WA Senate passes bill to bar hiring discrimination for cannabis use

Washington employers would be prohibited from refusing to hire a potential worker solely because of a drug test showing they had used cannabis under a bill that passed the state Senate on Wednesday.
Washington voters approved recreational marijuana in 2012 through Initiative 502. More than a decade later, though, as more states have moved to legalize the drug, Washington employers can still screen out applicants who use cannabis.
If Senate Bill 5123 becomes law, Washington would join several other states that have enacted laws shielding employees from workplace penalties for off-duty cannabis use. The bill passed the state Senate on a 28-21 vote Wednesday, sending it to the House for further consideration.
In 2019, Nevada became the first state to stop employers from rejecting an applicant because of a drug test showing cannabis use. Last year, California Gov. Gavin Newsom signed into law a bill barring discrimination in hiring, firing and other conditions of employment if a worker uses cannabis while off duty.
The Washington bill’s sponsor, Sen. Karen Keiser, D-Des Moines, introduced a similar proposal last year, but it didn’t get to the floor for a vote. Washington’s bill only covers drug tests before hiring, Keiser said. An employer could still test you for cannabis once you have a job, and could still make a hiring decision based on a drug test that doesn’t include cannabis.
“If your employer wants to test you every week after you’re hired, they’re still able to do that,” Keiser said. “This is simply opening the front door of getting into a job. Because too many people who see that they have to take a drug test to even apply, don’t even apply.”
Certain jobs are excluded from the bill, including in the airline and aerospace industries and those requiring a federal background investigation or security clearance. Employers could still screen workers for cannabis after an accident or if they suspect impairment on the job.
Thanks to an amendment from Sen. Curtis King, R-Yakima, the bill also excludes professions where impairment on the job means “substantial risk of death.”
A central challenge in regulating cannabis use in the workplace is that a test that measures impairment from the drug is not yet available. That poses a problem especially for workers and employers who are subject to federal regulations, including through contracts with the federal government or because workers must have commercial driver’s licenses.
Burl Bryson, executive director of The Cannabis Alliance, told lawmakers in a public hearing Jan. 10 that potential candidates can consume cannabis legally “and still test positive for weeks later.”
“If the same approach were applied to alcohol, employers would refuse employment to anyone who enjoyed a beer or glass of wine on the weekend,” Bryson said.
“It simply doesn’t make sense to base an employment decision on that kind of unreliable outcome and test,” Keiser said on the Senate floor just before the vote Wednesday.
The bill had drawn some opposition from business lobbyists, who expressed worries about employers’ responsibility for safety problems in the workplace.
Bob Battles, general counsel and government affairs director for the Association of Washington Business, which has 7,000 members including major employers Boeing and Microsoft, said Wednesday the organization shifted to a more neutral position, citing changes clarifying that it covered only preemployment screening, as well as King’s amendment to exclude positions where impairment could be deadly.

Kamala Harris and Tim Walz. Let's Win This!
I like Kamala Harris a lot. I'm excited she is going to be the Democratic nominee, and I want her as my President. She was initially my preferred candidate in 2020, before she withdrew her name. I was delighted when she was chosen to run as Vice President.
Tim Walz? He's a great choice. He's my governor, and he's the real deal. I know people who have met him and spent time with him, and all reports are that he is a very genuine, honest man. He is exactly what he seems to be. The midwestern dad energy is not artifice, it's sincere. He knows how to fix his car, and he knows how to make legislation happen in a legislature.
If you know nothing about him, know this:
He was a teacher and he supports strong funding for schools and early education. He has the endorsement from the NEA.
While serving as a high school geography teacher in Mankato, Minnesota, Walz was the faculty advisor of the school's first student gay-straight alliance organization.
Also at Mankato West High School, Walz was the coach of the boys Football team, which he coached to the school's first State Championship in 1999, winning first among class AAAA schools.
He has been a strong union man, and he supports the rights of workers to organize and negotiate. He has enthusiastic AFL-CIO support and endorsement.
He is a hunter and gun owner that supports reasonable gun control and licensure.
He is the father of teenaged children who are well-adjusted, and he spends time with them in a genuine and supportive way.
Walz advocated for, and signed into law, the legalization of recreational cannabis use in Minnesota.
He was in the U.S. Army National Guard where he rose to the highest possible non-commissioned rank in any battalion: Command Sergeant Major. Those are among the most important and respected members of the military, and the senior enlisted advisor to a battalion commander. You don't even get close to that job unless you are as reliable and competent as they come.
As a member of the Nebraska National Guard, Walz was selected as Nebraska Citizen-Soldier of the year in 1989.
He is a former member of the U.S. House of Representatives, serving Minnesota's First District from 2007 to 2019, when he took the office of Governor. While in Washington he served on the Agriculture, Veteran's Affairs, Transportation & Infrastructure, and Armed Forces committees.
His Lieutenant Governor, Peggy Flanagan, is a Native American activist and community organizer, and a member of the White Earth Band of the Minnesota Chippewa Tribe. If Harris-Walz win the presidential election, Flanagan would become the first Native American to serve as U.S. State Governor, and I'd be thrilled to see her in the Governor's mansion.

