Nicht teilnahmeberechtigte Personen erlangen auch im Fall der Auswahl zur Teilnahme keinen Teilnahmeanspruch. Teilnahmevermittlungen über Teilnahme- und Eintragsdienste können nicht berücksichtigt werden.

wefox ist berechtigt, Teilnehmer von der Aktion auszuschließen, die den Teilnahmevorgang oder die Website www.wefox/union manipulieren bzw. dieses versuchen oder gegen die Teilnahmebedingungen oder gegen die guten Sitten verstoßen oder sonst in unfairer bzw. unlauterer Weise versuchen, die Aktion zu beeinflussen.

Alle Teilnehmer, die zwischen dem 24.11.2020 um 0:01 Uhr und einschließlich dem 30.11.2020 bis 23:59 Uhr (nachfolgend „Teilnahmezeitraum“ genannt) die unter Ziffern II.1. genannten Schritte durchführen, nehmen an der Aktion teil. Es sei denn, sie werden gemäß Ziffer II.3. ausgeschlossen.

II.5.

Die Teilnahme an der Aktion ist kostenlos. Die Teilnahme an der Aktion ist weder vom Kauf einer Ware oder Dienstleistung noch von der Bestellung eines Newsletters abhängig.

III. Ablauf III.1. Im Falle eines Gewinns wird der Teilnehmer in Textform (per Mail) benachrichtigt. Er ist in diesem Fall verpflichtet, wefox innerhalb von 24 Stunden nach Erhalt der Benachrichtigung in der dort beschriebenen Form (rechtzeitige Absendung genügt) mitzuteilen, dass er den Gewinn annimmt, welche Trikotgröße gewünscht wird und an welche Adresse der Gewinn versendet werden soll. VII. Haftung wefox haftet für Vorsatz, grobe Fahrlässigkeit, nach dem Produkthaftungsgesetz und für die von wefox ausdrücklich gewährte Garantien / Zusicherungen. Für einfache Fahrlässigkeit haftet die wefox nur bei Verletzung einer wesentlichen Pflicht, wobei die Höhe der Ersatzansprüche summenmäßig begrenzt ist auf die vorhersehbaren, unmittelbaren Schäden. VIII. Vorzeitige Beendigung der Aktion VIII.1.

wefox behält sich vor, die Aktion jederzeit, ohne vorherige Ankündigung, abzubrechen oder zu unterbrechen. Dies gilt insbesondere, wenn aus technischen Gründen (z.B. Viren im Computersystem, Manipulation oder Fehler in der Hard- und/ oder Software) oder aus rechtlichen Gründen eine ordnungsgemäße Durchführung der Aktion nicht gewährleistet werden kann.

VIII.2.

Erfüllungs- und Schadensersatzansprüche des Teilnehmers bei vorzeitiger Beendigung der Aktion sind ausgeschlossen.

Eine Räumungsfrist zur Räumung von Wohnraum kann nach § 721 Abs. 3 ZPO nur verlängert werden, wenn der Mieter darlegt und beweist, dass er sich tatsächlich um für ihn angemessenen und seiner wirtschaftlichen Lage entsprechenden Wohnraum bemüht hat. Die Vorlage alleine von Bewerbungsunterlagen für anderweitigen Wohnraum ist nicht ausreichend, da dies nicht belegt, dass tatsächlich Bewerbungsbemühungen erfolgten. Das Gericht darf nicht auf vermeintlich gerichtsbekannte Umstände (wie knapper Wohnraum) abstellen.

Unternehmen haftet für Wettbewerbsverstoß seines beauftragten Handelsvertreters

Ein Unternehmen muss für Wettbewerbsverstöße beauftragter Handelsvertreter geradestehen. Das hat das LG Frankfurt mit Urteil vom 9. November 2018 entschieden (Az.: 3-10 O 40/18).

Handelsvertreter können als Beauftragte eines Unternehmens handeln. Begeht ein von einem Unternehmen beauftragter Handelsvertreter Wettbewerbsverstöße, kann nach dem Gesetz gegen den unlauteren Wettbewerb (UWG) auch das Unternehmen dafür haftbar gemacht werden, erklärt die Wirtschaftskanzlei GRP Rainer Rechtsanwälte.

So hat auch das Landgericht Frankfurt entschieden, dass ein Unternehmen für die Wettbewerbsverstöße seiner Handelsvertreter nach den Grundsätzen der Beauftragtenhaftung haftbar gemacht werden kann. In dem zu Grunde liegenden Fall machte ein Verbraucherschutzverband Unterlassungsansprüche gegen ein bundesweit tätiges Immobilien-Maklerunternehmen geltend. Für das Unternehmen wurden auch selbstständige freie Handelsvertreter tätig, die im Namen und Rechnung des beklagten Unternehmens handeln. Eine Handelsvertreterin schaltete im Namen des Unternehmens eine Immobilienanzeige, wobei sie die vorgeschriebenen Pflichtangaben zum Energieausweis nicht vollständig angegeben hatte.

