THE ROLE OF LAWYERS IN MEDIATION: WHAT DOES THE FUTURE HOLD?
An alternative dispute resolution method is mediation. It is normally the parties involved in a dispute in court who are involved in a mediation. Ultimately, referring them to mediation will result in a peaceful resolution without judicial intervention. There is often a question about lawyers’ role in mediation, as well as the future of the field. Understand how lawyers play a role in mediation as well as how they protect the interests of parties.
Lawyers may opt for Alternative Dispute Resolution as a fashion trend, but what will they do with it? Is there a role for lawyers in alternative family dispute resolution? It is still crucial for practising lawyers in India to play the role of advocates in settlements outside the court, since convincing the court is not the only task they have. In the case of mediation counsel, they must assist their clients since even statutory provisions follow the black letter of law. A law cannot compromise anything unless it is permitted to do so. The role of lawyers in mediation is often misunderstood by people ignorant of these black letters. Explore the future of mediation and lawyers’ role in it.
What is mediation?
The key to succeeding as an advocate in out-of-court settlements in India is to understand mediation processes. Court litigation is the traditional mode of dispute resolution in India. As a result, the road to justice has been slowed down tremendously in recent years due to overburden in this mode. Through Section 89 of the Code of Civil Procedure, courts promote Alternative Dispute Resolution as a means of resolving disputes. The result is the encouragement of settlements outside of court. Alternate methods, usually mediation, are suggested during litigation if they are permitted by the facts. Through mediation, parties can resolve their disputes with the help of a mediator. Mediation can save both parties’ interests if it suggests a middle ground.

Where there is the possibility of an amicable settlement in a family matter, the courts usually refer the parties to mediation. Lawyers who specialize in family law are more familiar with mediation’s typical outcomes. Family partition disputes, divorces, child custody disputes, etc., are usually dealt with this method. Mediators typically represent people from the same family, either by blood, marriage, or adoption. Mediation provides a forum for parties to resolve disputes and offers appropriate solutions to those disputes by providing a neutral agent, i.e. a mediator.
Can my lawyer represent me in mediation?
It appears that mediation statutes do not specifically restrict counsel’s role in mediation. Some people are intimidated by mediation, and they ask questions like, “Can my lawyer attend the mediation?” And how does the lawyer participate in it?As far as the former question is concerned, there is no specific prohibition on lawyers participating in mediation. Nevertheless, the mediator may not allow parties to meet privately and individually during mediation if they are meeting privately or individually. Below you will find a detailed explanation of the role lawyers play in mediation.
What do mediation lawyers do?
Advocates are often assumed to play no role in outside court settlements. Law is often written in black letters, making it difficult for laymen to understand. They are, however, responsible for governing the ADR process. Mediation lawyers have a strong understanding of both mediation and the laws applicable to mediation. It is counsel’s responsibility to assist their clients in mediation and to explain the legal implications of their statements.

The Role of Lawyers in Mediation — What Does the Future Hold?
Alternative Dispute Resolution is often viewed by the legal profession as threatening the ‘Right to Livelihood’. Mediation lawyers’ responsibilities are clearly illustrated by what has been discussed above. Therefore, lawyers play an important role in mediation. If things do not settle in mediation and the parties turn back to litigation in courts, counsel’s role in mediation is beneficial later on.

Ficmas Day 11: Feral Jasper/Mary-Alice
Good evening ducklings! I've come down with a spectacular flu, so more notes tomorrow. I got a bunch of different requests for today, so I picked one at random and it was Feral Jasper/Mary-Alice.
But all the suggestions were fun and excellent, so I will be doing a few more snippet posts in January to get them all in <3
Anyway, it's time I got some sleep so I hope you enjoy this part!
As with most things, the time comes for the Cullens to move on. It’s been five years since they arrived in Pennsylvania, and anything longer will invite gossip about the young doctor and his family living in that big old house outside town. They already draw enough attention as it is.
So it’s time to go. Carlisle and Esme decide that privately, out of earshot of the others, before they make the announcement. It’s going to be more difficult this time, because it’s Jasper’s first move. This is the only home that he’s known since they found him, and leaving it will be a strain. They’ve watched him since he arrived here become stronger and more certain in his place amongst them. And this place, this house and the looming forest, played an important role in that. They only have so many properties with grounds this size, that are appropriate for a vampire to roam privately and safely.
