Another violent man claiming to be the actual victim. This time use gender ideology.

A violent transgender sex offender has launched multiple lawsuits against over 20 members of staff at the St. Francois County Jail and South Missouri Mental Health Center after reportedly being denied female undergarments. Kelly McSean, a violent rapist and pedophile, is awaiting trial after escaping jail while in custody for attacking sex offender treatment program staff.
As previously reported by Reduxx, McSean, born Larry Bemboom, has an extremely long and depraved criminal history.
In 2003, while still living under his birth name, he pleaded guilty to the sexual assault of a 39-year-old African American woman. McSean had offered the woman a ride home, but instead took her to his residence where he both orally and vaginally raped her.
During the assault, McSean made racially degrading remarks to the victim, telling her that his ancestors owned slaves and ordering her call to him “master.” The woman managed to escape and fled nude from his residence. For the brutal attack, he was sentenced to just five years in prison.
Before his scheduled 2008 release, a prison psychiatrist reported that McSean met the statutory definition of a sexually violent predator and, after a second evaluating psychiatrist concurred, the state of Missouri filed a petition to involuntarily commit him to its Sex Offender Rehabilitation and Treatment Service program. A jury trial subsequently found that he met the legal requirements for civil commitment, and he was sent to reside at Sex Offender Rehabilitation and Treatment Program (SORTS) in Farmington.

McSean appealed the decision, but evidence presented by the evaluating psychiatrist provided insight into the predator’s extensive history of sexual violence dating back to when he was just a minor.
According to the evaluation — at 13 years of age, McSean molested an eight-year-old girl and forced her to perform oral sex on him. He also fondled and orally copulated a 12-year-old boy. The following year, he was sent to counseling after he was found soliciting other boys to perform oral sex on him in his school bathroom.
McSean was placed in sex offender treatment when he was just 15 years old after exposing himself to a younger relative, but while in treatment he molested another underage girl in his proximity.
Between the ages of 19 and 30, McSean would commit several more sex offenses, primarily against minors. He told the evaluating psychiatrist that he repeatedly raped a 16-year-old girl in 1995, as well as engaged in oral sex with her 11-year-old brother. He also stated that he moved in with two girls aged 14 and 16 in 1998, raped a 15-year-old girl, and molested a 14-year-old.
At age 30, he was arrested for sodomizing a 12-year-old girl after giving her marijuana. He received a suspended five-year sentence and three years probation. McSean said that while in the community, he committed a number of sexual assaults for which he was never charged, including molesting children as young as 8 at the Salvation Army, and raping unidentified male and female children.
In 2003, prior to being charged for the rape of the 39-year-old woman, McSean admitted to having kidnapped two teens and holding them captive at his residence where he forced them to perform oral sex on him.
McSean also said that around the same time, he was molesting a younger female relative and threatening to kill her if she told on him. He would sneak into her room at night, cover her mouth and rape her, as well as penetrating her with foreign objects.
While McSean attempted to appeal his sexually violent offender designation, the appeal was denied in 2010 and he has remained in civil commitment since. Sometime between 2010 and 2023, he began identifying as a “transgender female woman.”
While at SORTS, McSean violently attacked a treatment worker, leading to his transfer to the St. Francois County Jail to await trial on the charges.
On January 17, McSean, along with 4 other inmates, escaped the prison via a plumbing-access hole. Cameras that would ordinarily have tracked their escape were not functioning due to construction being done on the building. The prisoners weren’t discovered missing until a routine inmate count. A wild police chase ensued, with McSean and the others being caught on street surveillance camera footage stealing a car in a nearby parking lot.
McSean was apprehended three days after the escape, and has been at the St. Francois County Jail ever since. But Reduxx has now learned that over the course of the past 5 months, McSean has filed a number of lawsuits alleging mistreatment at the hands of staff both at the jail and at the South Missouri Mental Health Center.
Though McSean is alleging various forms of mistreatment, the majority of his complaints appear to stem from his inability to access “gender affirming” items and treatments, most notably women’s undergarments. He also takes issue with being “misgendered” and “demeaned” while in custody, and having been treated as a male despite his state and prison documentation listing him as a “female.”
McSean has similarly alleged sexual harassment, with these claims stemming from “misgendering” incidents, “discrimination on the basis of sex,” and routine searches not being conducted in the fashion he demands. He has also claimed he was “sexually assaulted” during a strip-search, emphasizing that his penis and “breasts” had been exposed to male officers.
McSean has alleged the various “mistreatments” have caused him anxiety, sleep issues, nightmares, high blood pressure, a los of appetite, migraines, crying spells, and more physical and psychological issues. He has requested damages ranging from $50,000 to $100,000 per defendant and per concern. In one of the filed complaints alone, the total requested damages exceed $14,900,000.
One of McSean’s lawsuits was filed with two other inmates as co-Plaintiffs, both of whom were involved in McSean’s escape from the jail in January – Aaron Sebastian, a sexually violent predator who sodomized a young girl, and Dakota Pace. McSean identifies both of the men as “friends” of his. In their lawsuit, the three criminals allege mistreatment at the hands of St. Francois County Jail staff.
Disturbingly, one of the multiple complaints filed by McSean suggests that the American Civil Liberties Union (ACLU) has intervened on his behalf at least once. In a hand-written complaint submitted in August, McSean wrote:
“After being informed that the ACLU and an attorney has contacted the St. Francois county detention center of [sic] the constitutional rights of transgender persons, I submitted an inmate request form as to the status of ability to purchase and have female undergarments.”
While the ACLU has not commented publicly on McSean’s case, the organization has been known to be a strong advocate of transgender inmates, even those who have committed the most heinous crimes.
In Indiana, the ACLU recently filed a lawsuit against the state’s Department of Corrections after a trans-identified male inmate convicted of murdering his infant stepdaughter was denied “gender affirming” surgeries. The suit, which was filed on August 28 of 2023, challenges a recently-adopted policy stipulating that the Indiana Department of Corrections (IDOC) cannot provide transgender surgeries to inmates.
The ACLU has also lamented the criminal penalties of transgender inmates, including the Florida execution of rapist and murderer Duane Owen.
On June 16 of 2023, the ACLU, through their official Twitter account, lambasted the state of Florida for refusing to provide “medically necessary gender-affirming care” to Duane Owen. Using feminine pronouns to refer to Owen, the ACLU claimed the state had caused Owen “enormous suffering” and had violated “her right to be free from cruel and unusual punishment for the more than 30 years she was in state custody.”
They further stated that Owen, who had raped and murdered two women in an effort to “harvest their hormones,” had argued in legal documents that he “should be afforded the essence of human dignity.”

