A Manhattan jury on May 30, 2024 convicted former President Donald Trump on charges he falsified business records related to the cover-up of his relationship with a porn star.
While this trial is now over, Trump still faces three other prosecutions: the state case against Trump and 18 others on charges they attempted to subvert the 2020 election in Georgia; the federal prosecution that charges Trump with conspiring to overturn the 2020 election; and a second federal prosecution on charges Trump illegally kept classified documents at Mar-a-Lago after his presidency ended and obstructed efforts to retrieve those documents.
While charging a former president with criminal offenses was a first in the United States with Trump, in other countries ex-leaders are routinely investigated, prosecuted and even jailed.
In March 2021, former French President Nicolas Sarkozy was sentenced to a year in prison for corruption and influence peddling. Later that year, a trial commenced of Israel’s longtime Prime Minister Benjamin Netanyahu related to breaches of trust, bribery and fraud; it is ongoing. And Jacob Zuma, the former president of South Africa who was charged with money laundering and racketeering, likely faces trial in 2025 after years of delay.
At first glance, prosecuting current or past top officials accused of illegal conduct seems like an obvious decision for a democracy: Everyone should be subject to the rule of law.
But presidents and prime ministers aren’t just anyone. They are chosen by a nation’s citizens or their parties to lead. They are often popular, sometimes revered. So judicial proceedings against them are inevitably perceived as political and become divisive.
Destabilizing prosecutions
This is partly why U.S. President Gerald Ford pardoned Richard Nixon, his predecessor, in 1974. Despite clear evidence of criminal wrongdoing in the Watergate scandal, Ford feared the country “would needlessly be diverted from meeting (our) challenges if we as a people were to remain sharply divided over” punishing the ex-president.
Public reaction at the time was divided along party lines. Today, some now see absolving Nixon as necessary to heal the nation, while others believe it was a historic mistake, even taking Nixon’s deteriorating health into account – if for no other reason than it emboldens future impunity of the kind Trump is accused of.
Our research on prosecuting world leaders finds that both sweeping immunity and overzealous prosecutions can undermine democracy. But such prosecutions pose different risks for older democracies such as France and the U.S. than they do in younger democracies like South Africa.
Mature democracies
Strong democracies are usually competent enough – and the judicial system independent enough – to prosecute politicians who misbehave, including top leaders.
Sarkozy is France’s second modern president to be found guilty of corruption, after Jacques Chirac in 2011 for kickbacks and an attempt to bribe a magistrate. The country didn’t fall apart after either conviction, and Sarkozy now faces additional charges related to alleged illegal campaign financing from Libya.
In mature democracies, prosecutions that hold leaders accountable can solidify the rule of law. South Korea investigated and convicted five former presidents starting in the 1990s, a wave of political prosecutions that culminated in the 2018 impeachment of President Park Geun-hye and, soon after, the conviction and imprisonment of her predecessor, Lee Myung-bak.
Did these prosecutions deter future leaders from wrongdoing? For what it’s worth, Korea’s two most recent presidents have so far kept out of legal trouble.
Overzealous prosecution versus rule of law
Even in mature democracies, prosecutors or judges can abuse prosecutions. But overzealous political prosecution is more likely, and potentially more damaging, in emerging democracies where courts and other public institutions may be insufficiently independent from politics. The weaker and more beholden the judiciary, the easier it is for leaders to exploit the system, either to expand their own power or to take down an opponent.
Brazil embodies this dilemma.
Ex-President Luiz Inácio “Lula” da Silva, a former shoeshine boy turned popular leftist, was jailed in 2018 for accepting bribes. Many Brazilians thought his prosecution was a politicized effort to end his career, but Lula was elected in October, 2022.
A year later, the same prosecutorial team accused the conservative former President Michel Temer of accepting millions in bribes. After his term ended in 2019, Temer was arrested; his trial was later suspended.