But vampires are traditionally nomadic, and just because the scenery and set changes, doesn’t mean anything else will. Esme is convinced she can make Jasper understand that this is necessary and a good thing. Montana will be wonderful; the hunting there is good, and even though they don’t technically own a large parcel of land there, they have a great deal of privacy.
Jasper’s so reasonable, there’s no reason he wouldn’t understand.

Mary-Alice is perched in the crook of a branch when Jasper shows up. She’s exactly where he left her, except for the fact that she ran into the second-closest town to hunt (Jasper had been unhappy when she admitted to hunting in the nearest town; the Cullens needed complete secrecy and Mary-Alice’s first few hunts made the Cullens worried and suspicious about nomads. She flat-out refused to give up human blood entirely, not when it made her stronger and sharper than animal blood, but she had quickly agreed that running a few more miles to the next appropriate town was not an issue.)
“Jasper.” She immediately abandons her task - weaving together stems and leaves into some kind of coronet. It’s a good task, one that keeps her mind still.
If she didn’t have something to occupy her in the hours Jasper was back with the Cullens, she’d go completely mad worrying that harm had fallen to him, even if she knows with conviction that Emmett would protect Jasper if anything happened. That’s reassuring in a foreign way - she’s never really had anyone to entrust with anything. She’s never really had anything valuable enough to need to protect it, aside from her own life.
(Maria would be laughing at her now. She spent decades trying to crush any sort of emotion or ambition from her people, to know that Mary-Alice spends most of her day on tenterhooks over the safety of her dearest… friend, that would make Maria howl with laughter. She always said that Mary-Alice was too sour and unpleasant to have a mate or a coven or even a friend. No one likes a girl who calculates the force, weight, and trajectory of their decapitation the first time they meet.)
He looks drawn and almost worried when he looks at her, but there’s a softening around his eyes when he spots her - he has to remind himself to relax so often, that she can almost spot the moments he tells himself to calm down.
But Jasper still looking solemn the she lands on the boulder next to him, to do her usual check of his state - he’s washed, his clothing is neat and clean, and his eyes are bright. No changes in the last few hours, which is good. That’s what she wants.
“Mary-Alice.” He reaches out and takes her hand, squeezing it.
They haven’t really talked about the kiss on the cheek. He had caught her by surprise, do that, and she didn’t entirely understand what he meant by that. He’d told her something about saving him, but he was running out of words when he explained, so she didn’t push. But since then, he touches her more often. And yes, she has some rather… feline tendencies as far as curling up against him when they’re alone. Emmett Cullen had laughed at her and asked if she was going to start purring the singular time he’d caught her curling up half on Jasper’s lap. But the touching that Jasper has started doing is something very, very different. He’s holding her hand a lot, touching her hair and her face which makes her edgy, and he’s holding her more, especially before he leaves.
“Something’s wrong,” she says in that same flat voice she greeted him with.
“The Cullens are leaving Pennsylvania.” The strain on his face is suddenly evident and that’s bad. That’s when he starts to struggle the most, with his weakness, his speech, his physical coordination. He’s made amazing strides over the last year, but there is always regression when he’s upset - like when Rosalie Cullen tried to teach him to drive.
“Where are they going?” This isn’t unexpected. It is obvious that they couldn’t maintain a permanent residence in a town this small, especially if Carlisle Cullen was posing as a human. She’s seen little flashes of things, but nothing concrete - mentioning it to Jasper would have been pointless and distressing.
“Montana. Friday. We leave for Montana on Friday.” He’s tugged free of her now, and is pacing. “We’ve driving to Montana, we have to pack the house.” Oh, very distressed - his speech is stilted and repetitive.
“Calm.” She tries to make her voice gentle but she doesn’t think it works very well because he doesn’t even look at her. “Everything will be fine, Jasper.”
“I won’t go without you.” He stops then and has the most stubborn look she’s ever seen on his face. It’s almost cute, the indignant expression and the way he looks directly at her. “I won’t leave you behind.”
She gives him a small smile. “Unless you tell me to go, I’ll follow you wherever you go,” she replies and his stance softens slightly. “Do they still think that I’m a delusion?”
Jasper scowls. A yes, then.
