The town that gave the world Spam is proud to be ‘autism-friendly’

AUSTIN, Minn.--The tall teenager with the buzz cut opened the museum door, extended a large hand and said cheerily, “Welcome to the Spam Museum.”

Samuel Ehret is an official “Spambassador” at the museum, a hot spot for tourists who have a taste for the much-mocked canned meat that has been made here by Hormel Foods for 81 years.

Samuel is also autistic, and he got this job because he loves all things Spam--its taste, its history, and especially the museum’s showpiece: a motorcycle that runs on bacon grease.

He also landed the job because Austin is an autism-friendly town. Ten years ago, it became one of the first in the country to launch a community-wide effort both to reduce the disorder’s stigma and make local businesses aware of the special needs of autistic customers. It is also probably the only small town in America to employ a community autism resource specialist.

The mission was “a grass-roots effort to improve our community,” said Mary Barinka, an employee of the nonprofit Hormel Historic Home, where she serves as an autism resource liaison for Austin. She is also a former Hormel marketing executive, and the mother of a 16-year-old daughter with autism.

For someone like 18-year-old Samuel, the town’s attention to the condition has been invaluable.

“When he was an infant, he would just lie there, no crying,” said Sarah Ehret, Samuel’s mother. Her son failed to reach expected milestones on time and she was at a loss as to why. When someone anonymously placed a magazine in her mailbox, it suddenly made sense. One of the articles was “Top 10 signs your child has autism.”

“This is my son,” she said to herself.

Autism is a neurodevelopmental disorder that is characterized by delayed language, repetitive behaviors, sensory sensitivities and difficulty with social skills. Although the symptoms of autism can overlap with other developmental disorders, such as learning disabilities and attention-deficit/hyperactivity disorder, it has distinctive characteristics, including narrow, intense interests and routines and occasional emotional meltdowns when those routines are disrupted.

More than 3.5 million Americans have been diagnosed with this disorder, according to the Autism Society. In April, the Centers for Disease Control and Prevention revised the estimate of those with the disorder to 1 in 59 children, four years after it was set at 1 in 68. Most experts attribute the increase to more-precise diagnostics and enhanced awareness of the disorder, particularly in black and Hispanic children.

Austin, with a population of 26,000, is the kind of place that still has a video store, where the one coffee shop in town is called “The Coffee Shop,” and a yellow traffic sign near a nursing home carries the warning “Dear Crossing.”

Fifteen businesses in this Midwestern hamlet carry the official designation “autism-friendly.” Among them: the Paramount Theater, Mid-Town Auto, two dentists, two ophthalmologists, two hair salons and three summer day camps.

To qualify as autism-friendly, a business must make an effort to minimize sensory overstimulation--lowering lights, turning down or eliminating loud music, and shielding the individual from others’ cross talk.

Business owners must fill out an application and then, along with their employees, go through educational sessions. They learn about the difficulties people with autism experience, including their triggers--a sound or a smell or an unfamiliar situation that may cause a meltdown. They also learn how to interact by speaking slowly, in a clear voice and in short phrases. Most important, they are shown the value of learning to be patient and flexible.

Jackson Schara has been to dentist Catherine Guy a number of times, and his first visit was so surprisingly comfortable that he made a YouTube video explaining why other people with the condition shouldn’t be afraid to go to an autism-friendly dentist.

Standing next to Jackson on a recent visit to her office, Guy described what she did for him that first time:

“It’s a sensory thing, so I told him about the armrests, the bib around the neck, that the chair will move. Then I offered him a bear or a weighted blanket on his chest for comfort.

“I also show them the special toothpaste, let them smell it, and do two or three teeth at a time. I let them experience the suction device, and even do a practice run.”

Sunglasses protect the patients from the harsh lights used to peer inside a mouth. A mirror is also available if they want to watch the dentist at work.

The value of these autism-friendly efforts is incalculable, families say, because it not only makes the lives of those living with autism easier, it also allows them to have experiences that those without autism have routinely. Best of all, they are lessons in communication, one of the chief skills that many children with autism must work especially hard to develop.

Jackson’s mother, Heidi Schara, remembers well a breakthrough moment she witnessed when her son came home from school one day.

“He said, ‘I think I talked too much about something or other.’ Then he said, ‘How was your day?’?”

That Heidi’s son was able to turn his attention from himself to his mother made it her “best day ever.”

She credits these eureka moments, in part, to Austin’s unusually open environment.

“Having this autism-friendly movement--it’s incredible to have people who want to understand,” she said.

For Jackson, who has a love of Japanese monster movies and is eager to talk about all things Godzilla, the experience at Guy’s office as well as at a hair salon in town have been revelatory.

“I am surprised at what I’ve done. Legitimately surprised,” he said.

Jackson was so comfortable getting his hair cut at the Style Lounge that he made a video of it.

Austin’s autism-friendly program began a decade ago, when a retired Hormel executive, Gary Ray, telephoned Barinka, a family friend, and asked whether her autistic daughter, then 6, was able to participate in any town activities, such as summer camp.

“No, not really,” Barinka remembers answering. “We’d like to take her to camp, but you have to explain her frequent needs and hire someone as a helper.”

Austin is small enough that Ray and his wife, Pat, were familiar with Barinka’s struggle to find appropriate recreation for her daughter.

“What if [Pat and I] gave you a small contribution of $5,000?” Ray said. “Could you start a camp?”

It didn’t take long for Barinka to say yes. She is a woman with a keen ability to advocate and organize and a seemingly bottomless reservoir of energy. Her job as autism resource specialist is part time, just 10 hours a week, but Barinka regularly puts in 40, often fielding questions and requests from other parents: “A new business wants to become autism-friendly, can you give a presentation to employees?” “How do I find the best speech therapists in town?” “The local community college wants to start a special autism program. Can you help out?”

To date, the Rays have contributed more than $100,000 to fund autism-friendly programs in Austin. One of the more successful is the monthly respite night, when children with autism are dropped off at the Hormel Historic Home--a site for weddings and tours as well as community events--and parents or caregivers are given a few hours of free time.

