bizonyítékok alapján a pszilocibin serkenti a neuroplaszticitást (az idegrendszer rugalmas újrarendeződési képességét) és a neurogenezist (új idegsejtek képződését). Szerinte ezt a hatását akkor is kifejti, ha valaki rendszeresen mikrodózisban (tehát a tudatállapot-változáshoz szükséges küszöb-dózisnál kisebb adagban) fogyasztja. Saját kutatásai az utóbbi időben ezzel a területtel, a mikrodózissal foglalkoznak a leginkább.

Stamets kidolgozott egy különleges mikrodózis-kombinációt, ami szerinte különösen eredményesen serkenti az emberi idegrendszer fejlődését, és ami három összetevőből áll:

1) a pszilocibin (a varázsgomba hatóanyaga)

2) a közönséges süngomba (egy nem pszichoaktív gombafaj, amelynek az ígéretes idegrendszer-serkentő hatásairól az utóbbi években több kutatás is beszámolt)

3) és niacin (avagy B3-vitamin).

Stamets szerint a jövőben ez a formula akár forradalmasíthatja az ún. neurodegeneratív (az idegrendszer pusztulásával összefüggő) betegségek (pl. Alzheimer, Parkinson stb.) gyógyítását. Egyelőre csupán ígéretes pre-klinikai vizsgálatokra hivatkozhat, a komoly klinikai vizsgálatok, amelyek embereken, szigorú módszertannal végeznek, még váratnak magukra. Azok a placebo-kontrollált vizsgálatok, amelyeket ezidáig a mikrodózissal kapcsolatban végeztek, óvatosságra intenek bennünket. Így például egy magyar kutató, Szigeti Balázs a Drogriporter Szabadegyetem előadásában is beszámolt arról, hogy saját kutatásokban az LSD mikrodózis pozitív hatásai valósak, de a placebót szedő embereknél is éppúgy jelentkeztek. Stamets mindenestre nagyon szuggesztíven képes magyarázni a mikrodózis pozitív hatásait. Szerinte a mikrodózist és a makrodózist nem binárisan kell elképzelni, ez egy spektrum.

Az első könyvét a témában 1978-ban írta, amikor én születtem: és azóta valóra váltak az álmai. A pszichedelikus kutatás reneszánszát éljük. Szerinte nagy különbség az akkor időszakhoz képest, hogy a társadalomban egyre kevesebb a paranoia, amikor ezekről a szerekről esik szó. Hite szerint minden embernek veleszületett joga van a tudatmódosításhoz - és ezt egyetlen kormány sem veheti el tőle.

Amikor megkérdeztem tőle, hogyan látja a pszichedelikus terület fejlődését 10 év múlva, akkor nagy meggyőződéssel azt felelte, hogy "a pszichedelikumok lesznek a jövő nootropikus (idegserkentő - a szerző) vitaminja". Masszívan csökkentik majd a bűnözést azáltal, hogy forradalmasítják a mentális egészségügyi ellátást. Nem tagadja, hogy elfogult: számára a pszichedelikus kutatás nem csak egyszerű érdeklődés, hanem egyfajta küldetés. De szerinte mindenki elfogult, még a magukat legobjektívebbnek tekintő egyetemi professzorok is. Ő legalább beismeri. Hogy a várakozásait beteljesítik-e a pszichedelikus szerek, az a jövő titka.