Never has the Cenotaph, in its 103 years of standing sentry on Whitehall, been “defended” on Armistice Day by a Port Vale fan supping a can of Stella Artois.
“I’m here in case the jihadists get past the police, who’ll probably just let them through anyway,” said Ben Neale, 22, from Tunstall, Staffordshire. “If they do come, they’ll soon wish they hadn’t.”
As it transpired, it was some of his fellow football supporters, backed aggressively by elements of the far right, who broke violently through police lines, toppling over metal barricades, throwing missiles and temporarily forcing officers back as they surged towards the Cenotaph on the anniversary of the end of the first world war.
Many stated explicitly that they had travelled to Whitehall because of comments made by the home secretary, Suella Braverman, who, days earlier, had claimed that police treated football supporters – such as Neale – unfavourably compared to “politically connected minority groups”. “She’s the only one making any sense at the minute. We’re sleepwalking into a race war,” said a middle-aged man who said he was a Sunderland fan but did not want to be named. “Armistice is our day!” he added.
“It’s getting ridiculous, them taking our streets, attacking the Cenotaph,” said another man, a black scarf covering the lower part of his face.
Who’s them? “The Palestinian mob,” he added, echoing the words of Braverman who had also alleged that the police were too soft on “pro-Palestinian mobs”.
As several dozen people scuffled with baton-wielding police during the countdown to the two-minute silence at 11am, the crowd increasingly felt like a hardcore football following at an away game.
Middlesbrough, Rangers and Nottingham Forest flags fluttered in the clear sky. Large numbers wore balaclavas and were clad entirely in black: the street wear of the ultra. Many were drinking heavily. Moments before the silence to remember those lost in conflict, a fug of cannabis smoke drifted above the crowd.
Broken briefly by a police helicopter, the silence itself concluded with polite applause and chants of “Ingerland, Ingerland.”
As promised, plenty of the far right had turned up. The Democratic Football Lads Alliance, a football hooligan network set up after the terror attacks of 2017, was among those present. So too was Tommy Robinson, founder of the anti-Muslim English Defence League, who had positioned himself in the middle of the throng, basking in the adulation of fresh-faced supporters who periodically chanted his first name.
Others, though, had gathered to pay their respects rather than “defend” the Cenotaph. Some even detected similarities between themselves and the pro-Palestinian demonstrators about to start their march two miles away.
Jake Taylor, 27, one of whose ancestors died near the Belgian city of Ypres in the first world war, said: “We’re both supporting the same thing. It’s ironic that the pro-Palestinian protesters are campaigning for a ceasefire, which is what Armistice Day is about.”
Later, as the gathering of about 2,000 left the Cenotaph, large groups were seen heading towards where the huge pro-Palestinian march was beginning to assemble, a 10-minute walk away.
For a few minutes, the observer accompanied one such group which – after blaming each other for losing Robinson somewhere near Trafalgar Square – set off briskly along Pall Mall.
“This’ll be tasty,” said one, clutching a union jack and Israeli flag as he began to jog. Moments later, a line of officers from the Met’s Territorial Support Group approached: the group quickly turned and bolted back the way they had come.
Across central London, a giant game of cat and mouse unfolded between police and counter-protesters as the latter attempted to reach the pro-Palestinian march. Groups of men could be seen hiding from officers in pubs; others clashed openly with the police. In Chinatown, a group began chanting “You’re not English any more” at officers.
Soon afterwards, a group of about 15 men was detained outside the Duke of York pub opposite Victoria station, close to the route of the pro-Palestinian march. Further down the Vauxhall Bridge Road, police on horseback stopped others leaving the White Swan as pro-Palestinian supporters filed past.
Another much larger group, numbering about 100, was also detained, this time near Westminster Bridge.
A more significant threat was detected shortly afterwards. At about 2:30pm, officers arrested 82 people in Tachbrook Street, Pimlico, to prevent them attacking their target in the parallel street: the hundreds of thousands calling for a ceasefire in Gaza.
As the pockets of “patriots” attempted in vain to reach the latest pro-Palestinian march, it was quickly evident that London was witnessing one of Britain’s biggest days of mass protest.
A vast crowd – 150 times the size of the gathering several hours earlier near the Cenotaph – was making its way south from Hyde Park towards the Thames, thousands of red and green Palestinian flags glowing in the sun.
Perhaps it was the weather, but the atmosphere felt more ebullient than previous marches, with huge numbers of families and children.

