The SEC strikes back

Just yesterday I’ve assumed that the SEC would not accept defeat in court from Grayscale without a fight and would delay the approval process of Bitcoin-ETF as much as possible.

Indeed, on Thursday the commission announced that the decision on the ETF is once again postponed. The team of applicants will have to wait.

As a reminder, the court ruled that the delay in the decision on Bitcoin-ETF is illegal and ordered the commission to issue the appropriate license to Grayscale.

Bitcoin emotionally climbed by almost 10%, then, after some thinking, it rolled back a little, and finally, after the regulator’s decision on another delay, returned to the initial level. The euphoria was short.

Honestly, I do not even know how are the applications wishing to release their own ETF evaluated? I can imagine people in formal suits with pencils in their hands checking every word in application papers.  What can you check for weeks and months? Perhaps I am naive, but I felt that for any application an official within a reasonable period of time should give at least a simple answer: yes-no, allow-prohibit, approve-refuse. Again, I think the reasonable time has passed.

In general, the latter delay is not a technical problem, it looks like a revenge for the crypto community. The only reasonable explanation is the Commission’s managers analyze recent defeats and discuss next steps. Indeed, the dilemma is not simple - it is necessary to comply with the court’s decision and at the same time save face. However, it is possible that an appeal will be filed and the process will be prolonged indefinitely, but I assess the probability of such a development as low.

I repeat my position: Bitcoin-ETF will be approved, and probably soon.

So, let’s keep waiting.
