In late May, Disney's lawyers filed a motion asking the circuit court to order Piccolo to arbitrate the case — with them and a neutral third party in private, as opposed to publicly in court — and to pause the legal proceedings in the meantime. Arbitration is generally considered a more efficient and cost-effective method of resolving disputes than litigation, and Disney said explicitly in court documents that the "main benefit of arbitration is avoiding heavy litigation costs." The reason it says Piccolo must be compelled to arbitrate? A clause in the terms and conditions he signed off on when he created a Disney+ account for a monthlong trial in 2019. Those terms of use — which users must acknowledge to create an account — state that "any dispute between You and Us, Except for Small Claims, is subject to a class action waiver and must be resolved by individual binding arbitration." Disney says Piccolo agreed to similar language again when purchasing park tickets online in September 2023. Whether he actually read the fine print at any point, it adds, is "immaterial." "Piccolo ignores that he previously created a Disney account and agreed to arbitrate 'all disputes' against 'The Walt Disney Company or its affiliates' arising 'in contract, tort, warranty, statute, regulation, or other legal or equitable basis,'" the motion reads, arguing the language is broad enough to cover Piccolo's claims.

In early August, Piccolo's lawyers filed a response slamming Disney's rationale as "preposterous," bordering "on the surreal" and "fatally flawed for numerous independent reasons." "There is simply no reading of the Disney+ Subscriber Agreement which would support the notion that Mr. Piccolo agreed to arbitrate claims arising from injuries sustained by his wife at a restaurant located on premises owned by a Disney theme park or resort which ultimately led to her death," they wrote in the 123-page filing. They confirmed that he did create a Disney+ account on his PlayStation in 2019, but he believes he canceled the subscription during the trial because he hasn't found any charges associated with it after that point. Piccolo's lawyers accused the company of trying to deprive Tangsuan's estate of its right to a jury trial. "The notion that terms agreed to by a consumer when creating a Disney+ free trial account would forever bar that consumer's right to a jury trial in any dispute with any Disney affiliate or subsidiary, is so outrageously unreasonable and unfair as to shock the judicial conscience, and this Court should not enforce such an agreement," they wrote. Piccolo's lawyers also took issue with the process itself, saying Disney didn't raise its alleged right to arbitration early enough in the proceedings. They further note that Piccolo didn't bring the lawsuit as an individual, but on behalf of Tangsuan's estate, which did not sign off on any such terms. There was no such estate at the time, since Tangsuan was still alive.

Oh it absolutely had an influence! And don’t get me wrong, the mainline games were great too, but after starting with HG, by the time gen 6 came around started getting kinda bored with them lol
As for the kind of spinoff I’d like to see…maybe something like you working in a pokemon center! You could get to treat pokemon with different types of injuries/status effects/etc. I refuse to believe it’s as simple as a push of a button lol. They could even have an element where wild pokemon come for help and sometimes decide to stick around :3

been thinking about anya all week and wow. wow. jimmy really makes her out to be this incompetent loser but really, jimmy was not only the reason curly ended up in such a state, but anya managed to keep him alive even though they were stranded and had little medical care… he made a big deal out of everything, was rude to her when he didn’t have to and made sure to make her feel sick every single time he “helped” out. but he didn’t help. he was dramatic and emotionally volatile and made her feel useless just because she asked him to do a simple thing. she already felt terrible and scared, having been literally raped by him and forced to stay in the same enclosed area as him until they’re rescued or something happens and she did her best to stay away from him, to protect herself, to lock herself away (wanting locks on rooms, locking the medical room when she died) or have some kind of defense (hiding the gun) against him because he was terrifying, didn’t view her as human or equal in any sense and didn’t see anything wrong with the way he took over her body. jimmy already has a pattern of using people, like when he used daisuke’s idolization of him to get daisuke hurt in the air vents to save ANYA. because jimmy didn’t wanna get hurt or save anya. he takes responsibility at the end but not for anya. he thinks his true crime that everyone’s out to get him for is because of what he did to curly. but he’s okay with people getting hurt and he’s okay with anya being scarred forever and hurt because he doesn’t view anya as a person so he never takes responsibility. he doesn’t even notice. he doesn’t care

finally processing that we're probably gonna have to have these teeth removed with either sedation or general anaesthetic and unfortunately I have a phobia of both of these to the point where just thinking about it gives us panic attacks and I genuinely don't know what to do because I absolutely want to avoid this at all costs but we also might not have any other option
#personal#thoughts#🍬 post#vent post#there is no amount of comfort or reassurance that can make me feel okay being sedated#like it's not even that I'm scared of side effects or risks or anything#I just can't even begin to express how much I absolutely do not want someone giving me a drug that's going to make me drowsy and incoherent#and also not remember anything afterwards#the premise of a stranger giving me a drug that's going to fuck up my ability to process anything or remember any of what happened#feels so incredibly violating and awful#like yes it's a medical context. yes I know it's so they can do the treatment. yes I know I'm supposed to trust them or whatever#but our brain doesn't process it like that. it's a stranger drugging you. that's terrifying regardless of the context#and given how much medical trauma we have and how awful some medical professionals have been to us#it happening in a medical context actually makes me feel worse#once again I'm not even necessarily scared of anything bad happening#even if you could absolutely guarantee that nothing bad would happen I would not be okay with it in the slightest#it's specifically the idea of my consciousness not being under my control#I take co-codamol for pain and that can make me drowsy and incoherent and fuck up my memory#but that's me choosing when to take it and how much to take and being able to stay away from people if I feel like I need to#and being able to make notes about what I've done and stuff like that#and there's a huge difference between that and being in a clinic having a procedure where you can't just get up and leave#and someone else is administering the meds and choosing the dosage and you're not the one in control of this situation#this makes me sound like a control freak and yeah I probably am#but that's kind of what haappens when you've had your bodily autonomy violated so many times by so many people