Der Verbraucherschutzverband klagte auf Unterlassung. Das beklagte Unternehmen vertrat jedoch die Auffassung, dass der Wettbewerbsverstoß der Handelsvertreterin nicht zu einem Unterlassungsanspruch gegen das Unternehmen führen kann.

Das sah das LG Frankfurt jedoch anders. Der Unterlassungsanspruch bestehe unter dem Gesichtspunkt der Irreführung durch Vorenthalten wesentlicher Informationen zum Energieverbrauch der beworbenen Immobilie. Die von der Handelsvertreterin geschaltete Immobilienanzeige verstoße gegen das Wettbewerbsrecht. Die Handelsvertreterin habe wiederum als Beauftragte des Unternehmens im Sinne von § 8 II UWG gehandelt. Daher habe das Unternehmen auch für die Handlungen der Handelsvertreterin einzustehen.

Beauftragter könne auch eine selbstständige Person sein. Voraussetzung dafür sei, dass sie in die betriebliche Organisation des Unternehmens so eingegliedert ist, dass der Erfolg ihrer Geschäftstätigkeit auch dem Unternehmen zu Gute kommt und dieses einen bestimmenden und durchsetzbaren Einfluss ausüben kann. Dies sei in dem vorliegenden Fall gegeben. Schon durch den Handelsvertretervertrag könne das Unternehmen maßgeblichen Einfluss auf die Tätigkeiten der Handelsvertreterin nehmen. Ob es von dieser Möglichkeit Gebrauch macht, sei unerheblich, so das LG Frankfurt.

CES 2019: here’s what you can expect from the annual tech-stravaganza

CES 2019 is almost here – and while we’re sure to see some surprises, we’ve also had a flurry of announcements from LG, Samsung and others about what they’re planning or not planning to showcase at the huge Las Vegas convention.

We’ve been keeping up with all the new announcements as they happen and our team has been working hard to prepare for this year’s event. What we’re expecting is an absolute deluge of news on January 8, followed by a non-stop scavenger hunt trying to find the best products of the show. It’s exhausting work, but there’s no place like Vegas during CES.

Each year, Sin City plays host to the gadget extravanganza that is the Consumer Electronics Show, now officially shortened to its acronym, CES. It’s the time of year where tech innovators from all over the world gather to announce the latest and greatest in smartphones, wearables, TV and audio tech. New laptops, tablets and smart cars fill row after row of booths at the Las Vegas Convention Center with all the tech coming in the next few years.

Last January we saw innovation in droves at CES 2018, from Samsung’s 146-inch modular MicroLED TV, The Wall, and the incredible HTC Vive Pro to LG’s rollable 65-inch OLED TV and the Huawei Mate 10 Pro. It’s the world’s biggest tech show, and it’s poised to become even bigger in 2019.

What and when is CES 2019?

The 2019 International CES will begin on Tuesday, 8 January and end on Friday, 11 January. It’s been taking place since 1967 and is staged by the Consumer Technology Association (CTA), a trade organization that represents over 2,000 consumer tech companies in the U.S.

Though it gets a lot of attention from the world’s media, this is not an event where the public can go see the latest tech. Unlike the IFA exhibition in Berlin each August, the CES is open only to the electronics trade, as well as journalists, bloggers and plenty of blaggers. (You know who you are…)

How big exactly is CES? It’s huge. If you’re going for the first time, go on a few five-mile walks in the preceding weeks. Seriously, it’s hiking boots-big. There are 2.75 million net square feet of exhibit space. Eleven venues. 24 product categories. Some company’s booths are vast and complex, while other, smaller firms grab a table in one of the 25 marketplaces.

In terms of footfall, the CES attracts about 180,000 people from 155 countries, as well as 6,500 media, who visit 4,500 exhibiting companies. All the biggest tech companies in the world gather … well, except for Apple.

Where will CES 2019 take place?

Since 1978 the CES has been staged in Las Vegas. Why? Hotel rooms, all 150,000 of them, and counting. The main venue is the Las Vegas Convention and World Trade Center (LVCC), which is a short (and very busy) monorail ride from The Strip, where most of the hotels are.

Along with the nearby Westgate Las Vegas and Renaissance Las Vegas, this is referred to as Tech East. This is where most of the major booths are. Tech West (comprising the Sands Expo, The Venetian, The Palazzo, Wynn Las Vegas, and Encore) is where you’ll find hi-fi and audio.

At Tech South (ARIA, Park MGM/Park Theater and Vdara) you’ll see VR, AR, and gaming. There are shuttle buses between the venues, but it’s best to stay put for the day at one of the three areas to avoid the traffic.

When do all the announcements happen?

Although the weeks before the CES are packed with rumors and reports of what may or may not be launched or announced at the CES, it’s not until Sunday, January 6 and Monday, January 7 – the two days before the show opens – that there will be any concrete news. These are the two media days, and they’re when the all-important press conferences are held, and consequently when a lot of the headlines are written.