If carried out as planned, the executions in Alabama, Missouri, Oklahoma, South Carolina, and Texas will mark the first time in more than 20 years—since July 2003—that five were held in seven days, according to the nonprofit Death Penalty Information Center, which takes no position on capital punishment but has criticized the way states carry out executions.
As for how they are being killed, you need to know about this:
Alabama on Thursday is preparing to carry out the nation’s second execution ever using nitrogen gas after becoming the first state to use the new procedure in January. Alan Miller is set to die by the process in which a mask is placed over the inmate’s head that forces the inmate to inhale pure nitrogen.
Khalil Allah and Marcellus Williams both had substantial evidence that they were innocent.
Travis Mullis and Emmanuel Littlejohn are both victims of horrific childhood trauma, violence, and abuse, with Mullis being particularly vulnerable from his mental health state, who even decided to waive his right to a stay of execution.
Alan Miller and Khalil Allah both attempted to be executed previously, and their executioners failed.
None of these men deserve to die this way. Abolish the death penalty.

Transgender youth have a much greater risk of suicide, according to the US Centers for Disease Control and Prevention. However, if they have access to a puberty blocker, their chances of suicide and mental health problems in the immediate term and down the road decline significantly, a new study finds.
The study, the first of its kind to examine access to pubertal suppression and suicidality, was published Thursday in the medical journal Pediatrics. The research comes as a handful of states are considering placing restrictions on transgender health care.One state, South Dakota is considering a law that would make it a felony for health care providers to prescribe medication to stop puberty, among other gender affirming health care treatments. South Carolina and Missouri are also considering similar restrictions

The legislation would contradict medical guidelines from several associations, including the Endocrine Society, which has guidelines that recommend doctors offer transgender teens pubertal suppression therapy , also known as puberty blocking. It became a treatment option in the United States in 1998.

Those who underwent the puberty-blocking treatment had lower odds of lifetime suicidal ideation and past-month severe psychological distress, compared to those who wanted the treatment but did not receive it.
Researchers reached that conclusion by analyzing data from the 2015 US Transgender Survey, involving 20,619 people between the ages of 18 and 36 years old.
Some smaller studies in the past have shown that people who have undergone puberty-blocking treatments early in life, along with psychological support, have better mental health outcomes later in life.”

A Month of Islam in America: May 2019
After more than 11 years of aggregating the painful details of the onset of sharia law in America, May 2019 was the month American tech companies Wordpress.com and Automattic enforced sharia law and banned the Creeping Sharia blog. With no explanation.
WordPress.com Blacklists Blogs Critical of Islam
Originally we suspected it was several years-old images (seen here) that Pakistan claimed violated Islamic sharia law but that would be too easy. It was more likely that terror-linked, foreign-funded CAIR was involved in the systematic shutting down of sites in America that are critical of sharia law and jihad.

A federal judge on Monday handed an Illinois man Adel Daoud a 16-year prison sentence for trying to kill hundreds of people by detonating what he thought was a car bomb outside a crowded Chicago bar, saying she factored in Adel Daoud’s mental health in imposing a sentence much lower than prosecutors requested.
The sentence — which, with time served, could mean the 25-year-old goes free in less than 10 years — includes prison time for attempting to have an FBI agent killed and for slashing an inmate with a shiv for taunting him with a drawing of the Prophet Muhammad.

Michael Bruce Messer, Jr., posted a message in an online forum stating he was interested in joining ISIS and volunteering as a suicide bomber.
While at his residence, agents found a .38 caliber pistol, according to the statement. They found another .38 caliber pistol during a warrant search on May 9, 2018 as well as assorted items related to ISIS, according to the statement.

Today is the 6th day of May welcome to the Daily Audio Bible I’m Brian it is wonderful to be here with you today as we move to the center of another of our weeks together. So, yesterday we began the book of Ruth, even as we ended the book of Judges and we talked about it being a breath of fresh air and…and it is. It's a beautiful story of character. Today we will conclude…it’s a short story…so we’ll conclude the book of Ruth today. So, we’re reading from the New Living Translation this week. Ruth chapters 2, 3, and 4.
Prayer:
Father, we thank You for Your word and we thank for this story, the book of Ruth that we have been able to enjoy over the last couple of days. We thank You for story of character and loyalty and uprightness because it's severely contrasted with what we've worked our way through in the book of Judges. And, so, we…we have this picture of what it looks like for everybody to go do what they want and over centuries what that does to people individually and collectively. And we have this picture here of uprightness, of goodness, of loyalty, of humility, of mercy, of not taking advantage. We thank You for this contrast between Judges and Ruth. We also thank You for showing us and beginning to set up the story that will lead us to King David who we will meet before too long. Thank You Father for ministering to us through Your word each and every day, giving us things to apply into our lives and hearts and to think about and to change and to repent of and to find comfort in. Like, You are constantly present and we thank You for leading us and directing us through Your word and we invite Your Holy Spirit to keep bringing up things into our hearts, into our minds, that we need to ponder, that You are leading us into as we move through this day. Come Holy Spirit we pray. In the name of Jesus, we ask. Amen.

