The website of the Columbia Law Review, one of the oldest and most prestigious legal journals in the country, has been down since Monday. At the time of this broadcast, ColumbiaLawReview.org shows a static homepage informing visitors that the site is “under maintenance.” Well, that’s not exactly true. In a stunning move, the board of directors of the Columbia Law Review decided to take down the website after the publication’s student editors refused the board’s request to halt the publication of an academic article written by Palestinian human rights lawyer Rabea Eghbariah titled “Toward Nakba as a Legal Concept.” Student editors at the Columbia Law Review say they were pressured by the journal’s board of directors to halt publication of the piece. They refused the request and published the piece online Monday morning. In response, the board, which is made up of faculty and alumni from Columbia University’s law school, shut down the law review’s website. After the website was taken down, student editors uploaded the article to a publicly accessible website, where it’s gone viral. The article begins, “The law does not possess the language that we desperately need to accurately capture the totality of the Palestinian condition. From occupation to apartheid and genocide, the most commonly applied legal concepts rely on abstraction and analogy to reveal particular facets of subordination. This Article introduces Nakba as a legal concept to resolve this tension,” unquote. The article is written by Rabea Eghbariah, a human rights lawyer completing his doctoral studies at Harvard Law School. Last November, the Harvard Law Review refused to publish a similar, shorter article it had solicited from Rabea, even after it was initially accepted, fully edited and fact-checked. In both cases, the article would have been the first time that either the Harvard Law Review or the Columbia Law Review had ever published a Palestinian legal scholar.
The video interview with Eghbariah, a transcript of the interview, and a full copy of the censored article, can be found on Democracy Now (5th of June, 2024).
Here's also a direct link to Eghbariah's article:

FAQ
Tumblr media
Please read this post before you send an ask!
TIMELINE
July: Trope voting form released. Late August: Prompt list is released for at least four weeks of preparation time. Prompts cannot be posted earlier than August 25th because of Moderator obligations in real life. (But, you know, go ahead and start writing/drawing, and add the themes in later, if you want!) September: Do as much or as little on your works as you want. You can prepare everything in advance or let September go by with vibes and start working in October. It’s up to you. October 1st: Challenge begins! A storm of whump breaks upon us all! During this time, some posts will be reblogged to the whumptober archive blog. We open the yearly AO3 collection for posting (optional). November 1st: The challenge is officially over! Completionist form opens for those who want to be included in the hall-of-fame. Early November: We release completionist and participant badges, solicit feedback, and post a hall-of-fame list of completionists by the 10th.
PARTICIPATION AND COMPLETION
Q: What counts as participation? Create or continue at least one work inspired by one of this year’s prompts. Q: What counts as completion? Creating work(s) inspired by at least one prompt from each day (or alts), for a total of 31 unique prompts. Q: Do I need to create 31 works? No. You can, if you want. Or you can create one work that you add to every day with a new prompt. Or several works that combine prompts. You can also update an existing work by adding new material with the current prompts. Q: Do I need to post my works somewhere to be a completionist or a participant? No. Q: How do you know I actually completed the challenge? We’ll take your word for it! Q: Do I have to finish my work(s) to be a completionist? No, you can post WIPs. And you’re not obligated to finish them in October, but if you want it to count towards being a completionist, you must have completed 31 prompts by the end of the month. So for example, if you’re writing a long fic and you fit 31 different prompts into the writing you did in October, it’s okay if that fic isn’t finished by the time October ends, you’ll still be a completionist. Q: Is co-writing/illustrating allowed? Yes, absolutely, and it would count towards being a completionist for both/all of you. Q: Is there a min/max limit on word count for written works? No. Q: Is there a min/max limit of quality for art? No. Q: Do I have to do something each day to be a completionist? No. You can skip days whenever you want, and as long as 31 daily prompts (or alts) are in your works done in October, you can be a completionist. For example, if you wrote a 1000-word ficlet that covers prompts in days 2, 3, and 17, you can check all three days off your list even though it’s only one work. Q: Is this challenge just for fics? No! Artworks, GIFsets, headcannons, rec lists, poetry, moodboards, or any other creative work is encouraged. Q: Can I combine Whumptober with other creation challenges? Absolutely, as long as the other challenges allow it too.