The children might do an art project, or go out to a restaurant, bowling lanes or the YMCA to swim. The lifeguards are taught to get their attention by calling their name instead of blowing a whistle. The Y sponsors swim teams for children with autism, and they occasionally compete against other teams with disabilities, including at the Special Olympics.

Autism-friendliness has also reached into the schools, where a peer program pairs high schoolers with autism with similarly aged student volunteers. The program is so popular that there is a waiting list of student volunteers.

Word of Austin’s unusual autism-friendly services has resulted in at least a half-dozen families moving to the town.

Carolyn Dube grew up in Austin, but she spent much of her life elsewhere, primarily in Phoenix, where the resources for her son, Alex, diagnosed with autism at 2½, were lacking.

“There were a lot of behavioral issues with him,” Dube said about life with her son in Arizona. “He threw things, was increasingly violent and too hard to predict.”

A new job brought her to a suburb of Minneapolis, about 90 minutes from Austin, and Dube began to pick up stories about her hometown’s transformation.

“We’d hear amazing things,” she said. “And that’s when we started realizing how special some of Austin’s autism programs were.”

Dube’s family moved back to Austin when Alex was 4. He’s in high school now and takes mostly mainstream classes. He is especially talented in math and science, and because autism is a spectrum disorder of varying degrees of disability, Dube fully expects him to go to college and study engineering.

“Now Alex is almost a new person,” she said.

Other parents say they’re seeing progress they never thought possible before Austin became autism-friendly. Barinka’s 16-year-old daughter used to bite the chain-link fence at her older sister’s softball games and throw tantrums. Today, she is on her high school dance team and plays the trumpet in the band.

Barinka has received calls from Salt Lake City and Flagstaff, Ariz. inquiring about how to set up their own autism-friendly programs, furthering a trend of entrepreneurship and innovation by individuals in the autism community. In 2015, for example, Pennsylvanian Topher Wurts, a marketing and technology executive who has a son with autism, founded a virtual Autism Village. It’s an app that works a bit like Yelp, locating nearby autism-friendly places and businesses and letting users rate and review their experiences.

How Barinka helped create her own bricks-and-mortar version of an Autism Village included not only the Rays, but also the Hormel Foundation, the Hormel Historic Home and numerous members of the community, both paid and volunteer, who make the programs run.

Because of such contributions, Austin is able to offer services at vastly lower costs than those in places where camps can run as high as $800 or $900 a week, according to Barinka. Austin’s autism day camps cost just $150, and many of the more than 50 campers receive scholarships, bringing the price down to $25.

EDITOR’S NOTE: This is the third story in a four-part series about former mine properties, legislation surrounding their safety and the responsibilities of the county mine inspectors and property owners in Michigan.

MARQUETTE — A four-year term as Marquette County mine inspector is up for grabs in November. Three Democratic candidates appear on the Aug. 4 primary ballot in Marquette County. No Republican candidates appear on the ballot.

Each candidate was asked to answer four questions regarding how they would fulfill the duties of the position. Here are their answers:

≤ Describe your background and why it makes you the best qualified person to hold the position of county mine inspector?  

I worked for CCI for 21 years. I started on the fencing crew in 1973, putting up fencing around caving grounds and old abandoned mines. I spent 5 1/2 years underground at the Mather B Mine. The next two years, I worked at the Tilden Mine in the concentrator pellet plant as a plant repairman. For the next 13 years, I worked at the Empire Mine in the concentrator, pellet plant and pit. While at the Empire Mine, I was a member of the safety committee, checking for any violations of unsafe conditions.

≤ Describe the most important aspect of the job of county mine inspector, and why?

The most important aspect is the safety of the employees on the surface and underground, and the people of Marquette County. Duties of the mine inspector are to check all the fences around caving grounds and abandoned mines to make sure they’re in good condition. All active mines have to be checked for safety violations as well as sand and gravel pits. All these inspections must be done to insure the safety of all.

≤ Since the voters would effectively be your boss, how do you plan to hold yourself accountable? How will you keep records of inspections and violations?

I will keep all records of my visits to the active and abandoned mines. All caving grounds and pits will have to be inspected. If any safety violations are found, the proper company will be notified. My report will be given to the Marquette County commissioners.

≤ Education about mining and abandoned mines is a part of the job description of county mine inspector. How do you see yourself educating the public?

I would like to visit the area schools to inform the students of the danger and risk involved with cutting fences and going around the pits and caving grounds. I want to inform the public of the potential danger of old shafts and buildings. I will make sure the proper danger signs are in place.

≤ Describe your background and why it makes you the best qualified person to hold the position of county mine inspector?  

I would be the best choice for Marquette County mine inspector due to the fact that I have the best overall knowledge of the mining industry. I have an associate’s degree in industrial technology from Northern Michigan University. My experience in mining is 3.5 years underground sinking inclined shaft 3,000-foot Republic Mine, very similar to the shaft at Eagle Mine. Operated equipment in pit for four years, welder for 12 years, maintenance mechanic for two years, electrician for nine years in the pits and plants of Republic, Tilden and Empire mines. I then became a millwright and worked at Eagle Mine and their processing plant in Humboldt. With my past experience, I can inspect these running mines, electrical systems, mechanical systems and structural integrity of plants and pits, also the general safety condition of the underground mines. As past owner of an excavating business, I had a reputation for getting the job done right and on time. Also for keeping my part of the deal that was promised by me.

≤ Describe the most important aspect of the job of county mine inspector, and why?

The most important aspect of the job of county mine inspector would be to keep abandoned pits and shafts safe from the public, also keeping running mines in safe condition. By doing this, my top priority of keeping the public and working people safe would be accomplished. To accomplish this, all fencing around abandoned mine pits will be inspected and repaired. Also make sure all shafts are capped off properly and all safety warning signs are in place. I would also double-check the existing inventory of abandoned mines and quarries. Making sure I get a GPS reading on all, to make the job more efficient. These records should not be open to the general public, in that it would spark interest for people to go exploring and get hurt. I would allow some of the information to be shared should a special situation arise.