I had a lot of anxiety at the beginning of this and I’ve really had to press into the Scriptures and pray and started ignoring all news related to it but I’m still doing my part like hand sanitizing and wearing a mask when I go to the store. Anyway, Lord, please bless the mental health of Your people Lord. Help us to increase, enjoy, in n wisdom, imagination, kindness, love, peace, purity, and patience Lord. Bless us with these things. Help us to see the truth that You are in control Lord, that You are all-powerful during this time, nothing has caught You off guard. Nothing is stronger than You Lord. Nothing can happen to us. You know us individually Lord. The Scripture say that You’ve counted the hairs on our head, and nothing will befall us, nothing will happen to us outside of Your approval. And help us to lean in on that Lord. Help Your Psalms 91 promises Lord that You will keep the us under the pinions of Your wings, metaphorically. Help us keep that in our heart Lord. Help that to resonate with us and become who we are Lord that we know that You’re our shield like David said, You’re our glory, the lifter of our head Lord. Bless us with joy abundantly during this time that we can see the trickery of the enemy and that we can rise above it in joy, that we can share Your life with others. In Jesus’ name I pray. Amen.
Hey there DAB family this is Catherine the South African from Houston calling. I’m a little behind on my DAB listening and I had listened to April 18th today and I heard Val from Vegas. And Val am so glad to hear you, are doing so well and that everything turned out so well for you. I am thrilled to hear the joy in your voice, and you gave me so much joy. So, God bless you and I hope that’s…you just continue to get stronger and stronger. And then there was a lady called Good News Cindy I think and she called and really made me smile just thinking of all the things that she’s enjoying about COVID if there’s…if one can even look at it in that light. But it made me think about what I’m grateful for and there is so much, there is so much to be grateful for. You touched about having time to be outdoors and take…to be…take notice of things that you’d otherwise miss when you’re at work. And we’ve been spending so much time outdoors just appreciating how beautiful the area we live in is, seeing spring slowly come and…well…quite quickly in Houston, take over. But the thing that I most value is that the fact that my husband’s home. He’s been furloughed. I’m working from home part time and we just have this amazing time together and it occurred to me, the next time we’re probably gonna be sitting around, “what do you feel like doing today love” is probably going to be when we’re both retired. And, so, I encourage married copies to just love each other and just enjoy this time together because goodness knows it’ll probably be a long time before we get something like this again. Alicia from Pennsylvania calling. I just heard some woman talking about her daughter and I just wanted pray for them. Lord, just give that mother the words to be able to talk with her daughter. Her daughter had said that she hadn’t slept in four days and I feel like I can relate to that and just the amount of mental strain that that brings. Crying on the floor in the fetal position for an hour, like just reminds me of my teenage years. And my mother was so…I know…I know that those times weighed so heavy on my mother’s heart and that she would have done anything to help me. And I just couldn’t hear her at the time. And I want to just tell you that there’s hope. I’m medicated now for bipolar and I have never felt better emotionally and I would say the only main difference between her and me is that I have seen God work in my life and I just pray that she does experience something in her life that shows You that You are real and that You’re here in that You are with her Lord. Lord I just pray that You lift them up, just let them be able to put in Your arms all the things that they can’t explain that have happened to them. This is an encouragement for my sister who is dealing with husband that is abusive and selfish and trying to take away the child that he said he never wanted. And I understand. I went through that myself. All I can say is that God is able to do so much more than you can ever ask, think, or imagine. After my situation was over God had provided a way for me to be the sole provider of my child and also gave me an amazing husband that I love so much. And we would never have been able to have children. So, it’s an amazing thing. God works through our trials and our battles are His battles. So, put on your armor every day. Gird your loins, expect to fight, but then just submit fully to the hand of the Lord and trust Him because He will deliver you. He is your deliverer. He loves you and your daughter beyond measure. D.C. Blocked From Legalizing Marijuana Sales
A bill placed to extend protections shielding state medical marijuana laws from federal disturbance is part of a 1,070-bill, that the incoming House Democratic majority plans on passing as part of a strategy to end the ongoing government shutdown.
Cannabis Protection rider has been enacted since 2015 but technically expired with the shut down last month. This leaves medical marijuana patients and providers in a limbo of legality as federal drug enforcement, and prosecution efforts are exempted furlough
According to Section 537 of the Democrats’ new bill,
“None of the funds made available under this Act to the Department of Justice may be used, with respect to any of the States of Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming, or with respect to the District of Columbia, Guam, or Puerto Rico, to prevent any of them from implementing their own laws that authorize the use, distribution, possession, or cultivation of medical marijuana.”
Hence, if the Senate approves the bill after the house does on Thursday, Trump will sign it into law, meaning state-legal medical marijuana companies would again be protected from law enforcement actions by an agency such as the D.E.A., until September.
Although in reality, it’s a 50/50 chance, as President Donald Trump demands to fund for a proposed wall along the Mexican Border, which the Democrats have refused to support. It is not set in stone if the Republican-controlled Senate plans on sending the appropriations bill to Trump’s desk without any funding for the wall. According to the report, Majority Leader Mitch McConnell (R-KY) and Sen. Richard Shelby (R-AL), the chamber’s Appropriations Committee chair, have both said: “they don’t see a point in voting on something the president won’t sign.”
All in all, broader recreational cannabis laws and people operating under them are not covered under the rider in the Democrat’ bill.
However, the new law also contains upsetting news for marijuana advocates, although the rider blocks Washington D.C. from spending any of their money to legalize and regulate adult-use and sales even though an old 2014 ballot ended the city’s prohibition on low-level possession and home grows.
Last year Mayor Muriel Bower (D) announced that she plans to present a bill legalizing marijuana commerce to the District of Columbia Council in early 2019. Although if congressional Democrats’ legislation is achieved, she will have no choice but to choose between potentially counter federal law or wait until October, when the new bill would lapse.
Justin Strekal, political director for NORML, said in a statement, “Democratic appropriators have been incredibly receptive to ending the absurd prohibition of allowing the District of Columbia to implement their laws as voters intended.” “Those who would seek to maintain this punitive restriction do so against the very foundation of our federalist structure under the Constitution.”
Next year brings the possibility of a broader rider protecting states with recreational marijuana laws, not just on medical cannabis.
Incoming House Appropriations Chair Nita Lowey (D), the author of the current large-scale spending bill, wrote, “The only differences between what I will introduce on Thursday and the Senate bills from the 115th Congress are technical, conforming, and scorekeeping adjustments.”