PROMPTS
Q: How do the prompts work? There are FOUR prompts per day: a theme and three ideas. You can use one, two, three, or all four prompts for each day. If you don’t like any of the daily prompts, you can substitute one of the ALT prompts instead. Q: How strictly/literally should we interpret the prompts? As literally or as figuratively as you want. For example, if the theme is WATER, that could mean drowning, waterboarding, raining, swimming, take place underwater, be lost at sea, construct a metaphor about a character’s mood that changes like a flowing river, crying, or whatever else you can think of that fits that theme. Q: Can I combine prompts? Is there a limit on how many? No limit and combine as many as you’d like. If you create a work that checks off multiple prompts, that work will count for a fill of multiple prompts. You need to address 31 different prompts to be an official completionist, but you don’t have to produce 31 separate works.
WORKS
Q: What’s whump? Hurting a character, whether that’s physically, emotionally, intellectually, psychologically, or any other way you can think of. Comfort afterwards is optional. Angst is emotional whump, so it counts. Q: How do I know if it’s whumpy enough? If your character is just mildly inconvenienced, it probably needs more whump. However, no participant has to prove whumpiness to the mods. Whatever you write is up to you. Q: What kind of characters can I create for? Anything. Generic “whumpee,” OC, PC, NPC, major characters, minor characters, or whatever you want. There are no limits. Q: Does it have to take place in a specific fandom? No, you can create works for your own worlds or for fandoms or for both. You can also create more generic or pan-fandom works. You can do cross-overs or use OCs, whatever you want. Q: Can I create AI-created works? No. We will not reblog or promote any works we know to be generative AI-created. Q: Is there anything we’re not allowed to write? As long as it contains whump and is based on our prompts, it’s fine. Please courtesy tag your works if you post them so people who follow the #whumptober2024 tag can filter according to their preferences. Q: What about sex, minor characters, and potentially disturbing content? You can create whatever works are legal in your country and post them accordingly. Please courtesy tag anything you think might be objectionable if you post to Tumblr so people who follow the #whumptober2024 tag can filter according to their preferences.
POSTING
Q: Where can I post my work? Post where and how you want. You don’t even have to (cross)post it to Tumblr. Just keep in mind if it’s not on Tumblr we will not be able to add it to the blog archive. There is an AO3 archive for Whumptober 2024, as well as the parent collection for works completed outside of the event. Q: Can I start posting early? You can, but this is an October event and wouldn’t it be more fun with everyone doing it at the same time? We won’t be reblogging any work predating October 1st. Q: Can I post late? Yes. For the sake of our hardworking Post Fairies, only a day’s themes will be reblogged to @whumptober-archive each day of October. But you can post whenever. Some of us are still working on and posting Whumptober fics from years ago. Q: Do I have to use your tags? Only on Tumblr and only if you want us to reblog your work on @whumptober-archive. Q: How do I have my works reblogged to the archive? Properly tagged posts will be reblogged to @whumptober-archive. If you want the official archive blog to reblog you, post on Tumblr and tag correctly (see this FAQ link for more info on tagging). Please note not all posts will be reblogged each day. Q: Can we @ you? For questions and comments, of course. We’ll be getting a flood of notifications, so if you really want us to see something send an ask. Q: Can I cross post on other blogs? Yes, multiple platforms and blogs are perfectly acceptable, as long as they allow cross-posting (to us). You can also post different works to different accounts under different names, without posting them everywhere at once. If you post some works under your main and others under an alt blog, that’s fine for completionist purposes. Q: Can I upload/repost my Whumptober content to other social media platforms? Of course! We’ve created an AO3 Collection to archive any fics posted there, which can be found here. The blog is the official archive, so please respect the personal boundaries of any whumpers in your social circle (don’t out anyone as a participant who would prefer not to be outed).