While even I can't somehow hate on the actual policy of throwing out cannabis convictions and deciding to reevaluate the notion that cannabis should be treated like heroin under federal law, please keep in mind that it would otherwise be all but impossible for Biden to try to get Griner back (which he's definitely personally racist and homophobic if he doesn't do, or at least Putin must he aware he will face that criticism from progressives if he isn't seen to be making enough attempts to get her back) when Putin imprisoned her for breaking the law in his country the exact same way the US has allowed and encouraged states to lock people up for cannabis use for decades. Biden is now saying he won't even attempt to discuss anything with Putin, such as finding an off ramp for the war (a black hole of a meat grinder into which he's already thrown astounding sums of taxpayer dollars and into which he is perfectly happy to throw however many fighting age bodies Ukraine can scrounge up) until Griner's release, which is obviously of equal or greater importance, is discussed. And if you think THAT is cynical wait until you realize Joe Biden and also anyone with eyes knew from the outset that there was no chance Russia would actually be meaningfully defeated by Ukraine and that neither that truth nor the sheer scale of the loss of life has moved him to even look like he's searching for an off ramp. And if you think THAT is cynical wait until you realize NATO is not actually a defensive alliance.

Le club a des chapitres en Ecosse, Angleterre, Belgique et Espagne. Les Blue Angels ont été liés à crime organisé, et ont été désignés gangs de motards criminels par le Police fédérale de Belgique. Les Blue Angels ont commencé à s'associer avec des clubs de motards en Angleterre dans les années 1970, formant une alliance avec le Road Rats MC de Londres, et rivalisant avec les Anglais Hells Angels. L'Ecosse reste l'un des rares pays d'Europe sans chapitre Hells Angels. Les membres potentiels des Blue Angels doivent être nommés par deux membres du club et peuvent être élus dans le club par d'autres membres après avoir purgé une période de temps en tant que « prospect ». C'est son fils également, Rob, qui a pris la relève de son père. Ce meurtre a eu lieu juste après un différent avec un réseau de narcotrafiquants qui cherche à s'implanter à York.

Blatantly Partisan Party Reviews (Victoria 2022): My Cheat Sheet to the Parties
There are plenty of parties contesting this year’s Victorian state election—indeed, the number of candidates is a state record. Interestingly, this has been achieved despite the fact that about a third of the parties who contested the 2018 election are no longer registered. Ballots will feature a bumper crop of cookers and other assorted micro-parties.
Here is my cheat sheet to summarise the recommendations in my reviews. I write from a left-wing perspective sympathetic to democratic socialism and green politics, and readers of this blog will have noticed that at the end of each entry I give a loose recommendation of what sort of preference I would give to that party. Here are almost all* of this election's parties categorised according to how good a preference I think they deserve. If you have even halfway similar political perspectives to me, I hope this might be useful.
*I do not review Labor, Liberal/National, Greens, or One Nation, on the principle that most people reading this blog have already formed views on those parties.
Before I begin, please remember to vote below the line for the Legislative Council (the larger ballot). If you vote above the line, your vote will be sent on a strange and discomfiting journey through the list of preferences registered by the party for which you vote 1. These preferences are typically determined by backroom deals and never reflect how voters would vote if they had control over preferences.
If you put any numbers other than 1 above the line, they will be ignored. THIS IS OPPOSITE TO THE SENATE SYSTEM: at the federal election in May, you could give preferences above the line and they were respected, but for state elections Victoria uses anti-democratic Group Ticket Voting (the only state to still use this loathsome system) and any preferences you mark beyond 1 will be ignored. The only way to ensure your preferences go exactly where you want them to go is to vote below the line. To cast a valid vote below the line, you must distribute at least 5 preferences, numbering 1–5. You can number as far as you want—and the more you number, the stronger your vote will be.
So, here is how I would categorise the parties. The links below lead to my reviews of each party.
Good preference: a party with a positive overall platform that has few or no significant flaws for the left-wing voter.