Sunday is typically light on news, and in 2019 it’s Monday that will see the big companies’ press conferences at the Mandalay Bay Hotel at the south end of The Strip. In 2019, confirmed press conferences include Hisense, Hyundai, Intel, LG, Panasonic, Qualcomm, Samsung, Sony, TCL, and Toyota.

As for whom is actually giving these nail-biting presentations, the first will come from LG on Monday, 7 January; its President and Chief Technology Officer Dr. I.P. Park will discuss AI and ‘self-evolving’ products … and a foldable phone?

January 8 will see keynotes from IBM Chairman, President and CEO Ginni Rometty (trust, AI and quantum) and Verizon CEO Hans Vestberg (5G), while January 9 has AMD’s president and CEO Dr. Lisa Su discuss next-gen computing.

CES 2019 predictions: what’s going to be announced

Just give the attendance list a cursory glance and you’ll see that a lot of bases are covered at CES – you’ll find AR and VR, voice control, connected cars, robotics, smart home, smart cities, health, wellness, sleep, sports, accessories companies, and everything in between.

However, in 2019 there are some trends that are likely to dominate.

The most obvious will be voice control. “Well definitely see more smart speakers with screens,” says Jack Wetherill, Principal Consultant: Home Electronics at Futuresource, who also thinks CES will see voice creep into more and more product categories, such as soundbars possibly from Samsung, Sony and LG. The TV remote control could finally begin its death throes.

“There has already been one TV with far-field microphones in the set itself,” says Wetherill, referring to Toshiba’s upcoming OLED, 4K HDR, and Full HD smart ranges with Alexa built in. CES could also see the spread of Netflix Calibrated Mode beyond some Sony TVs.

Headphones will also get chatty. “A new Alexa development kit from Qualcomm means we’ll see more integration of voice into headphones,” says Wetherill. “We’re waiting for headphones that respond to a wake-word, and while that probably won’t emerge at CES 2019, we will see true wireless earphones with longer battery life – it would be logical if Sony brought more ‘true wireless’ products at CES.”

Another trend will be foldable displays, with the Samsung Galaxy X likely to feature alongside LG’s foldable.

However, foldables could go much deeper than mere phones. “Where we’re expecting real change is laptops and tablets,” says Tom Morrod, Senior Research Director, IHS Markit. “We are expecting to see foldable laptops with OLED screens that extend across the entire keyboard area – this means you could open them up to monitor size, or to book format, or use them as a normal laptop format with the keyboard as half of the touch panel.” But how, exactly, Android and Windows adapt their OS for foldable devices will be interesting. Last but not least, connected cars at CES 2019 could also see integrated OLEDs to replace wing mirrors.

Aircharge at CES 2019

Wireless charging is on the up, and the CES will definitely see three new products from Aircharge: a Fast Wireless Charger 10W, Fast Dual Charger 10W, and a PS4 DualShock 4 Wireless Adapter. Both chargers will deliver 10W fast wireless charging, including both Apple and Samsung fast wireless charging.

AMD at CES 2019

Semiconductor company AMD has already said that it intends to show-off its 3rd-gen Ryzen processors and new graphics products at CES 2019.

According to a recent leak, that will include three new entry-level Ryzen 3 processors (3300, 3300X, 3300G), three mid-range Ryzen 5 processors (3600, 3600X, 3600G) and two Ryzen 7 processors (3700, 3700X). On top of the mainline processors, AMD might also surprise us with a few new mobile processors in the form of the 2.6GHz AMD Ryzen 3 3200U, 2.1GHz AMD Ryzen 3 3300U CPU and 2.1GHz AMD Ryzen 5 3500U.

Beyond processors, CES 2019 might be the place that we see the company’s next AMD Navi GPUs – though, that seems a little less likely than the 3rd-gen processors.

There’s also talk of a new Radeon graphics card, with 7nm Vega II GPUs possibly making an appearance.

Intel at CES 2019

Is Nvidia about to get a serious challenge in the high-end graphics card market? If reports from Anthony Garreffa at TweakTown are anything to go by, a discrete graphics card could be coming from Intel.

In the world of processors, rumor has it that Intel is developing a new 10-core, 20-thread CPU codenamed Comet Lake that will be based on yet another iteration of Intel’s 14nm process. If the rumors are true, this will be the first time Intel has outpaced AMD in the CPU core war in a very long time.

LG at CES 2019

It’s confirmed, LG will definitely have TVs at CES 2019. We can safely say that because the Korean-based electronics manufacturer already announced the Alpha 9 (Gen. 2) TV processor that will power its 2019 OLED TVs. Details were sparse on how it would significantly improve this year’s Alpha 9, but it could be saving that for CES.

We’ve also heard a lot of buzz about LG’s rollable OLED that was available to see behind closed doors at last year’s CES. It’s not confirmed yet, but there’s a good chance it will be available to see on the show floor in 2019. (Actually, that’s almost a given considering that it could be on sale in 2019.)

We also know LG will be showcasing two new ‘ultra’ monitors for the worker bees and committed gamers out there: one being a super-sized 49-inch UltraWide monitor, the other a new 144 Hz UltraGear gaming monitor. LG will also be showing off a new range of high-end Dolby Atmos soundbars, all three of which are launching with Google Assistant built in.

