Shell has won its appeal against a landmark climate judgment by a Dutch court, which in 2021 ordered the fossil fuel company to sharply reduce its greenhouse gas emissions. A court of appeal ruled on Tuesday that, while Shell does have a “special responsibility” to cut its emissions as a big oil company, this would not be achieved by imposing a specific legal goal. Shell had appealed against a lower court ruling in 2021 that it must cut its global carbon emissions by 45% by the end of 2030 compared with 2019 levels. It was the first such ruling against a company in the world. Shell’s chief executive, Wael Sawan, welcomed the appeal decision, saying it was “the right one for the global energy transition, the Netherlands and our company”. The case was brought by Milieudefensie, the Dutch arm of Friends of the Earth, and more than 17,000 co-plaintiffs. “This hurts,” said the director of Milieudefensie, Donald Pols. “At the same time, we see that this case has ensured that major polluters are not immune and has further fuelled the debate about their responsibility in combating dangerous climate change. That is why we will continue to tackle major polluters, such as Shell.” Shell was originally told it must slash emissions within its own operations, as well as those of its suppliers and buyers, in line with the Paris climate agreement. During its appeal, Shell argued in court that corporate emissions were a matter for politicians, not the judiciary, and that any fossil fuels it chose not to extract would simply be exploited by another company.

How very convenient; there hasn't been a government in decades which would impose such emissions cuts as those imposed by the lower court. With the PVV coalition government that's doubly unlikely.

Freed Palestinian prisoner diagnosed with cancer says ‘happy’ to be home
“Nehaya Khader Sawan is among the first batch of Palestinian prisoners who were released a short while ago from Ofer Prison.
A cancer patient, Sawan told Al Jazeera that while she was “exhausted”, she was happy to be home.
Her niece said Sawan was unable to continue speaking and needed to rest; she said her aunt was disoriented all day as she had “no idea where she was going” to be released, or when.
“She cannot speak [like she used to]. She is a cancer patient and in detention, her condition deteriorated,” her niece told Al Jazeera.
Sawan was diagnosed years before her arrest, her niece added. She was sentenced to 44 months in prison in August 2021.
“When we saw her we were happy, but we were also pained to see her [deteriorating] health condition,” her niece said. “We quickly realised that my aunt who went to prison, is not the same person who came out.””

Shell's $1 Billion Pause on Green Fuel Factory
A giant green gas plant being built in Rotterdam by Shell has been paused at the expense of the affected company to the tune of a billion dollars. It was to help airlines cut carbon emissions. With rising costs and occasional fees, Shell halted the undertaking, disappointing airways that wished for more sustainable fuels. The Anglo-Dutch firm has brought to a halt the construction of a ginormous green gas factory in Europe, that has resulted in a loss of $1 billion. The Rotterdam factory was supposed to fill the diesel tanks of European airways and truckers with planet-friendly fuel. Barely weeks after stopping the development, shell came out saying it had done so on a Friday morning. The move is a significant blow to the dreams of airlines to deliver low-carbon flights. Shell cited increased costs and weak pricing as the reason for canceling the plan. The manufacturing plant was supposed to supply 820,000 tons per year of biofuels. Half of that was to be renewable jet fuel, nevertheless, which is produced from waste vegetable oils and animal fats.Airlines have all held out for sustainable jet fuel as a central component of their strategy to market flights as "low carbon." It is all a part of its effort to reduce business impacts on the environment. Shell was seen as a crucial SAF supplier because of exposing its Dutch branch to launching the biofuel project in 2021. The production facility was expected to commence in 2025. A claim not isolated in itself, the move by Shell is the latest in a line of blows to low-carbon projects by major energy companies. BP announced today that it would not invest in any new offshore wind projects. Its new boss, Murray Auchincloss, decided to shift towards fossil fuels. He also brought a halt to biofuel projects in Germany and the US.Apart from suspending the green gas manufacturing unit, it recently announced a write-down of between $600 million and $800 million associated with the sale of the refining and chemicals hub in Singapore. Since Wael Sawan was appointed top govt of Shell in January 2023, he has been refocusing business enterprise strategy on oil and fuel in search of returns. The updated approach differs from an earlier policy at Shell, where management had committed to reducing oil production each year until 2030. According to Wael Sawan, new assets brought on stream in the last year would add over 200,000 barrels of oil equivalent to peak production. These projects are part of a broader program due to come onstream with the aid of 2025. At their peak all projects combined will add more than half of 1,000,000 barrels of oil equivalent per day to Shell's production. On the whole, Shell stopping the Rotterdam green gasoline project and refocusing its priorities back to conventional oil and fuel depicts a gigantic struggle for the future of low-carbon aviation fuel. The move shook the company not only in financial terms but also in terms of the expectations of carriers and environmentalists looking toward a greener aviation sector. Read the full article

