Unethical Executions in February
Demetrius Frazier is set to be executed in Alabama via nitrogen suffocation. This is a fairly new execution method, and early reports from witnesses and medical professionals raise concerns about prolonged deaths and unnecessary pain.
James Ford is set to be executed in Florida, despite psychological evaluation determining that he has the mental functions of someone around 11-14 years old. This should make him ineligible for execution, but the constitutional rules around executing intellectually disabled people are rarely enforced.
There is also Richard Tabler, who is set to be executed in Texas. There are no special issues with his case, but Texas is one of the most aggressive states when it comes to executions which raises ethical concerns on its own.

What to know
Kenny Smith’s jury sentenced him to life without parole
He has already endured the entire torturous process of an execution that Alabama botched in 2022
Alabama now plans to experiment on him with nitrogen suffocation, a method that has never been used in an execution anywhere in the world
Alabama has the worst record of any state for botched executions
A botched nitrogen gas execution could cause brain damage, stroke, a persistent vegetative state, or he could choke to death on his own vomit
A mishap with odorless, colorless nitrogen could kill prison staff within minutes
After its first torturous execution of Kenny Smith by lethal injection failed in 2022, Alabama now plans to use a never-before-used method—nitrogen gas—to put Mr. Smith to death on January 25.

Also another added horrifying fact is that Kenneth Smith was already supposed to be executed via lethal injection and they failed to properly due so because they apparently could not find a vein.
At the time of me writing this Kenneth has been executed. It took over 20 minutes for him to pass during which time he violently convulsed.
I don't care what you personally think about the death penalty but nitrogen hypoxia is inhumane and the state of Alabama need to have action taken against them for the inhumane death, and previous failed execution, of Kenneth Smith. (And other botched executions)
today the first person in the united states will be executed using a gas mask containing 100% nitrogen gas, meaning he will suffer and die of sudden hypoxia. although the state of alabama claims to predict that the nitrogen gas will "cause unconsciousness within seconds, and cause death within minutes,” medical experts have pointed out that there are risks that a person subjected to this form of execution could suffer from seizures, choking on their own vomit, and prolonged suffering, and claim that “alabama has refused to be forthcoming with the fine details of execution by forced nitrogen gas inhalation” affecting the defendant’s ability to “adequately make a legal defence.”
the UN has warned that this plan could constitute torture. the American Veterinary Association has advised again the use of nitrogen hypoxia for euthanasia of almost all mammals. experts also warn that safety issues for those in the vicinity of the execution could block prisoners right to have a spiritual advisor in the execution chamber as established by the supreme court in 2022, as well as the right to healthcare as established by the supreme court in 1976 should they not die immediately.
Kenneth Smith, who will be the the guinea pig for this inhumane punishment, could not be sentenced with the death penalty if his case was tried today as this sentence was imposed by a judge overruling the decision of a jury, which is no longer permitted.
the use of nitrogen hypoxia to kill prisoners has been approved in alabama, mississippi, and oklahoma, and is a risk in arizona, oklahoma, and nebraska.
you can sign this petition to several of these states’ governors and legislators here. if you’re a jewish community leader wanting to join the jewish community statement opposing the gas chamber you can sign here. you can also reach out directly to your reps, especially alabama governor Kay Ivey, who has the authority to stop this execution (although time is running very short) and other executions of this type in the future.
if you’re in “canada” like me, the canadian company walter surface companies, owned by a canadian private equity firm called onex corp is complicit in this execution as one of its subsidiaries is producing the gas masks that will be used in these executions. you can sign a petition here and do anything else you can to put pressure on these groups.
i’m horrified that any country still uses the death penalty. i’m horrified at the precedent that this particular execution sets. nobody should be okay with this.
#death penalty#light talks#alabama also has a long history of convict mistreatment and failure to execute#the death penalty is awful and expensive and stupid#the fact we torture people like this is disgusting