Will LG bring more ‘ThinQ’ branded smart home products? Probably. However, there are also rumors that LG’s CES 2019 keynote will see the unveiling of a foldable phone – though, it might not be available to check out at the show. We may instead have to wait until MWC 2019 to hear about that, though in the meantime we’re likely to hear more on the LG G8 flagship phone before it releases in March with a built-in 3D camera.

Either way, look out for pre-Christmas, pre-CES announcements of B-lister products – it’s an annual tradition from LG’s predictable Comms team.

Moreover, Nvidia may be preparing more than just RTX graphics for laptops at CES 2019, with a reference to MX250 graphics just appearing in an HP laptop listing.

The supposed HP Zahn 66 Pro 14 G2 Notebook PC was reportedly listed somewhere by HP with an Nvidia GeForce MX250 with 2GB of GDDR5 memory, first shared by Twitter user Momomo.

The world’s first foldable phone? That could well come at CES from Royole, which recently teased the FlexPai, the 7.8-inch AMOLED screen that folds in half.

A CES launch for the previously announced Samsung Galaxy Home smart speaker – compete with Bixby – seems a shoo-in, but will Samsung launch its Galaxy X foldable phone? “While the full Samsung launch might be at Mobile World Congress we could instead see the Samsung Galaxy S10 launched at CES, which won’t be foldable but will have 5G and triple camera, plus a new notch design on the front panel,” says Tom Morrod, Senior Research Director, IHS Markit.

Looking to get ahead of the deluge of news, Samsung has announced two new versions of its Samsung Notebook 9 Pen 2-in-1 laptop. Scheduled for a vague ‘2019’ release and with no pricing to speak of, the laptops are both a rehash (13.3-inch) and an expansion (15-inch) of the late 2017 debut model.

We will also almost certainly see Samsung refresh its TV line-up, which will mean more advanced QLED TVs (though probably not a new version of the recent 85-inch Q900R 8K QLED TV). However, if a recent patent filing is anything to go by, we could see a transparent TV. Since Samsung is often launching design-led screens, that wouldn’t be a surprise – though if you’re after some more practical features, the newly announced Remote Access should be able to source files, programs and cloud services from connected devices and computers direct to your TV.

What we do know for sure at this point is that Samsung will enhance its Serif TV and The Frame designer screens with QLED tech. The new screens will make their debut at the show and, according to Samsung, will reside in the large lifestyle TV exhibition zone of Samsung’s booth.

The last rumor we’ve heard concerning Samsung 2019 TVs is that they might include both Bixby and Google Assistant – giving users the choice over which assistant they’d like to use.

Sony at CES 2019

There’s likely to be an almighty rush to launch the first 5G-ready phones in 2019, and Sony’s desire to be first-to-market could mean that the CES 2019 sees the appearance of a 5G Xperia phone.

It’s also possible that Sony will use CES 2019 to launch its 5.9-inch XA3 and 5.7-inch Xperia L3 budget phones, according to KnowYourMobile.com. Sony may also launch a smart speaker-with-a-screen, following in LG’s footsteps.

Spotify at CES 2019

Efficacy or Exclusivity: Can Parties Seek Interim Relief Outside a Seat under the Indian Arbitration Act?

Introduction & Context

In international arbitration, the exclusive jurisdiction of the seat seeks to prevent courts of two nations from simultaneously exercising territorial jurisdiction over a matter, so as to uphold the sanctity of the final award. Courts, under UNCITRAL Model Law on International Commercial Arbitration (Article 8) and the Arbitration and Conciliation Act, 1996 (the “Arbitration Act”), preclude their jurisdiction on merits when faced with disputes with arbitration clauses. However, in relation to interim relief, the need for an efficacious remedy to protect the arbitral process overshadows the need for certainty that the choice of a seat provides.

On April 19, 2017, the Indian Supreme Court in Indus Mobiles Pvt. Ltd v. Datawind Technologies (“Indus”) held that the courts of a city of the seat of domestic arbitration would have exclusive jurisdiction over proceedings under the agreement, even if they lacked a cause of action under the Code of Civil Procedure, 1908 (“CPC”). The decision was rendered while the court was disposing of appeals from the Delhi High Court’s orders to preserve certain properties and for the appointment of an arbitrator. The parties had inserted a clause providing the courts of Mumbai with exclusive jurisdiction. However, the Supreme Court held that a specific choice of seat was by itself akin to an exclusive jurisdiction clause, and cursorily addressed the exclusive jurisdiction clause. Notwithstanding the holding on facts, this post seeks to examine the implications of courts being denied the ability to provide efficacious interim relief due to the treatment accorded to courts outside the seat in the judgment.

Indian Judicial position

The decisions of the Supreme Court cited in Indus need to be evaluated to arrive at the Indian position, before analysing the amended scheme of the Arbitration Act.

