Dan Ellsberg risked life in prison. And then he went on risking punishments again and again. He took part in countless — I think he may actually have a count, but the word is appropriate — nonviolent protest actions that involved his arrest. He knew that information was not enough, that nonviolent action was needed as well, and that it could succeed. He inspired and encouraged and volunteered to take risks with new whistleblowers and new activists and new journalists.

Nicht nur für Julian Assange setzen wir uns ein - auch wenn ein nerviger User auf Diaspora uns das in Dauerschleife seit Monaten vorwirft. Wir möchten auch auf das Schicksal von Yurii Sheliazhenko, PhD, und ein Mitglied des Board of Directors of World BEYOND War, in der Ukraine hinweisen.

Yurii Sheliazhenko wurde von der ukrainischen Regierung förmlich wegen des Verbrechens der Rechtfertigung der russischen Aggression angeklagt. Als Beweis soll diese Erklärung dienen, in der die russische Aggression ausdrücklich verurteilt wird.

Mit dem seltsamen Straftatbestand der "Belohnung und Rechtfertigung eines Angriffskrieges" hatte es auch ein Mitglied unseres Vereins hier in Deutschland vor einem halben Jahr zu tun - er wurde freigesprochen.

In der Ukraine mag man Friedensaktivisten weniger. Erst vor wenigen Tagen wurde in Yurii Sheliazhenko’s Apartment eingebrochen, vermutlich durch den Security Service of Ukraine. Yurii schreibt dazu: Today, 08/03/2023, in the first half of the day, unknown people started breaking in the door to my apartment at …. When I asked who it was, they told me that it was the SBU. They refused to introduce themselves.

Yurij und die ukrainische pazifistische Bewegung haben sich immer gegen beide Seiten des derzeitigen Krieges gestellt. Nun werden sie offenbar beschuldigt, die russische Seite zu unterstützen. Es ist inzwischen üblich, dass Kriegsbefürworter die Möglichkeit leugnen, gegen beide Seiten eines Krieges zu sein, und daraus schließen, dass jeder, der dies tut, in Wirklichkeit die Seite unterstützen muss, die der Kriegsbefürworter ablehnt. Aber sie werden keine tatsächlichen Beweise dafür finden, dass Yurij eine der beiden Seiten unterstützt hat.

Als Beweis soll die "Peace Agenda for Ukraine and the World" dienen, an der Yurij mitgeschrieben hat. Wir können in diesem Papier nichts finden, was die Anschuldigungen rechtfertigt:

Wir, die ukrainischen Pazifisten, fordern und werden uns bemühen, den Krieg mit friedlichen Mitteln zu beenden und das Menschenrecht auf Kriegsdienstverweigerung aus Gewissensgründen zu schützen. Frieden, nicht Krieg, ist die Norm des menschlichen Lebens. Krieg ist ein organisierter Massenmord. Unsere heilige Pflicht ist, dass wir nicht töten sollen. Heute, wo der moralische Kompass überall verloren geht und die selbstzerstörerische Unterstützung für Krieg und Militär zunimmt, ist es besonders wichtig, dass wir den gesunden Menschenverstand bewahren, unserer gewaltfreien Lebensweise treu bleiben, Frieden schaffen und friedliebende Menschen unterstützen. Die UN-Generalversammlung verurteilte die russische Aggression gegen die Ukraine und forderte eine sofortige friedliche Beilegung des Konflikts zwischen Russland und der Ukraine und betonte, dass die Konfliktparteien die Menschenrechte und das humanitäre Völkerrecht achten müssen. Wir teilen diese Position. Die derzeitige Politik des Krieges bis zum absoluten Sieg und der Missachtung von Kritik an Menschenrechtsverteidigern ist inakzeptabel und muss geändert werden. Was wir brauchen, sind ein Waffenstillstand, Friedensgespräche und ernsthafte Bemühungen, die tragischen Fehler zu korrigieren, die auf beiden Seiten des Konflikts gemacht wurden.

I urge your country, as party to the Genocide Convention, to immediately file a Declaration of Intervention with the International Court of Justice (ICJ) in support of the South African case against Israel for the crime of genocide.

Your United Nations mission, government leaders, and populace have rightfully expressed outrage at Israel’s bombing of hospitals, clinics, apartments, UN refugee centers, and escape routes, killing civilians, many of them children, in Gaza’s densely packed coastal strip.

I ask your country to take the next step, to file a Declaration of Intervention with the ICJ in support of the South African case against Israel on the crime of genocide.

Under the Convention on the Prevention and Punishment of the Crime of Genocide, the crime of genocide is defined as acts perpetrated to bring about the destruction, in whole or in part, of a national, ethnical, racial, or religious group, as such.

Israel’s killing, injuring, traumatizing, and making homeless large number of Palestinians and denying an imprisoned population water, food, medicine, and fuel meets the criteria for the crime of genocide.

If a majority of the world’s nations call for a ceasefire, yet fail to press for prosecution of Israel – what is to stop Israel from ethnically cleansing all Palestinians? For that matter, what is to stop other nations from repeating a horror of this magnitude?

This duty to refuse to obey unlawful Government orders includes orders to pay tax [Income tax, Council tax, VAT etc]. If a government uses the funds raised by taxation to wage illegal war or to commit genocide, crimes against humanity or war crimes, then a taxpayer’s normal duty to pay tax is reversed and becomes a duty to refuse to pay tax.

The only occasion when the use of armed force is lawful occurs when a State is under attack and it acts in self-defence to repel the attackers. On all other occasions the use of armed force is illegal.

Urge Governments to Invoke the Genocide Convention to Stop the War on Gaza

UPDATE: South Africa has heeded this call. Let's ask other countries to join!

Several countries' governments have accused the Israeli government of genocide and asked the International Criminal Court to prosecute Israeli officials, but that court effectively answers to the U.S. government and has refused for years to prosecute crimes by Israel or anyone else outside of Africa.

But the International Court of Justice has ruled against Israel in the past, and if any party to the Genocide Convention invokes it, the court will be obliged to rule on the matter.

If the ICJ determines that genocide is happening, then the ICC will not need to make that determination but only consider who is responsible.

This has been done before. Bosnia and Herzegovina invoked the Genocide Convention against Serbia, and the ICJ ruled against Serbia.

The crime of genocide is happening. The intentional destruction of a people, in whole or in part, is genocide. The law is meant to be used to prevent it, not just review it after the fact.