I'm having a bit of a rough mood from seeing that the judge in the Georgia case dismissed some of the orange motherfucker's charges.
Can I get some your ever-insightful perspective on this, and if there's still hope for prison time for something? Anything at all?
I can offer a few pieces of context on this, yes. First, the judge did dismiss a few of the less-substantiated and secondary charges against Trump in the Georgia election interference case. However, these charges were primarily related to "soliciting others to make false statements," i.e. how he enlisted others in the purpose of overturning the GA election results, and do not contest or impact upon the actual fact of election subversion (which is at the core of the prosecution). The judge also openly invited the prosecutorial team to re-submit the dismissed charges with more substantiated evidence and clearer testimony, so this wasn't a from-the-bench hack job like the ones Aileen Cannon keeps running in the Mar-a-Lago classified documents case (seriously, when can we appeal to the 11th Circuit to get her taken off? WHEN???) Which, considering that this is a Republican judge appointed by a Republican governor (Brian Kemp) is a good sign.
In short, this wasn't the judge saying "all these charges are bogus and inadmissible," it was the judge saying "I'll dismiss a few of these for not being as well substantiated as the others, but please resubmit with revisions/improvements and I will be happy to consider them again." And while I am not a lawyer, it is my understanding that prosecutors typically bring a multiplicity of charges, including some that might not ultimately stick, in case of this exact circumstance where some of them get dismissed/required to undergo judicial review/are otherwise ancillary to the central indictment. Which, in this case, is still intact. So no, Trump is 100% not "getting entirely off the hook" or "no longer under investigation in Georgia" or whatever else. I'm sure the GOP will try to spin it as such, but ignore them. The Trump "find me 11,780 votes" phone call to Raffensperger and the rest of his Georgia election interference has not been dismissed, and the RICO case still largely exists as first filed.
This is also a good sign that the judge won't order Fani Willis dismissed and the case completely shut down, as the Georgia Republicans have been trying to do with their hit-job inquiry into her personal life. If the judge was leaning toward dismissing Willis/the case entirely, this could have been a lot more sweeping intervention, but it doesn't look like he's going to do that, and in fact offered them an invitation to re-submit and make the case stronger. So that actually bodes better for the chances of eventually securing a conviction in the Georgia case, if the prosecutors have to go back to the drawing board and make sure everything is airtight. It's probably helpful to see all this in the above light and to understand that all legal cases drag on for years, with forward progress and setbacks. Especially this one, which is unprecedented in all ways.
However, I need to warn people again about thinking that Trump will be tried, convicted, and imprisoned before the election, and that this will spare us from having to vote against him or otherwise electorally dispose of him. SCOTUS, to nobody's surprise but still our disappointment, agreed to hear the Trump immunity case in late April (instead of just accepting the DC Circuit's opinion), and while they're likely to rule against him, that still creates another months-long delay. Importantly, though, the Department of Justice has announced that the "no legal proceedings 60 days before the election" rule does NOT apply to Trump, as he has already been indicted and the cases are currently being litigated. If they had decided that the 60-day rule applied, all trial proceedings would have to be frozen in the first week of September, but since not, they can continue into October and November. If the 60-day rule had been upheld, it would have drastically increased the odds of Trump avoiding trial entirely before the election, as few prosecutors would have wanted to proceed when they knew that there was an automatic kill switch built in. But if the DOJ holds to this, Trump could literally be on trial on Election Day itself. Which is good, obviously, but still: it will not be the magic solution. We still have to vote for Biden.
As I have said before, the stakes in 2024 are simple. The criminal trials will not get rid of Trump before the election. There will be another election that is Trump vs. Biden and therefore one of them will win the presidency. If Biden wins and Trump loses, Trump will be out of delay options and will go to prison almost 100% as all his criminal chickens come home to roost. If he wins, we will be fucked for generations to come. Vote accordingly.

Ric Grayson, or Tim 'Nightwing' Drake: a story of how Tom King's Nightwing pitch would have functioned.
You can often see the remains of discarded or overruled pitches in comics, if you look at structural decisions and compare them to pitches that you know were made.
