BILL HR 21: BORN-ALIVE ABORTION SURVIVORS PROTECTION ACT
BILL HR 21: Born-Alive Abortion Survivors Protection Act is a bill introduced in the U.S. House of Representatives on January 3rd, 2025 that's primary objective is to ensure that any infant born alive following an attempted abortion receives the same level of medical care as any other newborn at the same gestational age.
Provisions Include:
Standard of Care: Healthcare practitioners present during birth are required to exercise the same degree of care as they would for any other child born at the same gestational age. This includes immediate admission to a hospital.
Mandatory Reporting: A healthcare practitioner or employee that is aware of a failure to provide required care must report this to law enforcement authorities promptly.
Penalties for Non-Compliance: Those who do not provide the mandated care or do not report failure of care, can face criminal penalties including fines and up to five years in prison. Additionally, intentionally ending the life of a born-alive infant is classified as murder.
Legal Protections For Mothers: The bill explicitly states that mothers of infants born alive will not face prosecution. they will also be granted the right to pursue civil action against the healthcare practitioners who violate the provisions.
The problem is that there are already laws in place to protect newborns, like Born-Alive Infants Protection Act of 2002. As well as other federal and state statutes already in place to protect infants. Regardless of the circumstance of their birth.
This bill also perpetuates the misconception that abortions frequently result in live births. These cases are exceedingly rare and usually occur in the context of severe medical complications or non-viable pregnancies. Medical experts explained that these decisions made in these rare cases are made with compassion and involve the family.
The requirements for immediate hospitalization as well as mandatory reporting will interfere with medical judgement. Especially in cases where an infant is born alive but with no chance of survival. There is concern that healthcare providers may feel obligated to perform invasive and/or painful procedures on non-viable infants, which will only prolong suffering of the infant rather than providing it humane care.
The criminalization of medical decisions is an extreme concern as well. These could deter those wishing to go into reproductive healthcare from doing so, simply out of fear of legal repercussions. And for those in reproductive healthcare, it may even discourage them from making complex decisions.
This bill is less about protecting infants, and more about advancing a broader anti-abortion agenda. It has the ability to be used as a means to vilify abortion providers and undermine reproductive rights. This is made clear by the bills lack of emphasis on prenatal care, healthcare for children, or support for families that are facing complex medical decisions.

It is unnecessary - infants born alive are already protected under existing laws, such as the Born-Alive Infants Protection Act of 2002.
It Misrepresents the realities of abortion care and could create undue burdens on healthcare providers, interfering with their medical judgement. These decisions being made too late could result in mistake making that could result in the end of life for the mother and the child.
It criminalizes complex medical decisions, which could discourage healthcare professionals from providing compassionate, patient-centered care.
It politicizes reproductive healthcare rather than addressing broader systemic issues like access to prenatal and pediatric care."

hr 3205 is a proposed bill to classify fentanyl as a chemical weapon. this classification is a fearmongering tactic to get more resources out of mexico. and it’s bullshit. fentanyl is a public health issue, not a military issue. it is not a chemical weapon, it is a drug.
a two-minute phone call can make a difference. “hello, my name is [name] and i am a constituent in [town], [state]. i am calling to say that i do not support hr 3205, and i urge [representative] to say no to hr 3205. i do not need a response. thank you for your time.”
this bill is a stepping stone to worse things. it legitimizes the right’s claims that mexican cartels are targeting america to destabilize democracy (no i am not joking. it’s in the bill.) and further established the ludicrous idea that we have the right to bomb other countries- especially over, again, a public health issue.
as the wola article says, the president can choose to authorize missile strikes on chemical weapon factories without congressional approval.
it may not be comfortable to call. but this is important. it paves the way for worse things. it may be anxiety-inducing. but being bombed is worse than anxiety-inducing.
please make a 2-minute call and help stop this classification. thanks