Fusion: Science, Pirate, Secular, Climate Emergency (centre-left pragmatist; unregistered party endorsing three independents)

Decent preference: a single-issue party with a good objective but by definition too limited in their scope to encompass the fullness of parliamentary business.

Animal Justice Party (animal rights)
Transport Matters Party (centre-left taxi industry front)
Weak to middling preference: problematic, but not as bad as what is below

New Democrats (centre-right)
Weak or no preference: a party with more negatives than positives. In the Legislative Assembly, you must number all squares, and these parties should receive as bad a preference as possible. In the Legislative Council, you should vote below the line and either give this party a poor preference or let your vote exhaust before reaching it. I recommend preferencing fully to maximise the power of your vote, but you may wish to stop rather than express preferences between varying gradations of undesirability.

Ten years ago, Washington and Colorado became the first states to legalize marijuana for adult use when voters approved ballot measures in 2012. Since then, a total of 19 states and the District of Columbia have legalized recreational marijuana. And while federal marijuana legalization is seemingly stopped in its tracks, another five states are poised to change cannabis policy in the midterm elections, potentially making adult-use marijuana legal for more than half of the nation.
According to an April 2021 Pew Research Center survey, 91% of US adults favor some form of marijuana legalization. 43% of US adults currently live in a jurisdiction that has legalized marijuana for adults over 21; sales of adult-use and medical marijuana products hit $25 billion in 2021 and, by one Wall Street estimate, could reach $100 billion by 2030. And last month, President Joe Biden announced that he’s taking steps to overhaul America’s federal cannabis laws, starting by pardoning everyone convicted of simple marijuana possession at the federal level.
Notably, four states with legal marijuana on the November 8 ballot are traditionally conservative: Arkansas, Missouri, North Dakota, and South Dakota voters will all consider measures legalizing cannabis, while Maryland voters are widely expected to approve legalization.
“Four of the five states voting have two Republican senators and either completely or majority Republican congressional delegations in the house,” says BOWL PAC founder Justin Strekal, a longtime cannabis lobbyist in Washington, DC, and the former political director for the National Organization for the Reform of Marijuana Laws (NORML). “Voters deciding on adult use could significantly change the calculus for their federal representatives as to how to approach cannabis at the national level.”
Here’s a quick overview of the measures that voters will decide on at the ballot box.
ARKANSAS: ISSUE 4
Arkansas voters approved medical marijuana in 2016. Now they’ll consider legalizing cannabis for adult use with Issue 4, which would modify the state’s existing medical program.
The Responsible Growth Arkansas campaign turned in over 192,000 signatures in July to qualify for the November ballot. Following an attempt by the state Board of Elections to deny certification to the measure by declaring its wording insufficient, the campaign filed a lawsuit with the Arkansas Supreme Court in August. After weeks of uncertainty, the court ruled in favor of Responsible Growth Arkansas on September 22, clearing the way for the vote.
A September survey by Talk Business and Politics at Hendrix College found that 58.5% of Arkansas voters are in favor of the ballot measure, with 29% opposed and 13% undecided. However, an alliance of progressive cannabis advocates, religious leaders, and pro-Trump politicians — including Republican Arkansas Sen. Tom Cotton — is staunchly opposed to legalization. Pro-cannabis critics claim that the measure, which is largely funded by the medical cannabis industry, would allow existing medical marijuana businesses to dominate the adult-use market, and reward industry backers of the measure by limiting new competitors.
The proposed law would allow adults 21 and over to purchase and possess up to one ounce of cannabis from licensed retailers. It would also repeal residency requirements to qualify for the state’s medical marijuana program. Home cultivation would not be permitted.
The Arkansas Alcoholic Beverage Control Division would oversee regulation of the program and issuing licenses; the state’s existing 40 medical cannabis dispensaries would be permitted to serve adult consumers starting on March 8, 2023. Each would also be allowed to open another retail location for recreational marijuana sales, and 40 more adult-use retailers would be awarded new licenses through a lottery system.
Criminal background checks would no longer be required for people who own less than 5% of a cannabis business, but there are no social justice provisions attached related to expungement or social equity.
The amendment would repeal taxes on medical marijuana while allowing the state to charge a 10% sales tax on non-medical sales at dispensaries. 30% of tax revenues would be divided between law enforcement, university research, and state drug court programs, with the remainder going to the state general fund.
A recent analysis shows Arkansas could see nearly $1 billion in annual sales and more than $460 million in tax revenue over five years if voters approve cannabis legalization.
MARYLAND: QUESTION 4
Earlier this year, Maryland legislators voted to put a marijuana legalization referendum on the November ballot. Question 4 asks: “Do you favor the legalization of the use of cannabis by an individual who is at least 21 years of age on or after July 1, 2023, in the State of Maryland?”
A yes on Question 4 would make recreational cannabis legal in Maryland, where medical marijuana has been legal since 2013, by amending the state constitution. The legislation would make the purchase and possession of up to 1.5 ounces of cannabis legal for adults 21 and older, and would remove criminal penalties for possession of up to 2.5 ounces. In addition, adults would be allowed to grow up to two plants for personal use and gift cannabis legally.