This is a long post, because whatever this system was, it was an aberration and merits a long story. It messed around with peoples lives and property and mental health from the Midwest down through the Southeast and then up the coast with tornados, thunderstorms, deluges, hail, with awful consequences such as the boat accident in Branson, Missouri and the floods in the Mid-Atlantic states.

Is it July or March? A rare and steep summer dip in the jet stream has brought an incredibly wacky week of weather to the Lower 48.
Usually, this fast-moving air current along which storms track retreats in summer, meandering listlessly in Canada.
Not so in recent days.
“The jet stream has stretched all the way from Canada to the Gulf of Mexico over the eastern U.S., helping to trigger the intense tornado outbreak in Iowa, and the persistent, torrential rains in the Mid-Atlantic,” said Jeff Halverson, Capital Weather Gang’s severe weather expert. “Even veteran meteorologists with decades of experience are astounded by the extreme nature of this jet stream pattern.”
As this jet stream and pool of cold air in its wake have interacted with all of the intense midsummer heat over the Lower 48, it has incited all sorts of unusual and severe weather. Not only has the pattern been extreme but it has also become stuck in place. This has led to day after day of remarkable and frequently disruptive weather.
Thursday
Things kicked off Thursday when the jet stream dived south through the Midwest, triggering at least a dozen confirmed tornadoes in Iowa. Despite a direct hit to Marshalltown, a city of 28,000, and hefty damage on the outskirts of Pella, there were no fatalities — a testament to the high lead time provided by the National Weather Service in warnings issued that day.
Farther south Thursday, a derecho with widespread 60 to 80 mph gusts tracked from southern Nebraska down into northern Arkansas, spelling disaster at Table Rock Lake in Branson, Mo. The storm had a history of producing damaging winds — up to 89 mph in Lecompton, Kan. — along its nearly 500-mile track. The well-forecast storm caught some off guard, killing 17 people when it sank a duck boat trapped in high winds and waves.
Friday
The upper-level disturbance wrapped up in the diving jet stream plowed farther south and east Friday, shifting the threat for severe storms over the Ohio and Tennessee valleys. The Storm Prediction Center had a “moderate risk” of severe weather over portions of Indiana, Kentucky and Tennessee. The biggest threat proved to be damaging winds. The National Weather Service received 395 reports of high wind or wind damage. But that wasn’t all. Softball-size hail — incredibly rare in July, thanks to high freezing levels in the atmosphere — was reported in Kentucky.
Saturday
The weird jet stream helped to drag moisture up the Eastern Seaboard, setting the stage for prolific rains. At Reagan National Airport near Washington, four inches came down. Since 1941, only a dozen other calendar days have seen four inches or more.
To the south, a pair of nighttime supercell storms northeast of Chattanooga, Tenn., merged and formed a line around 2 a.m. Saturday. This line collapsed south into Georgia.
The National Weather Service hoisted a severe thunderstorm watch for the Atlanta metro area at 3 a.m. as the windy storms raced south during the morning rush hour. As soon as they were gone, the sun came out, the atmosphere reloaded, and the stage was set for another round of dangerous storms in the afternoon. For the second time that same day, a severe thunderstorm watch was in effect
.One storm that afternoon even split and formed two new supercells. Thanks to northwest flow and an unusual turning of the winds owing to the bizarre jet stream, the “left split” supercell blew up into a massive storm. The really weird part? This storm was spinning clockwise, or anticyclonic. Less than 2 percent of mature supercells do so. That storm went on to produce tennis-ball-size hail in Dacula, Ga. — the second-largest hailstone on record in the Peach State in July.
Sunday-Monday
Storms continued south into Florida on Sunday, and on Monday, they threw it into reverse — literally. Though the steering flow pushed clouds southeast, the cluster back-built westward along the front at the same rate. This gave the appearance of a stationary line of storms at the mouth of the Mississippi River, producing nearly 200,000 lightning strikes over the course of its 19-hour life span. It was nuts.
Tuesday-Wednesday
The stalled storm system has been blamed for widespread flash flooding from the Carolinas up through New England, drawing a fire hose of tropical moisture up the East Coast. Baltimore has picked up more than 15 inches of rain, a July record.

While the West Coast has not dealt with storminess, it has endured extreme weather of its own. Like a see-saw, the jet stream has lifted north allowing scorching heat to swell from the Desert Southwest to Seattle.Death Valley, Calif. soared to a daily record of 127 degrees Tuesday, very close to its highest temperature measured in decades: 129 degrees on June 30, 2013. Seattle is predicted to have its longest streak of hot weather on record with temperatures at least 88 degrees for a week. The Weather Service is also calling for “very dangerous heat” in the Sacramento Valley.