≤ Since the voters would effectively be your boss, how do you plan to hold yourself accountable? How will you keep records of inspections and violations?

My records of inspections and violations would be kept on and backed up on my computer. When looking at barriers, I will be taking pictures of places that need repair and documenting them on my phone. I also would make sure when a running mine is shut down permanently that the proper steps be taken to make it safe. There will be timeframes set up to have repairs done and be reinspected. I will keep an open line of communication with the county commission and public.

≤ Education about mining and abandoned mines is a part of the job description of county mine inspector. How do you see yourself educating the public?

≤ Describe your background and why it makes you the best qualified person to hold the position of county mine inspector?

I encourage everyone to vote their heart in this election. Protecting the lives of our children and our local miners is not a partisan issue.

I am a graduate mining engineer from Michigan Tech with over 40 years of experience at the Empire, Tilden and Republic mines. I began as a general laborer at the Empire Mine and worked summers at the mines while attending college. My first position with Cleveland-Cliffs was shift supervisor at the Republic Mine. From there I progressed to various assignments that broadened my knowledge of mining, eventually retiring as senior staff engineer at the Empire and Tilden mines.

My experience includes all phases of mining including mine planning, mine operations, drilling and blasting, health, safety, environmental, mine reclamation, project engineering, facilitating and leading teams. I have taken courses that include the U.S. Environmental Regulatory Framework and Planning and Design for Mine Closure. I developed good working relationships with management and union leadership and worked collaboratively with regulatory agencies such as the Michigan Department of Environment, Great Lakes and Energy; the Environmental Protection Agency; the Mine Safety and Health Administration; the Michigan Department of Natural Resources; and the Bureau of Alcohol, Tobacco and Firearms. As mine inspector I will provide leadership and interact with others in ways that enhance understanding and respect, while developing effective relationships.

I currently serve Gov. Gretchen Whitmer as an appointee to the board at the Michigan Iron Industry Museum, representing Michigan’s mineral industry, something that I have done for over 20 years having been previously appointed by Govs. Jennifer Granholm and John Engler. I know the mines of Marquette County and am currently co-authoring a book on the history of the Empire Mine. I understand the importance of mine safety (as both my great-grandfather and his brother were killed in Negaunee mines).

≤ Describe the most important aspect of the job of county mine inspector, and why?

The highest priority of the office of mine inspector is the safety of the miners working in the local mines and quarries and the safety of the public, especially children, with over 200 abandoned open pits, shafts and excavations throughout the county. Currently, there are water-filled pits and shafts that either lack adequate fencing or have damaged or vandalized fencing, which is mandated by state law.

I will create a list of the 25-30 most dangerous shafts and pits, including the names of surface and mineral owners, that need attention. I will submit the list to the county board and ask for their input. Proper fencing and signage can be expensive. Expense means nothing if it can save one life. I will meet with the owners to develop responsible solutions. Lacking cooperation, enforcement remains the final option.

I will collaborate with Northern Michigan University’s Earth, Environmental and Geographical Sciences Department to develop an online map that’s easily accessible to every county resident, pinpointing every abandoned and active mine in the county. County residents have a right to know whether abandoned mines exist in their neighborhoods.

Michigan law states that active mines will be inspected once every 60 days and I will comply.

≤ Since the voters would effectively be your boss, how do you plan to hold yourself accountable? How will you keep records of inspections and violations?

I will formalize electronic record keeping in the inspector’s office. This system will preserve records permanently and make the transition from one inspector to the next easier. Each abandoned mine inspection will be documented to include a checklist of items, such as proper signage, proper fencing, new subsidence or erosion and evidence of trespassing. Inspections of active mines will be similarly documented. Inspection records will be summarized and submitted to the county board. I will provide regular updates of my work with appearances at county board meetings, either as an agenda item or part of the public comment at the beginning and end of the meetings.

My plans are ambitious. Michigan statutes allow the mine inspector to appoint up to three deputy inspectors for the purpose of discharging the duties of the office. All deputy inspectors are under the supervision of the mine inspector and their duties prescribed by him.

I will need a few knowledgeable men or women volunteers with good communication skills to assist and accompany me. This provides a succession plan for the next inspector. In the unlikely event I am run over by a bus, there will be someone to step in without skipping a heartbeat.

≤ Education about mining and abandoned mines is a part of the job description of county mine inspector. How do you see yourself educating the public?

Activity in caving areas needs to be addressed. The most serious issue is children exploring abandoned mines, unaware of the hazards. Adults are equally responsible. I will schedule a town hall in Negaunee to listen and understand. Why? Not that long ago, Aaron Boersma, 16, of Caspian lowered himself into a mine pit with a rope tied to a tree and drowned in the water.

I will develop a public awareness campaign working with the county board. I will be available to speak to organizations and schools. When it existed, I taught a week-long course about mining for three years in the four west end school districts’ summer Gifted and Talented program. When Cleveland-Cliffs began the Partnerships in Education program, I presented in approximately 50 public school classrooms. I have presented to the Future Historians at the Iron Industry Museum. Within the past year, I presented to two groups at NMU on the topic of mine reclamation. I am comfortable speaking with groups and will continue to do so.

I will have an “open-door” policy and be available to listen to the many diverse voices found in our wonderful county to appropriately address all questions and concerns related to mining.

