"Reviewers told the report’s authors that AI summaries often missed emphasis, nuance and context; included incorrect information or missed relevant information; and sometimes focused on auxiliary points or introduced irrelevant information. Three of the five reviewers said they guessed that they were reviewing AI content.
The reviewers’ overall feedback was that they felt AI summaries may be counterproductive and create further work because of the need to fact-check and refer to original submissions which communicated the message better and more concisely."
Fascinating (the full report is linked in the article). I've seen this kind of summarization being touted as a potential use of LLMs that's given a lot more credibility than more generative prompts. But a major theme of the assessors was that the LLM summaries missed nuance and context that made them effectively useless as summaries. (ex: “The summary does not highlight [FIRM]’s central point…”)
The report emphasizes that better prompting can produce better results, and that new models are likely to improve the capabilities, but I must admit serious skepticism. To put it bluntly, I've seen enough law students try to summarize court rulings to say with confidence that in order to reliably summarize something, you must understand it. A clever reader who is good at pattern recognition can often put together a good-enough summary without really understanding the case, just by skimming the case and grabbing and repeating the bits that look important. And this will work...a lot of the time. Until it really, really doesn't. And those cases where the skim-and-grab method won't work aren't obvious from the outside. And I just don't see a path forward right now for the LLMs to do anything other than skim-and-grab.
Moreover, something that isn't even mentioned in the test is the absence of possibility of follow up. If a human has summarized a document for me and I don't understand something, I can go to the human and say, "hey, what's up with this?" It may be faster and easier than reading the original doc myself, or they can point me to the place in the doc that lead them to a conclusion, or I can even expand my understanding by seeing an interpretation that isn't intuitive to me. I can't do that with an LLM. And again, I can't really see a path forward no matter how advanced the programing is, because the LLM can't actually think.

China hacked Verizon, AT&T and Lumen using the FBI’s backdoor
On OCTOBER 23 at 7PM, I'll be in DECATUR, presenting my novel THE BEZZLE at EAGLE EYE BOOKS.
State-affiliated Chinese hackers penetrated AT&T, Verizon, Lumen and others; they entered their networks and spent months intercepting US traffic – from individuals, firms, government officials, etc – and they did it all without having to exploit any code vulnerabilities. Instead, they used the back door that the FBI requires every carrier to furnish:

In 1994, Bill Clinton signed CALEA into law. The Communications Assistance for Law Enforcement Act requires every US telecommunications network to be designed around facilitating access to law-enforcement wiretaps. Prior to CALEA, telecoms operators were often at pains to design their networks to resist infiltration and interception. Even if a telco didn't go that far, they were at the very least indifferent to the needs of law enforcement, and attuned instead to building efficient, robust networks.
Predictably, CALEA met stiff opposition from powerful telecoms companies as it worked its way through Congress, but the Clinton administration bought them off with hundreds of millions of dollars in subsidies to acquire wiretap-facilitation technologies. Immediately, a new industry sprang into being; companies that promised to help the carriers hack themselves, punching back doors into their networks. The pioneers of this dirty business were overwhelmingly founded by ex-Israeli signals intelligence personnel, though they often poached senior American military and intelligence officials to serve as the face of their operations and liase with their former colleagues in law enforcement and intelligence.
Telcos weren't the only opponents of CALEA, of course. Security experts – those who weren't hoping to cash in on government pork, anyways – warned that there was no way to make a back door that was only useful to the "good guys" but would keep the "bad guys" out.
These experts were – then as now – dismissed as neurotic worriers who simultaneously failed to understand the need to facilitate mass surveillance in order to keep the nation safe, and who lacked appropriate faith in American ingenuity. If we can put a man on the moon, surely we can build a security system that selectively fails when a cop needs it to, but stands up to every crook, bully, corporate snoop and foreign government. In other words: "We have faith in you! NERD HARDER!"
NERD HARDER! has been the answer ever since CALEA – and related Clinton-era initiatives, like the failed Clipper Chip program, which would have put a spy chip in every computer, and, eventually, every phone and gadget:

America may have invented NERD HARDER! but plenty of other countries have taken up the cause. The all-time champion is former Australian Prime Minister Malcolm Turnbull, who, when informed that the laws of mathematics dictate that it is impossible to make an encryption scheme that only protects good secrets and not bad ones, replied, "The laws of mathematics are very commendable, but the only law that applies in Australia is the law of Australia":

CALEA forced a redesign of the foundational, physical layer of the internet. Thankfully, encryption at the protocol layer – in the programs we use – partially counters this deliberately introduced brittleness in the security of all our communications. CALEA can be used to intercept your communications, but mostly what an attacker gets is "metadata" ("so-and-so sent a message of X bytes to such and such") because the data is scrambled and they can't unscramble it, because cryptography actually works, unlike back doors. Of course, that's why governments in the EU, the US, the UK and all over the world are still trying to ban working encryption, insisting that the back doors they'll install will only let the good guys in:

Any back door can be exploited by your adversaries. The Chinese sponsored hacking group know as Salt Typhoon intercepted the communications of hundreds of millions of American residents, businesses, and institutions. From that position, they could do NSA-style metadata-analysis, malware injection, and interception of unencrypted traffic. And they didn't have to hack anything, because the US government insists that all networking gear ship pre-hacked so that cops can get into it.
This isn't even the first time that CALEA back doors have been exploited by a hostile foreign power as a matter of geopolitical skullduggery. In 2004-2005, Greece's telecommunications were under mass surveillance by US spy agencies who wiretapped Greek officials, all the way up to the Prime Minister, in order to mess with the Greek Olympic bid:

This is a wild story in so many ways. For one thing, CALEA isn't law in Greece! You can totally sell working, secure networking gear in Greece, and in many other countries around the world where they have not passed a stupid CALEA-style law. However the US telecoms market is so fucking huge that all the manufacturers build CALEA back doors into their gear, no matter where it's destined for. So the US has effectively exported this deliberate insecurity to the whole planet – and used it to screw around with Olympic bids, the most penny-ante bullshit imaginable.
Now Chinese-sponsored hackers with cool names like "Salt Typhoon" are traipsing around inside US telecoms infrastructure, using the back doors the FBI insisted would be safe.

If you’ve rented an apartment in the US in the past several years, you may have had the sense that the game was rigged: Prices creep up not only at your building but at others throughout the city, seemingly in lockstep. A new civil lawsuit brought by the US Department of Justice today alleges that in many cases it’s not just in your head—and that a single company’s algorithm is to blame.
That company is RealPage, a Texas-based firm that provides commercial revenue management software for landlords. In other words, it helps set the prices of apartments. But it does so, the DOJ alleges in its lawsuit, by effectively helping its clients cheat; landlords feed rental rate and lease terms into the system, and the RealPage algorithm in turn spits out a suggested price that enables coordination and hinders competition.
“By feeding sensitive data into a sophisticated algorithm powered by artificial intelligence, RealPage has found a modern way to violate a century-old law through systematic coordination of rental housing prices,” deputy attorney general Lisa Monaco said in a statement.
RealPage’s reach is broad. It controls 80 percent of the market for software of its kind, which in turn is used to set prices of around 3 million units across the country, according to the DOJ. It already faces multiple lawsuits, including one from the state of Arizona and another in Washington, DC, where RealPage software is allegedly used to price more than 90 percent of units in large apartment buildings. RealPage’s algorithmic pricing first gained broader attention when a 2022 ProPublica investigation detailed how the company’s YieldStar software works.
The DOJ civil lawsuit, which was joined by the attorneys general of eight states, is a significant escalation in legal action against the company. It’s also a first for the DOJ, according to officials speaking on background during a call to discuss the complaint. While the government had previously filed criminal charges against an Amazon seller for algorithm-enabled price-fixing, this is the first civil action in which the algorithm itself, the Justice Department official says, was effectively the means of the violation.
The complaint itself quotes RealPage executives allegedly acknowledging anticompetitive aspects of its product. “There is greater good in everybody succeeding versus essentially trying to compete against one another in a way that actually keeps the entire industry down,” one RealPage executive allegedly wrote.
RealPage has repeatedly denied any allegations of antitrust violations, going so far as to publish a six-page digital pamphlet that claims to tell “the Real Story” about its products, along with an extensive FAQ page on a dedicated public policy website. The company did not immediately respond to a request for comment. “Attacks on the industry’s revenue management are based on demonstrably false information,” one section of that site reads. “RealPage revenue management software benefits both housing providers and residents.”
“We are disappointed that, after multiple years of education and cooperation on the antitrust matters concerning RealPage, the DOJ has chosen this moment to pursue a lawsuit that seeks to scapegoat pro-competitive technology that has been used responsibly for years,” said Jennifer Bowcock, senior vice president of communications and creative at RealPage, in an emailed statement. “RealPage’s revenue management software is purposely built to be legally compliant, and we have a long history of working constructively with the DOJ to show that."
The DOJ disagrees. “Algorithms don’t exist in a law-free zone,” said Monaco in a press conference to discuss the case. “Training a machine to break the law is still breaking the law.”
In this case, the complaint alleges that those algorithms consistently drove rental prices upward. “RealPage’s software tends to maximize price increases, minimize price decreases, and maximize landlords’ pricing power,” said the DOJ in a press release. RealPage also doesn’t just recommend prices; in many cases, it actively sets them.
“RealPage actively polices landlords’ compliance with those recommendations,” said US attorney general Merrick Garland in today’s press conference. “A large number of landlords effectively agree to outsource their pricing decisions to RealPage by using an ‘auto-accept’ setting that effectively permits RealPage to determine the price a renter will pay.”
The DOJ also claims RealPage has created a “self-reinforcing feedback loop” with its data intake and pricing recommendations structure that also gives it an alleged monopoly in the apartment revenue management software industry. Any competitor who plays by the rules, the DOJ claims, is at a distinct disadvantage.
The Justice Department has spent the past several years staffing up with technologists and data scientists, better enabling them to “interrogate the code,” as multiple officials described the investigative process. While this is the first major algorithmic collusion case, DOJ officials suggested it would be far from the last.

