A Tale of Two Judges

In federal court in Florida today a judge struck down a Florida law banning gender affirming care for minors as well as rules from the state's medical authority that set up barriers to trans adults seeking care

At the same time a federal court in Texas blocked guidance from the Biden Administration's Department of Education that Title IX should be understood as protecting trans students

And I think this is a great illustration that elections last LONG after they're finished, one judge blasted Florida's law as unconstitutional and quoted Dr. King in framing trans rights as the same as the struggle for racial equality and called on the courts to support them. The other gleefully sided with Republicans with Texas AG Ken Paxton declaring "“Joe Biden’s unlawful effort to weaponize Title IX for his extremist agenda has been stopped in its tracks"

The Judge in Florida was Senior Judge Robert Hinkle, he was appointed by President Bill Clinton in 1996, Hinkle took the semi-retirement known as senior status in 2016, but still hears cases as he did here. Hinkle also ruled in 2014 that Florida's ban on same-sex marriage was unconstitutional.

The Judge in Texas is Judge Reed O'Connor, He was appointed by President George W. Bush in 2007. O'Connor is very active in the conservative Federalist Society, Conservative Lawyers and Texas Attorneys General try to file their insane, legally nonsense, show boat cases in his court because if they get him he'll rule for the Republican side and against the Democratic side no matter what. In 2016 he blocked Obama Admin rules that declared Title IX meant trans students should be allowed to use the bathroom of their choice. While the Obama team appealed, once Trump was elected the rule was pulled and the case died.... hm. O'Connor is best known as that crazy man who ruled the Affordable Care Act unconstitutional in 2018, he was reversed, he ruled the Indian Child Welfare Act was unconstitutional, he ruled in 2022 the US Navy couldn't require Navy SEALS get Covid vaccines.

all to say when you get into a voting booth remember one of the things you vote for is Judges, who have a huge amount of power, and you can either get cool progressive minded judges who will still be making ground breaking rulings to protect civil rights 28 years after being nominated, or you can get conservative hacks who rule whatever wing nut thing they see on Fox 18 years after being nominated. During his Presidency Trump got to nominate 234 federal judges (Biden is currently at 201) including 3 Supreme Court Justices (Biden has 1) And those judges will be with us for years not like 10 years, or even 20, or even 30, no no no, Judge Albert Branson Maris was nominated by FDR in 1936 and served till his death at age 95 in 1989, JFK's last nominee, William Joseph Nealon Jr., passed away still hearing cases at the age of 95 in 2018 (the second to last passed away the year before in 2017) LBJ's last judge, Jack B. Weinstein, only passed away in 2021, there are at least 7 Nixon judges still hearing cases, 50 years after Nixon Resigned from office in 1974. We will be dealing with Trump's Judges for 40-50 maybe more years. So keep that in mind when you vote.

My dear Dr. Egleston:

Please excuse my delay in replying to your letter which has been forwarded to me down here in your neighboring state where I am spending a few weeks swimming and getting sunlight for my legs.

I am very glad to tell you what I can in regard to my case and as I have talked it over with a great many doctors can, I think, give you a history of the case which would be equal to theirs.

First symptoms of the illness appeared in August, 1921, when I was thoroughly tired from overwork. I first had a chill in the evening which lasted practically all night. The following morning the muscles of the right knee appeared weak and by afternoon I was unable to support my weight on my right leg. That evening the left knee began to weaken also and by the following morning I was unable to stand up. This was accompanied by a continuing temperature of about 102 and I felt thoroughly achy all over. By the end of the third day practically all muscles from the chest down were involved. Above the chest the only symptom was a weakening of the two large thumb muscles making it impossible to write. There was no special pain along the spine and no rigidity of the neck.

For the following two weeks I had to be catheterized and there was slight, though not severe, difficult in controlling the bowels. The fever lasted for only 6 or 7 days, but all the muscles from the hips down were extremely sensitive to the touch and I had to have the knees supported by pillows. This condition of extreme discomfort lasted about three weeks. I was then moved to a New York hospital and finally moved home in November, being able by that time to sit up in a wheel chair, but the leg muscles remained extremely sensitive and this sensitiviness [sic] disappeared gradually over a period of 6 months, the last remaining point being the calf muscles.