Past convictions for conduct made legal under the proposed law would be expunged, and people currently serving time for cannabis offenses would be eligible for resentencing, while those with convictions for possession with intent to distribute would be able to petition to have their records expunged three years after serving their time.
Prospects for the referendum passing look good, with a recent Washington Post and University of Maryland poll showing that 73% of registered voters support legalization. If the amendment passes, Maryland will join neighboring Washington, DC, as a legal adult-use jurisdiction; cannabis possession and home growing have been legal for adult DC residents since 2015, although Congress has blocked retail sales.
MISSOURI: AMENDMENT 3
Missouri passed legislation decriminalizing cannabis for personal use in 2014, and voters approved a medical marijuana program four years later. Now full legalization is on the ballot in Missouri with Amendment 3 — but after little public resistance for months, the proposal faces criticism from several factions as a coalition of officials and organizations have banded together to urge voters to reject the initiative.
The group Legal Missouri 2022, which is behind the proposed constitutional amendment, says it was written to provide a “level playing field” for the industry while promoting social equity, Marijuana Moment reported. The initiative is endorsed by advocacy organizations including the ACLU of Missouri and all six chapters of Missouri NORML.
Opposition to the measure includes false claims from a conservative PAC that it’s an attempt to insert critical race theory into the constitution by creating a position of “chief equity officer,” and the Missouri Democratic Party alleging that it “may negatively impact minorities, people of color and low-income earning Missourians.”
Amendment 3 would make it legal for adults 21 and older to purchase and possess up to three ounces of non-medical cannabis. It would also allow registered home cultivation. Existing medical dispensaries would be licensed to serve adult consumers with a dual license.
Tax revenue from recreational cannabis sales would be used to expunge the records of people convicted of nonviolent cannabis offenses; it would also subsidize veterans’ health care, drug treatment, and state public defender programs.
Regulation would be overseen by the Department of Health and Senior Services, with microbusiness licenses issued through a lottery system. Priority for those licenses would be given to low-income applicants and people disproportionately harmed by the war on drugs.
NORTH DAKOTA: MEASURE 2
A marijuana legalization measure in North Dakota would allow adults 21 and older to purchase and possess up to one ounce of cannabis and four grams of cannabis concentrate, as well as cultivate up to three plants for personal use, as long as the product from those plants is stored in the same location.
A coalition called New Approach ND collected signatures for Measure 2, which would require the state to create a regulatory program by October 1, 2023. The agency would also oversee cannabis business licensing for a maximum of seven cultivation facilities and 18 retailers. The initiative stipulates that no individual or entity would be permitted to own more than one cultivation facility or four retail locations to mitigate the risk of large companies monopolizing the cannabis market.
Measure 2 would put child custody protections into place for parents who use cannabis in compliance with state law, meaning they would not lose parental rights due to cannabis consumption. It would not provide a pathway to record expungements for marijuana convictions.
The state’s 5% sales tax would apply to cannabis products; no additional tax would specifically be imposed. Manufacturers would pay a $110,000 registration fee every two years, while retailers would pay $90,000; those funds would support the implementation and administration of the adult-use program.
Polling data on cannabis reform is scarce in North Dakota, but a 2018 survey found that 51% of residents backed legalization.
SOUTH DAKOTA: MEASURE 27
South Dakota voters approved cannabis legalization for adult use in 2020; however, the state Supreme Court invalidated the initiative. This year, voters have another opportunity to weigh in on legalization, but a recent poll shows that public opinion may have shifted on the issue, with a majority of respondents now opposed to cannabis reform.
In 2020, 54% of South Dakotan voters approved legalizing cannabis. However, following a legal challenge led by Republican Gov. Kristi Noem, the state Supreme Court invalidated the vote on procedural grounds, upholding a ruling that found the ballot measure violated the state’s single-subject rule for constitutional amendments, meaning it was not narrowly focused enough to meet the electoral standard.
This time, the initiative has omitted provisions around taxes and regulations; those decisions would be up to the legislature. The advocacy group South Dakotans for Better Marijuana Laws turned in more than 20,000 signatures to qualify Measure 27 for the November ballot.
If approved by voters, Measure 27 would allow adults 21 and older to purchase and possess up to an ounce of cannabis, as well as grow up to three plants for personal use. It doesn’t touch on regulatory policies concerning taxing cannabis sales, licensing, or social equity.
The measure includes civil penalties for violating provisions related to public consumption or growing more plants than permitted. Employers would be allowed to prohibit cannabis use by workers, and state and local governments could continue to ban marijuana-related activities made legal under the initiative.
All in all, it’s impossible to forecast what voters will decide this week, but the conversation about legalizing marijuana has come a long way in 10 years. “It’s remarkable,” says Strekal, the cannabis lobbyist. “Should two or more of the states that have it on the ballot pass, then we will have more than 50% of Americans living in a state that has legalized adult-use cannabis.”