So it turns out that Elons trip to Israel wasn't just for kosher theater and an IDF propaganda tour.
A secret meeting took place while he was there that went virtually unreported by any news media outlets.
In attendance was Netanyahu, Musk's tour organizer, investor Omri Casspi, Brigadier General Danny Gold, Head of the Israeli Directorate of Defense Research & Development and one of the developers of Iron Dome, Aleph venture capital funds partner Michael Eisenberg, and Israeli cybersecurity company CHEQ CEO Guy Tytunovich who is ex-israeli intelligence unit 8200.
The six men talked about technology in the service of Israel's defense, dealing with fake content and anti-Semitic and anti-Israeli comments, and the use by non-democratic countries of bots as part of campaigns to change perceptions, including on the X platform.
The solution Musk was presented was the Israeli unicorn CHEQ, a company founded by ex-Israeli intelligence unit 8200 CEO Guy Tytunovich that combats bots and fake users.
Following the meeting, Elon signed an agreement with cheQ, and apparently, the reason for the quick closing of the deal was Elons "direct involvement" with the company.
Now. What they won't tell you.
Israel is primarily responsible for the creation of bots. There currently exists dozens of ex-Israeli intelligence firms whose sole purpose is perception management, social media influencing/manipulation, disinformation campaigns, psychological operations, opposition research, and honey traps.
They create state of art, multi layer, AI avatars that are virtually indistinguishable from a real human online. They infiltrate target audiences with these elaborately crafted social-media personas and spread misleading information through websites meant to mimic news portals. They secretly manipulate public opinion across app social media platforms.
The applications of this technology are endless, and it has been used for character assassination, disruption of activism/protest, creating social upheaval/civil unrest, swaying elections, and toppling governments.
These companies are all founded by ex-Israeli intelligence and members of unit 8200. When they leave their service with the Israeli government, they are backed by hundreds of billions of dollars through Israeli venture capital groups tied to the Israeli government.
These companies utilize the technology and skills learned during their time served with Israeli intelligence and are an extension of the Israeli government that operates in the private sector.
In doing so, they operate with impunity across all geographical borders and outside the bounds of the law. The Israeli government is forbidden by law to spy on US citizens, but "ex" Israeli intelligence has no such limitations, and no laws currently exist to stop them.
Now back to X and Elon Musk.
Elon met with these people in secret to discuss how to use X in service of Israel's defense.
Elon hired an ex-Israeli intelligence firm to combat the bots…. that were created by another ex-israeli intelligence firm.
Elon hired an ex-israeli intelligence firm to verify your identity and collect your facial biometric data.
Do you see the problem yet?
Israel now has end to end control over X. Israel can conduct psychological operations and create social disinfo/influence campaigns on X with impunity. They now have facial biometric data from millions of people that can be used to create and populate these AI generated avatars.
They can manipulate public opinion, influence congressmen and senators, disrupt online movements, manipulate the algorithm to silence dissenting voices against Israel, and they can sway the US elections.
When the company that was hired to combat the bots is also Israeli intelligence…
Who is going to stop them?
Cyberspace is the wild.west. There are currently no laws on the books to regulate foreign influence on social media. There is nothing to stop them from conducting psychological operations and disinformation campaigns on unsuspecting US citizens. These companies operate with impunity across all geographical boundaries and there is nobody to stop them. But don't take my word for it.
For anyone wondering what the end game is for this, it was recently verbalized by Vivek Ramaswamy here on X. To narrow and completely eliminate the gap between what we say (think) in private and in public. In practice, the thought police of the future. And X is actively working on it.

(You are a witch that fell for the oldest trick in the book by giving your name to the mischievous Fae princes of the Celestial Court. Such an inconvenience on what was supposed to be a typical office night. You are honestly not having it. They, however, do seem quite happy about having you. You decide to make a deal with the Fae King to regain your freedom. The only thing that is functional in the whole situation is your phone signal in the Fae Kingdom.)

“Your precious contribution is very much appreciated.“
It is not every day that one seals their own fate because of a simple misunderstanding of idioms and literal meanings, but there you were, bound to the realm of the Fae Folk and belonging to the royal twins of the Celestial Court. Mondays were known to be unlucky days, but this was just ridiculous.
You weren't really in the mood for getting abducted, thank you very much.
There were so many assignments and drafts due next week and you feared Vanessa's wrath far more than you feared the dark magic of enamoured Fae.
Furthermore, you had the misfortune of being stuck with those mischievous miscreants in the middle of the witching hour. The law firm building was empty, the cranky doorman had left hours ago and the janitor had the habit of never arriving before six in the morning. You could scream, but that would not do much good. The cameras did not pick up sound and technology could not record the presence of the Fae, so the only thing you would accomplish is create evidence of your own insanity.
“Excuse me, I really must protest.“
You were in the process of trying to escape the grip of the regal solar-themed Fae. He seemed rather amused, since you weren't really successful, but he almost seemed to be playfully encouraging you to keep trying. Prince Sun had always been a very supportive person, even if he was the one causing the problem in the first place.
“Go on, beautiful, nobody is stopping you. I think that every once in a while everybody needs to raise objections and such. It is healthy.“
His lunar twin grinned, red eyes glowing with roguish mirth.
“I wholeheartedly agree with you, brother. We fully encourage sincerity and dialogue.“
You told them that you wanted to make an appeal. They happily informed you that such a thing was not possible and that you officially belonged to them. You were certainly not touched by their infectious enthusiasm. After all, being gifted with a human's True Name was an experience akin to a cat falling into a whole box full of catnip for them.

By all logic, you should be feeling some form of despair and terror, but you were mostly suffering from a horrible case of injured pride. You had fallen for the oldest trick since the dawn of magic. You were an absolute idiot. True, you were running on two cups of coffee, you had not slept properly in a week and your blood sugar levels were more tragic than Shakespeare's “Hamlet“. In your defense, working for William Afton, attorney at law, was no walk in the bloody park. Especially when you had Vanessa as your immediate taskmaster.
You had grown tired of struggling, giving yourself a few moments of respite. Prince Sun was holding you bridal style, his blue gaze soft, showing a type of adoration one would give to a hidden treasure, a joy one experiences when holding a droplet of water in a desert.
Prince Moon had a personality that was diametrically opposite to that of his brother. Hunger reigned in his eyes. Your essence was intoxicating, calling for him, enticing him. You dared not even imagine what his claws could do to you, nor what he could accomplish with his razor-sharp teeth.
Rowan charms could no longer save you, nor could silver. Leaves of holly had no more power, either. You couldn't bribe the royal twins with cream either, since apparently you were the new dessert in the grand scheme of things.
Moon reached out with his claws, searching for your delicate hand. He traced his claw along the sensitive flesh of your inner wrist with all the fervour and ardour of a lover, inspecting the soft skin. Upon giving your name to them, two different markings had manifested on each inner wrist respectively. A crescent moon on the right one and the mark of the sun on the left one.
“Gentlemen, there has obviously been a bit of a miscommunication.“
“Yes, those tend to be very practical in our line of work.“
“I don't have time for this, do you have any idea how many assignments I have due next week?“
“Actually, we do. I must voice our disapproval of you overworking yourself in general. Following orders of such unworthy scoundrels.“
“Well, I am not really in the mood for changing one group of masters for another. I wish to be taken to the Fae King.“
“You will meet him later anyway, he is a bit busy now.“
“No, no, not in that way. I wish to make my complaint.“
“Haven't we closed that topic already?“
“I demand my freedom back. You two said that King Eclipse could grant it to me if I convince him to. Although, I see now that this statement does not exclude you two being capable of the same thing and most likely you are just using the wording to trick me to stop asking you.“