Renters still evicted, despite federal ban | News, Sports, Jobs
BOSTON — A nationwide eviction ban was supposed to protect tenants like Tawanda Mormon, who was forced out of her two-bedroom apartment last month in Cleveland.
The 46-year-old, who was hospitalized in August for the coronavirus and can’t work due to mental health issues, said she fell behind on her $500-a-month rent because she needed the money to pay for food. When she was evicted in October, Mormon said she was unaware of President Donald Trump’s directive, implemented in September by the Centers for Disease Control and Prevention, that broadly prevents evictions through the end of 2020.
“It was difficult. I had to leave all my stuff,” said Mormon, who has been staying with friends and relatives since her eviction. “I don’t have no furniture, no nothing.”
With most state and local eviction bans expired, the nationwide directive was seen as the best hope to prevent more than 23 million renters from being evicted amid a stalemate in Congress over tens of billions of dollars in rental assistance. It was also billed as a way to fight the coronavirus, with studies showing evictions can spread the virus and lead to an increase in infections.
The CDC order has averted a wave of evictions, housing advocates said, but tenants are increasingly falling through the cracks.
Some judges in North Carolina and Missouri refused to accept the directive, tenant advocates said.
The order has been applied inconsistently, and some tenants, who had no legal representation, knew nothing about it.
Landlords in several states also unsuccessfully sued to scrap the order, arguing it was causing them financial hardship and infringing on their property rights.
“Right now, we are seeing variations in the way courts are applying the CDC order, and we are also seeing a lack of knowledge among tenants and property owners,” said Emily Benfer, a law professor at Wake Forest University and the chair of the American Bar Association’s COVID-19 task force committee on evictions. “Advocates are working overtime to inform tenants of their rights under the CDC order and, in many places, evictions are going forward.”
In Fremont, Nebraska, Dana Imus went to court this month to avoid getting evicted for falling behind on rent. The 41-year-old mother of four lost her job as a forklift operator in March due to the pandemic and hasn’t been able to get another one — partly due to her car breaking down.
When she presented a declaration to her landlord that she qualified for the federal moratorium, she said he told her wrongly that Nebraska didn’t recognize it. She also tried to pay her landlord $400 of the $1,000 rent for October, but he refused. She used the money, instead, for a car payment and now has no money for rent.
“It’s been a struggle,” she said. “It’s stressful. But I trust God so, I mean, I’m not too worried about it. I know I am not going to be evicted because I trust God.”
Those who didn’t know about the CDC moratorium include Charlene Wojtowicz, who thought she had avoided eviction from her two-bedroom house in Cleveland after a nonprofit paid three months of her back rent and her landlord withdrew his lawsuit. This week, the landlord demanded the 33-year-old mother of three pay the $455 she owes for November.
“I’m worried that me and my kids will be out on the street,” said Wojtowicz, who lost a new housekeeping job after getting COVID-19 this summer. “I’m a single mother with three children trying my hardest. It’s not like I don’t want to pay this man.”
Eviction filings have begun creeping up in several states, with the Eviction Lab at Princeton finding cities in South Carolina, Ohio, Florida and Virginia saw big jumps during October. A factor, tenant advocates said, was the CDC’s guidance related to the order last month that allows landlords to start eviction proceedings.
“It’s pretty alarming that lots of evictions are still, at least, being filed,” said Eric Dunn, director of litigation at the National Housing Law Project in Richmond, Virginia. The act of filing an eviction, he said, can prompt tenants to move out ahead of a hearing over fears that an eviction record would prevent them from renting another apartment.
“Because tenants often value their ability to obtain other rental housing over remaining in one specific property, the fact that such cases are being filed likely has a chilling effect on tenants who would otherwise assert the moratorium,” he said. “Tenants who receive eviction notices will move out to avoid the creation of an eviction record, rather than stay in their homes.”
The CDC last month also said landlords have the right to challenge the veracity of tenants’ declarations that they qualify for the moratorium. A false claim could result in criminal charges for perjury, and lawyers for landlords have taken advantage of that language to challenge tenants in court.
To be eligible for protection, renters must earn $198,000 or less for couples filing jointly, or $99,000 for single filers; demonstrate that they’ve sought government help to pay the rent; declare that they can’t pay because of COVID-19 hardships; and affirm they are likely to become homeless if evicted.
“We now have to fight this battle every time we go into court, where it’s not enough that the tenant provides the declaration,” said Hannah Adams, an attorney for Southeast Louisiana Legal Services. “Now they have to explain where every penny of their monthly check is going or even if they are getting a check. It creates a higher burden for tenants than was intended by the original order.”
Also driving evictions is that the order only applies to nonpayment of rent.
As a result, landlords are increasingly trying to sidestep the order by evicting tenants for minor lease violations like excessive noise or trash, or they are simply not extending leases, tenant advocates said.
That is what is happening to Imus, according to Caitlin Cedfeldt, a staff attorney at Legal Aid of Nebraska. Even before a judge ruled Monday that she qualified for the federal moratorium, her landlord gave her a new notice to vacate, alleging criminal behavior at her residence.
“The landlord lost today, but I think they are going to keep coming after her with notices like these in an attempt to circumvent the federal order,” Cedfeldt said by email.
The other challenge is that any legal victory could be short-lived. The CDC order is set to expire Dec. 31, just when a spike in virus cases threatens to further undermine the economy. Many tenants owe months of back rent. The global investment bank and advisory firm Stout estimates that by January, renters will owe as much as $34 billion.
It is unclear if the moratorium will be extended as tenant advocates have demanded. In addition, a coronavirus relief package that could include tens of billions of dollars for rent and mortgage assistance appears to be going nowhere. State and local rental assistance programs provided some relief, but advocates say the funds fall far short of what is needed.
Advocates already are pressing President-elect Joe Biden to sign a broad, new national eviction moratorium on his first day in office. They want Biden to work with Congress in his first 100 days to pass a relief package that includes at least $100 billion in emergency assistance for renters and landlords and resources for the homeless.
“By the time President-elect Biden takes office on Jan. 20, we may be in the midst of a historic eviction crisis in our country if no action is taken between now and then,” said Diane Yentel, president of the National Low-Income Housing Coalition.

Maya Goldman, 21, was elected as editor in chief of The Daily in January only after she was able to name the 11 members of the City Council, along with their wards and get together affiliations. In an indication of how significantly The Daily takes its responsibility to completely cover town, Maya Goldman, 21, was elected editor in chief only after she was in a position to name the eleven members of the City Council, together with their wards and party affiliations.