Both Brazilian presidents’ prosecutions were part of a yearslong, sweeping anti-corruption probe by the courts that has jailed dozens of politicians. Even the probe’s lead prosecutor is accused of corruption.
Depending on the perspective, Brazil’s crisis reveals that nobody is above the law or that the government is incorrigibly corrupt – or both. With such confusion, it becomes easier for politicians and voters to view leaders’ transgressions as a normal cost of doing business.
For Lula, a conviction didn’t end his career. He was released from jail in 2019 and the Supreme Court later annulled his conviction. Lula won the 2022 presidential race against Jair Bolsonaro, with Bolsonaro now indicted related to fraud in his dealing with the pandemic.
Stability versus accountability
Historically, Mexico has taken a different approach to prosecuting past presidents: It doesn’t.
During the 20th century, Mexico’s ruling Institutional Revolutionary Party, or PRI, established a system of patronage and corruption that kept its members in power and other parties in the minority. While making a show of going after smaller fish for petty indiscretions, the PRI-run legal system wouldn’t touch top party officials, even the most openly corrupt.
Impunity kept Mexico stable during its transition to democracy in the 1990s by placating PRI members’ fears of prosecution after leaving office. But government corruption flourished, and with it, organized crime.
That may be changing, though. In early August 2022, Mexican federal prosecutors confirmed that it had several open investigations into former PRI President Enrique Peña Nieto for alleged money laundering and election-related offenses, among other crimes, which appear to remain active.
Mexico is far from the only country to overlook the bad deeds of past leaders. Our research finds that only 23% of countries that transitioned to democracy between 1885 and 2004 charged former leaders with crimes after democratization.
Protecting authoritarians – including those who oversaw human rights violations – may seem contrary to democratic values, but many transitional governments have decided it is necessary for democracy to take root.
That’s the bargain South Africa struck as apartheid’s decades of segregation and human rights abuses ended in the early 1990s. South Africa’s white-dominated government negotiated with Nelson Mandela’s Black-led African National Congress to ensure outgoing government members and supporters would avoid prosecution and largely retain their wealth.
This strategy helped the country transition to majority Black rule in 1994 and avoid a civil war. But it hurt efforts to create a more equal South Africa. As a result, the country has retained one of the world’s highest racial wealth gaps.
Corruption is a problem, too, as former President Zuma’s prosecution for lavish personal use of public funds shows. But South Africa has a famously independent judiciary. Despite delays and appeals, Zuma’s prosecution continues, and he was prevented from contesting the presidency this year.
How mature is mature?
Israel is partly a testament to the rule of law – and partly a cautionary tale about prosecuting leaders in democracies.
Israel didn’t wait for Netanyahu to leave office to investigate wrongdoing. But several court processes were fraught with delays, in part because Netanyahu used state power to resist what he called a “witch hunt.”
Netanyahu tried unsuccessfully to secure immunity and stall while his Likud party cried foul. He was even reelected while under indictment. In December 2023, judges limited the number of trial days per week because of the war in Gaza, but the cases are ongoing.
With Trump’s Manhattan jury verdict, the process has revealed something fundamental about American democracy. As its repercussions play out, the verdict will likely be seen as both a matter of law – and politics.

When someone has a question like this, it's important to answer it seriously. There's a lot going on with why liberals think Trump supporters are stupid, and Peni Delina Bedard's post is a good place to start.
I have relatives who are Trump supporters. They're good people. In 2016, my uncle would laugh and say, "He's saying what everyone is thinking!" That kind of guy. Donald Trump promised, among other things, to get them a tax break. So I'm speaking from here.