In spite of it all, you had to admit the celestial princes were quite handsome and their appearance would normally be breathtaking, if you weren't meeting them under such circumstances.
In a resting position, their large wings almost appeared like regal capes. Complementary colours reigned in their respective palettes. Deep royal blues of Prince Moon's wings were speckled with tiny stars, while the rich golden hues of Prince Sun's had swirls of blue interwoven in their texture. In a way, the twins were perfectly symmetrical when it came to the design of their wings. Their attire was similar to that of jesters, but far more elaborate and indicative of their status. Silk and velvet were present, bejeweled buttons, finely tailored doublets.
Both of them were eager, lovestruck and needy. To a degree you almost felt like a lamp attracting a pair of silly mothlings. Which was fitting, considering they too had wings and all.
As Moon was still caressing you along your inner forearm, Sun could not resist nuzzling your hair. You could have sworn that you heard both of them purr. A part of you wondered how on earth did such a scene appear on the cameras, were you simply just floating around and talking to yourself? You internally apologized in advance to any poor security worker that would have to go through the recordings later.
Sun's voice brought you back from your silly reveries, his cheek resting on your head.
“As soft as silk.“
You had been somewhat aware that a pair of Fae had been hunting you for the past several weeks, but it was impossible to decipher their identity. Their glamour and shielding spells had been extremely powerful, their cunning unparalleled and their tricks endless. In many ways, they had been testing you, the purity of your heart and the strength of your soul. They would come to you, disguised either as lost little animals in need of help, or as injured humans in need of assistance. You would always help, no questions asked and always ignoring the warning tingle of enemy magic. Your mind had completely warped to the logic of the normal world and you no longer asked yourself the questions a witch would.
You did not suspect the odd new coworkers that had appeared out of nowhere either, nor did you seem to wonder where they had come from. You had simply accepted that you probably just never noticed them before and that they had always been there. A few pleasantries here, a few kind words there, and that had been all. Of course, all up till tonight when the name trick finally came to rip the veil of denial off.
You huffed, unphased by Sun's compliments regarding your hair.
“Were you the one that has been making those silly fairy-locks I kept waking up with? Those are impossible to untangle!“
“Technically you are not supposed to do that, elsewise you bring misfortune upon yourself. The poor keyboard on your laptop suffered a premature death because of that.“
“I really liked that laptop.“
“I know.“
“It was brand new.“
“May it rest in peace.“
You looked over at the little digital clock on a nearby desk. The witching hour was almost over and the power of the Fae would slightly weaken after four in the morning. If you somehow escaped them, maybe you could distract them enough till the desired hour strikes. Your magical weapons may at least have a fair chance afterwards.
You gasped as Moon leaned closer to you, his hand caressing your cheek, sliding down to your neck, distracting you with pleasurable sensations and making your spine tingle.
“What is going on in that pretty little head of yours, wishing star?“
“Nothing much, honestly.“
Both of them spread their giant wings, showing all of their glory, then draped them over you in what one may interpret as a soothing and protective gesture, but given the circumstances, it was also a demonstration of entrapment.
Impish jesters, forever grinning, forever teasing.
It was one thing to be bound and made to serve an ordinary fairy. It was a completely different thing to be serving the royal twins of the Celestial Court. They were dangerous, powerful, their stature surpassed even the tallest of humans, their urges were never satisfied and their desires never at rest. Not to mention that they were the most competent tricksters of the Fae kingdom.
Fairies were incapable of lying. Therefore, they had to resort to literal meanings and multiple interpretations, distortions, tricks. You could imply one thing that was perfectly accepted and understood in human society, but they would purposefully give it an obscure meaning that was still not a falsehood.
Your predicament was ironic in many ways. Embarassing even. To be precise, you came from a long line of magical practitioners that had been known over the centuries as the Cunning Folk. Various terms existed for such people, but in the modern times the closest definition would be light witches. It was an adequate name that differentiated them from warlocks or dark witches.
You, dear Y/N, had done your best in life to keep the madness of magic at bay. Yes, you knew how to ward yourself from curious spirits, you always had your trusted rolled up newspaper at the ready to hit the local boogeyman on the head when he was living rent-free under your bed, and pretty much every imp on the block knew to avoid you if they wanted to keep all their limbs attached.
Fae Folk, however, were a different story. Long ago, it had been a custom for the Fae to connect to members of the Cunning Folk in order to form a soul bond. A familiar and their witch, in a way. It had always been a connection stronger than any spell and a love more intense than any passionate marriage.
All of that had changed when the realm of the Fae had been afflicted by a darkness far more potent than any light spell could heal. The Hopes and Dreams of children had become scarce and all that was once joyful and innocent had become corrupted and ruined. The Fae King had become cruel and wicked, his once cheerful and loving demeanour had transformed into that of a deranged villain. He did have an odd shift of behaviour on certain birthdays, though, and this would usually take everyone aback for a solid twenty-four hours.
In light of all that, the Cunning Folk had gone into hiding and refused any new bonds with the Fae. This was unacceptable, since the Fae had depended immensely on the sweet nectar that human souls could provide, especially when that soul happened to be a magical one. Consequently, over the centuries the Fae had to resort to various tricks, from luring humans into their fairy circles, kidnapping them and taking them to their kingdom, tricking them with various word games and always having them fall in traps when they least expected it. Certain Fae were less malevolent and were simply in dire need and want of being parents to a child, so they would take human babies to raise them as their own, leaving changelings in their place.
And despite all your efforts, you still managed to become a captive. Go figure.
Prince Sun, ruler of the waking dreams, bringer of hope, and Prince Moon, protector of sleeping children and vanquisher of nightmares. All of those titles did sound pretty cute, but both of them were still impish fiends that loved to play pranks on adults. Oh, well, your time was running out, so you had to think of something fast. Or at least try to reach the little dagger with Runes that you had all nicely hidden and tucked away in a secret pocket of your trousers. You never knew when you would need to stab something supernatural. Or open an envelope.
You concocted a little plan and hoped for the best.
Trickery was not limited to the Fae and you lowkey felt proud of your cunning ways as you pulled Moon into a deep kiss, much to his initial shock. He began to eagerly reciprocate, the sweet haze of lust conspiring against him, your softness and loveliness engulfing his mind. Desire was a natural solvent to rational thought and you had no problems with using that against him. Sun, on the other hand, was both shocked, and slightly jealous, but he did know that something was off.
His suspicions were only confirmed when, in the span of several seconds, you pulled out a silver dagger with enough Runic carvings to obliterate a whole magical army, casually stabbed Moon's heart as if the very gesture was the most normal thing in the world, used Sun's surprise to wriggle out of his grasp and you ran away down the corridors like a feral kitten. Well, at least you were productive.
As you ran, your phone began to ring, conveniently giving up your location in the process, but oh well. It was Vanny, so of course you had to pick up.
“Y/N, where is that briefing paper that you were supposed to email me literally yesterday?“
“I'm in a bit of a situation, Vanessa.“
“What is it now?“
“Well, apparently I am getting married.“
“Congratulations, I still want that briefing.“
“I will call you back, alright?“
Meanwhile, Prince Moon was having a bit of an existential crisis. He stood there, shocked, dagger protruding from his heart.
Oh, yes, it hurt. It burned, stinged, all of the unpleasant things that one may imagine. However, it was nothing compared to how it could have been. The newly forged bond made him immune to most of your deadly spells and Runes, so at worst he would feel temporary pain and then it would cease.
In a way, his desire and respect for you only increased. A Fae always respected good examples of trickery.
Sun could not stop himself from wheezing, very much entertained with the situation.
“You really walked into that one, Moon.“
“Shut up.“
He would still make you pay for that little insult, nonetheless. The corridors had morphed into the same scenery over and over, the windows were suddenly sealed shut, the nearby doors leading to a dead end or into a void of eternal nothingness. You could no longer trust your senses, for mad whispers kept disrupting reality. Only a few more minutes, you hoped for only a few more minutes till the witching hour ends.
You were honestly an idiot for trusting your own luck.
Moon's voice echoed throughout the corridors, ominous and demonic. A bit spicy, as well.
“You should have saved that fire for the wedding night, wishing star.“
“Goodness gracious.“
It became rather obvious that Vanessa would not be getting that briefing paper anytime soon, nor would our good old William Afton be getting his early morning coffee next week, either. Or any week, for that matter. It was a tragedy beyond description, may he rest in pieces.
You had to stop to catch your breath, panting, perfectly aware of the fact that you were mostly screwed. Well, a part of your mind tried to add some rational remarks and told you that living with the Fae couldn't be that bad and at least you would hopefully be getting some really cute royal garments or something. When in doubt, at least material things never disappointed you.
Ghostly hands rose from the ground, grasping at your ankles, your calves, your thighs. You fell forwards unceremoniously and you would have experienced quite a hit to the ground had the hands not grasped you, shielding you from the hard floor.
“What a perfect way to spend my night, being manhandled seventy percent of the time.“
Wrestling them was useless, but at least there was more dignity in that than just doing nothing and thinking about the meaning of life till your captors arrived.
Prince Sun appeared first, somewhat sympathetic, but also visibly tired from all the shenanigans. He let you have your little moment of heroism, though.
“Take your time, darling one.“
“Oh, sod off.“
Prince Moon arrived soon after, eyes glowing a dangerous shade of crimson, the dagger still embedded in his chest. He pulled the blade out, his gaze following the path of the rivulets of blood, almost enchanted by the pattern they were making as they glided along the expertly made Runic symbols.
“Love the craftsmanship on this one. It would have been a poetic death. Stricken by a wishing star, tearing my heart asunder, red pearls the only gifts I have to offer.“
Sun went over to you, partially teasing, partially serious.
“Someone is a bit violent. Are you alright, darling one? Do you wish to talk about some unresolved issues?“
“You two are literally stealing me away.“
“It's not that bad. We shall be loving and caring consorts to you. After all, our bond is basically an engagement.“
“This is the shoddiest proposal ever. How is this even supposed to work, each of you gets their own day of the week?“
“We'll share equally.“
“Excuse me, I am not a meal.“
“Really? You do seem rather delicious.“
“This isn't fair. Do you have any idea how homesick humans can get in the realm of the Fae?“
“We have many spells designed to bedazzle the mind and encourage you to forget the mortal world. And everyone is nice in their own way once you get to know them.“
“You two had no other member of the Cunning Folk to bother and you just had to stumble upon me?“
The dark spell was lifted and you found yourself free. Well, not for long, since the twins were at your side once more. Sun kissed your hand like a true gentleman, his wings making the faintest flutter of joy.
“We searched for a heart of gold and dreams of hope.“
“And you decided to look in a law firm?“
“Bright light contrasts best against a shadowy background.“
“Can I see the terms and conditions of my service?“
“Oh? Good idea! You can read all of that on our way to the palace! It will be so much fun to explain it to you. Of course, the letters are inverted, so you will need a mirror just to read it.“
He conjured a seemingly reasonable rolled-up piece of paper, before letting it unfold. It reached the ground in a comical fashion and kept on going till the end of the corridor.
“Sun, that list is longer than the border of Ancient Rome.“
“Indeed! I had it shortened to make it easier for you.“
“Dear god.“
“I also must say that I wrote it myself. I do my fair share of corporate business and contracts with humans are my specialty, but I do prefer to engage in theater. I may have given a certain playwright a few tips on writing his special little Midsummer work.“
“Old Will? For real?“
“Wonderful chap to have a pint with at the pub. I am certain he would have had an aneurysm had he lived to see what his reputation had become nowadays. A cheerful knave being the main topic for school and homework? Scandalous. He was a most charming actor and a talented wizard of words. Had many a verbal battle with him, and I never managed to snag his soul. I fully respect him for that.“
“Good to know. Regardless, I still wish to talk to your brother about this whole affair. It is my right, considering the fact that I am not a normal human and I do have certain perks. I am certain that King Eclipse will have more respect for old customs than you two.“
Sun and Moon gave each other a look, before giggling at you, as if charmed by how silly your request was.
“King Eclipse? Darling one, do beware.“
“The knave stole the moonlight fair.“
“Neither fools nor traitors breathe for long in his lair.“
“Be our guest, challenge him, if you dare.“
You raised an eyebrow at their improvised little poetic endeavour, tilting your head, curious.
“Did you two just come up with that?“
“Well, we did think of incorporating a iambic pentameter somewhere in there, but we simply decided to free verse it.“
Needless to say that the whole charade continued even after they had conjured a portal to their world, taking you with them. You were playing a dangerous game, but realistically you had nothing to lose. Well, except your dignity and maybe your life, but nothing lasts forever anyway, so might as well.
Your case was one type of extreme. On the other end of the city, two members of the Fae species were in the process of “adopting“ a few bundles of joy. The bear Fae and the wolf Fae were aware that two children were very unhappy in their orphanage and oftentimes they would hear the little girl, Cassie, vocalize her wish to be taken away by magical creatures. The boy, Gregory, had nothing against any of that, as long as there was proper acommodation involved. He hated the hard old bed he had in the orphanage and the food was positively awful.
Of course, there had to be an equivalent exchange, so the two Fae had to bring some friends along. One of them was not too thrilled.
“Why are we doing this? I don't want to stay in the human world.“
“You only need to stay till the next full Moon, Bonnie, and then you will be free of the obligation. Monty will keep you company.“
“Monty is insane.“
“Don't be rude.“
“He pushed me off the stairs, Roxy.“
“Happens.“
Montgomery was far too busy exploring the wonders of a music player to really care where he was, honestly. A few broken orphanage windows and one angry half-blind nun later, the wolf Fae and the bear Fae had become proud new adoptive parents. Bonnie and Monty would have to serve as changeling replacements for a bit, but that is what happens when you lose fairy chess. You owe favours.
By the time Roxy and Freddy had returned home, Gregory had partially woken up, while Cassie was all snuggled in the soft pillows of her new bed. They boy looked around his new house, nonchalant and trying to read what was happening from the clues given.
“Have I been kidnapped?“
“Some may call it that.“
“By fairies? Like, a changeling type of situation?“
“Yes, but I assure you we are using all of the safety protocols that are necessary.“
“Well, I'll be damned.“
“We do wish to make the best effort and become your new family, Gregory. For you and Cassie.“
“Is that food over there? Cupcakes?“
“Oh, indeed, with buttercream and cherries.“
Gregory observed the treats for a good few moments, thought a bit, weighed all his options and of course made the best possible decision for himself in that type of situation. Fairy food was usually a forbidden thing, but he was already stolen anyway.
“I am a simple lad, I see free food and I cannot complain.“