Posted to female oncology ward for these two weeks and all I can say is cancer is cruel but amidst that pain and sorrow, you can really see true love in that ward
#saying this in light of one of my group's fav patient that passed away after my shift last morning#shes in her early 30s and was a teacher and was diagnosed with breast cancer that metastases to lung and cervical lymph nodes#she was weak since she was admitted last week and usually just sleep but shes so nice every time we administered medication to her#or even when we check her vital signs despite how tired she was#her husband is a teacher too and as of late hes there every day as her condition deteriorated#apparently she wanted to undergo chemotherapy but her first cycle led to some severe side effects so her doctor doesn't allowed it#when we read the case note before clocking out the shift yesterday theres a psychiatrist entry so yeah#her husband was just caressing her hands as she slept yesterday and he looks obviously pained when my friend asked what had she eaten#because we need to fill the intake output chart and yeah she was unable to eat much anyway#it was very sad to see her husband wiping his tears silently by her bedside#and then we came to the ward this morning to find out she had passed away and there was a discharge note on her case note#apparently she supposedly will be discharged today so that she will be able to go at home#turned out she left first..#it rained the whole morning today and it kind of summarizes the mood of our group members this morning#it was sad obviously but when i think about it you can really see how much her husband really cared for her until the end#i hope he will be able to heal and that may her soul rest in peace#personal.txt

EpiPens!
Do you or someone else you know carry an EpiPen? They're quite commonly carried, so let's start from the top! What IS an EpiPen?
An EpiPen is a "pen" that has a dosage of the drug epinephrine, which stops anaphylaxis, which a severe allergic reaction involving the throat to close, from being fatal. Anaphylaxis can be triggered through contact with a substance that a person is allergic to, such as peanuts. Not everyone is highly allergic to substances to the point that anaphylaxis occurs when they come in contact with it, so not every person with allergies needs an EpiPen.
The most important thing to remember is that anaphylaxis is deadly. If not treated immediately, a person going into anaphylaxis can die. Sometimes, the allergic reaction will solve itself, but it is NEVER a good idea to wait and see if the reaction will go away on its own. If a person is going into anaphylactic shock, administer their EpiPen immediately if they are unable to do so themselves, or call for emergency services if they do not have one.
What are the signs of anaphylaxis?
Symptoms of anaphylaxis include:
difficulty breathing or shortness of breath
inability to swallow
hives, redness, swelling, and itchiness on the skin
cramps, nausea, vomiting, and diarrhea
lightheadedness, fainting, increased heart rate, decreased blood pressure, and weak pulse
How do I properly administer an EpiPen?
A good saying to remember is "blue to the sky, orange to the thigh." When you look at an EpiPen, you'll notice that one end is blue, and the other is orange. The orange end of the EpiPen is the end in which the needle will come out. It is imperative that you remember that this is the end that will be administering the epinephrine. You do NOT want to put your finger(s) or hand anywhere over the orange end of the EpiPen. The blue end is a safety cap! The EpiPen will NOT eject any epinephrine if this blue cap is not removed. EpiPens should be administered to the thigh, and clothing does not need to be removed in order to administer the EpiPen. The needle will go through any clothing, and inject the drug directly into the bloodstream. The steps to administrating an EpiPen are as follows:
Hold the EpiPen with the orange end facing the ground, and the blue end facing the sky.
Pull out the blue safety cap. Do not touch the orange end of the EpiPen.
Jab the orange end of the EpiPen into the thigh of the person going into anaphylaxis. You MUST do this hard. Do not worry about hurting the other person, the needle will not eject if you do not jab it hard enough. You are concerned about making sure they stay alive before you are concerned about hurting them.
Hold the EpiPen in place for ten seconds before removing it from the thigh. All EpiPens have directions on the pen, but some EpiPens say to hold them in place for three seconds, other say five, and some say ten. To ensure the ENTIRE dosage has been administered, hold it in place for ten seconds. it is better to hold it in place for longer than needed than not long enough.
Get immediate medical attention. A person who has been injected with epinephrine will need to undergo an examination to ensure they are alright, as epinephrine can cause the heart to stop.
If the person is still experiencing symptoms of anaphylactic shock after approximately five to fifteen minutes after the initial dose, a second dose may be needed. People who carry EpiPens must carry two at all times in case this occurs.

"I don't have an EpiPen, can I use Benadryl?"
Benadryl and Epinephrine are both antihistamines, which means they both have the capability to combat allergic reactions. However, they do not act as fast as each other. Epinephrine is the only drug that can be used to resolve anaphylaxis, as Benadryl does not work fast enough. Remember, anaphylaxis kills! You need something that works FAST to save your or your friend's life!
"Where do I get an EpiPen?"
Your doctor must give you a prescription for an EpiPen! They are not over the counter, and can be quite costly if you do not have insurance- around $650 to $700. However, there are coupons and other offers available which can lower the cost of your EpiPen if you do not have insurance. But remember, not all insurance companies cover the cost of EpiPens, so check with your insurance provider!
"Is there a way I can practice using an EpiPen in case of an emergency?"
There are trainer EpiPens available! Some come with your EpiPen, so you can practice and show trusted individuals how to administer them if you are ever in an emergency!
“What happens if I administer my EpiPen thinking I was having a reaction, but I wasn’t?”
Don’t panic! Still get checked out, because as I mentioned, epinephrine can make your heart stop, but one dose of epinephrine when you don’t need it won’t kill you! Because epinephrine is metabolized fairly quickly, the effects of an unnecessary dosage including increased heart rate and blood pressure, will subside quickly!