So much winning. You will get tired of the winning. Donald Trump promised: "We're going to slash energy costs. We're going to get your energy bills in half." But hundreds of Alabama residents are receiving a $100 surcharge on their energy bills. Alabama received a "$1 million allocation for the LIHEAP program from the Infrastructure Investment and Jobs Act (IIJA) for fiscal year 2025," Presley wrote. "Under the IIJA, eligible households that receive heating assistance from the regular [Low-Income Home Energy Assistance Program] LIHEAP program funds also receive a supplemental award of $100 from these IIJA funds to help with home heating costs until the IIJA funds are depleted." But, according to Presley, "[t]his supplemental funding is currently paused due to President Trump’s executive order titled Unleashing American Energy."
The surcharge is the power company taking last month's $100 back. And, I said slowly, they won't get help going forward.

Louisiana resuming executions after 15 years, issues first protocol for nitrogen hypoxia
Louisiana will resume executions after a 15-year hiatus, forging ahead on plans set in motion last spring to carry out death sentences using nitrogen hypoxia. The office of Louisiana Gov. Jeff Landry released a summary of the state’s updated execution protocol on Monday alongside a pledge to move forward with the death penalty for the first time since 2010. There are currently 63 people on death…

Emmanuel Littlejohn has been waiting for months to find out whether he will die on Thursday or get to live. It's been "the hardest thing I ever did."
Littlejohn, 52, is set to be executed for the shooting death of a convenience store owner during a robbery in Oklahoma City in 1992. If Republican Oklahoma Gov. Kevin Stitt declines to grant him clemency, Littlejohn will be the third inmate executed by the state this year and the 17th in the nation. He's also one of five men the U.S. is executing in a six-day period, and he's set to die just about eight hours before Alabama is expected to execute Alan Eugene Miller using nitrogen gas.
"I would say to the governor: Do what you think is the right thing," Littlejohn told USA TODAY in a recent interview.
Littlejohn has admitted to his role in the robbery but has maintained that his accomplice was the one to pull the trigger, not him.
"I accept responsibility for what I did but not what they want me to accept responsibility for," Littlejohn previously told USA TODAY. "They want me to accept that I killed somebody, but I haven't killed somebody."
In a rare move, the Oklahoma Pardon and Parole Board voted 3-2 to recommend clemency for Littlejohn, whose legal team argued that the evidence in the case was unclear, especially who the triggerman was.
Still, Republican Oklahoma Attorney General Gentner Drummond said afterward that his office would still be arguing against clemency to the governor, calling Littlejohn a "violent and manipulative killer."

If you’re outraged over Missouri murdering Marcellus Williams, then you should know Oklahoma is planning on carrying out an execution of Emmanuel Littlejohn this Thurs. at 10am.
Littlejohn was pardoned by the PPB. There’s still time to call the Governor: 405-521-2342.

I was able to leave a voicemail by pressing 1 then 4 then 0. After what happened in Missouri, there's an overwhelming sense of hopelessness that the care about public comments but I hope Emmanuel is able to avoid Khaliifah's fate.

Hi, the best thing to do is to call the Governor’s office directly and press 0 to be connected to a staff person. Ask that the governor respect the wishes of the pardon and parole board and grant clemency to Emmanuel Littlejohn. 405-521-2342

The number of executions worldwide hit a nearly 10-year high in 2023 thanks to a surge in state killings by Iran, Saudi Arabia, China, and the United States.
A new global report published by Amnesty International documents that the death penalty was imposed on 1,153 people last year, though the total is believed to be significantly higher due to the secrecy surrounding China's penal system. The international human rights group believes "thousands" of people were executed by the Chinese government, but the exact figure is not known.
The 1,153 figure was 30% higher than the number of people who received the death penalty in 2022 and the highest annual figure documented by Amnesty since 2015 when the number of confirmed killings was 1,634. In addition to executions carried out, the number of death sentences handed down rose by 20% in 2023, with a total of 2,428.
Among the other key findings of the report:
U.S. executions rose from 18 to 24, keeping the U.S. among the world's top five executioners in the world.
The top five nations for the death penalty were China ("thousands"), Iran (853+), Saudi Arabia (172), Somalia (38), and the U.S. (24).
The 48% spike in executions in Iran made it the nation with the most documented death penalty cases;
China continues to execute thousands, while threatening the public that crime will result in the death penalty
Lowest number of executing countries on record shows progress.
In the United States, said Amnesty, the number of executions—all which took place in just five states across the south—rose 30% last year. The executions that took place were in Texas (8), Florida (6) Oklahoma (4), Missouri (4), and Alabama (2).