Robert Downey Jr. Refuses to Let Hollywood Create His AI Digital Replica: ‘I Intend to Sue All Future Executives’ Who Recreate My Likeness

Robert Downey Jr. appeared on a recent episode of the “On With Kara Swisher” podcast and sent a stern warning to Hollywood in the age of AI: “I intend to sue all future executives” who sign off on the creation of a Downey digital replica. The Oscar winner does not want his likeness being used on screen through AI technology and/or deepfakes. The topic came up in relation to Downey’s Marvel tenure as Iron Man, but he’s confident Marvel would not recreate his Tony Stark through AI.
“There’s two tracks. How do I feel about everything that’s going on? I feel about it minimally because I have an actual emotional life that’s occurring that doesn’t have a lot of room for that,” Downey said when asked about being digitally recreated in the future.
“To go back to the MCU, I am not worried about them hijacking my character’s soul because there’s like three or four guys and gals who make all the decisions there anyway and they would never do that to me, with or without me,” he added.
When host Kara Swisher said that “future executives certainly will” want to digitally recreate Downey on the big screen, the actor responded: “Well, you’re right. I would like to here state that I intend to sue all future executives just on spec.”
“You’ll be dead,” Swisher noted, to which Downey replied: “But my law firm will still be very active.”
Downey is currently confronting the future of AI on Broadway in the play “McNeal,” which takes aim at corporate giants in the AI space such as OpenAI CEO Sam Altman.
“I don’t envy anyone who has been over-identified with the advent of this new phase of the information age. The idea that somehow it belongs to them because they have these super huge start-ups is a fallacy,” Downey told Swisher about figures like Altman. “The problem is when these individuals believe that they are the arbiters of managing this but meanwhile are wanting and/or needing to be seen in a favorable light. That is a massive fucking error. It turns me off and makes me not want to engage with them because they are not being truthful.”
Downey is currently gearing up to return to Marvel, but he’s doing as a human being and not a digital replica of Tony Stark. He’s actually not playing Tony Stark/Iron Man at all and is instead taking on the role of the villainous Doctor Doom starting in 2026’s “Avengers: Doomsday.”

I've made it my mission to read the entirety of Project 2025 (a right wing manifesto on how to take over the USA government written by The Heritage Foundation amongst other people) and HOLY SHIT ITS SO BAD.
I have only completed reading the Foreword, and Jesus fuck it's so bad. There's so much. They pat themselves on the back for aiding Ronald Regan, they say that the 1970s is a historic low point in America's history (note that the 1970s was when OSHA was signed into law, 18 year olds earned the ability to vote, the Environmental Protection Agency was formed, and Roe v. Wade was overturning state bans on abortion).
They want to take out several words/phrases from EVERY law, bill, or legal document (including sexual orientation, gender identity, abortion, and other important phrases that provide clarification and protection).
THEY WANT TRANS PEOPLE TO BE ILLEGAL.

They see protections for other people as impeding their right to free speech.
They want to classify trans people as pornography, and in the same breath say that anyone who makes porn should be imprisoned. They literally want to imprison every trans person for fucking existing.
Keep in mind, that this is all information in the FUCKING FOREWORD. I'M NOT EVEN ON THE FIRST OFFICIAL SECTION YET. This is terrifying. They want to remove more protections from everyone. They want to label the people they don't like as sexually explicit and make them criminals for just living their best life.
I cannot explain how terrifying this is. And Project 2025 is already in motion. Book bans, and anti-queer (but especially anti-trans laws) have been introduced at an all time high recently. And this is just my area of focus as a trans activist. I'm sure that other horrific things have been introduced as well.
I cannot explain how terrifying all of this is. I'm seething with rage and I want to break down crying even though I know my tears won't fix anything. I'm distraught and in despair.

These systems function to identify and designate suspected individuals as legitimate targets, based mostly on shared characteristics and patterns rather than specific locations or personal information.
The accuracy of the information provided by these systems is rarely verified by the occupation army, despite a known large margin of error due to the nature of these systems' inability to provide updated information.
The Lavender system, heavily used by the occupation army to identify suspects in Gaza before targeting them, is based on probability logic, a hallmark of machine learning algorithms.
"Israeli" military and intelligence sources have admitted to attacking potential targets without consideration for the principle of proportionality and collateral damage, with suspicions that the Lavender system relies on tracking social media accounts among its sources.
Recently, "israel's" collaboration with Google was revealed, including several technological projects, among them Project Nimbus which provides the occupation army with technology that facilitates intensified surveillance and data collection on Palestinians illegally.
The occupation army also uses Google's facial recognition feature in photos to monitor Palestinian civilians in the Gaza Strip and to compile an "assassination list," collecting a vast amount of images related to the October 7th operation.
The Euro-Mediterranean field team has collected testimonies from Palestinian civilians directly targeted in Israeli military attacks following their activities on social media sites, without any involvement in military actions.
The potential complicity of companies like Google and Meta and other technology and social media firms in the violations and crimes committed by "israel" breaches international law rules and the companies' declared commitment to human rights.
No social network should provide this kind of private information about its users and actually participate in the mass genocide conducted by "israel" against Palestinian civilians in Gaza, which demands an international investigation providing guarantees for accountability and justice for the victims.

Wind Beat Coal Two Months in a Row for U.S. Electricity Generation. (New York Times)
Wind turbines generated more electricity than coal-burning power plants across the United States in March and April, outstripping the dirtiest fuel for two consecutive months for the first time, according to the Energy Information Administration.
The crossover in wind and coal generation is the latest milestone in the country’s energy transition as renewables rise and coal declines. In recent years, breakthroughs in technology have lowered the cost of building new wind turbines, solar panels and battery storage, helping renewable energy replace coal as the cheapest power source in many places.
Renewable energy has also gotten a boost from tax credits awarded under the Inflation Reduction Act, the climate law Congress passed in 2022. And states have passed regulations mandating that utilities transition away from fossil fuels, particularly coal. More than 20 states — including Minnesota, North Carolina and Nebraska — have enacted legislation that requires utilities to get all their electricity from clean, carbon-free sources by 2050 or before.
Those three factors — shifts in the economics of energy, federal tax credits and state mandates — have led to explosive growth in renewable energy in recent years, said Timothy Fox, a managing director at ClearView Energy Partners, a consulting firm.