As to treatment--the mistake was made for the first 10 days of giving my feet and lower legs rather heavy massage. This was stopped by Dr. Lovett of Boston who was, without doubt, the greatest specialist on infantile paralysis. In January, 1922, 5 months after the attack he found that the muscles behind the knees had contracted and that there was a tendency to foot-drop in the right foot. These were corrected by the use of plaster casts during 2 weeks. In February, 1922, braces were fitted on each leg from the hips to the shoes and I was able to stand up and learned gradually to walk with crutches. At the same time gentle exercises were begun, first every other day, then daily, exercising each muscle 10 times and seeking to avoid any undue strain by giving each muscle the correct movement with gravity. These exercises I did on a board placed on the bed.

My DCU - A Gender-Swapped World (Earth 11)

Canonically, the DC Multiverse contains a universe where all the characters have their genders swapped. Like, Instead of Superman, Batman, and Wonder Woman, they have Superwoman, Batwoman, and Wonder Man.

But to me it always raised the question - how does this world work actually?

Like, is it just 100% everyone is gender flipped and everything is exactly the same, except with the patriarchy replaced with a matriarchy?

Does Cat Grant (M) still cover the social pages for the Daily Planet? Or does he cover sports, and Steve Lombard (F) do the social pages?

Or like... who is President in 2024?

Is it Joelina Biden, and first spouse is Dr. Jim Biden?

Or is Dr. Jilly Biden (president), and Joe Biden is first spouse?

Most of the time, DC uses fake presidents as stands ins, so then, who was the first president of the United States in the Gender Swapped world? Was Abe Lincoln or FDR still president?

Every fictional character in Earth 11 is gender swapped. All the real world people, are their normal genders.

Who is president in 2024 on Earth-11? Joe Biden.

Heyyy guys this is my first post today im going to try to enter the void state with the lullaby method! I’ve been procrastinating for way too long and me,sister and my nephew are about get kicked out our home in 9 days !!! So I will be updating u guys on my progress !!! Day 1- I listened to some brown noise for 13 mins and laid down in a my regular position (on my side) started affirming not for the void state but that my sister had 10k dollars to pay for the late rent bcuz I felt like I needed to that so we can have stable housing then the void state comes along. i turned the brown noise off and tried to just fall asleep naturally and affirm I feel asleep and I affirmed but not I fall asleep anyways , I kept waking up and I just affirmed and affirmed then at 4 something am I got into sats I think and I said I am in the void state and I am I started feeling symptoms like tingling I can’t really explain it but instead I should’ve kept affirming the thing I was affirming before ( aka my sister has 10k dollars) but thats basically it I’ll keep update of any other resultss ❤️! one more thing I think I’m gonna stay awake until I get very drowsy like half asleep half awake or sats something like that .

Bayard Rustin, a man who is frequently considered to have been Dr. Martin Luther King Jr.’s “right-hand man”, is a civil rights activist who has been largely erased from the Black history taught in schools, and from the general population’s knowledge and perception of the Civil Rights Movement- but he was an integral part of the movement, and his erasure has largely to do with the fact that he was openly and unapologetically gay.

Bayard Rustin was born in 1912 in Pennsylvania, where he was raised by a Quaker family who very early on instilled in him the principles of nonviolence, which laid the foundation for his involvement with the civil rights movement. At a young age, he was interested in civil rights and racial justice, and at first, the racially progressive views of the Young Communist League attracted him to join. Eventually, their politics changed and he left the league.

In 1941, he turned his sights to socialism by joining the Fellowship of Reconciliation (FOR), who at the time advocated for equal rights for all people (except, as he would later find out, gay people). That same year, he met two other men who would be influential in his life- A.J Muste, the leader of the FOR, and Phillip A. Randolph. With these two men, he helped propose the March on Washington that convinced FDR to sign the executive order that allowed Black workers into the defense industry, and in 1944, Bayard Rustin was arrested as a “conscientious objector” because he refused to sign up for the draft for WWII, to which he was staunchly opposed. 