Death Penalty States Beware: Nitrogen Hypoxia Is Not the Solution to America’s Long History of Inhumane Executions
![Tumblr media](https://64.media.tumblr.com/77706ac09752f633cce8baae20bdc5f8/bf4dcee55decb715-ba/s540x810/ee091fa9246c8ed3f40ce19db2e62d6c216c6c9e.webp)
10 MAY 2024 | AUSTIN SARAT
On May 8, Alabama’s Republican Governor Kay Ivey set a date for the state’s second execution by nitrogen hypoxia. Her office announced that Alan Eugene Miller would be put to death sometime within thirty hours after 12:00 a.m. on Thursday, September 26, 2024.
The governor’s action followed a decision by the Alabama Supreme Court granting the state attorney general’s request for permission to set Miller’s execution date. Miller was convicted and sentenced to death in July 2000 for killing three men in a workplace shooting.
If Alabama goes forward with its plan, it will be Miller’s second trip to the execution chamber. His first trip, in September 2022, produced a gruesome spectacle.

incarcerated people are shutting down Alabama prisons and asking for your solidarity
Alabama prisons are the deadliest and most crowded prisons in the US. Their violence extends to gas chamber executions and illegal organ harvesting. The Alabama Department of Corrections (ADOC) is currently facing two federal lawsuits: one for enslaving Black detainees by denying them parole and leasing out their forced labor and another for targeting strike organizers. ADOC rakes in more than $450 million annually in profits from forced labor, and that's not including the profits incarcerated people generate for private corporations such as McDonald's and Raytheon. In response to these abuses, and in particular the horrific beating of six handcuffed detainees by Lt. Edmonds at Donaldson Prison on February 22nd, the Free Alabama Movement (FAM) has organized a minimum 90-day statewide prison shutdown/work stoppage. They are calling on supporters outside the prison walls to show solidarity. If you're located in or around Alabama, show up to the protest at St. Clair Prison in Springville, AL on Saturday March 2nd. For rideshare coordination contact the Tennessee Student Solidarity Network on IG or by email: [email protected] "Outside support for us starts at the prisons. That's where we need people. Come to one of the protests, show your face, and tell us that you support us. That's how we know that you support us. Outside support is the first step." - FAM
Everyone in the US, call Donaldson Prison at (205) 436-3681 and ask them to fire Lt. Edmonds for his brutal violence against incarcerated people.

Bloody September: 5 Executions Schedules in Various US States from the 20th to the 26th
Freddie Owens was 19 at the time of the crime and suffers from organic brain injuries
Marcellus Williams has maintained his innocence for over 30 years. The only evidence tying him to the crime was the testimony of two paid witness. DNA evidence done after his trial excludes him from the suspect pool
Travis Mullis is mentally ill
Emmanuel Littlejohn was convicted for murder due to his participation the robbery of Kenneth Meyers (the murder victim). The prosecution alleged that he was the one who pulled the trigger in Emmanuel's trial, but claimed it was his co-defendant in the the co-defendant's trial. The co-defendant only received life in prison.
Alan Miller suffered from delusions at the time of his crime, which legally bars him from receiving the death penalty. He also had ineffective assistance from counsel and has already survived one tortuously botched execution attempt
Below are some action items for these cases. CW: discussions of murder, abuse, SA

Pro-execution sadists disgust me honestly. Alabama just executed a man with nitrogen gas for the first time and the top comments were all how it was deserved and "an eye for an eye." Can't even pretend like we are against cruel and unusual punishment INSIDE the US anymore.