Elu is hesitant in new things but tries to keep an open mind. It’s difficult to adjust because she is unsure of what would happen if she tries something new and it might end up a bad experience. Not to mention growing up in an isolated village doesn’t give her enough exposure to foreign cultures.
Locals in her homeland know her to be a strong-willed girl who can be brutally honest because she intends to fix the problem right away, she believes that sugar-coating would delay the solution and make it worse. Though she does feel a little bad if someone cries from her criticism.
Being a beastman, she is very agile with a keen sense of smell as well as strength that surpasses humans. She often goes out hunting with the older members of the group and she displays full cooperation with other teammates.
But another thing to note is that she is a black bear beastman, her temperament is calm but she has a thin patience and she will growl or roar in anger. Despite being so small, she has incredible physical strength.
One thing she dislikes is when the team is unstable and problematic, she would quickly abandon that group and do the job herself or find another that’s got their heads together. She’d rather have the task done quickly and efficiently with no side tracking.
Unfortunately, this gives off the impression that she’s cold and unsociable which is far from the truth. She just needs to tone down a little bit.
Elu is actually mature and gives advice for those who can’t look after themselves. She enjoys the simple things in life and can have her moments where she spouts words of wisdom that makes others think she’s a wise, old sage.
Hometown: Bearland Woods
Family History
She grew up in a village where the locals rarely or never interact with outsiders. They aren’t against having outsiders visit but it was clear they don’t know how to handle interacting with people living different lifestyles.
The villagers are all beastmen who are mostly of the bear genus, though there are some who are deer and raccoon. Everyone knows each other and treat each other as if they were all family. Which means they don’t stand idly by if one of them gets hurt.
But they’ve been especially wary of outsiders after a group of shady businessmen started causing problems for them. Some of their people were imprisoned and branded as the bad guys when they retaliated.
They know nothing about the modern laws of the urban society and are pressured to take deals that would only benefit the other party. Thankfully, her father was a firm man and kept refusing them every time. But it won’t be long until they use every influence they have to chase them out of their home.
Elu is upset by these people and how they seem to be driven by their greed. It doesn’t help that they would disrupt the environment with their logging and illegal dumping.
Unlike city folk, life in her village was simple yet satisfying. They take what they need from the forest while also respecting the cycle of life. They don’t hunt out of vanity or pride. The males usually do the hunting but there have been women who are capable enough to hunt alongside them.
Due to Elu’s elder brother being born with weak body, she has taken the task of hunting for food and foraging. She has been taught knowledge on how to traverse the land and recognize edible and non-edible plants from her father.
Childhood Memories
Elu has a fond memory of her father protecting her from a bison that wandered too close, her father struggled but he overpowered the animal and sent it away from their borders. His tall stature and rough features may have come off as intimidating to others but to Elu he was her hero.
She wanted to be like him so she does everything she can to make him proud. Even courageously taking the chance to leave home to attend DCA in order to help their village.
There was an unpleasant memory where she was told to stay in the house by her father but she got curious and peeked to see these formally dressed businessmen. Whatever they said made her father mad, he eventually sent them away.
But what happened after that was scarred into her memory, a couple of houses in her village were suddenly set ablaze, her brother nearly losing his life when he was trapped in the rubble.
She smelled the source of the fire when the businessmen returned, they smelled like gasoline, when she cried out that they were the culprits. They mocked her by asking if they even have any solid evidence as well as a lawyer, implying that her village wouldn’t win because they have the money and power to make it their victory.
Elu’s rage from what the businessmen said made her determined to focus for the benefit of her village but this in turn made her closed off to outsiders. Afraid they would be like the businessmen, lying through their teeth.
Like Jinlong, she has trouble adjusting to the school life due to the culture shock. So, she often keeps to herself while occasionally asking the professors for advice when Elu feels like there was no other option. Which is the reason why she struggled a lot at first.
Not to mention, she doesn’t understand the concept of idol concerts and what the purpose of this was. She isn’t familiar with the pop songs or rock, she was more of a traditionalist but she felt like not many people would be interested in that.
She was at a loss for what she was doing and if she was even trying hard enough. Until Perrine approached her and made Elu comfortable enough to finally figure out how to get used to the school environment and subjects enough to guarantee her that she won’t need to drop out of school.
Putting her inventing skills to use, she does a lot of favors in exchange for what she needs, be it some notes or tutoring. In time, she got better and has gained a reputation for herself in school. Elu thinks that it’s only a small group but in reality she helped a lot of people and they admire her a lot.
Her grades are fairly decent but it was clear that she started to improve the more she managed to understand the foreign subjects. Not among the top students but still high around the B grade.
An excellent archery shooter who can shoot with high accuracy even when on horseback. She is known to even shoot arrows through ring holes as small as a pinky finger.
School Relationships
Elu mostly kept to herself and her “strictly business” attitude made it difficult for idle chit chat. It wasn’t until she was forced to seek out the help of other students that she learns to communicate more.
Even though she was still a bit professional, she at least made progress. She’s learned to try out new things little by little and learn more about new topics.
Perrine was the first to approach her and wasn’t thrown off by Elu’s reluctance. She managed to win her over just a bit with food because who doesn’t? Plus, it would help the girl relax a little and feel welcome.
Rozeline and Elu started off as acquaintances who exchanged information of interest until they became close enough to consider each other as friends in a way. Elu figured she could gain knowledge she needed from Rozeline and in turn can hope to put her issues in the urban public.
Elu found Rozeline’s inventions innovative and would take notes from her, but she’s sure to also provide her own feedback on how to make it eco-friendly while still efficient.
Jinlong was an enigma to Elu, she has never seen other beastmen let alone something like a dragonkin like Jinlong. So, she is both intrigued but also intimidated. When she got to know Jinlong by chance, she began to admire her. Their goals were different but they both relate to feeling out of place, but unlike Elu who was hesitant at first, Jinlong pushed through and got to her position.
Skilli sees Elu as this lost bear cub who is figuring out the right path, but with so many things she doesn’t know, finding the right path seems impossible. Skilli’s form is from Elu’s desire to find the way to settle her problems that won’t end in turmoil.
Skilli shares her knowledge to Elu as well as guide her to opening her eyes to new things she won’t find from the comforts of her home. Skilli teaches her how to cherish those differences in order to understand the world better. The fairy is the wisest and the most patient out of all the dorm fairies.
Matelot
She is a woodpecker and acts as Elu’s scout, always on the lookout for anything of interest from the treetops. Matelot often marks using symbols that Elu recognizes, she even knows Morse code.
Matelot is very quiet and likes to hide her presence, often scaring people and other animals when she starts pecking away. An animal of very little words, she talks softly into people’s ears before leaving the conversation.
Tala
She is a gypsy vanner horse with a calm temperament. No matter what chaos goes on in the background she just goes, “Oh, the usual?” then does her own thing. But when it’s an emergency, she can go from calm to serious when needed.
Elu often rides on her back to drive away approaching danger. Tala is also powerful enough to push away fallen trees and break small boulders.
Her Unique Magic is called, “Arrow of the Wind”, she can control any direction her arrows to follow her targets with a special wind spell that only she can cast. She can make the wind faster and therefore have a greater impact on the arrows.
She can also use it as a shield, any projectiles within her line of sight can be slowed down or be redirected back to her opponent.
Elu’s magical capability is mostly nature based. Though these abilities are used to benefit her village more than mainly using them for combat, unless she needed to as a last resort. She seeks to use her skills in creating more contraptions that make life easier but not at the cost of the ecosystem.
Mato Sorrel
The chief of their village, he is a large bear beastman who is strong enough to carry about five pine logs. He is having trouble with the businessmen who try to trespass their land and try to trick him into signing a ‘beneficial’ contract, he refuses every time because he didn’t have the opportunity to gain outside knowledge. He isn’t narrow-minded to think that outsiders are greedy but he just hopes that his daughter will be able to handle herself in the academy and hopefully bring an end to the trespassers.
Alo Sorrel (23)
He has a weak body so he isn’t able to hunt or participate in activities involving strength, he chooses to help the village to advance economically while keeping the environment in mind. He often sends letters to Elu to inform her what has been happening in the village. He feels guilty that he can’t do much to prevent trespassers from walking all over their homeland due to his weak body.
The character’s name, “Elu” means “Full of Grace” and is a name of Native American origin while the last name, “Sorrel”, means “reddish brown”. The artist just thought this last name sounded better fitting for the character despite the meaning.
Elu’s dorm, Sagamore, was considered to be the equivalent of the Savanaclaw in NRC. Most of the students there are beastmen much like Savanaclaw. Though, Dragonstone, also shares this comparison but Sagamore has more beastmen than Dragonstone does.
She was originally going to be written with the same wise and calm personality like Pocahontas but then it was changed to be a tougher personality with the sense of adventure and navigation like John Smith. The calm personality went to her brother.
The artist chose to assign a bear to Elu as a nod to Brother Bear as well as to fit the characteristic of someone that looks cute but is actually fierce.
Elu was the hardest to design since the first design had too much details and took the longest to draw, not to mention drawing a mechanical bow was difficult for the artist since contraptions are tricky.
The artist is open to criticism and opinions regarding Native American culture since the internet isn’t always helpful.