There's something that conservatives keep doing that makes it look to us like you're lying and something that liberals keep doing that makes it look like we've missed the point: 1) We ask you what you want. 2) You give an answer that's close but not exactly it. 3) We take your answer at face value and propose actions to make it happen. 4) You guys go "That's not what we want! That would only make things worse!" 5) We assume you were lying in step two and that your real motive is to cause whatever outcome will result from not taking the actions in step three. You see this a lot with abortion and gun control. You guys seem really upset about this whole (2) "saving babies" thing and we don't agree with you that fetuses are babies, but (3) we come up with plans for sex ed and IUD programs and we have evidence that they work, but this only (4) seems to make you more upset, so (5) we figure that saving babies isn't really what you care about and assume that oppressing women and keeping poor people poor is what you really want.
There are a couple reasons why this keeps happening.
A) Liberals do a lot of moral reasoning from consequentialism and conservatives do a lot of moral reasoning from virtue ethics. We all use both, but each side skews more one way. The short version is that liberals think the purpose of government is to create the best outcomes spread out among the largest group of people and conservatives think the purpose of government is to create a society in which people get better outcomes if they make morally good choices. It's okay if most people lose as long as losing was their own fault. This guy has a wonderful take on it. It's not that conservatives think they'll all be billionaires someday. It's that they think there's honor in getting what wealth and position you do have.
B) A big part of the liberal, progressive mindset is faith in evidence. If there are multiple scientific studies saying things like, "This vaccine is relatively safe" then, to us, that's almost as good as seeing it with our own eyes. Our problem is that it's very hard to imagine how someone wouldn't think this way. We remember being kids who didn't understand how the scientific system works, so we imagine that people who don't believe in science just don't understand how it works.
In 2015 and 2016, Trump communicated with conservatives using theatrics. He created an image, like a fictional character in a movie. He painted himself as a savvy businessman, an unstoppable winning machine feared by enemies and adored by women. We thought you knew it wasn't real. It was like if Bruce Willis were running for president. We thought you knew he was Bruce Willis and not John McClane. Bruce Willis can't kill a helicopter with a car when he's out of bullets. John McClane could only do it because he lives in a scripted world.
But then Trump had four years to show us the substance underneath the flash, and it turned out he can't govern. He postured and told President Enrique Peña Nieto that Mexico had better pay for the wall or else just cancel their meeting. In a movie, this is where the meebly secondary character would give way to the force of the hero's personality. The real-life Enrique Peña Nieto cancelled their meeting.
Then there's Joe Biden. He doesn't look like much, but he's great at working behind the scenes, grinding out deals between people who don't always agree with each other, laying down track for plans that won't show until later. And we can look at his work with veterans' benefits and infrastructure and we can see, "Ah yes, here is evidence that Biden governs reasonably well. The results speak for Biden's ability to get results."
We have had four years to see that Trump can't govern, that his policies are not only cruel but ineffective. There is evidence, lots of it, right in front of your eyes. Why don't you believe it? Do you just not understand?
He didn't get you your tax cut. He didn't restore American values. He didn't give us a high-winning economy. He didn't do the things you said you wanted done.
So I think the liberal side is justified in wondering what it was that you really did want.

