You would think Viv and Spindlehorse would know Kesha couldn’t sing, but honestly I’m willing to bet they assumed it would be fine because they’re an Indy studio. And maybe Kesha also thought it was okay at first. And so went full steam ahead until the episode was done. At least with the timeline it seems like they didn’t get hit with legal issues until it was ready to get uploaded/published.

I don’t know what happened, my guess is Viv and friends did know from the very beginning but thought they can somehow work their way around the problem. It’s implied from the leaks that Kesha actually did sing but they had to reanimated the musical scene again to replace the original audio with second singer.