In Bharat Aluminium Co. (BALCO) v. Kaiser Aluminium Technical Services Inc., (2012) 9 SCC 552, the Court held that there was deliberate legislative intent to provide both the court where the cause of action is located and the court of the seat of arbitration with jurisdiction over the dispute (¶96-106). It added that the scheme of the Arbitration Act would be rendered nugatory if these courts did not have concurrent jurisdiction. The parties however were free to specify exclusive jurisdiction.

In Enercon (India) Ltd. v. Enercon Gmbh, (2014) 5 SCC 1, the Court held that the parties’ explicit choice of Indian seat and laws meant that the Indian courts have exclusive supervisory jurisdiction. This reversed a Delhi High Court judgement granting London, the venue of the arbitration, concurrent jurisdiction with the seat. Interim measures were separately litigated in India, where the assets were present. In fact, A v. B, (2007) 1 AllER (Comm) 591, relied on here, clearly points out that the choice of seat is analogous to an exclusive jurisdiction clause for the validity of interim or final awards. The court held that the ultimate objective of arbitration was to resolve disputes finally, economically and speedily. Thus, this decision cannot be extrapolated to include any processual inefficiency.

The Supreme Court has dealt with the question of seat, situs and venue in a host of decisions culminating in Union of India v. Reliance Industries Limited and Others, (2015) 10 SCC 213. In cases deemed to be foreign seated arbitrations, the application of Part I of the Arbitration Act was wholly excluded, and thus only the court of the seat had jurisdiction over all implications of the curial law. See Videocon Industries v. Union of India & Anr., (2011) 6 SCC 161.

Amendment of the Arbitration Act

Following the amendments in 2015, section 2(2) of the Arbitration Act reads:

…Provided that subject to an agreement to the contrary, the provisions of sections 9…shall also apply to international commercial arbitration, even if the place of arbitration is outside India, and an arbitral award made or to be made in such place is enforceable and recognised under the provisions of Part II of this Act.

It is accepted position that the word “place” as used in the Arbitration Act (except in section 20(3)) refers to the seat of the arbitration [See BALCO ¶96]. Thus, the Arbitration Act now contemplates interim relief outside the seat to ensure efficacy of the arbitral process. The legislative intent is clearly visible, as the section enumerates three provisions, i.e., sections 9, 27 and 37 which are now applicable to foreign seated arbitrations. It is interesting that the Court in Indus extrapolated pre-amendment decisions of the Supreme Court, without dealing with the inefficiencies the amendment sought to do away with.

Enforcement Difficulties

The Law Commission of India in its 246th report, on the Arbitration Act highlighted difficulties with the BALCO exclusion of foreign seated arbitrations. It highlighted that the parties would have no effective remedy if there were assets located in India, and the courts of India were ousted of jurisdiction.

The situation post Indus furthers domestically the problems that the Law Commission had pointed out in the international context. The party seeking the remedy now has to litigate twice: once to obtain interim relief, and again possibly before a different court to ensure execution. Three areas where the time and complexity of the interim process are increased may be identified:

The Indian position on whether the CPC’s threshold used for temporary injunction under Order 38 Rule 5 and Order 39 Rules 1 & 2 has not reached finality, and may throw up substantive challenges depending on the court (See Nishith Desai Associates’ analysis).

A court’s interim order is not a deemed decree, unlike an arbitration award. Thus, an application would have to be made for the enforcement of the order as a decree, pursuant to section 36 of the CPC.

This order would then have to be transferred from the court of the seat to the court(s) where the remedy lay. Pursuant to section 40 of the CPC, this application would have to be made in line with differential rules of each state.

Comparative positions

Various jurisdictions have differing perspectives on the interaction between the seat and interim relief. However, a predominant number allow for the commercially prudent option of allowing interim relief outside the seat, at least for preservation measures.

England: The courts do not differentiate between international and domestic arbitration, and in U&M Mining Zambia Ltd v. Konkola Copper Mines Plc (2013) held that the parties may apply to courts outside the seat, if that was the only way the interim measure could be rationally sought

Belgium: Both in domestic and international arbitrations, the Private International Law Code stipulates the jurisdiction of the courts. The Belgian Judicial Code (BJC) in §1683 stipulates that the court of first instance, typically having territorial jurisdiction over the interim measure sought, is the court that has jurisdiction over interim measures. Pursuant to §1680 of the BJC, the appointment of an arbitrator is to occur at the court of the seat of arbitration. However, there are no stipulations about other interim measures.

China: In line with the Regulations of the Supreme People’s Court on Several Issues Concerning Enforcement Conducted by the People’s Courts, any preservation measures are to be enforced in the Intermediate People’s Court (if foreign-seated) or the Basic Courts (if domestic-seated) of the place where the party is domiciled or where the property is located.

Germany: Pursuant to sections 919 and 942 of the Code of Civil Procedure, i.e., ZPO, in domestic arbitrations, the court which has jurisdiction over the merits and the court of the district where the assets are located. In international arbitrations, despite conflicting decisions, in OLG Köln and LG Berlin, the Court held under section 1033 ZPO, a standard arbitration clause does not constitute a choice of forum, and a German local court could provide interim relief.