E.5 Can ethical consumerism stop the ecological crisis?
No. At best, it can have a limited impact in reducing environmental degradation and so postpone the ecological crisis. At worse, it could accelerate that crisis by creating new markets and thus increasing growth.
Before discussing why and just so there is no misunderstanding, we must stress that anarchists fully recognise that using recycled or renewable raw materials, reducing consumption and buying “ecologically friendly” products and technologies are very important. As such, we would be the last to denounce such a thing. But such measures are of very limited use as solutions to the ecological problems we face. At best they can only delay, not prevent, capitalism’s ultimate destruction of the planet’s ecological base.
Green consumerism is often the only thing capitalism has to offer in the face of mounting ecological destruction. Usually it boils down to nothing more than slick advertising campaigns by big corporate polluters to hype band-aid measures such as using a few recycled materials or contributing money to a wildlife fund, which are showcased as “concern for the environment” while off camera the pollution and devouring of non-renewable resources goes on. They also engage in “greenwashing”, in which companies lavishly fund PR campaigns to paint themselves “green” without altering their current polluting practices!
This means that apparently “green” companies and products actually are not. Many firms hire expensive Public Relations firms and produce advertisements to paint a false image of themselves as being ecologically friendly (i.e. perform “greenwashing”). This indicates a weakness of market economies — they hinder (even distort) the flow of information required for consumers to make informed decisions. The market does not provide enough information for consumers to determine whether a product is actually green or not — it just gives them a price supplemented by (often deliberately misleading) advertising designed to manipulate the consumer and present an appropriate corporate image. Consumers have to rely on other sources, many of which are minority journals and organisations and so difficult to find, to provide them with the accurate information required to countermand the power and persuasion of advertising and the work of PR experts. This helps explain why, for example, “large agribusiness firms are now attempting, like Soviet commissars, to stifle criticism of their policies” by means of “veggie libel laws.” These laws, which in 2001 had been passed in 13 American states (“backed by agribusiness”) “make it illegal to criticise agricultural commodities in a manner inconsistent with ‘reasonable’ scientific evidence. The whole concept of ‘veggie libel’ laws is probably unconstitutional; nevertheless, these laws remain on the books.” [Eric Schlosser, Fast Food Nation, p. 266]
We should not discount the impact of PR experts in shaping the way people see the world or decide to consume. A lot of resources are poured into corporate Public Relations in order to present a green image. “In the perverse world of corporate public relations,” note critics John Stauber and Sheldon Rampton, “propagandising and lobbying against environmental protection is called ‘environmental’ or ‘green’ PR. ‘Greenwashing’ is a more accurate pejorative now commonly used to describe the ways that polluters employ deceptive PR to falsely paint themselves an environmentally responsible public image … Today a virulent, pro-industry, anti-environmentalism is on the rise … PR experts … are waging and winning a war against environmentalists on behalf of corporate clients in the chemical, energy, food, automobile, forestry and mining industries.” A significant amount of cash is spent (an estimated $1 billion a year by the mid-1990s) “on the services of anti-environmental PR professionals and on ‘greenwashing’ their corporate image.” [Toxic Sludge is Good for You!, p. 125] See the chapter called “Silencing Spring” in Stauber’s and Rampton’s book Toxic Sludge is Good for You! for a good summary of this use of PR firms.
Even apparently ecologically friendly firms like “The Body Shop” can present a false image of what they do. For example, journalist Jon Entine investigated that company in 1994 and discovered that only a minuscule fraction of its ingredients came from Trade Not Aid (a program claimed to aid developing countries). Entine also discovered that the company also used many outdated, off-the-shelf product formulas filled with non-renewable petrochemicals as well as animal tested ingredients. When Entine contacted the company he received libel threats and it hired a PR company to combat his story. [Stauber and Rampton, Op. Cit., pp. 74–5] This highlights the dangers of looking to consumerism to solve ecological problems. As Entine argued:
“The Body Shop is a corporation with the privileges and power in society as all others. Like other corporations it makes products that are unsustainable, encourages consumerism, uses non-renewable materials, hires giant PR and law firms, and exaggerates its environment policies. If we are to become a sustainable society, it is crucial that we have institutions … that are truly sustainable. The Body Shop has deceived the public by trying to make us think that they are a lot further down the road to sustainability than they really are. We should … no longer … lionise the Body Shop and others who claim to be something they are not.” [quoted by Stauber and Rampton, Op. Cit., p. 76]
Even ignoring the distorting influence of advertising and corporate-paid PR, the fundamental issue remains of whether consumerism can actually fundamentally influence how business works. One environmental journalist puts the arguments well in his excellent book on “Fast Food” (from the industrialisation of farming, to the monopolisation of food processing, to the standardisation of food consumption it). As he puts corporations will “sell free-range, organic, grass-fed hamburgers if you demand it. They will sell whatever sells at a profit.” [Eric Schlosser, Op. Cit., p. 269] He complements this position by suggesting various regulations and some role for trade unions.
Which, of course, is true. It is equally true that we are not forced to buy any specific product, which is why companies spend so much in convincing us to buy their products. Yet even ignoring the influence of advertising, it is unlikely that using the market will make capitalism nicer. Sadly, the market rewards the anti-social activities that Schlosser and other environmentalists chronicle. As he himself notes, the “low price of a fast food hamburger does not reflect its real cost … The profits of the fast food chains have been made possible by the losses imposed on the rest of society.” [Op. Cit., p. 261] This means that the idea that by using the market we can “reform” capitalism is flawed simply because even “good” companies have to make a profit and so will be tempted to cut costs, inflict them on third parties (such as workers, consumers and the planet). The most obvious form of such externalities is pollution. Such anti-social and anti-ecological behaviour makes perfect business sense as prices fall when costs are passed on to others in the form of externalities. Thus firms which employ debt-slaves in sweatshops while polluting the atmosphere in a third-world dictatorship will have lower costs and so prices than those employing unionised workers under eco-friendly regulations.
The amazing thing is that being concerned about such issues is considered as a flaw in economics. In fact, seeking the lowest price and ignoring the social and ecological impact of a product is “considered virtuousness” by the market and by economists for, as green economist E. F. Schumacher, pointed out ”[i]f a buyer refused a good bargain because he suspected that the cheapness of the goods in question stemmed from exploitation or other despicable practices (except theft), he would be open to criticism of behaving ‘uneconomically’ which is viewed as nothing less than a fall from grace. Economists and others are wont to treat such eccentric behaviour with derision if not indignation. The religion of economics has its own code of ethics, and the First Commandment is to behave ‘economically.’” [Small is Beautiful, p. 30] And, of course, such a consumer would face numerous competitors who will happily take advantage of such activities.
Then there is the issue of how the market system hides much more information than it gives (a factor we will return to in section I.1.2). Under the price system, customers have no way of knowing the ecological (or social) impact of the products they buy. All they have is a price and that simply does not indicate how the product was produced and what costs were internalised in the final price and which were externalised. Such information, unsurprisingly, is usually supplied outside the market by ecological activists, unions, customer groups and so on. Then there is the misinformation provided by the companies themselves in their adverts and PR campaigns. The skilfully created media images of advertising can easily swamp the efforts of these voluntary groups to inform the public of the facts of the social and environmental costs of certain products. Besides, any company has the threat of court action to silence their critics as the cost in money, resources, energy and time to fight for free speech in court is an effective means to keep the public ignorant about the dark side of capitalism.
This works the other way too. Simply put, a company has no idea whether you not buying a product is based on ethical consumption decisions or whether it is due to simple dislike of the product. Unless there is an organised consumer boycott, i.e. a collective campaign, then the company really has no idea that it is being penalised for its anti-ecological and/or anti-social actions. Equally, corporations are so interlinked that it can make boycotts ineffective. For example, unless you happened to read the business section on the day McDonalds bought a sizeable share in Pret-a-Manger you would have no idea that going there instead of McDonalds would be swelling the formers profits.
Ultimately, the price mechanism does not provide enough information for the customer to make an informed decision about the impact of their purchase and, by reducing prices, actively rewards the behaviour Schlosser condemns. After all, what is now “organic” production was just the normal means of doing it. The pressures of the market, the price mechanism so often suggested as a tool for change, ensured the industrialisation of farming which so many now rightly condemn. By reducing costs, market demand increased for the cheaper products and these drove the other, more ecologically and socially sound, practices out of business.
Which feeds into the issue of effective demand and income limitations. The most obvious problem is that the market is not a consumer democracy as some people have more votes than others (in fact, the world’s richest people have more “votes” than the poorest billions, combined!). Those with the most “votes” (i.e. money) will hardly be interested in changing the economic system which placed them in that position. Similarly, those with the least “votes” will be more willing to buy ecologically destructive products simply to make ends meet rather than any real desire to do so. In addition, one individual’s decision not to buy something will easily be swamped by others seeking the best deal, i.e. the lowest prices, due to economic necessity or ignorance. Money (quantity) counts in the market, not values (quality).
Then there is the matter of sourcing of secondary products. After all, most products we consume are made up of a multitude of other goods and it is difficult, if not impossible, to know where these component parts come from. Thus we have no real way of knowing whether your latest computer has parts produced in sweatshops in third-world countries nor would a decision not to buy it be communicated that far back down the market chain (in fact, the company would not even know that you were even thinking about buying a product unless you used non-market means to inform them and then they may simply dismiss an individual as a crank).
So the notion that consumerism can be turned to pressurising companies is deeply flawed. This is not to suggest that we become unconcerned about how we spend our money. Far from it. Buying greener products rather than the standard one does have an impact. It just means being aware of the limitations of green consumerism, particularly as a means of changing the world. Rather, we must look to changing how goods are produced. This applies, of course, to shareholder democracy as well. Buying shares in a firm rarely results in an majority at the annual meetings nor, even if it did, does it allow an effective say in the day-to-day decisions management makes.
Thus green consumerism is hindered by the nature of the market — how the market reduces everything to price and so hides the information required to make truly informed decisions on what to consume. Moreover, it is capable of being used to further ecological damage by the use of PR to paint a false picture of the companies and their environmental activities. In this way, the general public think things are improving while the underlying problems remain (and, perhaps, get worse). Even assuming companies are honest and do minimise their environmental damage they cannot face the fundamental cause of the ecological crisis in the “grow-or-die” principle of capitalism (“green” firms need to make profits, accumulate capital and grow bigger), nor do they address the pernicious role of advertising or the lack of public control over production and investment under capitalism. Hence it is a totally inadequate solution.
As green Sharon Beder notes, green marketing aims at “increasing consumption, not reducing it. Many firms [seek] to capitalise on new markets created by rising environmental consciousness” with such trends prompting “a surge of advertisements and labels claiming environmental benefits. Green imagery was used to sell products, and caring for the environment became a marketing strategy” and was a “way of redirecting a willingness to spend less into a willingness to buy green products.” This means that firms can “expand their market share to include consumers that want green products. Since manufacturers still make environmentally damaging products and retailers still sell non-green products on shelves next to green ones, it is evident that green marketing is merely a way of expanding sales. If they were genuinely concerned to protect the environment they would replace the unsound products with sound ones, not just augment their existing lines.” Moreover, green marketing “does not necessarily mean green products, but false and misleading claims can be hard for consumers to detect” while the “most cynical marketers simply use environmental imagery to conjure up the impression that a product is good for the environment without making any real claims at all.” Ultimately, green consumerism “reduces people to consumers. Their power to influence society is reduced to their purchasing power.” It “does not deal with issues such as economic growth on a finite planet, the power of transnational corporations, and the way power is structured in our society.” [Global Spin, pp. 176–80]
Andrew Watson sums up green consumerism very eloquently as follows:
“green consumerism, which is largely a cynical attempt to maintain profit margins, does not challenge capital’s eco-cidal accumulation, but actually facilitates it by opening a new market. All products, no matter how ‘green’, cause some pollution, use some resources and energy, and cause some ecological disturbance. This would not matter in a society in which production was rationally planned, but in an exponentially expanding economy, production, however ‘green’, would eventually destroy the Earth’s environment. Ozone-friendly aerosols, for example, still use other harmful chemicals; create pollution in their manufacture, use and disposal; and use large amounts of resources and energy. Of course, up to now, the green pretensions of most companies have been exposed largely as presenting an acceptably green image, with little or no substance. The market is presented as the saviour of the environment. Environmental concern is commodified and transformed into ideological support for capitalism. Instead of raising awareness of the causes of the ecological crisis, green consumerism mystifies them. The solution is presented as an individual act rather than as the collective action of individuals struggling for social change. The corporations laugh all the way to the bank.” [From Green to Red, pp. 9–10]
“Ethical” consumerism, like “ethical” investment, is still based on profit making, the extraction of surplus value from others. This is hardly “ethical,” as it cannot challenge the inequality in exchange and power that lies at the heart of capitalism nor the authoritarian social relationships it creates. Therefore it cannot really undermine the ecologically destructive nature of capitalism.
In addition, since capitalism is a world system, companies can produce and sell their non-green and dangerous goods elsewhere. Many of the products and practices banned or boycotted in developed countries are sold and used in developing ones. For example, Agent Orange (used as to defoliate forests during the Vietnam War by the US) is used as an herbicide in the Third World, as is DDT. Agent Orange contains one of the most toxic compounds known to humanity and was responsible for thousands of deformed children in Vietnam. Ciba-Geigy continued to sell Enterovioform (a drug which caused blindness and paralysis in at least 10,000 Japanese users of it) in those countries that permitted it to do so. Many companies have moved to developing countries to escape the stricter pollution and labour laws in the developed countries.
Neither does green consumerism question why it should be the ruling elites within capitalism that decide what to produce and how to produce it. Since these elites are driven by profit considerations, if it is profitable to pollute, pollution will occur. Moreover, green consumerism does not challenge the (essential) capitalist principle of consumption for the sake of consumption, nor can it come to terms with the fact that “demand” is created, to a large degree, by “suppliers,” specifically by advertising agencies that use a host of techniques to manipulate public tastes, as well as using their financial clout to ensure that “negative” (i.e. truthful) stories about companies’ environmental records do not surface in the mainstream media.
Because ethical consumerism is based wholly on market solutions to the ecological crisis, it is incapable even of recognising a key root cause of that crisis, namely the atomising nature of capitalism and the social relationships it creates. Atomised individuals (“soloists”) cannot change the world, and “voting” on the market hardly reduces their atomisation. As Murray Bookchin argues, ”[t]ragically, these millions [of “soloists”] have surrendered their social power, indeed, their very personalities, to politicians and bureaucrats who live in a nexus of obedience and command in which they are normally expected to play subordinate roles. Yet this is precisely the immediate cause of the ecological crisis of our time — a cause that has its historic roots in the market society that engulfs us.” [Toward an Ecological Society, p. 81] This means that fighting ecological destruction today must be a social movement rather than one of individual consumption decisions or personalistic transformation. These can go on without questioning the ecocidal drive of capitalism which “will insidiously simplify the biosphere (making due allowances for ‘wilderness’ reserves and theme parks), steadily reduce the organic to the inorganic and the complex to the simple, and convert soil into sand — all at the expense of the biosphere’s integrity and viability. The state will still be an ever-present means for keeping oppressed people at bay and will ‘manage’ whatever crises emerge as best it can. Ultimately, society will tend to become more and more authoritarian, public life will atrophy.” [Bookchin, “The Future of the Ecology Movement,” pp. 1–20, Which Way for the Ecology Movement?, p. 14]
All this is not to suggest that individual decisions on what to consume are irrelevant, far from it. Nor are consumer boycotts a waste of time. If organised into mass movements and linked to workplace struggle they can be very effective. It is simply to point out that individual actions, important as they are, are no solution to social problems. Thus Bookchin:
“The fact is that we are confronted by a thoroughly irrational social system, not simply by predatory individuals who can be won over to ecological ideas by moral arguments, psychotherapy, or even the challenges of a troubled public to their products and behaviour … One can only commend the individuals who by virtue of their consumption habits, recycling activities. and appeals for a new sensibility undertake public activities to stop ecological degradation. Each surely does his or her part. But it will require a much greater effort — and organised, clearly conscious, and forward-looking political movement — to meet the basic challenges posed by our aggressively anti-ecological society. “Yes, we as individuals should change our lifestyles as much as possible, but it is the utmost short-sightedness to believe that that is all or even primarily what we have to do. We need to restructure the entire society, even as we engage in lifestyle changes and single-issue struggles against pollution, nuclear power plants, the excessive use of fossil fuels, the destruction of soil, and so forth. We must have a coherent analysis of the deep-seated hierarchical relationships and systems of domination, as well as class relationships and economic exploitation, that degrade people as well as the environment.” [“The Ecological Crisis, Socialism, and the need to remake society,” pp. 1–10, Society and Nature, vol. 2, no. 3, p. 4]
Using the capitalist market to combat the effects produced by that same market is no alternative. Until capitalism and the state are dismantled, solutions like ethical consumerism will be about as effective as fighting a forest fire with a water pistol. Such solutions are doomed to failure because they promote individual responses to social problems, problems that by their very nature require collective action, and deal only with the symptoms, rather than focusing on the cause of the problem in the first place. Real change comes from collective struggle, not individual decisions within the market place which cannot combat the cancerous growth principle of the capitalist economy. As such, ethical consumerism does not break from the logic of capitalism and so is doomed to failure.