Modern Context of the Black Bill of Rights

The 116th United States Congress is the most diverse assembly to date; 22% of current members of Congress are nonwhite. Of these members, 56% are Black, 43% are Hispanic, 17% are Asian, and 4% are Native American [i]. When the Congressional Black Caucus (CBC) was established in 1971 with just thirteen members, its founding members had one simple, but as yet unattainable goal: to “create a forum where they could discuss common political challenges and interests”[ii]. At the time of the caucus’s founding, the thirteen black members of Congress were the largest group of black congresspeople yet elected. These members included Shirley Chisholm (New York), William Clay, Sr. (Missouri), and Charles Diggs, Jr. (Michigan). The group’s first major act was to boycott President Nixon’s 1971 State of the Union Address after he refused to meet with them. When the CBC finally did meet with the president, they presented him with 61 recommendations intended to eliminate systemic racism in the United States and achieve racial equality. These recommendations were compressed into the Black Declaration of Independence and the Black Bill of Rights, unveiled in 1972. The Bill of Rights includes twelve sections, spanning topics including foreign policy, education, and the military. The list of demands is certainly ambitious; most of the recommendations have not been met, though many remain topics of modern political discussion. Each section and its modern context is explored below.
Jobs and Income
In this section, the CBC notes the disproportionate unemployment rates for Black and white laborers, which remains a problem today: “While the national unemployment average is about 6%, Black unemployment is an intolerable 10.6%” [iii]. A disparity persists; the unemployment rate for white Americans in the second quarter of 2019 was 3.1% and the rate for Black Americans was 6.1% [iv]. Interestingly, the CBC also suggested an idea that is still considered radical today: universal basic income. The concept was most recently popularized by 2020 Democratic presidential candidate Andrew Yang, who proposed instituting a $1,000 monthly payment to all American adults [v] The adoption of universal basic income seems unlikely, as only 43% of Americans “support a universal basic income program as a way to help people in the U.S. who lose their jobs because of advances in artificial intelligence” [vi].
Foreign Policy
The main idea presented in this section is an end to foreign involvement (excluding financial aid). Though the U.S. continues to be involved in foreign military activities, it has met the recommendation to “[withdraw] all economic or political support from African countries that practice suppression and perpetuate inequality and apartheid” [iii]. The Anti-Apartheid Act (1985-1986) “declares that it is U.S. policy to impose additional measures against South Africa if substantial progress has not been made within 12 months of enactment of this Act in ending apartheid and establishing a nonracial democracy” [vii].
Education
Concerning education, the CBC advocates for “federal, state, and local authorities to comply fully with the Supreme Court’s recent school desegregation decision that busing will be employed as a suitable means to ensure quality education for all American children” [iii]. It also notes that forced integration does not solve all problems within the education system, encouraging conversations to “[move beyond] the sterile issue of ‘busing’ to the basic issue of the redistribution of educational wealth and control.” Today, “approximately 77 percent of Hispanic students and 73 percent of Black students attend schools that are majority students of color… and approximately 88 percent of white students attend schools that are at least half white,” [viii] indicating that unofficial segregation is an issue. American public schools are funded by a combination of local, state, and federal sources but almost half of these funds are from local property taxes [ix]. A report published by the U.S. Commission on Civil Rights notes, “the majority of students enrolled in public schools in the U.S. come from low-income households. Poverty is strongly linked with racial and ethnic minority enrollment in schools, and the higher this minority enrollment, the higher the enrollment of students coming from high-poverty households” [viii]. Furthermore, “Given that school resources are so closely tied to the wealth of a community, low-income students and students of color are more likely to attend a neighborhood school that spends less on them and can provide fewer quality resources compared to a wealthier school that serves white students that would be able to provide more spending per-pupil and more quality resources” [viii].
Housing and Urban Problems
This section addresses familiar problems such as a lack of affordable urban housing and gentrification. It also recommends the establishment of a new Homestead Act in an effort “to make use of the billions of dollars worth of land now owned by federal, state, and local governments” [iii]. There have been several modern iterations of the Homestead Act, inspired by the original version enacted in 1862. The New Homestead Act of 2007, which did not pass into law, focused on rural revitalization and sought “to reward the hard work and risk of individuals who choose to live in and help preserve America’s small, rural towns…” [x]. In 2019, the Great Democracy Initiative, a progressive-oriented coalition, released a plan for implementing a Homestead Act that would address abandoned urban areas. “Homestead cities” would be chosen based on several factors, including employment opportunities, land availability, community involvement, and environmental impact [xi].
Health
The accessibility of healthcare in America is a popular political topic, particularly with the upcoming 2020 presidential election. The CBC also recognized lack of healthcare availability as a major problem, writing, “The current inaccessibility of adequate health delivery to all Americans, lack of adequate or comprehensive health coverage, and seemingly uncontrollable rises in health cost combine to relegate countless Americans to a state of insufficient medical care” [iii]. This insufficiency has been further defined as a result of the COVID-19 pandemic. Minorities are disproportionately affected by the virus; according to the CDC, American Indian or Alaska Native persons have an infection rate 2.8 times higher than that of white persons, Asian persons have a rate 1.1 times higher, Black persons have a rate 2.6 times higher, and Hispanic or Latino persons have a rate 2.8 times higher. These groups also have higher rates of hospitalization and death (excluding the rate of death for Asian persons, which showed no increase over that of white persons) [xii]. An analysis by FiveThrityEight showed that minorities also have less access to testing: “Our analysis revealed that, in many cities, testing sites in and near predominantly Black and Hispanic neighborhoods are likely to serve far more patients than those near predominantly white areas” [xiii]. This indicates that COVID-19 has had a greater impact upon minority communities and that people in these communities are likely to experience longer waits for testing and results and perhaps even testing shortages. This disparity is caused at least in part by a reluctance on the part of businesses to open in heavily minority areas, which tend to be lower-income, choosing instead to open in higher income (often majority white) areas.
Minority Enterprise
This section contains familiar calls for an increase in the number of Black-owned businesses, to be achieved via federal grants and loans and creating government contracts exclusively for Black-owned businesses. No such federal programs are currently in place, but the number of minority-owned firms is on the rise; the number of such firms in the U.S. grew to 8.0 million in 2012, compared to 5.8 million in 2007. In the same period, the number of total U.S. firms only grew from 27.1 million to 27.6 million [xiv].
Drugs
In this section, the CBC recognizes the devastating impact of drugs but advocates against the practice of imprisoning drug addicts as criminals, going directly against President Nixon’s “war on drugs.” The federal push against drug use was characterized by actions such as “increasing anti-drug enforcement spending, creating a federal drug task force, and helping to foster a culture that demonized drug use and drug users” [xv]. In contrast, the CBC urged the Democratic Party to treat addicts as people with “serious health problems” [iii]. According to Pew Research Center, imprisonment for drug offenses may not be as effective as it is assumed to be: “The analysis found no statistically significant relationship between state drug imprisonment rates and three indicators of state drug problems: self-reported drug use, drug overdose deaths, and drug arrests” [xvi]. The idea of drug addiction treatment as an alternative to imprisonment is not new, but it is supported by an increasing body of research. According to the Substance Abuse and Mental Health Services Administration, “In 2015, an estimated 21.7 million people aged 12 or older needed substance use treatment, or about 1 in 12 people…in 2015, 10.8 percent of people aged 12 or older (2.3 million people) who needed substance use treatment received treatment at a specialty facility in the past year” (xvii). The National Institute of Health reports that drug addiction treatment works to reduce criminal activity and drug use and improve social, psychological, and occupational functioning. Furthermore, drug treatments such as methadone are significantly less expensive than imprisonment [xviii].
Penal Reform
In this section, the CBC calls for several prison reforms including, “(C) The systematic inclusion of such aids to rehabilitation as halfway houses for men, home furloughs for married men and women, privacy…and to the full restoration of civil rights including the right to vote upon completion of a sentence,” and “(E) The revamping of first offender programs, methods of bail release, and parole and probation systems so as to encourage and assist the prison resident in readapting to society” [iii]. Rehabilitation after imprisonment is certainly not easy in the U.S. Formerly incarcerated individuals face consequences even after imprisonment; Renew Democracy Initiative reported that “nearly half of ex-prisoners report no earnings in the first year after leaving prison” and “nearly 45% of released convicts return to prison within a year” [xix].In 2016, approximately 6.1 million people were without voting rights as a result of a felony conviction [xx]. Although the CBC recommends “revamping” bail release methods, cash bail has recently been heavily criticized for its disproportionate effect on low-income offenders. According to a guide published by Harvard Law School, “The practice of making the payment of a money bond a requirement for pretrial release discriminates based on wealth, exacerbates racial disparities, results in over-incarceration, and imposes unnecessary costs on individuals and society at large” [xxi]. Lower-income individuals are incarcerated not because they have committed worse crimes than higher-income individuals, but because they are unable to pay for their own release. Judges determining cash bail amounts may also exhibit racial biases: “Recent empirical research finds that judges over predict the risk of Black defendants committing crimes on pretrial release and under predict the risk of white defendants committing crimes on pretrial release. Accordingly, money bail is imposed more often on Black defendants than white defendants, and Black defendants receive higher bail amounts than white defendants” [xxi].
Democratic Administration Appointments
This section recommends that the Democratic Party call for Black Americans to be properly represented in all appointed positions, including the Cabinet of the President. According to the U.S. Census Bureau, the U.S. population is 13.4% Black/African American, 18.5% Hispanic/Latino, 5.9% Asian, .2% Native Hawaiian/Pacific Islander, 1.3% American Indian/Alaska Native. and 2.8% two or more races [xxii]. Currently, of the voting members of Congress, 10.1% are Black/African American, 9.2% are Hispanic/Latino, 3.2% are Asian/Native Hawaiian/Pacific Islander, and .7% are American Indian/Alaska Native [i]. President Trump’s Cabinet currently has one Black member and one Asian member.
Justice and Civil Rights
This section tackles strengthening voting rights and increasing Black appointments to positions within the Justice Department. Most Americans today can agree that diversity in workplaces and in the government is important and, according to Pew Research Center, 64% of white Democratic-leaning Americans do not think we have gone far enough in giving Black people equal rights with white people [xxiii]. However, FiveThirtyEight created a compilation of polls that show that though diversity is wanted, methods of actually implementing it have inconsistent support among Black and white Democratic-leaning Americans. For example, a Gallup poll found that only 32% of white Democrats support reparations compared to 80% of Black Democrats, 65% of white Democrats support federal involvement in school integration compared to 83% of Black Democrats, and 33% of white Democrats think that police officers generally cannot be trusted compared to 71% of Black Democrats. Both white and Black Democrats, though, are wary of considering race in college admissions and job applications [xxiv].
Self-Determination for the District of Columbia
In this section, the CBC calls for full congressional representation for Washington, D.C., “the Last Colony,” noting that the city is mostly Black [iii]. The nation’s capital is still without full congressional representation, having only a non-voting representative in the House (Eleanor Holmes Norton). Washington D.C. currently has around 702,000 residents, more than Vermont and Wyoming. On June 26, H.R. 51 passed with a 232 - 180 vote. It states: “The bill provides for the admission into the United States of the state of Washington, Douglass Commonwealth, composed of most of the territory of the District of Columbia. The commonwealth shall be admitted to the Union on an equal footing with the other states” [xxv]. It is not expected to pass through the Senate.
The Military
In this section, the CBC advocates for equality within the military, noting that “this nation cannot be secure as long as the forces are more concerned with protecting themselves against their fellow servicemen than they are with fighting the external enemy” [iii]. They also call for the removal of the judicial system from the military, instead recommending the use of civilian federal courts. Modern discussions about race in the military have shifted from unequal treatment to aggressive recruitment of low-income Americans. In 2017, 57% of service members were white, 16% were Black, 16% were Hispanic, 6% were “other”, and 4% were Asian [xxvi]. The “No Child Left Behind” Act (2001-2002) stipulates that “each local educational agency receiving assistance under this Act shall provide, on a request made by military recruiters or an institution of higher education, access to secondary school students’s names, addresses, and telephone listings” [xxvii]. This leads to more intense recruitment of low-income, minority students. For youth ages 16-21, 49% reported that their main reason for joining the U.S. military was to pay for future education [xxviii]. Separating the judicial system from the military has received heightened attention recently, partially due to high reports of sexual assault within the military. According to the Sexual Assault Training Oversight and Prevention Act (or STOP Act, 2013-2014), “The military atmosphere is not conducive to resolving issues of sexual assault and harassment, and sexual violence continues to infect the Armed Forces” [xxix]. This lack of accountability is attributed to the Uniform Code of Military Justice, which allows military commanders to decide which cases move forward in the military judicial system. This presents an obvious conflict of interest, as commanders may be responsible for both the victim and the offender in sexual assault cases. The act did not pass and military judicial system remains unchanged.

