On Monday, 26-year-old Daniel Penny was acquitted after killing Jordan Neely, a desperate Black homeless man on the subway, on the grounds that he was trying to protect others. On the same day, police detained 26-year-old Luigi Mangione, who is suspected of killing the CEO of a company that has denied thousands of life-saving healthcare claims.
Penny walks free after killing a man victim to the system. What will be the verdict for Mangione, who is suspected of killing a man symbolic of it?
As many have remarked, Brian Thompson’s tenure as CEO of insurance giant UnitedHealthcare was grisly. Thompson (alongside other higher-ups) allegedly conducted insider trading, selling millions of dollars of stock upon learning that the Department of Justice re-opened an antitrust investigation into UnitedHealth. While the company was on an upward profit swing, it has been awash in allegations and revelations of limiting mental health care coverage via algorithm, denying healthcare services needed after hospitalization at drastic rates via artificial intelligence, and denying insurance claims at a starkly high rate.
A gun killed Thompson. Paperwork has killed thousands.

Each case, obviously, is its own. But in each, contradictions of who is human, questions of who merits sympathy, and inquiries of what sort of society we tolerate, ring loud and clear.

I signed a petition for the justice of Jordan Neely, he was choked to death in New York and he is becoming more prevalent in the news. I’m tired of looking up at checking the news and seeing people but my people for than anything being brutalized and it’s sickening.

🗣️Black people making white people uncomfortable or annoyed or angry, is not a “crime” that is punishable by death.
Daniel Penny held Jordan Neely in a choke hold for at least six minutes, long after Neely had stopped moving. Daniel Penny murdered an unarmed, homeless, mentally troubled Black man who did not hurt anyone on that train. And now racists are either gleefully dubbing Penny a “hero,” or shrugging their shoulders because they aren’t sure that a white man murdering a Black man actually qualifies as murder.
I’ve seen a lot of people conducting the same old tired (but unavoidably necessary!) thought experiment you always see after these kinds of jury rulings: “What do you think would have happened if Kyle Rittenhouse was Black and gunned down two people?” or, “What do you think would have happened if George Floyd was white and a Black cop choked him to death?” “What if Trayvon Martin was white, would George Zimmerman have stalked and murdered him?” These are rhetorical questions. We all know the answers.
And I’m reminded, yet again, of the words of James Baldwin:
“When the Israelis pick up guns, or the Poles, or the Irish, or any white man in the world says, ‘Give me liberty or give me death,’ the entire white world applauds. When a Black man says exactly the same thing, word for word, he is judged a criminal and treated like one and everything possible is done to make an example of this bad nigger so there won’t be any more like him.”
America, in case it wasn’t glaringly obvious, is most definitely a racist country. Anyone who says otherwise is lying to you.