Also I am REALLY REALLY SORRY that I haven’t been writing anything for this blog, I have an explanation:

1) I am still working two jobs, because although I SAID I would quit one of them if the tutoring thing panned out (which is has), I keep worrying about what will happen if anything happens to Liet? And also what will happen to the people I work with? And what if whoever replaced me forgot to feed grumpy lady’s fish, or was mean to the undertaker who likes science fiction, or never asked the guy on the fifth floor how his grandson the concert pianist was doing, or forgot to make sure that the retired botanist lady always has flowers in her room, or didn’t listen attentively while the lady on the ninth floor explains the rules of competitive fencing for the sixth time? and because of these questions I am still working an average of fifty paid hours a week

2) The volunteer tutoring thing is going really well! but a lot of kids need special help, and because I want to help them as much as possible, i uh. might be writing up several new activities and supplemental lesson plans per week. which is a lot of fun but also kind of stressful, just a bit

3) Taz is switching schools in the spring! He’s gonna be going to this weird half-vocational half-liberal-arts type place that’s designed to help kids get their trade certifications as a three-year-old, while simultaneously pushing them further in other academic subjects, so they have a wide skill base that will allow them to continue advancing in their career later on. It’s moderately hard to get into, especially the electrician track (Taz is gonna be an electrician, and yes, I am super proud of him), so we’ve been spending kind of a lot of time making sure he has all his ducks in a row for that

4) Ves has all but mastered the art of walking and she is determined to walk AS FAR AS SHE CAN, and as you can imagine it’s kind of hard to write stuff while chasing down a determined almost-one-year-old

5) I still feel really guilty about making time to write? Like, I want to believe that I could be pretty good at it if I worked harder, and I want to believe that that would be a positive thing to pursue, but it also seems really conceited to assume that I’m capable of that, and it seems really selfish to like.... have hobbies, for some reason? Cause what if my purpose in life is to make sure that someone keeps noticing a bunch of people who don’t get noticed often enough, and I stop doing that because I think that I might be capable of doing something that feels more prestigious or difficult or something, and then I try and it turns out I’m not good at it, and then everyone is justified in ridiculing me for wanting to spend time making bad art instead of doing important things like feeding grumpy lady’s fish?

A Guide to TaxACT 2018

How well does TaxAct do in preparing a family child care provider’s taxes online?

It only does a good job if you know exactly what you are entitled to deduct as a business expense, how much of these expenses you can deduct, and where they should appear on your tax forms.

This is the same advice I gave when I reviewed TurboTax and H&R Block recently.

Note: The IRS has a program where you can use the TaxAct software, as well as other tax preparation software, for free if you are income eligible. For more information.

For this article I reviewed the Online Self Employed+ product.

Business Income

On the screen titled “Business Income – Principal Business” enter “child care.” On the screen titled “Business Income – Business Activity Code” choose “624100 Individual and family services.”

On the screen titled “Business Income – Accounting Method” choose “Cash.” On the screen titled “Business Income – Cost of Goods Sold” choose “no” because you don’t sell products and don’t keep an inventory.

On the screen titled “Business Income – Employer ID Number” enter your EIN number if you have one.

On the screen titled “Business Income – Other Income” I would recommend putting your Food Program income here. You could include it earlier under “Business Income – Gross Receipts” along with your parent fees, but I think it’s better to show it here. If you got a Form 1099 MISC from your Food Program sponsor, enter that amount on the screen titled “Business Income – Form 1099-MISC.”

Business Expenses

Asset Description

When entering information about a vehicle on the screen “Depreciation and Vehicle Expense – Asset Description” it asks you to select an Asset Type. No matter which type you choose, TaxAct will not apply the new 100% bonus depreciation rule that allow you to deduct the business portion of either $10,000, $18,000 or the full amount, depending on how many miles you drove and the weight of the vehicle. This is a major error in this software. I can’t figure out how to take advantage of the 100% bonus depreciation rule.

The screen titled “Do you want to make any repair regulation elections for child care” asks if you want to apply several elections: “De minimus safe harbor election,” “Capitalize repair and maintenance costs,” and “Small taxpayer safe harbor election.”

The “Deminimus safe harbor election” refers to the $2,500 rule that allows providers to deduct in one year items costing individually less than $2,500. So, check off this box. When you enter expenses of less than $2,500 the software should attach a statement to your tax return indicating that you elected to use this rule. Since I didn’t follow through and file my taxes using TaxAct, I couldn’t tell if the proper statement was attached. Therefore, you should check to see if there is such a statement attached to your tax return before you file it.

This is the section where you are to enter all your regular business expenses, excluding expenses associated with your home (property tax, mortgage interest, house insurance, house repairs, utilities and house depreciation). However, there is a screen that asks for utility expenses. Don’t enter any amount here. Utilities will be entered later.

If you check the box titled “Capitalize repair and maintenance costs” this means you will be depreciating repair and maintenance costs rather than deducting them in one year. Unless you are going to show a loss for your business, it doesn’t make sense to check this box. Checking the box will give you fewer deductions this year but allow you to spread the deduction over a number of years.

The “Small taxpayer safe harbor election” applies to you if your home improvements and repairs are less than 2% of the purchase price of your home (up to a maximum of $10,000). If you check this box it will ask for your building property description. Enter the street address of your home.

However, when I entered information that would allow me to deduct a bathroom remodeling project under this rule, TaxAct did not correctly apply the rule. In other words, Tax Act depreciated it over 39 years as a home improvement and gave me a $123 deduction for a $5,000 bathroom project. By applying this safe harbor rule I am entitled to receive the full $5,000 deduction. This is a significant error in the software. See my article “When Can Your Home/Land Improvements Be Deducted in One Year?”

On the screen titled, “Business Income – Insurance, Taxes and Utilities” do not enter any amount under “Utilities” unless you do child care away from your home. Your utility expenses will be captured when you enter your house expenses under the section Business Use of Home.

On the screen titled “Business Income – Meals and Entertainment” only enter expenses here for food you paid for yourself or a parent or employee while away from your home. Don’t enter food expenses for daycare children here. Enter them on the screen that says “Other Expenses” later.

On the screen titled “Business Income – Other Expenses” this is where you can enter all other business expenses (except house expenses and items you are depreciating). You can use whatever description you want for your expenses. I have always recommended using the following expense categories: Food, Toys, Household Items, Cleaning Supplies and Activity Supplies. But these are just recommendations.

Business meals

TaxAct does not tell providers about the standard meal allowance method to claim food expenses and does not give the rates you can use to claim food expenses without receipts. The rates for 2018 are $1.31 breakfast, $2.46 lunch/supper and $.73 snack. You can deduct up to one breakfast, one lunch, one supper and three snacks per day per child, if you serve that many. You can count meals and snacks reimbursed by your Food Program sponsor plus any additional meals and snacks you served. You must calculate on your own the amount you are entitled to claim as a food expense and enter it on the screen that says “Enter your business meals expense for _____ child care.”