CHICAGO–(BUSINESS WIRE)–UnitedHealthcare will expand its fitness program for people enrolled in
its Medicare Advantage plans to Illinois and 11 additional states in
2019. The company is also enhancing the program with new features and
rebranding it as Renew Active.
Renew Active is a fitness program for body and mind designed to help
people live their best lives and achieve their health and wellness
goals. It provides access to an extensive choice of more than 6,000
fitness locations, including national, regional and local options, at no
additional cost. In Illinois, this includes participating Anytime
Fitness, Curves, Gold’s Gym, LA Fitness, Life Time and Snap Fitness
locations. Locations also include local participating YMCAs.
Through Renew Active, people can take advantage of an in-person fitness
orientation to help them get started toward reaching their goals as well
as all of the benefits of a standard membership at participating fitness
locations, including a wide variety of equipment, amenities and group
exercise classes.
UnitedHealthcare is also adding new features to Renew Active so that
plan participants can challenge themselves both physically and mentally.
The program will offer online exercises and activities to help people
keep their minds active.
Renew Active is available at no additional cost to people enrolled in
eligible UnitedHealthcare Medicare Advantage plans.
“We know that our health and well-being are closely connected not just
to the care we receive from our doctors but also to the way we live our
lives,” said Rick Dunlop, CEO of UnitedHealthcare Medicare & Retirement
in Illinois. “With Renew Active, we hope to make it easier, more
convenient and more affordable for people in Illinois to stay active,
both physically and mentally.”
UnitedHealthcare introduced its fitness program in 2017 because of the
important role that exercise plays in health and quality of life as
people age. The response from people enrolled in its Medicare Advantage
plans has been overwhelmingly positive, prompting the company to
significantly expand the program.
In 2019, Renew Active will be newly available to people enrolled in
select Medicare Advantage plans in California, Connecticut, Illinois,
Indiana, Iowa, Kansas, Minnesota, Missouri, Nebraska, Nevada, North
Carolina and Utah. These people will join the nearly 1.1 million
Medicare Advantage plan participants in 11 other states who currently
have access to the program.