Algeria: Under section 1046 of the Civil Code, the arbitral tribunal may request the competent court for assistance in enforcement of interim relief. The rules are silent on the inherent power of the court, but Article 458 bis 6 of the Civil Procedure allows parties to bestow such a power onto the tribunal.

Bahrain: Unless parties agrees otherwise, the summary courts have default jurisdiction over interim measures, for urgent and non-substantive matters.

Egypt: Article 9 of the Civil Procedure provides that in a domestic arbitration, the local court and the Cairo Court of Appeals in an international arbitration would have original jurisdiction.

Kuwait: In Kuwait, urgent matters are not arbitrated, unless the parties agree. Thus, parties may decide interim relief procedure under Article 173 of the Civil Procedure.

Model Law (Canada): In TLC Multimedia Inc. v. Core Curriculum Tech. Inc., [1998] B.C.J. No. 1656 (B.C. Sup. Ct.), the Court held that the UNCITRAL Model Law under Art. 9 allowed for interim relief to aid foreign seated arbitration.

Conclusion

The Court must balance the efficacy of interim measures with the exclusivity of the seat. The Court may find the Belgian jurisprudence useful, as it draws a distinction between the mandated appointment of the arbitrator at the seat, and other interim relief which may be sought outside of it. However, until the Court distinguishes this decision on facts, parties could be sure of their positions by adding specific clauses stipulating or restricting the jurisdiction of courts outside the seat.