When entering any expense (except house expenses) into TaxAct you need to remember only to enter the business portion of your expenses, after applying your Time-Space Percentage to those items that are used by your business and your family. So, if you bought a $100 toy used exclusively for your business, enter $100. But if the toy was also used by your children during non-childcare hours and your Time-Space Percentage was 35%, enter $35.

The problem is that there is no screen that will tell you what your Time-Space Percentage is, even after you have entered your square footage and hours into the software! So, you must either calculate this on your own, or pay for the service, look at IRS Form 8829, line 7, and then go back and reenter the proper amount of your business expense to correct your tax forms before filing them.

Depreciation

To claim depreciation on items used for your business, you’ll need to check “yes” on the screen titled “Business Income – Depreciation.” On the screen titled “Business Income – MACRS Depreciation Review” you’ll need to click “add” next to “New Copy of Federal Form 4562 Depreciation.” This is the form used to report depreciation. However, before answering questions to fill out Form 4562 you’ll need to know what items you must depreciate and what items are not subject to depreciation.

If the item you purchased cost individually less than $2,500 you don’t have to depreciate it. Claim these items on Schedule C in the section above Depreciation. If the item is a repair, you can deduct it in one year regardless of its cost. See my article “When Is a Home Improvement Now a Repair?” to learn about the expanded definition of what is a repair.

When entering a depreciable expense on the screen titled, “Depreciation and Vehicle Expense – Asset Description” you’ll be asked to choose an “Asset type.” Here’s the options to choose from:

Computers – 5 year depreciation: “Computers and Peripheral Equipment”

Furniture, appliances, play equipment – 7 year depreciation: “Office Furniture and Fixtures”

Fences, patio, driveway – 15 year depreciation: “Land Improvements”

Remodeling, adding an addition, new deck, etc. – 39 year depreciation: “Nonresidential Real Property”

After entering an item to be depreciated a screen will ask its cost. If you use the item 100% for your business, enter the full cost. However, if you also used it for personal use you must enter your Time-Space% of the cost here. This is a problem because you will need to find your Time-Space% elsewhere in the software.

a screen titled “Does _____ qualify for the special depreciation allowance?” will ask if you want to use the 100% bonus depreciation rule. If you purchased your item after September 28, 2017 always check the box to elect this rule. This will allow you to deduct the entire business portion in one year.

The next screen is titled “Depreciation – Section 179 Expense.” Enter items here if they meet the following tests: They are any expense used more than 50% in your business and are not a land improvement or home improvement. So, you could enter expenses for furniture, appliances, play equipment, and home improvements. The only drawback of the Section 179 rule is that if you stop using it 50% or more in your business before the end of the regular depreciation period you will have to pay back some of the deduction you claimed.

Home improvement

When entering a home improvement choose the category of non-residential real property. TaxAct will choose the MACRS Straight Line method for depreciating this over 39 years. TaxAct will not ask of your home improvement is eligible for the Safe Harbor for Small Taxpayers rule which allows you to deduct the cost in one year if you are eligible. Again, you must enter the business portion of the cost of any home improvement, otherwise the software will assume it’s used 100% for your business. In addition, the software will not ask if you want to use the new 2018 rule that allows you to deduct home improvements in one year using the Section 179 rule.

Business Use of Home

The screen titled “Business Use of Home – Method” asks you to choose between “Regular Method” and “Simplified Option.” As I have discussed elsewhere (“New Simplified Method for Claiming House Expenses Won’t Benefit Most Providers”), the vast majority of providers will be better off choosing the Regular Method. This is because you will likely get a much higher deduction than using the Simplified Option. You can explore both options and see which method gives you a higher deduction for your house expenses.

Simplified Option

If you choose this option a later screen titled “Business Use of Home – Gain or Loss: will ask you to enter the gain or loss derived from business use of home. Above this will be a number telling you your “Tentative profit (loss) from Schedule C, line 29.” If you show a profit, put this number under “Gain” below. If you show a loss, put this number under “Loss” below. What this question is asking is how much of your business is based out of your home. Since all of it is, put the full amount of the gain or loss below.

TaxAct does correctly take into account the special rule affecting family child care providers when calculating house expenses using the Simplified Option.

Regular Method

If you choose the regular method on the screen titled, “Business Use of Home – Daycare Personal Use” a later screen offers your three choices: “Exclusively for daycare only,” “Daycare areas are available for personal use,” and “Part of your home is exclusively used for daycare only and other parts are used for both daycare and personal use.” The only time you would check the “Exclusively for daycare use only” button is if you had a separate structure on your property used 100% for your business.

If you have one or more rooms in your home used exclusively for your business and other rooms used regularly for your business, check the last box. If you have no exclusive use rooms, check the second button.

The screen titled “Business Use of Home – Daycare Personal Use Hours” asks you to multiply the number of days used for daycare during the years by the number of hours used per day. This is an extremely misleading statement. Providers work different hours on weekdays and weekends and don’t necessarily work the same number of hours every week of the year.

Instead, you should enter the number of hours you care for children in your home, plus the number of hours you work in your home on business activities when children are not present. Read carefully my article “How to Track Hours When Children Aren’t Present.”

Enter your real estate taxes under the “Indirect” section, not the “Direct” section. Direct expenses are deducted at 100% of the cost. TaxAct will multiply your Indirect expenses by your Time-Apace Percentage. The same goes for mortgage interest, mortgage insurance premium, casualty loss, rent, insurance, repairs and maintenance, utilities, and other expenses.

There is a screen in the Business Use of Home section titled “Business Use of Home – Addition or Improvement.” This is the second time TaxAct asks you to enter home improvements. The first time was under the Depreciation section. If you entered a home improvement such as a deck or remodeled kitchen the software will depreciate it over 39 years properly.