3 Years Since Beirut Blast, No One Held Accountable As Probe Suspended
On August 4, 2020, the massive blast at Beirut's port destroyed swathes of the Lebanese capital, killing more than 220 people and injuring at least 6,500.
Beirut: Lebanon on Friday marks three years since one of history’s biggest non-nuclear explosions rocked Beirut. Yet nobody has been held to account as political and legal pressures suspend the investigation.
On August 4, 2020, the massive blast at Beirut’s port destroyed swathes of the Lebanese capital, killing more than 220 people and injuring at least 6,500.
Authorities said the disaster was triggered by a fire in a warehouse where a vast stockpile of industrial chemical ammonium nitrate had been haphazardly stored for years.
Three years on, the probe is virtually at a standstill, leaving survivors still yearning for answers.
The main activist group representing families of those killed has called for a protest march on Friday afternoon, converging on the port.
“This is a day of commemoration, mourning and protest against the Lebanese state that politicises our cause and interferes in the judiciary,” said Rima al-Zahed, whose brother was killed in the explosion.
“The judiciary is shackled, justice is out of reach, and the truth is shrouded,” she told AFP.
The blast struck amid an economic collapse that the World Bank has dubbed one of the worst in recent history and which is widely blamed on a governing elite accused of corruption and mismanagement.
Since its early days, the probe into the explosion has faced a slew of political and legal challenges.
In December 2020, lead investigator Fadi Sawan charged former prime minister Hassan Diab and three ex-ministers with negligence.
But as political pressure mounted, Sawan was removed from the case.
- ‘Culture of impunity’ -
His successor, Tarek Bitar, unsuccessfully asked lawmakers to lift parliamentary immunity for MPs who were formerly ministers.
The powerful Iran-backed Hezbollah group has launched a campaign against Bitar, accusing him of bias and demanding his dismissal.
The interior ministry has refused to execute arrest warrants which the lead investigator has issued.
In December 2021, Bitar suspended his probe after a barrage of lawsuits, mainly from politicians he had summoned on charges of negligence.
But in a surprise move this January, Bitar resumed investigations after a 13-month hiatus, charging eight new suspects including high-level security officials and Lebanon’s top prosecutor, Ghassan Oueidat.
Oueidat then charged Bitar with insubordination and “usurping power”, and ordered the release of all those detained over the blast.
Bitar has refused to step aside, yet has not set foot inside Beirut’s justice palace for months.
“Work (on the investigation) is ongoing,” said a legal expert with knowledge of the case, requesting anonymity due to the sensitivity of the matter.
Bitar is determined to keep his promise to deliver justice for victims’ families, the expert added.
Zahed, whose brother died in the blast, said: “The truth does not die so long as there is someone to demand it.
“We believe that we will get the truth.”
On Thursday, 300 individuals and organisations including Human Rights Watch (HRW) and Amnesty International renewed a call for the United Nations to establish a fact-finding mission, a demand local officials have repeatedly rejected.
“International action is needed to break the culture of impunity in Lebanon,” HRW’s Ramzi Kaiss said in a statement.
Amnesty’s Aya Majzoub accused authorities of using “every tool at their disposal to shamelessly undermine and obstruct the domestic investigation to shield themselves from accountability”.