However, in 1953, Bayard was fired from his position in the FOR after being arrested and charged with “sex perversion” for having sex with another man. At the time, many people feared that open discussions of homosexuality would threaten the image and therefore ultimately the credibility and impact of the civil rights movement, so Bayard, along with many other Black queer people, were often targeted for their identities, either being forced to hide them or be careful with them, or having their identities completely used against them to disparage their credibility within the movement.

During the late 1940s, Bayard Rustin helped to co-found the Congress of Racial Equality, or CORE, which became one of the most central civil rights organizations in the civil rights movement. In 1947, he participated in FOR’s “Journey of Reconciliation” (discussed more in this post) which provided the blueprint for the Freedom Rides of the 1960s, which led to the illegalization of interstate bus segregation.

In 1956, Randolph, who had become Rustin’s mentor, urged him to meet with Dr. Martin Luther King Jr. amidst the Montgomery Bus Boycott. When Rustin agreed, he and several other key pacifists of the movement met with King and were instrumental in convincing him to more fully adopt nonviolence as a way of life. Bayard Rustin’s upbringing in nonviolence led to it being one of the cornerstones of the civil rights movement.

Over the next couple of years, Bayard became part of King’s “inner circle” of close associates within the civil rights movement. He held a key position in King’s organization, the Southern Christian Leadership Conference, which he had helped to found, and he was behind many efforts of integration. He helped to organize many key events, like the Prayer Pilgrimage for Freedom, and the Youth Marches for Integrated Schools. However, in 1960, he reluctantly agreed to step away from the SCLC and from Dr. King, because the Democratic Convention threatened to publish a rumor that King and Rustin were romantically and sexually involved, using Bayard’s orientation against him, if they followed through with a protest against the convention that they’d been planning. Bayard himself was very disappointed with the way King didn’t stand up for him, but he also acknowledged that it was probably best for the movement that he step away.

In the following years, he got involved outside of the scope of the SCLC. He did community organizing, and eventually, in 1963, he was reintegrated into King’s campaign through the Birmingham Campaign. It was then that he made his most notable and significant contribution to the Civil Rights Movement. He had strong organizational and strategic skills, and people who worked with him knew that there was no better man to re-energize the movement through a strategic march, than Rustin- and thus began the plan that brought to fruition Bayard’s previous plans of a march on Washington.

Many people involved were still against Bayard being involved- including John Lewis, a prominent member of the SNCC, and Roy Wilkins, a prominent chair of the NAACP. Their reservations were largely against both his sexuality and his previous communist affiliations, so it was agreed that instead, his mentor, Philip A. Randolph, would be elected to lead the march, so that he could then, in secret, choose his mentee, Bayard Rustin, to lead the march from behind the scenes.

So, within a time span of eight weeks, Bayard Rustin organized the infamous 1963 March on Washington. He spent those weeks incessantly writing letters and organizing with others. It was an extremely chaotic environment, but he was very focused and determined, and when the march happened, it singlehandedly re-energized the Civil Rights Movement and is remembered to this day as a monumental moment from the movement. From it, King’s famous “I Have A Dream” speech was born. Thanks to Rustin’s tireless efforts, the movement regained a lot of steam.

After that point in time, more people, including King himself, began to come out in support of Rustin, causing the accusations against him to lessen their effectiveness, although many within the movement were still against his involvement. For the rest of his life, Bayard Rustin remained a committed part of the Civil Rights Movement, and his contributions cannot be overstated. He was a proud gay Black man and he fought for his rights in the face of adversity from every angle.