One obvious one people might be familiar with is that Helena Bertinelli, back in 2003, was being set up to be removed from the Bat books and transferred over to what eventually became Greg Rucka's Checkmate 2006. There's a whole establishing storyline done in Gotham Knights by Scott Beatty. However, Gail Simone's pitch for Birds of Prey, which was published a mere two months after the Beatty story wrapped up, took Helena and used her to expand the Birds of Prey roster. It's a move that likely redirected Helena's character arc permanently (though the ghosts can still be seen in the choice to use Helena B as Matron in Grayson).
Equally: I hypothesise the reason we got Ric Grayson is because we got Young Justice 2019.
If you look at the storytelling, in terms of cover dates:
Dick was shot in Batman #55, in November 2018
Tynion's 'Tec run finished July 2018
Young Justice 2019 started March 2019
City of Bane started September 2019
King's pitch for Tim to take over the Nightwing mantle would probably have been a 12 issue run, to my eye; with the schedule that Nightwing had at the time, it would have been 6 issues (twice monthly) and then 6 issues (once monthly), ending the run and placing Dick back as a restored Nightwing...in issue #61, August 2019.
City of Bane kicked off the next month, being King's big 'all family-in' storytelling climax arc. It would have been the perfect place to put Nightwing, once again himself, reuniting with people. (I cannot tell how this placement would have gone should King have got his full 100 issue run; but I don't think City of Bane was significantly shifted forwards?)
Now I can't tell if the twice monthly issues dropped to monthly because Ric Grayson went down like a lead balloon with the fandom, but that would have been a very fast turn around in solicits for DC to withdraw support on a new direction (about a month). If it was expected to remain twice monthly, then I still think it would have been a 12 issue story, but might have stretched to 18 to meet plot needs over in Batman (King doesn't seem to have an issue about padding stories to get timing to line up in ways he wants them to)
King's pitch was also made at the time when Tim was still Red Robin, but clearly there was internal interest in transitioning him away from the name and into some other identity as part of the shift away from n52. Putting Tim into the Nightwing suit for 6 months to a year would have been a nice intervening step to use as the prompt to give Tim a new identity.
It's a pitch from King that just...fits in really really well. I can see how he'd have had it interact with things. Especially as King really hadn't had an opportunity to use Tim in his run yet due to the Mr Oz storyline, and he'd been pulling so many other faces through his story.
(I will also note that the 'Drake' identity and costume for Tim appears in January 2010 in Young Justice; Bendis' initial concept was clearly taking Tim back to Robin before he also tried a 'new costume' growth arc).
But instead Bendis wanted to use Young Justice to anchor the whole Wonder Comics initiative, and he wanted Tim as Robin for it because the concept was to pull in all the nostalgia for everyone for Young Justice 1998, thus having everyone in their original identities. And that whole decision probably had more lead time than your average comic, so it took priority over suggestions of moving Tim to Nightwing (because they already had plans brewing).
(And then Young Justice got fucked over with SO MUCH editorial meddling, to the point that I cannot wait until enough people have left DC that we actually get stories about exactly how bad it was, rather than just inferring it from what can be seen in the text itself)
Come back next time for when I instead explain what I think happened with the accepted pitch for Ric Grayson (and how I cannot BELIEVE this was actually an accepted pitch, given the way it was treated as a hot potato; it feels more like an editorial dictate of a concept that was passed off until Dan Jurgens came up with an idea of how to make it into an actual plot)

A Summary of the allegations against Nanowrimo
A group of Rogue Writers have managed to assemble a list of the allegations that have come out against Nanowrimo in the last year, below.
Tumblr media
PROTECT KIDS FROM NANOWRIMO
NaNoWriMo and its staff have recently come under fire for their numerous unethical and predatory practices. These include, though are not limited to:
Hostility and inaction after numerous members raised child grooming allegations against a volunteer moderator who was in charge of teens within the NaNoWriMo forums.
