Ex-player accuses Lane Kiffin’s FAU of pulling a job offer after landing a recruit

This is one side of the story.

A.C. Carter, a former Alabama receiver-turned-college football coach filed a fraud lawsuit against Lane Kiffin on Tuesday, alleging that Kiffin misled him in order to land a former four-star running back on National Signing Day in February. SEC Country’s Christopher Walsh reported news of the lawsuit.

Carter played in the early 2000s for Alabama, long before Kiffin showed up as offensive coordinator in 2014.

Carter alleges Kiffin led him to believe FAU would hire him as an assistant strength coach, a job that carried a $40,000 salary and relocation expenses. Carter’s lawsuit says he is close with a former blue-chip running back whose profile matches that of D’Anfernee McGriff. Carter believes Kiffin’s FAU used his relationship with the recruit to lure the player to Boca Raton.

The filing of a lawsuit represents only the plaintiff’s side and is crafted in a way that will paint the plaintiff in the best light. As the defendant, Kiffin’s side will be told, at least in part, when he files his answer. Under Alabama rules of civil procedure, this is usually done within a month.

Carter says Kiffin led him to believe his hiring was “done,” Walsh wrote. But after Signing Day, FAU informed him he wouldn’t be hired, citing two previous misdemeanors on his record. From Walsh’s report:

Carter claims in the lawsuit that he sent documentation showing the resolution of the charges, one of which the prosecutor refused to pursue more than seven years ago, but FAU didn’t respond and numerous other inquiries went unanswered. That included waiting for hours outside of Patrick Chun’s office only to have the FAU athletic director refuse to meet with him.

Kiffin’s staff had already drawn criticism for including OC Kendal Briles, son of Art, and DL coach Eric Mathies, who was charged with DUI in 2014. It also includes DC Chris Kiffin, who was named in one of Ole Miss’ least significant NCAA violations.

What’s being alleged here is pretty bad.

Recruiting is not a field for pearl-clutching. Teams pull scholarship offers from prospects. Players back off verbal commitments in droves. Money exchanges hands in ways that are both fair and not.

But Carter is accusing Kiffin of misleading him and a recruit and causing them to make big life choices without information. Carter and his wife quit their jobs, he says. And the recruit allegedly picked FAU in part because he thought he’d have a close ally there.

Is anything illegal? We don’t know, exactly.

Sports Illustrated’s Michael McCann, a scholar on sports law, has the best explainer. Carter filed his suit in Alabama, home of the school Kiffin left before the National Championship. Per McCann, this might help him:

Carter, it should be noted, has filed his lawsuit not in Palm Beach County, Fla., where FAU is located, but in Shelby County, Ala., where Carter resides and where he might obtain a more sympathetic judge and jury than he would in Florida. Kiffin, after all, is not exactly beloved in Alabama.

Carter’s lawsuit is against Kiffin, FAU, and the state of Florida. He’s alleging a few things, including fraud, breach of contract, and unjust enrichment:

Carter’s best argument likely centers on his claims for unjust enrichment and quantum merit. An unjust enrichment claim contends that a defendant was conferred a benefit that was not intended as a gift and now owes the party who provided the benefit fair compensation. Quantum merit refers to a plaintiff that worked for a defendant expecting pay but was not paid.

McCann notes there’s a “high” likelihood the case settles. It’s hard to imagine Kiffin taking the witness stand in a dramatic trial over whether he illegally screwed a coach out of a job.