Apple has been fined €1.8bn (£1.5bn) by the EU for breaking competition laws over music streaming.
The firm had prevented streaming services from informing users of payment options outside the Apple app store, the European Commission said.
Competition commissioner Margrethe Vestager said Apple abused its dominant position in the market for a decade.
She ordered the US tech giant to remove all the restrictions. Apple has said it will appeal against the decision.
The European Commission's decision was triggered by a complaint by Swedish music streaming service Spotify, which was unhappy about the restriction and Apple's 30% fee..
Ms Vestager said Apple had restricted "developers from informing consumers about alternative, cheaper music services available outside of the Apple ecosystem".
"This is illegal under EU antitrust rules," she said.
However, Apple said it would appeal, adding there was no evidence consumers had been harmed.
"The decision was reached despite the Commission's failure to uncover any credible evidence of consumer harm, and ignores the realities of a market that is thriving, competitive, and growing fast," the company said in a statement.
"The primary advocate for this decision, and the biggest beneficiary, is Spotify, a company based in Stockholm, Sweden.
"Spotify has the largest music streaming app in the world, and has met with the EC [European Commission] more than 65 times during this investigation," it said.
Spotify attacks Apple's 'outrageous' 27% commission
Spotify called the fine handed out to Apple "an important moment" and said it sent "a powerful message" that "no company, not even a monopoly like Apple, can wield power abusively to control how other companies interact with their customers".
Apple said the Swedish company pays no commission to them as it sells its subscriptions on its website and not on the app store.
Spotify had argued that the restrictions benefit Apple's rival music streaming service, Apple Music.
Digital Markets Act
In January, Apple announced plans to allow EU customers to download apps outside of their own app store, as the introduction of the Digital Markets Act (DMA) drew closer.
The aim of the European Union's DMA is to help competition in the technology sector and to try to break down the stronghold the likes of Apple and Google have on the market.
The tech companies were given six months from August last year to comply with a full list of requirements under the new legislation, or face a fine of up to 10% of their annual turnover.
The firms have until later this week to comply with a raft of changes announced since the start of the year, as Apple, Meta and TikTok pursue challenges to aspects of the law.
Law professor at EDHEC, Anne Witt, told the BBC the DMA will have a "significant impact" on the way designated platforms operate within the EU.
"It is a more effective but also much blunter legal tool in the fight against market concentration in the digital economy," she said.
Last week, Spotify and 33 other companies operating across a wide range of digital sectors wrote to the European Commission with a renewed attack on Apple's "lack of compliance" with the DMA.
"Apple's new terms not only disregard both the spirit and letter of the law, but if left unchanged, make a mockery of the DMA and the considerable efforts by the European Commission and EU institutions to make digital markets competitive," it said.

Lobbyists for cable companies and advertisers yesterday expressed their displeasure with a proposed “click-to-cancel” regulation that aims to make it easier for consumers to cancel services.
Federal Trade Commission chair Lina Khan has said that changes are needed because “some businesses too often trick consumers into paying for subscriptions they no longer want or didn't sign up for in the first place.” The FTC proposed the new set of rules in March 2023, and comments from industry groups were taken this week in a hearing presided over by an administrative law judge.
NCTA – The Internet & Television Association, the primary trade group for cable companies like Comcast and Charter, said the rule would make it harder to offer deals to customers who are trying to cancel.
“The proposed simple click-to-cancel mechanism may not be so simple when such practices are involved. A consumer may easily misunderstand the consequences of canceling, and it may be imperative that they learn about better options,” NCTA CEO Michael Powell said at the hearing. For example, a customer “may face difficulty and unintended consequences if they want to cancel only one service in the package,” as “canceling part of a discounted bundle may increase the price for remaining services.”
Powell said that cable company reps can usually talk customers out of canceling. “Out of millions of cancellations, complaints received by NCTA members amount to only a tiny fraction of 1 percent,” he said. “Three out of four of the cable and broadband customers who called to cancel end up retaining some or all service after speaking with an agent.”
Powell worries that retaining customers will become tougher because, he said, the FTC “proposal prevents almost any communication without first obtaining a consumer's unambiguous, affirmative consent. That could disrupt the continuity of important services, choke off helpful information, and forgo potential savings. It certainly raises First Amendment issues.”
Powell also said the cost of complying—including retraining employees and maintaining records for longer than current practice—could force cable companies to raise prices. He claimed that the FTC's estimate of compliance costs is too low.
FTC: Sellers Must Take “No” for an Answer
The FTC said one of its proposed rules “would require businesses to make it at least as easy to cancel a subscription as it was to start it. For example, if you can sign up online, you must be able to cancel on the same website, in the same number of steps.”
Sellers would also have to obtain customer consent before they “pitch additional offers or modifications when a consumer tries to cancel their enrollment,” the FTC said. Before making those pitches, sellers would have to “ask consumers whether they want to hear them. In other words, a seller must take ‘no’ for an answer, and upon hearing ‘no’ must immediately implement the cancellation process.”
The FTC also proposes that sellers be required to “provide an annual reminder to consumers enrolled in negative option programs involving anything other than physical goods, before they are automatically renewed.”
At yesterday's hearing, the FTC also heard from the Interactive Advertising Bureau (IAB), a lobby group for the online advertising industry. “The proposed rule would disrupt the current regime by adding specific requirements dictating what auto-renewal disclosures must say and how they must be presented,” said Lartease Tiffith, the IAB's executive VP for public policy.
Tiffith argued that the rule will burden businesses “and restrict innovation without any corresponding benefit. And as the technology develops, these prescriptive requirements will constrain companies from being able to adapt their offerings to the needs of their customers.”
Tiffith defended auto-renewals generally, saying the practice of automatically renewing services brings “significant benefits to both businesses and consumers in the form of cost savings, convenience, and heightened value.”
Cable Lobby Complains About Cost
Powell claims that complying with the rules would require “rebuilding” cable company systems and that the cost “could easily exceed $100 million for initial implementation by our industry alone.” These costs “would likely lead to higher prices for consumers,” he said.
An FTC Notice of Proposed Rulemaking offered a much different take on the costs, estimating that the “annual labor cost for disclosures for all entities is $4,695,800.” That's based on “an estimated hourly wage rate for sales personnel of $22.15” and an “estimate of 212,000 hours for compliance with the Rule's disclosure requirements.”
The FTC said that non-labor costs for complying with record-keeping and disclosure rules, “such as equipment and office supplies, would be costs borne by sellers in the normal course of business.”
Powell argued that the proposal shouldn't be applied to the cable industry. “The ominously labeled ‘negative option’ feature is merely a plan that continues until the customer cancels,” Powell said. "Most such plans present few concerns … In many industries like ours, automatic renewals are the only model that makes any sense. Consumers expect their internet service to flow reliably and without interruption."
The cable lobbyist contended that consumers are happy with cable company cancellation practices, and that adding the rules to “established processes that are well understood by subscribers will create more confusion, not less.”
“Tens of millions of consumers use our services. They know they are paying for continuing service … and they know how to cancel, rarely complaining about the process,” he said. “The FTC's highly prescriptive proposal requiring numerous disclosures, multiple consents, and specific cancellation mechanisms is a particularly poor fit for our industry.”
Referring to the requirement to obtain consent before offering new deals to customers who are trying to cancel service, Powell said that “placing speed bumps on conversations between consumers and providers will deny them a rightful chance at a better deal and providers a fair opportunity to retain a good customer.”

