i was starting to theorize that maybe marriages via kidnapping/pain of death are legally legitimate because they are sworn before the gods, and so these vows have a specific legal binding to them that overrides vows sworn to men
this is more or less what ser roderik cites when discussing ramsay's kidnapping of lady hornwood with maester luwin:
so marriage vows would be unique in their legitimacy because you swore to the gods, not to any king or other mortal instrument (it's unclear to me how much the king of westeros is said to rule by divine right? maybe that's the implication but in general the faith of the seven seems not to have a lot to do with the rightful ruler of westeros. like idk if anyone calls robert or joffrey like the personification of the will of the seven. that seems unlikely to me since robert was king by conquest not inheritance and since the targs were also kings by conquest and did not keep the faith)
but then:
the vows of the night's watch are also sworn before the gods, old and/or new
jon swore his vows before a grove of weirwoods (castle black has no godswood) and the other boys swore in front of the seven with septon celladar
robb even cites that the kingsguard (who also swear their vows before the gods/in a sept) were relieved of their duties by the lannisters (above gods and men indeed, huh, jaime?)
so why are sansa's vows before the septon an unbreakable bond that legitimizes tyrion lannister as heir to winterfell if robb can figure out a way to break jon's vows to the night's watch and make him heir to winterfell. what makes sansa's marriage vows different from jon's vow to keep his watch (never mind the fact that jon is currently secret double turn cloaking with the wildlings, robb doesn't know that)
oh, and then there's this:
which i found interesting as well because this confirms that ramsay hasn't been legitimized (who would have issued the royal decree to do so? robert/his council didn't since we know lady hornwood still calls him ramsay snow, and robb hasn't legitimized him either) so then what does this mean:
obviously i agree with maester luwin (and normally i don't agree with him about anything) but how could roose bolton contest this if bastards cannot legally inherit unless they are formally legitimized? how would the hornwood lands be his (or ramsay's, or house bolton's) unless ramsay was legitimized before his marriage?
even if lady hornwood did sign a decree that named ramsay her heir (she signed it under threat of death so it shouldn't count!!! it shouldn't count!! me and maester luwin are correct) it would still be legally impossible for him to inherit... unless the decree lady hornwood signed also legitimized him which cannot be true since bastards can only be legitimize by royal decree and lady hornwood is just the lady of a great house
i could understand that robb is saying the lannisters disrespected vows sworn before the gods when they dismissed the kingsguard, but he won't because he's better than them
but he isn't better than them if he wants to break jon's vows, also sworn before the gods and also sworn for life
so if he can legal loophole his big brother out of his (willingly given!!!!!) vows to the night's watch, why can't he legal loophole his baby sister out of being a war bride who was wed as a prisoner of war