Still no answers three years after Beirut mega-explosion
Three years on, the probe into the traumatic disaster caused by a huge pile of poorly-stored fertiliser remains bogged down in legal and political wrangling, to the dismay of victims' families.
BEIRUT: One of history's biggest non-nuclear explosions rocked Beirut on August 4, 2020, destroying swathes of the Lebanese capital, killing more than 220 people and injuring at least 6,500.
Three years on, the probe into the traumatic disaster caused by a huge pile of poorly-stored fertiliser remains bogged down in legal and political wrangling, to the dismay of victims' families.
The mega-blast
The massive explosion, heard as far away as Cyprus, destroys much of Beirut port and entire districts of the city in scenes that shock the country and the world.
The blast leaves a 43-metre (141 foot) deep crater and registers as the equivalent of a magnitude 3.3 earthquake.
The disaster spreads fear and chaos, with mountains of broken glass littering roads and bloodied survivors flooding overwhelmed hospitals.
The blast was caused by a fire in a warehouse where a vast stockpile of the industrial chemical ammonium nitrate had been haphazardly stored for years.
The tragedy strikes amid a deep economic crisis, almost a year after mass demonstrations erupted against a ruling class deemed inept and corrupt as living conditions worsen.
On August 10, Prime Minister Hassan Diab resigns under a barrage of pressure over the explosion.
Probe thwarted
In December 2020, the lead investigator examining the blast, Fadi Sawan, charges Diab and three ex-ministers with negligence.
Two of them file a complaint, the probe is suspended, and Sawan is removed from his post by court order.
In July 2021, the new investigating magistrate, Tarek Bitar, moves to interrogate four former ministers but parliament stalls on lifting their immunity.
He is forced to suspend the probe following a series of court challenges.
Gun battle
In October 2021, the powerful Shiite movement Hezbollah and its ally Amal call for demonstrations to demand Bitar's dismissal.
Seven people are killed in gun battles during the rally.
At the end of 2021, Bitar resumes his investigation but less than two weeks later is forced to suspend work for a fourth time following more legal challenges.
Silos collapse
On August 4, 2022, several grain silos damaged in the explosion collapse in a cloud of dust, a traumatic reminder of the disaster that struck exactly two years before.
Days earlier, other parts of the silos crumbled after a fire broke out when remaining grain stocks fermented and ignited in the summer heat.
Judicial showdown
In January 2023, 13 months after his probe is suspended, Bitar resumes work and charges Prosecutor General Ghassan Oueidat and seven others with probable intent to murder, arson and other crimes.
Oueidat in turn charges Bitar with insubordination and "usurping power" but the investigator refuses to step down.
Oueidat also orders the release "of all those detained" over the port blast, leaving the investigation stalled and nobody yet held to account.
Victims' families and rights groups urge the United Nations to create an independent fact-finding mission.

Shell Pauses Dutch Biofuels Project Due to Market Decline
Shell to Pause Dutch Biofuels Project Due to Market Conditions Shell will halt construction on one of Europe’s largest biofuel plants because of weak market conditions, marking another setback for low-carbon projects as CEO Wael Sawan aims to increase returns. This follows BP's recent announcement of pausing two biofuel projects in Germany and the U.S. Since Sawan took office in January 2023, Shell has shifted its focus to more profitable operations in oil and gas by canceling and selling renewable and hydrogen projects, withdrawing from European and Chinese power markets, and divesting refineries. As a result, Shell's shares rose by 1.3% and have increased by over 12.5% this year. Initially approved in September 2021, the 820,000-ton-a-year plant in the Netherlands was scheduled to start production in 2025, but now it is expected to be operational towards the end of the decade. Located at Shell's chemicals park in Rotterdam, the facility was set to produce sustainable aviation fuel and renewable diesel from waste. Biofuel prices have recently dropped due to lower demand in Europe and increased supplies in the U.S. Analysts predict the market will remain well-supplied as more production facilities come online. In light of this, Shell stated that the decision to pause construction will reduce contractor numbers on-site and slow down activity to control costs and optimize project sequencing. UBS analyst Joshua Stone noted that the pause aligns with Shell's strategy to prioritize returns, highlighting the challenges in the advanced biofuels market. Shell will assess the project's commercial viability and may consider an impairment, with further details expected in its quarterly trading update. Huibert Vigeveno, Shell's downstream head, emphasized the company's commitment to achieving net-zero emissions by 2050, with low-carbon fuels being a crucial part of their strategy.