Since Congress established the Courts of Appeals in 1891, and given subsequent statutory developments, most civil and criminal cases in the federal courts have been litigated in the familiar pattern of proceedings before a single district judge; followed by an appeal as of right to a regional Court of Appeals; and followed by a writ of certiorari to the Supreme Court, which has the discretion to grant or deny the petition. A notable exception to this pattern came in the wake of the Supreme Court’s then-controversial decision in 1908 in Ex parte Young, which recognized an exception to state sovereign immunity by permitting plaintiffs to bring constitutional challenges to state statutes in federal court by suing not the state, but the state official charged with enforcing the law. The decision was controversial because it enabled plaintiffs (a railroad in Ex parte Young) to more easily challenge Progressive Era regulatory laws in federal court, and empowered one federal district judge to enjoin the operation of a statewide law. Congress responded to Ex parte Young in 1910 by enacting legislation, which required such suits to be brought before a three-judge district court, with a direct appeal available to the Supreme Court. The statute required that the court consist of one district judge and at least one court of appeals judge, with the third judge being appointed by the Chief Judge of the circuit (typically, though not always, another district judge). Supporters of the statute thought three judges, rather than one, would bring greater thought to the important issue of the constitutionality of a state law, and the result would arouse less public controversy as compared to the decision of a single judge. The direct appeal provision would make it more probable that any appeal would be more rapidly resolved as contrasted to the usual appellate process. Constitutional challenges to federal statutes were added to the ambit of the three-judge district court in 1937. That legislation was a small part of the fabled and failed Court-packing plan proposed by President Franklin Roosevelt in that year. The plan was primarily a reaction to a majority of the Supreme Court holding New Deal legislation unconstitutional, but the President and his supporters in Congress were also concerned with the many suits in the district courts leading to no less than 1600 separate injunctions of legislation. They argued that constitutional challenges to federal statutes should be treated with “equal dignity” to that of state statutes,and largely tracking the rationale for the 1910 Act, the amendment was passed with relatively little fanfare in August of 1937, after the Court-packing plan had been rejected. ...

The impetus for the 1910 and 1937 legislation eventually faded, and Congress severely cut back the jurisdiction of the three-judge district court in 1976. In part, the reforms were a victim of their own success. By the 1960s and 1970s, hundreds of three-judge district courts were being convened each year, and scores of direct appeals were being lodged in the Supreme Court. Most of each were challenges to state statutes, with not coincidentally many related to the burgeoning Civil Rights era and attendant litigation. Influential figures and organizations in the legal community, not least of whom were Justices on the Court itself, came to conclude that the virtual flood of litigation was a burden on both district courts (given the time-consuming logistics of assembling three judges rather than one to decide a case at the trial level) and on the Supreme Court (given that the direct appeals were ostensibly mandatory and had to be decided on the merits). Moreover, many argued that the original perceived need for the three-judge district court process had largely faded, and that even controversial and important litigation could be handled appropriately by a single district judge with the normal appeal process. ... Despite the almost complete abolishment in 1976, the three-judge district court has enjoyed a robust afterlife. Left standing was a separate such court established by the 1965 Voting Rights Act, to decide declaratory judgment actions regarding whether certain States and political subdivisions were, in making changes to election laws, subject to preclearance by the Department of Justice. Since the 1976 repeal, several federal statutes have been passed in the past several decades with judicial review provisions for that particular law, mandating that any constitutional challenges thereto are litigated before a three-judge district court, with a direct appeal to the Supreme Court.

Features Ruth Montgomery, who was once a Washington D.C. press reporter who was invited to cover, among other events, FDR's funeral and Richard Nixon's tour of Russia; in 1969 she retired from journalism after a medium convinced her to try automatic writing and she started to believe she was psychic. A new age celebrity, she died in 2001.

This segment focused on Charlotte King, a woman who claims that after an overdose in the 70s she gained the ability to predict earthquakes with 70% accuracy. Strangely, people took her seriously enough for a scientist at the Library of Congress (???) to start "Project Migraine", tracking the accuracy of her predictions (Dr. Dodge claims that he makes her call them all in the second she makes them).

Charlotte King is still at it, but oddly enough if you look at her website now you won't find any mention of "soul exchange"; she's pivoted to the idea that she can hear the frequencies of faults and uses "biological earthquake detection" like watching the patterns of insects to make her predictions.

She ends the segment by noting, in April 1992, that she thinks "the Big One" will hit Southern California soon, which it obviously didn't...but a couple months after that the extremely powerful Landers earthquake hit, and massive damage was only avoided by dint of the quake hitting in a sparse region of the Mojave. What does it all mean?

Well, no one went broke predicting earthquakes in California, huh?

The end credits tease is for "television history" being made, and it really was: the second season of the Charles S. Dutton sitcom Roc was performed live, all twenty-five episodes, the first show to do that since the early days of television. This was because of a popular live episode in season 1; it's hyped up here as a "haha if it's live ANYTHING COULD HAPPEN!" thing, but another reason was that the core cast of Roc were all Broadway actors. I haven't seen it but by all accounts they were so good at acting live they never made mistakes, and the third and final season reverted to pre-taped episodes.