I’m an enthusiastic cannabis supporter, writing in the *hope* that a few people will read this, but it’s mostly for my own therapy; writing relaxes me and makes me use my brain. If you’ve accidentally stumbled on this blog, I’m not a flake, and this is good advice for cannabis users.
Cannabis gets you high, fixes any number of aches and pains, and a lot more, through your endocannabinoid system (ECS). It's also the most improperly used and abused drug in America.

Most people think cannabis is like ibuprofen, or liquor; if two pills or two drinks work, three will help their pain go away faster, or get them higher.
Well, it does at first.
Your ECS is different over the long haul because just the right amount will get you the best buzz or the best treatment for your ailment. Sure, the first couple of times you overdose, you might get a mind-bending high, but excessive use just spirals into abuse in a matter of days because your ECS rejects chronic overdoses and becomes dysfunctional.
This is the most important fact to realize: your ECS is made to respond to your body’s own chemicals. Even though THC and cannabis’ other active ingredients use your ECS therapeutically, THC is many, many times more powerful than the natural components it replaces.
Your goal is to push your ECS to its peak performance level for your purposes (getting high, killing pain) the way you want it (alert, sedated, energetic, relaxed, etc.) without triggering an overdose reaction.
When your ECS gets overdosed, it rejects more and more THC, so you must use it more and more, and the high gets shorter and shorter.
This cycle quickly spirals out of control, especially in people with addictive tendencies. You can't become physically dependent with cannabis, but you can get psychologically addicted, much like coffee, where you crave it habitually, like mornings just aren't the same without it. Symptoms of withdrawal include mild anxiety and bitchiness.
More importantly, all that is unnecessary, and you get your best high by not crossing that overdose threshold.

With over 450 different active ingredients, cannabis, unlike liquor or ibuprofen, is too complex to know everything about it.