Peni Delina Bedard · August 31, 2019  ·  The serious answer: Here’s what we really think about Trump supporters - the rich, the poor, the malignant and the innocently well-meaning, the ones who think and the ones who don’t… That when you saw a man who had owned a fraudulent University, intent on scamming poor people, you thought “Fine.” That when you saw a man who had made it his business practice to stiff his creditors, you said, “Okay.” That when you heard him proudly brag about his own history of sexual abuse, you said, “No problem.” That when he made up stories about seeing Muslim-Americans in the thousands cheering the destruction of the World Trade Center, you said, “Not an issue.” That when you saw him brag that he could shoot a man on Fifth Avenue and you wouldn’t care, you chirped, “He sure knows me.” That when you heard him illustrate his own character by telling that cute story about the elderly guest bleeding on the floor at his country club, the story about how he turned his back and how it was all an imposition on him, you said, “That’s cool!” That when you saw him mock the disabled, you thought it was the funniest thing you ever saw. That when you heard him brag that he doesn’t read books, you said, “Well, who has time?” That when the Central Park Five were compensated as innocent men convicted of a crime they didn’t commit, and he angrily said that they should still be in prison, you said, “That makes sense.” That when you heard him tell his supporters to beat up protesters and that he would hire attorneys, you thought, “Yes!” That when you heard him tell one rally to confiscate a man’s coat before throwing him out into the freezing cold, you said, “What a great guy!” That you have watched the parade of neo-Nazis and white supremacists with whom he curries favor, while refusing to condemn outright Nazis, and you have said, “Thumbs up!” That you hear him unable to talk to foreign dignitaries without insulting their countries and demanding that they praise his electoral win, you said, “That’s the way I want my President to be.” That you have watched him remove expertise from all layers of government in favor of people who make money off of eliminating protections in the industries they’re supposed to be regulating and you have said, “What a genius!” That you have heard him continue to profit from his businesses, in part by leveraging his position as President, to the point of overcharging the Secret Service for space in the properties he owns, and you have said, “That’s smart!” That you have heard him say that it was difficult to help Puerto Rico because it was in the middle of water and you have said, “That makes sense.” That you have seen him start fights with every country from Canada to New Zealand while praising Russia and quote, “falling in love” with the dictator of North Korea, and you have said, “That’s statesmanship!” That Trump separated children from their families and put them in cages, managed to lose track of 1500 kids, has opened a tent city incarceration camp in the desert in Texas - he explains that they’re just “animals” - and you say, “Well, OK then.” That you have witnessed all the thousand and one other manifestations of corruption and low moral character and outright animalistic rudeness and contempt for you, the working American voter, and you still show up grinning and wearing your MAGA hats and threatening to beat up anybody who says otherwise. What you don’t get, Trump supporters in 2019, is that succumbing to frustration and thinking of you as stupid may be wrong and unhelpful, but it’s also…hear me…charitable. Because if you’re NOT stupid, we must turn to other explanations, and most of them are less flattering.

CIUDAD DE MÉXIXO * 23 de septiembre 2024. ) Apro El presidente Andrés Manuel López Obrador extraditó a 341 presuntos narcotraficantes a Estados Unidos, un promedio de 62 por año, con lo cual cumplió la cuota de extradiciones a la que se comprometió con Washington en el Acuerdo Bicentenario, indicó un estudio de la organización Elementa DDHH. En el informe “Extraditar la verdad México”, la ONG reveló que según documentos obtenidos del colectivo Guacamaya, mientras se negociaba el Acuerdo Bicentenario la Secretaría de la Defensa Nacional (Sedena) garantizó a las autoridades estadunidenses que México extraditaría cada año al vecino país a 60 presuntos narcotraficantes. Y este compromiso fue seguido al pie de la letra por López Obrador, quien cada año de su sexenio firmó la extradición de 61.9 mexicanos en promedio, así la cifra exacta para cumplir la cuota de 60. Estas extradiciones ocurrieron “pese a la retórica no intervencionista del presidente López Obrador, quien al igual que sus antecesores contribuyó a la estrategia kingpin”, la