“I wouldn’t like travelling in a vehicle anyway.” She can’t imagine how many things this family has that driving is a necessity. So far, she’s calculated that Jasper has at least twelve sets of clothing, which would be difficult to carry long-term. And that doesn’t even consider any of the books that Jasper has mentioned are in the house. It’s only been two months since Jasper presented her with the little oilskin bag to carry her ‘things’ (a dried flower, a wooden comb, a spare dress) so that she didn’t have to discard anything that wasn’t safe in her pocket. “I’ll run.”
Jasper shakes his head, and there’s a puff of frustration and worry that brushes against her for a split second.
“I could beat the Cullens there,” Mary-Alice reminds him, trying to be reassuring. She’s not very good at it.
“What if you run into trouble?” Jasper is frowning.
“I am trouble.” She doesn’t think that he gets it, honestly. That anyone who runs into her won’t walk away if they decide to pick a fight.
Jasper closes his eyes. “Will you meet them?” He finally asks.
Silence.
She looks into the future, to see what would happen so close to the Cullens move. And the vision flows so easily, it’s practically set in stone.
Carlisle and Esme horrified. Rosalie angry. Edward stoic. Emmett trying desperately to mediate. Montana is cancelled. They’re going to Vermont before settling in somewhere with snow; there are five other vampires there, solemn when the Cullens arrive. They’re trying to lose her, trying to hide Jasper from her, and he’s not recovered enough to be able to stand his ground. Instead, she’s left weaving her way through the country to try and find him again.
“They will spook if I approach them now.”
He sighs and looks down. “I worry about you,” he says simply, and Mary-Alice doesn’t have any idea how to reply to that.

what’s Bright Storm like? Since she didn’t get fridged like every woman in the original dotc series
She was always curious and dependable. Bright Storm's the kind of gal who would give you the shirt off her back if she wore a shirt to give you!
Long before they set off on the Sun Trail, she would occasionally confide in Clear Sky how much she wanted to see the world. Travelers aren't unheard of; this was before the Tribe split into its 3 separate Wards and welcomed a lot of comers and goers, but it's not that no one had ever left before. It was more that she had friends and family she was committed to.
Clear Sky pressured her into it, reminding her of how much they'd see, how they'd raise their kits somewhere new, and that he'd be sad and alone forever if she didn't come. Every chance he got, he was bringing it up. He was always her weakness, she hated letting him down.
Her dependability was based on how good of a listener she was, even Gray Wing the Wise appreciated it. She was always keeping an eye out for people's wants and needs, making connections between little 'tips' she'd heard from one source or another. After Gray Wing's death, she found herself in demand for this ability.
She couldn't make a plan quite AS good as xem, but she was better at making a plan into a 'group project.' She'd brainstorm and encourage everyone to join in, putting their brains together until it all fell into place. She could be good at delegating authority based on it, too, though Tall Shadow had much more confidence than her.
And really it's her confidence that holds her back, and can you blame her?
She tried to keep Jagged Peak alive for a moon, but barely caught enough for herself, let alone him AND her unborn kittens. But how could she go back to the camp and just pretend he wasn't out here, dying?
When she goes shuffling back with her son in tow, it was humiliating, it was heartbreaking. It became soulcrushing when Clear Sky rejected her again. With just a few words, she doubted everything.
...was she capable of knowing if she was interpreting this sign correctly? ...had she done the right thing, or did she just make everything complicated? ...he's right, it must be her fault the other two died, if she hadn't--
Tall Shadow interrupted this thought spiral, but Clear Sky is like an infection in her mind. She'd tell you, in a moment of shame many years later,
"I wasn't strong enough to beat him. No no honey, I mean it like the truth. Clea-- Skystar now, he's powerful if nothing else, and he makes you believe it too. It's a special sort of person who can say no to that. I said a lot of his words before I even realized I still had his tongue in my mouth."
Bright doesn't realize how smart she is, because she's so smart she realizes how little she knows. And that can make her doubt herself. She's genuine and caring, but susceptible to more self-assured people making her doubt her own judgement.
But there's no one else Thunder Storm would rather have in his corner, that's for sure.

Chilchuck's Timeline
Age 5: Met her future wife, Faydan, at school. This was well before Faydan realized she was a trans woman, and at the time both Chil and Fay were ostracized from their peers for being too gnc, as Chil was a tomboy and Fay was a very fem “boy”. The two quickly became very close friends.