Conclusion

If you do decide to use TaxAct or either of the other two online tax preparation programs, I would recommend you fill out the tax forms by hand first. Then I use TaxAct and enter your numbers. When you print out the tax forms you can compare them with the ones you completed by hand to see if TaxAct made any mistakes.

If you don’t understand what I’ve been describing in this article about TaxAct, don’t use it! I’ve talked with providers who did use online software, got audited, and found out that they had incorrectly entered information.

I had an accident a month or two ago. It was in a rental car. I found out today that the insurance company had disallowed some of the charges that the rental company tried to pass to them. Today my girlfriend asked me to drive her home from college as she was sick. I used her moms car. When coming home on the arterial we were at a red light and I was getting ready to get in the right lane when the light turned green the SUV in front of me began to go then stopped suddenly, (still don't know why) As I was still crossing into the other lane the corner of my front bumper bumped her fender corner. Today at a light a car rear ended me. My rear bumper has some small scratches and some paint marks from the other car. At this point I regret making a claim and wish i could turn back the clock. I am being forced into a box and it looks shady. Three weeks ago my 2005 Cadillac STS was involved in a parking lot flood where the water rose and filled the floors of my car by about 4 inches. From the time I dropped it off at the dealer it has been all negative. No i am just asking the insurance company to forget everything and drop the claim because the damage is not that extreme and i dont want to lose my car. I am told at this point it is too late. Is that true? My neighbors are floored by this, i have been driving it around for a few weeks just fine and the car still looks new With only 62000 miles on it. I can't help from thinking that something suspicious is going on here. Do they stand to make a nice profit by totalling my vehicle and then replacing one module for a 1000 or so and having a perfect car with all systems working? I am predominantly focusing on catering to the need of providing seedlings with the necessary care it takes to turn a seed into a strong plant. However as there are so many different variety of plants that require different care this may be a limit. The product should be streamline (not having thirty billion different attachments or cords or plugs or etc.) the consumer must be able to figure out the product within 5 minutes at most of study.

Homeless Veterans Exploited as Unpaid Labor

Over 200 homeless veterans live at a shelter in the mountains of North Carolina, I include myself in their ranks. The economics of being over sixty and over qualified as a communications arts professional introduced me to the Veterans I now live with and share a common bond.

For several years, veterans have been entering the doors of a homeless shelter where they are enrolled in a VA benefit for Homeless Veterans. Former members of the U.S. Armed Forces, who are discharged from military service (under conditions other than dishonorable) are eligible for a bed at a transitional shelter, meals, VA care, and case management.

The Veteran’s Restoration Quarters (VRQ) is a homeless shelter operated by a non-profit Christian organization Asheville Buncombe Community Christian Ministry, Incorporated (ABCCM).

ABCCM started as a collaboration of several local churches to address homelessness. Their common motivation was simple, a group of churches could accomplish more together, than each church could accomplish alone. In 1970 ABCCM incorporated - a noble beginning.

In 2003, ABCCM added 24 beds for sheltering veterans operating under the U.S. Department of Veterans Affairs (VA) Grant and Per Diem (GPD) program, veterans were sheltered in a warehouse building. Since then, ABCCM’s homeless services have grown, today the VA GPD program is within a two miles of a VA Hospital, in a former Super 8 Motel. The VRQ is an open campus with no fences, is comprised of 124 rooms with 246 beds, serving approximately 226 veterans and 20 non-veterans, it is surrounded by mountains near Asheville, North Carolina.

The VA GPD program provides homeless veterans up to two-years of transitional housing and a veteran may have three VA GPD program stays in their lifetime; a thoughtful and compassionate act of Congress. ABCCM is paid a (daily) Per Diem payment, for each night a veteran is sheltered. ABCCM's VA GPD program provides Veterans with transitional housing, meals, case management, and limited van transportation. 

The VA GPD program's stated goal: "increase [veterans] skill levels and/or income, and obtain greater self-determination". Noble beginnings and compassionate acts are not enough to keep a moral compass pointing true.

Voiceless and Vulnerable

I arrived at the Veterans Restoration Quarters in September 2015, I was without a job, homeless, penniless, and without transportation. But, within a week of arriving, I was offered the possibility of employment at the VRQ Front Desk; so I trained to be a Front Desk Manager for eight days, and then, I became a formal ABCCM paid employee. However, after about eight weeks, the reality of my employment became apparent: I was sometimes required to perform 40 or more hours in a work week, but I was only getting paid for 16 hours in a work week. ABCCM claimed that I was a “part-time” employee (working less than 20 hours) so I am required to work unpaid “Service Hours” as a Front Desk Manager, in addition to my paid hours. I was not alone, other veterans’ paychecks were being shorted; some were not getting paid at all. Was this a VA GPD best practice?

ABCCM established a “Service Hours” program that requires all VRQ sheltered residents to perform unpaid labor, unless employed or attending school full-time (no service hours), part-time (10 service hours), or not at all (20 service hours). Service Hours work activities are performed in areas such as: Housekeeping, Maintenance, Kitchen, Computer Lab, Front Desk, and Van Duty Driver. These are the same work activities necessary to the daily operation of any hotel or care facility. Except in this instance, ABCCM has contrived a Service Hours program to cut its costs, and in doing so, ABCCM has created a special labor class comprised of homeless veterans to perform its labor.

As a result of performing Service Hours, residents earn “Reward Points”. Reward Points can only be redeemed at the VRQ “Points Room” for a small spectrum of new or used donated clothing and toiletries. But not every veteran is eligible to earn and use Reward Points. There is no daily, weekly, or monthly statement of accrual for earned Service Hours or Reward Points.

ABCCM's homeless labor policy ignores Federal and State labor laws. Homeless veterans are required perform unpaid labor in order to gain access to a life-sustaining Veterans' benefit - which was previously earned through their service in the United States Armed Forces.

The required Service Hours and illusionary Reward Points programs are ABCCM compulsions - not a VA GPD best practice.

ABCCM’s Service Hours and Reward Points programs establish a pattern of practice designed to exploit voiceless, vulnerable veterans as an unpaid labor force.