First as the political-military leader of the murderous "Gruppo Etna", and later as the "Comandante TOLU' of Giustizia e Libertà" on a mission in the North. The COMRADE ANTONIO CANEPA WAS A TRUE LEADER OF THE SICILIAN ANTI-COLONIALIST RESISTANCE MOVEMENT (as the Comandante Mario Turri of the EVIS - the Army for the Independence of Sicily). He was assassinated in an ambush in Randazzo. It was the 17th of June 1945. His corpse was concealed under State Secret for a decade. To this day his memory is object of taints and miss-information. The concealed truth about Antonio Canepa is the most outrageous scandal in Sicily's last 70 years. The EVIS was not an "army" thought to win a "war". The EVIS was an "armed political party" fighting for a more just peace, on the path of Sicily's socialist (R)evolution. The "military camp" of the EVIS in Cesarò, in Messina province, even had its own traffic sign set up! The EVIS - beyond any reasonable doubt - IS THE CONTINUATION - also physical - of the ANTI-FASCIST RESISTANCE ON OUR ISLAND. THE REAL ONE. THE ONLY ONE that played a political-military role. Canepa's partisan network was deeply rooted ´within Catania University... and also counted on the trotskyist group "SICILIA ROSSA", that broke out of its clandestine existence on May Day 1945. The EVIS - which was born and died with Canepa - never had any "relationship" with gangs and bandits. If anything, it clashed with organised crime. In one of those clashes the young Francesco Ilardi died. Ilardi was later buried at the Sanctuary of Catania, together with the Comandante and their comrades. The EVIS was predominantly formed by young students, artisans and farmers. They called themselves "comrades". Period. In the chaos that reigned in those years, other groupings such as the gang around Salvatore Giuliano and Salvatore Ferreri had completely different political references -> During the Viterbo trial, Gaspare Pisciotta, a member of Giuliani's outlaw band, mentioned the name of Bernardo Mattarella (politician for the Christian Democrat party, and father of today's Italian president Sergio Mattarella) as well as the OSS-CIA. He was later poisoned as part of OSS-CIA operation "GLADIO". "CANEPA MUST DIE!". THIS DEMAND CAME FROM ROME. It came from within the "anti-fascist" CLN (National Liberation Committee). It was one of the many "showdowns" within the "partisan world", but the bullets came from the newly-founded GLADIO. In the chaos that arised during the post-war period in Sicily, the massacre of Randazzo on 17 June 1945 was the most cynical and politically criminal act - and the most concealed. In the location "Contrada Murazzo Rutto" near Randazzo, at the foot of the Etna, on Sunday, the 17th June 1945, following the orders from the "anti-fascist" government in Rome, the following people were slaughtered in an ambush: comrade professor Antonio Canepa, founder of the Army for the Independence of Sicily, as well as the young EVIS-activists Carmelo Rosano and Giuseppe Lo Giudice. They were Sicilian partisans who had chosen to continue the battle for the liberation of the Sicilian people and its working class. As for the executors, everything leads to the "reformed" SIM, the Italian secret intelligence service, which, following the Armistice of Cassibile on 8th September, had already incorporated nazi-fascist criminals such as Ettore Messana, already a "dirty war"-specialist in Slovenia, and other "patriots" from the Xa Mas (the 10th Assault Vehicle Flotilla) led by Junior Valerio Borghese. Borghese was on of the covert protagonists of Portella della Ginestra massacre, perpetrated against Sicilian civilians during May Day celebrations in 1947 in the town of Piana degli Albanesi. A COVER OPERATION carried out under the auspices of the OSS-CIA by the fake independentist flag of the Ferreri-Giualiano gang, who maybe did not even shoot on that tragic 1st of May 1947 (the ballistic report remains to be studied). Operation GLADIO was born! The FAKE MYTHS against CANEPA and the EVIS are still being exhumed, like badly buried corpses without peace. The EVIS does have its MARTYRS. People like SALVATORE GIULIANO are certainly not part of it. During the post-war chaos the systematic Italian re-occupation of Sicily had to be legitimised, so the myth of the "War on Banditry" was born: the reputation of Sicilian independence activists had to be systematically destroyed by linking them to banditry - and of course - to the Mafia. A load of bullshit, reiterated for the last 70 years! A hypocritical and coarse way to taint their Memory. Meanwhile, seemingly by force of habit: The deafening silence of the "institutions", but also of the ANPI (the National Association of Italian Partisans); the CLN (the National Liberation Committe); and all of the italian "partisanism", subjected and accomplice to a code of silence (it: omertà). The cowardice of the "academic world", and the denigrating attitude against Sicilians, that unites both the leftist historiographical ignorance and the visceral hate of the right-wing literature. Last but not least, the hypocrisy of the tri-coloured trade unions, that offend the Truth by staging every 10 years their "political picnics" at Portella. The conquer of this Truth is owed to the Sicilian People, and sees the (INDEPENDENTIST) SICILIAN LEFT on the front row since decades, thanks to the prophetic path of TerraeLiberazione, bio-political heir of the trotskyist independentist group "SICILIA ROSSA" of 1945. This HISTORICAL AND POLITICAL TRUTH has to be reconquered and defended every day from the FOGS, the MARSH, and the MINE FIELDS of the COLONIALIST SPECTACLE staged by the italianized Sicily. In July 1943 - during Operation Husky - the "Allies" (sustained by an efficient Resistance against nazi-fascism) occupied Sicily. It marks the end of a Regime, but, as we shall see, it was not what the sicilian partisans around Comandante Canepa had fought for. During WWII - this huge slaughterhouse in which the "crisis of 1929" is resolved - the 24th October 1943, beyond the temporary AMGOT, Washington's SICILY REGION 1 in the Mediterranean was born. It pervades like a "non-said"... under a sky populated by foreign airplanes, murderous drones, dysfunctional saints, and the G7 on a tourist trip. For the Sicilian People it's another PAST that does not pass. A past that cannot be understood by disregarding the TRUTH about CANEPA: the sicilian PARTISAN, the GREAT PROFESSOR of History of International Relations and Treaties, the geopolitical analyst who - despite the ongoing fascist Regime - studied Trotsky's works with method, and tried to apply them in Sicily in the most resounding fashion: the THEORY-PROGRAMME of the PERMANENT REVOLUTION within the historic- social conditions of an Island Nation that is being exploited and oppressed by a neocolonialist State. The EVIS was the armed political party that legitimised - in the continuity of anti-fascist Resistance - the future of an INDEPENDENSTIST SICILIAN LEFT: independent on every ideological, policy, organisational and operational level. Certainly, with his 100 young people, the guerilla-professor "Mario Turri" did not want to "wage war against Italy", he was not a fool. The EVIS was also not the armed force of the MIS (the Independence Movement of Sicily), whom Canepa knew very well. If anything, Canepa-Mario Turri offered an alternative to