Taylor Swift’s attorneys have threatened legal action against a Florida college student who runs social media accounts tracking the flights of her and other celebrities’ private jets.
Jack Sweeney, a junior at the University of Central Florida, has for years run accounts that log the takeoffs and landings of planes and helicopters owned by hundreds of billionaires, politicians, Russian oligarchs and other public figures, along with estimates of their planet-warming emissions. The accounts use publicly available data from the Federal Aviation Administration and volunteer hobbyists who can track the aircraft via the signals they broadcast.
Sweeney’s accounts fueled a free-speech debate in late 2022 when X, formerly Twitter, banned Sweeney for sharing what the platform’s owner, Elon Musk, said were his “assassination coordinates.” The accounts don’t say who travels on the aircraft or where they go once the planes land.
In December, Swift’s attorney at the Washington law firm Venable wrote Sweeney a cease-and-desist letter saying Swift would “have no choice but to pursue any and all legal remedies” if he did not stop his “stalking and harassing behavior.”
Sweeney’s accounts had caused Swift and her family “direct and irreparable harm, as well as emotional and physical distress,” and had heightened her “constant state of fear for her personal safety,” the lawyer, Katie Wright Morrone, wrote, according to a copy of the letter sent to the home of Sweeney’s parents. Sweeney shared the letter with The Washington Post.
“While this may be a game to you, or an avenue that you hope will earn you wealth or fame, it is a life-or-death matter for our Client,” Morrone wrote. She added that there is “no legitimate interest in or public need for this information, other than to stalk, harass, and exert dominion and control.”
The pop star has routinely faced stalkers showing up outside her homes, Morrone wrote, and one man now faces stalking and harassment charges after being arrested last month outside her townhouse in Manhattan.
Asked whether Swift’s representatives knew of any evidence that stalkers had used the jet-tracking accounts, Tree Paine, a spokeswoman for Swift, said, “We cannot comment on any ongoing police investigation but can confirm the timing of stalkers suggests a connection. His posts tell you exactly when and where she would be.”
Sweeney, 21, told The Post he saw the letter as an attempt to scare him away from sharing public data. The accounts offer only an incomplete sketch of which cities Swift might currently be in, similar to the public schedules for her concerts or any NFL games she might attend, he said. And the letters, he added, were sent to him at a time when she faced criticism over her flights’ environmental impact.
“This information is already out there,” he said. “Her team thinks they can control the world.”
Private-jet flights are routinely criticized for their “disproportionately high” impact on climate change, and Sweeney’s accounts have often been used to name and shame their most famous passengers. In 2022, the accounts were cited in an analysis that estimated Swift was the “biggest celebrity [carbon dioxide] polluter” of the year.
Her publicist told The Post then that the analysis was flawed because her jet was often loaned out to other people. Paine told The Post on Monday that Swift bought more than double the “carbon credits” needed to offset her travel before her recent tour kicked off.
Around the time of the December letter, Facebook and Instagram disabled the accounts Sweeney had created to track Swift’s air travel, saying they broke the platforms’ privacy rules, he said. He began posting those updates onto accounts on Facebook and Instagram that he uses to log the travel of planes used by a range of stars, called Celeb Jets. Then, last month, Morrone sent a second letter saying his posts about Swift’s aircraft constituted “harassing conduct.”
The letters included the names of three other Venable attorneys experienced in litigation, including one who says on LinkedIn that she is the founding member of the firm’s “Digital Crisis Planning & Response client solution” and helps “high-profile individuals” manage crises of varying magnitude, such as “celebrity disgrace events.”
Morrone did not respond to requests for comment. Meta, which owns Facebook and Instagram, also did not respond.
Planes in the sky regularly broadcast their locations via transponders so air traffic controllers and other pilots can see where they’re going. Anyone on the ground can pick up those signals using a cheap device, known as an ADS-B receiver, that is widely sold online.
The FAA allows plane owners to request their flights be hidden in the federal data that undergirds popular consumer flight-tracking websites, such as FlightAware. Swift’s jet appears to be blocked through such a request.
But many aviation hobbyists feed their raw data into independent websites, such as ADS-B Exchange, that those FAA requests do not cover. Criminal investigators, journalists and researchers have used those sites to look up historical flight paths or see who’s flying overhead.
Swift, Time magazine’s 2023 “person of the year,” made history Sunday as the only musician to win four best-album Grammy Awards, and her every movement is closely watched by paparazzi and superfans. Her “Eras Tour” last year was credited with boosting the local economies of every city she stopped in; one study cited by The Post estimated that “Swifties” spent about $93 million per show.
Her travel plans have drawn increased attention in recent weeks as she’s flown to watch her boyfriend, Travis Kelce, play for the Kansas City Chiefs, including from conservatives who have seized on the trips to criticize her.
They have also become a key point of interest for her fans, especially because her upcoming concert in Tokyo is just hours before Kelce’s scheduled Super Bowl appearance on Sunday in Las Vegas. Even Japan’s embassy in Washington recognized the public’s interest, posting on X last week, “Despite the 12-hour flight and 17-hour time difference, the Embassy can confidently Speak Now to say that … she should comfortably arrive” on time.
Sweeney’s accounts have in recent months tracked two jets that were owned by Nashville-based companies and registered to be operated by a Swift company called Firefly Entertainment, according to FAA documents. They do not track who travels on the planes or any other chartered flights.
Swift’s spokeswoman told The Post that “there is only one plane.” One of the planes previously tracked by Sweeney’s accounts, a Dassault Falcon 900, was marked in FAA records last week as being transferred to a real estate company. Each jet sells for about $25 million, according to brokerage estimates cited last month by The Post.
After X banned him and his accounts in December 2022, Sweeney opened new Facebook and Instagram accounts for Swift, former president Donald Trump, Amazon founder Jeff Bezos, reality star Kim Kardashian and Meta chief Mark Zuckerberg, among others. All of those accounts except for Swift’s remain online — including the accounts for Zuckerberg, who runs both sites. (Bezos owns The Washington Post.)
Sweeney continues to post Swift jet updates to other platforms, including Bluesky, Mastodon and Telegram. To abide by X’s rule against real-time location tracking, he also created accounts that post Musk and Swift’s flight updates with a 24-hour delay.
The December letter from Swift’s attorney states that Sweeney’s actions are “in violation of several state laws” but does not specify them. The letter does, however, cite nine anonymous Instagram comments saying the account is “scary,” “pathetic,” “weird,” invasive” and “dangerous” “stalker behavior.”
The letter says Sweeney is “notorious for disregarding the personal safety of others in exchange for public attention and/or requests for financial gain” and cites a message he sent to Musk in 2021, during which he countered Musk’s $5,000 offer to delete the Musk-jet account with a suggestion of $50,000, as first reported by the now-defunct tech blog Protocol. Sweeney said no money was ever exchanged.
After receiving the letters, Sweeney said he asked for help from the Electronic Frontier Foundation, a digital rights group, which sent his request to a list of attorneys. James Slater, a Florida lawyer who specializes in First Amendment and internet speech issues, responded on Sweeney’s behalf to the Venable letter.
Slater wrote that Morrone had not identified any legal claim, that the jet information posed “no threat” to Swift’s safety, and that Sweeney’s account had “engaged in protected speech that does not violate any of Ms. Swift’s legal rights,” according to a copy reviewed by The Post. Slater said he has yet to receive a response.
In an interview, Slater said he thought the Swift attorney’s letters were “hyperbolic and unfounded” and sent in hopes that Sweeney would “just delete everything and do what they said.”
“This isn’t about putting a GPS tracker on someone and invading their privacy. It’s using public information to track the jet of a public figure,” he said. “This is their means to try to quash a PR issue and bully my client to have the bad coverage die down.”