Tipping the Gilded Scales of Justice

The integrity of the VA GPD program's has been compromised; the principle of increasing a veterans income has been shelved. So, who would you tell?

An email with supporting attachments was circulated for nearly a year; U.S. Senator Thom Tillis (NC), serving on the U.S. Senate Committee on Veterans' Affairs, responded. The Senator’s office contacted the U.S. Department of Veterans Affairs and the U.S. Department of Labor (USDOL). The VA sent a letter back to Senator Tillis' Office that parroted-back the contents of the original email; the Senator's Office has been silent on any response from the USDOL.

Both the NC Department of Labor and the US Department of Labor question their respective jurisdiction in the matter when answering the original email, and each agency referred to the other as a possible solution.

After nearly a year of trying to motivate members of Congress, the U.S. Department of Labor, the N.C. Department of Labor, and also trying to find legal representation for myself and the homeless veterans of the VRQ… I applied myself to the effort, I read case law.

An action has been commenced against ABCCM in U.S. District Court in the Western District of North Carolina – Asheville Division, Civil Action No. 1:17-CV-150. The Complaint was served on July 3, 2017.

The Court has waived the $400 filing fee, I was allowed to proceed in the Form of a Pauper. As a Pro Se (self-representing) litigant, I cannot represent anyone else - only myself. [Chances are, I don’t know you, but I do know what you are thinking right now, go ahead roll your eyes, I would.]

As a Pro Se litigant, preceding in the form of a Pauper, I can prosecute the case as it affects only me. Rightfully so, I would not want to diminish another veterans opportunity to for justice.

ABCCM’s reports it’s most recent earnings from the U.S. Department of Veterans Affairs and U.S. Department of Labor :

2014 - $2,476,925 from VA GPD program ($3,236,037 total from the VA), and $699,541 from the USDOL;

2015 - $2,397,199 from VA GPD program ($3,187,179 total from the VA), and $574,836 from the USDOL;

2016 - $2,461,562 from VA GPD program ($3,678,694 total from the VA), and $205,478 from the USDOL.

In the last three years, ABCCM has earned over $10,000,000 from the VA; so, I would like to ask for some of it back, please.

Common sense says "find legal representation" and that is the purpose of this funding effort.

The introduction of the legal representation would accomplish a great deal more than equalizing the knowledge and experience appearing before the Court on my behalf; the appearance of legal representation would allow entry of all similarly situated veterans who are required to perform unpaid Service Hours.

At this time, the veterans remain silent and endure. The sheltered veterans at the VRQ are on the edge of survival, their sheltered existence is not protected by a lease, expulsions into homelessness are common. The authority and control of ABCCM over the veteran population is unchecked. Veterans can be expelled into homelessness for the perception of a campus violation. The veterans at the VRQ do not openly speak in opposition to ABCCM’s policies and practices - out of a lack of self-expression, lack of emotional control, or out of fear. The five stages of grief: Denial, Anger, Bargaining, Depression, Accpetance (DABDA) is not a liner progression of emotion; expect any one of those emotions to dominate a veteran's reaction to any injustice. A few veterans know that I have filed a Complaint with the Court, as a result, some of them avoid being seen with me, I understand, I place no blame on them.  The introduction of experienced and seasoned legal representation would give 200 veterans cause to speak on their own behalf.

The scales of justice are gilded; a price needs to be paid for legal representation, for depositions, discovery, pretrial motions, expert witness testimony, trial; and appeal.

A January 2013 study by the Court Statistics Project, "Estimating the Cost of Civil Litigation" states the average cost of employment litigation to be at $88,000... at this point, I estimate $20,000 should be sufficient to retain legal representation and pay for pretrial discovery and motions.

There are three prima facie Counts within the Complaint; Counts I and II speak directly to the heart of employment for all similarly situated VRQ residents.

*As part of my JVC experience, I participated in a three day border immersion trip.  Because there is so much to discuss, I will be writing three blog posts (one for each day) to share my experiences with you  This is part 2.*

Day two of our border immersion trip had Casa Bart and one member of Casa Nacho (Tucson House) on the road at 6:45 am driving to Nogales, AZ.  As you get closer to the border, not to far south of Tucson, the road signs start explaining distances in kilometers instead of miles and once you get into Nogales, AZ you can see the border wall dividing Nogales into two parts-Arizona and Mexico.  We met our guide, Julie, payed $5 to park our cars on the U.S. side of the border, and walked with Julie to the border.  Once at the border, it was a piece of cake to get through.  All we had to do was walk through a turnstile and head for the Kino Border Initiative (KBI) Comedor.  On the Mexico side, no one questioned our presence or asked to see documentation; we were greeted with a friendly good morning and were allowed to go on our way.  One of the first things I noticed as we walked to KBI was a vending machine that said one bottle of soda was 9 euros.

It took us less than 10 minutes to arrive at KBI.  Walking into KBI two things I immediately noticed were: 1) For some reason I was expecting the commodore to be larger. 2) The mural on the wall of Jesus as a migrant, wearing a backwards cap, surrounded by his 12 men and women disciples who are also migrants.  The comedor serves two meals a day to women and men who have recently been deported.  In order to enter, the guests show the greeter the piece of paper they are given when they are deported.  They then find a seat at one of the long tables, with women sitting at the table closest to the wall with the mural and men sitting at the other tables.  The guests sit and chat among themselves until the pre-meal routine starts.  The routine involves information about the different services the comedor provides (cell phone calls, changing the U.S. dollars into pesos-any money earned while in jail is given to people in american dollars even though they are being released in Mexico-, wound care, and a lawyer consultation, just to name a few); a light hearted activity to help the guests relax, smile, and have a little fun; and a prayer.  After this, the meal is served.  A few individuals load plates in the kitchen, pass them to a volunteer (this was my job at one meal), and then are passed to the head of a table to be passed down.  Plates are handed to the women’s table before being handed to the men’s tables.  Once everyone has been served, people walk around offering seconds to anyone who wants them.  Then, dessert!  After guests are done, they bring their dishes to the dish washing area and then socialize, leave, or take advantage of the services offered.  