become more physically fit through our participation in the Renew Active
network,” said Chuck Runyon, CEO of Anytime Fitness. “We look forward to

The rebranding of the program – previously known as Optum Fitness
Advantage – aligns it with Renew by UnitedHealthcare, the company’s
members-only health and wellness experience.

LGBTQ South Dakotans are facing the fight of a lifetime.
On Thursday, Republican state Rep. Tony Randolph introduced a bill that would outlaw marriage equality, permanently legalize conversion therapy, ban changes to legal gender markers, and block the passage of LGBTQ nondiscrimination protections.
House Bill 1215 is the third in a trio of anti-LGBTQ bills brought to the state’s legislature this month. On Wednesday, the House passed a bill that would criminalize trans-affirming medical care for minors. The other, Senate Bill 88, would require mental health providers to out kids expressing gender dysphoria to their parents. Anti-LGBTQ lawmakers and organizers use the state as a test case for the nation, experts say....

Like most high school students, Aerin Geary does not typically pay attention to state legislation. However, the South Dakota teenager has been closely following House Bill 1057, a Republican proposal that would make it a felony for medical professionals to provide transgender health care to minors.
[...] Like South Dakota, Florida and Colorado have introduced bills that carry criminal penalties. The "Vulnerable Child Protection Act," one of four bills proposed in Florida last week that have been opposed by LGBTQ advocates, would make providing certain medical care or treatments to transgender minors — including nonsurgical care, like hormone therapy — a second-degree felony. Medical practitioners could face up to 15 years in prison and a $10,000 fine.
Bills introduced in Illinois, Oklahoma and South Carolina would impose professional penalties — including the loss of a medical license — on those who provide trans health care to minors. In Missouri, proposed legislation combines professional penalties for medical care providers with penalties for parents or guardians of transgender minors, including a requirement that they be reported to child services. A proposal introduced in New Hampshire last year, which is still being considered, would add “sexual reassignment” to the definition of child abuse in the state’s Child Protection Act....

Public libraries that display “age-inappropriate material” could lose state funding and even see their librarians fined or jailed, under a bill proposed by a Missouri lawmaker.
The bill’s sponsor, state Rep. Ben Baker, a southwest Missouri Republican, said Thursday that the “Parental Oversight of Public Libraries Act” did not target books but was drafted in reaction to Drag Queen Story Hours being held across the state....
[...] The bill would give parents “recourse” to say they were “not OK” with the programming introduced into their community, Baker said. It requires each library district to create five-person oversight board of adults that would hold public hearings and make final decisions on whether “material” was age-inappropriate.Inappropriate “material” would then be moved so it could not be accessed by minors. Librarians who refused to do so could be convicted of a class B misdemeanor, and be required to pay a $500 fine and be sentenced up to a year in jail....
The Illinois bill will almost certainly not advance. It would be wildly unlikely for it to make it out of the Assembly, and the governor would almost certainly veto the bill if it passed. But that’s just one state of several, and it says something that the bill was even introduced in a nominally blue state. (”Nominally” because the voting patterns of the state don’t entirely support that reputation. If it weren’t for Chicago, Urbana, East St. Louis, and to some extent Peoria and Springfield, this state would be ruby red. The population centers currently have enough voters to outweigh the rest of the state.) However, that’s just one state of several. The Missouri bills will almost certainly advance, and the Oklahoma and South Carolina bills seem fairly likely. South Dakota also seems fairly likely to advance its bigoted legislation.
Seems pretty damn broken to me, all things considered.