Age 8: Faydan comes out and begins her transition. Chil helps her pick out the name Faydan (she briefly considered Meijack and Flertom, but ultimately decided against it even though Chil loved those names.)
Age 10: Chil realizes she's gay… in large part because of her developing a crush on Fay as she transitions.
Age 12: Chil begins an apprenticeship with a locksmith. Fay begins fantasy HRT
Age 12 cont.: Chil and Fay begin dating on Fay's 13th birthday
Age 13: A critical misunderstanding of how Fantasy HRT works leads to Chil getting pregnant with the twins. After a long and difficult time weighing their options, Chil and Fay decide to make it work and get married. Chil attempts to hide her pregnancy for as long as possible as she was scared of losing her apprenticeship. When she cant hide it she begs to be allowed to continue, but is kicked out.
Age 13 cont.: Mei and Fler are born, and while she is ecstatic about the births of her daughters, she begins to spend every moment not dedicated to her daughters dedicated to studying and teaching herself about locks and traps. This leads to the first spat of her marriage as Fay feels Chil is focusing too much on her career instead of their new family. Chil argues they have two new mouths to feed and Fay's job as a seamstress isn't bringing in enough.
Age 14: Gets a new apprenticeship in Kahka Brud, this one paid. So the family moves from their hometown.
Age 15: Discovers this apprenticeship supports maternity leave so Chil and Fay decide to have one more child. However, after Puckpatti Chil gets her tubes tied.
Age 16: First trip into the dungeon, discovers she was going to be used as bait and fed to monsters and flees. Returns home horrified. This leads to the first major fight in their marriage as Fay wants Chil to find a safer job for the sake of their kids, but Chil wants to make this job better for other half-foots.
Age 16 cont.: Agrees to take a break from going into dungeons, and instead focuses on trying to make dungeon diving more safe and fair for half-foots while continuing to study locks and traps.
Age 18: Gets antsy and begins to dungeon dive again, much to Fay’s disdain.
Age 20: Fay and Chil have another big fight about Chil's work, specifically how she's gone for weeks or months at a time and comes back thinner, injured, and then refuses to talk about it in any meaningful way. Also while she focuses on ensuring she's a good mother while home, she doesn't really spend any time focusing on being a good partner to Fay. Chil feels bad and agrees to try to be better.
Age 24: Chil begins working on the island and meets Dandan who helps her form the half-foot guild, meaning she's spending even more time away from home. As a last ditch effort to save their marriage Faydan insists the family moves to the island too. Chil reluctantly agrees as she enjoys the physical distance separating her work and home. But ultimately she does enjoy getting to see her wife and kids more often.
Age 25: The fateful dinner with Chil's party at the time happens. This breaks Fay and she leaves. As their kids are 12 at the oldest, she takes the kids with her, much to Chil's dismay. However, she does leave Chil a note saying that while she's leaving her, she can visit their kids at their old home in Kahka Brud if she wants.
Age 25 cont.: She is DEVASTATED by her wife leaving her, and doesn't understand why she left her, even though it was because she wasn't feeling valued as Chil's wife and was sick and tired of constantly worrying about her.
Age 26: Meets Laia and joins the Touden party.
Age 26 cont.: Finds Laia weeping over a letter from Lind and goes to comfort her. When she learns that Laia’s crying because she misses her daughter and feels guilty for not being able to be with her due to work, Chil mentions she understands because she's in a similar situation with her daughters. Mentions little else and tells Laia not to tell anyone else that Chil even has kids.
Age 28: Gets a surprise visit from all three daughters who are clearly distressed. While she has been visiting them and writing to them, this is the first time they've all come together to visit him. They tell her that after Puckpatti got her first job selling dragon dung, Fay disappeared and none of them have heard from her in over a week. Being blindsided by the emotional distress of her ex-wife (who she's still low-key in love with) disappearing and her daughters being panicked, she handles it the same way she always does, which is by not handling it and instead focusing on work. So she promises her daughters that she will completely financially support them while they look for their mom so they can put all their energy into that. She also makes an effort to contact her kids as much as possible.
Age 28/29: Plot Starts. She agrees to go help Laia save Fanil because she needs the money they paid her in advance for her daughters (and not at all because she cares about Laia, Marcel, and Fanil…) though she writes them in advance explaining what she's doing with some extra money and the key to her house quickly before they return.*