Headquarters took nearly 2 months to quietly remove the accused moderator's leadership powers, and over 5 months to remove their account… which they only did after this former moderator threatened to damage NaNoWriMo's contract with an affiliate.
Refusal to protect kids in the Young Writer’s Program from predators. Kids were instead bullied and silenced by the staff.
Ivan the Icy, a scavenger hunt game that featured a terrorist-styled “supervillain” (which they admitted was a mistake).
Local organizers (called MLs) not being background checked, yet required to host in-person events with kids present.
Harboring volunteer MLs who were reported as racist, homophobic, transphobic, and/or abusive.
Ignoring and silencing MLs who begged for help regarding serious issues within the volunteer program. This resulted in at least one participant suffering an event-related assault.
Inaction when MLs abused fellow MLs with bullying and ableist discrimination.
Promoting multiple Vanity Presses (predatory, scam-like publishers), including Inkitt, even after outside sources confirmed and announced they were predatory.
Solicitation via email for donations from kids in the Young Writer's Program.
WHAT CAN YOU DO?
Do you know of a school or classroom participating in NaNoWriMo through the Young Writers Program website? Please bring these issues to their attention.
If you donate to the NaNoWriMo organization, stop. There are plenty of other charitable organizations far more worthy of your monetary support.
Continue enjoying the November writing challenge WITHOUT the NaNoWriMo organization. Many authors and writing groups have written 50k words in 30 days without even being aware that the organization exists.
Please share this post.

A lot of people aren't going to want to hear this. I don't want to be saying it. But I think one thing we need to take away from the Trump successes is that branding matters.
Part of the problem the Left has with politics is that XKCD comic about average familiarity.
Tumblr media
"The average person probably only follows Senate roll-call votes and judicial appointments." "And White House press releases, of course." "Of course."
The Left has a bad habit of assuming that the work they do will speak for itself. We'll get into office, we'll make everyone's lives better, and people will see how much better their lives are and support us.
This is a mistake. In part because government moves slowly and in part because the Right is very good at filling the gap. Republicans proudly go on their propaganda platforms to take credit for things they voted against.
Sure, yesterday they were in the Senate voting against giving Kentucky healthcare. But today they can go to Kentucky and go, "While I was in the Senate, WE BROUGHT YOU HEALTHCARE. Isn't that the kind of leadership you want to re-elect?"
Republicans are masters of branding shit with their names and faces. And that works against the Democrats so much. People actually think Trump was better at pandemic relief. Why? Because they don't remember what the government was doing. They don't remember Congressional hearings and feverish debates about PPE. They don't remember endless arguments about vaccination.
What they remember is that one day, they got a check in the mail that had Donald Trump's signature on it.
That's all they remember. They think Trump personally sent them money to get through the pandemic. And no president has ever personally sent them money before. There were no checks with Biden's signature.
(There were checks. But not Biden checks.)
There were no Biden Booster shots or Biden-branded vaccinations or Bidencare medical clinics. But there were Trump Checks. People remember the Trump Checks.
We live in a society where people are so disengaged from politics that Google results for "Did Biden drop out!?" spiked on November 5th. Kamala Harris was running for election by a voting public that thought Biden was still on the ballot right up to election day.
And I know. I know we don't want our government to turn into the political equivalent of "This hurricane relief was brought to you by NordVPN. Are you worried about your internet safety?" But that's exactly what the Right has been doing. And folks. It's working.
So if we want people to like, subscribe, and hit that bell for notifications of Democratic successes... We might need to start branding and engagement soliciting too. That might just be what the modern political environment in the Information Age has become.

It was a record shattering week at ActBlue – the site which raises money for Democratic candidates, causes, and charities.
Since autumn of 2020 Ryan Murphy at GitHub has been tracking donations to ActBlue. The most money previously given to ActBlue had previously been during the seven days starting 27 September 2020. Last week ActBlue raised $252,517,168. All but the first 13 hours and 46 minutes of that was after Joe Biden stepped aside and Kamala Harris became the presumptive Democratic nominee.
