Do you happen to know of a searchable term for the area of legal expertise which leads to skill at producing licenses like the Apocynum Press one? I've been interested for a while in hiring someone to help me set up a vaguely-adjacent sort of license to use for some of my own projects, and one of the reasons I haven't done it yet has been uncertainty regarding how to find a hirable person of the right skill-set.

I do not! One of my followers probably does.

To be clear, it's likely to be expensive.

If your primary concern is, like, small claims court, then you can probably get away with doing it yourself. I'm not a lawyer, so take that with a grain of salt, but, like, a small claims judge isn't worrying about whether an arguable 1820s precedent means that the accidental semicolon in clause 12a subsection 17 means that someone has the right to cut off and eat your fingers. They're worrying about intent and maybe about which of you they like more.

If your primary concern is corporations ... uh.

I am not convinced corporations actually care about the law?

But, if you want to make 100% sure you're not accidentally giving anyone the right to cut off your fingers, you're probably looking at thousands of dollars in legal fees or a long hunt for a pro bono lawyer.

I love how you say on your writing blog that all your fics are subject to the autism clause haha, that's me with SO many fics...

yeah, I feel like we need to normalize the idea that fanfic writers' time is their own

because so many people think that because we might take requests or because we write for a fandom - we are writing as a performance/production. people tell us what to write and then we do it. but really, it is: we should write what we want, our time spent writing is about fulfilling our own needs creatively, and then when that writing is finished, we share it with other people as a privilege and as a kindness because we have made something that other people might enjoy

I want to normalize the idea that writing fanfiction is selfish, not a public service. and writers sharing their writing with you is a privlege

don't even get me started on how negatively the word 'selfish' is viewed when I genuinely think that everyone deserves some selfish time in life, because if each individual person doesn't get some selfish time, we will mentally and emotionally drown. like - look at how amazing and funny Jenna Marbles channel became when it became about her having a fun, selfish time. that is what fanfiction writing should be

but yeah that's what The Autism Clause is all about. the idea that I'm not gonna force myself to finish a fic if it's not clicking in my brain because I could be spending my time on fics that are clicking and that are way more fun

The sheer delusion of some of them, though.

One fan account literally got unfollowed by Jenna RIGHT after the account posted some bullshite about Percy…and the only thing they could come up with to comfort themselves and to further their delusion, is that Jenna is under some sort of “contract” to implicitly support Percy? WUT???

If there is some sort of contract involved that can compel her support, why wouldn’t she have actually posted something explicit in support?

Besides the fact that Jenna is a whole ass adult who has been in the business since she was a child, who would subject themselves to such a ridiculous contract? I doubt Wednesday paid enough to give up her freedom to that extent.

Not only is Jenna a great actress, but she also has Executive Producer credits under her belt…why would she subject herself to insane contractual clauses FOR HER OWN MOVIE?

Also, contracts can’t be enforced if they’re batshit unreasonable or ask you to do illegal things. There is a limit of what a contract can actually obligate you to do. Contracts are challenged and invalidated all the time.

It’d be more believable, and I’d respect them more if the antis claimed that Jenna kept being friends with and protecting/choosing Percy to protect her investment in the movie. I don’t believe in bullshite virtue signaling, but I do believe people will go far and long to protect their money. But no, they have to tell themselves she’s doing it because she’s being forced, absolving her of any ill intentions or greed so they can keep the delusion of this “perfect” person in their eyes.

It’s just so painfully obvious that these are either trolls, or just dumbass kids who literally pull things from their arse and have NO IDEA what they’re talking about.

It’s not a contract that has her silent, it’s probably half her complete righteous disdain of SocMed and the other half it's under the advisement of her legal and PR team.

Hey! Just a heads up that Katniss is supposed to read as Indigenous <3 (:

hi hi non ! so, this is something i am familiar with and have discussed with my coadmin, so let me take you through our thought process ! i absolutely agree with the indigenous coding of katniss, however the most popular interpretation of the text is actually that those of the seam bear strong similarities to the melungeon, an ethnic group from the appalachian region with a mixed ancestry (but also includes indigenous groups from the region!). a hunt for a fc of that ethnicity bore no results, and upon looking more fan opinions and theories, i did find a lot of poc who saw themselves in katniss, so we made sure that katniss was a poc, but we worried about the possibility of it seeming like we were conflating one thing with another if we included indigenous suggestions that were not explicitly stated to be melungeon, especially if they were not from the appalachian regions, but we realize now that this was a mistake and would just like to let you know that we maintain the belief that katniss should be melungeon, but if that is not possible (we will continue to work to find options), fcless is an option as well, but otherwise we will be requiring katniss to be indigenous. we are sincerely so sorry for neglecting to include indigenous fcs in our first answer, and also for not being candid about our thought process. here is an updated list of fcs we think would work for katniss

How do we know that Jensen’s role on TB lead to nothing? Would his role as Beau Arlen keep him from announcing other things? Or not? I’m not doubting you, I just am ignorant in this and would like more of your expertise and a walk through of your thinking. Thank you.

Announcing anything depends on the NDA an Actor signs. Jensen should never announce anything prior to getting permission from the production involved and ensuring the way he does it respects the clauses within his contract. Ideally, a smart actor always ensure he stays on brand for the shows/movie he was chosen for while making announcements about it. To answer your question, if Jensen had gotten any roles on the heels of his SB one, we would know about it by now and it would be in the press. As for his role on BS, I have no clue if he signed an exclusivity agreement for the time he will be on that show but usually studios do include that because they don't want actors to jump ships the moment a bigger, juicer roles comes along. Jared and Jensen both missed out on opportunities during the filming of Supernatural because, even if the show could have focused on other members of the cast, they had to stick to SPN as they were not allowed to shoot others things. Things are, however, improving on the exclusivity front:

To give you a recent example of an actor that successfully played her roles into something more, consider Jenna Ortega and analyze her rise. The mistake Jensen often makes is self aggrandizing and exaggerating his roles as well as announcing projects before they are fully fledged. As even the biggest projects can be cancelled last minute, deals fall through, actors get replaced, issues arise that lead to an entire project or a particular Actor's performance being scraped. This is why, to be an utmost professional, Jensen needs to stop name dropping, get some knowledge about legal clauses and NDAs and learn to promote his roles in the on brand way for that particular show without trying to overshadow them with SPN or his own ego. Because how you approach promotion can get you noticed by all the right people and productions adore an actor that stays on brand and promotes the movie/show in authentic ways.