After clean up from the morning meal was done, we all sat around a gentleman who wanted to share his story with us.  Andres had lived in the United States longer than I have been alive before being deported.  Do to a family emergency he returned to Mexico and, upon returning to the United States, he was arrested.  When telling his story, raw emotions appeared as Andres told us about how inhumane his treatment was when in jail, including multiple strip searches.  Within his story, there was also some familiarity; he was talking about Phoenix.  He had lived in Phoenix, stayed on the same campus Cailin works at, and attended church at St. Matthew a few times.  He had a life in the same place we all do but, because of where he was born, he is not welcome.  Hearing and reading the stories of people who have been deported always blows my mind because people who are undocumented are able to get special tax numbers so they still pay the government but yet could be sent back at any moment to a country they have not lived in for years, and may not even remember.

Our time with Andres was interrupted by a reminder we needed to be heading out to make our appointment at the KBI women’s shelter across the street.  After climbing up a few stairs, entering the building, and climbing some more, we entered a room where we met with four woman, three adults and one teenage, currently staying at the shelter.  All of these women had come to the border with hopes of crossing but now were unsure of what their next step would be.  It was clear they did not want to share a lot of their story with us, so after introductions and a small conversation, we walked to the neighboring room to purchase bracelets and earrings.  Women make these (only bright colors allowed) while staying at the shelter to help keep their mind off of their struggles and raise a little money.

From the Women’s Shelter, we walked through Nogales, Mexico for our lunch destination (where each person was able to eat a large meal for about $5).  When walking around Nogales, one of the first things which stuck out to me was the amount of pharmacies, dental businesses, and hair care places.  We were told a lot of people walk to the Mexican side of the border to take advantage of lower prices at these places and then head back home.  While walking around, it is also impossible to ignore the fact your white skin makes you stick out like a sore thumb, but not to many people made comments about out group of white people walking through their town.  Of everything we saw, there were three things which really stuck with me:

1) We stood on the opposite side of the fence where we had attended the mass on the border earlier in the year.  On the U.S. side of the border, you cannot just walk up to the fence because there is a bar blocking you from the parts of the walls which have space between bars.  On the Mexico side, you can walk right up to it.  For me, this was a very strong reminder of how it is the U.S. forcing people to be prisoners in their own country.    

    2) On the U.S. side of the border wall, no one is allowed to alter the wall in any way.  On the Mexico side, they might not be able to, but people still do and it is not covered up or taken away like it would be on the U.S. side.  As a result, a part of the wall is painted blue (with the idea if you walk down the alley far enough and look at the wall, it will blend in with the sky), a part is painted with candles, and a part has  wooden crosses set along the border in remembrance of those who have lost their life to immigration related issues.  

3) On part of the wall, there is a large windmill which fills the air with a beautiful sound but the reason it is there is connected to a gut wrenching story.  One day, a couple men shimmied up the fence and crossed over, but a border patrol officer saw them so they retreated and climbed back over the wall.  While this officer was trying to arrest these two individuals, a teenage boy was walking down below where the wall sits and across the street from it (where the windmill is placed, the wall goes up and down with the terrain of a hill so there is a significant amount of land underneath the wall).  The officer claims his life was in danger because of rocks being thrown up high and through a large wall with spaces so small a human can’t fit through so he needed to fire his gun an abnormal amount of times.  Angled down and away from where the windmill hangs is a picture of this teenage boy on a wall at the location where these bullets shot and killed him.  There have not been repercussions for this man who killed an innocent teenager as he was walking home from playing basketball.  There are a variety of excuses given for why this man has not been taken to trial yet, but one of the arguments is connected to the fact this teenage boy was killed in the limbo area that exists on each side of the border (60 ft each way I believe) and he was killed by someone on the opposite side of the border from where he was.  The exact details are hard to explain because they don’t make a lot of sense.  I can’t help but wonder how the story would have played out if the roles were reversed and a white teenager had been killed on the other side of the border by police officers on the Nogales, Mexico side of the border.

Once we were done wth our walking tour of downtown Nogales, we caught a bus (all the buses are refurbished U.S. school buses) back to the comedor in order to help serve the second meal of the day.  After this second meal, some of our group heard the story of another gentleman and some of us heard the story of a Jesuit Novice who was on his month long pilgrimage.  He was provided transportation to his starting point and then had $35 and a month to journey wherever he wanted to and find his way back to St. Paul, MN by the middle of May.  After these final conversations, we took a few pictures with people from the comedor and headed back towards Nogales, AZ.  Getting back to the U.S. side of the border was also very easy.  Julie prepped us by telling us we were to say we were on a border immersion trip through KBI and reminded us how most people were bringing bracelets and/or earrings back to the U.S.  We walked in, had our passports scanned (no stamps for this journey) and crossed back to the U.S.  Julie went first and explained how we were all with her so some of us did not even have to answer any questions as we crossed back and none of our bags were checked for items we might be bringing home.  Then, just like that we were back in the U.S.  On the drive back, the most we had to do is take a quick break to tell a check point officer everyone in the car is a U.S. citizen and we were coming from Nogales, Mexico.  Then, we were allowed to continue on our way back to Casa Nacho.

Of all of the days, this is the day I am still processing the most.  I am still wresting with the idea of a group of privileged white people being taken through Nogales, Mexico to hear a few stories and then head back to the comfort of their own homes.  Don’t get me wrong, I believe these experiences are extremely important and added a new component to my understanding when I arrived back at school to learn one of my kindergarten students and his mom are being deported and have until June to leave the country (his dad was deported this school year as well).  The thing I haven’t figured out is what I am going to do to make sure this trip wasn’t just an experience for me and leads to action.  It isn’t fair people have to choose between living in a counry full of violence and no job opportunities, staying away from their family, and/or staying in an area when the drug cartel is threatening to harm them or their family if they do not help them all because of a border we have created.  I don’t know what I am going to do to make sure I use what I have learned to take action, but hopefully this blog post series is a good first step.