American greatness has been fueled and sustained by qualities of character that are timeless and sorely needed during these days of national crisis.  There should be no mistake about this being a moment of crisis or blindness about its cause, or who specifically is responsible.

The three greatest American presidents — Washington, Lincoln and Franklin Roosevelt — collectively created America, saved the Union, ended slavery, and saved the world from tyranny. Each man’s greatest achievements and service were fueled by their exceptional character and dedication to virtue.

Washington was a man of exceptional humility, who repeatedly walked away from power to set in motion a new epoch of history. He was an example of the restraint necessary to sustain a republic. His actions awed the world, as well as the people of our young nation. When he passed he was eulogized as first in war, first in peace and first in the hearts of his countrymen. 

Lincoln demonstrated iron strength, indomitability, fortitude and magnanimity. His second inaugural is the greatest speech in America’s secular canon. Its words are transcendent.

He makes clear that the cause of war was the moral catastrophe of slavery. His determination is absolute.

Fondly do we hope ~ fervently do we pray ~ that this mighty scourge of war may speedily pass away. Yet, if God wills that it continue until all the wealth piled by the bondsman's two hundred and fifty years of unrequited toil shall be sunk and until every drop of blood drawn with the lash shall be paid by another drawn with the sword as was said three thousand years ago so still it must be said 'the judgments of the Lord are true and righteous altogether.'

So is his grace and magnanimity:

With malice toward none with charity for all with firmness in the right as God gives us to see the right let us strive on to finish the work we are in to bind up the nation's wounds, to care for him who shall have borne the battle and for his widow and his orphan ~ to do all which may achieve and cherish a just and lasting peace among ourselves and with all nations.

Franklin Roosevelt had the gift of faith, and because of it, he possessed a bottomless wellspring of optimism. Because of it, he was fearless — and made his nation so. His last inaugural address was the shortest in history. It stood at 544 words, but remains remarkable nonetheless as a declaration of moral purpose around a national purpose. FDR was a man without doubt by the end. His faith was in us, and it was not misplaced then or now. Here is what he said:

Mr. Chief Justice, Mr. Vice President, my friends, you will understand and, I believe, agree with my wish that the form of this inauguration be simple and its words brief. We Americans of today, together with our allies, are passing through a period of supreme test. It is a test of our courage--of our resolve--of our wisdom--our essential democracy. If we meet that test--successfully and honorably--we shall perform a service of historic importance which men and women and children will honor throughout all time. As I stand here today, having taken the solemn oath of office in the presence of my fellow countrymen--in the presence of our God-- I know that it is America's purpose that we shall not fail. In the days and in the years that are to come we shall work for a just and honorable peace, a durable peace, as today we work and fight for total victory in war. We can and we will achieve such a peace. We shall strive for perfection. We shall not achieve it immediately--but we still shall strive. We may make mistakes--but they must never be mistakes which result from faintness of heart or abandonment of moral principle. I remember that my old schoolmaster, Dr. Peabody, said, in days that seemed to us then to be secure and untroubled: "Things in life will not always run smoothly. Sometimes we will be rising toward the heights--then all will seem to reverse itself and start downward. The great fact to remember is that the trend of civilization itself is forever upward; that a line drawn through the middle of the peaks and the valleys of the centuries always has an upward trend." Our Constitution of 1787 was not a perfect instrument; it is not perfect yet. But it provided a firm base upon which all manner of men, of all races and colors and creeds, could build our solid structure of democracy. And so today, in this year of war, 1945, we have learned lessons-- at a fearful cost--and we shall profit by them. We have learned that we cannot live alone, at peace; that our own well-being is dependent on the well-being of other nations far away. We have learned that we must live as men, not as ostriches, nor as dogs in the manger. We have learned to be citizens of the world, members of the human community. We have learned the simple truth, as Emerson said, that "The only way to have a friend is to be one." We can gain no lasting peace if we approach it with suspicion and mistrust or with fear. We can gain it only if we proceed with the understanding, the confidence, and the courage which flow from conviction. The Almighty God has blessed our land in many ways. He has given our people stout hearts and strong arms with which to strike mighty blows for freedom and truth. He has given to our country a faith which has become the hope of all peoples in an anguished world. So we pray to Him now for the vision to see our way clearly--to see the way that leads to a better life for ourselves and for all our fellow men--to the achievement of His will to peace on earth.