cual se centra en perseguir a los líderes de los grupos criminales y no en combatir el crimen. El reporte, que coordinaron la directora de Elementa DDH, Adriana Muro, y la directora de la oficina en México, Renata Demichelis, contabilizó las extradiciones a Estados Unidos que firmó López Obrador desde el inicio de su gobierno hasta junio de este año, lo que arrojó un promedio de 5.1 cada mes. López Obrador realizó menos extradiciones que los presidentes Felipe Calderón (615) y Enrique Peña Nieto (421), pero su vehemente discurso contra el intervencionismo contrasta con su colaboración con Estados Unidos no sólo en materia de narcotráfico, sino también en el tema de la migración, en el que México ha jugado un papel para contener los flujos de migrantes latinoamericanos. De acuerdo con Elementa DDHH, la política criminal en materia de drogas de Estados Unidos, cuya piedra angular es la extradición, “representa un beneficio para la crisis de corrupción e impunidad que prevalecen en las instituciones de justicia de nuestro país”. Esto, porque “la política bilateral actual permite que la responsabilidad judicial recaiga en la jurisdicción estadounidense”, es decir, se ha extraditado a ese país el proceso penal, lo cual “facilita que México evada su responsabilidad de investigar y sancionar y debilita a las instituciones locales”. El informe de la ONG de derechos humanos, seguridad y política de drogas señaló que las dependencias gubernamentales en México “pierden memoria institucional y conocimiento práctico para procesar casos tan relevantes como el de Édgar Veytia (exfiscal nayarita), Genaro García Luna (exsecretario de Seguridad) y (el narcotraficante) Joaquín Guzmán Loera”. También propicia las delaciones y los presuntos secuestros de criminales ocurridos en territorio mexicano con el propósito de entregarlos a Estados Unidos, como ocurrió en julio pasado con el jefe histórico del Cártel de Sinaloa, Ismael “El Mayo” Zambada, quien fue al parecer plagiado por Joaquín Guzmán López para negociar un acuerdo con la Fiscalía del vecino país. Los fiscales estadunidenses, señaló la ONG, han promovido las negociaciones para lograr que una persona acusada testifique en contra de un coacusado o pueda apoyar al gobierno en señalar a otras personas implicadas en actividades delictivas. “Esto permite que se mantenga la espiral de persecución en países productores de drogas sin afectaciones concretas a la operación del mercado”, agregó el informe. Lo que hay en la práctica es un sistema burocrático en el que las agencias antidrogas, a las cortes y a los fiscales, se centran en abultar estadísticas para aparentar que luchan contra las drogas y para engrosar sus presupuestos. “Esto es una utilización política de las extradiciones”, dijo la directora de Elementa DDHH, Adriana Muro. A los fiscales y a las cortes estadounidenses tampoco les interesa si es ilegal la llegada a su país de las personas para enfrentar acusaciones por delitos de drogas. “En el caso Humberto Álvarez Machaín, relacionado con el asesinato del agente de la DEA, Enrique ‘Kiki’ Camarena, la Suprema Corte estadounidense validó su secuestro en territorio mexicano (ocurrido en abril de 1990) previo a su traslado a Estados Unidos, lo cual valida casos recientes como el de ‘El Mayo’ Zambada”, señaló el documento. Y sostuvo que las acciones de extraterritorialidad judicial promovidas por la DEA benefician tanto a los objetivos de la política criminal estadounidense, como a la impunidad y corrupción de las instituciones de justicia en México”. La ONG, con sedes en México y Colombia, deploró que los procesos en Estados Unidos por delitos de drogas se centren “en gramos y sustancias, no en la vida de miles de personas afectadas por el sistema bélico de la prohibición y las redes de corrupción que permiten que opere el mercado”. De 150 casos de extradiciones revisados por Elementa DDHH, en sólo tres se sentenciaron delitos asociados a víctimas. “Para las cortes que juzgan sobre delitos de drogas cometidos en México, las víctimas existen cuando cumplen un rol o para la política criminal de Estados Unidos”, señaló, y sostuvo que a menudo se olvida que los narcotraficantes también son responsables de violaciones masivas a los derechos humanos. La ONG llamó la atención sobre la opacidad del Acuerdo Bicentenario, suscrito por el gobierno de López Obrador con Estados Unidos en 2021. “No se publicó el convenio original y no existen reportes de acceso libre que demuestren los avances en sus indicadores de evaluación”, sostuvo Elementa DDHH y alertó que ese acuerdo “ha continuado con el modelo bélico y punitivo de la prohibición en sus objetivos e indicadores”, uno de los cuales son las extradiciones. www.acapulcopress.com Read the full article