the defenseless MIS and had good relations with the League of Young Separatists (it: LGS, Lega Giovanile Separatista) led by Guglielmo Carcaci. The LGS was a practical channel for the LEGITIMATE DEFENSE of the INDEPENDENTIST YOUTH, that was persecuted and tormented by the beastly Italian police force of Salvatore Aldisio, Rome's High Commissioner for Sicily. It should also be noted, that the post-war state apparatus - in Sicily more than anywhere else - remained manned by the same individuals who had been part of the fascist regime. To sum it up: The ambush at Murazzo Rutto in Randazzo on 17th June 1945 -> looks like a STATE-SANCTIONED POLITICAL MASSACRE - ordered by the "shareholders" of the Roman CLN and realized by the operation "GLADIO" that was formed within the post-war chaos. It was perpetrated with a "preventive counter-revolutionary" logic. As the "Cold War" was marching in, the illusions of partisanism were disappearing, and the same MENTAL FORCES - that by now had become structured - hit the 1947 MAY DAY Celebrations at Portella delle Ginestra. This history of Sicilian and socialist blood shed, is treated as a "non-said", ferociously hidden by the colonialist Spectacle of italianised Sicily. As for the myth of the separatist bandit, it is nothing but a well constructed mediatic invention of the AmeriKan secret services. It was incorporated as the Vulgate of the colonial tricoloured Left, as Europe's partition between the USA and UdSSR unfolded within the paradoxes of the Cold War. It has to be said, that in the mountains surrounding the little town of Montelepre (Salvatore Giuliano's birthplace) - in the most complete political irrelevance and quite identifiable at every moment - there was a little group of young men who became trapped in a story that was larger than them. They remained excluded from the Amnesty that was given by the CLN government even to some of most known fascist criminals. That colonialist bullshit about the "criminal and mafia-run Sicilian Separatism" acts like a "non-said", it has a background that has been ferociously hidden by the Colonial Spectacle of italianised Sicily: the MASSACRE OF RANDAZZO on 17th June 1945. This badmouthing continues to this day: The next episode will be staged by the State-run RAI: "Il Primo Maggio" (1st of May) -> Live from the colonialist-trade unionist Theatre of italianised Sicily! On the occasion of the 70th Anniversary of the anti-sicilian massacre in Portella della Ginestra! "The dominating ideology is always the ideology of the dominating class" (Karl Marx). And the (R)evolution of Sicily will not be a political picnic, nor a gala dinner. HONOR TO THE COMRADE CANEPA! THE GUERILLA-PROFESSOR, THE SOCIAL INTELLECTUAL WHO UNDERSTOOD THE WORLD AND WHO KNEW ITS LANGUAGES, THE MILITARY CHIEF AND IDEOLOGIST OF THE TRUE SICILIAN RESISTANCE. The EVIS - without any reasonable doubt - is the (physical) Continuation of the anti-fascist Resistance of our Island. THE TRUE RESISTANCE! The elimination of Canepa was certainly due to his radical political and cultural choices, but also due the fame that eventually would have protected him in the first decades of the First Republic. In some way Canepa was a "cumbersome" figure: "CANEPA MUST DIE!" *** In July 1943 the first phase of Operation Husky was an utter disaster. The "landing" in Sicily - which marks the turning point in WWII - risked to sink into the sea due to the heavy storm that welcomed the "liberating" Allies. But it became the most gigantic air-naval operation in the history of military until then. A new era began: the one that sees Humans taking the Skies and chasing away the Gods. The Sicilian situation is well known to the "Allies": The Regime of "Il Duce" - as per his own admission - does not have any true "consent". And the partisan Resistance - directed by an elusive professor - has carried out a series of actions that were anything else than just symbolic. The contested Island is briefly described with abnormal niceness in "Soldier's Guide to Sicily", an English-language guidebook that was distributed by the Allies command with 450,000 copies in preparation to Operation Husky: "Invaders and dominators have followed one another in all epochs... eventually the Italians have dominated the island." "Sicily is the largest island in the Mediterranean - it is more or less the size of Wales. But its importance depends from its (geographical) position... and from dozens of aviation camps... two-three hours away from Rome, four hours away from Milan... closer than we could ever get..." "The Headquarter of the (German Luftwaffe) field marshal (Albert) Kesselring is located exactly in Sicily... Furthermore, (Sicily) offers to our fleet the bases of Syracuse, Augusta, Catania, Palermo, Trapani and Marsala..." And: "Sicily is crucial: until now we had to sail around the entire Africa. We had to take our ships 12,000 miles around the Cape of Good Hope." Thousands of Sicilian-Americans participated in the Operation Husky - and now appear pathetic, as much for the denial as for the overestimation of Cosa Nostra's role, an "ethnic armed party" born within the Sicilian Diaspora in the USA. Those who don't understand American society, and blindly animate historiographic "tifoserie", will never understand anything. Period. Irrespective of that, Sicily is in a cyclical Revolt for its sacrosanct Independence. 1860 it was annexed by London for the little wannabe-reign of Piedmont, among the false garibaldinian Unity flag. Sicily is an exploited Colony, oppressed and repressed in all its attempts of economic and civil emancipation. Its social ascension is managed by the submissive function towards ROMafia, the corrupted Italian capital. Everything from careers to privileges for a restricted tri-coloured bourgeoisie, to the systematic repression towards the population by means of compulsory military service and mass-emigration, that function as regulators for the social metabolism. The "fascist reformism" doesn't go beyond a faint and tardive attempt at landed reorganisation, with a (somehow in its own "sicilianist") rhetoric of an Island, "centre of the Empire". Meanwhile the "Empire" was combing through the mountainous villages on its much trumpeted "fight against the mafia". By its own admission, the Regime never gained the consent of the Sicilians. its opposition was never the "backward, feudal, irredeemable" Sicily, (which by the way never existed), that was later also adopted in the tri-coloured Leftist and colonialist rhetoric, always subordinated and blind; selling itself to the "state capitalism" while constantly raving on about the "fight on feudalism" up until the 1970s! The future belongs to those who manage to raise a critical and solidary look on the things of life and on the world. That world to which comrade Canepa looked at with extraordinary scientific ability, living his Life like a battle, and his Death like an adventure. "Tomorrow's Sicily will be what we want it to be: pacific, laborious, rich, happy, without tyrants nor exploiters." The Sicily that we want will know how to defend its own interest with firmness, building fraternal relations with all the people of the world. We are "Independentists", not "Separatists"; it's todays colonialised Sicily which is alienated from the world. Independence will make it "united" within the ranks of the free nations.