Eighty-two days later he was dead.

I do not wish to add an atom to the awful burden which you are bearing with magic, and, as I believe, heaven-inspired strength at this time. But you do know that the most overwhelming disaster of Jewish history has befallen Jews in the form of the Hitler mass-massacres. Hitler's decision was to exterminate the Jewish people in all Hitler-ruled lands, and it is indisputable that as many as two million civilian Jews have been slain.

I have had cables and underground advices for some months, telling of these things. I succeeded, together with the heads of other Jewish organizations, in keeping these out of the press and have been in constant communication with the State Department, particularly Under Secretary Welles. The State Department has now received what it believes to be confirmation of these unspeakable horrors and has approved of my giving the facts to the press. The organizations banded together in the Conference of which I am [handwritten parenthesis/bracket seen to left of following text in Image:] Chairman, feel that they wish to present to you a memorandum of this situation, so terrible that this day is being observed as a day of mourning and fasting throughout the Jewish world. I wanna read one of your president fics but I have like .5% knowledge about the US presidents so could you give me a rundown on the presidents in one of the fics I should read-? Also why do you know so much. Are you planning on becoming a history major-

the chatfic is basically all of them so i cant run down ALL of them, but basically fuck LBJ, fuck reagan, fuck jefferson, fuck FDR, fuck like... a hella ton of those mfs. stan bobby kennedy and jack kennedy. for the linken fic, JFK was obviously the the 35th president. He was involved in the Space Race between the USA and the Soviet Union for like, basically who can get in space faster. His Presidency carried most of the Cold War and he actually started to draw back soldiers from Vietnam and TRIED to repair this stupid ass government, but LBJ said 'fuck that' and put the soldiers back. His soldiers were... uh... well... cant explain but illegally horrible.

Lincoln, 16th President, Civil War. Was Republican which I know sounds hella unusual but back then, parties were basically switched. Hell, Jackson, one of the worst who did the Trail of Tears which took Native Americans' land and forced them off of it, created the Democratic Party. His Presidency was mostly on the Civil War but of course the Emancipation Proclamation came through. The War was originally states rights but became slavery real quick. States--mostly the South, which made up the Confederacy--receded from the start and boom it started. Once it was over they began to come back. Bro got shot ofc as you know. Was hella sad and depressed and had mommy issues + abandonment issues + was probably bisexual.

JFK probably was too, and there's a BUNCH of weird coincidences between them, so that's why LinKen exists. One of the best nicknames i've seen for them is Headshot Homos. He had chronic illness + his back was always in pain and he had to take a shit ton of pills for it. He may've been SA'd as a kid too, which leads into the hypersexual activity, and that leads to the cheating.

SO TL;DR: you dont need to know just about anything to read the fics. I barely go for historical accuracy. For the notes, it's usually at the end where I add in any fun history facts, most of which are on TR because... well. They are. The chatfic and some references may not make sense if you don't know some stuff, but the comments--the 100+ there are, or 200+ i dont remember--have a bunch of facts in them by some super cool ass readers/friends. There's two other chatfics made inspired by mine, and the one by JFKMyBeloved has a bunch of facts in I believe both chapters notes. The other is hella accurate probably too.

Overall you can go in and see them as original characters and you're good. I'll explore the trauma as I have in chapter 11 throughout. And as I said any TR shit WILL be explained because I can't stop including that mf in EVERYTHING 💀💀

and tbh it just started as a hamilton phase, became more, and soon i was reading a fuck ton of books. i guess my brain decided TR would be my ONE president that I care the most about. 2000+ pages have been put into learning about this mf and HOURS of documentaries and reading his letters to his kids (it's in a book, A Bully Father, 10/10 with some spelling mistakes though). So I can barely tell you about the others but I WILL tell you abt TR ahsjdkfghnm