Not ALL of the money raised at ActBlue was specifically for the Harris campaign. But comparison with the previous week (beginning 14 July 2024) shows that Kamala-Mania was a HŪGE factor.
July 14th - July 20th: $61,349,601
July 21th - July 27th: $252,517,168
US: Kamala Harris campaign raises $200 million in one week
The presumptive nomination of Vice President Kamala Harris to run for the Democratic Party in November's presidential election continues to make waves in US politics. The Harris campaign team said on Sunday that in her first week since President Joe Biden dropped out of the race, and the party coalesced around her, the candidate raised over $200 million (€184 million) in donations. "In the week since we got started, Kamala Harris has raised $200 million dollars. 66% of that is from new donors. We've signed up 170,000 new volunteers," Harris' deputy campaign manager, Rob Flaherty, posted on X, formerly Twitter.
^^^ emphasis added
Keep in mind that Elon Putz has pledged $45 million a month to pro-MAGA PACs – i.e. $225 million. Trump is soliciting $1 billion from oil execs. Far right Silicon Valley tech oligarchs like Peter Thiel are also getting involved financially with Trump.
So there's no time to rest on our accomplishments. Freedom is not free and we need to continue to offer our own volunteer and financial support to pro-democracy candidates like Kamala Harris.
In 2020 there was a stretch when ActBlue took in over $100 million for eight weeks in a row. That's part of what it took to evict Trump from the White House. A similar effort will be needed this year to keep him out.

So much about current DC is so casually or clearly antisemitic it's just painful at this point.
So I was going through the Solicitations for Dc's December comics and I got so fucking mad To start it off, one of the first things I see when I open Instagram after Rosh HaShana is Superman drawn as Jesus/a Christ figure for an official cover by Jorge Jimenez. Then, there's an entire event throughout November and December in DC that's centered around Santa Claus. All well and fine, but two of the leading characters that have been chosen to hang around Santa are Harley Quinn and Damian Wayne, both very much ethnically Jewish at least.
These two characters' Jewishness is ambiguous and barely mentioned, so maybe DC just forgot? But that's exactly part of it, how these characters are very much Jewish going into their families and heritage, but DC chooses to ignore that repeatedly, making that part of their identities irrelevant and unmentioned. Not only that, but DC keeps hiring the same artist who's known to be a N@zi (and a CP artist), Otto Schmidt, for some of their Christmas and Santa covers. It makes me soooo mad and it's so, so wrong on so many levels.
The last time in recent memory I can recall a character's Jewish heritage being acknowledged in a recent DC comic I read, was with Hal Jordan, in Knight Terrors: Green Lantern, only because a Twitter user told the series writer Hal was Jewish, or he wouldn't know otherwise. I never understand why it's the fans' obligation to remind a writer of a character's heritage or ethnicity, why isn't it already known to the writer? Why are these things, which are a big part of so many people's lives are so largely ignored in stories that discuss these people's lives?
It's a gut kick at the worst level and it hurts like hell. It makes it a million times worse that it's not only Judaism and characters' Jewishness. It's all aspects and types of culture, from Selina Kyle's essentially erased and forgotten of ethnicity to whitewashing Damian Wayne and so on. God I hate it.

Multiversus: Collision Detected is a six-issue miniseries
Tumblr media
When it was announced back in June, it was unclear whether the Multiversus tie-in comic would be a one-shot or a miniseries. With the release of DC's November solicitations, it sounds like it is probably a six-issue miniseries on a biweekly release schedule.
The release schedule is as follows:
Issue #1: 18th September
Issue #2: 2nd October
Issue #3: 16th October
Issue #4: 30th October
Issue #5: 13th November
Issue #6: 27th November
Finn and Jake don't feature in much of the cover art or the blurbs, so it's unlikely they'll be major characters. It sounds like the story will focus mostly on the game's DC superheroes. Nevertheless, this is technically the first Adventure Time comic series since the conclusion of 2018's Marcy & Simon.
The series will be written by Bryan Q. Miller and illustrated by Jon Sommariva. Each issue will retail for $5.
